Staff: Atkins, Helling, Karr, Burnside, Trueblood, Yucuis. Davidson, McClure, Tapes: 96-32, side 2; 96-36, all. Review Zonin~ Matters 96-32 S2 ITEM 90. 5a. Consider an ordinance amending Title 14, Chapter 6, "Zoning," Article H, "Industrial Zones," to allow the outdoor storage of recyclable materials in the I-1 zone as an accessory use to a recycling processing facility by special exception. (First consideration) Davidson/ Item a. permit outdoor zones. is an amendment, first consideration .... to storage if recyclable materials in industrial ITEM 90. 5b. Consider an ordinance amending Title 14, Chapter 6, "Zoning," to allow temporary real estate sales centers in residential zones. (First consideration) Davidson/ First consideration of an amendment to the Zoning Ordinance to permit temporary real estate sales centers in residential zones. In response to one request council made last week we did send a letter to the Homebuilders asking how they or if they cared about the one change that was made and we did not hear back from them. The letter was sent. ITE~ 90° 5c. Consider an ordinance amending the Conditional Zoning Agreement for the D&L Subdivision, located southeast of the intersection of Highway 1 and Sunset Street, to eliminate the requirement to provide access to property to the south. (REZ96- 0002) (First consideration) Davidson/ Item c. is first consideration of an amendment to the CZA for D&L subdivision to eliminate the requirement to provide access to the property to the south. Norton/ Is that going to be combined? Vanderhoef/ This is first consideration, you can't. Norton/ I am sorry, first consideration. We have got to combine later .... This one says expedited consideration asked but that will come later, I take it. Thisrepresents only are~onably accuratetranscription ofthelowa City council meeting of March 4,1996. WS030496 March 4, 1996 Council Work Session Page 2 Davidson/ The applicant has also requested expedited consideration on that one. ITF_A~ NOo 5d. Consider an ordinance amending Title 14, Chapter 6, entitled "Zoning," Article K, entitled "Environmental Regulations," Section 1, entitled "Sensitive Areas Ordinance," Subsection I, entitled "Steep Slopes," to allow consideration of development activities within areas containing previously altered slopes. (Second consideration) Davidson/ Item d. is second consideration of a Zoning Ordinance amendment to amend the steep slope section of the Sensitive Areas Ordinance. Nov/ This is one that we can potentially take care of tomorrow. If there are only six of us, we need all six of us to agree to do that. Kubby/ I don't have any objection. Lehman/ Naomi, Larry is not here tonight. It will take 6 out of 6. Karr/ I did speak to Larry this afternoon... Larry... inclined to waive consideration tomorrow .... Lehman/ My feeling is that we should provide for a special meeting on Wednesday morning at 8:00 in case we do not have the votes tomorrow night to expedite this ..... administrative decision .... Like to see that we not be a stumbling block for a development to take place in 2-3 weeks .... have to schedule s meeting for Wednesday morning. Kubby/ Karr/ We could cancel it. Norton/ What is the concern? I thought we had six. Lehman/ I won't be here. It is Larry .... I have to leave tomorrow morning .... insurance that we do expedite tomorrow or we have a meeting on Wednesday. Nov/ I really would prefer not to do this at 8:00 AM. There will be five of us who will be going to JCCOG at 3:30. Can we schedule this meeting at 3:00? Lehman/ Regina plays basketball in Des Moines at what time, Marian? This represents only e reasonably accurate transcription of the Iowa City council meeting of March 4, 1996, WS030496 March 4, 1996 Council Work Session Page 3 Karr/ They tip off at l:00 ..... Deputy could do it. The problem is I don't know what Larry's schedule is and you need Larry .... You only need four votes, though. You don't need six if you are not collapsing. You only need four. Lehman/ Nov/ We have five of us at JCC0G. Thornberry/ If we are collapsing and we are all agreed that it can be collapsed, then there are six votes. But Larry said what? Nov/ Larry wasn't sure. Norton/ Karr/ You need 24 hours notice. You need to set it tonight. Nov/ Lot easier if we didn't have to make two trips into town .... talking about a five minute meeting .... Thornberry/ This is a back up plan. Nov/ Kubby/ How many people can make it at 3:00? We need a minimum of four to show up. Nov/ We have got four .... Let's say 3:10. Karr/ We would know tomorrow night.. We could announce it right away if we cancelled it. Kubby/ Good idea, Ernie. Nov/ We just have to post it. Karr/ And we just need six to collapse, not necessarily six to vote favorably also. So 3:10, Nov/ Yeah. Karr/ Okay. Norton/ Two items that are Nov/ Two Wednesday as a backup. going to require this, d. and e. both. of them can be done in five minutes. Thisrepresents only areasonably accuratetranscription ofthelowa City council meeting of March 4,1996. W$030496 March 4, 1996 Council Work Session Page 4 IT~! NO. 5e. Consider an ordinance amending the Zoning Chapter by approving a Sensitive Areas Development Plan and changing the use regulations from PRM, Planned High Density Multi-Family Residential Zone, to PRM-0SA, Planned High Density Multi-family Residential - Sensitive Areas Overlay Zone for a 0.32 acre property located at 517 S. Linn Street. (REZ96-0001) (Second consideration) Davidson/ Second consideration of Kevin Kidwell's Zoning Ordinance amendment from PRM to PRM-OSA. Norton/ The only question I have here... staff had recommended deferral of this pending several things and I didn't know whether those had ever been cleared up. There were three items. Lehman/ Dee, I think you are exactly right... administrative things that he has to work out with staff. It has nothing to do with our vote. If he can't work