FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUC-
TION OF WATER MAINS -PENINSULA PROPERTY, DIRECTING THE CITY
CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE
CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPEC-
TION.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY, IOWA:
That a public headng on the plans, specifications, form of contract, and estimate of cost
for the construction of the above-mentioned project is to be held on the 27th day of
January, 1998, at 7:00 p.m. in the Council Chambers, Civic Center, Iowa City, Iowa.
That the City Clerk is hereby authorized and directed to publish notice of the public

RESOLUTION NO. 98-3
RESOLUTION PROVIDING NOTICE THAT AT LEAST NINETY-FIVE PERCENT (95%) OF THE
WORK UNDER THE CONTRACT FOR THE SOUTH IOWA RIVER CORRIDOR INTERCEPTOR
SEWER PROJECT HAS BEEN COMPLETED AND THAT THE CITY INTENDS TO RELEASE
FUNDS RETAINED PURSUANT TO CHAPTER 573, CODE OF IOWA
WHEREAS, the City of Iowa City entered into a contract with Park Construction Company for
the construction of the South Iowa River Corridor Interceptor Sewer Project; and
WHEREAS, five percent (5%) of the amount due under the contract has been retained for the
payment of claims for materials and labor pursuant to Chapter 573, Code of Iowa; and
WHEREAS, more than ninety-five percent (95%) of the work under the contract has been
completed; and
WHEREAS, Section 573.15A, Code of Iowa, provides that a public corporation may release
all or part of the five percent (5%) retainage thirty (30) days after ninety-five percent (95%)
of the work under the contract has been completed if no claims have been filed within said
thirty (30) day period by persons or entities that have, under contract with the general
contractor or with subcontractors, performed labor or furnished materials, service or
transportation in the construction of the public improvement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, that:
The City Council hereby finds that at least ninety-five percent (95%) of the work
under the contract for the South Iowa River Corridor Interceptor Sewer Project has
been completed.
Pursuant to Section 573.15A, Code of Iowa, the City of Iowa City intends to reduce
the amount of the retainage under Chapter 573 from five percent (5%) to an amount
not less than one percent (1%) thirty (30) days after this Resolution has been passed
and approved unless a claim or claims are filed as provided in said Section 573.15A.

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST A WATER SYSTEM DEVELOPMENT AGREEMENT FOR SADDLEBROOK
MANUFACTURED HOUSING PARK, IOWA CITY, IOWA.
WHEREAS, Developer has received City approval for a subdivision of real estate known as
"Saddlebrook Addition Part 1, Iowa City, Iowa' (the 'Subdivision"); and
WHEREAS, Developer is designing and constructing a manufactured housing park within said
subdivision in an effort to increase the stock of affordable housing in Iowa City; and
WHEREAS, due to the unique nature and development issues associated with the Manufac-
tured Housing Park, Developer has requested an amendment of several of Iowa City's water
system development requirements; and
WHEREAS, issues of maintenance responsibility, water meter installation, removal and
protection, and service line maintenance have been addressed and resolved; and
WHEREAS, the parties wish to memorialize their agreement regarding their respective
responsibilities and duties for the design, construction, development and maintenance of the
Saddlebrook Manufactured Housing Park water system; and
WHEREAS, the City Council deems it in the public interest to enter into a water system
development agreement for the water system within the manufactured housing park.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
The Mayor is hereby authorized to sign and the City Clerk to attest the attached Water
System Development Agreement for Saddlebrook Manufactured Housing Park,
between the Developer and the City, upon direction by the City Attorney.

The City Clerk is hereby authorized and directed to certify a copy of this Resolution for
recordation in the Johnson County Recorder's Office together with the attached Water
System Development Agreement at the expense of Lake Calvin Properties.

