THE CITY COUNCIL OF IOWA CITY IS CONSIDERING APPOINTMENT TO THE FOLLOWING BOARD:
AIRPORT ZONING COMMISSION
One vacancy - Six-Year Term
January 1,2004 - December 31,2009
Duties of the Airport Zoning Commission are:
1. To recommend amendrr~ents to the current iowa City Airport Zoning regulations, including the
repeal thereof.
2. To recommend the adoption of new Airport Zoning regulations.
Iowa City-appointed members of boards and commissions must be eligible electors of the City of
Iowa City. The Board meets as required.
Applications must be received by 5:00 p.m., Wednesday, March 10, 2004. The City of Iowa City
encourages diversity in the appointment of citizens to boards and commissions. Persons interested in
being considered should contact the City Clerk at City Hall, 410 E. Washington Street. Application
forms are available from the Clerk's office upon request or on the City website at www. icgov.org

Duties: To exercise all the powers granted to cities and towns under Chapter 330 of the Code of
Iowa, except the power to sell said airport. To annually certify the amount of taxes within the limitations of
the Statutes of the State of Iowa to be levied for Airport purposes. All funds derived from taxation or
otherwise for airport purposes shall be under the full and absolute control of the Airport Commission,
deposited with the City Treasurer, and disbursed only on the written warrants or order of the Airport
Commission.
Iowa City-appointed members of boards and commissions must be eligible electors of the City of
Iowa City. The Airport Commission meets the second Thursday of each month at 5:45 p.m.
Applications must be received by 5:00 p.m., Wednesday, March 10, 2004. The City of Iowa City
encourages diversity in the appointment of citizens to boards and commissions. Persons interested in

The powers and duties of the Airport Zoning Board of Adjustment are:
1. To hear and decide appeals where it is alleged there is an error in any order, requirement,
decision, or determination made by an administrative official in the enforcement of the Airport
Zoning Chapter.
2. To hear and decide special exceptions to the terms of the Airport Zoning Chapter upon which
such board is required to pass under the Airport Zoning Chapter.
3. To authorize upon appeal in specific cases such variance from the terms of the Airport Zoning
Chapter as will not be contrary to the public interest, where owing to special conditions a literal
enforcement of the provisions of the Airport Zoning Chapter will result in unnecessary hardship,
and so that the spirit of the Airport Zoning Chapter shall be observed and substantial justice done.

Dear Councilors,
I am writing in enthusiastic support of Ms. Justine Zimmer as a candidate for the Iowa City
Historic Preservation Commission. From my interactions with her as director of the Englert Civic
Theatre project, I have come to value her as a skilled communicator with a knack for finding
practical solutions to complex issues. She is well familiar with the pros and contras of historic
preservation, has experience in grant writing, and is also sensitive to the needs of lower-income
residents who may be impacted by commission decisions. Above all, the appointment of Ms.
Zimmer would be a step towards gender parity on the commission. I wholeheartedly recommend
her to you.

Dear City Council Members:
This letter is in regard to Mr. Michael D. Brennan's application for a
position on the Iowa City Historic Preservation Commission. Under the
terms of the 28 E Agreement between the State of Iowa and the City of
Iowa City, Certified Local Government Agreement No. 19, dated March 2,
1987, Item 2., "That the State will monitor all preservation activities
of the CLG (Iowa City), including those of its historic preservation
commission;", the State is commenting on this applicant.
We have reviewed all of the applicants being considered for positions on
the Historic Preservation Commission. Our finding is that the
applications submitted by Michael Gunn, James Ponto, Richard Carlson,
and Justine Zemmer meet the following standard found in the above
referenced Agreement, "The commission will be composed of community
members with a demonstrated positive interest in historic
preservation .... "In addition, Richard Carlson meets the Secretary of
the Interior's Professional Qualification Standards for a Architectural
Historian.
Exhibit A, Article I, General Responsibilities of a Certified Local
Government, of the CLG Agreement states that "A. The CLG (Iowa City)
will enforce all appropriate state and local ordinances for designating
and protecting historic properties", and that "G. The CLG shall
maintain a system for the survey and inventory of historic and
prehistoric properties in a manner consistent with and approved by the
State." Item G means that Iowa City has accepted the responsibility of
identifying and designating all historic properties as defined in
National Register Bulletin 15) within the corporate limits of Iowa City.
Item G is incorporated in Section 14-4C-5 A of the Iowa City Code,
Chapter Four Land Control and Development, Article C Historic
Preservation Regulations.
To summarize, Gunn, Ponto, Carlson and Zemmer have demonstrated through
their work on the Conlmission, their jobs and volunteer work their
willingness to enforce appropriate state and local ordinances and to
fulfil the responsibility for identifying and designating historic
properties. Mr. Brennan's public statements before the Historic
Preservation Commission end the Iowa City Council suggest that , as a
Commission member, his fulfilment of these two responsibilities would be
problematic.

