Public heating on an ordinance amending the Zoning Chapter by changing the use regulations on a 40.7 acre parcel located on the north side of Rohret Road, east of Highway 218, from RS-5, Low Density Single-Family Residential, to OSA-8, Sensitive Areas Overlay/Medium Density Single-Family Residential. (REZ96-0020) Miklo/Our first item is a p.h. on a rezoning of 40 acres located on north side of Rohret Road .... proposal... currently zoned RS-5 .... proposal is to rezone it to RS-8 with Sensitive Areas Overlay ....includes several different housing types (presents map) .... Kubby/What is s.f. condominiums? Miklo/There is one lot that has s.f. houses that are sold as condominiums. (refers to map). Where these s.f. houses will be on individual lots. Norton/Other than that there is no difference? ..... Miklo/That is correct. Vanderhoef/ Nov/Didn't they do something similar on Rochester? Miklo/Rochester Hills .... 2-3 unit buildings. The proposal also includes dedication of 8 acres of open space along Willow Creek... provide for extension of Willow Creek Trail .... Shannon Drive... correct from Rohret Road up into the Galway Hills development .... eventually connect to Melrose Avenue .... It will provide for circulation between these two neighborhoods... collector street... not a direct path through the neighborhood .... Norton/Where is the little road that cuts down through there? ..... Miklo/(Refers to map). This road goes back into Walden Woods .... Norton/There must be something to the east of that. Why can't it go further east? Miklo/There are houses along there... a row of houses that are currently built .... Vanderhoef/Do we have any plans for a eight foot sidewalk?... Miklo/This would include a eight foot sidewalk ..... make it part of the trail system. Vanderhoef/ Miklo/There is a CZA attached to this. The signatures have not been completed, so this will need to be continued ....Grading and Erosion Control Plan has not been completed at this point ....You can have the p.h. but you should continue it to January 28. Nov/Bob, I have a question about the numbers here... description about this 8.7. acres that is going to have 120 more units. Is that in addition to 40 acres? Miklo/It is part of the 40 acres and it is included with the total, 249 units. Nov/(Refers to map). Norton/ Miklo/The CZA requires that Shannon Drive connects to the property line before lot 52 can develop... to assure that it does get built .... There is also provisions for traffic calming .... And also it stipulates that development of this would require review by P/Z and city council... of lot $3. Thomberry/Do I remember reading something about the city going in on the cost of a bridge? Kubby/In terms of the pond, are both of them needed for storm water management? Miklo/Yes, they are. Kubby/Are there other ways of configuring storm water management so the development wouldn't need to take down that small stand of trees? Miklo/There may be ....in terms of this site... difficult. Norton/Where is the grove... the one that would be gone? Miklo/(Refers to map) .... this area is also wooded ..... The Sensitive Areas Ordinance would allow up to 50% of the woodlands to be removed. This is less than 50%. Kubby/...if there is a way to reeonfigure and still allow the kind of density needed to make this economic viable ..... The development is only required to have 1 1/2 acres for green space. Why are they giving the 8.6? .... Miklo/A lot of it would be affected by the Sensitive Areas Ordinance .....wooded... slopes... not practically buildable .... Kubby/How much of it is going to have to be maintained by us? .....Is there going to be an issue of having to mow? ..... Miklo/ .... I wouldn't anticipate that we would want to go in and do a lot of maintenance .... P/R Commission did review this plan and was enthusiastic .... Kubby/Where is the 8.6? Miklo/This area along the creek (refers to map). Larry Schnittjer/That shaded area is the tree ..... Vanderhoef/Was there at one time .... to make a large pond between the two? Miklo/Not that I am aware of. Kubby/In staff report ..... clusters of evergreen on Andrea Court. But that is not part of this CZA. Is that part of the plan? Miklo/That would be part of the final plan which we will see a landscaping plan .... There is'a proposal for an evergreen screening of white pines along the highway and also along Rohret Road .... A landscape plan will be required with the final .... landscaping of Andrea Court. Norton/Bob, what are the virtues to the city of going with this increased density? Mildo/In terms of the City's comp plan, it calls for 2-8 dwelling units per acre in this area .... It is within the comp plan density for the area ..... It does have access to an medal street .... more efficient use of the land .... Thiswill meet the housing demand in a more compact fashion. It provides a variety of housing units in one neighborhood ..... (refers to map) .... Norton/It waszoned RS-5 .... 140, you can see going beyond that .... 