Absent: Baker. Staff: Atkins, Helling, Karr, Dilkes, Franklin, Schmadeke, Logsden, Winklehake, O'Neil, Mitchell, Craig, Fosse, Schoon, Miklo. Tapes: 97-96, all; 97-97, all. Dubuque Street Sidewalk 97-96 S1 [Tape problems] Schmadeke/If they didn't grant the easement, then at some point in time on public property and then it would be their obligation. They don't have sidewalks .... on their property. Lehman/(Can't hear). Nov/Ernie, turn around and face the microphone. Lehman/Bowery Street we just had some sidewalks in that were not sidewalks. Can that property owner be required to put that sidewalk in? Schmadeke/By special assessment. Lehman/It might be such- It sounds to be like you have some negotiating tools ..... Norton/There is a big sidewalk .... a four footer would be plenty there. Council/ Nov/But he had offered to maintain it .... He wants to be able to do snow removal with equipment rather than a shovel and therefore he wants the eight feet. Schmadeke/Six foot is what we recommending. Nov/ Vanderhoef/If we do the standard four foot, then they maintain it themselves anyway. Schmadeke/Right. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 2 Vanderhoef/I think you have got an idea there, Naomi .... Norton/Go with four and they maintain it. At six, we do. Vanderhoef/They can get down to the stoplight on the four foot .... Kubby/If they don't want to maintain it, then they should give us the easement for the six foot. Lehman/But if you go with the four foot, you can assess then for the cost of the sidewalk. Thomberry/Good bargaining tools there. Council/(All talking). Kubby/ Nov/As well as this petition, we want to know how the negotiations went with the property owner. If we can get some reasonable compromise. Schmadeke/Yeah, I will go back. Kubby/Okay, if they still refuse, where do we want to go? Council/(All talking). Norton/Four foot and they maintain it .... Nov/I have the feeling that they will have the city maintain it. Kubby/Okay. Norton/They can't do a four foot if we maintain it because we don't have the right equipment. Nov/ Council/(All talking). This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 3 Review Zoning Matters 97-96 S1 A. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 6, ENTITLED "ZONING," ARTICLE P, ENTITLED "FENCES AND HEDGES," TO CHANGE THE VISION TRIANGLE REQUIREMENT AT INTERSECTIONS. (FIRST CONSIDERATION) Franklin/The first item... first consideration of the vision triangle.. had p.h. on .... B. AMENDMENT OF TITLE 14, CHAPTER 6, ENTITLED "ZONING," ARTICLE O, ENTITLED "SIGN REGULATIONS," TO PERMIT PROJECTING SIGNS AS A PROVISIONAL SIGN IN THE CB-5 AND CB-10 ZONES. Franklin/Next item is projecting signs which is later on the agenda. C. AMENDMENT TO TITLE 14, CHAPTER 6, ENTITLED "ZONING," ARTICLE O, ENTITLED "SIGN REGULATIONS," TO PERMIT PORTABLE SIGNS AS A PROVISIONAL SIGN IN THE CB-2, CB-5, AND CB-10 ZONES. Franklin/Continued p.h. and first consideration of the amendments for portable signs. The question was how many sign faces can you have and you could have a maximum of two sign faces. Okay. D. CONSIDER A LETTER TO THE JOHNSON COUNTY BOARD OF SUPERVISORS RECOMMENDING APPROVAL OF AN APPLICATION FOR A CONTINUATION OF A CONDITIONAL USE PERMIT TO ALLOW A HOME BUSINESS, AN ART GALLERY, FOR PROPERTY LOCATED IN FRINGE AREA B AT 3880 OWL SONG LANE SE, IMMEDIATELY NORTH OF INVERNESS COURT. (CU9701) Franklin/Last item is to consider a letter to the Board of Supervisors on an application for a conditional use permit to allow home business. This is for the art gallery, the Barn, I think it is called out in Windsor Ridge. This is a conditional use permit that was granted previously. This would be for a five year period of time as opposed to two years .... provisions.. they continue the screening and if it were ever annexed into Iowa City, the conditional use permit would cease because this is a commercial use of residential property. So the recommendation is for approval for both the staff and P/Z Commission .... Nov/Sounds fine .... This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 4 Consent Calendar 97-96 S1 Thornberry/I had a question in the Consent Calendar (Agenda (#3e(4)-Lease of Airport Land-Iowa City Salvage Barn). Kubby/The Salvage Barn thing? Thornberry/Yeah. It is just going from one pocket into the other. Kubby/I had a question... for legal. In the non-discrimination clause, it doesn't match our Human Rights Ordinance .... on the Salvage Barn lease agreement, page 2, #10 .... The one I noticed was gender identity .... Dilkes/(Can't hear). Nov/There is Exhibit B mentioned and my package didn't have any Exhibit B. Dilkes/Is this still the Salvage Barn one? Nov/Yes... Salvage Barn lease, bottom of page 1, very last words are Exhibit B .... I still don't know what Exhibit B is. Dilkes/Where are you Naomi? Nov/Lease agreement, very bottom of the page, item #5, the very last words are exhibit B.... Karr/We can check on that tomorrow night. Council/ Dilkes/We will check on it. Nov/Page 2, item #6, you are missing a verb. It should be the lessee will provide. Council/(All talking). Vanderhoef/Page 2, #11, their respective interests in the premises are reasonably insured. How do we interpret reasonably insured? Dilkes/Ron, do you know what the insurance requirements... has been provided during the earlier term of this lease? This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 5 Nov/Come to the microphone please. O'Neil/I didn't know I would be answering any questions on this. I didn't even bring a copy of it. Dilkes/I think since we re talking about two city entities here, we are likely just going to have the insurance in place ..... O'Neil/I will look it up and discuss it with Eleanor tomorrow. Nov/Thank you, Ron. Okay .... Kubby/ This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 6 PCRB 97-96 S1 Nov/Let's do PCRB and let