RESOLUTION ACCEPTING THE WORK FOR THE SANITARY SEWER AND WATER MAIN PUBLIC IMPROVEMENTS FOR LOT 152 AND LOTS 168-179 INCLUSIVE OF COURT HILL-SCOTT BOULEVARD ADDITION, PART IX. WHEREAS, the Engineering Division has certified that the following improvements have been completed in accordance with the plans and specifications of the City of Iowa CiW, Sanitary sewer and water main improvements for Lot 152 and Lots 168-179 inclusive of Court Hill-Scott Boulevard Addition, Part IX, as constructed by Maxwell Construc- tion, Inc; of Iowa City, Iowa. WHEREAS, maintenance bonds have been filed in the City Clerk's office; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, iOWA, THAT: Said public improvements are hereby accepted by the City of Iowa City, Iowa, and that all dedications and public improvements are hereby formally accepted. UTILITY AND PUBLIC ACCESS EASEMENT LOCATED IN COURT HILL-SCOTT BOULEVARD ADDITION PART IX, AND TO APPROVE AND EXECUTE A SUBSTITUTED PRIVATE STREET, UTILITY, AND ACCESS EASEMENT AGREEMENT FOR THE SAME PROPERTY WHEREAS, the City possesses a water main easement and utility and public access easement within Court Hill-Scott Boulevard Addition Part IX, Iowa City, Iowa; and WHEREAS, subsequent to the approval of the final plat for Court Hill-Scott Boulevard Addition Part IX, an alternative, more efficient route was used for the placement of the water main, and the existing water main easement was not used; and WHEREAS. subsequent to the approval of the final plat for Court Hill-Scott Boulevard Addition Part IX, the "hammerhead" ending of the private street was modified into a cul-de-sac for aesthetic and safety purposes; and WHEREAS, the developer requested the City release the existing, unused water main easement and a portion of the utility and public access easement located in Court Hill-Scott Boulevard Addition, Part IX, said water main and utility easement being recorded on Apdl 3, 1990, in Book 1117, page 14, and said public access easement being recorded on Apdl 3, 1990 in Book 1117, Page 17, both portions to be released being designated and legally described on the plat attached hereto as Exhibit "B" and incorporated by this reference; and WHEREAS, the owner has agreed to enter into a new, substituted Utility and Public Access Easement Agreement which is attached hereto and incorporated by reference herein, which substituted utility and public access easement is designated and described on the plat attached hereto as Exhibit "A" and incorporated herein by this reference; and WHEREAS, Public Works has recommended the release of the existing, unused water main easement and the release of a portion of the private street, utility and public access easement and the execution of a substituted public access and utility easement agreement to conform to the actual construction existing in the development; and WHEREAS, it is in the public interest to release the existing, unused water main easement, to release a portion of the pri~fate street, utility and public access easement, and to execute the new, substituted Utility and Public Access Easement Agreement for the subject property. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: The City Council finds it is in the public interest to release the existing, unused water main easement and to release a podion of the pdvate street, utility and public access easement, and to enter into the new, substituted Public Access and Utility Easement Agreement attached hereto, which is hereby approved as to form and content. The City of Iowa City does hereby abandon, release and relinquish all right, title and interest in the Water Main Easement and Private Street, Utility and Access Easement described in Exhibit "B" attached hereto and incorporated by reference herein, and the mayor is hereby authorized to sign, and the City Clerk to attest, a release of said easements sufficient for recordation. The Mayor is hereby authorized to sign and the City Clerk to attest the attached Public Access and Utility Easement Agreement. The City Clerk is hereby authorized and directed to certify a copy of this Resolution for recordation in the Johnson County Recorder's Office together with the attached Exhibit "B", the attached release, and the attached Public Access and Utility Easement Agreement with Exhibit "A", said recording costs to be paid by Plum Grove Acres, Inc., the Developer of Court Hill-Scott Boulevard Addition Part IX. Washington St., Iowa City, IA 52240 (319)356-5030 PUBLIC ACCESS AND UTILITY EASEMENT FOR COURT HILL-SCOTT BOULEVARD ADDITION, PART IX THIS AGREEMENT made and entered into by and between Plum Grove Acres, Inc., an Iowa Corporation, hereinafter referred to as Subdivider, which expression shall include its successors in interest and assigns, and the City of Iowa City, Iowa, hereinafter referred to as City, which expression shall include its successors in interest and assigns. IT IS HEREBY AGREED AS FOLLOWS: For the sum of One Dollar and other valuable consideration, receipt of which is hereby acknowleclged, the Subdivider hereby grants and conveys to the City, an easement for the purposes of excavating for and the installation, replacement, maintenance and use of utility lines and water main for the Subdivision. This easement includes access to the areas designated as "Private Street, Utility and Access Easement", as shown on the Easement Dedication Plat of Court Hill-Scott Boulevard Addition Part IX of Iowa City, Johnson County, Iowa, which plat is attached hereto and by this reference made a part hereof. This easement