Comprehensive Plan 97-162 S1 Nov/The memo that was in the packet which says 1997 Comprehensive Plan .... all the stuff we added in the other day. Franklin/It is the amendments of November 3 as well as your November 19 meeting. Norton/ Kubby/Page 3, references page 35, Goal 2, Strategy 2. I thought that we had decided not to make reference to any kind of specific board or program because those kinds of things change. Dee Vanderhoef wanted that in very badly but I did not think there was a majority who wanted to reference a specific resource. Nov/I think that is why it was in as a "such as" rather than a specific ..... Franklin/We had a lot of discussion later on and this came up a number of other times .... people said let's not get too specific about this. I don't think having this in here, Karin, if the Workforce Development Board disappears, it gives it less meaning but- Kubby/It is no big deal. Further down .... page 33, Goal 7... Page 37, Goal 7... protecting scenic and historic vistas... Protecting versus maintaining the integrity of isn't really much of a water downed. It is fine by me but I don't think that is what the majority would ask .... Norton/Let's keep it unless somebody brings it up .... Nov/I don't have any concern about that one but I do have a concern about the next line where it says re-evaluateperformance standards for glare. I think it would read better if we put in Reevaluate lighting performance standards for glare. Franklin/Okay. If we put in lighting in front of performance, I think it reads better. Kubby/Page 39 .... Goal 4, Update codes .... It is also new construction techniques .... Franklin/Okay, so and new construction techniques. Kubby/ Franklin/ Kubby/I only had one other one ..... Page 2 .... Page 33,... Goal 4, Strategy 2, Ensure that at a minimum .... The way the sentence is written, the minimum refers to the activity listed, not to the minimum requirements ....So put at a minimum at the end of the sentence. Franklin/Okay .... If you put it at the end, I think it is clear .... Nov/I have another comment on this memo somewhere... page 5 .... South Planning District (page 7) you have Provide accessible apartment .... I think we should say encourage accessible apartments because the city does not provide apartments. Norton/Encourage inclusion. Nov/Encourage inclusion is fine also. Norton/ Franklin/Okay. Nov/ Bovbjerg/I had a question about page 31, Goal 1 because I don't surf or browse or do anything else. Worldwide web and Internet, are they restrictive? What if something else comes up? .... Norton/ Franklin/In this particular goal, it is a listing of different ways to communicate this to people in the community and cable t.v....press releases .... This is just another way. This strategies don't mean that we then can't, by force of law, look at anything else. It is to give an indication of direction and some suggestions. Nov/I have one more comment which is not in your memo but which I thought was suppose to be. Transportation page which would be 49 and under the second goal, one of the strategies says provide wide curb lanes for bicycles. I thought we added where appropriate after that. Norton/We did. Franklin/Yes, I have that in my text ..... Kubby/ Nov/ Norton/ Franklin/I guess I saw that as editorial ....It is in there, I have got it. Norton/One of the things that has bothered me .... question about secondary access .... We only have... one rather mild reference to secondary access in the Comp Plan, page 19. I just didn't know whether we needed more emphasis or not ..... In one of Scott's memorandum ..... comments .... he said it is mentioned several times in the Comp Plan but I couldn't identify where else beside page 19 .... imposing it but it is not very explicit .... WS120897 December 8, 1997 Council Work Session Page 4 Franklin/The question in my mind is whether you include anything as specific as those guidelines for secondary access in a comprehensive plan. We advocated at the time that we first introduced... that the council adopt them, the Commission and the council adopt them as either by resolution or by ordinance. But the decision at that time was not to do so, to leave them as a staff used guidelines. Maybe we do need to talk about having them be- Norton/Important consideration ..... Kubby/I don't see it mentioned ..... Norton/Page 19, am I wrong .... I don't know what the group thinks. I thought maybe P/Z might have some thoughts about it. Bovbjerg/We raised that question, was it one meeting ago? We asked our staff how obscure these guidelines are and whether they are readily available and whether they are understood and their opinion was that they are available, they are written, they are understood. People know to look for them and they know what is there. Norton/But is it too specific to call it out in the Comp Plan? Kubby/In terms of what all the guidelines are? Norton/No .... Kubby/We would have to basically put our