Staff: Atkins, Woito, Karr, Franklin, Davidson, Tapes: 96-16, all; 96-17, all; 96-18, all. Review Zoning ITEM ~Oo 6a. Matters 96-16 S1 Consider setting a public hearing for February 13 on an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article K, entitled "Environmental Regulations," Section 1, entitled "Sensitive Areas ordinance," Subsection I, entitled "Steep Slopes," to allow development activities under certain conditions on protected slopes that have been previously altered. Franklin/ To set a p.h. February 13 on an amendment to the Sensitive Areas Ordinance. This is something that came up in light of two projects .... Has to do with development of altered slopes. The Commission is still considering this item .... If no recommendation is made on Thursday, the p.h. will be set but then we will just defer it. Kubby/ I am kind of assuming... HyVee? Franklin/ No. There are two projects that brought it to our attention. One was HyVee but this doesn't apply to HyVee because of when they submitted their site plan. They were already in the pipe before the ordinance was adopted... the circumstances are similar. The project that precipitated it is the subject of the next item... p.h. on Sensitive Areas Development Plan and this is for a project on Linn Street that is being done by Kevin Kidwell.. apartment building on Linn Street .... Linn south of Harrison Hill Park ..... two older homes. That is an altered slope .... to allow development on .... east side of Dubuque Street ..... Should there be the same restrictions on altered slopes as there are natural slopes. The decision of the committee had been no... As we confronted these two projects .... going to mean either pushing that building very close to the street or diminishing it... trying to get a higher density of development .... Whole question came up of what we were reserving here .... You do nothing on 40% slope. It meant no intrusion into the slope plus a buffer We are sensitive to your direction... use this ordinance in a reasonable and flexible manner ..... If you have a 40% slope which is altered, you may bring in a plan which would come through P/Z and city council for a Sensitive Areas Development Plan and it would be reviewed .... whether it made any sense .... One of the key criteria would be the stability of the slope. Kubby/ Other things to look at... at there trees .... Franklin/ ...whether there are values to that altered slope that we would want to preserve .... I think the important thing... right now... if it is any slope 40% or greater, you can't touch it. With this is saying that with a 40% altered slope you might be able to touch it. You still have to go through the planned review process. Thornberry/ This should be on a case by case basis .... This is a guideline... Franklin/ It is a law. We have some flexibility... this is one where we don't have flexibility. The only avenue would be.. go to the Board of Adjustment to get an exemption from the ordinance. But then you have to show you can't make a reasonable use of the property. He could make a reasonable use of the property ..... But it is looking at it on a case by case basis with this particular amendment. Norton/ What are we going to see in the way of the amendment? Franklin/ This is just setting the p.h ..... It will be discussed at your work session .... 13th .... Kubby/ Let's say slope is a natural slope...erode ordinance because of the zoning? ...I get a little concern... because someone wants to use their land as intensely as possible that we start making amendments to it. Franklin/ I think if it were a natural slope, Karen, we would have never even considered this. Thornberry/ Franklin/ It has been written. It is before the P/Z Commission .... They have considered it at one meeting... You will see it two weeks from tomorrow night .... Norton/ Do we have a lot of altered slopes possibilities working? Those are altered slopes ..... For instance, the Law School area, where there is a pond and a cliff .... I think because of the value of that natural feature there, the pond and lime stone cliff, that it is unlikely that any commission or council is going to say yeah, blast it ..... you get to decide. ITEM NO. 6b. Consider setting a public hearing for February 13 on an ordinance amending the Zoning Chapter by approving a Sensitive Areas Development Plan for a 0.32 acre property located at 515 and 521 South Linn Street. Franklin/ Setting a p.h. for the 13th .... Sensitive Areas Development Plan... 515 and 521 South Linn Street. That is Kevin Kidwell's project. IT~( NO. 6e. Consider an ordinance amending the Zoning Chapter by changing the use regulations for a .5 acre property located at 840 Cross Park Avenue from CO- l, Commercial Office, to CC-2, Community Commercial. (first consideration) Franklin/ The next c., d., and e. pertain