Review Zoning Matters 97-75 S2 Nov/Review Zoning matters .... a. CONSIDER A MOTION SETTING A PUBLIC HEARING FOR JUNE 3 ON AN ORDINANCE AMENDING TITLE 14, CHAPTER 6, ENTITLED "ZONING," ARTICLE P, ENTITLED "FENCES AND HEDGES," TO CHANGE THE VISION TRIANGLE REQUIREMENTS AT INTERSECTIONS. Franklin/First item is setting a p.h. for June 3 on an ordinance amendment to change the vision triangle requirements in intersections. There are a number of these. Two of them I am going to highlight because you may not want to set p.h. b. CONSIDER A MOTION SETTING A PUBLIC HEARING FOR JUNE 3 ON AN ORDINANCE AMENDING TITLE 14, CHAPTER 6, ENTITLED "ZONING," ARTICLE O, ENTITLED "SIGN REGULATIONS," SECTION 5, ENTITLED "SIGNS PERMITTED BY ZONE; REGULATIONS," TO PERMIT PROJECTING SIGNS IN THE CB-5 AND CB-10 ZONES. Franklin/And that is the case with the next one which is also setting a p.h. to permit projecting sings in the CB-5 and CB-10 zones. This is coming back to you with a recommendation .... from P/Z and staff not to permit projecting signs .... that is, continue with the prohibition. If you would like to have the p.h. and go through the deliberations... this one had more discussion than one of the other ones I am going to point out to you in terms of both Design Review, P/Z Commission weighing different possibilities... The staff also put together a proposal if you did wish to have projecting signs, some recommendations for certain guidelines for them. Nov/On these projecting signs, did we state clearly that is it going to tell us the current time of the current temperature? .... Franklin/This would open up the possibility for projecting signs such that you would not need to contrive a projecting sign by using the time and temperature .... Franklin/That is another issue then. This was to open up projecting signs. Norton/There were mixed opinions .... Thornberry/... If we said they can be 2 feet by 3 feet or something .... Franklin/It sounds like there is some interest in it, so why don't you just go ahead and set the p.h. Norton/What are we going to do? Franklin/You are going to set a p.h. tomorrow and then...June 2 we can get into the intricacies of it. Kubby/ Vanderhoef/ Vanderhoef/Just go ahead and set the p.h. on that. Nov/We are setting a p.h. on fences without any discussion? Franklin/Yes, because that is a recommendation from P/Z to change the Code. Nov/Okay. Franklin/And item b. and item d. were two in which the recommendation was no change. Thus you can think about whether you want to set the p.h. but you are not compelled to. You just decided on item b to go ahead and set the p.h. because there is a enough interest in projecting signs, to talk about it. c. Franklin/To permit portable signs in CB-2, CB-5, and CB-10 zones .... Those sign like out in front of Jimmy's .... Season's Best .... Nov/Sometimes they are projecting signs. Nov/I understand .... anything that is perpendicular to the building and those signs can be perpendicular to the building. Norton/ Nov/They really can block a driveway. Franklin/That is part of the rules that is in there. Kubby/Is there any interest in .... have some kind of sunset clause .... force ourselves to review it .... maybe we need to think about that for any kind of signage .... experimenting... going to review this as part of the ordinance in a year .... Nov/I think you can do this with a portable sign permit ..... Kubby/ Nov/ Norton/Can't we have the hearing and then decide? Council/ Franklin/You are talking about a sunset provision just for the portable signs, right, Karen? Kubby/If we end up going for projecting signs, to do- For all of them to think about. Thornberry/...it gets into some money. Norton/They are looking at Design Review taking a look at most of these things because they can all be overdone. Nov/ Franklin/Then you will set the p.h. on the portable signs also. d. Franklin/Set a p.h. on an amendment adopting design criteria for changeable copy signs. This was a request that came out of Design Review Committee .... DR Committee, P/Z Commission and staff are all in concert that no change should be made ..... The question here .... do you want to go ahead and set this p.h. or not? If you decide not to... then you just don't second the motion to set the p.h. Vanderhoef/Tell me what the ordinance is right now. Franklin/That you can have changeable copy signs... certain regulation as to size .... Usually fascia signs .... Nov/Sometimes in a window. Vanderhoef/Can they be on the outside of a building? Franklin/Yeah. Norton/This is only regulating them outside a building? Franklin/Yes. Our Sign Regulations only deal with those that are outside. Thomberry/What do we do? CONSIDER A RESOLUTION AMENDING THE COMPREHENSIVE PLAN TO INCREASE THE DENSITY FROM 2-8 DWELLING UNITS PER ACRE TO 8-16 DWELLING UNITS PER ACRE FOR AN APPROXIMATE 2.38 ACRE AREA LOCATED AT THE NORTHEAST CORNER.OF THE INTERSECTION OF SCOTT BOULEVARD AND LOWER WEST BRANCH ROAD. Franklin/Consider a resolution amending the Comp