WATER SYSTEM DEVELOPMENT AGREEMENT FOR
SADDLEBROOK MANUFACTURED HOUSING PARK
JUNE 19, 1997
THIS AGREEMENT AND COVENANT, is made and entered into this 2~ day of
J~J~vE~l~ , 1997, by and between the City of Iowa City, Iowa, a municipal
corporation, (hereinafter "City"), and Lake Calvin Properties, an Iowa general partnership,
(hereinafter "Developer"), which expression shall include their successors in interest and
assigns, including the owner of the subject manufactured home park and/or their agents.
WHEREAS, Developer has received City approval for a subdivision of real estate known as
"Saddlebrook Addition Part 1, Iowa City, Iowa" (the "Subdivision"); and
WHEREAS, Developer is designing and constructing a manufactured housing park within said
subdivision in an effort to increase the stock of affordable housing in Iowa City; and
WHEREAS, due to the unique nature and development issues associated with the
Manufactured Housing Park, Developer has requested an amendment of several of Iowa City's
water system development requirements; and
WHEREAS, issues of maintenance responsibility, water meter installation, removal and
protection, and service line maintenance have been addressed and resolved; and
WHEREAS, the parties wish to memorialize their agreement regarding their respective
responsibilities and duties for the design, construction, development and maintenance of the
Saddlebrook Manufactured Housing Park water system.
THEREFORE, in consideration of the mutual covenants and obligations of Developer and City
under this agreement, Developer and City agree as follows:
I. Service Lines:
The Developer, its successors in interest and assigns, including the owner of the subject
manufactured home park and/or their agents, are exclusively responsible for installation,
repair, maintenance, replacement, service and use of all water lines, pipe, fittings, conduits
and appurtenances (service line) laid and extending from the City-owned, public distribution
water main to the point of service or buildings served. Said service line, and the Developer's
plenary and exclusive responsibility therefor, shall include stop boxes, pipes and valves
between the distribution water main and the water meter. For the purposes of this
agreement, it is agreed and acknowledged that the terms "distribution water main" and
"service line" shall be defined in accordance with Title 1 4, Chapter 3, Article C, Section 1 (1 4-
3C-1) of the Iowa City City Code. It is further understood and agreed that it is the parties
intent that this section address and assign all responsibility whatsoever for the installation,
repair, maintenance, replacement, service and use of all water lines, pipe, fittings, conduits
and appurtenances within and along the service line to the Developer, its successors in
interest and assigns.
II. Stop Boxes:
The Developer, its successors in interest and assigns are responsible for the installation of an
outside stop box for each individual manufactured home, which stop boxes shall be located
two feet away from the skirting of the home in an easily accessible area. Additionally, the
Developer, its successors in interest and assigns shall be responsible for the repair,
maintenance, replacement, and service of said stop boxes. However, the City of Iowa City
shall have the right of unlimited access to and use of said stop boxes, without the requirement
of notice to the Developer, property owner, water service customer or other party.
III. Water Meters:
The parties hereto'acknowledge and agree that the Developer, its successors in interest and
assigns are exclusively responsible for the installation of the water meters on each individual
lot, which installation shall be done by a licensed plumber according to the City Plumbing
Code and in conformance with the diagrams attached hereto as Exhibits "A" and "A-1" and
incorporated by this reference herein. Contemporaneously with the installation of said water
meters, the Developer shall also install and extend signal wire to the intended location of the
remote reading device, which location shall be on the front of the home in conformance with
the diagrams attached hereto as Exhibits "A" and "A-1" and incorporated by this reference
herein. Thereafter, the City shall install said remote reading device. The City will supply all
water meters at the cost set forth in the schedule of fees, Section 3-4-3 of the City Code,
which cost shall be charged to the Developer and/or manufactured home park owners/agents
as a water meter fee. The City shall retain full ownership rights in said meters. Each meter
shall be assigned to an individual lot and shall not be removed, relocated or used in any other
location or for any other purpose without the written consent of the City of Iowa City Water
Division.
IV. Protection of Water Meters:
It is hereby agreed and acknowledged that the Developer shall be responsible for protection
of the water meters from any destruction, and/or damage (i.e., freezing) other than ordinary
wear, whether caused by a third person, the Developers' agents and/or the elements. The
Developer shall be billed for repair or replacement upon the occurrence of any such damage.
It is hereby agreed and acknowledged that the Developer shall be responsible for the
replacement of any insulation and/or heat tape disturbed or damaged due to removal of
meters, water damage, etc. The Developer specifically agrees to hold the City of Iowa City
harmless from any damage to insulation and/or heat tape, however caused.
The City shall not be held responsible for any damage to the manufactured home skirting due
to improperly installed or supported remote reading devices and/or due to access to the water
meter, and the Developer specifically agrees to hold the City of Iowa City harmless from any
damage to such skirting, however caused.