to rezonings which P/Z Commissioners are here, four of them (Starr, Supple, Jacobson, Bovbjerg) to discuss the two zoning issue with you that we discussed two week ago. The first one being Cross Park Drive and the rezoning requested there for Kids Stuff. Do you need to go over that? ..... Nov/ Is the Commission interested in sitting up here with the microphone? ..... Remember... walk to the microphone... George Starr/ We will just do it this way. Nov/ George .... Do you want to explain how the Commission arrived at the recommendation of denial. Starr/ ...Did have a majority ..... Nov/ Cross Park was 5/1 and the other was 6/0. Norton/ Let's talk Cross Park first. The Con%mission acknowledged that that is a pretty small buffer ..... appropriate buffer... between the residential and the commercial .... We had already taken a parcel out of that and rezoned it to more intensive commercial and they felt that it was just gradual creep... My impression of the decision ...felt buffer was appropriate. Lehman/ You have already got Econofoods directly across the street from the apartments.. no buffer whatsoever. starr/ We acknowledge it is a small buffer .... Lehman/ Appears to me that the request for rezoning is certainly consistent with the use that Econofoods has there. Starr/ ...if you want to look at it from residential standpoint in maintaining what small buffer is ].eft there ..... Kubby/ Gradual change instead of dramatic change. Lehman/ (Refers to map) .... Starr/ Commercial office .... Norton/ It made no difference to your consideration where they were going to put the building? ..... some talk about a parking lot facing Cross Park all together... Starr/ .... I think there were some problems with that .... Norton/ Way of getting additional parking .... Starr/ Was some problem with that... parking. Nov/ They were also talking about south side of building facing Cross Park, having the appearance of an apartment building because they put in an entrance to the second floor .... Starr/ We looked at it .... land use... trying to keep that as a buffer. Kubby/ You have a locally owned business... serving a lot of people who live in that area as well .... difficult. Thornberry/ .... You give the permission to the big guy and the little guy doesn't have the same clout perhaps. I think we have got to be fair... Norton/ Traffic on Cross Park is going to be a problem... several wrongs here .... transition should be behind properties, right? Kubby/ They said they have looked for several years in a place... They want to be in that area. Vanderhoef/ I have a couple of questions. 1-I what the surrounding property owners, objection that came to you? We didn't get would like to know if there was any any either. Starr/ I think it is all rental property. Vanderhoef/ Apartments to the south of the property were built after Econofoods was there and there was a mixed zoning situation already in the area. Other question I have .... the street that would be... Pepperwood. Someone told me... Pepperwood is it going to go clear over to Gilbert? ..... Franklin/ Southgate Avenue. Pepperwood Drive is a private street. The one that goes between K-Mart and ...... Iowa City Kids, that are there now .... That is a private street. That will not go anywhere other than where it is right now. Then it jogs down and Southgate Avenue will go from Keokuk eventually to Gilbert Street. Vanderhoef/ Nov/ If this is rezoned, can it be rezoned with no access to Cross Park so cars entering must come in from Pepperwood Drive? Franklin/ It could be. Nov/ Franklin/ You can put conditions on a rezoning. If your condition of the rezoning is that you are restricting access to Cross Park, they still have access on a private street. So it is not denying access to the property. Woito/ .... require that it be on a public street .... Franklin/ It is not access. No, you don't have to have frontage for commercial lot .... Woito/ Supple/ What Sarah Holecek was referring to when she said that you could not restrict access off of Cross Park because in order to do that you would have to tie that restriction to the other lot and you can't tie it to the other lot because nobody is asking for anything on the other lot and that is a separate lot. council/ (All talking). Woito/ The lot that would be restricted would be access onto Cross Park? Supple/ If you wanted to restrict access on Cross Park Road, you would have to tie that restriction to the lot that fronts on Pepperwood and you can't- Because it is two separate lots, you can't tie the restriction for this lot to this lot (refers to map). Woito/ Because it is not being rezoned. Franklin/ The lot on Cross Park-I have an overhead (refers to map). Council/ (All talking). Mace Braverman/ Believe it or not, I am not here for this. The access on Cross Park is near Broadway .... behind Best