a. Consider a motion setting a public hearing for July 29 on an ordinance amending Title
14, Chapter 6, entitled "Zoning," Article E, entitled "Commercial and Business Zones,"
Section 2, entitled "Neighborhood Commercial Zone (CN-1)," to permit any retail or
personal service use in the CN-1 zone with a size limitation to help ensure neighborhood
compatibility.

b. Consider a motion setting a public hearing for July 29 on an ordinance amending Title
14, Chapter 6, entitled "Zoning," Article N, entitled "Off-Street Parking and Loading," to
increase the parking requirements for residential uses in the CB-5, Central Business
Support Zone.
Franklin/The second is increasing the parking requirements for residential uses in the
CB-5 zone .....
c. Consider a motion setting a public heating for July 29 on an ordinance amending Title
14, "Unified Development Code" of the City Code by amending Chapter 9, Article A,
entitled "Parking Facility Impact Fee" to revise the formula for payment in the CB-5
Zone.
Franklin/The third is in conjunction with item d. which is the revise the formula for
payment of the impact fee in the CB-5 Zone ..... We will have p.h.s on those July
29.
d. Amendment of Title 14, Chapter 6, entitled "Zoning," Article O, entitled "Sign
Regulations," to permit projecting signs as a provisional sign in the CB-5 and CB-10
zones.

Franklin/A carry-over item and it relates to permitting projecting signs .... Your last
discussion, it seemed that thero was an apparent majority of the council, I think .....
to allow projecting signs (mic problems).
Norton/There may have been but I have been one of the leading proponents of the
projecting signs ..... I am beginning to waffle to wait for a more opportune time ....
Just doesn't seem to me there is enough sentiment ....
Lehman/Were you an officer or PFC.?
Norton/I was a master sergeant.
Lehman/Why don't you act like one.
Norton/ ....There is a time to struggle and a time not to struggle.
Franklin/Are there four people who want to proceed with allowing projecting signs?
Lehman/Yes.

Franklin/You have an ordinance that addresses projecting signs and provides for some
criteria for improving them and the issue at hand was the size. You received in
your packets a memo from John Yates about the size and why six square feet .....
Baker/Does anybody have any feelings about the opposition to illumination of those
signs?
Thornberry/I kind of have an opposition to illumination
Lehman/Reverse illumination can be very attractive .....

Norton/It might be simpler.
Lehman/I wouldn't quibble about it.
Baker/I don't see any reason why we shouldn't.

Franklin/The Design Review Committee suggested two provisions. One is that they be
no wider than four inches and the other was that they be non-illuminated.
Thomberry/I like the non-illumination ....eliminates plastic signs... I can see nice little
wooden signs .....
Franklin/This does have a provision that it would go before Design Review
Committee .....
Baker/Why should you preclude illumination? .....

illuminated. Could we start without them and see wha~t happens?

Lehman/You limit the amount of candle power ....eliminate neon.

Nov/Okay folks, neon is allowed if its flat against a fascia sign. Illumination is allowed
in a fascia signs. People have choices .....
Kubby/
Nov/Current code allows illumination and it allows neon. We are not saying that it is not
allowed. We are just saying that projecting signs are different.
Franklin/So you are saying non-illumination projecting signs?
Nov/Yes, exactly.
Norton/
Franklin/I am not hearing a majority for illumination.
Baker/Three for illumination.
Franklin/You need four.

Franklin/The ordinance is written as such that there is not a provision about non-
illumination. It does not mention it. You could have an illuminated sign as long as
it met the other requirements in the Sign Ordinance. So if you want to include a
provision that says that projecting signs shall be non-illuminated or shall not be
illuminated, you need to put an amendment on the floor tomorrow night because it
is a p.h. Preferably you would do it during your p.h that you wish to amend the
ordinance that is before you that would limit it to non-illuminated projecting
signs.

Nov/That means six square feet on each face of this projecting sign?
Franklin/That is right, two feet by three feet.