V. Requirements for Removal of Water Meters:
The removal of water meters due to a sale, winter remove, malfunction, non-payment, etc.
shall be done promptly by the manufactured home park staff after notification from the City
of Iowa City Water Division. Water Division personnel must be present prior to the removal
of any such meter and shall obtain a reading from the meter for billing purposes. No meters
shall be removed without the written consent of the City of Iowa City Water Division.
Additionally, Developer shall notify the City Treasury Division of any tenant changes within
the mobile home park.
Meters that have been removed shall be stored in a protected maintenance office at the
mobile home park. These meters shall be clearly tagged by lot number and shall be used only
for that specific location.
The Developer agrees and acknowledges that nothing in this agreement shall be construed to
relieve Developer from complying with all applicable local, state and federal regulations,
including all other pertinent ordinances stated in the City Code of Iowa City, Iowa.
Vl. Billing and Collection Procedures; Delinquent Accounts:
In the event of a delinquent account, if an individual stop box for the specific manufactured
home exists, the notice required under Iowa City City Code Section 14-3A-7 shall be sent
directly to the mobile home owner and water service shall be disconnected at the individual
stop box. If an individual stop box for the specific manufactured home does not exist,
Developer shall be notified of the delinquency, and shall assist the Water Division in
disconnecting water service. Upon the occurrence of the third carding notice for delinquent
billings within a 365 day period, the City will automatically place the account into the name
of the Developer as of the last reading date. The water service shall remain in the Developer's
name until such time as either the tenant moves or an individual stop box is installed outside
of the skirting of the mobile home.
VII. Construction
For the purposes of this agreement, it is agreed and acknowledged that the terms of art
regarding Potable Water Use and Service shall be defined in accordance with Title 14, Chapter
3, Article C, Section 1 (14-3C-1) of the Iowa City City Code.

contract between the City of Iowa City and Yordi Excavating, Inc. of North Liberty, Iowa,
dated July 15, 1997, be accepted, and
WHEREAS, the performance and payment bond has been filed in the City Clerk's office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, THAT
said improvements are hereby accepted by the City of Iowa City, Iowa.

OPEN FOR PUBLIC ACCESS AND USE.
WHEREAS, the Engineering Division has certified that the following improvements have been
completed in accordance with the plans and specifications of the City of Iowa City:
Sanitary sewer, storm water system, and water main improvements for Walden Hills,
Lots 7-36, as constructed by Maxwell Construction, Inc. of Iowa City, Iowa.
Paving improvements for Walden Hills, Lots 7-36, as constructed by Streb
Construction Co., Inc. of Iowa City, Iowa.
WHEREAS, maintenance bonds have been filed in the City Clerk's office; and
WHEREAS, traffic control signs have been installed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA,
THAT:
Said public improvements are hereby accepted by the City of Iowa City, Iowa, and that all

AND SCHEDULED BID OPENING FOR THE MONTGOMERY-BUTLER HOUSE
STABII I?a, TION PROJECT FROM JANUARY 7 TO FEBRUARY 4, 1998.
WHEREAS, the City of Iowa City is the owner and legal title owner of property known as the
Montgomery-Butler House, located on ~ west side of Dubuque Street and soulh of the Iowa
River;, and
WHEREAS, on December 16, 1997, the City approved plans, specification, form of contract, and
estimated cost for the stabilization of said structure (RES. NO. 97-410); and
WHEREAS, on December 18, 1997, the City issued an Advertisement to Bidders requesting bids
on said plans and specifications by 2:30 p.m. on January 7, 1998; and
WHEREAS, the City desires to extend said deadline and bid opening to February 4, 1998, to allow
sufficient time for interested contractors to meet the bonding requirements for comple~on of the
project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, THAT:
1. The bid submittal deadline for the Montgomery-Butler House Stabilization Project is hereby
postponed to 2:30 p.m. on February 4, 1998.
2. The scheduled bid opening for the Montgomery-BuUer House StabilizaUon Project is hereby
postponed to 3:30 p.m. on February 4, 1998.
The proposals will be acted upon by the City Council at a meeting to be held in the Council
Chambers, 410 East Washington Street, Iowa City, Iowa at 7 p.m. on the 10= day of February,
1998, or at such later time and place as may then be scheduled.
The City Clerk is hereby authorized and directed to publish notice for the receipt of bids for the
construction of the above-named project in a newspaper published at least once weekly and
having a general circulation in the city.

