Resolutions. O~-~'_'/~- (1) CONSIDER A RESOLUTION APPROVING THE OFFICIAL FINANCIAL REPORT FOR CITY STREETS AND PARKING PROGRAM PROJECT STATUS REPORT FOR THE FISCAL YEAR ENDING JUNE 30, 2003. Comment: The Iowa Department of Transportation requires all municipalities to submit this report annually on or before September 30. ~ g.o/~ ~ (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A LEASE AGREEMENT WITH ELDER SERVICES, INC. FOR SPACE AT THE SENIOR CENTER TO OPERATE THE ELDERLY NUTRITION PROGRAM. Comment: The Senior Center Commission and Elder Services, Inc. have negotiated a Lease Agreement for the use of approximately 1,668 square feet of space on the first floor of the Senior Center for the operation of the elderly nutrition program. The lease shall be effective upon execution and shall terminate on June 30, 2004 without further notice. At that time if both parties agree that the tenancy shall continue it will be on a month-to-month basis on the same terms and conditions contained in this Lease Agreement. ~! (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I-rEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND HILLS BANK AND TRUST, IOWA CITY, IOWA FOR PROPERTY LOCATED 23 MONTROSE AVENUE, IOWA CITY, IOWA. Comment: Hills Bank and Trust, Iowa City, Iowa has requested that the City approve a Subordination Agreement for 23 Montrose Avenue to refinance a mortgage. On March 2, 2001 and on January 17, 2002, the owner of the property received loans from the City of Iowa City's Housing Rehabilitation Program for $13,860. The property is appraised for $130,000 which provides enough equity to cover the City's second lien position. September 23, 2003 Cit~' of Iowa City Parle 3 (4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I-I'EST TO THE RELEASE OF LIENS REGARDING THREE MORTGAGS FOR THE PROPERTY LOCATED AT 1027 MARKET STREET, IOWA CITY, IOWA. Comment: The owners of the property located at 1027 Market Street received assistance through the City's Housing Rehabilitation Program totaling $28,036. The financing was in the form of three conditional occupancy loans and a ten- year declining balance loan. The loans have been paid off; thus the liens can now be released. (5) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND IOWA STATE BANK AND TRUST CO., IOWA CITY, IOWA FOR PROPERTY LOCATED AT LOT 17 LONGFELLOW MANOR, IOWA CITY, IOWA. Comment: Iowa State Bank and Trust Co., Iowa City, Iowa has requested that the City approve a Subordination Agreement for Lot 17 Longfellow Manor to obtain a construction loan. On March 14, 2003, the owner of the property received a loan from the City of Iowa City's Home Investment Partnership funds for $177,500 to purchase five lots. The affordable student built home on Lot 17 will have enough equity to cover the City's second lien position. e. Correspondence. (1) L. September 23, 2003 City of Iowa Cit}/ Parle 4 ITEM 6. PLANNING AND ZONING MATI'ERS. a. CONSIDER AN ORDINANCE REZONING APPROXIMATELY 8.7 ACRES FROM INTERIM DEVELOPMENT (ID-RS) TO SENSITIVE AREAS OVERLAY-LOW DENSITY SINGLE-FAMILY (OSA-5) LOCATED ON THE WEST SIDE OF FOSTER ROAD. (REZ03-00017/SUB03-00019) (SECOND CONSIDERATION) Comment: At it July 17 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a staff memorandum dated July 11. Approval of this rezoning will allow the development of Oakmont Estates, an 8.7-acre, 16-1ot subdivision on property that contains a woodland and regulated slopes. The plan includes the dedication of 1.48 acres of land containing regulated slopes and woodlands to the city. The sensitive areas plan includes a tree protection