Review Planning and Zoning Matters 97-131 S1 a. Public hearing on an ordinance amending the Zoning Chapter by changing the zoning designation from RS-5, Low Density Single-Family Residential to OPDH-5, Plam~ed Development Housing Overlay Zone, for 3.63 acres located east of Somerset Lane and south of Wellington Drive. (REZ97-0012) Davidson/Pretty much a continuation of what they got started out there. Nov/Do you have anyway to show us the road that goes out to the main street? Where does this place get access? Davidson/(Refers to map). Eventually this road here goes out to Scott Blvd. The developer has preferred to do this little bit by little bit .... There is a concept plan which we have indicated that we are expecting Wellington to connect to Scott Blvd. eventually. Nov/Where does Somerset connect to something else? Davidson/(Refers to map) .... Wellington is the one that will eventually get to Scott Blvd. Norton/Now, there is no other access south of that? .... that comes out fairly close to the other road, the upper part of Village Green, doesn't it? Davidson/Yes, it does, Dee. Norton/Then there is quite a long stretch with no other exit along Scott on that side? Davidson/Yeah, we do feel like Wellington... that that is fairly good spacing .... Norton/ .... I was just thinking, would there be one in the south. Further west (refers to map). If you include Heinz Road, there would be three all together on this side between the two arterials. Norton/ Davidson/ .... They have stormwater retention area here that they want to use as an amenity... involves clustering the units on a common lot rather than the typical s.f. residential. The density of development of development is the same as RS-5 .... consistent with what they have been doing out there. Vanderhoef/So what is the fence around the pond? Davidson/...a concern at P/Z ....open space... more of a visual type open space. Norton/ Vanderhoef/So what kind of fence are we talking? Davidson/Benj amin (Chait), do you remember exactly what kind of fence they were putting up out here? Chait/(Can't hear). Davidson/I can't either. It is up in the existing parts already and it is designed to keep children from .... Kubby/...wet bottom pond... a safety concern .... Davidson/It wasn't a chain link fence. Thomberry/ Davidson/It is more like a white picket type fence ....something more esthetically pleasing... vinyl... It looks decent. Norton/ Davidson/It is how they are fulfilling their requirement down in this area ....It is considered an open space amenity for the development. Davidson/Yeah .... Kubby/...discussion about appropriate kinds .... Vanderhoeff Do they have a homeowner's association that takes care of this? .... Davidson/Right, all the common areas are controlled by the homeowners' association. Vanderhoef/ Thomberry/The city is not responsible for mowing? Davidson/No .... it is consistent with the previous additions of this which you approved previously. Norton/ Davidson/They were also sidewalks adjacent... finally resolved that since they are private streets and private sidewalks, it is basically up to the folks to work it out with the homeowner's association if they are not cleaned .... There are sidewalks... right up against the curb. b. Consider an ordinance amending the Zoning Chapter by conditionally changing the zoning designation from RM-20, Medium Density Multi-Family Residential, and RS-5, Low Density Single-Family Residential, to OSA-20 and OSA-5, Sensitive Areas Overlay Zone, for approximately 1.9 acres located at 1122-1136 N. Dubuque Street. (REZ97- 0003) (First consideration) Davidson/Rezoning and Sensitive Areas Site Plan for the Cliff Apartments. You have a letter from the developer requesting expedited action for this. You also had a second letter from a concerned citizen on Summit Street .... needs to be addressed by the developer's representative ....You may want to ask her some of those questions. Kubby/(Can't hear) If the developer will be monitoring this? .... Dilkes/I don't think the agreement provides for continuing monitoring. Norton/But that could be incorporated, couldn't it? ....20 year guarantee or something. Nov/I spoke to her. I told her there isn't that kind of guarantee .... There is a requirement of a licensed engineer to design it ....She was obviously upset. We had very much the same questions that she did ....Going to have to hope... monitor on site while it is constructed .... Thomberry/Wasn't the...plan... approved by our engineers? Davidson/That is right. Thornberry/If the city approved this plan and it doesn't work, it will go back to the city? Lehman/I hope not. Davidson/As I recall. Rick's approval was in terms of reviewing it and stating it was a reasonable way to proceed .... there are things you can't anticipate until you actually begin constructing the thing .... decisions in the field... Color of the stone... very white stone is very expensive ....less likely