Buy. And there is an access point in there to get in back of by Best Buy. It is not where Econofoods parking is. Thornberry/ I believe there is an access some place between the corner of Broadway and Cross Park. Franklin/ What are we trying to get at here? We are talking about this lot being rezoned. I don't understand why it could not be. That is what we are rezoning is this (refers to map). Nov/ Can we restrict it in the site plan review? Franklin/ No, you would want to do it during the conditional zoning. Woito/ The area in the dark (refers to map) is being rezoned. Franklin/ That is right, from CO-1 to CC-2, that is the request .... Can we restrict access to Cross Park Avenue? Woito/ You can restrict it for only that part that is being rezoned. To that extent Sarah was correct. Franklin/ .... yes, Thornberry/ ..... access right Dean. Put your pointer...more there. (Refers to map). Franklin/ That is irrelevant ..... to the right. There is Nov/ I drove through the parking area .... couldn't get out to Cross Park. I had to turn around and go back. Norton/ I got stuck behind Econofoods and couldn't get out. Supple/ There was one...site plan they drew up for us that showed the building moved further south into the lot that is being rezoned .... having apartments above... Is there anyway that the restriction can be that there would be an entrance off of Cross Park that would service the apartment parking and entrance for the apartment back there .... business parking was all to the front of the building? Franklin/ I don't think you could enforce that. Supple/ Nov/ .... people could go through from Cross Park to Pepperwood ... trying to avoid. Franklin/ Even if there were a physical separation .... You could put that kind of provision in but I don't think we should kid ourselves that.. going to stop commercial use of parking .... Vanderhoef/ Concern... don't want access between Pepperwood Drive and Cross Park Road. Franklin/ If I could sum it up. It is not just a matter of access. It is a matter of overall intensity of use. That when you make a conversion from commercial office to a community commercial. The intensity of that community commercial zone and the uses that are allowed there is greater than the CO-1 and therefore you lose whatever transition that you had ..... Baker/ (Can't hear). Franklin/ Any kind of retail use where you have a lot of traffic that goes in and out all of the time as opposed to an office use where the frequency of trips generated is less .... Kubby/ So if council were inclined to say yes to the zoning change with the restriction on access, do we have to go back to do a CZA? .... p.h. again .... Franklin/ If you want to put some conditions on rezoning it to CC- 2? Yeah. Woito/ You don't necessarily have to put conditions on the rezoning Kubby/ What would be the other tool to restrict access? .... Woito/ You can lawfully do it but I am troubled by forcing a property owner to access a private street. I am very troubled by that. I don't think that is an appropriate- Council/ (All talking). Braverman/ Just a thought. Why don't you condition it on having to approve a PAD for both ..... planned area development .... ? Nov/ That was what I was trying to get to. Franklin/ We don't have planned developments for commercial .... still conditioning the zoning and you are conditioning it on approval of a site plan by the city council. Norton/ ... Their point about spot zoning and looking at exactly who is coming in... We are suppose to be kind of dealing with principles here and not dealing with the individual cases .... I haven't heard any arguments that are different .... to maintain that buffer .... Nov/ It is a symbolic buffer at this point ..... Thornberry/ I really really don't think we should not give them the CC-2 on that property. Locally owned business that is doing well, would like to do better, with CC-2 already in the same block. Lehman/ Dean, that isn't relevant that they are locally owned because you are changing the use of the property .... Thornberry/ It would be right next to a CC-2. Lehman/ I think Naomi .... symbolic ..... I think you can encourage folk to make it as limited as possible. Ann Bovbjerg/ As I understand it, when P/Z looked at it, there were a couple of things. I-As we could not put a CZA on that attached part conditioned upon putting parking on the other properties that wasn't part of the zoning. In fact we could not fezone this it is conditioned upon the use of adjacent property. 