provides the City and the general public with a means of ingress, egress and passage over the private street designated as Scott Court on said plat and also includes an easement for the City water main on or in that same area. The City shall promptly backfill any trench made by it, and repair any damages caused by the City within the easement area. The City shall indemnify Subdivider against unreasonable loss or damage which may occur in the negligent exercise of the easement rights by the City. Except as expressly provided herein, the City shall have no responsibility for maintaining the easement area. The Subdivider reserves a right to use said easement area for purposes which will not interfere with the City's full enjoyment of its rights hereby granted; provided that the Subdivider shall not erect or construct any building, fence or other structures; plant any trees, drill or operate any well; or construct any reservoirs or other obstructions on said area; or diminish or substantially add to the ground cover over the utility lines. Nothing in this Agreement shall be construed to impose a requirement on the City to install the private improvement at issue herein. Nor shall the Subdivider be deemed acting as the City's agent during the original construction and installation of said improvement. Parties agree that the obligation to install the improvement(s) herein shall be in accordance with City specifications, and the obligation shall remain on the Subdivider until completion by the Subdivider. The Subdivider hereby covenants with the City that it is lawfully seized and possessed of the real estate above described, and that it has good and lawful right to convey it or any part thereof. 2 The provisions hereof shall inure to the benefit of and bind the successors and assigns of the respective parties hereto, and all covenants shall be deemed to apply to and run with the land and with the title to the land. WHEREAS, the City Council declares it is in the public interest to establish a policy which provides residents with assistance for City utility service fees by way of a fee discount program. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. Resolution No. 79-381 is hereby rescinded as outdated. 2. Discount Programs. It is in the public interest to establish annual and two-year discount programs for water, wastewater {sanitary sewer), solid waste and recycling services for residential utility service fees for qualifying low income residents as follows: a. Annual Discounts. To qualify for the annual discount program, all residents of a household must: - Be participating in one of the following programs: Supplementary Social Security Benefits, Title XX Program, Family Investment Program, Food Stamp Program. - The account holder must be a resident of the household. b. Two-Year Discounts. To qualify for a two-year discount, all residents of a household must: - Be participating in a reduction in the previous year's property tax pursuant to the Iowa Disabled and Senior Citizen Property Tax and Rent Disbursement Claim Program, as provided by state law. - The account holder must be a resident of the household. 3. Applications. Applications for the discount program shall be accepted by the City Finance Department throughout the calendar year, and shall be effective only after verification of eligibility and as of the date of the account holder's next regular monthly billing. Renewal applications for the discount program shall be accepted by the City Finance Department from March 1 through May 31 of the current year, and shall be effective commencing on July 1 of that same year. The City of Iowa City's existing low-income policy provides a discount for 100% of the solid waste fee for those customers that qualified under the low income criteria. The eligibility programs will not change. The attached resolution states the City policy for the eligible programs. These programs are as follows: · Supplemental Social Security Benefits · Title XX Program · Family Investment Program · Food Stamp Program · Iowa Disabled and Senior Citizen Property Tax and Rent Disbursement Program I am recommending that the City change the discount for solid waste curbside and recycling from a 100% to a 50% discount of the minimum monthly charge. For the water and wastewater fees, I am recommending a discount of the monthly minimum charge. The monthly minimum charge for solid waste/recycling is 911 per month; water is $8.54; and wastewater is 99.78 (based on the March 1, 1996, proposed 30% and 15% user fee increases). The total discount that would be applied for a customer that is eligible in a program listed above would be $23.82/month. A summary of the current and proposed charges is listed below: Current Discount Proposed ® Water 90 ® Wastewater 0 · Solid Waste - Curbside 8.75 · Recycling - Curbside 2.27 100% of minimum = 98.54 100% of Minimum -- 9.78 50% of minimum = 4.38 50% of minimum = 1.12 Total $11.00 923.82 The customer would be responsible for half the solid waste fee and the purchase of any additional yard waste bags or curbside refuse stickers. The customer would also be billed for water and wastewater consumption past the minimum of 200 cubic feet per month. 