Dennis go home. Kubby/Are we doing the paperwork or the ordinance or both? Nov/Well, they are all in here, so- Norton/The form looks imposingly long. Kubby/Why isn't the Board going to develop this? Why are we developing it? Nov/We are just giving them a sample of the form they should develop. Mitchell/I think Steve just wanted to give them something so they could get started at least right away. Nov/We expect they will amend it. Kubby/When people are being trained to provide assistance, I think it would be good for a couple of council members to get trained, too, because we get a lot of calls from constituents .... I would like to suggest that council members get trained .... Nov/And I assume the information desk at the library is a reasonable place to have somebody who can help with forms .... Kubby/The other place .... that isn't on the list, is the City Clerk's Office and the Human Rights Division .... Atkins/When I said Civic Center, I mean we will put them any where you want in the building, yeah. Norton/The information desk .... public... might not want to do that ....You are talking kind of private things .... Nov/ Susan Craig/Our thought that if necessary if someone appeared or asked for a fair amount of assistance filling out the forms, we would have someone called to come and help them and take them to a private location. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 7 Kubby/There are a couple things in the sample that I don't even want to be given as a sample .... it says, the review board will investigate if it appears to state a case of misconduct. And really what we are saying is all complaints will be taken and investigated. I think those are real different messages .... Dilkes/This is just a draft that Steve gave you to get started .... It is going to have to be worked on ....problems... We don't have a board of inquiry ....We can work on it and make it- Norton/Okay. Kubby/So we are on to the ordinance. Nov/Anyone want to comment on the ordinance as presented? Kubby/I had a question on page 8, c.(2), the bolded part of that sentence, This annual report shall not include the name of the complainants or officers. How will trends among individual officers be kept if they are not part of an annual report? Mitchell/ .... We could also keep confidential records with the Board, too, so the Board could track that. Although the public portions of the report wouldn't include the officer's name as well as the complainant's name. Kubby/How does the community then track trends? Mitchell/Regarding particular officers? They would just have to rely on the Board to do that. Dilkes/I think there is a danger in that, too. Annual report ....would include all complaints whether sustained or not sustained- Kubby/ Dilkes/... There is a problem there. You put the officer's name, you put not sustained. I think there is some difficulty .... I think some people will ignore the not sustained and look at the officer's name and I don't know if that is a fair thing to do .... issue of we didn't include in here that complainant's names and officer's names would be admitted from the report that the Board sends out on each complaint and I think that that is a reasonable thing to do unless it is a sustained finding .... Kubby/My biggest concern is that the city can track that information. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 8 Mitchell/The Board is still going to have that information .... I was going to recommend a change on page 7, paragraph 3... That if the complaint is not sustained, that the officer's name be omitted from the public report as well as the complainant's name ..... Norton/Add that at the end or have you not decided? Mitchell/I would probably insert a sentence right before the bold portion. Then what we could do is use that language so it is consistent on page 8, paragraph C. So that only in cases where the complaint was sustained would the officer's name be made public as well as the complainants. Nov/ Mitchell/ ....There are supreme court cases... public has the right to know .... Nov/So if I or anyone else walked into the Police Department and said I want a full report of every complain that was sustained, I have a right to have it? Dilkes/It is case by case. There is a balancing act on a case by case basis. Nov/There isn't a general public interest in having the names of every report that is sustained? Mitchell/It is a policy decision. Dilkes/I think there are some disciplinary measures .... that the public's interest in knowing... is certainly very high .... There are other reasons that discipline might be imposed... things that don't really affect the public .... where it wouldn't necessarily be the case that the public's right to know would outweigh the officer's privacy. So you have to look at it on a case by case basis. Nov/I am concerned that this report from this particular Board is going to be public information once it is handed to the city council. So I would like us to have rather firm descriptions of what this public reports contains in the ordinance. It is the names that I am concerned about. Mitchell/They are only going to get that report with the names in it if the complaint is sustained. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 9 Norton/ Nov/Okay. Kubby/I have some other questions on page 7 about...reasonable basis standard. Is this is something that is written elsewhere? Mitchell/It is in the State Code .... When a court reviews an agencies decision, that is the standard that they are help by .... Those are the three main .... Norton/What are we up to? Is this the second reading? Nov/This is second reading. I came up with a few very minor technical non-substantive which I gave to Dennis .... Mitchell/I want to clear up on page 9, B.