Resolution No. 25-149
Resolution to stagger the terms of the Housing and Community
Development Commission.
Whereas, Resolution No. 25-131 amended the by-laws of the Housing and Community
Development Commission (HCDC) to decrease the commission from nine members to seven
members; and
Whereas, the term of each member is three years which was not amended by Resolution No.
25-131; and
Whereas, under a nine -member commission, the terms were staggered such that three terms
expired every year; and
Whereas, with a seven -member commission, there was a consensus among HCDC members at
the April 21, 2025, meeting to stagger the terms such that the terms of three members will
expire in 2028, two in 2029, and two in 2030; and
Whereas, Resolution No. 25-131 provides Council will stagger the terms by resolution.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa that:
1. In order to ensure a staggered turnover in transitioning from a nine -member
commission, three terms will end one year, two terms in a second year, and two terms in a third
year.
2. Given existing vacancies and previous appointments, the initial appointments will be
as follows.
For the term 7/1/25 to 6/30/28 (3 members):
Because Council previously appointed Commissioner Kiche to serve for this
term, Council will appoint only two persons.
For the term 7/1/24 to 6/30/27 (2 members):
Currently there is one vacancy.
Because two members currently serve, Council will not appoint a person to
serve the unexpired term.
For the term 7/1 /23 to 6/30/26 (2 members)
0 Currently there are two vacancies.
6 Because one member currently serves, Council will appoint only one person
to serve the unexpired term.

Resolution amending the By -Laws of the Housing and Community
Development Commission and rescinding Resolution No. 22-214.
Whereas, the by-laws of the Housing and Community Development Commission (HCDC)
provide for a nine member commission; and
Whereas, occasionally HCDC has not been able to meet because there were only four
members present and a quorum is five members; and
Whereas, there currently are two vacancies on HCDC; and
Whereas, the average attendance through the last four years has been six members; and
Whereas, HCDC approved amendments to the by-laws at its meeting on April 21, 2025, to
decrease membership from nine to seven members; and
Whereas, the Council Rules Committee has reviewed the proposed amendments to the by-laws
and has recommended adoption; and
Whereas, the current by-laws were approved in Resolution No. 22-214.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa that:
1. The attached by-laws of the Housing and Community Development Commission are
approved and adopted by the City Council.
2. Resolution No. 22-214 is rescinded.

ARTICLE 1 THE COMMISSION
Section A. The name of the Commission is the Housing and Community Development Commission
of Iowa City, Iowa, as established by Resolution No. 95-199 of the City Council of Iowa City,
Iowa, pursuant to Chapter 403A, Code of Iowa (1995).
ARTICLE 2 PURPOSE
Section A. The purpose of the Commission is to assess Iowa City's community development needs
for housing, jobs, and services for low and moderate income residents, and to promote public and
private efforts to meet such needs.
ARTICLE 3 DUTIES
Section A. Duties of the Commission shall include: 1) assess and review policies and planning
documents related to the provision of housing, jobs, and services, for low and moderate income
residents of Iowa City; 2) review policies and programs of the Iowa City Housing Authority and
Community Development Division and make recommendations regarding the same to the City
Council; 3) review and make recommendations to the City Council regarding the use of public
funds to meet the needs of low and moderate income residents; 4) actively publicize community
development and housing policies and programs, and seek public participation in assessing needs
and identifying strategies to meet these needs; 5) recommend to the City Council from time to time
amendments, supplements, changes, and modifications to the Iowa City Housing Code.
ARTICLE 4 MEMBERSHIP
Section A. The Housing and Community Development Commission shall consist of seven (7)
members appointed by the City Council of Iowa City. All members shall be qualified electors of
the City of Iowa City, Iowa, and shall serve as such without compensation but shall be entitled to
the necessary expenses, including traveling expenses incurred in the discharge of their duties.
Section B. In order to satisfy the purpose and intent of this commission, when possible, at least one
person shall be appointed to the Housing and Community Development Commission with expertise
in construction, at least one person with expertise in finance, at least one person with nonprofit
management experience, and at least one person with property management experience. In
addition, when possible, the Commission shall include one person who receives rental assistance.
Appointments shall take into consideration persons of various racial, religious, cultural, social, and
economic groups in the city.
Section C. The term of office for each member shall be three (3) years except as set forth by Council
Resolution to ensure a staggered turnover when transitioning from nine (9) members to seven (7)
members in 2025.
Section D. The Chairperson and Vice -Chairperson will be elected annually (in July) from the
Commission membership. The Chairperson shall, when present, preside at all meetings, appoint
sub -committees with the approval of the Commission, call special meetings and in general perform
all duties included in the office of a Chairperson and such other duties as may be prescribed by the
members from time to time. The Vice -Chairperson shall take over the above duties of the
Chairperson in the event of the Chairperson's absence.
Section E. Three (3) consecutive, unexplained absences of a member from regular meetings will
result in a recommendation to the City Council from the Commission to discharge said member
and appoint a new member.
Section F. If a position becomes vacant by reason of resignation or otherwise and results in an
unexpired term the Council may choose to fill the unexpired term in such a manner that the
appointee shall continue in the position not only through the unexpired term but also through a
subsequent regular term.
ARTICLE 5 MEETINGS
Section A. Meetings of this Commission shall be on a regular monthly basis. A meeting date and
time will be established by the Commission. A regular meeting may be cancelled if no urgent
business requires a meeting.
Section B. Special meetings of the Commission may be called by the Chairperson and shall be
called by the Chairperson at the request of a majority of the membership.
Section C. Meetings shall be held in an accessible, public meeting place. Notices of meetings
(agenda) for all regular and special meetings shall be posted and distributed to members and the
media at least 24 hours before any meeting is held. All provisions of the State Open Meetings Law
shall be followed. The Chairperson or a designated representative, together with appropriate
members of the City staff shall prepare an agenda for all meetings. Agendas shall be mailed or
emailed to Commission members at least three (3) days prior to the regular meetings.
Section D. A majority of the members of the Commission (four or more) shall constitute a quorum
of any meeting and the majority of votes cast at any meeting, at which a quorum is present, shall
be decisive of any motion or election.
Section E. There shall be no vote by proxy.
Section F. Time shall be made available during all regular meetings for open public discussion.
Section G. Minutes of all meetings shall be prepared and distributed to the City Council within
three (3) weeks of the meeting in the manner prescribed by the Council. Minutes of all regular and
special meetings will be mailed or emailed to all the Commission members during the week prior
to the next meeting. Specific recommendations for the Council shall be set off from the main body
of the minutes.
ARTICLE 6 AMENDMENTS
Section A. The By -Laws of the Commission shall be amended only with the approval of at least a
majority of the Commission (at least four votes) at a regular meeting or a special meeting.
Section B. Policy changes or By -Law changes may be adopted at the meeting following the
meeting at which open discussion was conducted on the specific changes.