2 I believe this would be easy to administer as the City is currently utilizing these programs to offer discounts to customers that qualify, Also, it would be easy to change the computer program to bill these persons properly on a monthly basis. The average residential monthly bill will be approximately $52.21 per month based on an average of 700 cubic feet per month. For those customers eligible for this program, this would provide a discount of 923.82 or reduce the bill to approximately $28.39. A residential user who uses a minimum of 200 cubic feet or less of water per month and qualifies for one of the programs would pay only the refuse portion of the billing or 95.50 There are currently 92 customers signed up for the discount. The estimated annual cost or decrease in revenue based on 92 users for the new proposed discount program is $6,077 for refuse, 99,428 for water and 910,797 for wastewater. IA 52240 {319)356-5041 RESOLUTION NO. 96-23 RESOLUTION RESCINDING PRIOR RESOLUTION NO. 95-234 AND IN LIEU THEREOF SETTING FEES AND CHARGES WITH RESPECT TO THE ADMINIS- TRATION OF REGULATIONS OF VEHICLES FOR HIRE. WHEREAS, Title 5, Chapter 2 of the City Code of the City of Iowa City, Iowa, established regulations for vehicles for hire and drivers operating such vehicles within the City of Iowa City; and WHEREAS, 5-2-3 provides that the applicant for a license must file a motor vehicle operator's liability insurance policy in the office of the City Clerk, in a form approved by the City and with minimum limits as set by City Council resolution; and WHEREAS, 5-2-9 provides that any owner or operator licensed or permitted to do business in Iowa City shall, upon payment of the required fee, be entitled to a parking stand at a location on City street right-of-way to be designated by the Parking and Transit Director and Traffic Engineer; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: Prior Resolution No, 95-234 establishing certain fees and charges for vehicles for hire is hereby rescinded effective March 1, 1996, and this Resolution adopted and approved in lieu thereof. 2. The following fees are hereby established for vehicles for hire as follows: Processing a company application: $20.00 for a one-year period expiring March 1 unless suspended or revoked, with no refunds. Issuance or replacement of a decal: $40.00 each for a one-year period expiring March 1 unless suspended or revoked. If the City is notified by the insurance carrier of cancellation of insurance, the decal will be removed and returned to the City Clerk's office, with no refund. Issuance of driver's badge: $7.50 each driver for a one-year period, or the remaining period of Chauffeur's/Operator's License if under one year. Designation of a parking stand: $660.00 in CBD zone and $420.00 in outlying areas per year for each stand, expiring March 1. Said fee may be pro-rated on a quarterly basis. e. All such fees shall be effective March 1, 1996. Resolution No. 96-23 Page 2 The minimum limits for motor vehicle operator's liability insurance are to be quoted for all vehicle for hire operators as "individual" liability amounts, or in lieu thereof as a "combined" liability amount, said liability minimum amounts to be established at the following limits with a deductible not to exceed $500, and shall also comply with all state and federal requirements if greater: a. "Individual" Liability Amounts To cover the insured's liability for bodily injury or death of one person, as a result of one accident or other cause, Five Hundred Thousand Dollars ($500,000.00). o To cover the insured's liability for bodily injury or death of more than one person as a result of one accident or other cause, One Million Dollars ($1,O00,000.O0). If the vehicle for hire has more than ten seats, the insured's liability for bodily injury shall be Two Million Dollars ($2,000,000.00). To cover the insured's liability for damage to or destruction of property other than that of the insured as a result of any one accident or other cause, One Hundred Thousand Dollars ($1 O0,000.00). b. "Combined" Liability Amount To cover the insured's liability for bodily injury or death of one or more persons as a result of any one accident or other cause, and to cover the insured's liabdity for damage to or destruction of property other than that of the insured as a result of any one accident or other cause, One Million Dollars ($1,000,000.00) combined. Since that time the City licensed three busses as taxicabs and prompted my review of insurance requirements. Initially my recommendation was to increase the taxicab liability limits for vehicles in excess of 10 passengers to $100,000 per passenger based on the assumption that the excess layer of insurance over $1,000,000 would be much less expensive than the primary layer as in most markets. I have done some research into the marketplace and f'md that that assumption is incorrect in the taxicab insurance market. Although the excess layers are less expensive i.e. the primary layer cost approximately $2,700 and each million dollars of excess is $400, I believe the example of insuring a bus with seating for 50 passengers would cost $4,300 and could be economically impractical. Therefore I recommend that the liability insurance limits for vehicles with 10 passengers or less remain at $1,000,000 and for vehicles in excess of 10 passengers the limits increase to $2,000,000. These limits are similar to the Iowa Deparhnent of Transportation intnstate requirements. These accounts are either inactive/closed accounts with charges for water, wastewater, solid waste and/or recycling services OR current active accounts with charges only for solid waste and recycling services. The following steps describe our collection procedures on these accounts: COLLECTION OF INACTIVE DELINQUENT ACCOUNTS: A) when the account holder is owner or manager of property: 1) Bill sent to account holder 2) If unpaid 30 days after original bill a collection letter is sent to account holder. a) Research utility account files for an active account in the same account holder name. If such exists, a letter is enclosed with the 30 day collection letter advising any that delinquent balance would be transferred to the active account, if such is not paid within a specified pedod. 