that the developer would choose that because it is more expensive .... Lehman/White stone... concrete stone... life... much longer .... Davidson/ Norton/We have raised a lot of questions. Is there anything we should do to further guarantee this thing? ....to tighten up this so it doesn't bounce back on us right away?... Dilkes/I think the concept of a guarantee, you are not going to accomplish that .... person who is going to do periodic monitoring .... Probably about as much as you can accomplish short of a guarantee. You are not going to get a guarantee ..... Dilkes/Right, we still have enforcement authority if they are not complying .... Lehman/ ....He is responsible for this wall. Dilkes/I don't think just because the city approves or says it is a reasonable plan means that it becomes our responsibility. Kubby/Eleanor, there is a sentence in the P/Z September 4 .... lawyer for the property owner said one safeguard is Terragon would not continue to sign off on the plan (can't hear). Does that mean they start over? Dilkes/I don't know what the context of this- Once plans are certified, I don't think you can de-certify a plan .... Nov/I read that differently. I read it as amending the plan if needed rather than continuing with this... if the soil conditions were different. Norton/I think we should ask tomorrow night. Kubby/ Dilkes/I don't think you de-certify plans. I think you make adjustments if necessary... different plans. Lehman/Eleanor, bottom line, this is the property owner's responsibility, period .... Dilkes/That is certainly the way we look at it. Davidson/We will continue to enforce it accordingly. Kubby/Latest P/Z minutes about changing where the tree line is. That has already changed by the time we saw it. Davidson/Kirsten indicated she will be here tomorrow night. Consider an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article N, entitled "Off-Street Parking and Loading," to increase the parking requirements for residential uses in the CB-5, Central Business Support Zone. (Pass and adopt) Comment: At it June 19 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended that off-street parking requirements be increased for residential uses in the CB-5 zone. Davidson/Items c. & d. are pass and adopt .... d. Consider an ordinance amending Title 14, "Unified Development Code" of the City Code by amending Chapter 9, Article A, entitled "Parking Facility Impact Fee" to revise the formula for payment in the CB-5 Zone. (Pass and adopt) e. Consider a resolution approving a preliminary and final plat of W.B. Development Second Addition, a 5.17 acre, two-lot commercial subdivision located north of Escort Lane and east of Naples Avenue. (SUB97-0020) Davidson/Preliminary and final plat for a re-subdivision of Lots 1 & 2 .... (refers to map). It is that lot line right there that is moving... because of a perspective tenant property owner... requires re-subdivision of the property. Norton/So Lot 1 is divided into two now? Davidson/Right. Thomberry/Does anybody divide their lot one time, Jeff? Davidson/A one lot split does not require a re-subdivision. But this would be a further subdivision of something that has already been subdivided... Vanderhoef/The Scott Second Addition, where is there ingress and egress? Does it have to come- #5, there was something in P/Z minutes about that. Davidson/Right now, that is in the county but the person who owns it (refers to map). The property owners indicated that they will bring it into the city eventually. Vanderhoef/ Davidson/...it might be possible to get an access point down here on Naples .... some unofficial talk of a convenience store .... This came first .... Norton/Wouldn't it be weird if #5 belonged to somebody else other than the owner of 1 &2. Davidson/No, there is access to #5. Vanderhoef/ Davidson/Just the physical ability to get access to #5, that is possible ..... Kubby/ ....So the item that you are looking at, is that combining #5 with other lots? Chait/I think it has to do with annexing #5 .... Davidson/That is all speculation about adding it to those lots ....All the deficiencies have been resolved with this one. f. Consider a resolution approving the extraterritorial preliminary and final plat of a Re- subdivision of Lots 14 and 15 and a Portion of Outlot C, Woodland Ridge, Part 1, containing 2.36 acres and located south of Meadowview Lane and east of Dane Road. (SUB97-0019) Davidson/A resolution on another re-subdivision. This one is out in the county off Dane Road (refers to map) .... We had two lots, 14 & 15 and an outlot over here. What they have decided is to have the outlot over here (refers to map) .... Relates to the desire to have the subdivision set up so that in some point in the future they can have a connection to the subdivision to the south .... Because of our growth area... we didn't want this seen as encouraging residential development further south .... The Fringe Agreement