(1) Broadband Telecommunications Commission - April 1 Recommendations to Council: Accept TCI's proposed cure in lieu of a fine of $250 per day for failing to meet the system upgrade deadline contained in the franchise agreement. The cure is outlined in TCI's letter of March 23, 1998, in which TCI will pay a total of $46,000 and not increase subscriber's rates in areas in which the system is upgraded before the entire system upgrade is complete. (1) CONSIDER A MOTION SETTING A PUBLIC HEARING ON APRIL 28 TO DISCUSS THE FY99 ANNUAL ACTION PLAN, INCLUDING THE FY99 COMMUNITY DEVELOPMENT BLOCK GRANT {CDBG) AND HOME INVESTMENT PARTNERSHIP PROGRAM {HOME) BUDGET, FOR IOWA CITY, IOWA. Comment: The Housing and Community Development Commission will be submitting the FY99 Annual Action Plan to the City Council on April 28. The U.S. Department of Housing and Urban Development requires a public hearing and approval of an Annual Action Plan by the City Council for this funding. (2) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR APRIL 28 ON PROPOSED AMENDMENTS TO THE FLOOD INSURANCE RATE MAPS, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID MAPS ON FILE FOR PUBLIC INSPECTION. Comment: The public hearing is on proposed amendments to the Flood Insurance Rate Maps that are used as a tool for administration and enforcement of the Flood Plain Management Ordinance. The amendments to the maps include revisions of existing maps and expansion of area mapped. After the public hearing the maps will be forwarded to the Federal Emergency Management Agency for review and approval. (3) CONSIDER RESOLUTION OF INTENT TO CONVEY 2258 RUSSELL DRIVE, ALSO DESCRIBED AS LOT 204, PART 5, HOLLYWOOD MANOR ADDITION, TO THE TENANT AND SET'rING A PUBLIC HEARING FOR APRIL Z8. Comment: The Iowa City Housing Authority under its Tenant-to- Ownership Program, proposes to sell 2258 Russell Drive to the present tenant. The tenant has agreed to purchase 2258 Russell Drive for the appraised value of $100,000. Iowa State Bank will finance the first mortgage for the amount of $50,000. The City will carry a silent second mortgage in the amount of $50,000. This sale provides the opportunity for a low-income family to obtain ownership of their own home. April 7, 1998 qS- (4) City of Iowa City Page 4 CONSIDER A RESOLUTION OF INTENT TO CONVEY A VACATED PORTION OF THE FORMER BENTON STREET RIGHT- OF-WAY BETWEEN RIVERSIDE DRIVE AND THE IOWA RIVER WHICH IS ADJACENT TO UNDER TIRE SERVICE TO HENRY LINDER AND SETTING A PUBLIC HEARING FOR APRIL 28. Comment: A portion of the Iowa River Corridor Trail has been designed along the Iowa River on property where Linder Tire Service is located. The owner of this parcel of property, Henry Linder, as trustee, has agreed to convey the necessary property for the trail to the City in exchange for the City conveying to him an approximately equal amount of property the City owns south of Linder Tire Service where Benton Street was formerly located. The City Council is currently considering an ordinance to vacate this property. e. Resolutions. {1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A PARTIAL RELEASE AGREEMENT CONCERNING THE STORMWATER MANAGEMENT EASEMENT AGREEMENT FOR HIGHLANDER DEVELOPMENT, FIRST ADDITION, IOWA CITY, IOWA. Comment: The Subdivider's Agreement and Stormwater Management Easement Agreement for Highlander Development, First Addition, obligate the Developer to construct a stormwater management facility. This obligation constitutes a lien and a cloud on the title to the lots in the Subdivision. The Developer has substantially completed the stormwater facility, but a general release of the facilities is not yet appropriate. This Partial Release Agreement removes the cloud on the title to the lots in the subdivision while protecting the City by establishing an escrow fund which will be retained until the facility and further development which may impact the same are completed. (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND HAWKEYE STATE BANK, IOWA CITY, IOWA FOR THE PROPERTY LOCATED AT 1027 EAST MARKET STREET, IOWA CITY, IOWA. Comment: The Hawkeye State Bank, Iowa City, Iowa has requested that the City approve a Subordination Agreement for 1027 East Market Street. On September 3, 1997, the owner of the property received a $10,O00 Mortgage through the City's Housing Rehabilitation Program. The Hawkeye State Bank has refinanced a new first mortgage to the property owner for the amount