Schmadeke/If they didn't grant the easement, then at some point in time on public
property and then it would be their obligation. They don't have sidewalks .... on
their property.

Lehman/Bowery Street we just had some sidewalks in that were not sidewalks. Can that
property owner be required to put that sidewalk in?
Schmadeke/By special assessment.
Lehman/It might be such- It sounds to be like you have some negotiating tools .....
Norton/There is a big sidewalk .... a four footer would be plenty there.

Nov/But he had offered to maintain it .... He wants to be able to do snow removal with
equipment rather than a shovel and therefore he wants the eight feet.

Kubby/If they don't want to maintain it, then they should give us the easement for the six
foot.
Lehman/But if you go with the four foot, you can assess then for the cost of the
sidewalk.

The question was how many sign faces can you have and you could have a

D. CONSIDER A LETTER TO THE JOHNSON COUNTY BOARD OF
SUPERVISORS RECOMMENDING APPROVAL OF AN APPLICATION FOR A
CONTINUATION OF A CONDITIONAL USE PERMIT TO ALLOW A HOME
BUSINESS, AN ART GALLERY, FOR PROPERTY LOCATED IN FRINGE AREA B
AT 3880 OWL SONG LANE SE, IMMEDIATELY NORTH OF INVERNESS COURT.

Franklin/Last item is to consider a letter to the Board of Supervisors on an application
for a conditional use permit to allow home business. This is for the art gallery, the
Barn, I think it is called out in Windsor Ridge. This is a conditional use permit
that was granted previously. This would be for a five year period of time as
opposed to two years .... provisions.. they continue the screening and if it were
ever annexed into Iowa City, the conditional use permit would cease because this
is a commercial use of residential property. So the recommendation is for
approval for both the staff and P/Z Commission ....

Thornberry/I had a question in the Consent Calendar (Agenda (#3e(4)-Lease of Airport
Land-Iowa City Salvage Barn).
Kubby/The Salvage Barn thing?
Thornberry/Yeah. It is just going from one pocket into the other.
Kubby/I had a question... for legal. In the non-discrimination clause, it doesn't match our
Human Rights Ordinance .... on the Salvage Barn lease agreement, page 2, #10 ....
The one I noticed was gender identity ....

Nov/There is Exhibit B mentioned and my package didn't have any Exhibit B.
Dilkes/Is this still the Salvage Barn one?

Norton/The form looks imposingly long.
Kubby/Why isn't the Board going to develop this? Why are we developing it?
Nov/We are just giving them a sample of the form they should develop.
Mitchell/I think Steve just wanted to give them something so they could get started at
least right away.
Nov/We expect they will amend it.
Kubby/When people are being trained to provide assistance, I think it would be good for
a couple of council members to get trained, too, because we get a lot of calls from
constituents .... I would like to suggest that council members get trained ....
Nov/And I assume the information desk at the library is a reasonable place to have
somebody who can help with forms ....
Kubby/The other place .... that isn't on the list, is the City Clerk's Office and the Human
Rights Division ....
Atkins/When I said Civic Center, I mean we will put them any where you want in the
building, yeah.
Norton/The information desk .... public... might not want to do that ....You are talking
kind of private things ....

Susan Craig/Our thought that if necessary if someone appeared or asked for a fair
amount of assistance filling out the forms, we would have someone called to
come and help them and take them to a private location.

Kubby/There are a couple things in the sample that I don't even want to be given as a
sample .... it says, the review board will investigate if it appears to state a case of
misconduct. And really what we are saying is all complaints will be taken and
investigated. I think those are real different messages ....
Dilkes/This is just a draft that Steve gave you to get started .... It is going to have to be
worked on ....problems... We don't have a board of inquiry ....We can work on it
and make it-

Kubby/So we are on to the ordinance.
Nov/Anyone want to comment on the ordinance as presented?
Kubby/I had a question on page 8, c.(2), the bolded part of that sentence, This annual
report shall not include the name of the complainants or officers. How will trends
among individual officers be kept if they are not part of an annual report?
Mitchell/ .... We could also keep confidential records with the Board, too, so the Board
could track that. Although the public portions of the report wouldn't include the
officer's name as well as the complainant's name.
Kubby/How does the community then track trends?
Mitchell/Regarding particular officers? They would just have to rely on the Board to do
that.
Dilkes/I think there is a danger in that, too. Annual report ....would include all
complaints whether sustained or not sustained-
Kubby/
Dilkes/... There is a problem there. You put the officer's name, you put not sustained. I
think there is some difficulty .... I think some people will ignore the not sustained
and look at the officer's name and I don't know if that is a fair thing to do .... issue
of we didn't include in here that complainant's names and officer's names would
be admitted from the report that the Board sends out on each complaint and I
think that that is a reasonable thing to do unless it is a sustained finding ....
Kubby/My biggest concern is that the city can track that information.

