CONSIDER AN ORDINANCE REZONING APPROXIMATELY 8.7 ACRES FROM INTERIM DEVELOPMENT (ID-RS) TO SENSITIVE AREAS OVERLAY-LOW DENSITY SINGLE-FAMILY (OSA-5) LOCATED ON THE WEST SIDE OF FOSTER ROAD. (REZ03- 00017/SUB03-00019) (FIRST CONSIDERATION) Lehman: (reads item) O'Donnell: Move first. Lehman: Moved by O'Donnell. Vanderhoef: Second. Lehman: Seconded by Vanderhoef. Discussion. Kanner: We did get a memo from our City Forester who said that the rate of survival he estimated for private planting is close to only 60%, and I think that's something that we need to take a look at in our Sensitive Areas Ordinance, and ways to deal with that issue. Perhaps taken out of the private hands and money should be made to the City to do it which has a much higher survival rate of the trees according to our Forester, closer to 95% he expects. I was wondering if that's something that the Council would be willing to take a look at in the future. Lehman: Steven we have the ability to require the replanting now. Kanner: I think we were told that it's going to be tough to require replanting. It's a very nebulous kinda operation. Someone has to call it in. We don't have things written in to the lease, not the lease, into the title for the land that says anything about the requirement to keep these trees that they are going to plant outside to compensate. Lehman: I think Kanner: There's nothing, there aren't things written down. Lehman: The requirement is that they have keep the trees. They just don't have to be alive unless somebody complains if somebody complains they must replace the trees. Is that correct? Dilkes: I think we operate under a complaint basis. We don't have someone out there inspecting daily. Vanderhoef: We also were told that when these trees are put in they're usually put in by a nursery and that they are guaranteed for at least one year so if they die within the first year their replaced by the people that supplied them. I don't think HIS was able to identify any problem area. Pfab: So we require that the trees be put in by a nursery with a one year guarantee? Champion: No. Lehman: No, that's a private decision. We require that they be planted. Pfab: Well I mean....I think... Vanderhoefi The developers aren't out there planting trees by themselves. Pfab: Yes, but at the same time Vanderhoef: They get someone to do it. Pfab: Right, but at the same time ... is there anything to stop anybody from doing it if they decide they want to do it? Lehman: No. Vanderhoefi No, it's their decision. That's private business. Pfab: Right, it's private business but this is a public function here that with public assets here that is being lraded. Lehman: No. O'Donnell: It's to the developers advantage Irvin. Pfab: If he's got the lots sold he's gone. O'Donnell: Have to be scattered throughout the development. Pfab: What happens after the lots are sold? He's gone. (can't hear - Pfab and O'Donnell both talking) O'Donnell: His advantage ..... buy the trees ...That's the way we have to look at that. Pfab: I think that the least we could do is require that they be put in planted with the one year guarantee. Lehman: Is there any interest in changing the requirement on planting trees?
