ORDINANCE NO. 97-3770
AN ORDINANCE VACATING THE NORTH
12.5 FEET OF THE F STREET RIGHT-OF-WAY
FOR A DISTANCE OF 75 FEET IMMEDIATELY
WEST OF FIRST AVENUE
WHEREAS, Chester and Rhetta Pelsang
own property at 839 South First Avenue,
immediately adjacent to the right-of-way de-
scribed below; and
WHEREAS, the Pelsangs are in the
process of redeveloping said property including
the construction of a handicapped parking
space within the F Street right-of-way; and
WHEREAS, City approval of said right-
of-way encroachment was granted by Resolu-
tion No. 96-195; and
WHEREAS, the Pelsangs wish to have
said right-of-way vacated so that their entire
parking facility is located on their property; and
WHEREAS, the City will retain ease-
ments for any existing utilities.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. VACATION. Subject to retention
of easements for maintenance of an existing
sanitary sewer and other utilities, the City of
Iowa City hereby vacates the portion of the
F Street right-of-way legally described as
follows:
The north 12.5 feet of the F Street
right-of-way lying immediately west of First
Avenue for a distance of 7,5 feet.
SECTION II. REPEALER. All ordinances and
parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.
SECTION III. SEVERABILITY. If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision
or part thereof not adjudged invalid or unconsti-
tutional.

SECTION IV. EFFECTIVE DATE. This Ordi-
nance shall be in effect after its final passage,
approval and publication, as provided by law.

ORDINANCE NO. 97-3771
AN ORDINANCE AMENDING TITLE 9 OF THE
CITY CODE OF IOWA CITY ENTITLED "MOTOR
VEHICLES AND TRAFFIC," BY AMENDING
CHAPTER 3, SECTION 6B TO REDUCE THE
SPEED LIMIT ON IOWA HIGHWAY I FROM A
POINT 200 FEET WEST OF SUNSET STREET
TO A POINT 300 FEET SOUTHWEST OF NA-
PLES ROAD SOUTHWEST.
WHEREAS, the speed limit for vehicles from
a point 200 feet west of Sunset Street to a
point 300 feet southwest of Naples Road SW
is currently fifty-five (55) miles per hour; and
WHEREAS, the Iowa Department of Transpor-
tation has conducted a speed study and recom-
mends reducing the speed limit from 200 feet
west of Sunset Street to a point 300 feet
southwest of Naples Road SW to fifty (50)
miles per hour.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. AMENDMENT TO SECTION 9-3-6B.
Amending Section 9-3-6B by deleting the
provision which states the maximum speed
limit on Iowa Highway I from a point 200 feet
southwest of the intersection of Sunset Street
to a point 1,900 feet west of Miller Avenue is
50 miles per hour, and adding a new provision
which states: "The maximum speed limit for
vehicles on Iowa Highway 1 from a point 300
feet southwest of the intersection of Naples
Road to a point 1,900 feet west of Miller
Avenue is fifty (50) miles per hour."
SECTION II. REPEALER. All ordinances and
parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.
SECTION III. SEVERABILITY. If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the

ORDINANCE NO. 97-3772
AN ORDINANCE AMENDING TITLE 9 OF THE

TAFT AVENUE AND SCOTT BOULEVARD.
WHEREAS, the City Code provides the speed
limit for vehicles in suburban areas shall be
forty-five (45) miles per hour; and
WHEREAS, the section of American Legion
Road (Muscatine Avenue) between Taft Ave-
nue and Scott Boulevard is now suburban,
rather than rural, in nature.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. AMENDMENT TO SECTION 9-3-6B.
Amending Section 9-3-6B by adding the follow-
ing provision:
'The maximum speed limit for vehicles
on American Legion Road (Muscatine
Avenue) between the intersection of Taft
Avenue and the intersection of Scott
Boulevard is forty-five (45) miles per
hour.'
SECTION II. REPEALER. All ordinances and
parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.
SECTION III. SEVERABILITY. If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision
or part thereof not adjudged invalid or unconsti-
tutional.
SECTION IV. EFFECTIVE DATE. This Ordi-
nance shall be in effect after its final passage,
approval and publication, as provided by law.

