Review Zonin~ Matters 96-6 S2 Public hearing on an ordinance amending the Zoning Chapter by changing the use regulations for a .5 acre property located at 840 Cross Park Avenue from CO-I, Coramercial Office, to CC-2, Community Commercial. (REZ94- 0014) [Tape Problems] Franklin/ To rezone this portion here to CO-1. That was rezoned .... with the understanding that this would provide a transition.. between residential and commercial. (Refers to map) ..... Retaining the CO-1 along Cross Park Avenue would retain the concept of the transition. What you are looking at now is a rezoning of a lot that is right on Cross Park Avenue. The recommendation of the staff and of the P/Z Commission is for denial... based on the concept of a transition between the residential uses to the south and the more intensive community commercial to the north ....... It is an issue of incrementally chipping away at the transition ...... There are establishes uses... on all of these lots now ..... With rezoning to CC-2 it is conceivable that in the future there becomes even less of an argument to retain the CO-1 here. You do have residential on the west side of Keokuk as well as on the south side of Cross Park Avenue ..... Kubby/ So at the beginning the RM-12 was the transition zoning? Franklin/ Yes .... Nov/ They are talking about a much larger building... much more required parking... is room to put apartments on the side that faces Cross Park and put the parking on the .... east side which would face the Econofoods parking lot ..... bigger parking lot. Franklin/ In both... CO-1 and CC-2, residential uses are restricted to the second floor and above .... That also would require more parking .... I am assuming if they are contemplating those residential units that they would have room on those two lots to put the parking that is required for commercial and residential ..... Nov/ Norton/ Tom said he was talking second floor. Nov/ I was also told that the back of this would have more apartments... similar to an apartment building... two levels of apartments facing Cross Park plus apartments above retail so there could be six two bedroom apartments ..... Franklin/ Not by the Zoning Ordinance .... I think the building definitely could appear very similar... office on ground floor and residential above. The issue is one of intensity of use .... Gets down to the principle of the transition and how severe you think this would be in terms of a problem for people who are residents on the south side of Cross Park. Lehman/ Franklin/ Norton/ Franklin/ When there is rezoning, the rezoning is not conditioned on a particular establishment or a particular use and it cannot be. Baker/ Franklin/ In the state law which enables us to do conditional rezoning the first thing that you look at is the appropriateness of the zone for the uses that are permitted in the zone. If you wish to restrict the uses, then you zone it a particular way to preclude those uses. Thornberry/ Can you have parking in CC-I? ...... There is CC-2 to the east. Franklin/ That is Econofoods. Thornberry/ Could the parking for that building be there in that CC-1 if they are going to build on that lot behind? Kubby/ So build on the lot that us zoned appropriately ..... Franklin/ That you build on this lot and parking is over here- Thornberry/ No, parking is on Cross Park. Franklin/ That was what was originally being suggested. The issue there is one of providing parking for one use in another zone. With a commercial it is not as obvious because the CO-1 and CC-2 .... greater intensity of use in CC-2 than CO-1 ..... comparison of multi family residential next to s.f ...... allows you to increase the intensity of use on the multi family lot beyond what that lot would hold and it de facto rezones that s.f. property to multi family because what you got is an accessory use that is essential for that multi family development. It is the same principle here ..... de facto increasing the zoning to CC-2 on Cross Park Avenue... If you want to do that... then just zone it CC-2. Kubby/ Is it impossible to do the building they want to do and have the parking all on one lot .... ? Franklin/ My understanding is it is impossible. The location they are in now is too small for them .... Nov/ They are talking about 8,000 sq.ft of commercial... not enough parking. Lehman/ Larger question... if we change the zoning... Baker/ Explain to me why you can't conditional zone...? Franklin/ Then you are talking about conditionally zoning it for a use. It is not a principle use, it is an accessory use .... Franklin/ Nov/ What if it were rezoned CC-2 and they were allowed to put apartments in it, does that fit anything at all? ..... Vanderhoef/ Tell me what the reasoning is for not allowing the apartments on the ground floor .... Franklin/ In