2-The use of the adjacent property was going to be the required parking... allowing that particular use, the only way you could use it was to have parking which would be on another lot which wasn't part of the zoning so they couldn't incorporate that into any conditions. That is what is frustrating about any kind of access or limiting or saying what shall happen on the next property .... We can't stipulate because it is not part of the rezoning. Woito/ Not a good situation... if you are trying to limit access ... fronts on private drive. Norton/ But there will be access off of Cross Park some day .... as CO-1 use ..... A matter of how much. Bovbjerg/ Franklin/ There is a difference between restricting access and having that be a condition of rezoning and restricting the use of a piece of property that is not being rezoned ..... Difference between putting a condition on a rezoning which restricts access... We cannot, however, put a condition which restricts use. If you want to restrict use, then you rezone it such that it is restricting. Nov/ I think we all understand. Franklin/ Where do we go with this? Kubby/ We have heard P/Z's rationale .... We need to persuade each other tomorrow night .... Franklin/ Tomorrow night you have first consideration on this item. The p.h. was closed. Okay. Should we go to the other then? Baker/ You can't restrict use. Can you force the business, uses of zoning to- But can you restrict site of use? the site, the building itself, the Franklin/ That comes into design, yes. Baker/ By conditional zoning, force the parking on the other side of the building .... In other words, if the building was restricted to no parking allowed in front of the building on Cross Park- Franklin/ Okay, remember you are zoning that one lot. So your conditions pertain to what is going to transpire on that lot. If you are concerned about access onto Cross Park Drive and you can justify that logically, you can then place restrictions on the design, the layout, the access. But I think what was being questioned was the logic of it if Econofoods has access to Cross Park Drive further on down the block. Baker/ If the intent is to diminish the use of Cross Park as access, you force the building-force the parking to the other side. You may have to allow access .... Baker/ Franklin/ Thornberry/ If it were CC-2, it might be better to have access to a city street as opposed to a private street. Question about if that were zoned CC-2, you are saying- If they were to buy both lots, would it then be one lot and one would revert to the other? Franklin/ No, the zoning will follow that boundary unless a decision is made to rezone it regardless of ownership. Thornberry/ P/Z's problem was ths south portion that would be rezoned .... Franklin/ The northern property is already zoned CC-2. Thornberry/ It was on its own as opposed to having it one whole lot. Franklin/ Nov/ Let's switch to the other one. Supple/ I heard a comment that I thought maybe needed some explanation. Mine was the sole vote in favor of rezoning and basically my rationale .... 60% of that street is already zoned CC-2 and I didn't see that this was really going to be harmful to anyone and could be helpful to someone. I have heard two things: 1-If you have a design and you approve that design that then you have some security there. But that doesn't necessarily mean that 20 years from now somebody won't tear down that building and put up something else. That really doesn't give you that security. The other thing is... Econofoods was not rezoned this way. Econofoods was zoned this way and there was suppose to be a buffer there and the street was suppose to be going in a different place. Then the street was put here (refers to map) ..... ITEM NO. 6c. WS012996 January 29,1996 Council Work Session Page 12 Franklin/ The other rezoning of the 4C's. item to discuss with the Commission is the .3 acre property on Sycamore and Deforest for Nov/ We just received the covenant. None of us have read it. I assume that you have read it, Karin .... Franklin/ I just got it this afternoon and I have only skimmed it. One thing... your decision about this really does not include the private covenants because we are not a party to those private covenants .... giving you some assurance that something has been worked out between the neighborhood and the applicant... The important documents for the city are the CZA which I understand we will have signed by the p.h. tomorrow night .... the details of private covenants are not really germane .... Kubby/ .... It is my understanding that in signing the covenant that that would automatically protract the protest. Do we know what those numbers are? Still 20%- Franklin/ No, I don't know that right now. I have to look at these names on here and what was on the protest to do the recalculation. Nov/ The protest... just requires six people to say yes. Franklin/ ...more protests, not that I am aware of. As of last Thursday, according to Bob Miklo reporting to the P/Z Commission... there were not sufficient signatures to require an extraordinary majority vote. Kubby/ Knowing that the neighbors signed it may still impact our decision. Franklin/ Sure, presumably that is why you continued the p.h. Nov/ I had a phone call... person who has the second bid on this. That person will be at the p.h. and present his side of it. Thornberry/ ..... if the first offer is the first thing that was requested, is it workable or not regardless of how many other offers. Consider an ordinance amending the Zoning Chapter by changing the use regulations of an approximate .3 acre property located at 1500 Sycamore Street from RS-5, Low Density Single-Family Residential, to CO-I, Office Commercial. (First Consideration) ITEM NO. 6f. Consider an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article D, entitled "Residential Zones," Section 5, entitled "Neighborhood Conservation Residential Zone (RNC-12)," to clarify the number of roomers permitted in duplex units in the RNC-12 zone. (First Consideration) Franklin/ First consideration... clarify the number of roomers in RNC-12 zone. CHANGE TAPE TO REEL 96-16 SIDE 2 ITEM NOo Consider an ordinance amending Title 14, Chapter 6, entitled "Zoning," to allow recycling processing facilities in the I-l, General Industrial, zone and related amendments. (Second Consideration) Franklin/ Second consideration to allow recycling processing facilities in I-1. What we would like you to do with this is, item g ..... There is an amendment coming through that deals with the issues that John Ockenfels raised when he saw this and it has to do with outside storage. They are significant enough that we thought is should go back through P/Z. Basically... allow outside storage of processed recycled materials as a special exception. So there will be that review process ..... litter is the biggest issue with recyclables. Lehman/ Karin, are you comfortable to the changes that were made to accommodate City Carton? Franklin/ Yes ..... Kubby/ ..... talking about making specific changes to the Zoning Code to accommodate a specific business .... We do do this .... We have to look at each specific case... Nov/ I have a technical question. If we approve this, does City Carton become immediately in violation of the zoning? Franklin/ No, they are non-conforming now to a large extent. They would become more non-conforming. We have this tract such that- What John was concerned about was that if he wanted to change anything in future years... likely they are going to want to do some expansion... Norton/ Franklin/ The amendment is about outside storage ..... discussion with John, yes .... He would have a lot of difficulty putting all of those material inside and that is what this ordinance requires is that you storage ins inside .... Nov/ And he would like to be able to store outside and this would require a special exception of fence or something? Franklin/ Both.. special exception process... shown that is will be litter free...materials contained .... number of provisions... including screening. Whole thing came up due to Iowa City Transfer .... It came to out attention...we did not have anything in the Zoning Ordinance which permitted recycling facilities .... This is something .... Franklin/ It is important for a land transaction that is taking place. Thornberry/ ..City Carton .... more non-conforming... What are the ramifications to them? Kubby/ If they have a fire, they can't rebuild. Franklin/ Main things have to do with screening and pick up where you drop your stuff .... they are not major .... very minimal. The outside storage of processed recyclables will be an issue for them... a practice .... Nov/ If they had a fire... they could probably come up with more efficient design .... Franklin/ We should move on. ITEM I~O. 6h. Consider an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article N, entitled "Off-Street Parking and Loading," to reference the Parking Facility Impact Fee Ordinance in the off-street parking regulations section of the Zoning Chapter. (Pass and Adopt) Nov/ Any questions on item h., off street parking and loading? Hearing none- Kubby/ I have one other question for Karin. Kind of a development thing. Jeff Davidson- Jeff Davidson/ Many of you recall that last spring there was a relatively controversial issue at the JCCOG level which resulted in an amendment being made to the Arterial Street Plan of the Iowa City urbanized area .... that added the extension of Highway #965 between Highway 6 and Highway 1 and the extension of Camp Cardinal Road between Highway 6 and Melrose Avenue through the Arterial Street Plan. That having been done, the next logical step was to actually plan where the extension of Highway 965 ..... would go and that is the step that we are at now. The entire corridor (refers to map) ..... western alignment and an eastern alignment ..... The entire corridor is about 4 1/2 miles long. We hired a consulting firm to assist us with this project .... We did hire the same