CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
APRIL 7 ON AN ORDINANCE VACATING A PORTION OF
FORMER BENTON STREET BETWEEN RIVERSIDE DRIVE AND
THE IOWA RIVER WHICH IS ADJACENT TO LINDER TIRE
SERVICE.
Comment: A portion of the Iowa River Corridor Trail has been
designed along the Iowa River on property where Linder Tire
Service is located. The City previously vacated .13 acres of the
former Benton Street right-of-way and passed a resolution
authorizing conveyance of this property to the Linders in
exchange for the Linders conveying to the City an approximately
equal amount of property along the Iowa River for the trail.
However, the Linders have now indicated they need an
additional .01 acres of the former right-of-way before they will
convey the property the City needs for the trail. This additional
.01 acres is not needed by the City. This hearing complies with
the state law requirement of a public'hearing prior to enacting a
vacation ordinance.

CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
APRIL 7 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT,
AND ESTIMATE OF COST FOR CONSTRUCTION OF THE
SOUTHGATE AVENUE AND WATERFRONT DRIVE PAVING
IMPROVEMENT AND WEST PEPPERWOOD RELIEF SEWER
PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF
SAID HEARING, AND DIRECTING THE CITY ENGINEER TO
PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: This project includes PCC paving, storm sewer,
sanitary sewer, water main, and earthwork. Waterfront Drive
will be improved south of Hy-Vee to the Hilltop Mobile Home
Park. Southgate will be extended from Waterfront Drive to
South Gilbert Street. The estimated construction cost is
$845,000 and will be funded by Road Use Taxes.

Comment: This project includes a 2.4 mile PCC and/or ACC
trail, retaining walls, pedestrian bridges, and storm sewer. This
trail is a part of the regional trail system. The estimated
construction cost is $1,800,000 and will be funded by Federal
STP funds ($750,000), General Obligation, and local Road Use
Taxes ($1,050,000).
CONSIDER A RESOLUTION SETTING A PUBLIC HEARING
FOR APRIL 7 ON PLANS, SPECIFICATIONS, FORM OF
CONTRACT, AND ESTIMATE OF COST FOR THE
CONSTRUCTION OF COURT STREET EXTENDED, PHASE I,
IMPROVEMENTS, DIRECTING CITY CLERK TO PUBLISH NOTICE
OF SAID HEARING, AND DIRECTING CITY ENGINEER TO PLACE
SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Comment: Phase I of Court Street Extended consists of paving
improvements from its present east terminus to the west line of
Windsor Ridge Subdivision, a length of approximately 1,720
feet. The total estimated construction cost is $571,405 and will
be funded by General Obligation Bonds and Road Use Tax Funds.
CONSIDER A RESOLUTION OF INTENT TO CONVEY 1417 PINE
STREET, ALSO DESCRIBED AS LOT 45, BLOCK 3, SECOND
HIGHLAND DEVELOPMENT ADDITION, TO THE TENANT
AND SETTING A PUBLIC HEARING FOR APRIL 7.
Comment: The Iowa City Housing Authority, under its Tenant-
to-Ownership Program, proposes to sell 1417 Pine Street to the
present tenant. This family has leased 1417 Pine Street from
the Iowa City Housing Authority since September 1995. The
appraised value of the home is $79,000. The family has
received a letter of commitment for a real estate loan from Iowa
State Bank for $50,000. The City will carry a second mortgage
in the amount of $29,000. This sale will provide the opportunity
for a low-income family to obtain ownership of their own home.

Comment: This certificate is executed and delivered in
connection with the issuance by the City of Iowa City of
$8,500,000 General Obligation Bonds. The disclosure certificate
is being executed and delivered for the benefit of the holders and
beneficial owners of the bonds and in order to assist the
participating underwriters in complying with the Securities
Exchange Commission (SEC) Rule 15c2-12(b)(5).

Comment: This certificate is executed and delivered in

in detail, a number of facts, promises and obligations that must
be met and agreed to by the City in order to maintain these
Bonds as tax exempt.