Resolution adopting the by-laws of the Housing and Community
Development Commission and rescinding Resolution No. 17-94.
Whereas, the by-laws of the Housing and Community Development Commission (HCDC)
provide membership should include at least one person with expertise in construction and one
in finance; and
Whereas, HCDC would benefit from having at least one person with expertise in nonprofit
management and one person with expertise in property management; and
Whereas, additionally appointments to HCDC should take into consideration various racial,
cultural, social, and economic groups in the City; and
Whereas, HCDC approved amendments to the by-laws at its meeting on July 28, 2022, but they
are not effective until approved by the City Council; and
Whereas, the Council Rules Committee has reviewed the proposed amendments to the by-laws
and has recommended adoption; and
Whereas, the current by-laws were approved in Resolution No. 17-94.
Now, therefore, be it resolved by the City Council of the City of Iowa City, Iowa that:
1. The attached by-laws of the Housing and Community Development Commission are
approved and adopted by the City Council.
2. Resolution No. 17-94 is rescinded.

Just an FYI of some cleaning up we're doing on the Board/Commission terms. Several of the commissions
have a start and end date that are the same, after talking to Eleanor we got the go ahead to adjust the ending
dates by one day.

RESOLUTION NO. 17-94
RESOLUTION ADOPTING AMENDED BY-LAWS OF HOUSING AND COMMUNITY
DEVELOPMENT COMMISSION AND RESCINDING RESOLUTION NO. 06-348
WHEREAS, the City Council of Iowa City now appoints members to the Housing and
Community Development Commission (HCDC) annually in June rather than August; and
WHEREAS, the current HCDC By -Laws approved in Resolution No. 06-348 specify
commission members elect a chair and vice chair after new members are appointed to the
commission; and
WHEREAS, on January 19, 2017, the HCDC discussed amending Article 4 Membership,
Section D of said By -Laws to specify the commission will elect a chair and vice chair in
July instead of September; and
WHEREAS, the HCDC recommended unanimously in favor of amending said By -Laws on
February 16, 2017; and
WHEREAS, the Rules Committee approved of the attached amended By -Laws;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
IOWA CITY, IOWA, THAT:
The attached Housing and Community Development Commission By -Laws are
approved.