(2) under limited powers. Right now it requires a majority vote of all members of the Board to file a complaint which I think it should be but as far as in paragraph 2, we require the same thing just to decide the level of review .... My recommendation would be to make it a majority of the members at the meeting. Nov/We put that in rather deliberately, you know. We said that because there are only five members, we did not a majority of a quorum which meant only two members making a decision and that is why we put it in this way. Thomberry/That is correct. It was a conscious decision. Mitchell/Okay. Norton/ Council/(All talking). Kubby/It might be something that we need to keep track of, too, if it paralyzes the Board because attendance issues .... Norton/ Council/(All talking). Nov/We have to assume that they all plan to come to the meetings. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 10 Norton/Do we have to make amendments on the floor tomorrow night about this? Mitchell/I would consider regarding the sustained versus not sustained... I guess I would regard that to be substantive. Norton/How do you want us to do that? .... Dilkes/I think we will want to talk... I think most of the changes are non-substantive... because there are so many of them, it is going to be hard to do it by amendment. It may be we have to back up to first consideration. Kubby/What is substantive here? Thomberry/...sunset clause. Dilkes/We already did that. Thomberry/ Council/(All talking) Dilkes/I am not particular concerned about that... do it by motion... We will talk about it .... Karr/There is more than page 7. Dilkes/I think it is just a logistic thing how we figure out how to get you to amend it when there are amendments scattered throughout the whole thing. Nov/I don't think you need a formal amendment for non-substantive. But this sustained and releasing names are probably something we should amend on the floor .... Norton/ Dilkes/We will work it out. Nov/Okay. Mitchell/One thing, Naomi and I spoke... in the intent section, we basically repeat everything else that is in the ordinance ..... This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 11 Norton/Duplicated that way. Mitchell/There are certainly some pros and cons. Cons are that you can cause some confusion is the wording is not exactly the same .... Kubby/ Nov/Too many words. Norton/I found myself getting confused and you are still in the preamble. Nov/I think we could modify the preamble to make less redundant. Mitchell/Okay. Nov/ Dilkes/I would reiterate, I think a lot of times you have pretty detailed legislative findings on intents and goals and that kind of thing and it can be quite helpful when you are trying to interpret the actual provisions of the statute. Nov/Can we somehow get out of the redundancy by saying described in the intent section rather than repeating the words? ....two different interpretations of the same process. Dilkes/The language of the ordinance will always control .... I agree they should be as consistent as possible. Maybe we will just take a look at it. Nov/I see no reason to say the same thing exactly the same way. I would say in the intent section, it could be much briefer. Dilkes/It can be done either way, whichever you want. Nov/I don't think we have any agreement. Anybody else care? Norton/I would prefer not to have so much duplication .... Kubby/There is three people .... Nov/There are only three people who say they would like less redundancy. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 12 Thomberry/ Nov/ Mitchell/I will just go ahead and leave it the way it is. Nov/Okay. Norton/Let me ask...Paragraph J., page 2, it says, the city council finds that internal accountability .....is a valid legislative purpose. I found that kind of an odd wording ..... Kubby/ Norton/It is a valid goal I understand ...... Dilkes/It is a valid subject for your consideration. That is all it says, really. Thornberry/Okay, thank you, Dennis. Nov/Thank you. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 13 Consent Calendar Addition 97-96 S1 Karr/Madam Mayor, we have an addition to the Consent Calendar tonight and the gentleman just arrived. If you could .... It is an addition of a temporary outdoor service area... Mr. Finley and ask to be added late to tomorrow night's agenda for your consideration. Kubby/ Bob Finley/Golden Oldies. I would like to add to the agenda to have a one day beer garden for our grand opening. Karr/A temporary outdoor- Nov/... put it on the agenda tomorrow. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 14 Police Grants 97-96 S1 Nov/Police grants .... Atkins/R. J., I want him to come to the microphone. I sent you a memo two weeks ago... we were recognized for with respect to DVIP and domestic abuse. Shortly thereafter we received two more grants... technology and continuation of our drug grants. These involve a lot of money... specific attention is called to the fact that the DVIP Grant requires us to hire an additional officer .... domestic abuse, DVIP is one player in the whole process. Have the County Attorneys received their grant? Winklehake/Yes. Atkins/DVIP did not get their social worker. Winklehake/However, they are looking at some other funding source to provide the social worker .... still possibility that they will be able to work with us on the grant. Atkins/The question... pursuit of that grant and acceptance of that grant with the understanding it would require an increase in staff of one. Kubby/I am okay with it as long as it is understand that it is not an automatic- When the grant money runs out, that I don't want it to show up in the budget as another officer that comes out of the General Fund... make conscious decision about it. Atkins/... We would take one of our current officers and assign them full-time because that is the intent of the grant. Kubby/ Winklehake/This particular grant is renewable every year. It depends on the history we provide .... The Narcotics grant... 