STABILIZATION PROJECT
Sealed proposals will be received by the City
Clerk of the City of Iowa City, Iowa, until 2:30 P.M.
on the 7th day of January, 1998, and shall be
received in the City Clerk's office no later than
said date and time. Sealed proposals will be
opened at 3:30 p.m. on the 7th day of January,
1998 by the Director of Planning & Community
Development or designee. Bids submitted by fax
machine shall not be deemed a 'sealed bid' for
purposes of this Project. Proposals will be acted
upon by the City Council at a meeting to be held in
the Council Chambers at 7:00 P.M. on the 13th
day of January, 1998, or at such later time and
place as may then be scheduled.
The Project will involve the following:
The stabilization of the historic Montgom-
ery-Butler House, including repairs to the
roof structure, protection of the building
from the weather, and secudng the build-
ing.
All work is to be done in strict compliance with
the plans and specifications prepared by the
architects, Susan L. Licht, AIA, and John F. Shaw,
AIA, of Iowa City, Iowa, which have heretofore
been approved by the City Council, and are on file
for public examination in the Offme of the City
Clerk.
Each proposal shall be completed on a form
furnished by the City and must be accompanied in
a sealed envelope, separate from the one
containing the proposal, by a bid bond executed
by a corporation authorized to contract as a surety
in the State of Iowa, in the sum of 5% of the bid.
The bid security shall be made payable to the
TREASURER OF THE CITY OF IOWA CITY,
IOWA, and shall be forfeited to the City of Iowa
City in the event the successful bidder fails to
enter into a contract within ten (10) calendar days
and post bond satisfactory to the City insuring the
faithful performance of the contract and mainte-
nance of said Project, if required, pursuant to the
provisions of this notice and the other contract
documents. Bid bonds of the lowest two or more
bidders may be retained for a peded of not to
exceed rdteen (15) calendar days until a contract
is awarded, or until rejection is mede. Other bid
bonds will be returned after the canvass and
tabulation of bids is completed and reported to the
City Council.
The successful bidder will be required to
fumish a bond in an amount equal to one hundred
percent (100%) of the contract price, said bond to
be issued by a responsible surety approved by
the City Council, and shall guarantee the prompt
payment of all materials and labor, and also

protect and save harmless the City from all claims
and damages of any kind caused directly or
indirectly by the operation of the contract, and
shall also warrantee the work on the impmvernent
for a period of one (1) year from and after its com-
pletion and formal acceptance by the City.

RESOLUTION APPROVING THE VOLUNTARY ANNEXATION OF A 2.59 ACRE
TRACT OF LAND LOCATED AT 3151 HIGHWAY 6 EAST.
WHEREAS, Iowa City Lodge,. Number 1096, Loyal Order of Moose, Inc., hereafter referred to as
Moose Lodge #1096, is owner of an approximate five acre tract located south of Highway 6 and
east of Heinz Road; and
WHEREAS, the southern 2.59 acres of the five acre tract is located adjacent to, but outside the
Iowa City, Iowa corporate limits; and
WHEREAS, Moose Lodge #1096 has voluntarily requested annexation of the 2.59 acre tract into
the City of Iowa City, Iowa; and
WHEREAS, this tract is contiguous to the corporate limits of the City; and

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY,

The plans, specifications, form of contract and estimate of cost for the above-named
project are hereby approved.
The amount of bid security to accompany each bid for the construction of the above-
named project shall be in the amount of 10% (ten percent) of bid payable to Treasurer,
City of Iowa City, Iowa.
The City Clerk is hereby authorized and directed to publish notice for the receipt of bids
for the construction of the above-named project in a newspaper published at least once
weekly and having a general circulation in the city.
Bids for the above-named project are to be received by the City of Iowa City, Iowa, at
the Office of the City Clerk, at the Civic Center, until 10:30 a.m. on the 5th day of