Plan for the property on the comer of Lower West Branch Road and Scott Blvd .... assisted living development. F. CONSIDER AN ORDINANCE AMENDING THE ZONING CHAPTER BY CHANGING THE USE REGULATIONS FROM RS-5, LOW DENSITY SINGLE- FAMILY RESIDENTIAL, TO OPDH-12, PLANNED DEVELOPMENT HOUSING OVERLAY, FOR A 2.38 ACRE PROPERTY LOCATED AT THE NORTHEAST This represents only a reasonably accurate transcription of the Iowa City council meeting of May 19, 1997 WS051997 May 19, 1997 Council Work Session page 5 CORNER OF THE INTERSECTION OF SCOTT BOULEVARD AND LOWER WEST BRANCH ROAD TO PERMIT A 37 UNIT MULTI-FAMILY BUILDING FOR ELDERLY HOUSING. (REZ97-0002) (FIRST CONSIDERATION) Franklin/The re-zoning for that, the first consideration. If the resolution fails, then the zoning should not proceed. G. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 6, ENTITLED "ZONING," TO PROVIDE ELDERLY HOUSING ALTERNATIVES. (SECOND CONSIDERATION) Franklin/Second consideration on the Elderly Housing alternatives. Nov/We have a letter from Stephen Greenleaf about changing that whole thing... quite a bit of change .... I thought it went to everyone at home ..... Council/(All talking). Vanderhoef/ Franklin/A kitchenette, it is a small kitchen or an alcove with cooking equipment .... In the Code it says if it is not specifically defined in the Code, that you go to Webster's .... dictionary and I did. Thomberry/What constitutes a kitchen? Franklin/Cooking equipment and that would be a stove, a refrigerator, a sink, a cupboard... standard in a kitchen .... You can put a sink in a kitchen .... Thornberry/You can put a sink in a bathroom. It doesn't make it a kitchen. Norton/ Nov/ Franklin/I received this letter this afternoon and I have looked at it. Basically what I see happening here is we are going right around to where we started about a year ago which was a unit that did not meet the definition of Oder family home and consequently an effort to change that definition of elder family home. In response to that problem a year ago, we decided to look at housing alternatives and that is where the elder congregate housing comes up. We have looked at Mr. O'Brien's plans and I think Jim, have you gotten a letter from Melody yet? Franklin/And basically there in one lot where there is a problem and it is that is designated as elder family home which has too many units on it and does not meet the definition of elder family home. Nov/Does it meet the definition of congregate housing? Norton/It has too many units on it. As an elderly congregate it would only get 8, I think. Franklin/That is correct. It has too many units regardless of whether you call it elder family home of elder congregate housing. It does not meet the definition of elder family home but it could meet the definition of elder congregate housing with four fewer units. It would fit. Norton/It also has that problem of being kind of a vertical duplex, two leveled .... Franklin/With elder congregate housing, you could do that. Norton/... I am curious when we are going to consider those, if they are to be considered? Franklin/I would like at least an opportunity if you do want to consider this, to respond to this letter. My immediate response is this goes back around to where we were. Norton/ Nov/I am not advocating that we make these changes but I do think we have to write a response. Franklin/Okay. Norton/I think we need to discuss them a little bit ....Could _we pass second consideration and then discuss them? Franklin/Yes. Norton/ Franklin/On the third then you can amend it. If it is substantial, it will need to go back to the P/Z Commission. These would be substantial. If you were to adopt these changes, this is entirely different concept for elder family homes, it would need to go back to P/Z Commission for re-consideration. Vanderhoef/Part of this has been resolved... elder congregate housing .... Only thinking would still request people to look at would be on page 5, under Article L., 1. where in the special exception and provision use we are talking about that they have to verify that the owner will occupy one of the dwelling units on the premises .... Norton/You are talking about a change for elder family home, not for the particular situation we are looking at ..... Vanderhoef/Owner or responsible party is all that I would like to see in there .....I don't think it would make any difference whether it was a owner or a verified responsible party ..... Norton/ Nov/This would mean that you could rent a large house and have this like a business. It would have to be occupying that house while you are doing it .... Vanderhoef/ Franklin/And it would still be a single family detached or zero lot line house, not a duplex ..... It could not be a duplex, period. Because what it says right now is that elder family home, elder group home are in detached single family houses or zero lot lines, not a duplex. Vanderhoef/And in those two instances I would like a possibility of a responsible party living in that