5th or 6th year of a grant that was originally a three-year... We have to apply for that grant every year and we usually find out about beginning of June whether or not it is going to be renewed. Same expectation will be there for the domestic violent investigator. We will have to provide for that every year .... Atkins/If it is acceptable to you, I would bring back to the next council meeting the resolution increasing the Table of Organization by one position. I wanted you to look at it ahead of time .... This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 15 Norton/How can it operate, the whole project, without the social worker component? .... Winklehake/The social worker part of it would be one person of their agency that would devote... item to domestic violence. From our end of it... domestic violence, sexual abuse... child abuse in a domestic setting. Norton/Can you operate without that other person? Winklehake/I would suspect there is going to be a lot of interaction with them whether or not they are getting any grant anyway because we already do have some interaction .... We would be able to do a better job from our end doing domestic violence intervention....have a follow through... I think yes, we can do that .... Norton/ ....you have to endorse their application? Winklehake/Yes, we did. There are three different parts of the grant: law enforcement... prosecution... social agencies and another one for discretionary fund .... Cris Kinkead from DVIP indicated that there is other money available and they feel fairly certain they will be able to secure that funding .... Nov/A different grant? Winklehake/A different type of grant .... Nov/ Winklehake/ .... She feels fairly certain they are going to be able to meet that requirement for other funding ....Our grant, the contingency for next year, would be on how well we perform .... Atkins/Okay at the next meeting I present the resolution on the position? Okay, thank you. Kubby/ Winklehake/ Norton/We have talked almost entirely about the second of these two. There are two of them here, isn't there? This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 16 Atkins/Yeah. The technology one was the equipment one and then the drug grant and two weeks ago I sent you the other memo. Norton/We don't have any trouble coming up with the matching money? Atkins/No ...... Nov/I think the idea of the joint application for three different people within the community... excellent idea. Good job. Atkins/Thank you. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 17 Transit Interchange Project 97-96 S1 Nov/Okay, we are on transit interchange. We didn't get any pictures. Did you bring some pictures? Ron Logsden/Yes. Council/(All talking-looking at pictures). Logsden/After the Design Review meeting and meeting with city council... suggestions... we tried to go back and put the interchange and the direction so it does face the downtown area, the main entrance of the interchange and some other design suggestions. I will let Steve talk to you about that. Steve Ford/With Shoemaker and Haaland Engineers .... concerns you had from the last meeting and tried to work with those .... The island which was...proposed... same size as it was before .... For safety reasons we didn't pull it all the way to the east but we did center it... safety .... What I wanted to tell you is most of the drivers will now use the east door. The building is flipped around completely so the office and restrooms are on the west end .... Front entry is now on the east side, facing downtown .... We have tried to at that front entry pull the brick... safety and esthetic appeal, pulling you into the front door... four... planters ....highlight is now on the downtown side .... Kubby/ ....drivers went to the back entrance... Nov/Is this west side entrance more convenient for the drivers? Ford/Equally so... as convenient. Nov/I just wondered if it shouldn't have one entrance ....so people don't mistakenly come in the wrong way. Ford/It will be marked and appropriately signed .... It will say Iowa City transit... front door appeal... lighting on both sides .... clearly identified .... may say welcome .... Kubby/There is enough room to make that U-turn? Ford/There is. Logsden/Yes, we went out and put cones .... where the bus would be ....also driver entrance would be locked .... This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 18 Kubby/ ....This makes me very enthusiastic about it .....more welcoming to the general public .... Norton/This is still not a place where people wait for the bus? Ford/There will be waiting in the information area .... Norton/Looking at anyway to incorporate the thing into the comer at Talbot's? Ford/We haven't been given that direction. Nov/No. CHANGE TAPE TO REEL 97-96 SIDE 2 Nov/ Ford/The north side will be exactly the same .... Nov/The windows will go clear through .... Ford/On the north side it will have a mirror image. Nov/I want an assurance there are windows on both sides and it is fairly see through. Ford/... that is the idea. Norton/ Nov/Anybody else want to say something? Schoon/Design Review met this evening and reviewed the project. Randy Rohovit, the chair, is here. The Committee recommended disapproval of the design as presented by a vote of 4-1 .... Randy Rohovit/Most of the discussion centered around style- Nov/Randy, will you come closer to the microphone? .... This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 19 Rohovit/... massiveness of the structure... not perceived as being very transparent within its sight .... Also... mixing ped traffic with vehicle traffic .... safe ..... Norton/You mean it doesn't improve that ..... Nov/I am concerned about the .... transparency. Why did the committee say that it was not transparent enough? Rohovit/The windows ..... use of the brick and materials