of $52,000. The property is assessed at 9101,OO0 which provides enough equity to cover the City's second lien position, of which was the City's original position. April 7, 1998 City of Iowa City Page 5 (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING A RENTAL REHABILITATION LOAN FOR PROPERTY LOCATED AT 1117 EAST COLLEGE STREET, IOWA CITY, IOWA. Comment: The owner of the property located at 1117 East College Street received a $7,500 loan through the City's Rental Rehabilitation Program on August 25, 1987. The financing was in the form of a 10-year, no-interest Declining Balance Loan. The terms of this loan were satisfied February 25, 1998; thus, the lien can now be released. (4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING TWO REHABILITATION AGREEMENTS, TWO PROMISSORY NOTES AND TWO MORTGAGES FOR PROPERTY LOCATED AT 143 POTOMAC DRIVE, IOWA CITY, IOWA. Comment: The owner of the property located at 143 Potomac Drive received $13,574 loan through the City's Housing Rehabilitation Program on September 22, 1994,and August 2, 1995. The financing was in the form of two Rehabilitation Agreements, two Promissory Notes and two Mortgages. The terms of these loans were paid off March 26, 1998; thus, the lien can now be released. f. City of Iowa City PUBLIC DISCUSSION (ITEMS NOT ON THE AGENDA). ITEM NO. 6. PLANNING AND ZONING MATTERS. Public hearing on an ordinance conditionally changing the zoning designation on a l O-acre tract located on the south side of Melrose Avenue and west of West High School from Low Density Single- Family (RS-5) to Planned Development Housing (OPDH-8) to permit an 80 dwelling unit retirement community. (REZ98-0002) ~7~_-~v.~.~ v~f I n~n Comment: At its March 5 meeting, by a ote o 6-0, the Planning ahoY' Zoning Commission recommended approval of the requested rezoning subject to agreements and easements for the provision of sanitary sewer service and compliance with building and site design plans. (REZ97-0011)~__~)~ ~~ Comment: At its March 5 meeting, the Planning and Zonfng Commission, by a vote of 4-2, recommended denial of the requested rezoning due primarily to concerns with the scale of a proposed multi- family building on the site. Staff recommended approval of the requested rezoning subject to conditions in a memorandum dated February 26. The applicant revised the request for a lower density and requested reconsideration by the Commission. At its March 19 meeting, the Commission agreed to reconsider this item on April 2. Conditionally changing the zoning designation on approximately 41 acres located between Lower West Branch Road and Court Street extended, approximately 4/5 miles west of Taft Avenue from Low Density Single-Family Residential {RS-5) to Medium Density Single- Family Residential (RS-8) for 29.1 acres and Low Density Multi-Family Residential (RM-12)for 11.9 acres. (RE.~7-00.~ Comment: At its February 19 meeting, by a vote of 6-0, the Flanning and Zoning Commission recommended approval of the requested rezoning subject to a conditional zoning agreement outlining the applicant's obligations regarding the extension of Court Street and requiring approval of a future OPDH application for each parcel prior to development of the property, to be prepared and reviewed in accordance with the neighborhood design concepts contained in the Comprehensive Plan. Staff recommended approval subject to conditions in a February 13 memorandum to the Commission. Changing the zoning designation on approximately 24.12 acres from Interim Development (ID-RS) to Sensitive Areas Overlay-5 (OSA-5) and approving a preliminary Sensitive Areas Development Plan for property located at the east termip~s~of Hicl~ory Trail. (RE~97-0007). Comment: At its February 19 me~,ting, by a vote of 6-0, the Planning and Zoning Commission recommended denial of the requested rezoning due primarily to concerns about inadequate secondary access. The Commission's recommendation is consistent with the staff recommendation set forth in a memorandum dated February 13, 1998. Protest petitions have been filed by neighboring property owners representing more than 20% of the property within 200 feet of the subject property, requiring a super-majority vote of the Council (6 of 7) to approve this rezoning. April 7, 1998 City of Iowa City Page 8 Consider an ordinance approving the preliminary OPDH plan for Walnut Ridge, Parts 6 and 7, a 66.68 acre, 20-lot residential subdivision located at the north terminus