Public hearing on an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article P, entitled "Fences and Hedges," to change the vision triangle requirement at intersections. Franklin/The first item is a p.h. on an ordinance amendment to change the vision triangle requirements at intersections .... I want to introduce to you Doug Ripley ..... our Transportation Engineering Planner... He did a lot of work on this particular item. This is to address the issue of a vision triangle at street intersections and basically .... to amend the regulations such that on local streets, residential streets, that triangle is measured along the curb line as opposed to along the r.o.w. line .... Nov/ ....Sounds clear, let's do it. Norton/ Franklin/Does everybody understand this totally? Nov/Yeah. Norton/ Franklin/Then there is the solidity requirement or lack there of. You can see through it. Nov/I assume that solidity is measurable? Franklin/Yes. Norton/Don't we set a stringent requirement of that? .... Franklin/20% or less. Public heating on an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article O, entitled "Sign Regulations," to permit projecting signs as a provisional sign in the CB-5 and CB-10 zones. Staff memorandum included in Council packet. Franklin/A p.h. to permit projecting signs as a provisional use in CB-5 and CB-10 zones ..... Not something that was recommended by either the P/Z Commission, DR Committee or the staff. However the DTA did recommend it. If you do wish to pursue the allowance of projecting signs, we are suggesting ....there should be some controls on them as to size, illumination, etc ..... Norton/Can I bring my pictures, too, for the p.h.? Franklin/If you would like to, yeah. Norton/ Lehman/ C. Public hearing on an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article O, entitled "Sign Regulations," to permit portable signs as a provisional sign in the CB-2, CB-5, and CB-10 zones. Franklin/P.h. on amendments to the sign regulations to permit portable signs as a provisional signs in CB-2, CB-5 and CB-10 zones ..... on and around the downtown .... This will them on private property and on public r.o.w. is someone has a sidewalk cafe permit .... examples... Jimmy's has a valet parking sign that they put out at the sidewalk on Friday nights. That would not be permitted under this ordinance. It is not permitted now. It also would not be permitted with this change .... It would have to be either back onto the private property of Commerce Center or you could have someone standing them ..... Norton/ Kubby/You can wear a sandwich board in public property. Norton/That is the way to get the sign out there. Just put in one somebody. Franklin/I don't know .... Can they wear a sandwich board and stand out in front and say valet parking? Franklin/I don't know. Norton/Is that a portable sign? Franklin/Seem portable. I think it would be a moving sign, too. Okay, do you want me to find that out? Norton/Yes, sure. Franklin/ Nov/No, tell them they can't have a portable sign unless it is on their property. If they want to put a T-shirt that says valet parking on it, they can have a kid wear a T- shirt. Kubby/I am going to be asking council to think about a sunset clause for this one because the signs are a real low investment .... Norton/I would support that. Thomberry/ Norton/ Kubby/I am going to bring that up tomorrow at the p.h.. Maybe people can comment on that issue. Nov/I also would like to say this is part of the changeable copy sign .....design... appearance... We have to think about those kinds ofth_ings also. Franklin/Right now there are no controls for that changeable copy in this provision. D. (REZ97-0002) (Second consideration) Franklin/The second consideration for the assisted living housing on Lower West Branch Road and Scoot Blvd. There is a request from the developer for expedited consideration of this. E. Consider an ordinance amending Title 14, Chapter 6, entitled "Zoning," to provide elderly housing alternatives. (Pass and adopt) Franklin/The pass and adopt on the elder housing alternatives and we have done an amendment to elder family homes that would not require them to be owner occupied. It refers to a responsible party that is managed and/or owned. So ownership is not required. Kubby/But that includes the fact that someone has to either own it or live there? Franklin/Yes, that there is a responsible party who lives there who may be the owner but does not need to be the owner. Norton/I have a question about that... meaning of responsible .... The manager, let's say, is living in the place .... Now how responsible can they be. At some point the owner has to be responsible .... Franklin/The person does not take over property owner responsibilities under the law. Nov/But they are responsible for operating the business ..... Norton/If that is understood. Thornberry/ ....we are talking about managing the facility. Franklin/It would be the owner that we would go against if there were any legal action. However, if we needed to notify them, we can notify them through the responsible part. We do that now with condominium associations .... Norton/ Kubby/I think those lines of responsibility are fairly spelled out in other parts of law. Did P/Z talk about that issue at all... owner occupied