all have this heaviness to them .... the material being used .... heaviness to us. Thomberry/Like a bus or something. Kubby/ Rohovit/Against this design. Kubby/It was approved before and it is basically turned around, right .... Schoon/At least for a couple of committee members they would not have agreed with the city council in terms ofreorienting the structure. There is a safety concern for them .... bringing that pedestrian activity up to that intersection .... they thought you could do something different to make that site more attractive. For two people that was a very important issue. Vanderhoef/Was there any discussion about moving the entire structure further west? .... Rohovit/I think safety centered around building that facility in the middle of the road. Council/(All talking). Norton/ Nov/What about the transparency question in terms of color7 Was there any discussion about lightening the color? Rohovit/No, there wasn't. Nov/ Norton/What happened to the compressor? This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 20 Ford/(Can't hear). Nov/We told them to put it inside and they did. Ford/Mechanical is all inside. Nov/What color is the glass? Ford/Slightly tinted .... Nov/How about clear glass? Ford/ .... Nov/ Ford/Essentially neutral tones ....I think it does have a transparent look to it ....you do need a little tint .... Vanderhoef/How is the efficiency of the building as far as heat and cool? .... Ford/(Can't hear). Nov/ Ford/Tempered .... Thornberry/... it is not going to get that much sun .... Norton/I would kind of like to hear Dick Gibson's comments .... Nov/ Dick Gibson/... A little bit of a University hat ..... My concern is right next to this is a monumental place that is on the National Register of historic places .... area was already compromised quite a bit with urban renewal .... jammed a lot of buses in there .... bluntly .... This project needs an architect .... it is very important. It could be an icon in downtown Iowa City... It is very important... represent Iowa City... I am not sure you are going to get that with this solution .... With regard to transparency .... see through building... there is an esthetic that is associated with This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 21 that .... big heavy concrete columns don't speak to a transparent building... Very heavy building in terms of its scale and massiveness .... It did not have appropriate architectural input from the word go .... people have been tinkering with the design ever since .... design by committee is what it amounts to .... I wonder if there is better opportunity... get this thing over here an a very important comer .... get along with one less bus lane... widen that out... move this thing around the comer somehow .... whole mess of things that I am concemed about ..... start with a very simple concept, i.e. toilets for bus drivers and then it takes on like a stone rolling down hill .... bigger and bigger .... very sizable structure .... Kubby/When you talk about safety, there aren't cars that are tuming into this .... It is a very pedestrian oriented comer. Why not go with that flow .... take it over ....of pedestrian oriented space? Gibson/... You are going to have some number of buses .... Would you put a hot dog stand out in the middle of the street?... ask people to leave the safety of the curbside and go out for a purpose like that .... Kubby/ Norton/...they go out and back.. get the same information from other places... mixed purposes... 16 feet in that flower bed .... Gibson/The sidewalk beyond that out to the curb is quite wide .... dead one block down through there .... This thing might enhance the activity of that comer .... Lehman/I would assume you get strong objection from Talbots if you cover those windows. Gibson/That is not my problem to deal with .... I don't know if it has been seriously looked at even ..... City has a lot of power .... Nov/...Clinton Street side has very low traffic ..... Vanderhoef/...entrance to the mall .... Nov/If this were just information, you could put a booth on the sidewalk... Not what we are really doing .... We are really building a place for the bus drivers .... Gibson/The bus drivers got along for years quite well until we closed Schaeffer Hall... opened again to the public last Tuesday morning .... This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 22 Nov/This also gave them a place to sit and eat and take a break .... Norton/Thank you, Dick. There you have it... sticky I think. Nov/It is sticky... I am truly disappointed that we don't get glass samples and brick samples... Also I want to know exactly how big is this .... Ford/(Can't hear). Norton/Think of the concept .... Nov/What is the total length of the building? Ford/ Nov/60 feet, 40 feet ..... Norton/Do we want a structure out there in the middle of the street? Vanderhoef/40 X 16 on the building .... 80 feet long and 23- Thomberry/How much was it? $225,000? Vanderhoef/...looking at lots of different things happening in the downtown and I have wondered whether this is truly the place for the bus depot?...very congested spot .... Kubby/This is the hub .... This area is the hub. Vanderhoef/ Norton/The thing with information and tickets can be done easier .... Is there any chance you can incorporate anything in that comer? Has anybody asked the mall if you can do anything with that comer? Kubby/We haven't asked ..... Franklin/...before Talbot's went in, we had a conversation with the Mall about putting in bathrooms for the bus drivers when they were doing the reconstruction for Talbot's and I don't know what happened .... It didn't work out that we could get This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 23 those bathrooms .... P/Z Commission has a meeting at 7:30. I am just thinking of the projecting signs issue. Nov/Okay, thank you. Thomberry/There