Neenah, WI $ 6,303,000.00 McComas-Lacina Construction Iowa City, IA $ 6,430,000.00 Architect's Estimate $ 7,061,320.00 Public Works and Engineering recommend award of the contract to Knutson Construction Services of Iowa City, Iowa. Funding for the project will be 80% Federal funds with a 20% local match of General Obligation bond proceeds. In addition, alternate bids were received to build an additional one to three floors of which Knutson Construction was also the Iow bidder. The City has six months to exercise these options for the additional floors. The execution of these options will depend on the availability of additional federal funding. (1) CONSIDER A RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION WITH THE IOWA DEPARTMENT OF TRANSPORTATION FOR FUNDING FROM THE IOWA CLEAN AIR A'I-I'AINMENT PROGRAM (ICAAP) FOR THE ARTERIAL STREET TRAFFIC SIGNAL INTERCONNECTION PROJECT. This application is for funding to interconnect traffic signals in arterial street corridors in Iowa City. The total amount being requested is $197,491, which will be matched with $49,373 in local funds. This project will allow traffic signals on major streets to operate more efficiently. Comment: Liberty Bank, Iowa City, Iowa has requested that the City approve a Subordination Agreement for 434 Westside Drive to refinance a mortgage. On May 31, 2002, the owner of the property received a loan from the City of Iowa City's Downpayment Assistance for $5,000. Comment: Hills Bank and Trust, Coralville, Iowa has requested that the City approve a Subordination Agreement for 428 Fifth Avenue to refinance a mortgage. On May 8, 1996and on January 8, 1997, the owners of the property received loans from the City of Iowa City's Housing Rehabilitation Program for $25,176. The property is appraised for $99,290 which provides enough equity to cover the City's second lien position. Comment: The owner of the property located at 1211 Sheridan Avenue received assistance through the City's Housing Rehabilitation Program totaling $13,781.86. The financing was in the form of two conditional occupancy loans and a five-year declining balance loan. The loans have been paid off; thus the liens can now be released. (5) CONSIDER A RESOLUTION AUTHORIZING THE HISTORIC PRESERVATION COMMISSION TO FILE AN APPLICATION FOR A CERTIFIED LOCAL GOVERNMENT (CLG) GRANT TO OBTAIN FUNDS FOR THE PURPOSE OF PREPARING A NATIONAL REGISTER OF HISTORIC PLACES NOMINATION FOR THE PROPOSED DOWNTOWN HISTORIC DISTRICT. Comment: In the Survey and Evaluation of the Central Business District dated April 2001, architectural historian Marlys Svendsen of Svendsen Tyler, Inc. recommended the nomination of the proposed Downtown Historic District to the National Register of Historic Places. In order to receive federal funding through the Certified Local Government program, the Iowa City Historic Preservation Commission is requesting approval of this grant and allocation of the required matching funds. Listing on the National Register of Historic Places does not involve any legislative actions or regulative processses. It does however, make available to property owners tax incentives for substantial rehabilitation of their building, and the opportunity for the business community to market downtown as a historic shopping and entertainment district. ~)'~..-.1~o (6) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE IOWA AVENUE MULIT-USE PARKING FACILITY PROJECT. PUBLIC HEARING ON AN ORDINANCE REZONING APPROXIMATELY 8.7 ACRES FROM INTERIM DEVELOPMENT (ID-RS) TO SENSITIVE AREAS OVERLAY-LOW DENSITY SINGLE-FAMILY (OSA-5) LOCATED ON THE WEST SIDE OF FOSTER ROAD. (REZ03-00017/SUB03-00019) Comment: At it July 17 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a staff memorandum dated July 11. Approval of this rezoning wiJl allow the development of Oakmont Estates, an 8.7-acre, 16-1ot subdivision on property that contains a woodland and regulated slopes. The plan includes the dedication of 1.48 acres of land containing regulated slopes and woodlands to the city. The sensitive areas plan includes a tree protection and tree replacement plan for portions of the woodlands. CONSIDER AN ORDINANCE CONDITIONALLY REZONING 5.69 ACRES