it out and get a building permit .... Davidson/ Bob did not indicate this morning to me anything outstanding that he wanted me to attention. that there was bring to your Nov/ We have already done first consideration. Norton/ I didn't see in writing any assurance that they could in fact fiddle with that slope without causing troubles .... Davidson/ I will check with Bob tomorrow and he will be at the meeting tomorrow night but I am not aware that there was anything outstanding. Larry says he is not aware either. ITF&! NO. 5f. Consider a resolution approving a preliminary plat for Newport Ridge Subdivision, a 12-1ot, 25.5 acre residential subdivision located on Newport Road, ¼ mile east of its intersection with Prairie du Chien Road. Davidson/ Item f. is one you have not seen. It is a consideration of a resolution approving a preliminary plat for Newport Bridge Subdivision, 12 lot, 25.5 acre subdivision out on Newport Road. This plan is in compliance with the existing Fringe Area Agreement which calls for agriculture or residential development in this area. We received the grading plan for this this afternoon and the applicant was told that if Public Works has time to review it before tomorrow that there was a chance that you would consider it tomorrow night. This represents only a reaeonably accurate transcription of the Iowa City council meeting of March 4, 1996. WS030496 March 4, 1996 Council Work Session Page 5 Otherwise we would recommend deferral until your meeting on the 26th. Norton/ This also has some deferral matters about the outlots and access .... certification of fire protection. Nov/ Those are administrative. Davidson/ The grading plan is the only thing that we feel that would hang it up your consideration tomorrow night. Nov/ Those are discussed at the P/Z meeting and staff will be sure that the plat is changed before it gets to us. Kubby/ Even through the version of the staff report doesn't have all the deficiencies taken care of? Norton/ Will we have another shot at this is what I am saying? Nov/ Yeah .... Norton/ I never understand. We are blessing things that are not complete. Davidson/ The preliminary plat is a resolution. It is not multiple considerations like an ordinance. Norton/ Nov/ It would not come to us if those things had not been taken care of. We just wouldn't have it on the agenda. So the only thing pending that could cause us to defer is the grading plan because that is the only one that is mentioned on our agenda. The others would have been taken care of before it came to us. Davidson/ We wouldn't put it on the agenda if there was something substantially outstanding. I assume those have been cleared up. We will confirm that. Kubby/ Typically... development .... we get planning staff reports about a Nov/ Kubby/ One thing that I in the Fringe area ordinances, right? continually don't understand about things is that they have to meet our subdivision So if the Sensitive Areas Ordinance is Thisrepresents only areasonably accuratetranscription oftholowa City council meeting of March 4,1996. WS030496 March 4, 1996 Council Work Session Page 6 within our subdivision ordinance, why don't they have to comply? Davidson/ Zoning Ordinance ..... Kubby/ Zoni subdiv' ' .... ng, not lSlOn .... Venderhoof/ The difference between the two. Nov/ It might help for some people if we said, "Consider a resolution approving preliminary plat within Johnson County for Newport Ridge" so that we know this is not a city plat .... Thornberry/ Naomi, I am wondering if I should abstain from this. I know Luke Van 0rden pretty well. His mother taught me how to fly .... I trained their dogs to take care of her sheep. Kubby/ Do you have any financial interest? Thornberry/ No. Burnside/ (Can't hear). No .... Norton/ Davidson/ Anything else about this? I will check with Bob about stuff being taken care of but that is my understanding. Shall we move on- Kubby/ I have another zoning thing. When are we going to see the Galway Hills plat? Dayideon/ We just had a meeting with the developer last week .... There are some things that staff has met with Larry about that apparently Larry has not finished and not gotten to the property owners yet because they weren't aware .... of the things that we had requested Larry to do. So it will be a little while, think. Thisrepresents only areasonablyeccuratetranscrlptlon ofthelowa CIW council meeting of March 4,1996. WS030496 March 4, 1996 Council Work Session Page 7 Burlington and Gilbert Intersection Reconstruction 96-32 S2 Davidson/ Items 6 & 7 are on your agenda tomorrow night. P.h. and then considering a resolution approving the plans, specifications .... reconstruction of the intersection of Burlington Street and Gilbert Street. This is a project that we have had in the works for sometime. I think the reason we have it on your agenda for discussion tonight is that you will see from the information in your council packet that staff, because council approved the Near Southside Design Plan in December, we have taken it on ourselves to prepare basically an alternate to the bid specification for design elements related to the Near Southside Design Plan. You have some information summarizing the significance of those elements. You also have a memo from Karin in your packet sort of detailing the rationale... The elements consists of brick accent elements in the are between the sidewalk and the curb, brick crosswalks... and conduit placed in the sidewalk .... Those are essentially the three elements that are in there. These things are consistent in the design that has been used in the city plaza area d.t. There is also some consistency with the areas around the city's parking ramps ..... We will have the options to put some plantings in .... IDOT has given us approval within the area between the property line and two feet in to do some plantings if we decide. The Design Review Committee