(FIRST CONSIDERATION) Comment: The State of Iowa has passed legislation to allow cities to increase their parking fines. This ordinance raises expired meter and overtime tickets from $3.00 to $5.00 and all other parking violations, except handicapped, from $5.00 to $10.00. Monthly permit parking fees increase by $10.00 per month. This ordinance also modifies the parking ticket escalation to comply with the new State law. Although a public hearing is not required to implement such changes, an opportunity for public discussion on the proposed changes to the ordinance will be provided pursuant to the City Council agenda prior to the City Council consideration of the ordinance. Comment: This project will include replacing a fan in the Civic Center North Court Trane HVAC [Heating Ventilation Air Conditioning Unit. This project also involves modifying the ductwork system in order to reduce the static pressure, which will alleviate the noise and vibration problems in the upper floors and increase cooling efficiency on the first floor. Comment: On May 16, 2003, Frank Fleming, the applicant for a Certificate of Appropriateness for the application of vinyl siding to his duplex at 815-17 S. Summit Street, filed an appeal to the City Council of the Historic Preservation Commission's denial of the Certificate. Prior to the June 24, 2003 hearing, Staff will provide to Council information regarding the Certificate and the appeal process. June 10, 2003 City of Iowa City Parle 3 (3) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR JUNE.24" ,~.~ ON THE APPEAL TO CITY COUNCIL OF THE DECISION OF THE HISTORIC PRESERVATION COMMISSION REGARDING THE CERTIFICATE OF APPROPRIATENESS FOR THE ENCLOSURE OF A SUN PORCH AT 520 GRANT STREET, WHICH APPEAL WAS FILED WITH THE CITY CLERK ON JUNE 2, 2003 BY APPLICANTS CONNIE WEBB AND SHELLEY BRIGHI. Comment: On June 2, 2003, Connie S. Webb and Shelley A. Brighi, the applicant for a Certificate of Appropriateness for the enclosure of a sun porch at 520 Grant Street, filed an appeal to the City Council of the Historic Preservation Commission's denial of the Certificate. (1) CONSIDER A RESOLUTION ACCEPTING PAYMENT OF $300.00 CIVIL PENALTY AND WAIVER OF RIGHT TO HEARING FROM PEACEFUL FOOL Comment: This Resolution accepts payment of a $300 civil penalty, authorized by Iowa Code section 453A.22(2), from Peaceful Fool, 110 E. College Street. Section 453A.22(2) provides that a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor. By making this payment and signing the appropriate waiver, Peaceful Fool waives its statutory right to have a hearing on whether the civil penalty should be assessed. o2~-17~ (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE FY2004 AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE CITY OF UNIVERSITY HEIGHTS FOR THE PROVISION OF TRANSIT SERVICE WITHIN THE CORPORATE LIMITS OF UNIVERSITY HEIGHTS. Comment: This resolution approves the FY2004 agreement for provision of fixed route transit service within the corporate limits of the City of University Heights. The total cost of the FY2004 contract is $28,069. This is a 2.4% increase from the FY2003 agreement. The cost increase was determined by using the national consumer price index [CPI] for calendar year 2002. The City of Iowa City's Finance Director and the City of University Heights agreed to use the CPI as the index for determining the cost increase for transit service for future years. June 10, 2003 Cit~' of Iowa City Parle 4 o..~ [*'11 (3) CONSIDER A RESOLUTION ACCEPTING CIVIL PENALTY AND WAIVER OF RIGHT TO HEARING FROM A & J MINI MART, INC. Comment: This Resolution assesses a thirty (30) day retail cigarette permit suspension, beginning May 23, 2003, and accepts payment of a $1500.00 monetary civil penalty, authorized by Iowa Code section 453A.22(2), from A & J Mini Mart, Inc., 2153 ACT Circle. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor. The civil penalty for the second time .the permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor is either $1500.00 or a thirty (30) day retail cigarette permit suspension, at the option of the permittee. The civil penalty for the third time the permit holder's employee is convicted of or pleads guilty to selling or providing tobacco to a minor is both a $1500.00 monetary civil penalty and a thirty (30) day retail cigarette permit suspension. This is, at least, the third time an employee of A & J Mini Mart, Inc., has been convicted of or plead guilty to selling or providing tobacco to a minor. By turning in its retail cigarette permit, making this payment and signing the appropriate waiver, A & J Mini Mart, Inc., waives its statutory right to have a hearing on whether the civil penalty should be assessed. (4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A LICENSE AGREEMENT FOR THE TEMPORARY USE OF PUBLIC RIGHT-OF-WAY BETWEEN THE CITY OF IOWA CITY, HELEN AND WILLIAM BYINGTON, AND LITTLE DONKEYS INC., d/b/a PANCHERO'S MEXICAN GRILL, FOR A SIDEWALK CAFI~. Comment: Helen and William Byington, as landowners,, and Little Donkeys Inc., d/b/a Panchero's Mexican Grill, seek