Planning and ITEM ~0. 6ao Zoning Matters 96-31 Sl Consider setting a public hearing for March 26 on an amendment to the Comprehensive Plan to incorporate an amendment to the JCCOG Arterial Street Plan which includes Oakdale Boulevard. Davidson/ We have no overhead projector .... Are we waiting for Dee? Nov/ I am not hearing too well. Davidson/ First item is to consider setting a p.h. for March 26 on an amendment to the Comp Plan... clarification on this... We have parallel issues going on at city of Iowa City and JCCOG. Same issue .... At our board meeting on March 6 we are going to be considering an amendment to the JCCOG Arterial Street Plan to add a segment of Oakdale Blvd .... You have got the map. The previous city council adopted the JCCOG Arterial Street Plan as the arterial street planning element of the Comp Plan. So at the same time that we are at JCCOG processing an arterial street plan amendment, we are processing an amendment to the Comp Plan for Iowa City ..... Since it will be after the JCCOG meeting that you will actually consider this as an amendment to the Comp Plan, if there are any questions...clarify .... Nov/ For what purpose would that road be connected? ..... Davidson/ ...purpose in connecting it to 1-provide access to that area as it develops. 2-To provide circulation within the community between Iowa City and Coralville .... Vanderhoef/ And this is only what? 3/4 mile or 1 mile north of interstate? Davidson/ Right. Vanderhoef/ And how tough is it to put a street through and by the quarry? Davidson/ If this is approved .... do... is an alignment study. We get the engineers, we get the environmental consideration and we determine actually where the road would go. For now all we are considering is should there ever be a road here. Norton/ How much of it is in the city? About half of it? Davidson/ At the present time about 1/3 of it. The western 1/3 of it is in Coralville. The eastern 2/3's is in unincorporated Johnson County. Of that 2/3's that is in unincorporated Johnson County, the middle 1/3 would eventually be annexed by City of Coralville, the eastern 1/3 would eventually be annexed by Iowa City and that is according to an existing agreement between Iowa City and Coralville on that area. Kubby/ .... Davidson/ Probably middle portion is more than 1/4 .... that dashed line there (refers to map)...annexation boundary .... sewer service area .... Norton/ Is that segment in our growth area? Davidson/ The growth area north of 1-80 is undefined and the reason it is undefined is we need to define it... plans to bring to you to do ..... Because of downstream sewer line capacity, we know we have 700 acres north of 1-80 to be designated by the city council...can be served ..... exactly what it is that should be served is part of what you all have to determine .... getting to point that we need to get to defining that. Davidson/ The current position of Iowa City would be there are no plans to annex this area... change your mind at any time .... Lehman/ ..... entire are... only 700 we can serve .... Norton/ Davidson/ There are some downstream line capacity issues in the river corridor trunk feed that also limit that 700 acres. ¥anderhoef/ ..... You are talking in terms of an additional 1,000 to 2,000 vehicles dumping out on Old Dubuque Road and we are also seeing considerable growth to the north ..... CHANGE TAPE TO REEL 96-31 SIDE 2 Vanderhoef/ I am wondering whether this is a good move to have another street come out at that location ..... Davidson/ There is a page in your report there that deals with the traffic service issues. The portion of Dubuque Street extended north of 1-80 is the highest volume secondary road in the county .... It is about 5,000-6,000 vehicles a day. What we have been able to determine... it is manageable ..... The amount of volume that our model showed actually being diverted from north Coralville coming into Iowa City on this is fairly moderate .... Vanderhoef/ Question is whether we choose to cut another road through there or have that same amount of traffic use 1-807 Davidson/ Or Hwy 6, right, those being the two alternate routes. Vanderhoef/ 80 is really so close. Davidson/ 80 is close and 80 is improvements over the next 5-10 have 6 lanes .... scheduled for some capacity years .... eventually it will Norton/ Does your traffic counts assume any development in that section that we are talking about right now? There are some small pockets of neighborhood commercial type of development that they also show in that area... They don't have high density or high intensity commercial zoning slated for that area in their development plan. Kubby/ ... why do such a major construction project? Vanderhoef/ From the Iowa City side I question it at this point. What speed are they talking about? Davidson/ We are talking about a facility similar to Mormon Trek Blvd... Scott Blvd .... 