250 seems to me to be the high side of that operation .... Miklo/Other option would have been...RS-5. Norton/We had problems with Mormon Trek... sewer capacity .... Miklo/In terms of Mormon Trek, the sewer issue has been resolved with the Abbey Lane Sewer construction and that same issue does not apply to this. Nort'on/... overall support of the west side ..... Vanderhoef/Has there ever been any conversation with the school about wanting another entrance-exit to that area? ..... Miklo/There had been discussion when we reviewed Galway Hills development. There is the potential for an access here (refers to map) ....discussion for a further date ' when Galway Hills is reviewed. Kubby/In our comp plan, what is the lowest category of density? .... Miklo/I believe there might be a rural which is RR-1 .... Norton/Is there any guarantee for senior housing on lot 53? Miklo/Nol there isn't .... whatever goes there will require a rezoning process just as we are going through now. Norton/...traffic density .... Miklo/Depends on the use ..... Nov/Depends on how you define it .... Baker/Bob, were building elevations part of this (can't hear) ....? Miklo/Yes, they are... weren't included in your packet. Baker/...have those for tomorrow nights meeting. Kubby/I noticed... 'discussion ....noise barriers along the highway ..... Miklo/...tw0 rows of white pine .... This will probably be the last phase of development (refers to map) .... there will be some time for those to be established. Nov/Wasn't there something along Rohret also? ..... Miklo/The subdivision or development is designed so that Shannon Drive will be the primary way in and out .... (refers to map)... I would say approximately 25-30 units will go back into these streets ..... Because of the tums required (refers to map), it isn't designed to be convenient for cut through traffic .... Vanderhoef/What is the distance between Shannon Drive and Mormon Trek? Miklo/I would have to check .... 1/4 mile .... Lehman/ ..... Miklo/Larry' says it is 1/2 mile .... Kubby/It will probably be on our docket next time to continue the p.h. and to vote on it .... Miklo/ Thornberry/ b. Public hearing on an ordinance amending Title 14, Chapter 6, entitled "Zoning," by changing the regulations pertaining to childcare facilities. p.h. on amendments to the Zoning Ordinance pertaining to childcare facilities ..... lengthy and complex ordinance .... simpler than it appears. Right now we allow home based childcare facilities in our s.f. zones. This is going to clarify that and specify that the same requirements that the state imposes would be imposed. The major change is for childcare facilities which care for 12 or more children ..... This ordinance would allow them in all zones either as s.c. in lower density residential zones, accessory uses in the industrial zones and permitted or provisional uses in the multi-family commercial office type zones. There are some guidelines that Would need to be followed... play area... buffering requirements .... Lehman/Most of these are set down by the state? Miklo/Several of them are. Miklo/Right.... that is the way it is now .... Norton/ ....There is by and large no supervision for less than 127 Miklo/Our research wasn't that extensive .... what do other communities allow? Norton/...anxious to have some requirements .... not much of any way to enforce it. Miklo/Those aren't so much zoning issues to be concerned about .... inspection issues .... Norton/ Nov/Department of Human Services does some oversight. Norton/ ' Vanderh.oef/'.... Concerned of the statement of no playground equipment in the front and side yards ....terminology ~meant'by side yard ....20 foot from center of the road kind'of thing ....This may be the most appropriate place for them ....One thing that did' come up that I am not real clear about ....exception... that is on page 4c ..... talking about the childcare center, by right ....location ....BDI... might well be places that would choose... wouldn't be on the same lot as the business. Miklo/That would require a special exception in that case. Vanderhoef/She indicated that usually if someone comes to you asking for special · exceptions .... wondering... how many people would think about doing that? Is there a way that we can state something like that...? Miklo/There is a table that we' are attaching that indicates that it is a special exception in industrial zone, that that is an option. Kubby/ Miklo/ .'