might be one or two shops available in the mall .... maybe if we could rent a little space in the mall .... Logsden/The grant would not work. You couldn't spend the $225- for rent .... Nov/...there is a grant. Kubby/What is the time frame? ..... Logsden/We would probably not be able to build this construction season but the money will still be available for next construction season .... Kubby/ Nov/Is the comment from Dick Gibson valid? That there wasn't an architect to design this? Logsden/No, there was an architect. Dick Gibson/There was not a architect leading the design. Do we want to let P/Z come forward first? Franklin/This is something that the P/Z Commission and the Design Review Committee have recommended that we not put up projecting signs. Council's position or at least four of you indicated a desire to look at the concept of projecting signs. What don't we deal with that aspect of it first, should we open up projecting signs or not and then we can get into the specifics of the criteria .... George Starr/On a kind of related item, I think the Commission would like to re-visit the policy of joint meetings between council and commission when there is disagreement after the commission has sent a recommendation. We seem to be in council's work session which, to me, does not seem to be an appropriate forum for open free equal discussion that we use to traditionally have when that disagreement occurred .... I think they would agree .... this just does not seem to be the forum .... I guess I would like to suggest that the commission and council re- visit that policy and see if we can come to some kind of agreement. Norton/Was that policy changed? No~No .... Council/(All talking). Nov/We used to meet in this room .... Kubby/ Nov/ Starr/But it was specifically a meeting between council and commission pertaining only to those issues .... Norton/ Starr/I think the commission came to this meeting with that understanding as well .... Kubby/Or have this meeting at the beginning of our work session so we can do that. Starr/I think there are some guidelines that we can look at to make it work. As far as the projecting signs, I reviewed the staff report... minutes... I have very few comments This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 28 to make. I believe it was the majority of the Commission's position that the current ordinance seems to be working extremely well .... The Commission questioned what enhancements projecting signs would add to the downtown area? .... What good does the amendment do? .... We couldn't really come up with any additional ones .... If projecting signs are allowed, it is my understanding that awnings could also still be allowed... You could have an awning without a sign on it... You could also have a projecting sign .... added additional visual clutter to the downtown .... We simply couldn't come up with no real compelling reason to change the ordinance ....The competition would try to be there.. all be at the same size... Norton/Is that any different than with facade signs? ....Many cities have projecting signs .... Starr/... seemed to us as you are looking down the streetscape, you could potentially have competition .... bigger so people could see it .... Thomberry/If you had restrictions on signs so finite so that it couldn't extend out beyond X number of inches... They couldn't one-up-manship .... Starr/ Thomberry/I am thinking Galena, Illinois ..... look down and see all these little signs projecting out .... I don't remember any awnings .... Starr/We had significant conversation about the awnings... Thomberry/ Starr/ Norton/Freedom of choice .... so many communities in this country that manage to deal sensibly with projecting signs .... beer signs in windows .... Starr/My impression from the Commission is if the ordinance is amended, that it should be amended with some fairly strict- Council (All talking). Norton/I don't care what shape it is as long as it is a reasonable sign. Starr/I guess I will reiterate what I said earlier ....My impression... the Commission was basically coming from the visual clutter ....I would ask since this is a meeting between the council and the Commission .... Dick Gibson/Strikes me... signs do block visibility .... unique atmosphere .... remarkable thing going on Saturday night .... need to be thinking in terms of what is unique in downtown Iowa City and strengthening those things .... I can't see where the gain .... signs... emotional .... Thomberry/... talking about... little signs .... We would say how big they can be .... Gibson/ ....gives you four feet vertical height, project out 4-5 feet... too big. Thornberry/It can be smaller .... Gibson/ Norton/ Kubby/ Chait/Minority opinion of one. The question is do we want to do that. Thomberry/ Nov/We have P/Z meeting at 7:30. Anyone from P/Z who has to add to this discussion, I would like to hear it. Starr/I have to agree with Dick. I might make a move to amend tomorrow night. One of them is place of meetings... All meetings shall be held in a city facility. I think it should say held in an accessible city facility. Nov/ ....I have no problem adding accessible. Atkins/Everything in this building is now ....I agree... I see your point. Kubby/Next issue is in terms of terms and ifa position or appointment becomes vacant by a reason of a resignation or somehow results in an unexpired term, that could may choose to fill that term out plus the next full one and I thought that we had said if it is six months or less. Vanderhoef/We did. Kubby/That is not incorporated here. Nov/Okay. Council/ Kubby/Those are the only two comments I had. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 49 Karr/I am wondering if it got lost in the re-writes because I thought it was in there at one point. We will double check that .... consistency. Nov/Marian, can you just redo both of those .... Karr/...I don't see it as a problem .... 