30 to 35 would be the posted speed likely. Vanderhoef/ .... capability for a four lane at a later date. Lehman/ ...access to 80 is extremely limited ..... I guess I have no problem protecting Coralville .... We are just saying we are going to reserve this in case we find we have to do it. Kubby/ It also sends a message that it is out there and there becomes pressures to do it .... There is five of us who go to JCCOG ..... kind of sets the template for what happens here .... Davidson/ I do see that it is beneficial that you will know what is happening at JCCOG by the time you consider it as a council. Norton/ What do you anticipate .... Davidson/ That is residential zoning in the county right now. Norton/ .... where this road is going to come in? Davidson/ There has been nothing requested by Iowa or Coralville or any other entity in JCCOG to take the road further east .... There is some nice property. With arterial streets... we like them to connect with arterial streets at the other end .... Thornberry/ Nov/ We have all kinds of streets that don't go straight through. Kubby/ ITEM NO. 6b. Consider setting a public hearing for March 26 on an ordinance amending the Zoning Chapter by changing the use regulations of an approximate .14 acre parcel located at 24 N. Van Buren Street from RM-44, High Density Multi-Family Residential, to R/O, Residential/Office. (REZ95-0016) Davidson/ Karin and Bob are both at the Joint P/Z HCD meeting .... Consider setting a p.h. on a rezoning...N. Van Buren Street from RM-44 to R/O. ITEM NO. 6c. Public hearing on an ordinance amending Title 14, Chapter 6, "Zoning," Article H, "Industrial Zones," to allow the outdoor storage of recyclable materials in the I-1 zone as an accessory use to a recycling processing facility by special exception. Davidson/ Item c. is an amendment to the Zoning Ordinance. A p.h. is what you will be doing... allow outdoor storage of recyclable materials in the I-1 zone. This would be permitted by special exception..° case by case basis .... response to City Carton concerns .... Nov/ .... What is pelletizing? Davidson/ Pelletizing is a process by which ..... paper .... plastic... The pellets are used for fuel and they are sold to electric cooperatives and used for fuel. Nov/ .... I don't see how those pellets are more secure from wind gusts than a sheet of paper .... more dense but I still think that if you have pellets that are not in containers... not sealed... they would be blown .... Davidson/ .... They are mixed with something .... Nov/ .... I don't understand why this ordinance is preventing litter by pelletizing. So we need to find out. Nov/ I think if the pellets were stored outside and if they were not in a covered container, they would be blown. Lehman/ .... it is far more dense but nothing like paper. Nov/ .... I would like it clarified. Norton/ Nov/ It is to their advantage to keep the whole thing from blowing away .... Davidson/ I will see if our Solid Waste Management Planner knows anything more about pellets and their potential to blow. Nov/ Also the kind of container .... council/ (All talking). Davidson/ I am not aware that there has been a problem but we will take the up. ITEM NO. 6d. Public hearing on an ordinance amending Title 14, Chapter 6, "Zoning," to allow temporary real estate sales centers in residential zones. Davidson/ This is a p.h. on an amendment to the Zoning Ordinance to allow temporary real estate centers in residential zones. They would be allowed as provision uses in RS, RM and RFBH zones subject to some requirements. There has been one change in this .... Once 10% or less or five or less, whatever is least .... Intention is that they have not been established as permanent offices. Nov/ I would like to amend part of this because the way the restriction on employees is worded. It is kind of negative and I think it could be more positive. I want to say, "employees shall be limited to the minimum number needed to show and sell the dwelling units within the same development," rather than more than this is prohibited. Public hearing on an ordinance amending the Conditional Zoning Agreement for the D&L Subdivision, located southeast of the intersection of Highway 1 and Sunset Street, to eliminate the requirement to provide access to property to the south. (REZ96-0002) Davidson/ P.h. on an amendment to a CZA for D&L Subdivision, the area south of Mennards .... airport will not relocate .... now know what is going to happen to the additional lots down there. We are comfortable with this being deleted. Nov/ Norton/ What happens if there is some commercial development on the airport property? Nov/ That particular location will not be developed...extend runway through there. ITEM NO. 6f. Public hearing on an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article K, entitled "Environmental Regulations," Section 1, entitled "Sensitive Areas Ordinance," Subsection I, entitled "Steep Slopes," to allow consideration of development activities within areas containing previously altered slopes. Davidson/ P.h. on an amendment to the Zoning Ordinance regarding steep slopes in the Sensitive Areas Ordinance. You have quite a bit of discussion...The most significant change is in the definition of an altered steep slope. Holechek/ Right, we have actually created a definition of altered steep slope rather than having it be self defining as it previously was presented. ITEM