RESOLUTION APPROVING BY-LAWS OF THE HOUSING AND COMMUNITY
DEVELOPMENT COMMISSION.
WHEREAS, the Housing and Community Development Commission revised and unanimously
adopted by-laws at its meeting on August 15, 2006; and
WHEREAS, the Council Rules Committee has reviewed the proposed by-laws and has
recommended adoption; and
WHEREAS, it is in the public interest to adopt by-laws that set forth the duties, officers, members
and meeting schedule of the Housing and Community Development Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that the by-laws of the Housing and Community Development Commission, which are
attached and incorporated by reference herein, are approved and adopted by the City Council.

meeting and the majority of votes cast at any meeting, at which a quorum is present, shall be decisive of any
motion or election.
Section E. There shall be no vote by proxy.
Section F. Time shall be made available during all regular meetings for open public discussion.
Section G. Minutes of all meetings shall be prepared and distributed to the City Council within three (3)
weeks of the meeting in the manner prescribed by the Council. Minutes of all regular and special meetings
will be mailed to all the Commission members during the week prior to the next meeting. Specific
recommendations for the Council shall be set off from the main body of the minutes.

RESOLUTION APPROVING THE BY-LAWS OF THE IOWA CITY HOUSING AND
COMMUNITY DEVELOPMENT COMMISSION.
WHEREAS, the City Council of the City of Iowa City, Iowa passed Resolution No. 95-199,
establishing a Housing and Community Development Commission for the City of Iowa City,
Iowa; and
WHEREAS, it is in the public interest to adopt by-laws which guide the procedures and actions
of the commission; and
WHEREAS, the proposed by-laws have been reviewed by the Council Rules Committee, and
are recommended for adoption.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,

ARTICLE 1 — THE COMMISSION
Section A. The name of the Commission is the Housing and Community Development
Commission of Iowa City, Iowa, as established by Resolution No. 95-199 of the City Council
of Iowa City, Iowa, pursuant to Chapter 403A, Code of Iowa (1995).
ARTICLE 2 — PURPOSE
Section A. The purpose of the Commission is to assess Iowa City's community development
needs for housing, jobs, and services for low and moderate income residents, and to promote
public and private efforts to meet such needs.
ARTICLE 3 — DUTIES
Section A. Duties of the Commission shall include: 1) assess and review policies and
planning documents related to the provision of housing, jobs, and services, for low and
moderate income residents of Iowa City; 2) review policies and programs of the Public
Housing Authority and Community Development Division and make recommendations
regarding the same to the City Council; 3) review and make recommendations to the City
Council regarding the use of public funds to meet the needs of low and moderate income
residents; 4) actively publicize community development and housing policies and programs,
and seek public participation in assessing needs and identifying strategies to meet these
needs; 5) recommend to the City Council from time to time amendments, supplements,
changes, and modifications to the Iowa City Housing Code.
ARTICLE 4 — MEMBERSHIP
Section A. The Housing and Community Development Commission shall consist of nine (9)
members appointed by the City Council of Iowa City. All members shall be qualified electors
of the City of Iowa City, Iowa, and shall serve as such without compensation but shall be
entitled to the necessary expenses, including traveling expenses incurred in the discharge of
their duties.
Section B. In order to satisfy the purpose and intent of this citizen commission as required
by the U.S. Department of Housing and Urban Development, when possible, at least one
person shall be appointed to the Housing and Community Development Commission with
expertise in construction and at least one person with expertise in finance. In addition, when
possible, the Commission shall include one person who is a member of the Local Homeless
Coordinating Board, and one person who receives rental assistance.
Section C. The term of office for each member shall be three (3) years. In order to ensure
a staggered turnover, initial appointments shall be three (3) members for each of one, two,
and three years respectively.
Section D. The Chairperson and Vice -Chairperson will be elected annually (in September) from
the Commission membership. The Chairperson shall, when present, preside at all meetings,
appoint sub -committees with the approval of the Commission, call special meetings and in
general perform all duties included in the office of a Chairperson and such other duties as may

be prescribed by the members from time to time. The Vice -Chairperson shall take over the
above duties of the Chairperson in the event of the Chairperson's absence.
Section E. Three (3) consecutive, unexplained absences of a member from regular meetings
will result in a recommendation to the City Council from the Commission to discharge said
member and appoint a new member.