. :Proctor and Gamble... can do that on site as an accessory use. Can they apply for a special exception in the industrial zone and say in front of the building? .... Miklo/ ....they wouldn't be able to put it in the first 20 feet from the street... setback buffer from the street .... Kubby/In terms of residential zones, are there any conflicts of having a non-family member who are employees at the childcare center? Miklo/No... If they are going to have more than 11 children, they would require a s.e ..... If they are less than 11 children, they are an accessory use. Kubby/Isn't there another part'of the code that says if you have a business in a s.f. residential zone, you can't have non-family employees? .... Miklo/That applies for home occupations. I am not sure. Nov/ Kubby/I guess I would like us to check that out .... Miklo/ Norton/ Thornberry/.Is .this 11 at one time or 11 total kids? Miklo/The state requirement allows 6 preschool children and then up to 11 over the course of the day .... Thomberry/I could see where you could have a different set of kids on the weekends. Nov/There was a conversation last year... about revising the rules for home businesses. Did you ever go that far? Miklo/No. Nov/I know we discussed it ..... Thornberry/ Miklo/The only restriction on the personnel is they have to live in the residence .... Kubby/I have a question about parking .... sufficient stacking spaces .... There is no formula or number... staff... did have a recommendation... The ordinance didn't ' spell that out .... Miklo/Near the doorway or entry way... stacking spaces or parking spaces that are unencumbered by driveways so that someone could park their car and drop off their children... There will be a site plan review involved in the larger childcare centers .... Kubby/1:20 .is kind of what staff recommends but you didn't want to be that hard and fast in the ordinance? Vanderhoef/I would like to thank P/Z and Planning .... Kubby/...big change .... Thornberry/Appreciated the part of... percentage of working mothers now. It is important .... Norton/Sandy Kuhlman ....her views .... Kubby/... childcare is going to be one of the biggest issues about welfare reform ....This is really going to help .... Consider an ordinance vacating the north 12.5 feet of the F Street right-of-way for a distance of 75 feet immediately west of First Avenue. (VAC96-0002) (First consideration) Miklo/First consideration of vacation of a portion off Street. d. Consider an ordinance amending the Zoning Ordinance by changing the use regulations of approximately 7.12 acres located west of Dubuque Street and south of the Iowa River, from County RS, Suburban Residential, to P, Public. (REZ96-0016) (Pass and adopt) Miklo/Pass and adopt of the rezoning of last portion of Water Plant site. This was deferred some time ago so that the City Development Board could review the annexation and they have since reviewed the annexation and approved it. e. Consider a resolution approving the extraterritorial preliminary and final plat of Furrow's Edge, Part II, a resubdivision of Furrow's Edge, Lots 1-4, a two-lot, 16.14 acre residential subdivision with one outlot restricted to agricultural uses, located in Fringe Area A east of Highway 1 and north of Penny Lane. (SUB96-0025) Miklo/Resubdivision of Furrow's Edge. This is on the east side of Hwy 1, just north of · Penney Lane... currently... four lots (refers to map) .... The owner of adjacent property is purchasing lots 3 & 4 and would like to add those to an existing lot in Highland Height's Subdivision and remove the requirement for the street. Lots 3 & 4 are being resubdivided as outlot A and there is a note... restrictions on outlot A... Plat does provide that if this is ever amended to allow residential development, access would come via a drive back to Penney Land rather than opening up an additional access point onto the Hwy 1 ..... The proposal to amend the subdivision for Highland Heights, which is development to the north, to remove the access restriction has been withdrawn. So they are not officially amending the plat to · remove the access restriction. Kubby/Do they still want an access from Outlot A to Hwy 1 ? Miklo/No, this plat would not permit that .... Norton/ Miklo/ Norton/ Miklo/There was a farm drive that was upgraded and the plat will not be amended to Officially allow him to use that for access. Kubby/Can he unofficially use it? Mildo/That would be a county enforcement issue. Thornberry/ Norton/So we are only dealing with one of these two issues .... Miklo/(Refers to map).Initially the proposal was to allow this driveway to extend to share the curb cut onto Hwy 1. That is no longer the proposal. Miklo/That does not appear on this map but it is to the north... two farm access drives .... Thornberry/Is Penney Lane ever' embargoed? It may or may not be. It is a private county subdivision street, whereas Dingleberry Road has been in place for some time .... Penney Lane was built as part of this subdivision .... Norton/...complicated set of drawings .... Thornber/y/ f. Consider a resolution approving the preliminary plat of Hollywood Manor, Part 6, an 8 acre, 24-1ot residential subdivision located west of Sycamore Street and South of Burns Avenue. (SUB96-0026) Miklo/The preliminary plat for Hollywood Manor, Part 6 .... 