unit. Norton/Wouldn't that be an amendment that we could consider tomorrow night that would not change the substance of this thing sufficiently to send it back? Franklin/I got to think about what the ramifications of that are because when we did elder family home and elder group home, we thought we had it all clearly defined in everybody's mind what it was and then when we got into new construction and the construction of duplexes where you could have 8 on either side, it then became a significant density issue and that was not what was originally conceived. I mean we originally were thinking big old houses that a number of elderly people were going to live in together and share the cost. So I want to think about whether that is significant or not. I would prefer that we get an answer from staff and if we amend, we do it on the third. Vanderhoef/I am okay as long we we check that one out. Lehman/Karin, you have read this? Franklin/Yes .... Lehman/I see Mr. Greenleaf is here. Is there anything he needs to tell us that he hasn't told us in his letter? Franklin/I don't think so ..... So we will respond to the responsible party issue and the letter from Steve for your June 3 meeting and tomorrow night you can just do the second consideration. Thomberry/Just a question... owner occupied... and the owner dies .... elder family home. Franklin/An elder family home, it could be owned by all of the people that live there. Thomberry/What about the owner occupied and the owner dies? What happens to that home? Franklin/Elder family home, you could have 8 people living there, all of whom owned a share of the house .... You could have one person that actually had title of the house and the others are living there by arrangement. Then that person dies, that property would have to be passed onto an heir who doesn't live there. Then you have a problem. Norton/I think it has got to come down to responsible party. Thomberry/...if the new owner has a responsible party .... they are responsible for it .... It can continue .... Perhaps owner occupied is a little too restrictive .... Kubby/It makes it guaranteed it is locally owned and managed. Thomberry/ Council/ Norton/I think it has to come back to something like responsible party ....some conditions... CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 6, ENTITLED "ZONING," ARTICLE N, ENTITLED "OFF-STREET PARKING AND LOADING," SECTION 1, ENTITLED "OFF-STREET PARKING REQUIREMENTS," TO ALLOW EXISTING FRATERNITY/SORORITY HOUSES TO BE CONVERTED TO ROOMING HOUSES WITHOUT HAVING TO PROVIDE ADDITIONAL PARKING. (PASS AND ADOPT) Franklin/The next item is the ordinance to allow existing fraternities and sororities to convert to rooming houses. You have a memo from Bob in your packet .... There may be one or two circumstances where you have a very large lot .... difficult to place the parking to make the conversion. Overall... the ordinance would not then be needed. Norton/What do we do? Defeat it then? Franklin/Yeah, that is the easiest. Vote it down. Vanderhoef/As I see it, the way it sits right now, it is at least to the advantage of the owner, the fraternity, to have the opportunity to sell this property ....grandfather clause, would that pass on again if that went to an apartment house? Franklin/Whatever the use converts to and it can convert to any... residential use that requires no more spaces than the fratemity or sorority. When that new use is in there, they will have a certain requirement for parking by the book, by the Code. That will then establish the new conversion rate .... Vanderhoef/...it could never go back to either a fratemity or sorority? Franklin/That is correct. That is possible. Norton/ Vanderhoef/My thought .... it becomes a decrease value- Franklin/...For the person who buys it... It could be converting to an apartment building that requires... 24 spaces... So then you would just keep that 24. So if the new use requires exactly the same amount as the old use, then you continue it on ..... Vanderhoef/There was something in the notes about that there is one year on this. Franklin/ .... say you have a conversion to a rooming house and it only stays there for nine months, once you make the conversion to that new use, then that sets it. Vanderhoef/Fraternity house that was being rented as a rooming house? Franklin/You have changed the use when it is rented even if the ownership remains the same. Thomberry/So when the fraternity can come back and be in existence again, then they couldn't be in that location? Franklin/They would have to comply with whatever that reduced parking requirement was. They could have no more than that number of people or they could use no more than a certain square footage which it is very difficult of the structure. Nov/If a fraternity rented their house because they were disqualified and then they were re-accepted into the community .... They wanted to re-use that same house. The tenants would move out, the fraternity would move back in and they would have