commercial zones we don't allow residential on the ground floor because in this town it is so easy to do residential... you would have residential occupying all of our commercial space then ..... Thornberry/ I am familiar with that. Lehman/ Interested in hearing what happens at the p.h .... Public hearing on an ordinance amending the Zoning Chapter by changing the use regulations of an approximate .3 acre property located at 1500 Sycamore Street from RS- 5, Low Density Single-Family Residential, to CO-l, Office Commercial. (REZ94-0015) Franklin/ This one is also a rezoning issue. A p.h. and this is to rezone a .3 acre property on Deforest and Sycamore. (Refers to map). The property has been used as offices of Lutheran Social Services for some years... since 1967 .... religious institution... by right under the zoning at that time. Since then... religious institutions is a special exception .... Importance is if another religious institution were to purchase this property it could use it as such. The non- conformity that is there can go to another user unlike a special exception which they would have to get another special exception ..... A religious institution could purchase the property and continue the use of this property as a religious institution ..... Nov/ If we agree that this is a social service institution ..... Franklin/ Placement of it there relies upon interpretation of Board of Adjustment in 1967 and there is no way that you can establish a service institution in RS-5 zone today. Nov/ Continued same use ..... Franklin/ That would be a nice easy solution .... The request is to rezone this to CO-1 to permit an office use which would essentially continue the use of this property as it has been used for the last 20-30 years .... Recommendation by staff was to rezone it to CO-1 ..... of P/Z commission was denial of the rezoning and this was after input from the residents of DeForest area ..... opposed to the rezoning of this property... like it to be retained in RS-5... s.f. residence... Rezoning did have a number of conditions placed upon it to try to enable the office use to fit in ...... Parking lot is to the south .... Additionally no parking or access drives could be placed to the north of any building on the site .... Building set back from Deforest would have to be maintained ..... And existing landscape screening on east boundary of the property would need to be retained. Not finished with final language, they are asking that we continue the p.h. so they have a couple of more weeks to work together to find a solution that works for everybody ..... Public hearing on an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article D, entitled "Residential Zones," Section 5, entitled "Neighborhood Conservation Residential Zone (RNC-12)," to clarify the number of roomers permitted in duplex units in the RNC-12 zone. Franklin/ P.h .... clarify the number of roomers permitted in duplex units. This all started... when we were looking at the rezoning of the Fairchild area to RNC-12. There were some multi family duplex owners who came to the council that night of that p.h. and were concerned... they had two roomers... that they would loose those roomers if the area were rezoned to RNC-12 .... At that time the council said look into that in terms of the number of roomers that are permitted in duplexes. It went on the work program and we have... taking to P/Z Commission which makes the number of roomers permitted in RNC- 12 consistent with the number of roomers permitted in the previous RM-12 which is what this was a rezoning from and simplifies the roomer situation for both the property owners and for those on the staff who have to enforce the occupancy regulations. Typically you are not going to see an RNC-12 rezoning from RS-12 to RNC -12. You see it from RM-12 to RNC- 12. Remember this zone is one about neighborhood conservation. Any multi family that is there has a right to continue... consistency is logical... As RNC-12 is written right now, two roomers per s.f. One for a duplex. That is consistent with RS- 12, the s.f. zone. The Commission with input... they did not wish to increase the number of roomers permitted in RNC-12 because this would be an increase in the number of people. Nov/ And cars. Kubby/ With RNC-12 zoning, if you have multi family, we have to kind of know the date of when that use started .... Not hard to tag properties at a certain date, they can have two roomers .... Norton/ How big is that enforcement problem... is it a biggie? Franklin/ Enforcement of roomers, period, is a biggie ..... It has to do with our requirement to notify of an inspection and how fluid the people are .... We go to do the inspection, the roomer is gone and it is not necessarily the landlord that notifies the tenants .... There may