STATE OF IOWA, DECEMBER 12, 1997 -
Sealed bids will be received by the Iowa
Department of Transportation, at the Office of
Contracts in Ames, Iowa and at its official
depository on the third floor of the Marriott Hotel,
Des Moines, Iowa, until 9:00 a.m.C.T. on the
above date, for the various items of construction
and/or maintenance work listed below. Mailed
bids are to be sent to the Iowa Department of
Transportation, Office of Contracts at Ames,
Iowa 50010. Opening and reading of the bids
will be performed at the Iowa Department of
Transportation, at Ames, Iowa after 9 o'clock
a.m. on the same date such bids are scheduled
to be received, unless otherwise specified by the
Iowa Department of Transportation.
A Proposal Guarantee in an amount as set
forth in the proposal form shall be filed with each
proposal. The Proposal Guarantee shall be in
the form of a certified check or credit union
certified share draft, cashier's check, or bank
draft drawn on a solvent bank or credit union.
Certified checks or credit union certified share
drafts shall bear an endorsement signed by a
responsible official of such bank or credit union
as to the amount certified. Cashier's checks or
bank drafts shall be made payable either to the
Contracting Authority or to the bidder and, where
made payable to the bidder, shall contain an
unqualified endorsement to the Contracting
Authority signed by the bidder or the authorized
agent. A Bid Bond, properly completed on the
Form No. 650001 available from the Iowa
Department of Transportation, Contracts Office,
may be used in lieu of above.
Failure to execute a contract and file an
acceptable performance bond and Certificate of
Insurance within 30 days of the date of the
approval for awarding the contract, as herein
provided, will be just and sufficient cause for the
denial of the award and the forfeiture of the
proposal guarantee.
Plans, specifications and proposal forms for
the work may be seen and secured at the Office
of Contracts, Iowa Department of
Transportation, Ames, Iowa, until noon on the
day previous to the letting.
All proposals must be filed on the forms
furnished by the Iowa Department of
Transportation, Contracts Office, sealed and
plainly marked. Proposals containing any
reservations not provided for in the forms
furnished will be rejected, and the Iowa
Department of Transportation reserves the right
to waive technicalities and to reject any or all
bids.
Attention of bidders is directed to the Special
Provisions covering the subletting or assigning
of contracts.
Minimum wage rates for all Federal Aid
projects have been predetermined by the
Secretary of Labor and are set forth in the
specifications. However, this does not apply to
projects off the Federal-Aid system.
All Federal-Aid projects are subject to the
Work Hours Act of 1962, P.L. 87-581 and
implementing regulations.
By virtue of statutory authority, a preference
will be given to products and provisions grown
and coal produced within the State of Iowa, and
also, a resident bidder shall be allowed a
preference as against a non-resident bidder
from a state or foreign country which gives or
requires a preference to bidders from that state

WHEREAS, the City of Iowa City desires to remove and replace the WooIf Avenue bridge

WHEREAS, the City of Iowa City desires to contract for construction inspection services,
project administration and other special services to assure construction is in conformance
with the design plans and specifications of the Project; and
WHEREAS, an Agreement for professional engineering services has been negotiated with
NNW, Inc. of Iowa City, Iowa;
WHEREAS, it is in the public interest to enter into said Agreement with NNW, Inc.

WHEREAS, the City desires to improve and reconstruct WooIf Avenue including the bridge over
U.S. Hwy. 6 and CRANDIC Railroad. The project limits are from Newton Road to Bayard Street.
NOW THEREFORE, it is agreed by and between the parties hereto that the City does now
conlract with the Consultant to provide services as set forth herein.
I. SCOPE OF SERVICES
Consultant agrees to perform the following services for the City, and to do so in a timely and
satisfactory manner.
A. Project Administration Phase:
1. Provide project administration;
2. Prepare field alignment and elevation information and provide construction
staking one time for each stage;
3. Make timely visits to the project during the course of construction;
4. Negotiate, prepare, and obtain approval of all change orders required by the
construction, including submission of verification information;
5. Conduct weekly construction meetings;
6. Review monthly pay estimates and submit to City Engineer with
recommendations;
7. Keep public information board on site up Io date. (Board shall be furnished and
erected by City.);
8. Have available at site, in office, or by phone or pager 24 hrs/day, a full time
representative who can respond to off-hour issues and answer citizen's inquiries;
9. Provide periodic project updates for neighborhood newsletter;
10. Keep project material, labor and inspeclion records as required by IDOT for
Federal-Aid projects;
11. Perform material testing as required by IDOT Instructional Memorandum (I.M.)
and City procedures;
12. Coordinate with and inform the University of Iowa and Veterans Administration
Medical Center;