subdivision ordinance in the Comp Plan. Norton/Then you could get that way, yes. Kubby/I mean, it is something like that ..... Norton/ .... In a similar sort of- In the Housing section... page 39, we say nothing about our interest in encouraging home ownership. yet I have sensed considerable feeling among the council members that that is a desirable goal. Franklin/Is that a desire over and above providing a diversity of housing? Norton/...I suppose that is one of them. Davidson/The very first strategy does address that. How about cemetery? Nothing is said in the Comp. Plan about cemeteries .... Lord knows I am not big on cemeteries .... Problem... hard to find what is our form of commitment to that .....I don't know where that should be or whether that should be considered. Nov/I don't know. I don't have strong feelings about mentioning cemetery in the Comp Plan. Norton/ Nov/I think it is there. I don't think you need to plan in the Comp Plan for the present cemetery. Franklin/I am at a loss as to where you would put it exactly. It is a service that you decided to provide. Norton/I don't know where to put it. The one other thing that bothered me .... P/Z minutes .... Joe's remarks... developing piece mill .... take things in a little bit broader scope .... more aggressive stance in certain development issues .... About as strong as you are going to get I suppose .... Franklin/I don't know what his point was at that time in the conversation. He is representing a developer there ..... looking at this... more broadly .... Our approach is the matter of policy... look at it as comprehensively as you possibly can... contextually, how it fits .... Norton/I will leave it that way ..... Franklin/We had the discussion of using the CIP to take a more active role in directing development and doing the district plans ....opportunity to look at it comprehensively for a portion of the city .... Vanderhoef/I think he was talking piece meal .... Norton/ .... trying to look at a bigger area and it is hard to do with multiple ownership. Seems to me the city ought to try to look at it in a fairly large scale .... stormwater .... Maybe that is enough what we got in there .... Vanderhoef/...necessary... new sewer line... developable .... Kubby/ ....encourage certain things and that we discourage certain things .... Norton/South Sycamore Water Plan is just really impressive .... everybody's benefit... same may true,... in other areas ..... Kubby/I have a question about our Annexation Policy, page 12... three conditions. Must they all be present? Franklin/No, or at #2. It is in a series: 1, 2 or 3. Otherwise that would say and. Kubby/Okay. What happens if someone comes in with a development, with an annexation proposal that is outside of our growth boundary? What is our response to that voluntary annexation? They are willing to pay for everything .... Franklin/By your current policy, you would not annex it and it is also likely .... that couldn't happen immediately until we got out to the edge of our growth boundary because you have to be touching .... to annex ..... you would have to re-look at your growth policy if you wanted to pursue that which has a lot of implications in terms of infrastructure. Kubby/Page 35, Economic Well Being .... earlier discussion... concern... last Goal, 1 st Strategy, making sure that was referring to individual businesses ....It didn't seem very clear to me .... Norton/Which wording are you concerned about, Karen? Kubby/My concern is that- Norton/ Kubby/I don't want us to have the language in here to facilitate us kind of avoiding guidelines by providing infrastructure development to a whole area very frequently. I want to make sure that the language really does reflect that the last goal... really does refer to individual businesses .... Last goal .... in achieving the above goals .... Franklin/Particularly for Goal #3, talking about areas. I am trying to figure- Your concern is that the financial incentives not be put into areas rather than specific business ..... guidelines would govern individual businesses and not areas. Kubby/Or you change the guidelines. That is another way to work it. Norton/ Franklin/The decision on financial incentives, at any point that that decision is made, you can have that discussion of whether it applies to the area or to the specific businesses. Kubby/But that is not how our guidelines are written .... Franklin/ .... go back to plan .... This would support putting sewer into the park as it is written .... I think that you could read it that this would allow one to argue that the plan supports financial support for infrastructure development in an industrial park. Kubby/I disagree with that because of the guidelines say that they don't then have to meet- Franklin/Then the businesses, as they come in, are not subject to those guidelines which is a decision of council .... Kubby/I guess I am arguing against that ..... Franklin/Are