Design Review Application for Iowa City Transit Interchange and
Recommendation Regarding Projecting Signs
At its June 16, 1997, meeting, the Design Review Committee recommended, by a vote of
4-1 (Woodson voting no), disapproval of the design review application for the Iowa City
Transit Interchange Facility. In addition to this recommendation, the Design Review
Committee recommended by a vote of 5-0 that the City Council reassess the location for
the transit interchange facility due to the design impact and safety concerns of the facility.
Also at its June 16 meeting, the Design Review Committee strongly recommended, by a
vote of 4-1 (Swan voting no), that projecting signs continue to be prohibited. By a vote of
5-0, the Committee then recommended that if projecting signs are permitted, the
Committee supports the staff's recommendation in the May 1, 1997, memo to the Planning
and Zoning Commission with the following modifications:
the width (thickness) of projecting signs be no wider than four inches and
projecting signs not be illuminated.

THE CITY OF IOWA CITY, IOWA, ON THE
MATTER OF THE PROPOSAL TO ENTER INTO
A DEVELOPMENT AGREEMENT WITH AL AND
MARY JO STREB AND THE HEARING
THEREON.
Public notice is hereby given that the Council
of the City of Iowa City, Iowa, will hold a
public hearing on the 17th day of June, 1997
at 7:00 p.m. in the Civic Center, 410 E.
Washington Street, Iowa City, Iowa, at which
meeting the Council proposes to take additional
action on the proposal to enter into a
Development Agreement (the "Agreement")
with AI and Mary Jo Streb (the "Developer").
The Agreement would obligate the Developer
to construct certain Minimum Improvements
(as defined in the Agreement) on certain real
property located within the Scott-Six Urban
Renewal Project Area as defined an~l legally
described in the Development Agreement,
consisting of an industrial park. The
Agreement further obligates the Developer to
dedicate an easement for sewer right-of-way
and limit the price of land in the industrial park.
Under the Agreement, the City would offer
grants, loans or other financial incentives to
businesses locating in the industrial park, at its
discretion and in accord with its economic
development policies; and the City may provide
certain public infrastructure improvements
through the use of tax increment financing as
described in the Agreement.
A copy of the Agreement is on file for public
inspection during regular business hours in the
office of the City Clerk, Civic Center, Iowa
City, Iowa.
At the above meeting the Council shall
receive oral or written objections from any
resident or property owner of said City, to the
proposal to enter into the Agreement with the
Developer. After all objections have been
received and considered, the Council will at this
meeting or at any adjournment thereof, take
additional action on the proposal or will
abandon the proposal to authorize said
Agreement.

ORDINANCE AMENDING TITLE 14, "UNIFIED
DEVELOPMENT CODE," CHAPTER 3, "CITY
UTILITIES," ARTICLE A, "GENERAL PROVI-
SIONS" OF THE CITY CODE TO ESTABLISH
RULES GOVERNING BILLING ADJUSTMENTS
TO CITY UTILITY ACCOUNTS FOR INCORRECT
BILLINGS; TO WAIVE PAYMENT FOR CERTAIN
SOLID WASTE/RECYCLING SERVICES; AND,
TO AMEND THE CITY CODE PROVISION CON-
CERNING THE ESTABLISHMENT OF CITY
UTILITY ACCOUNTS TO ELIMINATE THE
REQUIREMENT OF A WRITTEN AGREEMENT.
WHEREAS, the Department of Finance of
the City of Iowa City has a Billing Adjustment
Policy that establishes a policy for determining
a billing adjustment when an account holder
has beeh incorrectly billed for a city utility
(water, wastewater (sewer), solid
waste/recycling); and
WHEREAS, in the Spring of 1996 the City
embarked on a new curbside recycling program
which resulted in the discovery that a number
of residential rental households were being
incorrectly billed for solid waste/recycling,
which is billed on a "per dwelling unit" basis,
because the Finance Department records were
not cross-checked with records of the Depart-
ment of Housing and Inspection Services that
establish the number of dwelling units of resi-
dential rental properties; and
WHEREAS, a system has been developed
and implemented. which provides for verifica-
tion of the accuracy of Department of Finance
records regarding the number of dwelling units;
and
WHEREAS, the City Council of the City of
Iowa City desires to waive payment of solid
waste/recycling collection services that were
provided to Iowa City households but not billed
for due to incomplete billing information when
the failure to bill is discovered by the City on or
before July 1, 1997; and
WHEREAS, the City Council of the City of
Iowa City desires to enact rules governing
utility billing adjustments by ordinance so that