24 lot residential subdivision... (refers to map) ..... As part of this development, Lakeside Drive would be continued into this area and eventually would travel farther to the west .... these lots are fairly large to provide a buffer .... The plat also contains a proposal for a landscaped buffer in that area .... further review of the rest of the design... Kubby/Modified grid pattern... like this better .... efficient... better but it still doesn't really give you the consistent multiple choices that a straight grid gives you .... Do we really' want to encourage the modified grid versus the straight grid for the south side? .... I am just thinking about in the future. Vanderhoef/Going west I have some of the same thoughts... cul de sacs at the end of Lakeside .... (refers to map). Is Lakeside is going to go over and dead-end when it hits Weatherby Park? Kubby/...I am just thinking about the future. Kubby/The park is there and I don't want this arterial going through the park. Miklo/ Kubby/I ,am just thinking on the other side of Weatherby Park. Council/(All talking). Norton/Can you tell me where the contribution of open space goes? .... It just goes in a general kitty? ..... Miklo/It would go into a fund to be used in this general part of the city. Norton/ Miklo/Weatherby Park is sufficient for this specific area ....So it would be used in this general area. Vanderhoef/And it could be used for development of Weatherby. Miklo/Right. Vanderhoef/Will there be a 8 foot sidewalk on Lakeside Drive? Miklo/N.o, there is a four foot sidewalk on Lakeside Drive. There is a trail connection .... We would anticipate requiring a trail connecting the ends of the cul de sacs .... Vanderhoef/... all of this area to the east... doesn't have any connection... Miklo/The south district plan calls for another collector street in this vicinity to actually -skirt the southside of Weatherby Park. So that will provide both vehicular and · pedestrian access to the park .... g. Consider a motion to authorize the Mayor to forward a letter to the Johnson County Board of Supervisors recommending approval of a request to rezone approximately 40 acres located within Fringe Area C north of Highway 1 West, and west of Landon Avenue, from A-l, rural, to RS-10, Suburban Residential. WS011397 January 13, 1997 Council Work Session page 14 Miklo/Rezoning in the county from A-1 rural to RS-10... roughly a 40 acre parcel .... anticipated... divided into as many as four lots according to.RS-10 standards ..... · This is in compliance with the Fringe Area Agreement for Area C... CHANGE TAPE TO REEL 97-4 SIDE 1 Kubby/Developing in a contiguous manner or clustered manner .... doesn't seem like a very efficient form of development .... Miklo/In subdivision review process we look at issues such as that to make sure... street... connect to adjacent developments .... But the surrounding area is used for agricultural purposes ..... Kubby/.. it should happen closer to town versus so far away .... better planning. Norton/If you keep doing this, pretty soon you got sprawl all the way out there .... Vanderhoef/I had a concern ..... alignment for 965 .... 1/4 to 1/2 mile west to this development. When I looked at the plan to have at least two center lots in this share one driveway .... few entries onto the highway as possible, what crosses my mind... someone with every ten acres comes in with one request at a time, are we going to end up with a whole line up of driveways all the way down there. Miklo/ In order to subdivide this, they would have to do the entire parcel at one time .... This is an existing 40 acre tract that stands as it is and we anticipate that they will request subdivision of this up to four smaller parcels in the future ..... Kubby/If this happens all up and down Hwy 1 ..... So we could be following our Fringe Area Agreement but still have a problem in the future. Thornberry/What is the speed limit on Hwy 1 right there? Miklo/55 mph. Norton/There is going to be two accesses now .... Vanderhoef/ .....So we are talking three driveways in that little short distance. Norton/ Vanderhoeff Miklo/(Refers to map). It is a concept plan ....issue when we review the subdivision .... Norton/ Miklo/ Kubby/Two accesses... if that should be replicated .... Norton/ Nov/They could have a road at the north end of all of those lots and exit onto Landon. Miklo/The topography for this property is such that that may not be practical ..... Council/(All. talking). Vanderhoef/We know that 965 is probably going to want restricted access ..... Norton/Is there anything we could do now? .... Vanderhoef/That is what I am asking. h. Consider a motion to authorize the Mayor to forward a letter to the Johnson County Board of Supervisors recommending approval of a request to fezone 2.75 acres of a 10 acre property located north of American Legion Road approximately 1.7 miles southeast of Iowa City, from A-l, Rural, to RS, Suburban Residential. (CZ9657) A rezoning in the county...A-1 Rural to RS Suburban Residential .... Fringe Area for this particular area proposals rezonings to allow ten acre lots to be permitted but smaller lots... not be permitted... Are some special circumstances associated with this particular development (refers to map) ....Ten acre parcel, divided into This represents only a reasonably accurate transcription of the Iowa City council meeting of January 13, 1997. WS011397 January 13, 1997 Council Work Session page 16 five smaller parcels .... existing residential lot in this area... four platted lots here .... We feel it is a reasonable request for the rezoning... Issue with driveways .... this is a high speed corridor .... 