Kubby/I know that that sign would need to be adhered to the building .... Can within that
structure the sign moved?
Franklin/No .....

Baker/You are talking about a stationary sign with motion within the sign? ....
Franklin/I don't remember what the term is.
Kubby/A kinetic sculpture is what I am thinking of, for example .....

Franklin/Under the current ordinance you cannot have movable signs.
Norton/Animated is the word.
Thomberry/Theoretically then, it could be hung out there on hooks?
Norton/And it would swing gently in the breeze.
Franklin/As it is written, it must be fixed to the building wall or to a pole which is
mounted on the building but may not be swinging or easily moved by wind.
Norton/That is clear .... Have we invited the right people tomorrow night to testify about
this? Design Review and others ....

Franklin/Okay, there is one other part to this. You need to make your decision about
illumination. That requires an amendment on the floor tomorrow night.
Lehman/If we don't make an amendment, it could be illuminated?
Franklin/That is correct. No amendment and you can have lights .... Other point... right
now it is not thicker than eight inches and the Design Review Committee has
suggested it be not thicker than four inches. Again, if you wish to make that
change, you need to put an amendment on the floor tomorrow night.
Vanderhoef/Four inches is fine.
Lehman/Four inches lets room for a fluorescent bulb inside.

Vanderhoef/ ....Are we including only the part of the alley that goes up to where the
HyVee-
Franklin/The vacation is a vacation of the entire alley. Remember when we vacate
something, that is just vacating it as public r.o.w. We still retain ownership. Now
when we dispose of it, what we are looking at now is whether HyVee is interested
in purchasing that r.o.w. abutting their property ....
Vanderhoef/We have negotiated only that area where the dairy has property on both
sides?
Franklin/That is correct. They have given us the money for that. And they understand
that we are talking with HyVee.
Norton/Where was the agreement? Somebody had written to us about a concern that we
weren't getting a fair trade? .... Who had brought up the difficulty? Never mind, I
will find out later. Somebody had a protest .....

Baker/I wanted a clarification about item c. I missed the first time around .... Where it
said that .... no fewer than or no more than 25% be provided on site. Is that
different than just saying that 25% is required?
Franklin/Yes because you are also saying that- As it stands now, you can put more
spaces on site if you wish to but you still have to pay. What this says is that you
can have no more than 25% of the required spaces on site and that was the
discussion about how much you wanted of the property devoted to parking.
Baker/I understand the first part of that is no fewer than and no more than 25%.
Thomberry/It has got to be 25% period paragraph.

Kubby/Karin also mentioned to me ..... I inquired briefly to Karin about the Scott Six
Plan and all of those votes and she said we may need a delay. It is not part of the

Franklin/That is correct. Just as you did the last time. #5, 6, & 7. You continue the p.h.
on item 7 and defer 5, 6 and consideration on item 7.

Vanderhoef/The thing that struck me was inconsistency of language .... I am thinking we
need to go "shall" and "shall" on that ....

Franklin/It is the "shall" and "must" and "whereas"? Okay.

Passenger Rail Coalition 97-103 Side 1
Nov/We are on the Passenger Rail Coalition.
Jeff Davidson/I think most of you are familiar with this item. We did discuss it with
JCCOG last week .... The Quad Cities Metropolitan Planning organization ..... they
are the ones really pushing this coalition... sounds like a good idea... What is
going to happen with Amtrak service... should take it seriously ....just endorse the
study ....
Kubby/Where would the station be in Iowa City if this happens?
Davidson/That is an issue throughout the corridor .... That is something ....don't get hung
up with that... part of the subsequent study ....We would have to discuss what we
would want to do here if it came to that.