8. Kubby/(Agenda #3e(8) 1997 Comprehensive Improvements Assistance Program)... I think it is a good thing to go for ....It says relocate Housing Authority to the Civic Center. Atkins/If we build a third floor.. propose... federal money assist in the financing, the construction .... Kubby/...wondering how high a priority that is. Atkins/We expect our chances to be slim to none. However, one of the calculations we make when we put the project together is bringing them over and charging them rent because they are currently paying rent... We can fund the capital, they can pay us rent to create the cash anyway to do that .... I don't know .... Kubby/ Vanderhoef/Are there any plans? .... Atkins/'We have some very rough plans .... Public Works Department... put them up... Send the Housing folks into where Public Works now is located .... Build in for Marian's Office .... All non-bearing walls .... Helling/ ....Document Services would share top floor with Planning. Atkins/Second floor Police Department ..... Nov/ Arkins/...give you a quick tour... nice exercise room downstairs .... 9. Kubby/Item #32 is adjourn to executive session at the end of the meeting. I thought we had scheduled this for 6:00 PM instead after the meeting. When did that get changed? This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 50 Nov/I don't know when it got changed but it got changed .... we can show up at 7:00 PM. Kubby/I gave up an opportunity to do something that was very important to me because the meeting was at 6:00 instead of 7:00PM. It is going to be late. Atkins/May I make a comment? If it is very late, I don't want you dealing- Kubby/I understand. Nov/ Atkins/I just mean, if it is so late, it is not fair to me and it is not fair to you, it is not fair to Marian .... I would say we will wait... I want to be able to visit and talk and feel comfortable about the discussion .... Nov/It is very difficult to do all of this in one hour. Karr/It is why you moved it Madam Mayor .... Atkins/ Kubby/I guess I would like it if you could check in about those kinds of moves .... Norton/ Atkins/I am assuming it will be retroactive ..... Nov/We may go through the agenda quickly, We will see. 10. Kubby/A couple of years ago.. idea... employees to talk to Steve... program for safety gear for employees who ride their bikes to make sure they are wearing helmets... lights... Where is the program? Arkins/I thought we did ....TEAM Committee. 11. Kubby/I spoke with Jay Shaw last week and he is interested in sending us some information... check in to see if people will read it before he sends it... And the answer is yes, that is great... This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 51 12. Nov/The Pride Month proclamation was one that I did on Saturday at their meeting. So I am not going to read that .... 13. Nov/(Agenda #20-New regulations regarding animals).I ran into Misha. We talked more about rodeos. There really is no reason to say that rodeos are allowed in Iowa City because there is no place within the city limits .... Thornberry/ Nov/I am just talking about the ones with animals .... I would really like the council to see some of these things .... Kubby/I am ready to ban them. Thornberry/You can see some of my pictures .... I will show my rodeo pictures. Nov/Is there anyone here who would like to reconsider? .... just about rodeos. Norton/I have more trouble with rodeos than with circuses .... Nov/I see on, two, three. Is there anyone on this side that would like to reconsider banning rodeos in the city limits? Lehman/ Nov/There is no point in having them permitted .... Council/(All talking). 14. Kubby/ When are we going to hear about the SEATS negotiations? Thomberry/When it is done. At least when we get all the information. It is not done... We asked for information to bring to the city council. Vanderhoef/We will be meeting again in roughly two weeks... don't have a date set. Kubby/In looking at Bob Welsh's letter .... Nov/Bob Welsh is hearing only from the people who say this is wonderful .... This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 52 Kubby/I am saying there is some real practical, real cooperations that still need to happen if we want to give decent transportation options to people ....stopping at the city limits is a big concern .... Norton/I can't believe that they will dropping at the edge of town... Thornberry/It won't happen. Nov/The county can take care of people that want to go out of town. Council/(All talking) Thornberry/I have got a SEATS comment. We are negotiating with the county for SEATS. They are not the only game in town. So what we are going to do... is getting that apple completed to know exactly what we are getting... Once they know exactly what we expect and we know exactly how much it is going to cost us, we are going to shop it... to the cab company .... to the city .... privately... And they know that ....They are one of the people that we are looking at to give us SEATS service .... We can shop that apples to apples to apples so that there is no difference but there will definitely be a difference in the price. Kubby/ Thornberry/...we would like to know what we are getting for out money ..... Norton/As long as they are not scab wages. Thomberry/I don't care what they pay for wages. Kubby/Some of us do. That is a factor .... one of the pieces of information we want is the hourly wage and what the bennies are. Thornberry/We can do that .... Kubby/... When we do engineering contracts, we have the hourly wage .... We do that on some contracts. Thomberry/... All I am saying, Karen, is we are going to shop this out and the county knows it .... Norton/ This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 53 Thomberry/ Norton/You know what I am talking about. I don't want to buy slave labor .... If you can figure it out. Thornberry/ Kubby/The other value that is here .... cooperate more... city... county... goals is to have a unified system .... Whether it ends up that we do it privately or another entity... a big value is a unified system .... goal .... Our negotiating teams need direction from us and we need to hear back from them when we get the information ..... Have a report you can give us on paper... if you have it. Norton/ Thomberry/We are going to get an extension from the county because we wanted to bring all the information back... to get a council direction on where to go .... Norton/Contract usually starts July 1. 