be some over occupancy that the landlord isn't even aware of ..... It kind of compounds the enforcement problem .... You are right technically with computers... you can put the date in when it is established. Kubby/ So if we want one roomer we should vote no. Franklin/ That is right. Norton/ Which is what P/Z did, right? Franklin/ That is right. Baker/ Council/ (All talking). Nov/ Even if the law says one roomer, there may be three. We just don't know. Consider an ordinance amending Title 14, Chapter 6, entitled "Zoning," to allow recycling processing facilities in the I-l, General Industrial, zone and related amendments. Consider a letter to the Johnson County Board of Supervisors regarding a request to rezone 38.22 acres from County A-I, Rural, to County RS, Suburban Residen- tial, for property located in Fringe Area 4 on the west side of Prairie du Chien Road approximately ¼-mile north of its intersection with Newport Road NE. Franklin/ Letter to the JC Board of Supervisors request to rezone 38 acres .... The rezoning of this property is inconsistent with the current Fringe Agreement and the recommendation from staff and P/Z is denial. Nov/ Send a letter .... WS011596 January 15, 1996 Council Work Session Page 12 CDBG/HOME Fund Allocations 96-6 S2 Nov/ Next item is CDBG. Marianne- Milkman/ HOME. I sort of tried to give you a short crash course in the HOME Program in the memo. It is a new program... it does have a few really important differences from the CDBG Program .... I know you all know CDBG. The main points about the HOME Program is that A-you can only use it for various types of housing activities and the housing has to be affordable, 80% below median income and for rental housing .... to households below 64% median income .... Talk about housing affordable to- Other things... 15% of the funds must go to something that is called Community Housing Development Organizations... CHODOs... We have two certified CHODOs in the city who are eligible ... GICHF and .... HACAP and then finally in the HOME funds you can provide a separate allocation for operational funds for these CHODOs ..... Nov/ Is that operations in same 15% or is it different? Milkman/ No, it is separate. It cannot be part of the 15%. The 15% has to be for projects creating housing or supporting housing. So, why the reallocation of FY95 HOME funds and that is because both FY95 HOME and CDBG funds were allocated to Burns and GICHF for the partnership to acquire and develop new affordable rental housing and that has not been successful. Another thing with the HOME funds is that you must commit them within a two year period of being given the credit for that money and commitment means there has got to be something real there, legally binding commitment for the housing. That is why we have that $150,000 of HOME funds that have to be reallocated and we have to move it quickly. The other part of this is that because the $150,000 was allocated to GICHF plus Burns, that counted for part of that 15% that had to go to CHODO. Now that is sort of out of the picture, we have to use-make sure that $40,000 of that $150,000 goes to either HACAP or the Fellowship. So you have got three projects before you to vote on tomorrow night. They all have been recommended by Housing Community Development Commission. Venderhoer/ Upfront there you were talking about 5% Community Home Funds can be allocated for operational expenses. What else could they be used for? Its basically single room occupancy, rooming house and it is something that we have been feeling needs to be done... Identified as a really big gap in our housing... for homeless people trying to get out of shelter... single men are the ones who have the most trouble finding shelter... They are not eligible for Section 8 assistance because we only provide it for elderly or persons with disabilities if they are single. And many of them don't have full time jobs... many of them do have jobs but they don't get paid enough either to pay for rent in a room in town.. averaging around $250 per month .... A lot of questions about how this was going to work. But in talking with Pat Jordan who is here from the EHP and then with Teresa and Lynn Detweiler who are interested in doing this. We have come up with pretty workable project. It is a nine bedroom home. We will use $125,000 of federal funds- Part of it is HOME, part CDBG to acquire the property and with that acquisition will come 15 years of below market rate and below fair market rate rents for five people in those nine rooms ...... We are estimating that the average rent will be for people coming out of shelters will be about $125 a month... As they make more money, it will go up .... That includes utilities. Kubby/ Rationale... first step... Why not do nine? .... Milkman/ We thought