3) If unpaid and not transferable to another account within 60 days after original bill, a collection letter is sent to the account holder advising of possible collection through certification to Johnson County as a lien against the property. 4) The delinquent utility accounts are reviewed annually. After verification with the City Assessor's records that the account holder is owner of the property, a collection letter is sent advising of our lien collection procedures and the date and time such would be presented to you, the City Council, for consideration to collect the delinquent balance due in the same manner as property taxes. B) when the account holder is a tenant: 1) Bill sent to account holder 2) If unpaid 30 days after the original bill, a collection letter is sent to the account holder AND to the ownedmanager as listed on the utility account. a) Research utility account files for an active account in the same account holder name. COLLECTION ON ACTIVE ACCOUNTS CHARGED ONLY SOLIDWASTE AND RECYCLING SERVICES: A) A collection letter is sent to the account holder and/or owner of the property at least 30 days pdor to the lien collection letter. (Solid waste services are not discontinued for nonpayment of a billing. Our collection on these accounts is limited to annual review and collection as a lien against the property.) B) See ~ above. On January 10, letters were sent to account holders and property owners advising of our lien collection procedures and the date and time these accounts would be presented to you for consideration, providing them the opportunity to pay the delinquent balance or the opportunity to be heard concerning the unpaid charges. Exhibit A identifies each unpaid delinquent account collectible through these lien procedures, listing the utility account number, service address, property parcel number, owners' name, tenants' name, mailing address, brief legal description of the property, period of time services were provided and an itemization of those collectible delinquent charges. We have itemized the total delinquent balance on the attached SUMMARY OF DELINQUENT ACCOUNTS between the two main account holder categories of tenants versus owners and by the type of activity--payments, transfers to other utility accounts, write-offs, liens and special adjustments. The adjustment of $90.18 was on an account that was incorrectly billed due to the water meters being reversed in a duplex. Our adjustment procedure relieves 50 per cent of any back bill charges for City utility services, whereby we adjusted off $90.18 in utility charges. The following is a brief review of the percentages based on total dollars billed of $13,757,172 during this period compared to the beginning delinquent balance of $24,631. Owners agree to secure its construction site against pedestrian and public traffic by providing adequate traffic control, by providing adequate signage, and by fencing all open excavation while the contractor is not working, thereby ensuring public safety and a safe construction site. 3. In consideration for Owners' promises herein, the City agrees to allow Owners to temporarily close a portion of the sidewalk right-of-way along the south side of Burlington Street and the east side of Dubuque Street adjacent to their property. 4. Owners agree to provide, keep in place, and maintain in good working condition certain signage necessary to: a) route pedestrians. b) provide advance warning. c) provide for the orderly and predictable movement of traffic. All signage shall be in accordance with the Federal Highway Administration Manual on Uniform Traffic Control Devices. 5. Owners agree to indemnify, defend and hold the City harmless against any and all claims for bodily injury, death or property damage arising out of its actions and those of its contractors, subcontractors, agents, employees and assigns arising out of Owners' use of the public right of way under this easement agreement, specifically including any and all claims and/or liabilities which may be alleged against the City as a result of its decision to allow Owners to temporarily close a sidewalk adjacent to their property along Burlington and Dubuque Streets as described herein. Owners further agree to carry Class II liability insurance in the amounts of $500,000 each occurrence, $1 million aggregate bodily injury, and $250,000 aggregate property damage with contractual liability coverage included. Owners shall further furnish a certificate of insurance of said valid insurance coverage, which certificate must be satisfactory to the City. 6. After the apartment building construction is complete, Owners agree to restore any and all portions of the sidewalk right-of-way to its pre-construction condition, to the City's complete satisfaction. City and Owners agree this Temporary Easement shall be in effect beginning January 20, 1996 and end upon substantial completion of the work, but no later than August 20, 1996. 