versus responsible party or owner? I did ask Bob and Melody whether they felt the change was anything that the P/Z Commission would be concerned about and if it should go back and they did not believe that it should. Kubby/I think this just creates a little more flexibility but still protects the residents as well as the city. Franklin/Okay. F. Consider a resolution approving the final plat of Walden Hills, a 40.7 acre, 53-1ot residential subdivision located on the north side of Rohret Road, east of Highway 218. (SUB97-0010) Franklin/The final plat on Walden Hills and this is ready to go. G. Consider a resolution approving the extraterritorial final plat of Meadow View Subdivision, a 31.5 acre, 10-lot residential subdivision located in Johnson County on the west side of Buchmeyer Bend at its intersection with Highway 1. (SUB97-0003) Franklin/A plat in the county, Meadow View Subdivision. This is a ten lot subdivision ..... Kubby/Great... additional r.o.w. for future realignment. Nov/I have a question about one of the notes on the plat. Outlot C has a note that says county to release to owner. What does that mean? Franklin/I don't know. I see what you are talking about. I will find out before tomorrow night ..... I will check. Norton/I didn't understand .... road is not realigned... and won't be for awhile. Is that right? We don't have a time table for the relocation of that road, do we? Franklin/That is correct ..... It will be up to the county to make the determination as to when that change needs to occur. Norton/Up to that time, does Lot 1 have access only at the northern portion or can it have access anywhere? This plat was revised from the preliminary such that more land was dedicated for that intersection realignment. So the requirement limiting access on Lot 1 could be released .... Norton/ Franklin/The concern initially was that access point would be too close to the intersection of Buchmeyer and Hwy 1. Kubby/Pressure to re-do it will come as more development happens out there and those county residents approach the supervisors and say there is no reason not to do it because you have got the r.o.w. Norton/Do we know anything about what is going on out here? What is the water septic and all that like?... Franklin/The water and the septic all have to be approved by the Health Department .... For it to go through final platting, that will need to have been already reviewed by the Health Department .... We don't do it at the city level .... Norton/We haven't seen anything about that ..... Franklin/The sheriff, the fire is the mutual aid is probably Solon. Norton/And it is consistent with the North Corridor Plan .... Franklin/Yep. Anything else on that one? Okay. H. Consider a resolution approving the extraterritorial final plat of Williams Woods Subdivision, a 22.99 acre, 4-lot residential subdivision located in Johnson County on Highway 1 West approximately 1.5 miles southwest of Iowa City. (SUB97-0011) Franklin/The Williams Woods Subdivision. This is a four lot subdivision on Hwy 1 West ..... Norton/What about the point .... that road goes up and down... hairy trying to get in and off that road. Now we are down to one access .... Franklin/Yes. P/Z was very anxious it not ever be converted to a real access, is that provided for here? And I sure agree with them because it is really sticky out there. Franklin/(Refers to map). This access point .... goes to Outlot B and Outlot A. Outlot B & A are reserved as open space and therefore that is not going to be anything other than agriculture or open space .... Kubby/This is a much better development than what we saw before .... Franklin/It is clustered ..... Norton/#965 is going to be in between them, presumably. Franklin/That is right. Norton/Gets kind of sticky when you look at the whole context. Franklin/In terms of access points, you are talking about. Okay. Atkins/Mr. Beckord from Chamber of Commerce is here. John Bechord/The Area Chamber would like to recommend that council adopt an ordinance which would allocate a pre-determined percentage of the cost of building projects funded by the city, commission and/or acquire original art or ornamentation be installed at the project site. It is also recommended that an organized mechanism be developed for commissioning, selecting, placing, maintaining and de-accessioning such art .... There are already these public art requirements for federal and state buildings ....1/2 of 1% of the projects cost for a federal or state funded building has to be allocated to art and we are proposing a similar commitment to public art be established at the local level. We have identified six main issues ..... The Arts Business Partnership Committee of the Chamber .... they started to look at the various aspects of a public arts program .... There are six main issues. 1. What should the percent allocation be? ....This book is called the Public Art Directory ....examples of public arts programs .....City of Scottsdale .... Austin, Texas .... Corpus Christi .... Richmond, Virginia... many examples in here. 2. What projects may be covered?... a lot of variance .... 3. How will the funds actually be spent? .... understand that public arts concepts go beyond traditional sculpture .....4. Should the percent allocation for art be mandatory for every project? ....some ....require a majority vote by council on a case by case basis ..... 