firm that helped us with the Sensitive Areas Inventory Map .... What we are doing here is trying to plan for where this road, if built, will go. We are not here tonight to talk about actually building it .... only where it would go... The decisions to actually build portions of it will be up to the Coralville city council, Iowa City city council .... and Johnson County Board of Supervisors will have a role ..... All three municipal entities are important players on this. What we are planning is an urban arterial street ..... Probably in a relatively short term ...... storm sewers... sidewalks... similar to Scott Blvd .... It would be according to our accepted standards for a normal arterial. It would be initially constructed at two lanes... enough right away to go to four lanes if necessary .... There are currently no plans to build any of this except for this intersection (refers to map). Coralville, in conjunction with the mall project, does need to rebuild that, probably this summer ..... That will be reconstructed to be safer and more understandable for people traveling through there. They want to make sure what they do here is consistent with what the corridor will be. In conjunction with the mall.. interest... developing that property .... We have tried to, some of the larger property owners, get with them and try and understand what their redevelopment plans may be as we are conducting the study. We have notified all of the property owners in the study corridor (refers to map) ..... very interesting in seeing this project happen to just sort of wanting more information .... 22 letters that we sent out at the end .... If we take existing development growth patterns into consideration, it is reasonable to expect... could take 20-30 years .... We started with 36 alternative alignments in the study .... listed factors evaluated .... to come up with these two. Impacts are very similar for these two .... I have already met with the Board of Supervisors regarding this matter last week. Their attitude... ambivalent. There is some impact to the County Shop ... with the easterly alignment .... There would be a small amount of r.o.w. from the County Home property with the east alignment ... They did not take any official action because they wanted to hear the results of your discussion... I am going tomorrow to Coralville to talk about the same subject. They did seem to acknowledge there is a need to plan for this road... didn't express any opposition to entering in any agreement .... Kubby/ The agreement.. would include not passing certain kinds of development so that it would interfere with the alignment? Davidson/ Yes. Protecting the corridor is the important thing here. ..... Davidson/ I really think- One of the reasons that we are bringing this issue of two alignments to the elected officials is at this point we feel like we have relatively similar impacts of either of these two alignments .... The second thing...most of you know I have a joint position with the city and my boss had to leave to go to another meeting. I need to switch hats real quick and go from JCCOG to Assistant Director of Planning Department to give you some of Karin's concerns about the east alignment. I will tell you... I have had several discussions with individual council members and city staff of Coralville and I think it is fair to say Coralville is coming down in favor of west alignment and Karin is aware of that... doesn't want to indicate to you the west alignment is unreasonable .... But she does have a couple of concerns that she does want me to raise with you about the west alternative versus the east alternative. She put together this diagram that shows, adopted bay the city council, the long range .... growth area boundary.. predicated on sewer service area that being probably the most important infrastructure the city supplies for development to occur (refers to map). WS012996 January 29,1996 Council Work Session Page 22 long range growth area and that is something you all should be aware of when you make your decision on which one you are going to favor. To serve this area (refers to map) with municipal sanitary sewer will require a series of lift stations or a lift station .... to where it can flow by gravity into the city's sewer system. So that is a consideration. The east alignment could clearly provide access to that area beyond the growth boundary, it probably doesn't to the extent of the west alignment .... Important point .... west alignment to a much greater degree. There are concerns .... then where is your boundary. Right now we have a boundary because it is predicated on the sewer service area. If a decision is made to go beyond that, how far beyond that? So that is a question that you will be faced with if the west alignment is selected. Kubby/ Let's say we select the