Mitchell/The Board is still going to have that information .... I was going to recommend
a change on page 7, paragraph 3... That if the complaint is not sustained, that the
officer's name be omitted from the public report as well as the complainant's
name .....
Norton/Add that at the end or have you not decided?
Mitchell/I would probably insert a sentence right before the bold portion. Then what we
could do is use that language so it is consistent on page 8, paragraph C. So that
only in cases where the complaint was sustained would the officer's name be
made public as well as the complainants.

Mitchell/ ....There are supreme court cases... public has the right to know ....
Nov/So if I or anyone else walked into the Police Department and said I want a full
report of every complain that was sustained, I have a right to have it?
Dilkes/It is case by case. There is a balancing act on a case by case basis.
Nov/There isn't a general public interest in having the names of every report that is
sustained?
Mitchell/It is a policy decision.
Dilkes/I think there are some disciplinary measures .... that the public's interest in
knowing... is certainly very high .... There are other reasons that discipline might
be imposed... things that don't really affect the public .... where it wouldn't
necessarily be the case that the public's right to know would outweigh the
officer's privacy. So you have to look at it on a case by case basis.
Nov/I
am concerned that this report from this particular Board is going to be public
information once it is handed to the city council. So I would like us to have rather
firm descriptions of what this public reports contains in the ordinance. It is the
names that I am concerned about.
Mitchell/They are only going to get that report with the names in it if the complaint is
sustained.

Kubby/I have some other questions on page 7 about...reasonable basis standard. Is this is
something that is written elsewhere?
Mitchell/It is in the State Code .... When a court reviews an agencies decision, that is the
standard that they are help by .... Those are the three main ....
Norton/What are we up to? Is this the second reading?
Nov/This is second reading. I came up with a few very minor technical non-substantive
which I gave to Dennis ....
Mitchell/I want to clear up on page 9, B.(2) under limited powers. Right now it requires
a majority vote of all members of the Board to file a complaint which I think it
should be but as far as in paragraph 2, we require the same thing just to decide the
level of review .... My recommendation would be to make it a majority of the
members at the meeting.
Nov/We put that in rather deliberately, you know. We said that because there are only
five members, we did not a majority of a quorum which meant only two members
making a decision and that is why we put it in this way.
Thomberry/That is correct. It was a conscious decision.
Mitchell/Okay.

Kubby/It might be something that we need to keep track of, too, if it paralyzes the Board
because attendance issues ....

Norton/Do we have to make amendments on the floor tomorrow night about this?
Mitchell/I would consider regarding the sustained versus not sustained... I guess I would
regard that to be substantive.
Norton/How do you want us to do that? ....
Dilkes/I think we will want to talk... I think most of the changes are non-substantive...
because there are so many of them, it is going to be hard to do it by amendment. It
may be we have to back up to first consideration.
Kubby/What is substantive here?
Thomberry/...sunset clause.
Dilkes/We already did that.

Dilkes/I am not particular concerned about that... do it by motion... We will talk about
it ....
Karr/There is more than page 7.
Dilkes/I think it is just a logistic thing how we figure out how to get you to amend it
when there are amendments scattered throughout the whole thing.
Nov/I don't think you need a formal amendment for non-substantive. But this sustained
and releasing names are probably something we should amend on the floor ....

Mitchell/There are certainly some pros and cons. Cons are that you can cause some
confusion is the wording is not exactly the same ....

Norton/I found myself getting confused and you are still in the preamble.
Nov/I think we could modify the preamble to make less redundant.
Mitchell/Okay.

Dilkes/I would reiterate, I think a lot of times you have pretty detailed legislative
findings on intents and goals and that kind of thing and it can be quite helpful
when you are trying to interpret the actual provisions of the statute.
Nov/Can we somehow get out of the redundancy by saying described in the intent
section rather than repeating the words? ....two different interpretations of the
same process.
Dilkes/The language of the ordinance will always control .... I agree they should be as
consistent as possible. Maybe we will just take a look at it.
Nov/I see no reason to say the same thing exactly the same way. I would say in the intent
section, it could be much briefer.
Dilkes/It can be done either way, whichever you want.
Nov/I don't think we have any agreement. Anybody else care?
Norton/I would prefer not to have so much duplication ....
Kubby/There is three people ....
Nov/There are only three people who say they would like less redundancy.