other people reading it differently? It is still going to be a decision at the time when it comes before council .... Question at this point is does the council want to leave this open that you would provide financial assistance both to industrial parks and to individual businesses or do you want to tighten it up such that financial incentives are given only to individual businesses? Franklin/That is right... issue is with the guidelines. Bovbjerg/ Kubby/I had a couple of more things. I [7:05 PM: Baker, Thornberry, Vanderhoef.] Kubby/I didn't see any specific language... about impact of development on wildlife habitat .... about having that as a factor in making decisions .... Franklin/If it were there, it would be under Environmental Protection. I don't remember any discussion of that. Norton/Page 38, under Environmental Protection ..... critical wildlife habitat....page 36 about the 4th bullet. Franklin/Yes. Nov/Good enough. Kubby/ Nov/Anybody have anything on the main book. The South District Plan? Franklin/On the larger text, the only changes are in the memorandum? Norton/Guess so. Kubby/I brought the '89 Update .... phased map .... It helped guide decisions .... about when development should happen .... give a basis for decision ..... So I brought it so people could look at it .... To help discussions .... We haven't had very deep CIP discussions before ..... A big part of the job of the Comp Plan is now being put as a side-bar .... big thing ..... Franklin/When Southgate Avenue goes through, it will be much clearer in how to get around there. Council/(All talking). Nov/All right, anything on the South Plan? Kubby/We got that letter from Harry Wolf, representing Southgate .... discussion... long run... CC-2 because of the volume of traffic, then that is what should be in the Plan .... Franklin/As it is in the text, it is advocating this shift to a general commercial designation down there .... east side of Gilbert Street. Kubby/I would like to hear discussion .... Nov/I don't hear anybody advocating changing it. Kubby/We should contact Harry and tell him. Thornberry/ .... There is already a lot of traffic .... It should be that designation now as opposed to changing it in the future. Franklin/The Plan recognizes the increase in traffic that has occurred is going to occur and points us in the direction of changing that zoning down there. But the Plan won't change the zoning. We will have to go through that. Kubby/(Can't hear). Norton/CI-1 now, leave it there for now. Franklin/It will be .... It will be at least three months from after we adopt the Action Plan .... Franklin/Okay, when you do that, you should reference this memorandum which I will change before tomorrow night's meeting to incorporate the word changes that you mentioned today .... and do that before you close the p.h. Amend it on the floor. Nov/Do you want us to amend the resolution? Franklin/Your resolution is for the Comprehensive Plan .... The subject of the p.h. is this thing. So the public needs to know in a p.h. that you have done all of these things ..... Nov/You don't have to amend the resolution that we are voting on? Franklin/No .... Move to incorporate the changes in the 1997 Comprehensive Plan. Before the p.h. discussion and definitely before you close the p.h. Close your p.h. and then adopt the resolution. WS120897 December 8, 1997 Council Work Session Page 11 Review ZoninE Matters 97-162 S1 a. Public heating on a resolution approving the annexation of a 2.59 acre tract located at 3151 Highway 6 East. (ANN97-0003) Franklin/First item is p.h. on resolution .... annexation... This is for the Moose Lodge. What they have done is they purchased about five acres .... They need to annex the part that is in the county ..... zoned RR-1 and has a farm house on it. That is why the zoning, the next item is rezoning from a county designation and city designation to RM-20. b. Public heating on an ordinance amending the Zoning Chapter by changing the zoning designation for a five acre tract located at 3151 Highway 6 East from County Rural (A1) (2.59 acres) and Rural Residential (RR-1) (2.4 l acres) to RM-20, Medium Density Multi- Family Residential. (REZ97-0017) Franklin/We chose the RM-20 because there is RM-20 zoning right next door to it .... (refers to map) ....This is a zoning which is subject to a CZA ....That CZA is in your packet. Kubby/Do we have a signed CZA? Holecek/(Can't hear). Franklin/If it is not signed by tomorrow, we will let you know. Basically the issues in the CZA have to do with sewer service. At some point in time ..... The Scott Trunk Sewer (refers to map) .... coming up to Scott Six Industrial Park. There is quite a difference here between this development here and where the sewer line is. So what they are going to do in the short term is to run a force main around and come into a sewer on Heinz Road .... for the interim but in the long run... you need to connect to city sewer and they