west alignment. It doesn't mean we move our growth area. It means that road is in the county .... Davidson/ Good point.. .adopting the west alignment and knowing that is where the road is going to go, doesn't mean you have to provide any municipal services beyond your growth area. However, realistically it is going to create pressure to do so ..... Nov/ And to build this street without the sanitary sewer line underneath it doesn't seem to make a great deal of sense? Davidson/ Another issue, you are extending the sanitary sewer line out to the landfill ..... is already municipal sanitary sewer being provided .... The city has extended... It has not been sized.. to accommodate. Kubby/ It is outside out growth area. Davidson/ .... Couple of other points. Right now it is plain that the city's long range growth emphasis is in the east and in the south ..... To adopt a new growth area boundary in the west is a very important policy move for the city... it probably creates pressure for you to extend municipal services to that area. We are already feeling a little bit of that ..... We are already getting in this area some pressure .... Baker/ When you say we are going to create pressure .... political pressure? Or legal obligation? Davidson/ Political pressure. Woito/ It is common knowledge what happened with Scott Blvd. Davidson/ Many of you will recall we extended a major trunk line sewer up in this are ...... S.E. Interceptor .... That is something that we plan to do now... may accelerate... One final thing... This dark are you see (refers to map) have all been factored into the decision making on sizing of the sewer plan improvements... The capacity of the new plant and the connecting of the two plants have all been predicated on this growth area boundary. Norton/ S.W. Interceptor sewer there is demand for already... Davidson/ My understanding we are dealing with some of that now with trunk line improvements in various areas .... Eventually that is all going to catch up with us .... Those are some land use and planning issues that Karin wanted me to get out for you to consider ..... Kubby/ Let's look at 100 years... How far does the next westerly watershed go? ..... How far out does that go? Davidson/ (Refers to map). This area you get into the Old Man Creek watershed .... goes all the way to Frytown .... I think a good .... it took us 30 years to build out between First Avenue and Scott Blvd in Iowa City. That is about a mile ..... It is pretty much fully developed now ..... If you keep that existing rate of growth, 30 years to fill in a mile ..... One final thing .... Karen, you asked about Coralville... They have not taken any official action but I think at least informally are thinking about the west alignment here. If you note this growth area boundary, there is a lot more of this Stretch of the road. That is a consideration. Clearly this bridge (refers to map) on the west alignment, Coralville would see them having a role in the financing of that. Important factor with Coralville coming down on the west alignment versus the east. Nov/ Jeff, do you know if any of that west alignment south of the orange line is sewerable by Coralville? Davidson/ In this area, no, that is why the line is right here. Somewhere in here (refers to map) is the ridge between the Willow Creek watershed and the Old Man's Creek watershed. (Refers to map). Kubby/ Having financial responsibility for the bridge makes Coralville want the west? Davidson/ I think it would be fair to say... they are perhaps a little more aggressive about development in the area. Kubby/ Oh, so it would happen sooner .... Davidson/ .... They see themselves have a role in that... Another issue.. is this portion of the road is the state highway... that the state is doing everything that they possible can to turn the jurisdiction over to us locally .... They fell this is more of a local service road now .... Realistically it is .... There are funds that the federal government makes available for major bridge projects ..... Kubby/ ...Looking at southern portion below Rohret Road... hilly area .... have it not be so straight... curve to the east.. then west to avoid... See if we had any extra land down here to sell them. They have made an offer of $2250 .... pay all cost, all legal fees, all the work with regard to do this. In that agreement we would say they would promise to higher only employees with high skill standards and there would be no strike clause .... promise to work as quickly and efficiently as possible .... I think the union people ...if it is drafted very carefully we might avoid a legal challenge on the performance labor agreement... avoid the David Bacon wage requirements which would avoid that Iowa Supreme Court case and avoid you have to hire union laborers. Norton/ Why should we avoid that requirement?