about that also. Two reasons for it. 1-I The idea that it is good to have people... role models... who are paying their way in the house also. And the other is a matter of dollars ..... Norton/ How do you recruit the other four? Milkman/ Like anybody else ..... Thornberry/ These are singles? Milkman/ Single rooms ..... persons living alone. Thornberry/ They have no children is what I am asking. Council/ (All talking). Kubby/ Do you anticipate any conflict?.. paying for rent .... WS011596 January 15, 1996 Council Work Session Page 14 Norton/ On the airplanes they do that all the time. Milkman/ Other thing .... there are strings attached to paying less rent. You have to have personal action plan .... agree to work with counseling. You have to agree to be trying to get yourself into one of those other rooms ..... Thornberry/ Are the other rooms going to be any different... nicer- ? Milkman/ No difference I don't think. council/ (All talking). Milkman/ Other issue... we do have to provide some support services .... You can't just give people housing and say bye .... The support service issue is a very important one and one which will be ongoing... they will be requiring support services. Kubby/ Milkman/ And Pat Jordan is spearheading a group of homeless providers and supportive service providers to try and work a program... extension of the early bird program CHANGE TAPE TO REEL 96-7 SIDE 1 Milkman/ Until people are self sufficient and independent and they are looking for sources of funding. Come July 1 we have got to find other sources ..... That is going to be difficult because there is very little money there. For now ... we do have $2,000 that can be put into that and we will be still below our cap .... In CDBG Program there is a cap on how much money you can spend for public services, support services .... that is a 15% cap for the CDBG Program, not the HOME Program. Basically this project, then, is for $125,000 of which $85,000 are in HOME funds and $40,000 are CDBG plus an additional $2,000 CDBG. Nov/ Marianne, does that constitute the entire purchase price .... Milkman/ They will have a small mortgage in addition which will be- they are going to rehab it themselves. It does need quite a few repairs on it ..... They will have a $30,000 mortgage ..... They will have some debt that they have to pay off. WS011596 January 15, 1996 Council Work Session Page 15 do ..... see the need for it... This property is going to be put away for their retirement .... At that point everything will be paid off .... income property for them .... Next one. Okay. Next we are at that $40,000 that needs to be allocated to a Community Development Housing Organization and both HACAP and the Fellowship were asked to submit proposals for that. HACAP did not submit a proposal but GICHF did. The copy you have ..... They have accepted purchase offers on two units. One is a condo on Benton Street ... four bedroom house on over Street. Kubby/ Appreciated that they are both north of Highway 6. Milkman/ I think that is terrific .... Acquired both of these for total cost of $143,000 approximately of which $40,000 will be the subsidy from HOME funds. Rest will be conventional financing ..... Since the units are there, good shape, ready to move into. Something that can happen fast .... Kubby/ Milkman/ Usually they are kept in house .... So those will have- no other source of funding aside from that HOME fund. We have the household that live at them... fair market rent... will probably need to have Section 8 certificates or vouchers until the mortgage is paid off ..... GICHF... goal.. provide additional affordable rental housing .... very low income people... Once that debt is retired on the units, they can't own them forever .... They be rental housing affordable to very low income... At the point the debt is paid off the rents will drop and will just basically cover operating expenses ..... At that point they will not need additional Section 8 housing assistance. Thornberry/ While they are living... is there someone who goes out and inspects these houses to make sure they are being kept up? Is there an inspection process .... ? Milkman/ ...They would require rental permits... inspected by the city... Also the Fellowship manages the properties. Thornberry/ ..... Kubby/ Neighbors probably won't even know. WS011596 January 15, 1996 Council Work Session Page 16 Kubby/ Isn't it true, if there is a change in tenant and the new tenant is on Section 8, that it is inspected on some regular basis through the Section 8 Program? Milkman/ Yes, annually. Kubby/ Milkman/ .... There are quarterly inspections of the properties. The final one is operational funding. This is only Community Housing Development Organizations are eligible for it. Both HACAP and GICHF applied for it. We have