a. Consider a motion setting a public hearing for January 13 on an ordinance amending
Title 14, Chapter 6, entitled "Zoning," Article L, entitled "Provisional Uses and Special
Exceptions," to provide for temporary use permits to allow short-term activities, such as
special events or seasonal outdoor storage and sales.
Franklin/To allow temporary use permits. This is like car sales in shopping center
parking lots or something like that.
Nov/We need to give permission for something on a private parking lot?
Franklin/Well, it is a use that is not allowed there just by right .... neighboring car
dealership wishes to use that parking lot for a car display. Well that car display
and that car dealership is not the permitted use on that site. So it is a temporary
use permit to okay that kind of thing.
Nov/Okay.
Kubby/Wouldn't go for things like craft shows...
Thornberry/...circus in parking lot...

Kubby/Is what they were saying correct, Sarah? It doesn't depend where on the property,
it is whether it is a permitted use or not.

Lehman/A petting zoo inside the Old Capital Center would take a special permit, is that
right?
Holecek/Yes.
Lehman/How about a musical performance? That is certainly not retail.
Franklin/Is that on the list?
Boothroy/(Can't hear). Unfortunately, I don't have the ordinance in front of me. As I
recall, if it is within a building and it is associated with a retail use, it doesn't
require a permit.
Boothroy/ Does not.
Lehman/So a musical group would be associated with retail and wouldn't have to have a
permit.
Boothroy/And musical performances like at Old Capital Mall would not require one.
Lehman/A petting zoo for the little kids outside J. C. Penney's is associated with retail?

Peninsula - Proposed Development Process 97-163 S2
Nov/Peninsula development.
Franklin/What I wanted to discuss with you... how we are going to proceed with this. We
have drafted a request for qualifications. The intent is we go out and get a
consultant to help us with a design concept for the peninsula property and we
would look for someone who has experience in putting together traditional
neighborhood developments and their charge would be to prepare a design plan, a
conceptual design plan .... They would assist us in putting together a request for
proposal... design concept... pictorial rendition of what we want to have happen
there .... have some drawings to go with it... to go out and get developer...
developers.
Thomberry/You can't do that in-house, Karin?
Franklin/No, we do not have the skills to put together this kind of design concept ..... Part
of this... we do this through a public process .... include people who might have an
interest in this property .... part of this process in developing this concept .... move
from the concept to the actual development.
Norton/
Franklin/I think probably we would do most of the verbal for the RFP .... What skills ....
we do not have are the drawings and the experience in doing traditional
neighborhood development. We want to bring somebody in who has that
experience... work with the public... be able to visualize that and draw it.
Thornberry/Would these be local people? .....
Franklin/The consultants to do the traditional neighborhood design? I don't know of
anybody who has done that locally .....
Kubby/ ....Cedar Rapids... Fairfield ....
Norton/What kind of numbers are you talking about here, roughly?
Franklin/It depends on how long the sherret is .... somewhere from $50,000 to $80,000 .....
It is also something that we would be able to use, not just on the peninsula ....We
can use that in various parts of the community.

Kubby/With the sherret, how does that coincide with the brainstorming that we did?
Franklin/One of the things that we will include in the RFP .... statement that I put together
in that November 3 memorandum to you .... That has been taken to the P/Z
Commission ....
Lehman/ .... I think this project... I would love to see this work... I think there needs to be
as much input by local developers .... along the way... So that when the RFP goes
out, there is no basic surprises... They will have been brought along step by step ....
their input ....explanation from the consultant to them ....sell them on the
concept ....I think this can fly... require... working with...developers ....
Nov/I think they would be interested in the sherret process .....
Franklin/One thing we have to be careful of... We cannot focus on any particular
developer ..... so as not to taint the RFP process ....
Lehman/ ....specifically invite... developers ....
Franklin/Just as we did when we had Mr. Dover come in... major developlrs .... most of
them were there.
Lehman/ .... so important.
Franklin/A learning process for everybody .... that will bring some people on board to be
thinking this way... other projects ....
Lehman/We need them on board... have them be part of the process.