and tree replacement plan for portions of the woodlands. Applicant previously requested expedited consideration. CONSIDER AN ORDINANCE CONDITIONALLY REZONING 5.69 ACRES FROM LOW-DENSITY SINGLE-FAMILY RESIDENTIAL (RS-5) TO LOW-DENSITY MULTI-FAMILY RESIDENTIAL (RM-12) LOCATED AT 1715 MORMON TREK BOULEVARD. (REZ03-000'IS) (PASS AND ADOPT) Comment: At its June 5 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval subject to a conditional zoning agreement requiring approval of an OPDH (Planned Development Housing Overlay) and establishment of a 70-foot wide evergreen buffer along Highway 218 in the event that the property redevelops for residential use. In a report dated June 5, staff recommended approval. This property is the location of All Nations Baptist Church. Action: ITEM 7. CONSIDER AN ORDINANCE REPEALING TITLE 6, "PUBLIC HEALTH AND O~ - z/_O¢~ ~ , SAFETY," CHAPTER t, "NUISANCES," SECTION 2, "PUBLIC NUISANCE DEFINED; PUBLIC NUISANCES ENUMERATED," SUBSECTION (Q), "VEHICLES ILLEGALLY PARKED, STORED, PLACED, OR KEPT ON PRIVATE PROPERTY." (SECOND CONSIDERATION) Comment: The City Council, at its meeting on August 19, chose not to amend this ordinance to address the enforceability issues created by the exceptions to the ordinance's limit of 6 vehicles on residential lots, and directed that the ordinance be repealed. Action: ~/-/~////~ September 23, 2003 City of Iowa City Parle 5 ITEM 8. CONSIDER A RESOLUTION APPROVING THE 2003-2004 DEER MANAGEMENT D~ ~,=,7, C~ ~ PLAN FOR IOWA CITY. Comment: Each year, the City Council will consider a Deer Management Plan based on the Long-Term Plan approved by the Council in March of 1998. The Long-Term Plan was affirmed by the Task Force on July 8 and the City Council on July 14. The Resolution includes sharpshooting of no more than 200 deer within the corporate limits of Iowa City during Winter 2003-2004. , Action: ~ _/~//~'~,¢¢~ .... ITEM 9. MAYOR TO SIGN AND THE CI~ CLERK TO A~EST A CONTACT FOR CONSTRUCTION OF THE IOWA HIGHWAY 1 (DODGE STREET) / NORTHGATE DRIVE T~FFIC SIGNAL PROJECT. Comment: The bid date has been deferred from September 9 to October 7. A notice of the later date will be published as required by law. CONSIDER A RESOLUTION AU'I'HORIZING THE MAYOR TO SIGN AND THE CLERK O_~- ~/~,. TO A'I-rEST TO AN AGREEMENT TO PURCHASE A NINE-UNIT APARTMENT BUILDING FROM GREATER IOWA CITY HOUSING FELLOWSHIP (GICHF) AND TO ASSIST GICHF IN THE FINANCING OF AFFORDABLE HOUSING IN THE PENINSULA. Comment: The Peninsula development agreement calls for construction of affordable housing. The City and Greater Iowa City Housing Fellowship (GICHF) have been working closely to develop a total of sixteen affordable housing units in the Peninsula, including this 9-unit apartment building. Attached to the resolution is an agreement in which the City agrees to purchase the apartment building from GICHF upon its completion. Act,on: TEM ' SOLUT ON END NG THE BUDGETED POS T ONS THE O~ -~J~ SENIOR CENTER BY ADDING ONE HALF-TIME CLERICAL ASSISTANT- SENIOR CENTER POSITION. Comment: A portion of the funds budgeted for temporary employees to assist with certain clerical duties at the Senior Center will be used to fund the performance of those duties by a half-time permanent employee. This is necessary in order to comply with the provisions of the FY '04 collective bargaining agreement (CBA). This arrangement will best meet the needs of the Senior Center while ensuring full compliance with the CBA. The cost for the remainder of the fiscal year is estimated at between $11,250 and $15,250, depending on the cost of benefits to the employee.