has included a memo in your information endorsing .... Laura is here... The other thing that probably you will want to consider is that staff is working with some private property owners further up the street: Jim Clark... and Frieda .... to try and get some of these same types of design elements incorporated into their projects... Both of those people have been looking forward to working with us on those. I think clearly your decision about this will set the tone for this corridor and our ability with those private entities .... We will try to make sure it is consistent up and down the street .... Jeff McClure is here from Engineering division .... plans .... Thornberry/ I have two quick questions. One is how well will the bricks hold up under the stringent truck traffic...? Davidson/ Jeff has put a lot of work into essentially explaining to IDOT what it is we are going to do and if fact, it will stand up to the pounding of an arterial street state highway which is what Burlington Street is and Jeff has been able to do that successfully. The IDOT has indicated that they will approve that. Thlsrepresents only areasonably accurate tr8nscrlptlon ofthe Iowa City council meeting of March 4,1996. WS030496 March 4, 1996 Council Work Session Page 8 Thornberry/ Davidson/ They are clear with it right now .... on Clinton Street... we have had fairly good success with the brick crosswalks. We are proposing to use a design with that brick that I think will be more favorable .... We will have something that will be better on Burlington Street .... Jeff has been successfully and is comfortable with what is proposed for that .... Thornberry/ The second question is regarding between the street and the sidewalk, you are proposing brick? Is this laid brick with mortar between the bricks or is this sand between the bricks? Davidson/ No, this brick, Dean, will be placed on a concrete base. Thornberry/ Nov/ I had concerns about the crosswalks on Washington Street where the buses have gouged a little curve into the brick. Rick said they are going to do something different from what we had on Washington Street ..... Davidson/ Jeff showed me an article...where they have even more severe weather than we do... they have done a number of d.t. streets... It has been very successful for them. Norton/ I thought those little humps might be called traffic calming measures. Council/ (All talking). Norton/ So they are going to be functional, not just gaudy .... Davidson/ There was a letter we received today with some concern about the accessibility of pedestrians in this area and we feel like what we have proposed, if anything, will hopefully enhance the area for pedestrians .... We have the same traffic light system for people to cross. The crosswalks will be more clearly delineated .... wider sidewalks.. drainage will be improved... more vertical separation between sidewalk and the street .... overall it will be an improvement for pedestrians. ¥anderhoef/ How wide of sidewalks? .... Jeff McClure/ Six feet. We are going to have- I can show you a diagram. Six foot sidewalk. But there will an additional paved Thisrepresents only a reasonably accurate transcription ofthe Iowa City council meeting of March 4, 1996. W8030496 March 4, 1996 Council Work Session Page 9 area with the brick that functions as a sidewalk even if it is not designated as a sidewalk. Nov/ So the total is how dense? McClure/ (Refers to diagram of intersection). We are going to have a five foot sidewalk on the eastside ..... (refers to diagram). We are go from an existing five foot sidewalk to a six foot sidewalk. Burlington Street will have six foot sidewalks down both sides .... Gilbert on this eastside will also have a six foot sidewalk and Gilbert on westside will also have a six foot walk. Currently these are four foot walks (refers to map) ..... Nov/ Currently we have in front of the Rec Center is a six foot walk. McClure/ (Refers to diagram). Vanderhoef/ McClure/ Parkway between the curb and the sidewalk? There is going to be 3 1/2 feet on the west side .... about 5 feet on this side .... (refers to diagram)... Norton/ What do accents mean? .... McClure/ A visual delineation between the sidewalk and the street. It could be grass .... brick pavement .... It is going to be brick pavers. Davidson/ Copy of the Near Southside Plan... page 18 is kind of a concept of Burlington Street ..... idea of what we are trying to do on Burlington Street ..... IDOT made us move the lights further back .... Brick treatment .... This kind of design, Dee, is used already in front of the parking ramps. McClure/ Right now there is 4 1/2 or 5 feet... tough for grass to grow .... Anywhere where we had 5 feet or less .... we wanted to put something solid in .... brick pavers... Along this side (refers to diagram) we have got about 7 feet and we may be able to put plantings there... trees if DOT says okay ..... Norton/ I had in mind a cyclone fence there .... Vanderhoef/ Let's go back up around the Rec Center .... with of sidewalk is 6 feet and then you go down to 1 foot right in This represents only a reasonably accurate transcription of the Iowa City council meeting of March 4, 1996. WS030496 March 4, 1996 Council Work Session Page 10 front of the door. McClure/ The parkway is 6 feet. It is not 1 foot from the door .... then the street .... Vanderhoef/ .... so we got like 7 feet from the front door. McClure/ To the bottom of the steps. Vanderhoef/ I am real concerned because we have had a drop off area there .... real active space. This is a meeting place .... Not sure we are taking acre of the entrance to our public building. McClure/ There really is no parking or stopping allowed on Gilbert Street .... Anybody can get into the Rec Center off of Burlington Street .... parking lot and are safe to drop people on. Same complaint of a shop owner .... saying that they drop patients off