says it should remain agricultural. It is zoned agricultural currently and it will basically take a decision of the city council to move that growth area limit .... Norton/Where is the growth area? Davidson/(Refers to map). Norton/This is the one where there is a road in already? .... Norton/ Davidson/It will essentially be reserved for a future road, Dee. This represents only a reasonably accurate transcription of the Iowa City council meeting of September 22, 1997 WS092297 September 22, 1997 Council Work Session page 9 Landfill Grant Program 97-131 S1 Brad Neuman/This item, staff would like to propose a landfill grant program through the Iowa City Landfill... available to everyone in Johnson County .... $25,000 annually. Money would come from the surcharge tax that the State of Iowa places on landfills in Iowa .... We send a majority of it back to the state... part of that money is used for planning, implementation and education programs .... eligible participants would be business, non-profits, and government throughout Johnson County. We would fund up to 75% of a given project requiring a cost share match to a maximum of $5,000 per project. We are looking at .... this year...deadline at end of November .... awarding those grants at end of January. Programs would be... grants would come into me... visit site... meet at staff level... come to you for final approval of those grants .... bailers... containers .... educational programs .... any reduction at the source type program ....monitoring the program for three years ....required to give annual report ....take that and show other small businesses... This program is similar to Blue Stem... last year they saved 734 tons from going to the landfill .... Norton/$5,000 limit... at Blue Stem? Neuman/I thought their limit was a little higher. Norton/... I was wondering how far would $5,000 go? Neuman/That is what we will earn in the first year. Kubby/It may be the $5,000 leverages other money .... Norton/I am just wondering if $5,000 is a realistic number. Neuman/...hate to give it all to two grant applications .... Kubby/ ....why would you want to use this particular pot of money to fund machinery. Davidson/ ....we can monitor it. Neuman/... Blue Stem handed out some cardboard balers are $3,400 .... They required some cost share also .... Thomberry/We were mandated to cut back the amount in our landfill by 50% from year '88. And how long do we have? Thomberry/And where are we? Neuman/We are around 41% here at the landfill. We are also part of a regional planning area. We report as six counties, not an individual and that is... 36% as a region. Thomberry/Is there something that we, as a council, could do to help the private haulers, help their business customers to recycle cardboard, etc.? Kubby/ Thomberry/I am going to be changing my waste hauler from the Burger King because he will not us to separate out the cardboard and that is 50% of my waste .... And my previous hauler did .... M &M, put it in the dumpster .... They are a big hauler .... I do separate out my cardboard. That is 50% of my waste that goes to the landfill .... Norton/What you are saying is we want staff to bring us some ideas for how to get into commercial. Thornberry/ Kubby/Grant is a separate question... promote the grant .... Nov/It was written for non-commercial. Kubby/It can be for for-profit. Neuman/Yeah, a business, private business. Lehman/Brad, are there not cities that prohibit the dumping of refuse that is more than 50% cardboard? Neuman/Some counties have bans on recyclables such as cardboard. Cardboard and paper are usually those that are banned, they cannot be landfilled. Thornberry/ Kubby/That discussion is a different day. We had one apartment owner that was on our pilot program... came in 30% higher than he was doing for garbage .... Would affect his rent ..... everyone... We would like to put everybody on that same playing field and then define what they would recycle. Kubby/There was something about terms of the grant award and about the site being open to visits from JCCOG .... It might be good to add in the public... good educational tool .... Neuman/We could arrange that with them .... We could talk to them about that... part of the grant award is sharing that information with others. We should add that in. Davidson/Are there four votes for the grant program? Council/(Yes). Norton/I would like to be sure we follow this other matter of how we can push on the commercial and multi-plex. Davidson/Whenever you want to bring the multi-family recycling issue back for discussion, we have got a report prepared and did a pilot project. It is kind of up to you to decide you want to put that on your agenda. We can discuss that whenever you want. Thomberry/I think we do. Vanderhoef/(Can't hear). Kubby/I had a few other things about the application .... It might be interesting to not only know who the broker for the material is but what