CONSIDER A RESOLUTION AUTHORIZING THE ACQUISITION OF
PROPERTY FOR THE CONSTRUClTON OF THE IOWA RIVER
CORRIDOR TRAIL - BURLINGTON STREET TO NAPOLEON PARK
PROJECT.
Comment: On July 15, 1997, the City Council passed Resolution
No. 97-242, authorizing the acquisition of permanent and
temporary construction easements for the Iowa River Corridor
Trail Project. A couple of property owners, however, would prefer
that the City acquire the property necessary for the trail from
them in fee simple rather than by permanent easement. The
change in the type of acquisition will only minimally affect the
purchase price, if at all.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO
SIGN AND THE CITY CLERK TO ATTEST A SUBORDINATION
AGREEMENT BETWEEN THE CITY OF IOWA CITY AND HILLS
BANK AND TRUST COMPANY, HILLS, IOWA FOR PROPERTY
LOCATED AT 1531 PLUM STREET, IOWA CITY, IOWA.
Comment: Hills Bank and Trust Company, Hills, Iowa, has
requested that the City approve a Subordination Agreement for
1531 Plum Street. On July 9, 1993, and on September 16,
1994, the owner of the property received loans in the form of
two Rehabilitation Agreements, two Promissory Notes, and two
Mortgages for a total of $19,180 through the City's Housing
Rehabilitation Program. Hills Bank and Trust Company is about
to refinance a new first mortgage to the property owner for the
amount of $63,375. The property is assessed at $84,500
which provides enough equity to cover the City's second lien
position, of which was the City's original position.
CONSIDER A RESOLUTION AUTHORIZING THE MAYOR
TO SIGN AND THE CITY CLERK TO ATTEST A

Comment: The University of Iowa Community Credit Union,
Iowa City, Iowa, has requested that the City approve a
Subordination Agreement for 811 Hudson Street. On October 7,
1987, the owner of the property received a $2,500 Promissory
Note through the City's Housing Rehabilitation Program. The
University of Iowa Community Credit Union has refinanced a
new first mortgage to the property owner for the amount of
$45,000. The property is assessed at $70,000 which provides
enough equity to cover the City's second lien position, of which
was the City's original position.

IA022CE0026 is replacing IA022CE0024 which expired 10-31-
97. The Voucher Project Number IA022V00020 is replacing

Consider a motion setting a public hearing for April 7 on an ordinance
conditionally changing the zoning designation on a 10-acre tract
located on the south side of Melrose Avenue and west of West High
School from Low Density Single-Family (RS-5) to Planned
Development Housing (OPDH-8) to permit an 80 dwelling unit
retirement community. (REZ98-0002)
Comment: At its March 5 meeting, by a vote of 6-0, the Planning and
Zoning Commission recommended approval of the requested rezoning
subject to agreements and easements for the provision of sanitary
sewer service and compliance with building and site design plans.
Staff recommended approval subject to conditions in a February 27
memorandum to the Commission.

b. Public hearing on an ordinance conditionally changing the zoning
designation on a 4.46-acre tract located at 500 Foster Road from
Interim Development Single-Family Residential {IDRS) to Sensitive
Areas Overlay-8 (OSA-8) to permit 35 dwelling units and approving a
preliminary Sensitive Areas Development Plan. (REZ97-0011)
Comment: At its March 5 meeting, by a vote of 4-2, the Planning and
Zoning Commission, by a vote of 4-2, recommended denial of the
requested rezoning due primarily to concerns with the scale of a
proposed multi-family building on the site. Staff recommended
approval of the requested rezoning subject to conditions in a
memorandum dated February 26. The applicant has revised the
Sensitive Areas Development Plan and has requested reconsideration
from the Commission at their April 2 meeting. At its March 19
meeting, the Planning and Zoning Commission agreed to reconsider
this item at a reduced density. Staff recommends continuing the
public hearing to Council's April 7 meeting. ~~

Low Density Multi-Family Residential (RM-12) for 11.9 acres.

Comment: At its February 19 meeting, by a vote of 6-0, the Planning
and Zoning Commission recommended approval of the requested
rezoning subject to a conditional zoning agreement outlining the
applicant's obligations regarding the extension of Court Street and
requiring approval of a future OPDH application for each parcel prior to
development of the property, to be prepared and reviewed in
accordance with the neighborhood design concepts contained in the
Comprehensive Plan. Staff recommended approval subject to
conditions in a February 13 memorandum to the Commission.