The following is a sampling of Mr. Brennan's public statements. These
excerpts are from his April 30, 2003 Memorandum to the Iowa City City
Council, titled "Re: College Hill Preservation District Overlay".
Brennan; "... the commission's plan~ for its future growth, to include
review authority over as many as 2,000 properties in Iowa City."
State's observation: The CLG Agreement and the Iowa City Code direct
the Commission to continue identification, evaluation and registration
activities which result in the creation of more historic landmarks,
historic districts, and conservation districts.
Brennan:" ...the intrusive nature of the Commission as it relates to
ordinary property owners and taxpayers."
State's observation: The Commission only acts reactively in response to
applications for Certificates of Appropriateness. When a property owner
under takes ordinary maintenance or repair, this does not require a
Certificate or a review by the Commission.
Brennan: "...questionable nature of how the boundaries of this district
were created and changed, and how determination of a structure's
contributing status was made (the original concept apparently was for
another historic district, which still appears to be a long term goal).
State's observation: The Co~u~ission followed Iowa City Code as well as
the National Register Bulletins 15 and 16b, Code of Iowa 303.34 and
414.1 and State comment when establishing boundaries.
Brennan: "...nearly all significant decisions about the district were
made before property owners were clued-in (unless they happen to check
the web site regularly). Some hasty changes were made after some
property-owners voiced concerns. The speed with which the changes were
made flies in the face of careful consideration of objective factors.
.... that the commission's priority was getting something through the
Council with little scrutiny."
State's observation: Typically, a historic preservation professional, a
consultant, does the research, recording and evaluation required to
define a historic landmark, historic district or conservation district.
The results are presented in a report. The content and format of the
report, complies with National Register Bulletins 15 and 16b. The first
draft of the report is reviewed by the public, the State, Iowa City
Mayor and City Council, and the Historic Preservation Commission. In
effect, this is the first time any of the involved parties see the
proposed landmarks or districts, the contexts under which they were
evaluated, the critierion or criteria which make them historically
significant, their proposed boundaries and in the case of districts, the
contributing properties. It is only after the first draft of the report
is reviewed that significant decisions start to be made as a result of
dialogue between the reviewing bodies.
What appears to Brennan as "hasty changes" may well be responsive
changes on the part of the Commission to concerns, observations and

issues raised during the review process. The hasty changes may have
been required into to comply with Iowa City Code and the Secretary of
the Interior's Standards for Identification, Evaluation, and
Registration.
Brennan: "This ordinance imposes significant restrictions on property
rights."
State's Observation: The Iowa City Historic Preservation Ordinance as
revised closely follows other municipal preservation ordinances across
the United States, incorporating in its structure and language the
powers and procedures that have been upheld under judicial review. In
effect, case law, particularly in regard to "takings and property
rights", supports Iowa City's Historic Preservation Ordinance.
Moreover, a review of the Iowa City Historic Preservation Commission's
complete meeting transcripts reveals a consistent pattern of working
with property owners to facilitate approval of their applications for
Certificates of Appropriateness in a manner that meets the property
owner's design and material needs and wishes while still complying with
the Iowa City Code.