will be done with the material. Neuman/That is kind of the idea .... We will work that in. Kubby/And if the grant is going towards equipment, in looking at our economic development guidelines .... ask about the energy efficiency of the equipment. Neuman/Okay. Lehman/To me the guideline here is how much can you save what you are putting in the dump .... Kubby/When we look at how our economic development guidelines are written, individual businesses who receive public assistance will have to go through that process. Lehman/I don't consider this economic development. This is protecting our landfill. Kubby/ ....dual purpose .... Lehman/To me the whole purpose is reducing the amount of stuff that is going into the landfill. Neuman/ .... a small business could ask for a baler .... private hauler could ask for a baler and it might be seen as economic development as they are expanding their business. Davidson/We weren't planning on asking about things like wage rates and fringe benefits. Norton/ Kubby/We should review what our guidelines say. Norton/Hate to get it so complicated... balance here somewhere. Thomberry/Even a private entity .... get a baler... that is what we are after .... Davidson/Right now...recommendation on the projects we receive, it will be this information right here... oriented to reduction. Kubby/ ....in future... Solid waste committee in the future... they can make recommendations to us along with staff. Norton/We talked to JCCOG about having some kind of a commission to run the landfill .... Nov/Landfill commission .... varieties of communities with representatives on the commission? Davidson/I would make one correction in terms. What we are considering is an advisory committee, not a commission. The other entities in the county indicated that they were not interested in a commission similar to what Linn County has. The advisory committee is something that is part of the East Central Plan that is one of the elements for Johnson County. Lehman/Is there such a thing as a portable baler? Neuman/(Yes). Lehman/ ....take it from business to business to business. Neuman/Blue Stem funded one for General Mills last year for $2200, a portable baler. Lehman/ .... my business .... Davidson/Recycling in downtown businesses is something we have also taken a look at... You might want to schedule future work session... would require some city oversight because of the space constraints .... might even extend to franchising out the pick up downtown .... This represents only a reasonably accurate transcription of the Iowa City council meeting of September 22, 1997 WS092297 September 22, 1997 Council Work Session page 15 Washington Street Two-Way 97-131 Sl Davidson/Two weeks ago .... we talked about making Washington Street two way and at that time there was not a majority of council in favor of doing that because of the need to essentially remove a curb-side loading zone .... (refers to street map). What you asked us to follow up on was that if we wanted to establish a more formal loading area, what would have to come out .... There is a space of 10' 8" (refers to map) all of the streetscape elements are located .... expanding this existing loading zone up here ....Outline for you what we have got going in this area ....If we were to set this up and make it symmetrical with the angle parking area ....you would cut it off fight there (refers to map) .... All of this would need to come out .... This is the way for you to formalize the commercial loading zone .... make the street two way. Also .... this is a very heavily used area. Mostly University vehicles .... LIPS... mail trucks .... some private vehicles .... (refers to map) .... This just sort of indicates to you what would have to come out if you want to proceed with this. Four votes to do so? Nov/I say leave it one way. Norton/How did it happen that the Downtown Committee did not look at this issue specifically? Davidson/The Downtown Strategy Committee did look at it specifically... discussed it... They did not advocate changing it to two-way operation. Thornberry/Okay. Davidson/Thank you .... Why did we propose the shutfie? It has been discussed over the last year...by the council, city staff, DTA, Iowa Avenue Streetscape Committee, and a group of University of Iowa graduate students. So it has been an idea that has been out there .... We had to start with something... What will it do? We see this as a way to continue to emphasize Iowa City's committee to alternative transportation. To put issues out there besides driving your car downtown .... expand the CBD core by tying into near north and near southside commercial areas... moving people throughout the community... increase available parking in the downtown. Where will it go? There is two legs to it... south leg would leave Clinton and Washington and go down past Chauncey Swan to Lucas .... south over to Burlington... to Bowery ....Gilbert ....Court