CONSIDER A MOTION SETTING PUBLIC HEARING FOR SEPTEMBER 29, 2009 ON A LEASE WITH THE JOINT EMERGENCY COMMUNICATIONS SERVICES ASSOCIATION OF JOHNSON COUNTY FOR PLACEMENT OF A MONOPOLE TELECOMMUNICATIONS TOWER AT THE IOWA CITY INDUSTRIAL PARK. Comment: The Joint Emergency Communications Services Association of Johnson County (the 28E entity created by the City, County, Johnson County Emergency Management Commission, North Liberty, and Coralville for emergency telecommunication services) would like to lease a portion of land at the Iowa City Industrial Park for placement of a monopole telecommunications tower and a storage facility. The proposed lease is for 5-years with the option of nine (9), five (5)-year renewals. Rent is $1.00 per year. The City and JECSA previously entered into a nearly identical lease at Fire Station 3, but the FAA did not approve that location. a9- a95 2. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR OCTOBER 6, 2009 ON AN ORDINANCE AMENDING TITLE 3 ENTITLED "CITY FINANCES, TAXATION & FEES," CHAPTER 4 ENTITLED "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES," ARTICLE 3 ENTITLED "POTABLE WATER USE AND SERVICE," OF THE CITY CODE TO INCREASE OR CHANGE RESIDENTIAL WATER SERVICE CHARGES AND FEES. Comment: This proposed ordinance would increase the non-sufficient funds (NSF) check fee from $15.00 to $25.00. (Items "b" will proceed as outlined in the memo of 2/28/07 entitled `Rezonings, Due Process and Ex pane a) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR SEPTEMBER 29 ON AN ORDINANCE AMENDING TITLE 14, ZONING TO ALLOW COMMUNICATION TOWERS IN THE INTERIM DEVELOPMENT RESIDENTIAL (ID-RS AND ID-RM) ZONES BY SPECIAL EXCEPTION. (REZ09-00004) Comment: At its August 20 meeting, by a vote of 6-1 (Plahutnik voting no), the Planning and Zoning Commission recommended approval of this amendment to the zoning code. Staff recommended approval in a memo dated August 14, 2009. Approval of this text amendment will change the current code language, providing a special exception to allow cell towers in the Interim Development Residential zones. Action: b) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR SEPTEMBER 29 ON AN ORDINANCE REZONING 3,450 SQUARE FEET OF LAND LOCATED AT 611 SOUTHGATE AVENUE FROM COMMUNITY COMMERCIAL (CC-2) TO INTENSIVE COMMERICAL (CI-1) (REZ09-00005) Comment: At its August 20 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this rezoning. Staff recommended approval in a report dated August 20. Approval will allow this property to be developed for intensive commercial uses. (SUB09- 00006/SUB09-00007) Comment: At its August 20 meeting, by a vote of 6-0 (Busard abstaining), the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated August 20, 2009. Approval will allow the development of an extension office building on a 1.64-acre, 1-lot, subdivision located at 4265 Oak Crest Hill Road SE. AUTHORIZING THE ACQUISITION OF PROPERTY INTERESTS NECESSARY FOR CONSTRUCTION OF THE SYCAMORE STREET FROM LANGENBERG AVENUE TO DEFOREST AVENUE IMPROVEMENT PROJECT. Comment: The City of Iowa City must acquire right-of-way, fee title, permanent easements and/or temporary construction easements to construct the Sycamore Street from Langenberg Avenue to Deforest Avenue Improvement Project. This project will include reconstruction of the existing rural chipseal section of Sycamore Street from the south city limits to Burns Avenue to an urban section which includes pcc pavement with curb and gutter and a new storm sewer system. Also included in the project is pavement patching from Burns Avenue to Highway 6, new traffic signalization at the U.S. Hwy. 6 and Sycamore Street intersection, a southbound turn lane addition on Sycamore Street (north of U.S. Hwy. 6), and installation of an 8' wide sidewalk along Sycamore Street from U.S. Hwy. 6 to Deforest Avenue. a) PUBLIC HEARING Action: ~~ ~~~ ~ _ ,3 ~ b) CONSIDER A RESOLUTION Action: "/ ~r O ITEM 7. CONSIDER AN ORDINANCE AMENDING TITLE 4, ALCOHOLIC BEVERAGES, CHAPTER 2, LIQUOR LICENSES AND BEER PERMITS, SECTION 3, LOCAL REVIEW OF APPLICATION / INVESTIGATION OF APPLICANT. (FIRST CONSIDERATION) Comment: This ordinance amends City Code to codify its policies on applications for renewal of liquor licenses which require review, inspections and investigations of each applicant for a liquor license or beer permit by the fire chief, building official and police chief, and written