there. We can't design for people doing illegal things .... They have parking in back of their office building. The Rec Center has parking off of Burlington Street .... I don't like that squeeze there (refers to diagram) ..... There really shouldn't be any drop off. Vanderhoef/ Trueblood/ (In audience-can't hear). When Community Theater and Footlighters or something like that has ..... curb there is wide enough to do that right now ..... Entrance through the craft room .... Vanderhoef/ Can you get a loading zone done for us on College Street... designated for that purpose? Trueblood/ Can't answer that. Kubby/ There is a kind of a handicapped parking and loading zone right there... Vanderhoef/ Davidson/ There is a bus stop right there ..... Kubby/ People load and unload from that door all of the time .... summer camp... Hospice .... Vanderhoef/ That door is frequently locked, too .... It is not like This represents only a reasonably accurate transcription of the Iowa City council meeting of March 4, 1996. WS030496 March 4, 1996 Council Work Session Page 11 the front door... If there was some loading and some thought about this. Trueblood/ I have to be careful what I say. It would be nice admittedly if we had a nice little pull off right in front of the door which we have never had .... Even the width of it right now wouldn't allow for us to do that legally .... It won't interfere with the pedestrian traffic .... Just a matter of education bringing them around to that craftroom door and that sort of thing to do their loading and unloading. Kubby/ Davidson/ A couple other things... expense. One of the reasons that our cost estimates is a little higher... we are going to be keeping the intersection open during construction and that makes it a lot more expensive .... Jeff indicated to me...opportunity to, if the alternate bid is something that you want to go with, deduct some off of the base bid for expense that will be saved... because we are doing to alternate bid. Can't put a number on that at this time... Kubby/ I know at one point there as a lot of discussion about the area in front of the businesses on the west side of Gilbert Street .... change .... trees... I know DR talked about this. Besides the brick pavers in the parkway, what else can we do to try to soften or compliment how urban and car-ish in front of those stores it is. Laura Hawks/ I guess we did talk about that at one point in time... I think Jeff had pointed out there might be a possibility of incorporating some planters with the concrete steps somehow .... McClure/ (Refers to diagram). That has been pretty much eliminated. The DOT... clear zone requirement .... going to need more than 5 feet of space and we just don't have .... Kubby/ No planters. Not even a bike rack? .... McClure/ No. Vanderhoef/ How about on the south end of the Rec Center where the trees are right now? McClure/ (Refers to diagram). We worked with Project Green. They are not really happy with these types of plants that are in This representsonly areasonably accuratetranscription ofthelowa City council meetingof March4,1996. WS030496 March 4, 1996 Council Work Session Page 12 there right now as part of this project .... As part of the project we are going to tear all of these plantings out along here... seed it and mulch it and they have got a whole planting plan made up that they are going to implement after we are out of there. Kubby/ .... what will be replacing them? Emilie Rubrlght/ (Can't hear). McClure/ She says depends on the space. Rubright/ We have had about four plans but then the street keeps changing... on hold until we saw what was left... replace the foundation plantings... concerned about how you are going to screen off the swimming pool ..... concrete patio .... Had no idea what to propose because we didn't know... elevations... design .... Kubby/ How much space .... between sidewalk and where the hill starts to go down? McClure/ About four feet. (Refers to diagram)... new retaining wall .... There is proposed right now to have a railing put on that .... Possibility to put a railing on that wall so people don't go over .... I know the Rec Center does have some ideas about screening the sun deck area. McClure/ (Refers to diagram). Kubby/ Is it designed...what pattern the bricks will be? McClure/ ¥eah... I spent some time on this. (Refers to drawing). This is basically an overall picture of what the intersection would look like... crosswalk areas... herring bone pattern with a straight brick border ..... That pattern was chosen... herring bone pattern and traffic is crossing it at 45, it distributes the pressure out along the bricks... aggregate interlock. It distributes the load a lot better. Kubb¥/ Nov/ McClure/ In the crosswalk, this is how it is going to be constructed (refers to drawing) .... normal ten inch paving... concrete.. two inch buffer... set bricks in with full ten inch Thlsrepr~ents onlyareasonablyaccuretetranscrlptlon ofthelowa Citycouncil meetingof March 4,1996. WS030496 March 4, 1996 Council Work Session Page 13 paving underneath it .... reinforced concrete, 3/4 inch asphalt mixture and then they lay the bricks on top of that... all compacted and rolled over and then they sweep sand into the joints... (refers to drawing)... back of curb .... Kubby/ Will the parkway also be herring bone? McClure/ Yeah, I put it in a herring bone but I put it at a less expensive orientation .... Kubby/ McClure/ (Refers to drawing) This is the parkway and this is where we will have the herring bone with the border .... six feet... Then we will have the brick in the curb ramp area also .... slightly different color red to delineate between the parkway and the crosswalk .... Thornberry/ How much more expensive is this brick? .... Davidson/ The four elements which include the brick plus the lighting... about $100,000 ..... Vanderhoef/ For the Southside Plan, we