Street ....Clinton and Washington .... served ....close in residential areas... post office ....North leg would go up to Jefferson Street... Johnson... Bloomington.. Gilbert... Church... Dubuque Street... Market... Clinton and Washington .... serve Mercy... near northside housing .... ties north and southside .... serves high density area .... Big question is how would we pay for it. Currently there is money budgeted in our operations budget for the Hawkeye Route .... there is an excess in our operating funds .... lower level of service .... We are recommending no fare for this route because we think that would be essential for people to us it... no revenue stream that would offset our operating costs ....We can add this service and not have to increase the revenues into the division ....ridership on this route will help us maintain our state and federal funding .... If you do decide that you would like to do it... some performance factors .... We set a goal of 60,000 riders... 5% increase to our system .... Over the first year we should evaluate the service to determine if there is enough riders... Is it s seasonal ridership ....We are open to questions. Thomberry/If we were to do this... neat to have something like a San Francisco trolley running ....something look different than a city bus ....easy on and easy off type thing ....Pella has the little vehicles ....We use to have buses that ran on the things up above... A special vehicle that would look... easy on and easy off.... Kubby/ ....different maintenance parts .... Nov/I think it is going to be a winter time only kind of thing. Fowler/The original proposal doesn't call for buying any new equipment .... existing equipment... different paint scheme... different logo... Money budgeted .... for three smaller heavy duty type vehicles... if this did work. Our initial proposal was to keep the cost as low as possible to give it a trial period .... Lehman/I agree with what you are saying .... I have one question about the route... Why did you pick Dubuque Street? Fowler/Cambus is using Clinton Street right now. Nov/Oh, no they are not. Fowler/We would be a block off... apartment buildings .... viable option on other side of the street .... put us back within a block of the northside commercial district again. Lehman/ ....coming down Linn Street rather than Dubuque. Fowler/Linn Street... benefit to northside merchants. Kubby/(Can't hear). Fowler/One of the things that we looked at was the odd even parking in that area... Gilbert Street was pretty much open .... Nov/ ....people will get a free bus into down. Vanderhoef/What was going to happen to street parking particularly in the south section...? Davidson/There is already very extensive on-street parking in these neighborhoods already .... something that we will have to monitor .... Norton/ Fowler/ .... people come into the north neighborhood and then walk over and take a Cambus. Thomberry/Do you think this would work, Joe? Fowler/ ....yes. Lehman/ .... You could move the routes one block one way or the other .... You are just asking us whether or not we are willing to try it .... Kubby/...changing routes... educational .... Lehman/Not like a route clear across town. Council/(All talking). Norton/ .... we know the concentration of housing on South Johnson and South Van Buren. Fowler/S. Johnson would be our preference... illegal parking ....That is why we picked Dodge Street. Kubby/Have a battering ram on the front of the bus. Norton/ ....question of enforcement ....got to get tougher about loading zones .... Fowler/The way the odd even enforcement is enforced is if someone goes out and receives a ticket at 8:05, there is no incentive to them to move their car ....Usually they may get another ticket in the afternoon. Norton/ Vanderhoef/Joe, do you anticipate mueh change in revenue off our fixed routes? .... Fowler/It would be some decline .... really help the rest of the fixed route system .... increase on time performance of the rest of the route .... We had talked at one point about having a no fare zone that you don't pay when you get a certain distance (can't hear) ....Why is this better? .... Fowler/Current routes and current configurations you would anticipate that people would walk several blocks to get to a no fare zone .... Our thought was that if there was an alternative... fixed rote buses make less stops ....they would be able to stay on time better .... Nov/Is this a single bus? Fowler/Yes. Nov/Is your $93,000 projected for Hawkeye... is that a net? Fowler/Anticipated that Hawkeye would cost a little over $108,000 to operate and it would have generated $91,000 in revenue. So there was going to be a $17,000 positive flow there .... Kubby/Add some of that 7th Avenue Hawkeye route money to SEATS... people with disabilities will now be riding SEATS instead of fixed route. Thornberry/ Kubby/ Norton/ Fowler/We would designate new stops and use existing