Nov/Can you tell us a little bit more about the IDOT meeting?
Davidson/We discussed this at JCCOG last week. The Board did determine that they
didn't want to send an entourage from this community .... I believe Henry Herwig
from Coralville, Steve Lacina from Johnson County, Brian M from the
University and Naomi wanted to have someone from Iowa City and myself will
probably go on August 12. I did call IDOT. We will be scheduled in the
morning .... The attention is just to thank them for the things that they have done
for our community .... similarly to let them know what the concerns are of this
community .... railroad crossings and extension of arterial streets .... To make some
contact, make some visibility with the Commission... political body ....
Nov/I would like to go and I would like to know what time... on the agenda ....
Davidson/In the morning .... I reserved a car ....
Kubby/We need a woman in that group .....

East-West Arterial Street Naming 9%103 Side 1
Nov/Next item.
Jeff Davidson/Sometime ago, council did request that we provide a recommendation to
you on the name for the East-West arterial street ..... portion of which is scheduled
to be built next year. We check the policy which has rarely been used .... it is
suggested that historical names are appropriate for the northeast quadrant .....We
felt with the subject of historical names... appropriate.. input from Historic
Preservation Commission .... you have attached memo ..... does indicate that
Captain Irish Parkway was the name selected to be recommended to you ....
Kubby/Isn't there a liquor or brandy called Captain Irish? ....Captain Morgan, thank you.
Davidson/The rational .... Irish Parkway would lead people to conclude it was named
after the ethnic group rather than the individual. There was an article in the
paper .... he was a major property owner in Iowa City. He did own a tavem ....
served with former Governor Lucas .... instrumental with bringing a railroad to
Iowa City. He is certainly a very significant historical figure ....
Norton/Somebody from the Press called me and I had these names .... I think it is very
appropriate ....
Thomberry/I was kind of thinking Irish Parkway .....
Norton/Didn't want to give ethnic implication ....

Baker/You said the city usually has not control over street name.
Davidson/Typically it is left up to a developer, Larry ....arterial streets have historic
names.
Baker/I always thought that council ought to reserve the right to name streets.

receives an official name ....

Nov/Sandusky Storm Sewer.
Rick Fosse/What I want to do tonight is just give you a brief background of where we
have been. Let you know where we are going. Got one small decision to make
tonight .... Background is .... (refers to drawing/map) .... dark blue line is the
drainageway. Quite a bit of drainage comes into the neighborhood .... originally
designed to bypass this basin ....
Norton/There are catch basins for it to enter at different places along there?
Fosse/
That is right. In the neighborhood up here as well as surrounding neighborhood.
This project was initiated on two issues. One is that people are unhappy with the
way their backyards flood during rain storms .... Other thing that we wanted to
address was some people are reporting that they are having property damage to
their homes .... We had our initial neighborhood meeting... seems to be a lot of
neighborhood support for the project. Since then that has dwindled quite a bit. So
what we are going to do is backup and take a look at what exactly the problems
are out there. Specifically what kind of property damages can we attribute to
stormwater versus the sanitary sewer problems that we have been having out
there ....Sewer won't become effective until the Napoleon Park lift station goes
on-line .....We might be able to look at an alternative that has a lower impact on
the neighborhood... addresses property damage issues ....
Nov/Where is the location of the man who came to city council meeting and was very
concerned about flooding?
Fosse/That is here (refers to map).

Norton/One of the letters we got was from Novotny's, right there.
Nov/I was concerned about the one who came to the council meeting... serious problem.
I wanted to know what we can do or if we can do something.
Fosse/That is the one thing I wanted to get some direction on tonight is this project today
is addressed only surface water issues. And the problem. that I heard Mr. Moyer
describing the other night was ground water issues in his basement. He didn't
come in the next week ..... Question is do expand the scope of this project again to