Karr/Madam Mayor, we have an addition to the Consent Calendar tonight and the
gentleman just arrived. If you could .... It is an addition of a temporary outdoor
service area... Mr. Finley and ask to be added late to tomorrow night's agenda for
your consideration.

Police Grants 97-96 S1
Nov/Police grants ....
Atkins/R. J., I want him to come to the microphone. I sent you a memo two weeks ago...
we were recognized for with respect to DVIP and domestic abuse. Shortly
thereafter we received two more grants... technology and continuation of our drug
grants. These involve a lot of money... specific attention is called to the fact that
the DVIP Grant requires us to hire an additional officer .... domestic abuse, DVIP
is one player in the whole process. Have the County Attorneys received their
grant?
Winklehake/Yes.
Atkins/DVIP did not get their social worker.
Winklehake/However, they are looking at some other funding source to provide the
social worker .... still possibility that they will be able to work with us on the grant.
Atkins/The question... pursuit of that grant and acceptance of that grant with the
understanding it would require an increase in staff of one.
Kubby/I am okay with it as long as it is understand that it is not an automatic- When the
grant money runs out, that I don't want it to show up in the budget as another
officer that comes out of the General Fund... make conscious decision about it.
Atkins/... We would take one of our current officers and assign them full-time because
that is the intent of the grant.
Kubby/
Winklehake/This particular grant is renewable every year. It depends on the history we
provide .... The Narcotics grant... 5th or 6th year of a grant that was originally a
three-year... We have to apply for that grant every year and we usually find out
about beginning of June whether or not it is going to be renewed. Same
expectation will be there for the domestic violent investigator. We will have to
provide for that every year ....
Atkins/If it is acceptable to you, I would bring back to the next council meeting the
resolution increasing the Table of Organization by one position. I wanted you to
look at it ahead of time ....

Norton/How can it operate, the whole project, without the social worker component? ....
Winklehake/The social worker part of it would be one person of their agency that would
devote... item to domestic violence. From our end of it... domestic violence,
sexual abuse... child abuse in a domestic setting.
Norton/Can you operate without that other person?
Winklehake/I would suspect there is going to be a lot of interaction with them whether or
not they are getting any grant anyway because we already do have some
interaction .... We would be able to do a better job from our end doing domestic
violence intervention....have a follow through... I think yes, we can do that ....
Norton/ ....you have to endorse their application?
Winklehake/Yes, we did. There are three different parts of the grant: law enforcement...
prosecution... social agencies and another one for discretionary fund .... Cris
Kinkead from DVIP indicated that there is other money available and they feel
fairly certain they will be able to secure that funding ....
Nov/A different grant?
Winklehake/A different type of grant ....

Winklehake/ .... She feels fairly certain they are going to be able to meet that requirement
for other funding ....Our grant, the contingency for next year, would be on how
well we perform ....

two weeks ago I sent you the other memo.

community... excellent idea. Good job.

Transit Interchange Project 97-96 S1
Nov/Okay, we are on transit interchange. We didn't get any pictures. Did you bring some
pictures?
Ron Logsden/Yes.
Council/(All talking-looking at pictures).
Logsden/After the Design Review meeting and meeting with city council... suggestions...
we tried to go back and put the interchange and the direction so it does face the
downtown area, the main entrance of the interchange and some other design
suggestions. I will let Steve talk to you about that.
Steve Ford/With Shoemaker and Haaland Engineers .... concerns you had from the last
meeting and tried to work with those .... The island which was...proposed... same
size as it was before .... For safety reasons we didn't pull it all the way to the east
but we did center it... safety .... What I wanted to tell you is most of the drivers
will now use the east door. The building is flipped around completely so the office
and restrooms are on the west end .... Front entry is now on the east side, facing
downtown .... We have tried to at that front entry pull the brick... safety and
esthetic appeal, pulling you into the front door... four... planters ....highlight is
now on the downtown side ....
Kubby/ ....drivers went to the back entrance...
Nov/Is this west side entrance more convenient for the drivers?
Ford/Equally so... as convenient.
Nov/I just wondered if it shouldn't have one entrance ....so people don't mistakenly
come in the wrong way.
Ford/It will be marked and appropriately signed .... It will say Iowa City transit... front
door appeal... lighting on both sides .... clearly identified .... may say welcome ....
Kubby/There is enough room to make that U-turn?
Ford/There is.
Logsden/Yes, we went out and put cones .... where the bus would be ....also driver
entrance would be locked ....