Vanderhoef/Did we get information about Mr. Dover at all after he left... about his
thoughts specifically for this property?
Franklin/Yes, we had a conversation with him... worked with him all day .... He had some
ideas about the peninsula... interesting ideas about the commercial aspects of it ....
need to work through .....hotel, restaurant .....trying to get at the economics of
how one would do that .... I think we should get too hung up on the neo-traditional
concept in terms of having commercial right there in residential on this site ....

relatively small site... limitations in access ....having a very small kind of
commercial thing.
Vanderhoef/
Franklin/We are talking about the population that would be on the peninsula ....
Washington Park property north of Foster Road .... whole area .....
Norton/
Franklin/I would like very much to get the owners and developers of property north of
Foster Road involved in the sherret .... The timing on this, if we send the RFP out
by the end of this week... get it back by middle of January or first of February ....
working through that sherret process so that we had an RFP to go out maybe in
around April. And then... response to that, due back by July or August... leaving
about four months... developer... get quite specific in terms of what they would do
on the Peninsula... enough time for them to put some thought into it .... Then
selecting the preferred developer in September or October... person that we would
work with to get down to the detail .... Learn... whether it is feasible to look at this
project as being developed by more than one... Make sure you get the
coherence .... If that time schedule that I have outlined works... possibility then of
construction beginning in spring or summer of 1999... depending upon the Elks
getting the golf holes done... coordinating our construction of Foster Road .... That
is the scheme at this point in time. So if that is okay with you guys, that is how we
will proceed. Okay.
One other item related to the Peninsula. In continuing to look at this, we have
thought about the possibility of selling just the top as opposed to the top and the
slopes. And the thinking there is the slopes are an area where we have talked
about there not being development there but transferring the density to the top.
And the notion here is that we transfer that density prior to the sale of it .... selling
the same value in terms of how many units you can get but the ownership would
just be the top flat or buildable portion. The city would retain the hillsides and we
essentially get what we want.
Kubby/It sounds like putting an overlay zoning on it in some way.
Franklin/ ....we will own the flat down at the bottom... retain that hillside ....take that
density... transfer that to the top.

Nov/What about maintenance? .....
Franklin/I think it becomes just a maintenance issue just as the flat is ....maybe even less
so... just woods ....
Norton/Could be tough to find... question of where that slope begins... sticky issue.
Franklin/Maybe looking at topography... protected slope... critical slopes... steep slopes...
have some of that in the developable land.
Norton/I assume we will see sketches of this ....
Franklin/Oh yeah. We are working on a survey now .... In terms of concept, I wanted to
run that by you and see what you thought .....
Lehman/Wouldn't it be wise in not making that decision until after we see what the
consultant comes up with?
Franklin/Possibly.
Lehman/I don't have any great desire for the city to own that property. I think that
property could be sold along with the upper portion with the stipulation that it
cannot be developed. So any maintenance... responsibility of the homeowner's
association ..... We could prohibit building in that area .....

Vanderhoef/Wouldn't we have to change our zoning ..... ?
Franklin/Yeah, we are going to have to change the zoning on the whole peninsula right
now. It is ID-RS and we are going to need it to go to P and some combination ....

Nov/Isn't there another issue, someone else's property asking for rezoning to higher
density on the Peninsula?

Franklin/That is farther east ....pretty close to the Calibria or No Name Street/Foster
Road intersection.
Thornberry/I like Ernie's suggestion ....up to homeowner's association to keep it ....
Lehman/We have so much land now that we have to maintain .....
Kubby/On the other hand... they could be cutting trees down ....
Vanderhoef/Also property tax advantages .....

to make it feasible ....

Kubby/ ....late fee first.
Nov/Does anyone have any questions for Don. The memo is pretty thorough.
Vanderhoef/I think it is just a philosophy right now whether we want to say that there is
this amount that we are asking for administration of those additional letters that
have to go out when someone is late with their payment and when charging the
user fee of 1.5%.
Lehman/Do you have any idea of.... 700 letters week... late notices. Do you have any
idea of what the amount of those bills are? .....

Kubby/That the big industry users are paying their bill.
Lehman/I would think so.
Vanderhoef/...residential customer that is more apt not to pay. I did have some
conversation with Don this afternoon and he said perhaps the $3.00 is a little bit
high for the administrative fee. It could be a bit lower ....I would like to have it
separated out .....
Nov/What about the programming? Is it difficult to do it in this way? ....
Yucuis/If we are getting a flat fee, it is going to add time to the program. The sooner you
can tell us that is what you want... more time we have to do it as far as

programming goes .... A straight percentage amount is easier to program than flat
fee plus.
Norton/A straight percentage is pretty stiff for those big users ....
Lehman/I don't think that is the problem.

Nov/If they sent out a pay that says pay by this date this amount. After this date, that
amount, there will be fewer letters sent out. People will see it up front.
Lehman/ ....add penalty into original bill ....
Norton/Have two numbers, pay by now and pay by next time.
Thornberry/I don't know what strata the delinquencies fall in. Do you know, if there are
some that do this a lot? Are the same names cropping up? ....
Yucuis/If there is the same names coming up, it doesn't come up very often .... Section in
our Code that says if you are late paying, late paying, late paying .... delinquency
deposit added on ....three times in a 12 month period .....It is not a big
percentage ....

Norton/If you could back the fix fee off.... there must be a constant component in it .....

