AGENDA IOWA CITY CITY COUNCIL SPECIAL COUNCIL MEETING - JANUARY 23, 1996 6:30 P.M. COUNCIL CHAMBERS ITEM NO. 1 - CALL TO ORDER. ROLL CALL. ITEM NO. 2 - PLANNING AND ZONING MATTERS. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 6, ENTITLED "ZONING," ARTICLE N, ENTITLED "OFF-STREET PARKING AND LOADING," TO REFERENCE THE PARKING FACILITY IMPACT FEE ORDINANCE IN THE OFF-STREET PARKING REGULATIONS SECTION OF THE ZONING CHAPTER. (SECOND CONSIDERATION) Comment: At its November 16 meeting, the Planning and Zoning Commission, by a vote of 5-0, recommended approval of amendments to reference the Parking Facility Impact Fee Ordinance in the off-street parking regulations section of the Zoning Chapter. The Commission's recommendation is consistent with the staff recommendation contained in the staff memorandum dated November 16. No comments were received at the December 19 public hearing on this item. Act,on; CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 6, ENTITLED "ZONING," ARTICLE 5, ENTITLED "PERFORMANCE STAN- DARDS," SECTION 10B, CONCERNING THE LOCATION OF ABOVE- GROUND STORAGE TANKS. (PASS & ADOPT) Comment: At its November 2 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of the amendments concerning aboveground storage tanks. The Commission's recommen- dation is consistent with the staff recommendation contained in the staff memorandums dated November 2. No comments were received at the December 5 public bearing on this item. Agenda Iowa City City Council Special Council Meeting January 23, 1996 Page 2 ITEM NO. 3 - ITEM NO. 4 - CONSIDER AN ORDINANCE AMENDING THE ZONING CHAPTER TO CLARIFY THE DEFINITION OF TIME/TEMPERATURE SIGNS. (PASS & ADOPT) Comment: At its November 2 meeting, by a vote of 5-1, with Scott voting in the negative, the Planning and Zoning Commission recom- mended approval of the amendments specifying requirements for time/temperature signs. The Commission's recommendation is consis- tent with the staff recommendations, contained in the November 2 staff memorandum. At its November 10, 1995, meeting, the Design Review Committee, by a vote of 7-0, also recommended approval of the amendments. No comments were received at the December 5 public hearing on this item. Action: CONSIDER AN ORDINANCE AMENDING TITLE 3, CITY FINANCES TAXATION AND FEES, CHAPTER 4. SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES. (SECOND CONSIDERATION). Comment: The proposed ordinance increases rates for wastewater by 15% effective on bills issued on or after March 1, 1996. The rate increases as proposed will be applied as a flat increase across-the-board to all existing rate blocks and minimum charges. Action: CONSIDER AN ORDINANCE AMENDING TITLE 3, CITY FINANCES TAXATION AND FEES, CHAPTER 4, SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES, SECTION 3-4-3 POTABLE USE. (SECOND CONSIDER- ATION) Comment: The proposed ordinance increases rates for water by 30% effective on bills issued on or after March 1, 1996. The rate increases as proposed will be applied as a flat increase across-the-board to all existing rate blocks and minimum charges. (SECOND CONSIDERATION) Kubby/ Norton/ Novick/ Move second consideration. Second. Moved by Kubby, seconded by Norton. Any discussion? Thornberry/ Yes. Given that I voted "no" on this last time and there is no amendment to include low income housing people in the increased water rates, is there going to be? Woito/ Yes. Thornberry/ Woito/ Yes. Atkins/ Novick/ Before the third consideration? Yes. But it is not an amendment. It is therefore it takes only one reading. a resolution and Thornberry/ Then why can't we have the reading this evening? Norton/ Baker/ Novick/ Atkins/ Not ready yet. Cause we haven't got the resolution. We haven't received the resolution yet. I have the low income policy drafted. It's being scheduled, worked on the agenda today, being scheduled for the 29th for the work session. Resolution will be on the 30th so you have an opportunity to vote next Tuesday night. Thornberry/ I will vote on this tonight. To pass this and I'll be very, very, very upset and disappointed if it is not included. Atkins/ Dean... Kubby/ It's always been the plan even for the last year and a half that we have talked about this and since we've talked about this set of rate increases the plan has always been that the meeting the same meeting that this #4 Page 2 is passed and adopted that that resolution of low income policy would be adopted at the same meeting so that they would be implemented at the same time. We've always talked about it in those terms. Novick/ The effective date .... Thornberry/ You've always talked about it. opportunity. I haven't had the Kubby/ This group has talked about that scheduling. Norton/ Yea, yea. Lehman/ I appreciate you voting in the affirmative tonight and if it is not passed prior to the third reading I would have no problem with you or any of the rest of us voting "no" because we all have a commitment to that. Norton/ Yea, that's right. Kubby/ And with that reasoning we need to have the agenda organized such that we vote on the low income policy first and then the third reading. Atkins/ Yes. Please keep in mind we will present the low income policy, it's up to you to approve it or dis... Novick/ Right, and we have... Kubby/ Thank you much. Novick/ .... we have the authority to modify that proposal at the work session on the 29th you know if you are not completely satisfied. You can propose changes at that time. Thornberry/ Okay. Novick/ It will be in the packet Friday right? Atkins/ Yes. Novick/ Okay. Norton/ I wanted to add that I'm still uncomfortable with the full rationale behind our decision but I'm going along with this one on the logic that we have a chance to revisit it and certainly will be doing so in each of the succeeding years but I'm certainly not buying any long series of such rate increases without a more satisfactory #4 Page 3 rationale than I have seen so far. Agenda Iowa City City Council Special Council Meeting January 23, 1996 Page 3 ITEM NO. 5 - CONSIDER AN ORDINANCE AMENDING TITLE 14, ENTITLED UNIFIED DEVELOPMENT CODE, CHAPTER 3, CITY UTILITIES. (SECOND CONSIDER- ATION} Comment: The proposed ordinance changes the meter required section from a refundable fee to a non-refundable fee, adds language to the code that allows access to maters, shut off valves and stop boxes of account holders and allows discontinuance of service if access is not allowed. ITEM NO. 6 - CONSIDER AN ORDINANCE AMENDING THE MOTOR VEHICLES AND TRAFFIC CHAPTER TO CLARIFY THAT BICYCLES MAY BE LOCKED TO PARKING METERS WHICH ARE EQUIPPED WITH BICYCLE RACKS. (PASS & ADOPT) Comment: This past summer the city conducted a pilot program for bicycle racks attached to parking meters. The pilot program was successful and the use of parking meter bicycle racks is going to be expanded. The proposed ordinance amendment is recommended to make it clear that bicycles can be locked to parking meters equipped with a bicycle rack. ITEM NO. 7 - ADJOURNMENT.