fewer people in it because the parking had changed. Franklin/Well, they should meet then whatever the parking requirement was- Kubby/ ....That may not be an issue for that particular one. · Vanderhoef/ Nov/Rule was in place. Lehman/ Franklin/It is use. Nov/I am seriously considering whether the fraternity that wants to go back into that particular house can have the same number of people based on the changed use? Franklin/We will have to look at it. Thornberry/What you are saying is- I voted against this ordinance for the wrong reason. Franklin/That is right. Franklin/ i. CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF WALDEN HILLS, A 40.7 ACRE, 53-LOT RESIDENTIAL SUBDIVISION LOCATED ON THE NORTH SIDE OF ROHRET ROAD, EAST OF HIGHWAY 218. (SUB97-0010) Franklin/Resolution approving final plat of Walden Hills. The construction plans on this are not completed. We will let you know tomorrow if that is all taken care of by tomorrow evening. Kubby/Can we talk about this? Norton/Do we have to do anything about the road comments?... Franklin/That has been resolved as far as I know .... Chuck .... issue that is addressed in Linda's memo was settled in that the neck downs will be installed. Kubby/What is the note on the plat? ....Issue. But whether the engineer would certify them or not. Schmadeke/As far as I know, the engineer still wants that disclaimer on the plans. Kubby/What is the implications for the city .... Lehman/The disclaimer is for the protection of the engineers? Schmadeke/That is correct. Lehman/ Schmadeke/He would retain some liability as being the designer. We would be accepting his design. Dilkes/Somebody could sue the city is they had a problem there regardless of whether the disclaimer was on the plat. I think it is a question more of the engineer's liability and that is what he is trying to get rid of.... Are there more accidents? .... Neck down intersections, are there more accidents at these intersections then at regular sized intersections? .... Davidson/I think, Dean, the notion of neck downs and all of these traffic calming issues .... they are an innovation... based on what we assume to be sound engineering judgment ......This is a publication from the Institute of Transportation Engineers ....I will quite ....about speed humps... a much more severe traffic calming device to put on a street .... "There is no evidence indicating that properly designed and installed speed humps have caused or contributed to accidents or increased accident rates.". ....I couldn't find anything specifically about neck downs. It is an innovation .... Thornberry/On Dubuque Street, south of Burlington, a necking situation right in the middle of the street .... Davidson/...traffic calming devise .... Thomberry/That is kind of dangerous right there ..... Then I am thinking you have got a narrowing of a street at an intersection... more accidents... more curbs being replaced .... Franklin/The neck down is not in the travel lane .... Kubby/There is an issue that this is a final plat. We have approved the preliminary plat and this is not substantially different... We really don't have an ability to say no because of that because we have already approved this. Thomberry/There is an engineer .... that has a problem with necking. Kubby/Our own engineers had problems with it... professional conferences .... Dilkes/Regardless of what the statement from the certifying engineer is on the plat, because these are innovative techniques, if there is an accident there, it is going to be an issue probably for litigation as to whether this was in accordance with general engineering practices ..... Norton/ Nov/We understand that if they don't work, we can take them out. Thornberry/ Nov/...bus stops back from an intersection based on the fact that the street is wider ..... Davidson/As it stands now, there will be no bus stops on Shannon Drive .... Franklin/This is also a collector street .... When we started this whole discussion of traffic calming, we talked about it just on local residential streets... decision of the council to go for collector as well as the local residential because of the input you were getting from Teg Drive neighborhood .... It is going to slow traffic down .... Council/ Davidson/Staff has not worked with the developer to encourage these because we felt that what the wanted to do was unsafe .... What we do believe is that collector street will have traffic on it that goes in excess of 5 miles per hour over the posted speed limit .... if we don't do something of which we worked with a couple of different possibilities with a developer and that is based on the policy you all adopted .... Franklin/We would not recommend your re-considering that policy right now since we have not much traffic calming and we do know that we have neighborhoods that are very concerned about traffic going through the neighborhood and as we grow more, that concern will increase or you will hear it more often from people that are living more