Norton/Looking at anyway to incorporate the thing into the comer at Talbot's?
Ford/We haven't been given that direction.

chair, is here. The Committee recommended disapproval of the design as
presented by a vote of 4-1 ....

Rohovit/... massiveness of the structure... not perceived as being very transparent within
its sight .... Also... mixing ped traffic with vehicle traffic .... safe .....
Norton/You mean it doesn't improve that .....
Nov/I am concerned about the .... transparency. Why did the committee say that it was
not transparent enough?
Rohovit/The windows ..... use of the brick and materials all have this heaviness to them ....
the material being used .... heaviness to us.
Thomberry/Like a bus or something.

Kubby/It was approved before and it is basically turned around, right ....
Schoon/At least for a couple of committee members they would not have agreed with the
city council in terms ofreorienting the structure. There is a safety concern for
them .... bringing that pedestrian activity up to that intersection .... they thought you
could do something different to make that site more attractive. For two people that
was a very important issue.
Vanderhoef/Was there any discussion about moving the entire structure further west? ....
Rohovit/I think safety centered around building that facility in the middle of the road.

about lightening the color?
Rohovit/No, there wasn't.

Dick Gibson/... A little bit of a University hat ..... My concern is right next to this is a
monumental place that is on the National Register of historic places .... area was
already compromised quite a bit with urban renewal .... jammed a lot of buses in
there .... bluntly .... This project needs an architect .... it is very important. It could
be an icon in downtown Iowa City... It is very important... represent Iowa City... I
am not sure you are going to get that with this solution .... With regard to
transparency .... see through building... there is an esthetic that is associated with

that .... big heavy concrete columns don't speak to a transparent building... Very

simple concept, i.e. toilets for bus drivers and then it takes on like a stone rolling

least four of you indicated a desire to look at the concept of projecting signs. What
don't we deal with that aspect of it first, should we open up projecting signs or not
and then we can get into the specifics of the criteria ....
George Starr/On a kind of related item, I think the Commission would like to re-visit the
policy of joint meetings between council and commission when there is
disagreement after the commission has sent a recommendation. We seem to be in
council's work session which, to me, does not seem to be an appropriate forum for
open free equal discussion that we use to traditionally have when that
disagreement occurred .... I think they would agree .... this just does not seem to be
the forum .... I guess I would like to suggest that the commission and council re-
visit that policy and see if we can come to some kind of agreement.

request for funding until we had at least ten names signed on the line .... Their
meeting was last Thursday ..... I guess I am looking for direction on whether we

previous appointment that got us into this consideration ....an architect in a
business slot ....The committee chose to put him in that ....That is why we were
trying to get a straight business person instead of.... The bylaws say two business
people and two architects and two people from design and building trades.
Kubby/That is our choice .... that is us tilting the scales to the architect ....
Karr/Because of the committee filled more than one slot, they got to pick which one
before the appointments.

3. Norton/I went out to Sandusky... They tried to have an open house... but it wasn't a
very satisfactory format .... Not everyone was hearing the same story... I hope they
are arranging a neighborhood meeting ....
Atkins/I spoke with Rick ....the project is not going to get finished this year. So we do
have some time.
Norton/So there is time to get organized... difficulties .... a lot of cross connects.
Atkins/...There were some problems .... problems is the trees ....
Norton/I just hope that somebody is checking on the connects... sumps pumps connected
directly into the sanitary sewer ....

Atkins/We expect our chances to be slim to none. However, one of the calculations we
make when we put the project together is bringing them over and charging them
rent because they are currently paying rent... We can fund the capital, they can
pay us rent to create the cash anyway to do that .... I don't know ....

SEATS. They are not the only game in town. So what we are going to do... is
getting that apple completed to know exactly what we are getting... Once they

us, we are going to shop it... to the cab company .... to the city .... privately... And
they know that ....They are one of the people that we are looking at to give us
SEATS service .... We can shop that apples to apples to apples so that there is no
difference but there will definitely be a difference in the price.

will not approve purchasing land for what they consider more than the appraised
value ....

review appraisal. There will be some significant work to be done before we decide

Lehman/I asked him several questions, one of them being what if we don't do anything
with the airport and what I gleaned... probably nothing... He strongly
recommended that we do acquire the property ....