15. Norton/... I read somewhere... difficulty... Public Works structure and the location on the airport. Atkins/I wrote the memo .... Airport Commission raised a number of questions about the timeliness. They are anxious to pursue the development of that site .... I strongly encourage you to watch this very closely .... We haven't settled in on a formal recommendation. I am going to go to the Airport Commission meeting on Wednesday at noon to see what they have to say .... I will know some more. Norton/ Atkins/ Vanderhoef/There was something in our minutes that said something about an RFP and I haven't seen or heard anything about it. Dilkes/Ron developed sort of a draft RFP that he has passed out to them. Vanderhoef/ This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 54 Dilkes/It has not gone out. Norton/...comment... we out to sit down with them... with the airport. Karr/We are going to be remodeling the Chambers .... a whole different atmosphere .... Starts next week, Friday afternoon. Atkins/Attractive nicer environment .... Karr/Some of the issues regarding the actual scheduling will be council decisions .... Nov/Work sessions... do an agenda doubling kind of thing .... Norton/Context they say is not give and take 16. Karr/Jeff Davidson handed me a note and he said this just became know to him last this aftemoon. If any of you are interested in going to a dinner meeting in Des Moines on 26th of this month to discuss passenger rail coalition with Des Moines and Quad City representatives, please let me know tonight or call Jeff for more information .... interested in meeting with Iowa City reps. Nov/How nice .... Karr/I know a number of you are out of town. Norton/I will try. Karr/I will tell Jeff you are interested. 17. Atkins/... I will gone the week of July 7 ..... 18. Atkins/ .... On Wednesday afternoon, I understand the Airport Commission will be approving a major contract, ACSG. Dilkes/ACSG is the land acquisition consultant .... Atkins/It is a major contract in the neighborhood of $1/2 million .... just so you are aware that it is moving along and they are starting to make some major commitments. Lehman/... We have 30 days after signing the contract. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 55 Dilkes/Not 30 days after signing the contract. It can be terminated on 30 days notice and I have also made it contingent on funding approval by the city council. I think what I can do is shorten up that termination provision in the event that funding would be withdrawn .... Atkins/The whole process will become much higher profile now. Dilkes/The process needs to get moving .... got people out there waiting for us. Thomberry/...total acquisition? Lehman/I think they do. Kubby/We made a decision. Thornberry/Nobody seems to agree on one of the properties as far as what the value is. Dilkes/We haven't even gotten to the point where we got specific appraisals on that property. This will just get that process going .... Council/ Lehman/I talked to this gentleman from FAA this morning .... he told me that the FAA will not approve purchasing land for what they consider more than the appraised value .... Dilkes/They like to see on significant pieces of property, two appraisals and then a review appraisal. There will be some significant work to be done before we decide what price makes sense. Lehman/I asked him several questions, one of them being what if we don't do anything with the airport and what I gleaned... probably nothing... He strongly recommended that we do acquire the property .... Kubby/...Master Plan... 20 year plan. Lehman/ Kubby/There are some things that are a must to stay in compliance. This represents only a reasonably accurate transcription of the Iowa City council meeting of June 16, 1997 WS061697 June 16, 1997 Council Work Session page 56 Lehman/... I think kind of what we think we have to have and what we may have to have may be two different things. Norton/... I thought we were trying to proceed... keeping a relatively minimum airport. Thornberry/ ....If we don't have the clear zones that are delineated on the Master Plan- Lehman/That is what he said, you acquire those. Thornberry/ Lehman/...protect the airport .... Norton/I feel like I only have a piece of the action .... I am trying to figure out who is on first and do we all have the same information .... Somehow somebody should keep us informed relatively uniformly about the airport issues. Thornberry/ Norton/I didn't even know you were going or under whose aegis... Dilkes/That was the trip that I had informed you of in my last memo that got delayed .... Norton/I have my troubles with council acting in subsets in any case. I just want to make that clear. I like this to be a coherent group of seven people .... Thornberry/...how far you want to go? Norton/Seems to me on most of these things the council doesn't operate as subsets. By and large that is not a good policy ..... need to have a report. Thomberry/I thought I tried to do that. Norton/I didn't even know you were going or why. Thornberry/... I tried to say what we gleamed... Norton/In general... I don't think we ought to operate as subgroups. Thornberry/I agree we shouldn't operate independently as subgroups ....