of Kennedy Parkway. {REZ98-0001) (First consideration) Comment: At its February 19 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the requested amendments of the OPDH plan for Walnut Ridge, Parts 6 and 7. Staff recommended approval in a February 13 memorandum. Action: 7~-~~r~//~~ /~ ~ Consider an ordinance amending Title 14, Chapter 6, "Zoning," Article E, "Commercial and Business Zones," Section 2, Neighborhood Commercial Zone (CN-1) regarding size restrictions on restaurants. (Second consideration) Comment: At its March § meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of amendments to the CN-1 Zone that establish the threshold for requiring a special exception at an occupant load of 100 persons. The Council has requested that the Planning and Zoning Commission consider a higher occupancy threshold of 130 persons rather than 100 persons. At its March 19 meeting, the Planning and Zoning Commission recommer~ded against an increase to 130 persons. (REZ97~ 0018) (Second consideration) Comment: At its February § meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the amended plan, subject to the extension of Shannon Drive to Rohret Road to provide vehicular access to the property prior to occupancy of the buildings. Staff recommended approval subject to conditions in its January 30 memorandum. Expedited consideration has been requested. (SUB97-0030) Comment: At its February 5 meeting, the Planning and Zoning Commission recommended approval by a vote of 6-0 of the preliminary plat for Lot 51, Walden Hills, subject to the approval of a revised Grading Plan prior to Council consideration. In a memorandum dated January 30, staff recommended approval subject to conditions. This resolution should be considered only upon the approval of item g. above, for which expedited consideration has been requested Action= ~.~,t~/~/~~-C~ ~~ Consider a resolution approving a final plat of a Resubdivision of Lot 51, Walden Hills, a 2.9 acre, 25-1ot residential subdivision located at the northeast corner of Shannon Drive and Irving Avenue. (SUB98-0004) Comment: At its March 19 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the final plat for Lot 51, Walden Hills, subject to the approval of construction drawings and legal papers prior to Council consideration of the final plat, and subject to approval of the preliminary plat by Council prior to its consideration of the final plat. In a report dated March lg, staff recommended approval subject to conditions. Action: ~z~Z~ ~_~_~~. ~/. ~~ Consider a resolution approving a final plat of Westcott Heights, an 84.12 acre, 31-1ot residential subdivision located in Johnson County on the west side of Prairie du Chien Road, % mile north of Newport Road. (SUB98-0005) Comment: At its March 19 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the final plat of Westcott Heights, subject to approval of the legal papers prior to Council consideration of the final plat, and that the requirement for a 60-foot wide right-of-way be modified to require 50 feet for Morel Circle and West Ridge Court. In a report dated March 19, staff recommended approval. Action: April 7, 1998 ITEM NO. 7. City of Iowa City Page 10 VACATING A PORTION OF FORMER BENTON RIVERSIDE DRIVE AND THE IOWA RIVER WHICH LINDER TIRE SERVICE. STREET BETWEEN IS ADJACENT TO Comment: A portion of the Iowa River Corridor Trail has been designed along the Iowa River on property where Linder Tire Service is located. The owners of this parcel of property have agreed to convey the necessary property for the trail to the City in exchange for the City conveying to them an approximately equal amount of property the City owns south of Linder Tire Service where Benton Street was formerly located. The property being vacated is not needed for access to other adjoining properties. This hearing complies with the state law requirement of a public hearing prior to enacting a vacation ordinance. Due to impending Department of Transportation deadlines for the Iowa River Corridor Trail project, staff requests that Council have first consideration following the public hearing. a. PUBLIC HEARING Action: ITEM NO. 8. Do CONSIDER AN ORDINANCE (FIRST CONSIDERATION) Action: PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE SOUTHGATE AVENUE AND WATERFRONT DRIVE PAVING IMPROVEMENT AND WEST PEPPERWOOD RELIEF SEWER PROJECT, ESTABLISHING ABOUT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project includes PCC paving, storm