THE APPEAL TO CITY COUNCIL OF THE DECISION OF THE HISTORIC PRESERVATION COMMISSION REGARDING THE CERTIFICATE OF APPROPRIATENESS FOR THE APPLICATION OF VINYL SIDING TO A DUPLEX AT 815-17 S. SUMMIT STREET, WHICH APPEAL WAS FILED WITH THE CITY CLERK ON MAY 16, 2003, BY APPLICANT FRANK FLEMING. Comment: On May 16, 2003, Frank Fleming, the applicant for a Certificate of Appropriateness for the application of vinyl siding to his duplex at 815-17 S. Summit Street, filed an appeal to the City Council of the Historic Preservation Commission's denial of the Certificate. In deciding the appeal, the City Council must consider whether the Historic Preservation Commission has exercised its powers and followed the guidelines established by law and City Code, and whether the Commission's action was patently arbitrary or capricious. After applying this standard of review, the City Council may, in conformity with the provisions of 14-4-C of the City Code (Historic Preservation Regulations) reverse or affirm, wholly or partly, or may modify the decision of' the Commission regarding the Certificate of Appropriateness and may make such order, requirement, decision or determination as ought to be made, and to that end shall have the powers of the Historic Preservation Commission. Comment: In deciding the appeal, the City Council must consider whether the Historic Preservation Commission has exemised its powers and followed the guidelines established by law and City Code, and whether the Commission's action was patently arbitrary or capricious. CONSIDER AN ORDINANCE AMENDING TITLE 3, "CITY FINANCES, TAXATION AND FEES," CHAPTER 4, "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES" OF THE CITY CODE TO INCREASE THE FINE FOR PARKING TICKETS, INCREASE MONTHLY PARKING PERMIT FEES, AND CHANGING THE PARKING TICKET ESCALATION. (SECOND CONSIDERATION) Comment: The State of Iowa has passed legislation to allow cities to increase their parking fines. This ordinance raises expired meter and overtime tickets from $3.00 to $5.00 and all other parking violations, except handicapped, from $5.00 to $10.00. Monthly permit parking fees increase by $10.00 per month. This ordinance also modifies the parking ticket escalation to comply with the new State law. Although a public hearing is not required to implement such changes, an opportunity for public discussion on the proposed changes to the ordinance will be provided pursuant to the City Council agenda prior to the City Council consideration of the ordinance. In order to allow for publication of the monthly parking permit fee increase to be effective July 1 (annual permit renewal date), this ordinance should receive second and third consideration June 23. CONSIDER AN ORDINANCE AMENDING THE PLANNED DEVELOPMENT HOUSING OVERLAY (OPDH-5) PLAN FOR THE PENINSULA NEIGHBORHOOD BY AMENDING THE PENINSULA NEIGHBORHOOD CODE AND REGULATING PLAN. (REZ03-00016) (FIRST CONSIDERATION) Comment: At its May 15 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated May 15. The code amendments include: 1) addition of a new housing type - cottage flats or duplexes; 2) allowing for bay windows; 3) providing for changes in grade to make it easier to provide access for persons with disabilities; 4) allowing home occupations to occur on upper floors; and 5) removing the requirement for balconies for apartment buildings. The Regulating Plan includes revised locations for residential dwellings. Correspondence included from applicant requesting expedited consideration. b. CONSIDER AN ORDINANCE REZONING 6.91 ACRES FROM MEDIUM- DENSITY SINGLE-FAMILY (RS-8) TO SENSITIVE AREAS OVERLAY MEDIUM-DENSITY SINGLE-FAMILY (OSA-8) FOR A PROPERTY LOCATED AT 1515 NORTH DUBUQUE ROAD. (REZ03-00010/SUB03- 00002) (SECOND CONSIDERATION) Comment: At its May 1 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. In a staff report dated April 17, staff recommended approval. This subdivision requires a Sensitive Areas Overlay rezoning because the applicant has requested a reduction of a buffer for a protected slope. CONSIDER AN ORDINANCE REZONING 6.92 ACRES FROM INTERIM DEVELOPMENT (ID-RS) TO LOW DENSI~ SINGLE-FAMILY (RS-5) FOR PROPER~ LOCATED WEST OF CUMBERLAND LANE SOUTH OF SCO~ PARK. (REZ03-00014/SUB03-00013) (SECOND CONSIDE~TION) Comment: At its May 1 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval. In a staff repo~ dated May 1, staff recommended approval. This mzoning will allow the Highland Woods subdivision, a single-family residential development, to occur on this properly.