are talking about three or four of these kind of intersections? Davidson/ Three. Norton/ You mean on Burlington .... work on Clinton Street. Davidson/ Clinton would have some features ..... I think it is reasonable to say you are setting some kind of precedent for Burlington Street. Vanderhoef/ Dollars .... when we are talking about three of these .... Thornberry/ When we give IDOT this proposal, do they participate? McClure/ They will participate in letting us do it. That is as far as it goes. We are fully responsible for the cost of this and the cost for maintaining it .... We are receiving USTEP funds for this project .... Urban- Davidson/ Safety something or other. McClure/ Urban Street Traffic Engineering Program. Thisrepresents only areasonably accuratetranscriptlon ofthelowa City councll meeting of March 4,1996. WS030496 March 4, 1996 Council Work Session Thornberry/ Davidson/ It is a state program, Dean, once a year .... Page 14 that they take applications McClure/ They share in the cost up to 55%, a maximum of $200,000 and USTEP is primarily for improving the safety of their state highways. Davidson/ This intersection is the 12th highest accident intersection right now in the community ..... capacity improvements with the left lanes will improve that. Lehman/ Jeff, this Southside .... possibility of blvd. on Burlington Street... I question .... Davidson/ Actually we discussed that with the DOT and they are not opposed to the concept of it. Lehman/ If we do that... Davidson/ Because this being the east terminus of this .... left turn storage lane... you are not making a decision on the blvd. by approving or not approving this. You can still go either way on that further up the street. Lehman/ The blvd. would not extend down to this? Davidson/ No. Nov/ No ..... Vanderhoef/ Davidson/ There might possibly be a two foot brick decoration that ran along the left turn lane ..... The blvd. proper would be further to the west .... Norton/ Are the curb ramps brick? Davidson/ They will be .... the redesign is in compliance with ADA. McClure/... we do have some red curb ramps around town ..... We will be putting in red .... brick on curb ramps. If you choose not to go with these Near Southside designs, we will put in what we put in on these other curb ramps around town which is plain concrete...red dye... Thlsrepmsents only areasonably accurate transcription ofthelowe City council meeting of March 4,1996. WS030496 March 4, 1996 Council Work Session Page 15 Lehman/ What is the advantage to brick as opposed to colored concrete? McClure/ Cost, esthetics. Davidson/ The brick is largely for decoration. Lehman/ ..... What is the relative life expectancy of the brick? McClure/ That is really tough. I have done a lot of research on the bricks ..... Manufacturer guarantees me that these are going to last forever. I can't say that the bricks are going to be as great as paving the whole thing in concrete. You are not going to get that same performance. But we have chosen is going to be as best as we can get using brick pavers. Thornberry/ The snow plows won't chew them up or anything? McClure/ I can't say that either. The bricks that we have chosen have beveled edges ..... CHANGE TAPE TO REEL 96-36 SIDE 1 McClure/ One thing else I wanted to add. We put together the plans and specifications, not knowing how you would react to the Near Southside Design elements and how the DOT ...would react. So the way that the plans and specs are put together is we have our base bid and that includes everything to get his intersection done the way we originally planned a year ago .... Then we have added four alternate bids and they are the conduit by itself; the brick crosswalks by itself; the brick parkways by themselves. And then the brick crosswalks and the brick parkways together .... 26th of March.. several decisions that you can make .... It is going to be a long comment ..... If you say yes, you want to do this for sure, that would help us out a lot .... Kubby/ ...Conduit... pedestrian lighting. Davidson/ Jeff can point it out on the plans. It is basically what IDOT has allowed us to have it. McClure/ (Refers to diagram)... DOT said that we can put plants, lighting, whatever within two feet of the r.o.w. line. Conduit is running right along back of curb .... (refers to diagram). Kubby/ Thisrepresents only a reasonably accuratetranscription ofthelowa City council meeting of March 4,1996. WS030496 March 4, 1996 Council Work Session Page 16 McClure/ ...As far as permanent improvements, we pretty much stopped them back here (refers to diagram). Atkins/ Are you asking the council to express preference tonight? McClure/ It won't help the bidding process. We are going to bid it the way it is set up now. If we could hear... just kind of think ahead of time of what you think you would allow. Nov/ We think we can state a preference for doesnft come out outrageously expensive. McClure/ The prices we get will have a bearing Atkins/ ...conduit .... McClure/ .... We don't have to work out the scenario... were .... using brick if it on a decision .... Other ones Nov/ The others are brick just in the crosswalks, brick just in the parking or both brick crosswalks and parking. McClure/ Exactly .... Nov/ McClure/ Higher unit prices .... Thornberry/ I would like to see the prices before I say .... McClure/ As long as you know what is going to be asked of you on the 26th .... Nov/ Is there anything that is going on bridge over Ralston Creek? .... McClure/ Davidson/ I think...Rick...asked us to program that. We are just getting ready to put together a new transportation improvement program ...JCCOG... in there for FY98. Council/ Thank you. McClure/ Am I going to need any of this stuff tomorrow night for the p.h.? Thisrepresents only areasonably accuratetranscription ofthelowa City council meeting of March 4,1996. WS030496 March 4, 1996 Council Work