NOo 6g. (First consideration) Davidson/ Then Item g. is first consideration. Kubby/ I would ask people overnight to re-read the whereas. I am very hesitant to support this even with a case by case basis strategy which I think is a very reasonable strategy. The third whereas says that these altered slopes can be designed to protect the public from injury and property damage. Any slope can be designed... we decided slopes of this steepness are pretty steep and they are important to protect from having them be cut into .... I am kind of tending to say no to the amendment because this distinction is not clear in my mind .... I still will value that slope and the eco-system that has developed on that slope. Norton/ That is a big issue you are bringing up .... Kubby/ If someone comes in and they want to develop a lot that is really not big enough for the project .... that they will ask for an amendment .... on a natural slope as long as the engineer geologist says that cutting into it won't de- stabilize it, will we amend the ordinance. We value of the protection of the steepness of that slope and the distinction between altered and unaltered isn't making sense to me at this point. Davidson/ As drafted these plans would go through P/Z and council .... for consideration. Kubby/ Davidson/ Item f. is the hearing and g. is the consideration. Kubby/ Thornberry/ On the development activities in previously altered slopes, Kevin Kidwell in his memo requested a expedited consideration for the use regulations change and also for his development ..... i. requires h.- Nov/ If we defer the ordinance we also have to defer the development plan. Thornberry/ My goodness. Thornberry/ The guy is trying to get a building built that has been recommended by staff and by P/Z but it is by an altered slope. Kubby/ It will be cutting into an altered slope. Norton/ That is a big precedent .... Thornberry/ You dig a hole and you pile dirt next to it, that is am altered slope. Kubby/ And over time it becomes part of the urban landscape .... becomes a stable part .... Lehman/ I know what you are saying. Let's see what comes up tomorrow night. IT~ NOo 6h. Linn Street. Davidson/ Items h. and i. are the p.h. and ordinance consideration for rezoning from PRM to PRM Sensitive Areas Overlay for the Kidwell project .... Bob is more familiar with it than I am. It does require the previous item to be implemented. I didn't get a sense that we weren't moving forward and .... these decisions through the mail I think ought to be done at a meeting .... Nov/ I think we need to focus a little bit. Baker/ I don't want to walk in and say that a majority has decided that we are only going to discuss the 6:00 AM to 9:00 PM fixed route .... out to do it at a public meeting. Kubby/ For me the bigger thing is that we decide that not in isolation from each other ..... doesn't give me any chance to persuade or be persuaded... I think this is a good tool to have individuals focus to bring to a meeting. I feel very uncomfortable about checking this off and turning it in .... Nov/ This is not to vote, this is to discuss ..... Kubby/ Then I encourage everyone to check everything. Nov/ I think we need to focus... time to get moving. Lehman/ .... We have got a city staff .... I would really like to see Joe Fowler and his folks come up with alternate proposals with a recommendation .... rather than for us to try and design routes .... I think that Joe and his folks can do that... pros and cons of various proposals .... make our decisions based on concrete proposals rather than items that we really don't know about .... Nov/ However, what they have proposed is closing everything at 7:00 and then they proposed closing everything at 9:00 and the council has said no to both of those proposals. Kubby/ We did not say no to the latter proposal. Council/ (All talking). Nov/ Sorry, I thought that is what I heard. Thornberry/ I think the big issue I think we need to decide... is what do we want as a transit system for Iowa City .... Once we have that nailed down as a policy statement for the city transit, if we don't need blanket coverage then we can go to something else .... arterials .... Norton/ ...are some details that I think we have reached some agreement. I thought we have made a fair amount of progress .... Nov/ Can we agree that staff will do something with routes? Baker/ Nov/ Kubby/ What we need to do is point to a map and say that is the kind of service we want .... Thornberry/ We have to start with a policy statement as to how much service we are going to be offering our customers. Kubby/ Maybe we need a meeting that the only topic of that meeting is transit .... Thornberry/ What do we want to give our customer .... Baker/ This kind of survey .... Thornberry/ Nov/ Do whatever you want with this. This is just an idea to help us focus. Norton/ Nov/ $44- is the number. Norton/ Where did I hear $33 sometime? Atkins/ I think he used the number when he was calculating night time service .... he pulled out certain factors. Nov/ ...includes all of our costs. I think we need to pay respect to those. Baker/ .... budget crunch .... Kubby/ ...realities of money... close as you can get to that policy statement. Nov/ We did put in a final number in the budget. Kubby/ We put in $100- But the thing that we got from Steve in the memo that you outlined it says $80- and I am concerned about that .... I would feel more comfortable if that number were amended to $100- because that is what we decided as the maximum .... Baker/ On discussion at our informal meeting 4 of March...set aside some time that night. Atkins/ 4th is pretty well packed. Council/ (All talking). Kubby/ We directed the city manager to put $100- maximum so that it wasn't taken from some place else .... Nov/ You are not changing the budget except the contingency. Kubby/ It is just shifting in terms of where the money is earmarked in terms of our budget discussion. Steve put it down to $80- Atkins/ Go ahead with your budget discussion. What we will do is amend the budget later on. Don't worry about it right now .... Kubby/ Atkins/ I would be happy putting a memo in file explaining that. Nov/ I spoke to a couple of legislators on Saturday. The increase on Transit Levy has gone out of committee .... voted out to the floor. They don't expect it to go very far .... Even Des Moines is not pushing for an increase in the levy .... Kubby/ Atkins/ I have an update memo I have prepared for you tonight. There are a couple of things that I remember differently. For example, $7.50 for ten tickets, I thought that we decided that we would do strip tickets still but they would be discounted. Nov/ Discounts are below that. We decided that there would be a ten strip and low income discounts are below that... If you are going to qualify for a discount, you have to qualify. Norton/ I thought there was a discount just for a strip ticket without- Nov/ I am sorry. I didn't hear that as a- Baker/ ...strip tickets- ... some bonus. Council/ (All talking). Atkins/ I thought you agreed to talk about this in another meeting. Kubby/ ...I want this to be factual that is why I am bringing that up now. Nov/ .... I did not hear that it was clearly decided. Kubby/ I thought it was as decisions .... four people who wanted to do that as a firm thing. Just like the $.75 fare and the (can't hear) as well as half price for SEATS. For lower income riders there would be a sliding scale that would allow people to have half price rides .... 50% waiver. Council/ (All talking). Baker/ I think Karen's point is those are not the decisions that we necessarily made. Kubby/ If we are using that as our guide for focusing discussion, I want the facts to be corrected on here. What I believe to be the facts .... Nov/ I tried to make notes of everything I heard and I thought the discounts on strip tickets was to be discussed. Kubby/ You can go back on the record and look. Atkins/ The budget is to bed. Nov/ It was my impression... get the new schedules on the buses by June 1 ..... Council/ (All talking). Baker/ I did want to remind everybody we need to talk about sales tax sometime. The sooner the better. Nov/ Do people want to set an April date today or wait until we come back? I would like people to fill this out again and then I will confirm that this new thing that we are doing is true ..... Council/ (Discussion regarding Water Festival schedule). Kubby/ I will call and confirm everything and get you a schedule .... Kubby/ We had a memo in our packet from the Melrose Avenue Neighborhood Association asking about some cross walk information and I guess I want to request that Jim Brachtel comment on this so that we have the benefit of his reaction to this when we talk about specifications ..... Nov/ ..... say there will be cross walks. The particular relocation of that cross walk should not be decided... Kubby/ ...in some point in the future give us specific feedback. Atkins/ Fine, got a note. Kubby/ We got his memo from CVB saying they were planning on doing the grant program this year without 25%. We want you to give us our full 25% funding. I just wondered if 25%- I wanted to know if this persuaded anybody? Norton/... I still would be in favor of giving them their full allocation. Nov/ We would then have to find the money elsewhere because we have made the commitment for $10,000 for other purposes. Thornberry/ What was that $10,0007 Norton/ $5- for Arts and $5- for the Jazz .... Thornberry/ I didn't remember the Arts. I remembered the Jazz. Nov/ Yeah, we did both of them .... Kubby/ Last council time I had was the information about the cost of the Neuzil Tract being $43,000 an acre and at what point will we discuss making a counter offer or- Vanderhoef/ The Jensen Tract likewise. Thornberry/ Nov/ Question the numbers .... they said the numbers were comparable .... Kubby/ I guess I just bring it up to say the letter says this has not been discussed yet. Just to remind us to put it on the docket. Vanderhoef/ It was discussed at P/R. Atkins/ P/R has a position that they are not interested. Vanderhoef/ I talked today to Terry. Kubby/ Nov/ I think we need to receive a formal recommendation from the commission... agree or disagree with it. So far all we have is the minutes. Atkins/ Okay. I will have that scheduled.