such rules will have the force and effect of
law; and
WHEREAS, the process of implementing the
City Code provision requiring a person estab-
lishing a City utility account to execute a
written agreement and the implementation of a
record retention system for said agreements is
time-consuming and expensive, and should be
repealed.
NOW, THEREFORE, BE IT ORDAINED BY
THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
SECTION I. Title 14, "Unified Development
Code," Chapter 3, "City Utilities," Article A,
"General Provisions," Section 4, "Rates and
Charges for City Utilities" is hereby amended
by adding a new subsection E to read as fol-
lows:
E. Billing Adjustments
1, A billing adjustment will be made when
it is discovered that an account holder
has been incorrectly billed for water,
wastewater (sewer) or solid
waste/recycling service for the period
of adjustment.
2. "Period of adjustment" shall be defined
a~ follows: The entire period of inaccu-
racy on the account, or five years prior
to the date the error was discovered
and corrected, whichever is the lesser
period.
3. The calculation of any billing adjust-
ment shall be based on the rate or rates
in effect at the time of the incorrect
billing or billings.
4. When an account holder has been
overcharged for services rendered, one
hundred percent (100%) of the over-
charge for the applicable period of
adjustment, without interest, shall be
refunded or credited to the account
holder.
5. When an account holder has been
undercharged for services rendered the
account holder shall be billed fifty per-
cent (50%) of the total amount under-
charged, without interest, for the appli-
cable period of adjustment.
6. No interest shall run in favor of the City
on undercharges and no interest will
run in favor of the account holder on
overcharges.
7. The City Manager or designee shall
establish rules for determining the
period of inaccuracy and the calculation

of what the correct billing would have
been during that period.
Billings for solid waste/recycling servic-
es that were provided by the City to
the account holder but not billed by the
City shall be waived and shall not be
collected when the billing error is dis-
covered by the City on or before July
1, 1997.
SECTION II. Title 14, "Unified Development
Code," Chapter 3, "City Utilities," Article A,
"General Provisions," Section 5, "Establishing
City Accounts; Deposits Required" is hereby
amended by deleting subparagraph A and
substituting in lieu thereof the following:
A. Prior to establishing a water service
account, a wastewater account and/or
a residential solid waste collection
account with the City, any person es-
tablishing an account, with the excep-
tion of a residential owner account,
shall be required to make a combined
account deposit before City services
are. provided. The amount of this de-
posit shall be as provided in the sched-
ule of fees, Title 3, Chapter 4 of the
City Code.
SECTION III. REPEALER. All ordinances and
parts of ordinances in conflict with the provi-
sions of this Ordinance are hereby repealed.
SECTION IV. SEVERABILITY. If any section,
provision or part of the Ordinance shall be
adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the
Ordinance as a whole or any section, provision
or part thereof not adjudged invalid or unconsti-
tutional.
SECTION V. EFFECTIVE DATE. This Ordi-
nance shall be in effect after its final passage,
approval and publication, as provided by law.

Re: Billing Adjustment Ordinance
The June 17 agenda includes a public hearing on the proposed ordinance regarding billing
adjustments. The ordinance is fairly straightforward and self-explanatory. It establishes the billing
adjustment rules that have previously been discussed with you and formally provides for waiver
of errors in solid waste/recycling billings that are discovered on or before July 1, 1997.
Earlier recommendations made by this office included expanding the terms of the written
agreement between a customer and the City when an account is established. However, the City
has now discontinued the requirement that residential owners make a deposit, which means that
these customers can establish service by phone. Thus, any "agreement" would have to be sent
to these customers for signing and it is likely that a certain percentage would not be returned. The
other problem with the "agreement" concept is that because of the applicable statute of limitations
in order to be useful the written agreements would have to be maintained for five years from the
termination of the account. As explained in Don Yucuis' memo to you, these two factors make
the requirement of a written agreement cumbersome and expensive.
The ordinance itself is sufficient to establish rules regarding billing adjustments. Customer
Service intends to provide an information sheet to the customer when an account is established
which will include a summary of the billing adjustment rules. My one concern with not having a
written "agreement" that is signed by the customer is with respect to interest. The ordinance
provides that the City will not pay interest on overbillings and the customer will not be charged
interest on underbillings. The Iowa Code provides that the interest rate on an open account will
be 5% after six months from the date of the last item, unless the parties shall otherwise agree
in writing. Without an agreement we run the risk that a customer who is overbilled would seek
interest from the City despite the ordinance. In my discussions with the Finance Department, we
have determined that this risk would not justify the expense and time required in obtaining the
written agreements and setting up a record retention process for those agreements. Thus, the
proposed ordinance eliminates the requirement of a written agreement.

Item #9, June 19, 1997 Council Meeting - Utility, Billing Adjustment Ordinance
Several months ago staff presented you with information regarding billing adjustments for solid
waste and recycling pick up. The City Council gave staff direction to forgive any backbillings
pertaining to recycling pickup; to cross reference Treasury Division utility records with Housing
and Inspection Services to determine if any accounts should be charged recycling that are not;
and to draft a new billing adjustment ordinance. Prior to that, the deposit charged for residential
owner accounts was eliminated. The existing City Code includes a requirement that an account
holder needs to sign a written agreement when an account is established.
Included in the new billing adjustment ordinance is the elimination of the requirement to get a
written signed agreement by the account holder prior to establishing an account. With the
elimination of the deposit charge for residential owner accounts, staff would like to eliminate the
requirement for a signed written agreement. The process to secure a written agreement for all
current and future account holders and the implementation of a record retention system of
those written agreements, would be very time consuming and expensive. The City currently can
enforce all sections of the City Code pertaining to utility service and payment without a signed
agreement.