Session Page 17 Arkins/ At least have it here, Kubby/ .... show intersection... Norton/ Which do the curb ramps go with? McClure/ Crosswalk ..... Norton/ McClure/ I have a sample .... we have chosen what they call a vacuum dry press kiln brick .... testing to see what bricks hold up best... surface on it is kind of rough... texture .... coefficient of friction .... The actual paver is about another half inch thicker than that one .... cheaper than the extruded brick is. Thornberry/ Where does this come out of? McClure/ ...Ohio .... Thornberry/ To get them here costs something .... Nov/ Thanks. This represents only a reasonably accurate transcription of the iowa City council meeting of March 4, 1996. WS030496 March 4, 1996 Council Work Session Page 18 University of 96-36 S1 Nov/ Softball. Iowa Softball Complex Liqhtinq - Joint Agreement Trueblood/ Regarding softball. I am here mainly to answer any questions tonight about the proposed agreement with the University of Iowa or the project itself. I can tell you that it is a project that we have talked about for a number of years. It has actually been on the books for quite sometime... In view of the fact of what is happening with Napoleon Park and therefore the Girl's Softball Program for FY96, to help them out. I can also tell you it was ranked a high priority by P/R Commission when they ranked the project ranking #4 overall out of a dozen projects or so. Lehman/ ...Long term. Thornberry/ I have a question to the Legal Department regarding cost of these lights. Does the Legal Department think you have got a free range to put in whatever you want and the University will pay for it? Trueblood/ No, not exactly. Thornberry/ I read the contract- Trueblood/ As a matter of fact... we jointly have already selected the lights and poles that will go in .... We were all in on that process and... they were putting in fewer foot candles than what the manufacturer had originally recommended because we said we don't need that much. We are not building a professional softball complex here. So we reduced that to the tune of about $30,000 .... Kubby/ High efficiency? Trueblood/ They are much more energy efficient than incandescent lights are. These are 15 watt... much more expensive to purchase. Much more energy efficient. They last a lot longer. Lehman/ ...You have an agreement with the University that is renewable at our option? Trueblood/ That is right .... unless we default in some fashion in the agreement. The agreement is really pretty simple and straight forward and there is almost no way that we can default. Thisrepresents only a reasonebly accurate transcription ofthelowa City council meeting of March 4,1996. WS030496 March A, 1996 Council Work Session Page 19 Council/ Trueblood/ ...It can be an infinite number of five year- Norton/ I thought it was terrific .... It is wonderful .... Lehman/ I think you done good. Trueblood/ Thornberry/ I heard you speak to a breakfast group .... Nov/ I have a question...It says normal maintenance like repairing the light bulbs... But what if some drunk kids knock down the whole pull and you have to start again from scratch? Whose liability is that? Kubby/ Who was using the field. Nov/ Whose insurance company? Trueblood/ That would to be answered at that time, frankly .... That is not addresses in the lease itself .... Take a look at both insurance companies... If we allowed... We have done it... Boys Baseball. They installed permanent lighting on two of their fields which they incurred the cost .... When something is permanently installed on city property, it becomes city property unless we have an agreement to the contrary ..... have to look at our insurance .... Nov/ (Can't hear) .... doesn't say who is the ultimate owner. Trueblood/ My understanding that anytime that is not specified in the lease, the ultimate owner is the property owner. Thornberry/ Trueblood/ Lehman/ But if we put the lights on their property, it basically becomes their property .... Trueblood/ Kubby/ (Tape cuts out-can't hear). I think the only serious question here is 20 or 25 years. Yucuis/ The wastewater project .... Page 3, there is a savings compared to what we had in the rate increase budget for the next 10-11 years and the difference between what we had in the budget at 7% and what we are proposing .... market right now for 25 year bonds should save approximately $217,000 a year over the next 25 years .... 2.3% of revenues .... Wouldn't we be wise taking savings we have... and perhaps not adjusting .... Atkins/ It is not wrong. Lehman/ It seems to me that the rates in year 2000, I can't live with them. Atkins/ Well, we are whittling away at them .... Lehman/ If we used savings to adjust the rates now, we are still going to have that same projected rate in the year 2000. ¥ucuis/ Ernie, I am just saying what the impact could be on rates. What we will do is probably six months from now is come back with another proposal for rate increases next March. At that time we will have our FY96 actual. We will know where we ended up the year. We will know if we need to carry over any of that money to the new FY97... better handle on what we think the rates will be next March. We will also have two more bids come in in the next three months. The Napoleon Park Lift Station and the North Plant Improvement... $6 million... it will also have an impact on bonds that we issue next year. Lehman/ Yucuis/ What I say it will do is it will give us a little more flexibility ..... Norton/ I am interested in softening them... WS030496 March 4, 1996 Council Work Session Page 23 Yucuis/ On the wastewater one, I am looking more at the annual savings .... I am looking at the total wastewater budget down the road. $217,000 a year will give us more flexibility in looking at rates annually. To have that little buffer of extra money available compared to what we were projecting before. 