Submit necessary documents to State and Federal Agencies both dudng
construction and upon final completion;
Upon completion of the project, determine final contract quantities from actual
field measurements, or from field and office records as well as period pay
estimates and submit same to the City;
Prepare certifications of completion for City Council acceptance;
Attend necessary meetings of the City Council and Neighborhood Association
both dudng the course of construction and at the time of final project acceptance;
Prepare as-built drawings;
Provide City with mylar copy of as-built drawings.
Tie-down existing property pins within an easement.
Construction Inspection Phase:
1. Provide full time on-site inspection and documentation utilizing a technician or
engineer experienced in the inspection and construction of bridges, concrete
pavement, storm sewer and watermain work;
2. Provide assurance construction is substantially in accordance with the plans and
specifications;
3. Provide certified concrete inspector as required;
4. Provide City with copies of daily diary entries and results of materials testing and
certification.

Preparation of elementary sketches and supplementary sketches required to
resolve actual field conditions encountered;
Assist the City as expert witness in litigation arising from the development of
construction of the project and in headngs before various approving and
regulatory agencies.

The time of completion is tied to the contractors schedule.

The Consultant shall not commit any of the following employment practices and
agrees to prohibit the following practices in any subcontracts.
To discharge or refuse to hire any individual because of their race, color,
religion, sex. national origin, disability, age. marital status, sexual
orientation or gender identity.
To discriminate against any individual in terms, conditions, or privileges
of employment because of their race. color, religion. sex, national origin,
disability, age, marital status. sexual orientation or gender identity.
Should the City terminate this Agreement, the Consultant shall be paid for all
work and services performed up to the time of termination. However, such sums
shall not be greater than the 'amount not to exceed' amount listed in Section IV.
The City may terminate this Agreement upon seven (7) calendar days' written
notice to the Consultant.
This Agreement shall be binding upon the successors and assigns of the parties
hereto, provided that no assignment shall be without the written consent of all
Parties to said Agreement°
It is understood and agreed that the retention of the Consultant by the City for
the purpose of the Project shall be as an independent contractor and shall be
exclusive, the Consultant shall have the right to employ such assistance as may
be required for the performance of the Project.
It is agreed by the City that all records and files pert.aining to information needed
by the Consultant for the project shall be available by said City upon reasonable
request to the Consultant. The City agrees to furnish all reasonable assistance
in the use of these records and files.
It is further agreed that no Party to this Agreement shall perform contrary to any
state, federal, or local law or any of the ordinances of the City of Iowa City, Iowa.
At the request of the City, the Consultant shall attend such meetings of the City
Council relative to the work set forth in this Agreement. Any requests made by
the City shall be given with reasonable notice to the Consultant to ensure
attendance.
The Consultant agrees to furnish, upon termination of this Agreement and upon
demand by the City. copies of all basic notes and sketches, charts,
computations, and any other data prepared or obtained by the Consultant
pursuant to this Agreement without cost, and without restrictions or limitation as
to the use relative to specific projects covered under this Agreement. In such
event, the Consultant shall not be liable for the City's use of such documents on
other projects.
The Consultant agrees to furnish all reports, specifications, and drawings, with
the seal of a professional engineer affixed thereto or such seal as required by
Iowa law.
The City agrees to tender the Consultant all fees in a timely manner, excepting,
however, that failure of the Consultant to satisfactorily perform in accordance
with this Agreement shall constitute grounds for the City to withhold payment of
the amount sufficient to properly complete the Project in accordance with this
Agreement.
Should any section of this Agreement be found invalid, it is agreed that the
remaining portion shall be deemed severable from the invalid portion and
continue in full force and effect.
Original contract drawings shall become the property of the City. The Consultant
shall be allowed to keep mylar reproducible copies of the Consultant's own filling
use.
Fees paid for secudng approval of authorities having jurisdiction over the Project
will be paid by the City.
IV.
COMPENSATION FOR SERVICES
Contract Administration Phase:
The City agrees to pay for services stated in this agreement on an hourly basis at the
hourly rates shown in Appendix A, attached hereto.
Construction Inspection Phase:
The City agrees to pay for services stated in this agreement on an hourly basis at the
hourly rates shown in Appendix A, attached hereto. For the purposes of establishing
liquidated damages the daily inspection rate is $320.00 per day
The maximum not to exceed amount for the combination of both phases is: Fifty-seven
Thousand three Hundred dollars ($57,300.00), excluding resetting property pins.
Resetting property pins using tie-points: $100.00 per pin.