55 mph... We would recommend that at the time the county approves the plat, they require a shared curb cut so the driveway for the new resulting lot would enter at the same point .... could branch off... as long as there is not another curb cut .... It is not the best situation in a high speed area such as this .... Therefore in our recommendation, we are recommending approval even though it is not in strict compliance and recommending... county restrict it to one driveway. NOV/We have a letter from people who want a second driveway .... I will give it to Maclan .... Thomberry/ Miklo/They asked. the P/Z Commission not to include that recommendation. The P/Z Commission voted unanimously toinclude the proposal for the driveway restriction ..... Nov/ Norton/Doesn't seem to be too heavy a requirement... This is a really tough problem to maintain consistency on these access on arterials .... Mikio/We have been fairly consistent on major streets .... Norton/ Miklo/ Thomberry/Is the topography conducive to putting in two driveways with one curb cut in that location? Miklo/Yes, it is ....It would only require a short easement. You indicated some interest... asked us to pursue three specific items which we have done. Karin and David Schoon took this to the DT Strategy Committee .... You can see .... attractive addition to the d.t .... median should be done in context with an overall plan for d.t ..... expenditure of funds for the median should occur only after other needs in d.t. have been met. We also prepared a cost estimate for you .... one of those median islands $71,680 is the projection... attachment in information you received .... We do have irrigation systems, electrical outlets, 15% contingency and ... mobilization of the contractor ..... If you were to do the whole five block corridor at one time, projected expense... $326,400. The final thing you asked us for was to see how the people who have access to the three alleys... limitation of right in and right out movements. We did submit a questionnaire. We received nine in return .... I guess we are just interested in knowing if you want us to go ahead, what your feelings are about it, answer any questions. Next step would be to have a design done... so that we could send it to Ames to have IDOT give us the approval .... We will need to have a design done... Ames will not look at a concept plan. It has.to be a specific design. Baker/...'Are there any other constraints that says we ought to do it now?... Davidson/No, there is no deadline... went into the Near Southside Design Plan and started looking at those elements... things we should be thinking about in the short term, this is one of them ....put it in the CIP some place else... bring it up in 3-4 years. Baker/Strategy Committee is thinking about south of Burlington ..... Seems logical to postpone it. Kubby/Seems like a good idea who time has not yet come. Lehman/List of folks... you contacted .... I don't see Hawkeye State Bank .... Campus Amoco .... I would think that every business along Burlington Street should be surveyed as to how they feel about this .... I did get a call today... I guess I would like some more input from every single business along the street. Davidson/We did the property owners .... just with access to the alley, the three alleys. Following up ..... memo we got from him on Oakland Cemetery expansion .... Let me just read part of this. "A majority of council members seem to favor a plan that will accommodate lot sales for a minimum of 30 years .... support to utilize up to ten acres .... I interpret these to mean that the majority of council members would prefer not to expand the cemetery by more than ten acres." So, I don't know that I really got that from the meeting or not and we need to clarify that with him .... Karr/Can I also refer you to the work session minutes of that meeting that are in your packet... Terry and I worked together on that one, that issue ....as far as staff input... needs to be changed or if that addresses your concern. Kubby/I am not sure what actually happened that night. There is a lot of confusion ....I will get you a memo on it. 12. Nov/(Agenda #4) I have a couple of somethings. Someone called me about the local control on tobacco. I was thinking that we would have local control on sales... think about a higher fine for illegal sales .... This woman was wondering if we were going to consider a No Smoking here or there kind of thing and I told her I don't know yet. Her concern was very valid .... make it very severe and nobody can smoke except in their own home .... lung cancer... based on second hand smoke where she was working .... Kubby/I had a person call me not sure that the resolution is clear ....communities could not have lesser restrictions than the state ....