comments on any disapproval. Recommendations from each department will be due 7 calendar days before the expiration of current licenses, or within 7 calendar of completion of applications. for new license. Renewal applications will no longer be accepted more than 70 days prior to expiration of the present license which will conform to the time frame allowed by the State Alcoholic Beverages Division. CONSIDER A RESOLUTION ESTABLISHING ANNUAL PASS FEES FOR THE O~ ~ 301 THORNBERRY OFF-LEASH DOG PARK AND RITA'S RANCH DOG PARK. (DEFERRED FROM 8118) Comment: As required by the City Code, all Parks and Recreation fees must be approved by City Council resolution. Johnson County DogPAC and the City staff have proposed a revised annual fee schedule for use of the off-lease dog parks in Iowa City, and this fee schedule has been approved by the Iowa City Parks and Recreation Commission. The fee schedule proposes an annual pass fee of $25, with a reduction of $5 for spayed/neutered dogs; a bi-annual fee of $50 with aspay/neuter reduction of $10; and a tri-annual fee of $75 with a $15 spay/neuter reduction. The Commission also recommends there no longer be a reduction in fees offered for dogs that are microchipped, at the recommendation of Misha Goodman from the Iowa City Animal Services Division, who states that this reduction does not play a role in the dog owner's decision as to whether to microchip their dog. CONSIDER A RESOLUTION ADOPTING A COMPLAINT FEE POLICY FOR CODE off- 3D3 VIOLATIONS. Comment: Housing and Inspection Services (HIS) responds daily to complaints regarding zoning code, housing code., and other code violations. Typical complaints include over-occupancy of rental units, parking on the grass, accumulated junk and debris, and illegal signs. Presently there is no inspection fee or policy except for weeds and snow removal. This policy provides that there will be no fee for the first inspection, but if the violation is not corrected by the time the inspector re-inspects, the violator will be charged $75.00. Comment: The existing recycling processing contract with City Carton Company, Inc., expired on June 30, 2009. The new contract will retroactively cover July 1, 2009 through June 30, 2012, with one three-year rollover option. The option exists within this contract to move to a single stream processing system. CONSIDER A RESOLUTION SUPPORTING THE NAMING OF THE US HIGHWAY 6 BRIDGE LOCATED IN THE CITY OF IOWA CITY, IOWA THE BRIGADIER 'i~ - 305 GENERAL JOHN CORSE MEMORIAL BRIDGE. Comment: The Sons of Union Veterans of the Civil War (SUVCW) is currently executing a project in which each of the bridges on US Highway 6 (Grand Army of the Republic Highway) will be named honoring a Civil War General, each a native of Iowa. In connection with this project, City Staff has received a request from SUVCW to name the US Highway 6 Bridge the Brigadier General John Corse Memorial Bridge. John Corse was a native of Burlington, Iowa. Because the Iowa Department of Transportation (IDOT) has jurisdiction of US Highway 6 Bridge, this designation must be made by the IDOT. Comment: This agreement provides for distribution of cost sharing between the Iowa Department of Transportation and the City of Iowa City for emergency repair, permanent restoration, and design and administration of the repair of flood damaged infrastructure under the Burlington Street (Westbound) Bridge and US HWY 6 Bridge. The estimated total project cost is $98,583.95 and will be funded with $95,374.39 in federal and state funds and the remainder in road use tax proceeds. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A COOPERATIVE AGREEMENT AMONGST THE IOWA O~ "' .~ DEPARTMENT OF TRANSPORTATION, THE UNIVERSITY OF IOWA, AND THE CITY OF IOWA CITY FOR THE BURLINGTON STREET PEDESTRIAN BRIDGE REHABILITATION PROJECT [BRFN-6-7(76)--39-52]. Comment: This cooperative agreement deals with several issues. The most important of which are as follows: The City of Iowa City will design, let, inspect, and administer the project. All costs associated with the design and construction of the project are shared amongst the City of Iowa City (25%), The University of Iowa (25%), and the Iowa Department of Transportation (50%). CONSIDER AN ORDINANCE AMENDING TITLE 8, POLICE REGULATIONS, CHAPTER 6, PERSONS UNDER EIGHTEEN YEARS OF AGE, TO ADD A NEW SECTION 2, JUVENILE CURFEW TO ADD A NEW JUVENILE CURFEW ORDINANCE.