25 year I think just on the life of the pipes, 20-25 year, city government or local government, you probably double that, so it is a 50 life or a 100 year life on most of your infrastructure like that. The longer term .... would be a better savings for all the users. Nov/ (Can't hear) .... you got a $4 million difference .... Norton/ I have been arguing all along that we ought to spread it over a longer set of users and not load it all on this particular generations of users .... Nov/ I am trying to say the same thing that you are... Why not think about the total spread. Kubby/ (Can't hear). ¥ucuis/ The issue that we are talking about right here is to pay for the project that ... will be bid. We are looking immediately, let's pay those bills. The other issue of continuing on with the same city council policy, the 20%, that...is another issue that we talk about at the time we come back with rates .... Sales tax will be another issue then .... factored in. Nov/ I am still not sure I understand why a lower tax and a lower interest are (can't hear) .... Vanderhoef/ ..oI am looking at what is going to happen...20-25 years down the line and we have all of these outstanding bonds .... Yucuis/ If you want to go 20 years, then that is what we would go out for bid at. We would not go out for bid at a 20 year bond and a 25 year bond at the same time .... either a 25 year or a 20 year and that decision would be made within the next two weeks. Kubby/ You are saying one of advantages of a 25 year bond, is that increase annual savings that creates some flexibility. Yucuis/ Your expenses each year are $217,000 lower than we had This represents only a reasonably accurate transcription of the Iowa City council meeting of March 4, 1996. Norton/ It is who pays, that is what it is about .... The overall group...25 year goal are going to pay a little bit more... I think there is a certain point of spreading it more .... Kubby/ (Tape problems-cuts out). Vanderhoef/ I would like a mix of some 20 and some 25 in the total project. Lehman/ What is the recommendation from the Finance Director and why? Yucuis/ I personally like the better flexibility of having more money available .... to have the flexibility of coming back to you... this gives you more flexibility of doing that. If you are looking at the grand total cost of the bonds, 20 year is a more advantageous ..... paying less over the 20 years you are saving little less than $4 million based on the 25 year. Kubby/ The projects costs (can't hear) .... Yucuis/ Those are factored into the size of the bond issue. Norton/ Kubby/ Yucuis/ Once you sell the bonds, you are going to pay that out for at least the next ten years .... Kubby/ I am saying we have already built in that flexibility... lower bid... less overall costs .... Yucuis/ The savings was factored into the original budget... The $19 million was factored in at that time .... we had already factored in the savings .... The timing was such that we saw the savings coming in but we ha the resolution coming at the same time. In the narrative we said we would issue less bond. Thisrepresents only ateasonably accurato transcrlptlonofthelowa City council meeting of March 4,1996. Atkins/ So if we did a 25 year GO this time, next year Vanderhoef/ Right, that is what I am talking about. Kubby/ (Can't hear) .... a 20 year. Atkins/ Your interest rates now are at the lowest they have been in several years .... if we have a low interest rate... take the 25 ..... If rate kicks back up again .... Council/ Kubby/ There is a policy decision... who pays .... Norton/ It really is tricky .... we put a little bit heavier burden on the present generation of payers .... I am looking to spread it out... Trying to get a balance is not easy .... moderation to the current troops .... Kubby/ Norton/ Lehman/ Dee, I think we are going to look at this before the next rate increase in some depth. Norton/ Right now... I am going to hang for the longer one. Kubby/ Do we know the exact point at which our bond rating could be lowered? ..... ¥ucuis/ There are a lot of factors that go into that rating .... we pay off our debt a lot quicker .... They look at a lot of things .... what is going on in the community. Arkins/ This is our last rating (reads rating statement) .... Those are the kind of things... Norton/ Will the 25 year choice run us up the flag pole or something? Yucuis/ Not on a revenue issue .... If you went 20 year Go, the amount of bond issue would be decreased by approximately $1.4- 1.5 million... closer to a $17 million issue .... wouldn't have to set aside that one year debt service reserve. Kubby/ So why are we looking at 20 year reserve instead of 157 Yucuis/ On the water project? The 15 year does not fit into that budget .... The debt service on a 15 year, $5.8 million issue, is about $580,00 a year. So it does not fit into our projections and rates that we proposed. I prefer to either be at the $532- or less ..... Kubby/ (Can't hear) .... Yucuis/ This is also abated all by water .... This is a change in the way we have been doing things .... Kubby/ Norton/ Yucuis/ On any GO issue, you can pay it off with other money. Atkins/ remember that schedule. Vanderhoef/ (Can't hear) .... Nov/ Don, before you go away, there is an older sewer revenue bond which is at 7.89%. What are chances of getting that re-issued? Yucuis/ I listed all of our bond issues that have occurred since 1985 forward. The last four of those have been re-issued and refinanced .... The January '93, refunded that issue you were talking about... Atkins/ .... in 93 we re-financed that... and brought down the interest... Yucuis/ If you go from February '88 on up, eliminate the last four issues, those are all of our current issues outstanding- CHANGE TAPE TO REEL 96-36 SIDE 2 Atkins/ That was about a $1.3 million savings .... On page 2, at the very bottom, the issuance cost is less for 25 year bond even though the amount is the same? Yucuis/ The issuance cost is less in a 25 year? Total project cost plus the debt service reserve is approximately the size of your bond issue. You take a percentage of those two, of the total bond issue size, 1.5% discount. Vanderhoef/ The other concern that I have had calls on is about the Oakdale extension and they have been calls from the county, calls from the city who are already concerned (can't hear). They are concerned about federal moneys that go into building that road which there is a very tiny amount of land that we would ever be annexed by Iowa City in the Fringe Agreement.