FROM LOW-DENSITY SINGLE-FAMILY RESIDENTIAL (RS-5) TO LOW- DENSITY MULTI-FAMILY RESIDENTIAL (RM-12) LOCATED AT 1715 MORMON TREK BOULEVARD. (REZ03-00018) (SECOND CONSIDERATION) Comment: At its June 5 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval subject to a conditional zoning agreement requiring approval of an OPDH (Planned Development Housing Overlay) and establishment of a 70-foot wide evergreen buffer along Highway 218 in the event that the property redevelops for residential use. In a report dated June 5, staff recommended approval This property is the location of All Nations Baptist Church. I c. CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF VILLAGE GREEN PART 19. (SUB03-00029) Comment: At it July17 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval subject to staff approval of legal papers and construction drawings. It is anticipated that legal papers and construction drawings will be approved by September 9. Staff recommended approval in a staff memorandum dated July 17. Approval will allow the development of Village Green Part 19, a 7.11-acre, 10-lot residential subdivision located at Wintergreen Drive west of North Jaime Lane. Deferred August 19. THE IOWA CITY HOUSING AUTHORITY AMENDED PUBLIC HOUSING ADMISSIONS AND CONTINUED OCCUPANCY PLAN (ACOP). Comment: HUD mandated Community Service Requirement. The community service and self-sufficiency requirement is intended to assist adult public housing residents in improving their own economic and social well-being and give these residents a greater stake in their communities. The community service and self-sufficiency requirement allows residents an opportunity to "give something back" to their communities and facilitates upward mobility. The community service and self-sufficiency requirement applies to all adult residents in public housing except for those exempted under Section 12(c) of the United States Housing Act of 1937, as amended. Specifically, every adult resident of public housing must contribute eight hours of community service each month, or participate in an economic self-sufficiency program for eight hours each month. This requirement does not apply to Section 8 tenants. Interim Reexamination Policies. As a result of HUD recommendations following a Rental Integrity Monitoring review, the ICHA is opting to recalculate rent based on an increase in earned income only during the annual reexamination, unless earned income causes the total family income to exceed 80% of the Family Median Income. HUD requires that only decreases in income are processed at interim reexaminations, the ICHA was processing both increases and decreases. The ICHA is changing this policy to promote economic self- sufficiency by encouraging participants to maintain employment, to seek opportunities for better employment, and to change the behavioral patterns that lead to ongoing poverty. Secondly, this policy change will increase administrative efficiency and effectiveness by reducing redundant processing of information and verifications. Correspondence included in Council packet. CONVEYANCE OF 1926 BROADWAY STREET AND 1946 BROADWAY STREET TO HAWKEYE AREA COMMUNITY ACTION PROGRAM (HACAP) BY AMENDING THE REAL ESTATE CONTRACT EXECUTED ON NOVEMBER 21, 1995, FOR THE SALE OF '1926 BROADWAY STREET AND 1946 BROADWAY STREET. Comment: The City of Iowa City sold two multi-family buildings located at 1926 and 1946 Broadway Street to HACAP in 1995 for their appraised value pursuant to an installment contract. The contract provided for monthly payments with interest at 7% per year and a balloon payment due on February 1, 2006. HACAP has requested an amendment to the contract that will provide for monthly payments with annual interest of 5.5% and with the balloon payment due on October 1, 2008. The sale price remains the same. The amendment will allow HACAP to continue to provide transitional housing services to the homeless. The amendment also includes an increase in the amount of insurance coverage to meet the City's current minimum requirements. HACAP is presently current on the contract payments. CONSIDER AN ORDINANCE REPEALING TITLE 6, "PUBLIC HEALTH AND SAFETY," CHAPTER 1, "NUISANCES," SECTION 