have agreed to do that? Nov/Are they not connecting to the sewer on Highway 6? Franklin/Yes, I mean to the gravity sewer. They are connecting to the city sewer now and to the gravity sewer when the interim development is there. Norton/ Franklin/(Refers to map). The trunk sewer is down here .... It is in the county but because we have just put a sewer through there, it makes that land a little more attractive for development .....A1 Streb has just bought this piece (refers to map) ....some intention of developing it .... The next provision in the CZA has to do with them agreeing to pay the water main extension fees and sewer tap on fees as required. Also dedication of a 20 foot sidewalk easements along Highway 6 and paying the equivalent cost of a four foot sidewalk. This would be an eight foot sidewalk .... They will just pay for the four foot. Nov/I would like a clarification on when they pay it .... Franklin/They pay it now. They pay it before they can get any kind of a building permit. Nov/Is that understood clearly? ..... Franklin/It is always hard to tell what somebody else understands but I think it is understood .....I think they understand ....There is nobody here from the Moose tonight .... Nov/It doesn't say that all of the fees are paid up front. Franklin/That is the way we do these sidewalks now. Holecek/Are you specifically looking at the CZA? Okay, we are also executing a development agreement that states that with part of the issuance of the first building permit, all those fees need to be paid ....We have taken that and made it more specific. Nov/Okay .... Norton/ Holecek/The sidewalk is suppose to be done either when the sidewalk comes from the west... actual connection to it. Or when future improvements occur in that area .... They don't have sanitary sewer through the property right now ..... Vanderhoef/...traffic flow... Highway 6 at that point is at 55 mph in fi-ont of this property? Franklin/I think you are right. Vanderhoef/Has there been any conversation about .... deceleration lane there? .... Davidson/Put that other map back up ..... I think what we concluded on that was we have a project .... take four lanes of Highway 6 ... tapers .... all the way out to Scott Blvd ....to taper down then .....Because of that project, we wouldn't want to put in a deceleration lane .....DOT ....cost share with them .... Franklin/We have a pretty wide shoulder there .... Norton/There could be a temporary deceleration ..... Davidson/It is hard to put something in and then tear it out. Vanderhoef/ Kubby/Is it possible to do something temporary? .... to make the shoulder safer- CHANGE TAPE TO REEL 97-162 SIDE 2 Davidson/They... would have to approve it. Norton/Highway 6 at Gilbert going eastbound ..... Thomberry/There are others on Highway 6 too, Dee, that are wide shoulders, turn lanes. Across from just east of Menards at Sunset, there is also wide shoulder turn lanes. Franklin/We do have a capital project for that one for a fight turn onto Sunset. I think what we need to do is maybe monitor this... approach DOT about doing anything on the shoulder if we wanted to put in something .... WS120897 December 8, 1997 Council Work Session Page 14 Vanderhoef/ Davidson/With respect to an impact fee for this property if we were to do something like that, we would take a look at all the eventual property that would be served by that deceleration lane .... Nov/Their frontage is not very much at all. Lehman/If we are talking about .... future.. that being four lane, it would seem a shame to put in that to DOT standards before we even know what kind of a problem we are going to have. Davidson/ ....edge of town ....really don't need two through lanes of capacity .... Lehman/ Vanderhoef/...daycare or some such thing during the day ...high traffic periods of time .... Franklin/I wasn't aware of a daycare .... Norton/They said they had a lot of daytime activity. Vanderhoef/Don't they bring children in their after school or something .... change the driveways... Lehman/ Franklin/One of the issues that we had relating to the access had to do with future development ..... in that we wanted to have an opportunity... access easement... a square around their drive and that is to allow any property to the east to hook into that drive. We are concerned about the number of drives and curb cuts that there are on Highway 6 .... don't have cueing problems... So we have got an access easement that would allow this to go to the east ....potential for a drive in here (refers to map). Thomberry/(Refers to map). Franklin/That is their stormwater detention. Vanderhoef/ Council/(All talking). Norton/There was considerable discussion in P/Z about a lane long enough to accommodate to try to keep this thing from stacking out into the road .... Council/(All talking). Holecek/Dee, that was part of the Board of Adjustment decision .... relates to the size of that being large enough... as to how much pavement was necessary. And the Board of Adjustment wanted the larger size access to allow for cueing. Norton/But that is not part of the CZA? Holecek/No. Nov/It is part of the development plan .... Kubby/What is going to happen with the current Moose Lodge site... on Dover? Franklin/I don't know. There are two other conditions .... 