Lehman/If you were to send a bill with two amounts... paid after a certain date... prior to
a certain date ....easy to program a flat fee plus 1 1/2% of that ....Send me a bill
that is $20 paid by 10th of the month. $21 if paid after the 10th ....It is easier to
program that based on a percentage of the bill or a flat fee plus a percentage of the
bill?

Norton/I don't understand .... adding a constant has got to be about the most trivial
process for a computer .....
Vanderhoef/If we are going with the two figures... want the gross and the net. If we just
put those two figures in but make a statement on the bill ....
Yucuis/Printing out the bill a certain way is no problem whether you have the flat fee or
1 1/2%. But ifI call in... I owe $45 but I had a thing over here that said I only
owed $42... next bill in there. We have to be able to look that up .... We can't just
say... $3.00 fee .....We have to give them straight answers... programming gets a
little complicated ....
Vanderhoef/So the total on this bill for the late payer, they can consistently know that
that is $3.00 plus 1 1/2%. That can be written on the statement ....
Kubby/...If you only pay part of your bill on time and you have a balance due ....
Yucuis/It is just explaining it to people that don't pay on time ....
Thornberry/If you are late, it is going to be another 5%, period ....
Norton/Suppose we had a fixed fee plus 1 1/2%. What is the 1 1/2 for?
Lehman/The cost of mailing ....
Norton/So they are all justifiable .... I would have argued to separate it out ....
Kubby/ ....consumer friendly... have explanation for out bills... simplify ....

Nov/Now utility discounts. I take it from the resolution .... recommending that we do a
60% discount on water and wastewater and 75% on the solid waste and recycling.
What does the council think about that?
Norton/...logic ....
Nov/He has provided with lots of good charts ..... Which one looks reasonable is the way
we are doing it.
Lehman/The 60/60/75 is a slightly less .... beyond that it does represent a slight increase
over what they are paying now .... I don't have any problem with the 60/60/75.
Nov/Everybody's bills are going up a little bit.

Parks and Recreation Reorganization 97-163 S2
Trueblood/I assume you have all had a chance... memo and look at the organizational
chart that I submitted ..... Just to go through .... follow along in the organizational
chart. It shows that we are... creating three new positions but we are eliminating
two management positions... Park operations... eliminating Superintendent of
Parks .... eliminating... City Forester .... Creating Superintendent of Parks and
Forestry... includes CBD... person would be Terry Robinson .... Also creating a
new position of Clerk Typist and new Senior Maintenance position .... Notice
under Park Operations... Forestry Operations and CBD Operations, there are no
lines draw between those ....intentional... want it regarded as one division ....It
won't be uncommon .... more common to see Parks crews helping CBD .... that
kind of thing.

Trueblood/ .... at City Park .... New Parks Maintenance facility... having that designed ....
City Park .... new Superintendent would move out to the Parks Maintenance
headquarters immediately ....
Thornberry/Where does Terry work out of now?
Trueblood/The Cemetery Building .... Cemetery will remain its own division .....different
enough from the rest of them .... That person would still answer directly to me.
Lehman/Savings... $15,000 the first year. How do you envision that as the years go on?
Trueblood/... I didn't word that real clearly. We can reduce the current budget of those
three divisions by about $15,000. About $10,000 of that is either directly or
indirectly a result of this reorganization. The other $5,000 is some staff turnover
and replacements ..... Difficult to get a handle on it-

Lehman/So it would be $12,000 more than the present system .....
Norton/Terry .... you had a Parks Superintendent and Forester .... Does Terry then .... do
the work scheduling for all of those folks? .....Who is telling who what to do in
some sense?
Trueblood/He would be doing it in cooperation with the Senior Maintenance Workers ....
As you see in the Parks Operation... the Park Operations would remain the same
personnel-wise. One Senior Maintenance worker would be reclassified .... Forestry
Division would gain one new Senior Maintenance Worker .... These people will be
working back and forth. In the CBD Operation... remain the same .... Two Senior
Maintenance Workers in the Parks Division .... One in Forestry and one in CBD
and those people would be the primary on-site supervisors of the work going on.
Norton/ ....those four... supervisory ....component ....
Trueblood/ .... even Maintenance Workers III might be out... working with temporaries ....
then they are in charge... At times the IIs have some supervisory responsibility
over temporaries ....
Thomberry/Terry would the Park Senior Maintenance Worker... guy in charge... and
Forestry guy .... will they be union?
Trueblood/Everybody you see on his page with the exception of the temporaries and the
Superintendent will be bargaining unit employees .....
Lehman/You are sold on this?
Trueblood/That is correct.
Kubby/Concern .... we ask Terry to do a lot of things... I want to make sure he is tending
to our plant material as much as possible... Who is going to be doing? .....I want to
make sure all those tasks get done.
Trueblood/Right now, besides Terry... Forestry crew we have a person with a four year
degree in urban forestry ....two year degree in horticulture .....Sherri Thomas...
two year degree in horticulture... and new turf grass specialist ....plenty... taking
care of plant materials.

both of those ....
Atkins/We have done that where we have bid those landscaping contracts separate ....