been a considerate, consistent and conscious commissioner. I have
followed the U.S. Department of the Interior, National Park Service,
Preservation Assistance Division materials in all matters concerning
historic preservation in Iowa City. I have a Master of Fine Arts in
Historic Preservation. I have voted for exceptions, recommendations and
alternatives to preservation work, when applicant's have expressed their
financial need to alter materials and services. I do understand BOCCA
codes, OSHA requirements and building terminology. I have worked in a
architectural firm and have been an associate within the field for over
a decade. I am writing to you today, because of Mr. Michael Brennan's
letter to Eleanor Dilkes of February 11, 2004.
I am sorry that Mr. Brennan is somewhat alarmed about definitions,
regulations and due process. The Iowa City Historic Preservation
Handbook is based on our national standards for rehabilitation. It is
our mission to uphold these guidelines of The Secretary of the Interior,
in order for Iowa City to be considered a Certified Local Government, by
the State of Iowa Historic Preservation Office. Our Preservation
Handbook provides guidelines, not City Ordinance. It's intent is to
protect our character-defining spaces, materials, features and finishes
for the prosperity of future generations.
I am anxious that Mr. Richard Carlson may be unseated, because of Mr.
Brennan's concerns.
Mr. Richard Carlson has provided the City of Iowa City countless hours
in research, editing and writing skills for historic preservation. Mr.
Carlson has taken time to meet with property owners to evaluate, inform
and advise applicant's to the process of the commission. It has not only
been an honor to work with Mr. Carlson, but a pleasure to have his
professional experiences in the field utilized so well. Please realize
that our time as commissioners extends beyond our meeting minutes.
Mr. Carlson is an irreplaceable asset. Commissioner Carlson is able to
confirm historical context on the local, state and federal levels of
government.