Public hearing on an ordinance changing the zoning designation on
approximately 24.12 acres from Interim Development (ID-RS) to
Sensitive Areas Overlay-5 (OSA-5) and approving a preliminary
Sensitive Areas Development Plan for property located at the east
terminus of Hickory Trail. (REZ97-0007)
Comment: At its February 19 meeting, by a vote of 6-0, the Planning
and Zoning Commission recommended denial of the requested
rezoning due primarily to concerns about inadequate secondary
access. The Commission's recommendation is consistent with the
staff recommendation set forth in a memorandum dated February 13,
1998. Protest petitions have been filed by neighboring property
owners representing more than 20% of the property within 200 feet
of the subject property, requiring a super-majority vote of the Council
(6 of 7) to approve this rezoning. The applicant has requested the
public hearing be continued to April 7.

An ordinance amending Title 14, Chapter 6, "Zoning," Article E,
"Commercial and Business Zones," Section 2, Neighborhood
Commercial Zone (CN-1) regarding size restrictions on restaurants.
Comment: At its March 5 meeting, by a vote of 6-0, the Planning and
Zoning Commission recommended approval of amendments to the
CN-1 Zone that establish the threshold for requiring a special
exception at an occupant load of 100 persons. The Council has
requested that the Planning and Zoning Commission consider a higher
occupancy threshold of 130 persons rather than 100 persons. At its
March 19 meeting, the Planning and Zoning Commission
recommended against an increase to 130 persons.

Comment: At its February 5 meeting, by a vote of 6-0, the Planning
and Zoning Commission recommended approval of the amended plan,
subject to the extension of Shannon Drive to Rohret Road to provide
vehicular access to the property prior to occupancy of the buildings.
The application was accompanied by a preliminary plat, which will be
considered by the Council at an upcoming meeting. Staff
recommended approval subject to conditions in its January 30
memorandum.

Consider a resolution approving a preliminary plat of Galway Hills, Part
Five, a 13.63-acre, eight-lot residential subdivision located on the
south side of Melrose Avenue and west of West High School.

Comment: At its March 5 meeting, the Planning and Zoning
Commission recommended approval of the proposed preliminary plat,
subject to easements and agreements for the provision of sanitary
sewer service. Staff recommended approval subject to conditions in a
February 27 memorandum to the Commission.
Consider a motion to forward a letter to the Johnson County Board of
Supervisors recommending that a request to rezone §.3 acres from
Suburban Residential (RS-l O) to Planned Commercial (CP2) for
property located in the northwest quadrant of the intersection of
Highway 1 and Landon Avenue be denied. (CZ9801)
Comment: At its February19 meeting, b~y a ote~~of 6~0, the Planning
and Zoning Commission recommended that the Council forward a
letter to the Board recommending that the requested CP2 rezoning be
denied due to its inconsistency with the Fringe Area Policy. This
recommendation is consistent with the staff recommendation
contained in a staff memorandum dated February 6. Consideration
deferred from March 10. At their March 12 meeting, the Board of
Supervisors denied the proposed rezoning, therefore Council
consideration is not necessary.

THE FILING OF AN APPLICATION WITH THE IOWA DEPARTMENT OF
TRANSPORTATION FOR FY99 IOWA DOT STATE TRANSIT
ASSISTANCE FUNDING AND FEDERAL TRANSIT ADMINISTRATION

Comment: JCCOG will be filing a n on behalf of Iowa City
Transit with Iowa DOT for State Transit Assistance [STA] and Federal
Transit Administration [FTA] funding for FY99. Iowa City Transit will be
receiving approximately $296,635 in Iowa DOT STA formula funds and is
applying for $2,628,100 in FTA capital funds. A memorandum listing the
capital projects to be applied for in FY99 by Iowa City Transit is included.

