(1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
MARCH 2, 2004, ON PLANS, SPECIFICATIONS, FORM OF
CONTRACT AND ESTIMATE OF COST FOR THE CONSTRUCTION
OF THE 2004 ASPHALT RESURFACING PROJECT, DIRECTING THE
CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND
DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE
FOR PUBLIC INSPECTION.
Comment: This project includes asphalt resurfacing on Morningside
Drive and Rochester Avenue. Also included in this project is asphalt
resurfacing work in Oakland Park Cemetery and various parking lots
located in City Park.
(2) CONSIDER A RESOLUTION AUTHORIZING MAILING AND
PUBLICATION OF NOTICE OF INTENT TO COMMENCE A PUBLIC
IMPROVEMENT PROJECT TO CONSTRUCT THE SOUTH GILBERT
STREET IMPROVEMENTS PROJECT - NAPOLEON LANE TO CITY
LIMITS AND TO ACQUIRE PROPERTY FOR THE PROJECT; AND
SETTING DATE OF PUBLIC HEARING FOR APRIL 6, 2004.
Comment: The City of Iowa City must acquire right-of-way, fee title,
permanent easements and temporary construction easements to
construct the South Gilbert Street Improvements Project - Napoleon
Lane to City limits. State law requires the City to give notice to
agricultural property owners whose properties may be affected. This
notice will notify all potentially affected property owners of the
opportunity to present their views on the project and proposed
acquisition of property rights at the public hearing. This notice protects
the City's right to condemn if necessary. This project includes grading,
paving, storm sewer, water main, and related construction of South
Gilbert Street from Napoleon Lane to City limits. This is a joint project
with Johnson County.

2004, ON THE CITY OF IOWA CITY FY2005 IOWA DEPARTMENT OF
TRANSPORTATION CONSOLIDATED TRANSIT FUNDING
APPLICATION AND AUTHORIZING THE PUBLICATION OF A
NOTICE OF SAID HEARING.
Comment: In March, JCCOG will be completing Iowa City Transit's
FY2005 Iowa Department of Transportation Consolidated Transit
Funding Application. This application will contain FY2005 State Transit
Assistance formula operating funds and a listing of projects programmed
for Federal Transit Administration Section 5307 and/or 5309 operating
and capital projects. A public hearing on the application is required by
law, with a notice of the hearing published in advance. The grant
application will be available for public review prior to the public hearing.

Comment: This project has been completed in substantial accordance

(5) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST TO A SUBORDINATION
AGREEMENT BETVVEEN THE CITY OF IOWA CITY AND HILLS
BANK AND TRUST COMPANY, IOWA CITY, IOWA FOR PROPERTY

Comment: Hills Bank and Trust Company, Iowa City, Iowa has
requested that the City approve a Subordination Agreement for 716
North Dubuque Street to refinance a mortgage. On December 10, 2003,
the owner of the property received a loan from the City of Iowa City's
HOME Investment Partnership Funds for $187,500 and City General
Funds for $61,832. The assessed value of the property provides enough
equity to cover the City's lien position.

a. AMENDING THE ZONING CODE REGARDING REQUIREMENTS FOR
RELIGIOUS INSTITUTIONS IN THE COMMERCIAL OFFICE (CO-1) ZONE.
Comment: At its January 15 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of an amendment to the zoning cede to
remove specific lot size and setback requirements for religious institutions in the
Commercial Office (CO-1) zone. With this amendment, the dimensional
requirements for religious institutions will be the same as other uses permitted in
the CO-1 zone, and establishing a religious institution in the CO-1 zone would
require special exception approval by the Board of Adjustment. Staff
recommended approval in a memorandum dated January 9, 2003. This
amendment was requested by "The Church of Iowa City".

WAY LOCATED ADJACENT TO 425 BELDON AVENUE. (VAC03-00004)
(SECOND CONSIDERATION)
Comment: At its December 18 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of this vacation subject to the conveying of
44-square feet of property for use as right-of-way at the intersection of Beldon
Avenue and Grove Street. Staff recommended approval in a report dated
December 18. This vacation will allow the City to trade unneeded right-of-way for
property that is needed for street paving at the intersection of Beldon Avenue and
Grove Street.

Comment: At its December 4 meeting, by a vote of 6-0 (Chait absent), the
Planning and Zoning Commission recommended approval of the proposed
rezoning subject to Army Corps of Engineers approval of a wetland
compensatory mitigation plan. Staff recommended approval in a report dated
December 4. Approval would allow for the implementation of a wetland
compensatory mitigation plan, and the consideration of J JR Davis Addition an
eight-lot commercial subdivision. If Army Corps of Engineers approval of the
wetland compensatory mitigation plan associated with this property is not received
by the time this item is considered, staff will recommend deferral to the Council's
March 2 meeting.

4. Approval would allow for an eight-lot commercial subdivision west of Mormon
Trek Boulevard and south of Highway 1. If Army Corps of Engineers approval of
the wetland compensatory mitigation plan associated with this property is not
received by the time this item is considered, staff will recommend deferral to the
Council's March 2 meeting.

SANDHILL ESTATES, IOWA CITY, IOWA (SUB03-00028)
Comment: At its November 20, 2003 meeting, by a vote of 6-0 (Shannon
absent), the Planning and Zoning Commission recommended approval of the
Sandhill Estates preliminary plat. Staff' recommended approval in a report dated
November 12, 2003. The proposed preliminary plat of Sandhill Estates is a
146.48 acre, 379-1ot residential subdivision located east of Gilbert Street, south
of Pepperwood Addition.