WHEREAS, the City Council of the City of Iowa City has adopted a Consolidated Plan for
housing, jobs, and services for low and moderate income persons; and,
WHEREAS, the U.S. Department of Housing and Urban Development requires ongoing citizen
participation in matters relating to the Consolidated Plan whose goal is to help families and
individuals to achieve their highest level of self-sufficiency; and,
WHEREAS, it is in the public interest to combine the functions and duties of the Iowa City
Housing Commission and the Committee on Community Needs, and,
WHEREAS, said Commissions will be dissolved on August 31, 1995, and be replaced with the
Housing and Community Development Commission established herein effective September 1,
1995; and,
WHEREAS, the City Council of the City of Iowa City deems it in the public interest to establish
a Housing and Community Development Commission for the City of Iowa City, Iowa, to advise
the City Council on matters relating to housing and community development issues for low and
moderate income residents; and,
WHEREAS, the purpose of said Commission shall be to assess Iowa City's community
development needs for housing, jobs, and services for low and moderate income residents, and
to promote public and private efforts to meet such needs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that:
1. The Iowa City Housing and Community Development Commission is hereby established.
2. The Housing and Community Development Commission of the City of Iowa City shall have
purpose, duties, membership and terms defined in the By -Laws of said Commission.
3. The Iowa City Housing and Community Development Commission shall be established on
September 1, 1995.
4. Resolution No. 70-121, Resolution No. 76-136, and Resolution 1109 are hereby revoked,
repealed, and rescinded and set aside and held for naught as of August 31, 1995,

WHEREAS, the City Council of the City of Iowa City, Iowa, has
established itself as the Low Rent Housing Authority for the City of Iowa City,
Iowa, and
WHEREAS, the City Council of the City of Iowa City, Iowa, deems it
in the public interest that the City Council establish a Housing Commission for
the City of Iowa City, Iowa, to assist the City Council in the area of Low Pent
Housing, and
WHEREAS, the City Council of the City of Iowa City, Iowa, on the 4th
day of March, A.D. , 1969, pursuant- to Resolution No. 1109 enacted on said
date established a housing commission for the City of Iowa City, Iowa, and
the City Council deems it in the public interest that said Housing Commission
as established be modified.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF IOWA CITY, IOWA, as follows:
1) There is hereby established for the City of Iowa City, Iowa, a
Housing Commission.
2) The Housing Commission of the City of Iowa City, Iowa, shall
consist of seven (7) members or commissioners, and said members or
commissioners shall be appointed by the Mayor with the approval of the City
Council. All members of the Commission shall be qualified electors of the
City of Iowa City, Iowa, and shall serve as such members or commissioners
without compensation but shall be entitled to the necessary expenses, including
travel expenses, incurred in the discharge of their duties.

3) The term of office of each member or commissioner shall be
two (2) years, but of the seven (7) numbers first appointed, four (4) shall
be appointed for one (1) year terms and shall serve until May 1, 1971, and
three (3) shall be appointed for two (2) year terms and shall serve until May 1,
1972. Thereafter, all members shall be appointed for two (2) year terms.
Of the four (4) members appointed to serve until May .1, 1971, three (3) shall
be the members of the previous Housing Commission whose terms would have
expired on May 1, 1971, had the Council not amended Resolution No. .1109
and the Housing Commission established by said Resolution, if said members
accept said appointment.
4) The Mayor shall appoint a Chairman and a Vice -Chairman from
among the members of said Commission with the approval of the City Council,
who shall serve in such capacity for a period of One (1) year.
5) The Commission shall investigate, study, review, and analyze
the housing needs and the meeting of such needs within the City of Iowa City,
Iowa, and shall investigate and determine if any slum areas exist or other
areas where there is unsafe, unsanitary, or overcrowded housing conditions,
and shall study and investigate and maize recommendations relating to the problem
of clearing, replanning, and construction of slum areas and the problem of
providing dwelling accommodations for elderly persons or persons of low or
medium income.
6) The Commission shall report to the City Council from time to time
the results of the Commission's studies and investigations and the Commission's
recommendations.
7) The Commission shall adopt a set of By -Laws, Rules and Regulations
which they deem necessary and advisable for the conduct of the business of the
Commission, subject to the Ordinances of the City of Iowa City, Iowa.

8) The City Manager shall be the Administrative Officer of said
Commission and shall be in charge of the administration of said Commissions
and he shall have the power and authority to employ.at his discretion such
administrative personnel, both temporary and permanent, as may be necessary
and advisable to carry out and conduct the business of said Commission and
the housing programs in which the City is or may become. engaged.
9) The Commission shall be subject to the authority of the City
Council of the City of Iowa City, Iowa, and shall undertake such duties as
are delegated to the Commission by the City Council of the City of Iowa City,
Iowa, with all final authority over the administration, projects and the policing
of publicly assisted Housing Projects being retained and exercised by the City
Council of the City of Iowa City, Iowa.
10) Resolution No. 1109 is hereby revokedl, repealed, and rescinded
and set,aside and held for naught.