The latest version of the Historic Preservation Handbook has been approved by the city council.
Several definitions in the handbook were not reviewed or approved by the Historic Preservation
Commission (HPC). In early November 2003 I called the planning office about obtaining a copy of the
handbook. I was told that changes were still being made, but that it should be completed within about a
week. I agreed to wait and about a week later purchased a copy from the planning office. The title page
is stamped "Final Draft, November 13, 2003." The final draft was presented to HPC at its meeting on
November 1 I, 2003. Though there was no formal vote approving the final draft, it is clear from the
minutes that placing it on Council's agenda was the only step left in the approval process.
Upon reading the draf~ definitions I became somewhat alarmed. Presumably the proposed
definitions were in accord with the forthcoming revision of the Zoning Code. (I purchased a working
copy of that, but the revised Historic Overlay Zone section was not completed as of mid-January). If so,
they represented the potential for an enormous increase in the scope of HPC's power. The definition of
Historic (and Conservation) district was being substantially altered. Various references limiting HPCs
authority to review changes to the exterior appearance of buildings located in historic districts were
eliminated and at least one definition expressly provided for review of certain types of interior work.
An update on the progress of the revised Handbook through Council appeared on HPCs agenda
for December 11. At that meeting, city staff informed the commission that the Handbook would be
placed on the January 5, 2004 Council agenda. As the commission prepared to move on to the next
agenda item, I related some of my concerns about the new definitions. I asked about the change in what
constitutes a Historic District and whether the comnUssion and council should specifically vote on that
change. I also identified concerns relating the exterior/interior changes. There was a short discussion and
city staff indicated the concerns would be looked into.
Council's packet from December 23 includes the full text of the revised Handbook. The cover
reads "Final draft, December 19, 2003." The only changes I found compared to the "Final Draft,
November 13, 2003" were in the definitional section. The main change to the definition of Historic
District had been removed (though the corresponding change to the definition of Conservation District
remains in place). Several of the changes relating to the interior/exterior question were gone.
These 'reversions' seem to have been made due to the concerns I raised at the December 11 HPC
meeting. I appreciate the responsiveness of city staff. I remain concerned about the process involved. A
review of the minutes of HPC's meetings since the summer of 2003 indicates there was little to no
discussion of the substantive impact these definitional changes might have had. It does not appear that
HPC was attempting (or wanted) to expand its power or that it was apprised of the possibility. The
discussions concerning the revised Handbook read as though HPC provided review of staff work for
formatting, typographical errors and a few areas of substantive inquiry. There was no discussion
concerning the redefinition of what constitutes a historic district or the other issues. These are issues that
go to the core of HPC's power. Yet they were changed without being brought to the commission's
attention and, as to the 'reversions,' without any opportunity for HPC to review the changes prior to
submission to Council.
The approved 'Final draft' of the definitions leaves open several ctmosities and questions:
The definitions of property and structure are circular. The word 'property' is used in its own
definition. The terms site and object, which are fundamental historic preservation terms, are not defined
at all. (The National Register definitions of these terms are found at 36 CFR 60).
The new definitions include provisions for review of landscaping and, despite the 'reversions,'
may well expand HPC's purview to certain kinds of interior remodeling projects. Please review and
compare the Handbook definitions with current ordinance definitions in chapters 14-6B & 14-6J-3/4/5.
Some examples:
Certificate of No Material Effect: The document, issued in lieu of a Certificate of Appropriateness, that
signifies that the work contemplated in the application will have no effect on any significant features of a
[district property].
Concern: There is a definition of exterior features, which is plainly limited to the outside of a
building. There is no definition of the term significant features, which can obviously be interpreted to
include things inside a building, as well as things on the property that are not buildings (fences,
driveways/paving, landscaping).
Example: An entirely new section (Site and Landscaping) has been added to the revised
handbook (see page 26), which indicates an expansion in the scope of HPC power.
Solution: Replace the term significant features with exterior features. Alternatively, give a
specific definition to the term significant features.
Change in appearance: Any alteration, addition, demolition, new construction or other change that
modifies the site of or exterior of a structure of a [district property].
Concern: This sweeping statement comprises the first sentence of the current definition (14-6J-
5B). However, limiting language in the current definition is deleted from the Handbook definition:
This definition shall pertain only to changes in appearance which are visible from the
public way or from adjacent properties and for which a building, demolition, house
moving or other regulated permit is required for compliance with applicable City codes.
Furthermore, nothing in this definition shall be construed to prohibit or limit normal
repairs or maintenance which do not involve alterations or changes in the exterior
features of a historic landmark or of a building and for which no regulated permit is
required. For purposes of this Article, changes made in the color of the exterior surfaces
of a building are not considered a change in appearance, but deemed to be ordinary
maintenance and repair.
Deleting this language removes all express limitations to review only of work that requires a
regulated permit.
Solution: Restore the deleted language and/or consider inserting limitations modeled on Iowa
Code section 303.21 "The Commission shall not consider or attempt to control the interior a.~.~ngcmcnt
[portion] of any building in the district." "The Commission shall not consider or attempt to control
changes in appearance which do not require the issuance of a regulated permit."
Demolition: Any act or process that destroys a structure or any architecturally significant component of
a structure or building.
Concerns:
Iowa City does not presently have a 'demolition-by-neglect' ordinance. This definition
establishes the concept. It also could be read to extend HPC's power to the interior portions of buildings
since architecturally significant components are present inside as well as outside of buildings.
How, if at all, does an architecturally significant component differ from a significant
feature as used in the Certificate of No Material Effect definition?
How do both of those terms differ from exterior features, which is defined and limited to
the exterior of a building?
The term structure is defined as "Any man-made feature that has been constructed on a site or
property."
Driveways/paving, fences and landscaping are man-made features. (Remember that the
current definition of Overlay Zone requires application of the more restrictive requirements of two
applicable ordinances. Therefore, the general zoning definition of structure is rendered meaningless).
Solutions: Delete this section entirely unless a city-wide demolition-by-neglect ordinance is
adopted, thereby restricting everyone's rights on an equal footing.
Expressly exclude interior portions of buildings from the scope of HPC's review
authority.
Use the general zoning definition of structure (14~6B-2) which expressly excludes
vehicles, sidewalks and paving.
Concern: Landscaping is expressly brought under HPC's purview, as it is listed in the definition
of property, as well as in the instances cited above.
What ultimately matters is how the revised zoning ordinance is worded. If these issues are
addressed before the zoning ordinance is completed, the handbook definitions can be revised again with
relatively little effort. The Commission does not appear to want to regulate the interior of homes. The
language of the new ordinance, as well as the handbook, should not be susceptible to any other
interpretation.

You should also know that Section 362.5 of the Code of Iowa generally prohibits, with certain important exceptions, a
