Comment: On July 15, a public hearing will be held on the plans and specifications for the Court Street Transportation Center (FKA Near Southside Transportation Center). This is a multi-modal transportation facility which will be located on the east half of Block 102, south of Burlington Street. Following approval, it is hoped to receive bids and award the contract in September and begin construction in October. June 24, 2003 Cit}/ of Iowa Cit~, Parle 3 f. Resolutions. (1) CONSIDER A RESOLUTION APPROVING AN AGREEMENT 0_~-/cY'~ BETINEEN THE CITY OF IOWA CITY AND THE IOWA STATE DEPARTMENT OF ECONOMIC DEVELOPMENT FOR EMERGENGY SHELTER GRANTS PROGRAM FUNDING, AND AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO AI-I'EST THE SAME. Comment: The Iowa Department of Economic Development has agreed to provide the City of Iowa City $93,400 in funding for supportive services for persons who are homeless. These funds will be used in FY04 by the following local agencies: Domestic Violence Intervention Program ($22,800), Four Oaks a.k.a. Youth Homes ($11,400), Shelter House ($32,300), and Table to Table ($22,800). The award also includes $4,100 to reimburse the City for its expenses in administering this grant. This Emergency Shelter Grants Program funding represents a decrease of $12,230 in funds from the FY03 allocation. g. Correspondence. CONSIDER A MOTION SETDING A PUBLIC HEARING FOR JULY 15 ON AN ORDINANCE CONDITIONALLY CHANGING THE ZONING DESIGNATION OF 5.69 ACRES FROM RS-5, LOW-DENSITY SINGLE- FAMILY RESIDENTIAL, TO RM-12, LOW-DENSITY MULTI-FAMILY RESIDENTIAL, FOR PROPERTY LOCATED AT 1715 MORMON TREK BOULEVARD. CONSIDER AN ORDINANCE AMENDING THE PLANNED z-~LO~-~ DEVELOPMENT HOUSING OVERLAY (OPDH-5) PLAN FOR THE PENINSULA NEIGHBORHOOD BY AMENDING THE PENINSULA NEIGHBORHOOD CODE AND REGULATING PLAN. (REZ03-00016) (SECOND CONSIDERATION) Comment: At its May 15 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated May 15. The code amendments include: 1) addition of a new housing type - cottage flats or duplexes; 2) allowing for bay windows; 3) providing for changes in grade to make it easier to provide access for persons with disabilities; 4) allowing home occupations to occur on upper floors; and 5) removing the requirement for balconies for apartment buildings. (SUB03-00017) Comment: At its May 15 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of Galway Hills, Part 7, a 10.98-acre, 16-1ot subdivision located on Dublin Drive subject to staff approval of legal papers and construction drawings prior to Council consideration. Legal papers and construction drawings (have) been approved. Staff recommended approval in a report dated May 15. June 24, 2003 Cit~/of Iowa City Parle 8 ITEM 6. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE CIVIC CENTER NORTH COURT TRANE HVAC PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will include replacing a fan in the Civic Center North Court Trane HVAC Heating Ventilation Air Conditioning Unit. This project also involves modifying the duc[work system in order to reduce the static pressure, which will alleviate the noise and vibration problems in the upper floors and increase cooling efficiency on the first floor. The estimated construction cost is $47,795 and will be funded with General Obligation bond proceeds. (1) PUBLIC HEARING I ~ 0~-~00% (2) CONSIDER A RESOLUTION APPROVING ITEM 7. A CIVIL PENALTY OF EITHER THIRTY (30) DAY RETAIL ClGARE'I-DE PERMIT SUSPENSION OR $1,500.00 AGAINST DELI MART #2. Comment: This hearing is the time designated for the Council to consider whether a Resolution should be adopted assessing the civil penalty authorized by Iowa Code section 453A.22(2) against Deli Mart #2, 1920 Lower Muscatine Avenue. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee violates Iowa Code section 453A.2 by selling or providing tobacco to a minor. The civil penalty for the second time the permit holder's employee violates section 453A.2 is either $1500.00 or a thirty (30) day suspension of the retail cigarette permit, at the option of the permittee. As a part of the hearing, the Council will be provided with information establishing an employee of permit holder Deli Mart #2 violated section 453A.2 by selling or providing tobacco to a minor and that this is the second such violation by an employee of this permit holder within a two-year period. The permit holder's representative will then have the opportunity to provide the Council with information s/he deems appropriate. The Council will then decide whether to assess the requested civil penalty and, if it decides to do so, will adopt an appropriate Resolution. D/B/A TERRAPIN COFFEE IOWA CITY FOR A SIDEWALK CAFIS. Comment: The Moen Group, as landowner, and Terrapin Coffee Brewery, Inc., d/b/a as Terrapin Coffee Iowa City, seek a license agreement for temporary use of public right-of-way at 259 Iowa Avenue, Iowa City, Iowa for a sidewalk cafe. City staff and Design Review have reviewed the plans and specifications and required submittals and recommend approval of said agreement. Action: / ITEM 12.