a license agreement for temporary use of public right-of-way at 32 S. Clinton St., Iowa City, Iowa for a sidewalk cafe. City staff and Design Review have reviewed the plans and specifications and required submittals and recommend approval of said agreement. (5) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN o~- ["/-~ AND THE CITY CLERK TO ATTEST A LICENSE AGREEMENT FOR THE TEMPORARY USE OF PUBLIC RIGHT-OF-WAY BETWEEN THE CITY OF IOWA CITY, THE MOEN GROUP, AND MONDO'S OF IOWA CITY, INC. d/b/a MONDO'S DOWNTOWN, FOR A SIDEWALK CAFI~. Comment: The Moen Group, as landowner, and Mondo's of Iowa City, inc., d/b/a Mondo's Downtown, seek a license agreement for temporary use of public right-of-way at 212 S. Clinton St., Iowa City, Iowa for a sidewalk cafe. City staff and Design Review have reviewed the plans and specifications and required submittals and recommend approval of said agreement. June 10, 2003 City of Iowa Cit~/ Parle 5 03- t7 ~-~ (6) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'FI'EST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND COMMERCIAL FEDERAL, IOWA FOR PROPERTY LOCATED AT 913 WEBSTER STREET, IOWA CITY, IOWA. Comment: Commercial Federal, Iowa City, Iowa has requested that the City approve a Subordination Agreement for 913 Webster Street to refinance a mortgage. On May 23, 2000, the owners of the property received a loan from the City of Iowa City's Downpayment Assistance Program for the amount of $3,000. The property is appraised for $97,000 which provides enough equity to cover the City's second lien position. o:~- I~.~ (7) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING TWO REHABILITATION AGREEMENTS, TWO PROMISSORY NOTES, AND TWO MORTGAGES FOR THE PROPERTY LOCATED 2119 EAST COURT STREET, IOWA CITY, IOWA. Comment: The owner of the property located at 2119 East Court Street received assistance through the City's Housing Rehabilitation Program totaling $24,091.16. Comment: The owners of the property located at 1311 First Avenue received assistance through the City's Downpayment Assistance Program totaling $13,000. The financing was in the form of a conditional occupancy loan. The loan has been paid off; thus the lien can now be released. Comment: Iowa State Bank and Trust, Iowa City, Iowa has requested that the City approve a Subordination Agreement for 1209 Highland Avenue to refinance a first mortgage. On August 23, 1996, the owners of the property received loans from the City of Iowa Housing Rehabilitation Program for the total amount of $33,216.62. CONSIDER A MOTION SE'I-rING A PUBLIC HEARING FOR JUNE 24 ON AN ORDINANCE AMENDING THE CITY CODE TITLE 14, CHAPTER 6, ENTITLED, "ZONING," ARTICLE G, ENTITLED "OFFICE AND RESEARCH PARK ZONE (ORP)" AND ARTICLE L, ENTITLED "PROVISIONAL USES, SPECIAL EXCEPTIONS, AND TEMPORARY USES." Comment: The proposed amendments will allow utility substation facilities as a provisional use or a special exception in the Office and Research Park Zone (ORP) and allow the Board of Adjustment to reduce the minimum lot size for a utility substation in the ORP Zone under certain conditions. It is anticipated that the Planning and Zoning Commission will make a recommendation regarding this amendment prior to the Council meeting on June 24. Staff recommended approval in a memo dated May 28, 2003. Action: b. PUBLIC HEARING ON AN ORDINANCE AMENDING THE PLANNED DEVELOPMENT HOUSING OVERLAY (OPDH-5) PLAN FOR THE PENINSULA NEIGHBORHOOD BY AMENDING THE PENINSULA NEIGHBORHOOD CODE AND REGULATING PLAN. (REZ03-00016) Comment: At its May 15 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated May 15. The code amendments include: 1) addition of a new housing type - cottage flats or duplexes; 2) allowing for bay windows; 3) providing for changes in grade to make it easier to provide access for persons with disabilities; 4) allowing home occupations to occur on upper floors; and 5) removing the requirement for balconies for apartment buildings. The Regulating Plan includes revised locations for residential dwellings. Action: (/ I c. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee violates Iowa Code section 453A.2 by selling or providing tobacco to a minor. The civil penalty for the second time the permit holder's employee violates section 453A.2 is either $1500.00 or a thirty (30) day suspension of the retail cigarette permit, at the option of the permittee. As a part of the hearing, the Council will be provided with information establishing an employee of permit holder Deli Mart #2 violated section 453A.2 by selling or providing tobacco to a minor and that this is the second such violation by an employee of this permit holder within a two-year period. Comment: The minimum fee for a building permit will increase from $35 to $42. The 20% building permit fee increase equates to a 15% total fee increase for a single-family dwelling valued at $150,000 and 11% total fee increase for a commemial project valued at $500,000. The permit fee for single-family dwellings is approximately 0.89% of the project value and 1.1% of the project value for commercial projects.