Nov/What do you people think about the Sister City idea?
Kubby/I like it a lot... hesitant... I want to see what kind of community or organizational
interest here is in #3-9 before I commit to doing #2 .... I need some questions
answered about that energy.. time .... to create the non-profit, to run the non-
profit .... Before I am willing to write the $480 check and pass a resolution. I want
to know that there is some energy behind the resolution .....I want to hear some
community conversation about this.
Nov/There will be some city time to form a non-profit organization .... our City
Attorney... funding it seems to be very flexible ....Hard to know if there is enough
community interest in this particular city .....
Norton/ ....15 years on the Foreign Relations Council ....There is some work to do ....
Vanderhoef/Has anyone talked to the Chamber or the University? .... to see if they have
any interest in helping build a coalition.
Kubby/ ....needs to be some footwork done ....
Thomberry/I was thinking of maybe going visiting .... Should have a sister city ..... I don't
see why we can't do it .... Osage.
Kubby/ ....Osage... they are doing some stuff that we are not doing ....
Norton/Got to make it work .... energy ....
Thornberry/After visiting with the mayor... I liked the guy... I think the city is not a great
match with Iowa City .....spa community .... resort ....It is more like ....Hot Springs,
Arkansas ....
Lehman/A lot more to that city than just spas.

they are doing ..... Another larger stack of paper in Lisa's file .... You can always
read more about it.
Lehman/Dee, you say you are active in the Foreign Relations Council... I would like
their opinion of this.

2. Thornberry/On the Board of Appeals... #4 of Iowa Board of Appeals... read this one
paragraph (11/3 minutes) .... placement of laundry facilities .... reviewed .... They
are enforcing the Code when they want to or maybe one person is doing it and
another person is not enforcing the Code as written ....
Nov/Sounds like they need training for that department.
Atkins/Perspective... 600-800 building permits a year .....

3. Thornberry (Agenda # 4 d(4)-Kirkwood Jobs Training Programs) On this joint
agreement with Kirkwood Community College. I understand that we only pay for
that when it is- They only get money when it is used and they do a training and
they have only done it once in the last two years.

Kubby/I have a question .... Question raised .... training moneys are given... pay for
employee during that training period... possibility of that employee being let go at
the end of the training period ....One of the pieces of information that I would like
to know before approving it ....If an entity has used this money before, I would
like to see their record of the use of these moneys to make sure .... got to goals ....
1- If they get to the goal of the number of employees they were going to train .... 2-
To get a record of retention of those employees after the training period ....Only
for folks that have come back a second time for these moneys.

idea of moving forward with that project ..... do more projects every other week.

10. Norton/I want to bring up an issue... trouble with ...water rates. I have looked at the
numbers a lot... I don't understand- We are going to be short money .... If no raise
next March .... I assume we still need the money. What I don't understand is where
is it going? What is happening? .... $97,000... would go into our accumulation of
cash .... that we would not gather ....
Kubby/With our projected rate increases... from the schedule of rate increases, with the
increase that we are going to pass tomorrow night and the rest of the scheduled
rate increases, are we still going to be on target for raising money including the
20% down payment for both waste and wastewater?
Yucuis/I believe we are.
Norton/At the same time? You can't be on the same time scheduled.
Yucuis/The thing that has changed, Dee- We had a rate increase in March '97 .....
projects... delayed... spread out projects because of delays. And because of that,
the rate increase of March '97 isn't paying for anything... accumulating more cash
this FY .... lesser debt to pay, lesser projects to pay. So that cash is there.

Norton/Let me try again ..... If you do not collect $100,000... had you proceeded with the
15 and 10 rate increases .... residential .... There is $100,000 that you are not
collecting next year .... cost of the Water Projects overall is not going down .... We
have paid more .... My point is the costs are not decreasing... substantial relief this
year... net increase is 2.3% ....I am worried... why not cut the rates overall rather
than just cut the minimum ....give them two lower raises .....
Lehman/We have got an excess of cash from last year that we did not anticipate because
we didn't use it for projects... also have had a substantial reduction in part of that
sewer project .....
Norton/ .... It is conceivable that the costs are not going up... Why not make a smaller
raise each of two years ..... taken me a couple of weeks in trying to analyze it...
preferred some method of a smaller rate increase this year... and next year .....
Kubby/Next year the schedule is a smaller increase... percentage ....