look at ground water issues and if so, what boundaries shall we set? I don't know
what the limits might be. In other parts of town where we have had ground water
problems, usually the most we can do for them is to put a sump pump discharge
box along the back of the curb ....
Nov/Does his sump pump go into the storm sewer at all?
Fosse/I don't know ....
Norton/We have a report... open house... some people claim there are a great many cross
connects .... sump pumps are tied directly into the sanitary sewer ....
Lehman/How much do sump pumps actually put into the sewer?
Fosse/Enough to overwhelm it.
Kubby/Especially in a wet year ....get your basement dryer but you might cause backups
in other neighborhoods.
Lehman/...are we currently putting in connections for sump pumps in new subdivisions?
Fosse/Only in those areas that have hydric soils?
Lehman/...area south of Hwy 6, will we require that.
Fosse/Yes, this area does have hydric soils ....
Norton/Most of these do have sump pumps ....
Fosse/A lot of them were retro-fit jobs ....
Nov/Sometimes they don't have to come and tell you about it.
Fosse/One of our former mayors came clean on that.
Norton/I don't understand why. Novotny is downstream from the stormwater at 1-15
Sandusky .... You would think he would be one of the most heavily impacted by
access water in the backyard ....He is the one that is claiming the cure is worse
than the problem.

Fosse/Early on he was in favor of the project ....at that time he was hoping for a
solution ....impact on features in his yard ....His next door neighbor is reporting
damage to his home .... Conflict right here.
Thomberry/
Norton/It is very tricky... You are going to re-design the whole thing... plenty of time to
discuss this ....
Fosse/Certainly the #1 goal is to eliminate the property damage to homes and the next
design criteria is to reduce that nuisance flooding that is occurring back there ....
you can't eliminate it .....
Lehman/Is this a situation that the city has had anything to do with creating it?
Fosse/This is one of the very first basins that went in in the Stormwater Management
Ordinance. With the exception of this guy getting property damage from it, it is
really functioning as it was designed .....backyards... They just don't work well
together ....
Kubby/It reminds me of our discussion about Friendship and Shamrock ..... people would
have understood .... We decided we were willing to spend some money on
Friendship and Shamrock to decrease some real severe property damage and to do
a minimal approach. I would suggest that we be consistent and do that here, as
well.
Fosse/
One angle, pinpoint .... that is recording damage from flooding and look at what
alterations can be made to that structure, flood-proof it and then just leave the rest
as it is.
Kubby/I like that minimal approach at this point.
Lehman/I agree because I don't know where you stop ..... I think we did the right thing in
Shamrock .... same approach. As long as we didn't create the problem .... I don't
know what obligation we really have ....
Norton/Can we be assured that our requirements in developments currently are better
than what permitted this situation? ....
Fosse/There are two things that are different. One is the developers know that if they
don't encumber a yard with an easement for stormwater management, they have a
more marketable product ..... trying to turn it into an amenity. The other thing...

where they do go into the yards .... potential for flooding, we have their engineers
put onto the lot the minimum low opening that that hole can have and not be
flooded ....
Thomberry/How can you do that when you got to consider a 50 year flood?
Fosse/Usually what govems it is the elevation of the downstream road .... One of the
other issues out here is easements. The policy that we have been using for
easement acquisition on projects like these has not been working well in recent
years .... I think it is time to really re-think that policy... put together some ideas
and come back to you ....
Kubby/...do we want to expand the project into dealing with ground water issues?
Lehman/No, I don't think so.
Norton/
Fosse/What we already have in place is we have $25,000 a year in our budget to put in
sump pump discharge box that I was talking about.
Lehman/I have no problem with that.
Fosse/And what we can do is see if there are other problems in this location ....
Norton/It is surprisingly steep slopes .....
Nov/All right. The main thing we have decided is no Sandusky storm sewer construction
this year.
Fosse/That is correct.
Nov/And you will come back?
Fosse/Yes, we will.
Norton/Are you doing anything to look for cross connects? Can we do anything?
Fosse/About the only thing we can do .... to look through the sewer lines through our
cameras and watch for those homes that have steady flow ....