towards the center of the community. Norton/Let's try. Kubby/I am ready. Council/(All talking). Nov/This neck down system is really feasible after constructing a new street. The humps can be added and subtracted more easily. Vanderhoef/And they all cost money. Thornberry/And changed more easily then. Nov/Okay .... This represents only a reasonably accurate transcription of the Iowa City council meeting of May 19, 1997 WS051997 May 19, 1997 Council Work Session page 15 Iowa River Power Dam Renovation/Iowa River Corridor Trail Project 97-75 S2 Nov/We are on the Iowa River Dam. Davidson/What we thought we would do here is Marv Haug from H. R. Green is here as well. I am just going to...big picture overview and then Marv is going to talk specifically about the dam issue which is 4/19 on your agenda ..... agreement between Iowa City and Coralville .... (Presents overhead projection/slides). This is the Iowa River Corridor Trail System here. The area that we are talking about specifically is the power dam right here between Iowa City and Coralville .... This is really the backbone of the trail system that is slowly getting established in the community. We have several elements of this constructed already .... (refers to map) .... Item #17 on your agenda tomorrow night is construction of a raw water main in this area here (refers to map). The proposal is to also construct a trail over the top of it ....important project to University of Iowa, access to Mayflower Apartments ....intended to utilize existing Taft Speedway ....bicyclists ....access road... Elks... (refers to map) .... as River Corridor Trail ..... City property... construct a trail through there... The County, further north, long range plant to reconstruct the trail on County Road W66 .... funds through ECCOG .... The dam issue... is a very important one for Coralville. JCCOG has studied this area (refers to map) along First Avenue .... very difficult to even reconstruct anything through there .... Coralville is extremely interested in this project as well. As of this does come from the adopted Iowa River Corridor Trail Plan adopted by Iowa City, Coralville, JCCOG. It is a consistent adopted planning document that we are attempted to use when we implement part of this. Any questions about the big picture here about how this all fits together? Norton/On the west side of Coralville, what happens to it given the fact that you can't come back down towards Crandic Park very well? Davidson/Right now Coralville has an existing bike lane which is on 5th Street through Coralville .... considered very reasonable for linking the rest of that city to the River Corridor Trail. The actual crossing First Avenue... studying First Avenue Corridor within Coralville .... Marv Haug/Maybe what I should do is show some slides that we have used in a report that we have prepared to kind of outline some of the problems that we have seen at the dam ..... Give a little background as to why we are doing some of the work that we are on the dam itself. (Presents slides). This represents only a reasonably accurate transcription of the Iowa City council meeting of May 19, 1997 WS051997 May 19, 1997 Council Work Session page 16 CHANGE TAPE TO REEL 97-81 SIDE 1 Haug/Chuck, do you know if if there was... actual date of the dam itself?. I guess I am not aware of any. This is the existing tress, a walkway that is out there ..... notice that it is not the straightest along here. This is a date of 1891 on this particular stone .... there is water coming around the backside of this west abutment .... (refers to slides). So we are getting some water passing around the backside of the dam which is on the west abutment of the dam .... not a very good situation ....Placed some sandbags along the top on one area ..... We did get the Corps to agree to lower the rate of the output from the Coralville Reservoir to 500 els and that considerably helped us in doing the evaluation of this dam .... We used divers also in doing this study... identify areas of distressed .... damage done to the piers on the lower end... due to freeze thaw action... concrete is from about the 1920's... also seeing some of the rebars exposed... This is the east abutment... cannot find any drawings that showed anything on this east end. There are some large pieces of concrete that have broken off and fell down .... small hole at this location .... This that hole again where water is bypassing and coming over the dam .... One of the divers did find a very large hole... 2-3 feet in diameter... water was coming through the dam at a pretty high velocity at that location ....That is all the slides that I have. What we have done here is to re-do the boat ramp .... This is the boat ramp that is located in Coralville on upstream side of dam... Edgewater Park .... We have come in and designed a boat ramp that is considerably steeper. This is the outline of the new one ....This is the mitigation at the fraction of the cost of replacing a new fish ladder.