equipment. Nov/Different kind of sign... different color... Thomberry/Make it snappy. Nov/A mural. Thornberry/...internally lit. Fowler/We will include this in the route study then. Fowler/I would think .... by end of this FY, July, August Atkins/Joe, you want to move fairly quickly on this? Fowler/Yes. Nov/ ....Chauncey Swan... has to go entire circle. Fowler/ .... run it in opposite directions depending on time of day .... in morning you would come by Chauncey Swan last before you went downtown. In the afternoon you would stop by Chauncey Swan first. Kubby/(Can't hear). Fowler/We have done some initial discussions with Cambus. They were not interested in us providing service on Clinton Street .... Thomberry/You have obviously driven this route .... Fowler/ ....we know it is drivable. We attached a form to the contract that listed the information that we would like to get. We had discussed it with the county previously. We have actually met the staff from Johnson County and staff from Iowa City Transit and we discussed different reports that we felt were valuable to us in evaluating the service with Brunell and Brunell went through. We spent a couple of hours together. He went through the request that we had and some of the requests that we had were altered. We ended up with a product that he felt was producible from existing information that they were gathering. We have put a lot of effort into it this year to get to a reporting system. The county has used tour minutes to predicate the amount of the contract. They have then subsequently acknowledged .... that they were not aware that there has been a reduction in the amount of service/That last year there was a reduction in the amount of service because of the things that you implemented about the certification for people to use SEATS. There was a reduction in the number of vans they put on the street. Joe was able to document with their year end print outs, driver wages basically, that led to this $103,000 amount of revenue that was not expended on the system. The county has acknowledged that they put out less service because of what the city has implemented and so consequently there should be a further reduction then and that is that $560,000 for this current year, 4% the following year, 4% the following year. The city and the county are both in agreement right now that those are decent numbers and tour minutes is where that number originated .... Kubby/I felt like we have been talking about this part of it and the county acknowledged it long ago .... I am not opposed to... sixty day .... Let's get productive about our conversation with it... They are concerned about a number of things about enforcement .... Filed House front .... wasn't done the way they had expected .... wondered what the follow up is when somebody doesn't comply with their approved plan .... They had an approved plan for the front of the Field House but they didn't follow the plan. Thomberry/Sounds like the DR Committee are having some problems among themselves. Norton/ .... Let me discuss DR for a minute. They are concerned about the enforcement of the Portable Sign Ordinance. They said there were a number of violations this weekend .... Kubby/In a transition period .... Norton/I think they are having some trouble moving on DR districts .... tums out to be more work than they anticipated ....generally concerned about the spirit of the committee .... It reminds me of the status of a number of them. The Riverfront and Natural Areas is also concerned that they are being ignored or left out of the loop .... I think we need to think very carefully how we are going to deal with the Riverfront- Atkins/The way we staff them? Norton/They just seem they are left out of the loop. Norton/They were talking about that in relation to trails and they were not happy that they weren't being consulted on trails .... Karr/And if they aren't in the by-laws, they certainly can recommend a change in the by- laws to correct the problem. 8. Norton/Where do we stand on recognition? They are getting certificates. Have we a formal process for recognizing people leaving commissions now? Nov/Yes, they all certificates. Norton/I thought there was going to be an occasion where they came to the council. Karr/We are just trying to figure out a time to start that procedure. We have everything in place. it is simply a matter of when we start. Norton/Give them due regard. I still don't know where we stand on Rohret and Melrose plantings? Things still don't look too create out there. Atkins/Those are legal issues. Lehman/Melrose has done some re-plantings. Norton/I was thinking about Rohret Road and Melrose. Are we progressing with something about the plantings out there? Dilkes/Yes. Streb Construction... we haven't gotten a response from the bonding company in response to our demand letter. Atkins/Terry asked me whether we should go ahead and take some out and replant them.