not funded operational expenses before for either of them .... It is not surprising that they both have trouble ..... uncertainty of what will ever get funded. Both applied for fundin9. The GICHF request was for $39,500 .... half of their operating budget for next year ..... big short fall... additional administrative .... that is now over. Those monies aren't there... Had staffing through VISTA volunteers and those are no longer there. That is their request. HACAP has a different problem .... The lot rent that they requested for the two new units they have in the mobile home park is not an eligible operating expense. That was part of their $23,000 request. Only the $18,171 are eligible for operations funding... this case is to do with the acquisition of the Broadway Street Apartments, the Public Housing ..... Anticipated it was always understood that any Public Housing tenants who were in there would remain in there until they wanted to move. Basically it would become the second phase of their Transitional Housing Program ..... Because of fire... people have chosen to move out... four apartments .... are occupied right now. That means that there will be a large number of families moving in and they will not all have already been through the first phase of Transitional Housing Program .... They will be starting out... homeless or near homeless folks. So there is a need for more staffing .... That is the reason for HACAP's request... Laura Higgin, HACAP, is here also and can answer questions. The Community Development Commission .... has recommended allocating $35,000 to GICHF and $10,000 to HACAP of the total $45,000 that is available for operational funding. We have put in a staff recommendation... different... $30,000 for GICHF and $15,000 for HACAP and the reasons are 1- that I think it is really vital that the services be there for families moving into Broadway Street and 2- I don't' think it is appropriate to make up almost the total shortfall of half of operational funding for the Fellowship from the federal funds ...... (Presents drawing). Neighborhood has already seen this drawing ..... A quick overview ..... Mormon Trek, 218, Ty N Cae Neighborhood, Mormon Trek Village ..... (Refers to drawing). What is outline in yellow is the tributary area to this sewer. The existing sewer that is out there is not sized to serve the tributary area .... to carry the flows that are east of interstate... What this project is is a proactive attempt to enlarge that sewer before we have people getting sewage in their basement. A couple other driving forces here .... The sewer we need to connect here is the Southwest Interceptor... makes sense to put that in before the park is developed ..... And the other need we need to get through Mormon Trek Village ..... What we have developed here are primarily two routes (refers to drawing). The creek route and the street route. The creek route has advantages of being less expensive to construct and nobody's access is denied during construction. Primary drawback... not very palpable to the folks whose backyards that goes through ..... change the character back there... easement restrictions ..... Thornberry/ What can they plant back there? Fosse/ Bushes, shrubs, gardens ..... Lehman/ Fosse/ We have to get under these three gas pipelines and the pipelines dip down and get under the creek .... Street route costs about $150,000 more .... going to look a lot like it did before... Third option that we looked at is an abbreviated version of this project. It would commit us to the north route... but it would come up to just past that (refers to map). Be able to get the done for about $200,000 to $250,000. Part of that would also include paying for oversizing the sewer that will be constructed through here. The disadvantages to that abbreviated project is that sooner or later there is going to be some problems along here .... Should be set for quite some time... keep an eye on it .... Kubby/ Say this intensity of development can only happen when we improve that sewer so it can handle it. Fosse/ That will allow us to get some more life out of the street... before it is removed .... And by simply oversizing this sewer without replacing it downstream you can't pick up any of that additional depth ...... Fosse/ Full impact of that, I have not been through all of it .... One thing I can do tonight is check that out further if you give me some direction .... Franklin/ West of 218 we have looked at in later stages of development just because of the sewer situation .... occurring more coincidence with Southwest Interceptor improvements. This is a very localized issue ..... It is really a small area that this trunk sewer would serve. There is no imperative in terms of the Comp Plan now to extend that sewer beyond 218 ....