2, "PUBLIC NUISANCE DEFINED; PUBLIC NUISANCES ENUMERATED," SUBSECTION (Q), "VEHICLES ILLEGALLY PARKED, STORED, PLACED, OR KEPT ON PRIVATE PROPERTY." (FIRST CONSIDERATION) Comment: The City Council, at its meeting on August 19, chose not to amend this ordinance to address the enforceability issues created by the exceptions to the ordinance's limit of 6 vehicles on residential lots, and directed that the ordinance be repealed. CONSIDER AN ORDINANCE AMENDING TITLE 8, "POLICE O~-~q~ REGULATIONS," CHAPTER 8, "POLICE CITIZENS REVIEW BOARD," SECTION 8, ENTITLED "BOARD COMPOSITION; LIMITED POWERS OF THE BOARD," TO PROVIDE THAT PEACE OFFICERS EMPLOYED AS SUCH BY THE CI~ OF IOWA CI~ WITHIN FIVE YEARS OF THE APPOINTMENT DATE SHALL NOT BE APPOINTED TO THE BOARD. (SECOND CONSIDE~TION) Comment: Due to the appearance of a conflict, a majority of the City Council directed that the ordinance be amended to exclude peace officers employed by the City of Iowa City within five years of the appointment from se~ing on the Police Citizens Review Board. CONSIDER A RESOLUTION APPROVING FUNDING FOR DELUXE BAKERY o~-,,~(o FROM IOWA CITY'S COMMUNITY DEVELOPMENT BLOCK GRANT - ECONOMIC DEVELOPMENT FUND AND AUTHORIZING THE CITY MANAGER TO ACT AS THE CHIEF ADMINISTRATIVE OFFICER AND SUBMIT ALL NECESSARY DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. Comment: On August 29 the City Council Economic Development Committee recommended $15,000 in funding for this project. The Council Economic Development Committee has recommended that these funds be as a loan at 3% interest for a term of 5 years. CON~IDER A RESOLUTION RESCINDING RESOLUTION NO. 94-309 AND O$-,~t~.'7 ADOPTING IN LIEU THEREOF A NEW RESOLUTION MODIFYING THE COMPOSITION OF A SENIOR CENTER COMMISSION FOR THE' CITY OF IOWA CITY, IOWA, AND ESTABLISHING THE MEMBERSHIP, TERMS, DUTIES, POWERS AND AUTHORITY OF SAID COMMISSION. Comment: Resolution No. 94-309 established a Senior Center Commission ("Commission"), and it was based upon a 25E Agreement between the City and the County for the funding and operation of the Senior Center. Because the 28E Agreement has been dissolved, Resolution No. 94-309 needs to be rescinded and a new resolution adopted. The major change is the composition of the Commission. Under Resolution No. 94-309, the City Council appointed six members of the Commission and the Board of Supervisors appointed three. The proposed resolution changes the composition of the Commission by decreasing its size from nine to seven members. Council will continue to appoint six, but there is a new provision for an at-large member to be selected by the six Council appointees. The at-large member must be a qualified elector of Johnson County but not necessarily an elector of the City. The Board of Supervisors will not appoint any member. The six current Council appointees will continue to serve out their terms. At its meeting on August 8, the Commission unanimously approved a motion recommending that Council adopt this resolution. Action: ITEM 14. CONSIDER A RESOLUTION APPROVING BY-LAWS OF THE SENIOR , 05 -~ ~ ~(~ CENTER COMMISSION. Comment: The Senior Center Commission unanimously approved new by- laws. The Rules Committee has reviewed the by-laws and has recommended adoption. The changes reflect the resolution passed at the August 19 meeting, which decreased the size of the Commission to seven (7), eliminated appointment of three (3) members by the Board of Supervisors, and provided for an at-large Commission member to be selected from the six (6) Council appointees. A more detailed memorandum from staff was in the Council packet for the August 19 meeting. Rules Committee met on August 21 (minutes included in Consent Calendar) and approved by-laws as amended. The Rules Committee has reviewed the by-laws and has recommended adoption. The primary change is to the Board's authority to make it consistent with Ordinance No. 02-4038, which is codified at Iowa City City Code section 14-5M- 2. Comment: Ordinance 97-3792 establishes the Police Citizens Review Board and sets forth mechanisms for complaints. The Ordinance aisc provides the City Council to grant extensions of the 45-day reporting requirement for good cause.