5. Establish a selection and management mechanism .... give some suggestions ....on kind of art. 6. Establish a policy for selecting the artist for public projects ....preference for home grown artists .... Some of you... may seem curious the Chamber would endorse a policy proposal.. that may seem to add to the cost of a public building project. But when you educate yourself about the way these things work, the advantages of public art, the actual minimal costs ..... really not a big cost ..... Kubby/Even in a lot of private buildings ....banks ....that we all pay for .... Beckord/These are a one time allocation of funds .... and we have seen first hand the advantages of public art ....University ....kind of art, kind of environment and kind of energy these buildings ....finally it should surprised you the Chamber is supportive of the concept ....businesses in this community... biggest supporters of art ..... contributors to all kinds of art programs. It has been documented... art is an attraction.. develop a critical mass of art and cultural events, there are economic benefits. It is an investment ....Art if one of our area's most precious resources ..... Our support of this proposal .....I am certain our enthusiasm...this is public art .... Kubby/Let's start exploring the possibilities for Iowa City. Thornberry/Start exploring the cost of these things. Nov/I have a couple of ordinances that other cities have written. I will distribute copies. Norton/I have been of a mind that we ought to be doing this for a long time .... You name it, every city you like to visit does something in this vein. Beckord/ ....It is a draw frankly. You go to court houses... ornamentation .... Kubby/Dean is grumbling... Thomberry/I held up my budget book .... Norton/But in the long run we have to look at the investment, the virtues. Thomberry/This is one of the virtues. Norton/How small do those percentages go down? ..... Beckord/1/2 to 1 1/2% .... Nov/You can change proportions... for a utility oriented investment you are going to allow 1/2% and for some major public edifice, you are going to say 1%. Kubby/I am not quite sure how... I don't want this group to formulate an ordinance .... Basically you have provided us is some menus .... Norton/You don't have to re-invent the wheel here. It has been done in a lot of places. Nov/...we don't have to start writing ordinances. Kubby/I would like a group of people who are not us, give us what they think would be a good fit for our community. Atkins/Would you like us to draft a policy so you have some target to your debate?... you can decide how you want to take it from there. We ought to be the ones not to actually get into the details of selecting the art. But we should be the ones to say yes, we want to do this ..... This recommendation is here in front of us. It is a very easy process to make a decision based on this. Kubby/ Nov/ Norton/We might want to consider creating a cultural and arts commission first and let them work out and hammer out some of the details for our consideration .... Nov/ Kubby/ ....we need to make sure there are four people who support this concept .... Beckord/When you look at this... communities .... This is not some kind of trendy thing... These policies have been in place for years. Nov/ ....late 60's urban renewal. Kubby/Ernie, what do you say? Lehman/I will look at it. Kubby/Okay. Norton/Worth looking at. Nov/Definitely worth looking at. I think we ought to do it .... Norton/Ernie said looking at it .... Lehman/ .... I think if you applied that to our budget .... small portion of our city budget. I think we should probably look and see what it amounts to. Kubby/We could look at an average year ..... Have some idea for the next decade what it means financially and what it means, how those projects may have been different if those moneys had been applied this way. Norton/We have put nothing in up to until now .... It is not that we don't have any art in Iowa City. Norton/ Kubby/We spend hours and hours in this room... look at this room. This room could use some help. It is a nice room .... Beckord/ Norton/It is worth looking at .... Beckord/ Nov/There is going to be a lot of remodeling in this room... art among the remodeling .... Council/(All talking). Nov/Thank you, John. We had a note here that the DR Committee had said- Schoon/The Committee met this afiemoon. The applicant brought in their design after the mall had requested that they redesign their project. Nov/For what reason were they asked to re-design? Schoon/The mall is proposing to build a raised plaza along the Clinton Side of the building all the way from Talbot's down to Taco Bell and that is to provide accessibility to store fronts .... along Clinton Street. (Refers to plans) .... access to this raised plaza area .... This part of the restaurant will now be at the same level of this part of the restaurant which eliminates that accessibility issue on the interior of the restaurant? Norton/ Schoon/I believe it will be approximately 10 -12 feet. They don't have any details yet... just illustrations... Mall will be doing this, the plaza, while Taco Bell will be doing this project themselves .... (refers to plans) .... They will just construct something that will be temporary to serve the Taco Bell which hopes to open this August. Kubby/ ....even less than the planter? Norton/They are not coming into the r.o.w.? Schoon/Those details we don't have yet. Thomberry/... They have been having a heck of a time with these mall people .... Design Review, they have had a problem. Kubby/I am glad we have had Design Review. Thomberry/I am just telling you what has transpired... a problem with Design Review. NoVon/ Thomberry/ ....It looks really nice. Schoon/The DR Committee met today. They recommend approval subject to three conditions. The Committee recommended they go back to one fascia sign that they had started with the original project ..... They wanted to limit the number of signs .... The other condition is that the plaza area... will have to be reviewed and approved prior to its construction and that also given that they are reducing the number of fascia signs down to one, that the applicant will be able to use window signs and door signs along the doors (refers to plans). Nov/What kind of awnings are they using? .... Are they also talking about non-lighted awnings? Schoon/Correct. They are non-illuminated awnings. Thornberry/Every window then would be available for advertising, then. Is that correct? Schoon/Correct .... Kubby/You would suggest not allowing advertising in every window? Thomberry/Could be very flooded. Norton/Particularly if that is repeated all the way down. Seems like there ought to be some reasonable number of window signs .... Couldn't there be some limit on the number of window- Schoon/I was just asking Karin. There is a limit on 25% of the window area can be used as signs. Council/ Kubby/They understand that? Schoon/That is our standard sign ordinance. Norton/The total window area for the enterprise? Kubby/Including temporary signs like for specials and sales? Norton/Maybe that will do it. Council/ Kubby/ ....Should we do something different? .... It has nine panels. Norton/But if 25% of the total window area were sign, it would be pretty heavy duty, I think. Thomberry/ Norton/That is the only existing guidelines we have. Kubby/Could we be more stringent than that? Schoon/Council could add or elaborate on that condition. Thomberry/We would have to go back to that original Sign Ordinance. Nov/ Kubby/Is there interest by people in being more stringent with this project than our Sign Ordinance? Thomberry/I don't think I would be willing to do that but I would be willing to look at the sign ordinance .... Kubby/ Nov/It is possible for us to restrict the portable signs ....I don't think you can do it with projecting signs. Thornberry/I don't think that has anything to do with the amount of windows ..... Nov/ Norton/...Dean's point is 25% of that glass area is pretty substantial signage. Davidson/You have before you for consideration the first traffic calming proposal that has gone through our approved process .... Just a couple of clarifications I wanted to make in the material that you received. The Traffic Count Report that you received, this is kind of a format that we are using with neighborhood associations that has so far been real effective .... typographical error in the second paragraph. We used a template from the project with the Grantwood Neighborhood Association. That is why that Lakeside Drive showed up... make that Teg Drive .... Page 4 .... second paragraph .... This whole report pertains to only Teg Drive. Also wanted to point out.. neighborhood group .... Police Department was out there with some patrol cars just watching speeders on Teg Drive .... First day of our three day count did reflect the police being out there .... There are some folks in the neighborhood group think that if we would have come out two weeks later... Clarification... about who exactly got the survey and we thought long and hard about how to distribute it... focus on people who would be directly affected by these devices should you decide to put them down .... If your residence was located where you would have to go over a speed hump to get to your residence, you got a survey... half closest to Teg got the survey. Very quick summary... a proposal that staff is comfortable with. It has been designed with the neighborhood group .... design standards of the Institute of Transportation Engineers .... function as a street, water will drain and all of those things .... We did distribute it to all the emergency response providers and no one has any problems with it .... The results of the survey... folks in the neighborhood are willing to give it a try... We are asking you do consider it.. direct staff to go ahead .... Council/(Do it). Kubby/ ....people being concerned about the stop signs being removed. Is there any consideration of keeping a stop sign and putting in a hump? Davidson/...felt what we installed the stop signs to do, the speed humps will do .... Nov/ Davidson/They were slowing traffic down... staff is not uncomfortable removing those signs on Teg. Davidson/I think there was one comment .... Kubby/What is the timeframe? Davidson/I talked to Rick .... they can be installed this construction season... He said yes, they can. If you would like, we can get back to you with a specific