sewer, sanitary sewer, water main, and earthwork. Waterfront Drive will be improved south of Hy-Vee to the Hilltop Mobile Home Park. Southgate will be extended from Waterfront Drive to South Gilbert Street. The estimated construction cost is $845,000 and will be funded by Road Use Taxes and sewer revenue bonds. PUBLIC HEARING Action: CONSIDER A RESOLUTION APPROVING April 7, 1998 City of Iowa City Page 1t ITEM NO. 9. PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE IOWA RIVER CORRIDOR TRAIL PROJECT - BURLINGTON STREET TO NAPOLEON PARK, STP-E-3715(9)- 8V-52, AND DIRECTING CITY CLERK TO PUBLISH NOTICE. Comment: This project includes a 2.4 mile PCC and ACC trail, retaining walls, pedestrian bridges, and storm sewer. This trail is a part of the regional trail system. The estimated construction cost is $1,800,000 and will be funded by Federal STP funds ($750,000) and local Road Use Taxes ($1,050,000). PUBLIC HEARING Action: ITEM NO. 10. b. COMMENT: Phase I of Court Street extended consists of paving improvements from its east end (just east of Scott Boulevard) to the west line of Windsor Ridge Subdivision, a length of approximately 1,720 feet. Staff recommends continuing the public hearing to the April 28 Council meeting and deferring the approval of plans, specifications, form of contract, and estimate of cost to allow additional time to resolve design issues. a. Comment: The Iowa City Housing Authority, under its Tenant-to- Ownership program, proposed to sell 1417 Pine Street to the present tenant. The tenant has agreed to purchase 1417 Pine Street for the appraised value of $79,000. Iowa State Bank will finance the first mortgage for the amount of $50,000. The City will carry a silent second mortgage in the amount of $29,000. This sale provides the opportunity for a low-income family to obtain ownership of their own home. a. PUBLIC HEARING Action: CONSIDER A RESOLUTION AUTHORIZING Action: ITEM NO. 12. CONSIDER A RESOLUTION APPROVING THE FY99, 2000, 2001, 2002, AND 2003 OFFICIAL REPORT OF MUNICIPALITIES FOR THE STREET CONSTRUCTION PROGRAM FROM JULY 1, 1998, TO JUNE 30, 2003. Comment: The Iowa State Code requires that cities receiving allotments of Road Use Tax Funds submit a five (5) year program of proposed street construction and reconstruction to the Iowa Department of Transportation for their review. This report must be submitted to the IDOT by May 1 of each year. The report in no way binds the City to these projects or the timing, and modifications. can be made. A copy of the report is attached. City of Iowa City Page CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST AN IOWA DEPARTMENT OF TRANSPORTATION FUNDING AGREEMENT FOR THE CONSTRUCTION OF THE SUMMIT STREET BRIDGE RECONSTRUCTION PROJECT [BRM-3715( 13)--8N-52]. Comment: This agreement provides for an 80% Federal / 20% City funding split, up to a maximum amount in Federal funds of $850,000. This project involves the removal and replacement of the Summit Street bridge, which spans over the Iowa Interstate Railroad, and the removal and replacement of street pavement from Kirkwood Avenue to Sheridan Avenue. The preliminary estimated construction cost is $1,100,000. The local share of this project will be funded with general obligation bonds and road use taxes. CONSIDER A RESOLUTION APPROVING THE EXTERIOR SIGNAGE AT 112 SOUTH DUBUQUE STREET. Comment: At its March 30, 1998, meeting, by a vote of 3-2, the Design Review Committee recommended that the City Council approve the application with the consideration that of the two signage options presented only the signage with the light colored lettering and dark green background be approved. Since the sign is internally lighted, the majority of the members felt that the sign with the lighted colored background would be too bright for the area. Action: AUTHORIZING, AND THE CITY CLERK TO CONSIDER A RESOLUTION APPROVING, DIRECTING THE MAYOR TO EXECUTE AND ATTEST, AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND NEUMANN MONSON PC ARCHITECTS, TO PROVIDE ARCHITECTURAL CONSULTANT SERVICES FOR THE CONSTRUCTION OF THE SCANLON GYMNASIUM COMPLEX IN MERCER PARK. Comment: Additional professional architectural services are required to complete the design, bidding, and construction phases of this project, which is the construction of a 16,000 square foot addition to the Mercer Park Aquatic Center. It will include space for two basketball courts, three volleyball courts, and a multipurpose room.