PLACE FOR RECEIPT OF BIDS.
Comment: This project includes full depth patching, diamond grinding,
sawing, and cleaning & sealing all joints and cracks on Mormon Trek
Boulevard from Benton Street to Melrose Avenue. This work will give the
road a better ride as well as better traction and will extend the life of the
pavement. The estimated construction cost is $185,000 and will bP~
funded by Road Use taxes.

Comment: This project includes the construction of a 16,000 square foot
addition to the Mercer Park Aquatic Center. It will include space for two
basketball courts, three volleyball courts, and a multipurpose room. The
estimated construction cost is $1.4 million and is being partially funded
through private donations.

finance the first mortgage for the amount of $60,320. The City will carry
a silent second mortgage in the amount of $22,180. This sale provides
the opportunity for a low-income family to obtain ownership of their own
home.

SECTION 12 HEREIN TO AMEND BY ORDINANCE LANE USAGE AND
PAVEMENT MARKINGS ON MELROSE AVENUE FROM UNIVERSITY
HEIGHTS TO BYINGTON ROAD. {PASS AND ADOPT)
Comment: This action is bein~~en al'~~low a right turn lane to be
constructed for west bound traffic on Melrose Avenue at the intersection
of Hawkins Drive. The lane usage and pavement markings on Melrose
Avenue between Byington Road and University Heights were adopted by
ordinance in the fall of 1997, as part of an agreement between the City
and the Melrose Avenue Neighborhood Association. The proposed lane
usage and pavement markings will provide two 11 foot traveled lanes and
two 5 foot shoulders from $. Grand to Byington Road and three 11 foot
travel lanes and two 7 foot shoulders from University Heights to S. Grand
Avenue, except east of the intersection with Hawkins Drive where one
right turn lane will be included. It has been determined that the proposed
right turn lane is necessary to accommodate existing traffic volumes.

CONSIDER A RESOLUTION APPROVING, AUTHORIZING, AND
DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO
ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY
AND DOVER, KOHL, AND PARTNERS FOR A DESIGN PLAN FOR
DEVELOPMENT OF THE PENINSULA.
Comment: This agreement is for design of a development plan for the
City-owned Peninsula property. The design process will include a series
of meetings and interviews with area property owners, developers, and
citizens to be conducted between May 1 and May 8. The fee for design
services is $80,000 with expenses not to exceed $15,000. The City will
recoup these fees and expenses when the Peninsula property is sold.

THE CITY TO ATTEST THE SUPPLEMENT AND FIRST AMENDMENT TO
AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND ACT INC.
(FORMERLY THE AMERICAN COLLEGE TESTING PROGRAM INC.)
CONCERNING ACT INC.'S MASTER DEVELOPMENT PLAN AND STREET
IMPROVEMENTS BY THE CITY OF IOWA CITY.
Comment: This agreement has been ne otiag/~ted tw~~een the City and
ACT Inc. and provides for the dedication of ACT property to the City
along the alignments of the proposed Captain Irish Parkway and First
Avenue extended. The property dedication includes right-of-way and
construction easements for the Captain Irish Parkway construction project
this summer, as well as right-of-way for the potential future extensions of
the Captain Irish Parkway and First Avenue.
CONSIDER A RESOLUTION AUTHORIZING ABANDONED BICYCLE SALE
TO BE HELD MAY 2, 1998.
Comment: This resolution authorizes the Police Department to auction
recovered bicycles that the department has not been able to return to
their rightful owners. The Police Department generally has one or two
auctions per year. This is an ongoing process.

CONSIDER A RESOLUTION CERTIFYING UNPAID MOWING AND CLEAN-
UP OF PROPERTY CHARGES, SIDEWALK REPAIR CHARGES, FROZEN
WATER METER FEES AND WATER SHUT-OFF FEES TO COUNTY FOR
COLLECTION IN THE SAME MANNER AS A PROPERTY TAX.
Comment: This resolution authorizes the fili0g~of a lien against properties
for unpaid mowing and clean-up charges, sidewalk repair charges, frozen
water meter fees and water shut-off fees. On March 6, 1998, letters
were mailed to each property owner listed in Exhibit A notifying them of
the date for the Council's consideration of the resolution. After the
resolution is moved for adoption, property owners should be permitted to
speak concerning the unpaid charges.