schedule .... Norton/How did you respond to the question about not providing people with places to cross Teg Drive? .... Davidson/What we hope to obtain is traffic slowed down enough that it will be safe for pedestrians to cross .... Nov/Is there any intersection to get to the park that would remain with a stop sign? Davidson/Right now there are two intersections ..... Norton/ Nov/If we need them, we will have to put them back. Davidson/ ....Okay, thank you. Kubby/ Norton/Good luck. Ron Logsden/Briefly, the transit interchange proposal or project as it stands right now .... Schaeffer Hall .... restroom facilities .... Total project is $225,000 .... Iowa City's portion is $45,000, federal portion is $180,000. We have often wanted an area downtown to disseminate information .... sell monthly passes .... We also thought it would be beneficial for the drivers to have their 1/2 hour to 45 minute break downtown .... eat their lunch .... It has been a problem for a long time .... incorporate into the project. Trying to get something built this construction season .... Kubby/Is that breakroom area part of the office space? Logsden/Yes, it is. We have a little counter ....wouldn't be seen from the window .... Steve Ford/Show you the overall site plan and orient you that way .... with Shoemaker and Haaland Engineers. (Refers to site plan) ..... Have to show you on the plan where the existing island is .... Right now there is a bus that comes around to the south side of that median... taking that lane out and increasing that center median's width to allow for the building area and rerouting the bus to the north side .... shortening the island .... This is more of a blow up of the island and footprint of the building (refers to plans) .... can buy ticket there... general public use .... entire facility will be heated and cooled and it will be lockable. Kubby/Any thought of having an entrance on the east? .... easier for some of the drivers to get in to the restroom and office area... that was not a public entrance. Ford/Always a possible confusion on a two door system .... Obviously we have to provide secondary emergency exit anyway and that would be here through this window area (refers to plans) .... Norton/How isolated is that east end? ..... Ford/The condensing unit .... heating and cooling unit (refers to plans) .... Trying to protect that area from view of the mechanical. Norton/ Ford/ Nov/How about damage to mechanical equipment lefl at grade... accessible? Norton/Why couldn't there be a low screening wall there or some kind? .... operational end of this is backwards to the downtown .... Kind of wish it were looking towards the active part of downtown. Ford/It is possible .....up above the restrooms .... Nov/ Norton/I am talking about turning the whole building around. Nov/Yes, face the entrance towards the- Ford/Main problem we are faced with is the turning radius of the buses coming around that comer and just the way that the circulation functions. Kubby/ Ford/Right now it is a direct access from the Mall over to the Pentacrest... trying to orient that entry ..... main cross walk .... Norton/Seems very important to make that end of it attractive some how rather than looking at a compressor. Ford/ ....details to be worked out, the signage... lighting on that side ....how that is portrayed .... Lehman/How large is that planter? Ford/16 feet by 18 feet approximately. Lehman/Or else make that an area with benches where people can sit .... I really think the entrance to that should face the downtown. Kubby/Are there ways to design it to reduce those safety issues? .... Ford/Problem with entering from the east... University of Iowa ..... assume Hawkeye service .... Hawkeye is a major portion of our current service and so the route study we had done at that time emphasized continuing service to Hawkeye .... one full time bus throughout the day and then part time bus morning and afternoon. And so we were talking to the University about these implications .... several things .... would impact Transit... Our advantage to find out .... what they intended to do with the Hawkeye service so that we could present the different options .... Two things in particular that were called out in this were the development of a downtown shuttle to enable employees and others to travel throughout the downtown .... Other one... the free fare zone that is in here to establish the boundaries .... Summit, Bowery, and Church. This was of particular interest to the University because they could see it as another means to move students throughout the downtown .... University also said they were going to do a Transit Route Study .... Why don't we look at out transit routes together and why don't we ask Coralville to join in this effort and we can get all the Transit systems that are serving the same area to sit down together... Wrote you the memo if you want us to delay the Transit Study... until fall. Jeff has indicated JCCOG would be able to do it this fall and then present it .... Other option would be to go ahead and complete our Transit Study and implement it. Then let the University look at the service that we are providing and then see how their system would fit in with our system. We have a Transit Study that is almost complete...