Dale Helling/Basically you got the information that we sent you... details of what we
propose to do ....recommendation... Jim is here and Darrell Smith, the design
consultant ....
Kubby/The numbers were interesting to me because on the second page of Darrell's
letter the two ply membrane, the actual contractor amount is $212- And for the
single ply... some information about $95,000 plus ....Both of these figures are
different than the figures from-
Norton/I didn't understand the figures quite either.
Darrell Smith/I can talk about the two ply modified system because I did see the
proposal that the contractor gave on that one .... His system is a little bit different
than mine .... We are just going to replace the wet. And also his type of system is a
little bit different. He was going to have a hot kettle and tar on the site and mop
down a couple of sheets .... then put a top ply of the modified system where the
system that I am anticipating .... two ply of the modified material and it will be
torch applied. A lot cleaner system .....I don't know exactly what the single ply
bid all entails ....
Norton/... On B. and D., those two roofs. Is that $16,000 in addition to the $165-?
Smith/That would be in addition to the fully adhered single ply TPO membrane ....

bituminous roof you can repair minimally as you go along and then recover it ....
You can extend the life of that bituminous by completely recovering the roof2 - 3

punctured ....moisture resistant... so just a little bit of moisture won't affect it ....
polystyrene.

entrance remodeling .... What we are doing.. front entrance is getting in fairly bad
shape as far as concrete and benches... ramps and railings don't meet ADA
requirements .... redo and renovate that whole front area .... D1 is the Demolition
sheet .... (refers to demolition sheet). The dotted line represents the amount of area
that we are going to be demolishing and replacing. The second sheet, A1,
Construction Site Plan indicates what we are going to be doing ....widening

are at this point in time... things are moving along with the County... meeting with
them again soon ..... Tomorrow night on the agenda we have a one month
extension of our present contract and that will go through the entire month of July
and hopefully we will completed by then.

Kubby/Can you give us some more detail? .... One of the things that we had discussed in
the informal meetings was the issue of an integrated fleet in terms of not stopping
at city lines and having only five dedicated vehicles. Where we are are with those
kinds of issues and numbers.
Vanderhoef/We are still working out on some of the management ends of things. As far
as integrated service, we are still talking about it.

decided we don't need the city's permission. That the 1996 Cable Act and
language in our franchise agreement, we can do this .... Our intention at this point

.... consultants... attorneys... let them know what the situation is and get a
preliminary opinion .... Get in a better position to establish our own posture on
this. Right now the franchise agreement states that they will complete the re-build

situation... good deal of tension.

9. Baker/Two very quick things. I noticed as part of a crime bill, I think, passed
nationally... federal government... trying to get police officers into
neighborhoods .... to live. There ought to be a program... that we have some
program... for policemen to live in targeted neighborhoods... that increases the
permanent visibility of police.
Atkins/We have tried informally and met with some... positive vibes .... We put out some
feelers .... did get a response from a large apartment complex. I didn't take it much
further than that ....
Baker/Maybe we should be initiating some contact ....

11. Kubby/I had two issues. One is 1993 we asked out City Attorney's office to look into
the issue of mobile home tenant rights .... found out there was a difference between
the legal relationship between landlords and tenants if you live in a mobile home
or not .... Ann Burnside had written an opinion saying we are not preempted by
state law. To have some local laws to make all tenants have the same kind of
relationship between the landlord and the tenant and we never did anything with
it.

12. Kubby/(Agenda #11, 15, 16 - Animal Control) My second issue is about some
comparisons on the two animal control ordinances about money and cost for
permits and costs for fines that we are going to be voting on tomorrow night. And
in terms of the permit section... reclaim fee for impounded animal. That the first
reclaim in a 12 month period is free but the first offense for dog at large will be
$10 and it just seems a little inconsistent. It may be if we have to, if there is a first
offense, charge something but maybe the policy direction is that the first time
someone was caught with pet at large that they be given a warning.

that they get picked up... that it is free ..... I prefer the free and warning way.

zero for a first offense.

for the University and the building of the Biology Building and the loss of parking
that Joe tells me is something between 20 to 25 parking spaces and there have
been agreements previously that contractors pay $10 a day per parking meter
when they are not in use. We are talking about a very long time period here of
decreasing the parking on Iowa Avenue and I would like to see if we could

negotiate with the University to get 25 spaces in the parking lot at the comer of