7. While we find that it is possible to construct such a temporary walkway, there are safety and operational factors outlined below that should be considered before requiring it to be built. Safety - Moving the pedestrian way out into Dubuque Street will present certain hazards both from vehicles and from hoisting objects overhead. Also, the south transition to the existing walk will occur either in a driveway to a parking lot or on a temporary surface such as plywood which can be slick. Operational - I expect that Dubuque Street will be a location where much of the building materials will be delivered to the site. Those items which can't be hoisted over the sidewalk will be delivered from trucks parked on Burlington Street or in the alley. Obstructing Burlington Street presents obvious problems and obstructing the alley presents operational problems for Firestone. Unloading materials along Dubuque Street will cause the least problems in the area. Also, if the walkway is installed in the street, cars and trucks approaching the intersection will be moved west and may not activate the traffic signal detectors to get a green light. Access to the cross walk button will also be difficult. Since there are alternative routes on the opposite side of the street from the sidewalks that are closed and cross walks exist at all proceeding intersections, coupled with the problems noted above, Engineering and Public Works does not recommend requiring a temporary walkway along Dubuque Street. Washington Street Iowa City, Iowa 52240 RE: Sidewalk closure Dubuque and Burlington Dear Steve: As you know, I represent Jim Clark, who has requested closure of the City sidewalks along Burlington and Dubuque Streets where construction will be taking place in the next few months. The request was formally filed by Ed and Mary Foraker, however, Jim has a signed agreement for purchase of the property and we expect to close in the next few weeks. I saw the portion of the Council Meeting on February 16 at which the sidewalk closure was discussed. I understand that concerns have been expressed to Council members by residents in Capitol House Apartments, which is immediately south of the construction site. If I understand the concerns correctly, the residents do not wish to cross over to the other side of Dubuque Street to travel north to downtown Iowa City. Jim Clark and I have discussed this at some length and I have considered the comments made at the January 16 Council Meeting. For a number of reasons, we believe that closure of the sidewalks is the safest option and should be approved by the Council. Construction materials will, of necessity, be unloaded from Dubuque Street to the construction site. Some materials will be unloaded from the alley on the east end of the property. However, the alley is narrow and is used by the Firestone Store and we do not wish to interfere with their operations. If delivery trucks are able to pull up as close as possible to the building on the Dubuque Street side, this will minimize disruptions on both Dubuque Street and in the alley. If the walk is kept open the trucks will have to park further into the travelled portion of Dubuque Street. We also anticipate that a drive will be installed off of Dubuque Street into the west side of the building. Materials will Steve Atkins January 23, 1996 Page 2 also be delivered via this drive and construction workers will be driving vehicles into the building to park. This would not make it feasible to cover the walk where this drive enters the property. This could also become slippery and muddy and present a further danger to pedestrians. Also, a crane will be necessary to lift loads of construction materials into the upper stories of the building. Of necessity this crane will need to be on the west side of the building where the Dubuque Street sidewalk is located. The elevation of the east side of the property is substantially lower than the west side. Since the lot is 150 feet from east to west, use of the crane will be necessary on both ends of the building from time to time. Keeping the sidewalk open poses two problems with the crane. First, it means that the crane will be farther out in the travelled portion of Dubuque Street. Also, if there were some accident with a heavy load of construction materials, the canopy would provide little or no safety benefit. Such canopies are typically designed to prevent injury from a dropped hammer or a board, but not to protect from an entire load of lumber slipping from a crane. We do not want to create a false sense of security. Finally, access to the "walk button" on the pole on the southeast corner of the intersection will be blocked by the construction fencing. Because of the volume of traffic on Burlington, it is always necessary to obtain a walk light to safely cross Burlington Street at Dubuque Street. It would be next to impossible to make this area safe and still leave access to the walk button. We believe that the west side of Dubuque Street offers a much safer route. The intersection at Dubuque and Court Street is a four way stop and is comparatively easy for pedestrians to cross. The walkway on the west side of Dubuque Street is a seven foot sidewalk which provides ample room and a safer surface for use by residents of Capitol House Apartments. If residents of Capitol House are walking to downtown Iowa City, which seems their likely destination, pedestrian traffic on Dubuque Street is largely funneled through the Holiday Inn, so it makes a very minor difference which side of Dubuque Street a pedestrian is on when he or she crosses Burlington Street. Jim will make every effort to reopen the Dubuque Street sidewalk as soon as possible. Closing the sidewalk will facilitate construction and help reopen the sidewalk to normal use more quickly.