MISCELLANEOUS
A. All provisions of the Agreement shall be reconciled in accordance with the generally
accepted standards of the Engineering Profession.
It is further agreed that there are no other considerations or monies contingent upon
or resulting from the execution of this Agreement, that is the entire Agreement, and
that no other monies or considerations have been solicited.
Before commencing work, the Consultant shall submit to the City, For approval, a
certificate of insurance meeting the requirements herein, to be in effect for the full
contract period. The Consultant shall notify the City in writing at least thirty (30)
calendar days prior to any change or cancellation of said policy or policies.
Cancellations or modifications of said policy or policies shall be considered just cause
for the City to immediately cancel the Agreement and/or halt work on the project, and
to withhold payment for any work performed under the Agreement. Any policies of
insurance purchased by the Consultant to satisfy its responsibility under this
Agreement shall include contractual liability coverage, and shall be in the following
type and minimum amounts:

WHEREAS, ongoing negotiations for FY98 paratransit service have produced the need for a
seventh extension to the FY97 Agreement; and
WHEREAS, Section IV ~Duration" of the FY97 Agreement permits an extension of the
Agreement by mutual agreement of the parties; and
WHEREAS, representatives of the City of Iowa City and Johnson County have negotiated a
seventh extension of the FY97 Agreement for a period of thirty-one days, to January 31,
1 998.

Extension Agreement for FY97 Paratransit Service Between the

This extension agreement is made and entered into by and between the City of Iowa City,
Iowa and Johnson County, Iowa.
WHEREAS, there is an existing 28E agreement for FY97 paratransit service between the City
of Iowa City and Johnson County; and
WHEREAS, the parties have extended said agreement to December 31, 1997; and
WHEREAS, ongoing negotiations for FY98 paratransit service have produced the need for a
sixth extension to the FY97 agreement; and
WHEREAS, Section IV, 'Duration," of the FY97 agreement permits extensions of the current
agreement by mutual agreement of the parties.
NOW THEREFORE, it is agreed by and between the City of Iowa City and Johnson County:
That the existing 28E agreement for FY97 paratransit service between the City of
Iowa City and Johnson County is hereby extended for a period of thirty-one (31)
calendar days to January 31, 1998.
For the extension of the FY97 paratransit service agreement from January 1, 1998 to
January 31, 1998, Johnson County shall be reimbursed $47,182 by the City of Iowa
City. All fares collected over $2,567 shall be returned to the City of Iowa City.
In all other respects, the terms of the FY97 28E agreement for paratransit service
shall remain in effect.
This extension agreement represents the entire extension agreement between the City of
Iowa City and Johnson County for paratransit service. It may be amended only by a written
instrument signed by all parties.

RESOLUTION NO. 98-15
RESOLUTION ESTABLISHING FEES AND CHARGES FOR THE POTTER'S
STUDIO IN THE ROBERT A. LEE COMMUNITY RECREATION CENTER.
WHEREAS, the City Code provides that, "Upon recommendation of the Parks and Recreation
Commission, all Parks and Recreation fees shall be established by City Council resolution";
and
WHEREAS, the Parks and Recreation Commission has reviewed all fees and is recommending
certain increases to be implemented in FY98 and FY99; and
WHEREAS, the City Council has adopted a resolution establishing all fees except the potter's
studio; and
WHEREAS, it is in the public interest to review and occasionally revise said fees.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA that the attached schedule of fees and charges for the potter's studio be adopted for
FY99.