1-requires that a lighting, planting and building elevations be submitted to Planning ..... last one is that the additional regulations that pertain to clubs .... setback regulations. They have agreed to all of those conditions. We just need to get the signed document... Kubby/We have a couple of very small annexations lately .... Do you think there is any kind of trend? ..... Franklin/The last one was the Naples Avenue ..... remnant triangles ....What are you thinking of in terms of trend? Kubby/I just don't think it is smart to annex in such little chunks ..... The large annexations... were back in the 60's ....The industrial park was the other large one. Kubby/We had some good comprehensive planning with both of those big ones. Norton/ c. Public hearing on an ordinance amending the Zoning Chapter by amending Title 14, Chapter 6, "Zoning," Article B, "Zoning Definitions," Section 2, by changing the definition of Transient Housing to increase the number of days persons are able to stay as temporary residents. Franklin/Text amendment to change the definition of transient housing to increase the number of days people are able to stay as temporary residents from 10 days .... to 90 days .... most that anyone stays in either EHP or DVIP ..... Thomberry/How did they arrive at 90? .... Franklin/90 days was .... most that they would allow anybody to stay just so they had turnover...enable people to get employment ..... It is not... It is maximum .... Nov/ Franklin/15 to 20 days was the average. Nov/That is an average ..... Norton/I have trouble understanding these two aspects .... transient housing... transitional housing .... Franklin/That is the particular situation for DVIP and you are not addressing that in this ordinance amendment. Transitional housing is not defined, per se, in the Zoning Ordinance. It is allowable for DVIP to have apartments or rooming units above a principle use .... in the zone in which they are located ..... Norton/ Nov/Does it require a special exception? Franklin/Yes. Franklin/They are in a commercial zone... have to have a permitted use on the ground floor. I don't think they are intending to convert any on the ground floor. Nov/ Norton/ d. The Comprehensive Plan, including the South District Plan. (1) Public Hearing (2) Consider a Resolution Adopting Franklin/We have already talked about that. e. Consider an ordinance amending the Zoning Ordinance by changing the use regulations of a 2.81 acre tract, located southeast of the intersection of Iowa Highway 1 and Naples Avenue, from County CP-1, Planned Commercial, to CI-1, Intensive Commercial. (REZ97-0014) (Second consideration) Franklin/Second consideration on the Naples Avenue rezoning .... f. Consider an ordinance amending the approved Sensitive Areas Development Plan for Walden Hills to allow the development of 120 dwelling units on Lot 53, containing 8.66 acres and located within the OSA-8, Sensitive Areas Overlay zone at the northwest comer of Rohret Road and Shannon Drive. (REZ97-0016) (Second consideration) Franklin/Second consideration on Lot 53 .... Expedited action is requested on this item. Kubby/And that is because of getting tax credits? .... Consider an ordinance amending the Zoning Ordinance by changing the use regulations of a 0.87 acre tract, located on the east side of West Side Drive and south of Earl Road, from RM-12, Low Density Multi-Family Residential and CI-1, Intensive Commercial, to CO-l, Commercial Office. (REZ97-0004) (Second consideration) Franklin/Second consideration on rezoning for the insurance office on Westside Drive. Also have request for expedited consideration there. h. Consider a resolution approving a preliminary and final plat of Highlander Development, Second Addition, a 15.8 acre, six-lot commercial subdivision located northeast of the intersection of Interstate 80 and Highway 1 North. (SUB97-0028) Franklin/A subdivision for the Highlander and basically this is to accommodate- Nov/I was about to ask you for a better map. Franklin/This to accommodate conversion of the Highlander to a Radisson .... they need to have a lot that can be encumbered. So this Lot 24 will be that lot. The drive... will be used as access for Lots 21-23 and Lot 25 will have access out to Northgate. Approval of this is conditioned on providing secondary access out to Northgate for the Highlander development .... That will be the primary access .... Primary access for 25 on Northgate Drive .... Conceivable 25 ....purchased by owner of 24... expansion... Nov/They don't have an actual development plan for 25? Franklin/No. There is no development for 21, 22, 23, or 25.