ITEM 8. CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 1927 GRANTWOOD
STREET TO A PUBLIC HOUSING PROGRAM TENANT.
Comment: The Iowa City Housing Authority, under its Tenant-to-Ownership Program,
proposes to sell 1927 Grantwood Street to a public housing program tenant. The amount
of the sale will be the appraised value of the home, which is $122,000. The family
consists of a single parent and her son and nephew, as well as two foster children. The
parent has been employed full-time since 1998 and the family has participated in the
public housing program since 1999. The family has received a written commitment for a
mortgage from a local bank in the amount of $97,600. The City will provide a second
mortgage for the remaining $24,400. This sale will provide the opportunity for a Iow-
income family to obtain ownership of their own home.

ITEM 9. CONVEYANCE OF THE WEST ONE-HALF OF A TWENTY FOOT WIDE BY EIGHTY
FOOT LONG VACATED PORTION OF THE ALLEY LOCATED BETWEEN LOTS 4
AND 5, BLOCK 15, COUNTY SEAT ADDITION, ADJACENT TO 729 SOUTH CAPITOL
STREET, TO EAGLE VIEW PROPERTIES, LLC.
Comment: This alley was vacated in 1965, but has never been conveyed. Richard
Strauss, on behalf of adjacent property owner Eagle View Properties LLC, has offered to
purchase the west half of it for $800.00 ($1 per square foot). The City needs to retain a
utility easement over the alley property. Based on the retention of an easement,
adjacent right-of-way having been recently been appraised at $1.50 per square foot, and
the fact that the Strausses have paid real estate taxes on this portion of the alley since
approximately 1995, Staff feels the $800 offer is adequate consideration. This Resolution
authorizes conveyance of the above property to Eagle View Properties, LLC subject to a
utility easement.

MARKET, TO PROVIDE FOR THE NONCOMMERCIAL PLACEMENT OF OBJECTS
IN CITY PLAZA ON A TEMPORARY BASIS, TO MODIFY THE PROVISION ON
RESIDENTIAL PICKETING, TO CLARIFY THE CURRENT PROVISIONS
REGULATING MOBILE VENDORS AND AMBULATORY VENDORS, TO CODIFY
SPECIFIC ADMINISTRATIVE RULES AFFECTING SAID VENDORS, AND TO MAKE

Comment: Staff is recommending amendments to various provisions governing the
private use of public property which include parades, "sidewalk days," Farmers Market,
and park facilities. The amendment also creates a uniform process by which the City
issues permits for a variety of private uses. A more detailed memorandum from staff
outlining these and other major changes was in the Council packet for the January 15
packet, and the January 29 packet contained a memo specifically addressing the First
Amendment as it relates to the proposed ordinance.

Comment: This resolution sets a public hearing on a revised proposed ordinance to
establish a stormwater utility and stormwater utility fee. Council should defer final
consideration of the next item to March 2.

Comment: A public hearing on this ordinance was held November 'i0, 2003. This
ordinance was deferred on November 24th and amended and given first consideration
on December 16% Item will be deferred until March 2 when a public hearing will be
held on an amended ordinance.

ITEM 13. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE
PARKING DIVISION OF THE PARKING AND TRANSIT DEPARTMENT BY ADDING
ONE HALF-TIME AND ONE THREE-QUARTER TIME CASHIER POSITIONS
Comment: The Parking Division has been using temporary employees to cover vacation
and sick leave usage by permanent cashiers. This resolution creates two part-time
positions that will cover these absences. This is necessary to comply with the revised
definition of temporary employees in the current Collective Bargaining Agreement.
Funding for these positions is currently authorized as temporary employees. This
funding will be transferred to permanent part-time employees.

ITEM 14. CONSIDER A RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY
c>~r-.~,\ LOCALLY KNOWN AS 925 WASHINGTON STREET, WHICH IS A PUBLIC
NUISANCE FOR THE PURPOSE OF ABATING THE NUISANCE.
Comment: The property at 925 Washington Street has been a nuisance for
approximately 15 years. It contains a single family dwelling, which has been vacant for
at least 5 years. The City has sent the owner numerous Notices of Violation for tail
grass and weeds, snow, junk, garbage and debris but these problems continue. There
is evidence that the house is used by vagrants and infested with vermin. The City cited
the owner for failing to register it as a vacant and abandoned building. Staff' believes
that the house can be saved if not allowed to deteriorate. The property has also
become a serious fire hazard because of debris and garbage in the interior and
because of the numerous unvented heating devices, propane tanks, and a jury-rigged
wood burning stove. Staff would like to acquire the property to abate the nuisance.

ITEM15. CONSIDER A RESOLUTION ADOPTING THE MELROSE AVENUE/GRAND
AVENUE TRAFFIC OPERATIONS STUDY FINAL REPORT
Comment: This repod has been prepared by a joint City-University-Melrose Avenue
Neighborhood Association committee at the City Council's request. It will be used as a
tool to guide decision-making on transpodation issues in the Melrose Avenue/Byington
Road/Grand Avenue area.

ITEM 16. CONSIDER A MOTION GRANTING A 60-DAY EXTENSION TO THE POLICE
CITIZENS REVIEW BOARD FOR THE FILING OF THE PUBLIC REPORT WITH THE
CI~ COUNCIL ON COMPLAINT ~03-13.

Comment: This certificate is executed and delivered in connection with the issuance by
the City of $7,305,000 General Obligation Bonds. The disclosure certificate is being
executed and delivered for the benefit of the holders and beneficial owners of the bonds
and in order to assist the participating underwriters in complying with the Securities
Exchange Commission (SEC) Rule 15c2-12(b)(5).