ORDINANCENO.
AN ORDINANCE AMENDING TITLE 5, ENTI-
TLED 'BUSINESS AND UCENSE REGULA-
TIONS,' CHAPTER 2 ENTITLED 'VEHICLES
FOR HIRE.' BY DELETING THE PROVISIONS
APPUCABLE TO PEDICABS AND HORSE°
DRAWN VEHICLES.
WHEREAS, Title 5, entitled 'Business
and License Regulations', Chapter 2, entitled
'Vehicles for Hire' establishes licensing
requirements for taxicabs, pedicabs, and
horse-drawn vehicles, and
WHEREAS, the City Council of Iowa City
wishes to delete the licensing requirements
for pedicabs and horse-drawn vehicles.
NOW THEREFORE, BE iT ORDAINED BY
THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
SECTION 1. AMENDMENT: That Title 5,
entitled 'Business and License Regulations,'
Chapter 2, entitled 'Vehicles for Hire,' be
amended as follows:
a. Section 5-2-1, entitled 'DEFINITIONS,' is
hereby amended by deleting the defini-
tion of HORSE-DRAWN VEHICLE and by
deleting the definition of PEDICAB; and
by deleting the definition of "VEHICLE
FOR HIRE" and adding in a new definition
of "VEHICLE FOR HIRE" which reads as
follows:
"VEHICLE FOR HIRE: Taxicab."
b. Section 5-2-2B(2) is hereby deleted and a
new Section 5-2-2B(2) added to read as
follows:
"No Vehicle for Hire shall be
operated on any street within the
City unless a decal has been issued
by the City Clerk. The decal shall be
attached to the lower corner of the
front windshield on the passenger
side."
c. Section 5-2-6B(5) is hereby deleted and a
new Section 5-2-6B(5) is added to read
as follows:

"Taxicab drivers shall possess a cur-
rently valid Iowa chauffeur's
license.'
d. Section 5-2-6C(2) is hereby deleted and a
new Section 5-2-6C(2) is added to read
as follows:
"The refusal to issue a driving badge
may be based on an adverse driving
record and/or conviction of other
crimes."
e. Section 5-2-7A(2) is deleted and a new
Section 5-2-7A(2} is added to read as fol-
lows:
'A passenger of a vehicle for hire
may request from the driver an
estimate of the fare to be charged,
and the driver shall provide such an
estimate based on the fares
displayed on the rate card. The
driver of a taxicab shall then charge
a fare not to exceed the estimate
given plus the rate card fare for one-
half (1/2) mile.'
f. Section 5-2-7C(1) is hereby deleted and a
new Section 5-2-7C(1) is added to read
as follows:
'The driver of a taxicab shall have
the rights to demand payment of the
legal fare in advance and may refuse
employment unless so prepaid, but
no driver shall otherwise refuse or
neglect to convey any orderly
person, on request, anywhere in the
City unless previously engaged or
unable to do so.'
g. Section 5-2-7C(2) is hereby deleted.
h. Section 5-2-8C(2) is hereby deleted.
i. Section 5-2-1 1 is hereby deleted in its
entirety.
j. Section 5-2-12 is hereby renumbered as
Section 5-2-11.
SECTION II. REPEALER: All ordinances
and parts of ordinances in conflict with the
provisions of this Ordinance are hereby
repealed.
SECTION III. SEVERABILITY: If any sec-
tion, provision or part of the Ordinance shall
be adjudged to be invalid or unconstitutional,
such adjudication shall not affect the validity
of the Ordinance as a whole or any section,
provision or part thereof not adjudged invalid
or unconstitutional.
SECTION IV. EFFECTIVE DATE: This
ordinance shall be effective March 1, 1997.