°. So I have been on the phone a bit. I don't know how this council feels but I am of a mind that I think this is not a good project you can put out (can't hear) from the Iowa City side. Where that road is tentatively scheduled and I know they don't have a route and they have not studied it. However, if you have ever walked out there or looked at that area, it is all way low grade. It floods much of (can't hear). The property, a large chuck of that property and definitely that is in the county (can't hear) is owned by one property owner and there would not be development, shall we say, on the south side (can't hear) might come through. The people are talking about the safety issue of where that would come out. It has to do with the fields and the ice, the vision. They are talking- signalization at some point in time and I think going back to the things that were my original concerns long before I ever read the P/Z minutes was that this is the road that really is paralleling another major federal highway that we are going to be putting federal funds into this at four lanes to 1-80 and I can't agree with it. This is not something that I would choose (can't hear). Norton/ If it comes up tomorrow at JCCOG, are we going to- Vanderhoef/ It comes up for voting on- Kubby/ (Can't hear). Norton/ What happens if it isn't extended? Vanderhoef/ Well, it can- The way it is laid out in the Coralville section, there is a part already that the sewer lines and everything (can't hear) are east of First Avenue right now. There is one property owner there and that same property owner (can't hear) owns the adjacent land that is out in the Fringe area that has not been annexed at this point. Thisrepresents only ereasonably accur~etronscrlption of theIowa City council meeting of March 4,1996. WS030496 March 4, 1996 Council Work Session Page 32 Thornberry/ Who is that? Norton/ It would just terminate there, in other words. Venderhoer/ ¥eah. His name is (can't hear), is what I was told. And so as that area- It may be a very useful kind of street for the Coralville area and there would be ways that it could be done as a loop east of First Avenue and come back to First Avenue. Kubby/ One of Coralville's concerns (can't hear). And so (can't hear) what are some other options and (can't hear). How do the people north of 1-80 (can't hear)? Vanderhoef/ It can loop all of the way. Norton/ I mean if it doesn't ever come on over to Dubuque Street. you still have to go back down and over the interstate, on the interstate, to get back. Vanderhoef/ And for another connection to Iowa City I don't see it as necessary at that point when we have another federal potentially a six lane coming through there. That and the environment kind of thing that is out in the north corridor north of the quarry and there is wetlands already at this point. If you look at where they cut the road into First Avenue in Coralville, it appears that they are having to lift the grade ten or more feet out there to get it above the flood plain. When you get across First Avenue there is a box culvert there and a map of that it is acting almost like a dam that is backing up water behind it. So it is pushing it out into where houses would be and when you get to the other end up over in what would be the Iowa City area, it crosses Muddy Creek twice. We are talking about two more bridges, culverts, whatever. Norton/ Two more bridges, indeed. Arkins/ (Can't hear). Concerns about the thing. If I recall, it is up before JCCOG? Vanderhoef/ Yeah, and we haven't even had an opport- Arkins/ You may just want to send it back. I couldn't even come close to answering all of the things that you- Venderhoer/ Right now I cannot support it at this point. And I This represents only a reasonably accurate transcription of the Iowe City council meeting of March 4, 1996. WS030496 March 4, 1996 Council Work Session Page 33 don't know about anybody else. Norton/ We have not heard a full justification from Coralville. Not really an elaborate one, have we? Nov/ Well, but maybe (can't hear). They are saying (can't hear). Kubby/ (Can't hear-cutting out). Even though your particular vote may still stay the same, to get some response from Coralville and out staff about this particular (can't hear). Vanderhoef/ Well, I started (can't hear) them at the last meeting and Jeff was- I don't know. I wasn't getting any answers that I wanted and I didn't have enough information myself at that point. These were things that had popped up in my mind the minute I read that little bit on- Atkins/ If you are- I mean, if I hear collective concern, I will raise that with Jeff tomorrow to tip them off and ask a number of questions. That may change the whole approach to this (can't hear). Kubby/ I guess I wouldn't think it would be fair without thoroughly discussing these concerns, to come to the conclusion no, it is not a good idea because I may- I have- Vanderhoef/ At this point I can't support it with what I know. That is what I am saying. So I am not ready to make a decision on (can't hear) and to have a little brief public hearing is the way it is listed on that (can't hear). P.h. and then vote and I am not- Kubby/ And I am sure that Coralville is (can't hear). Vanderhoef/ I want to know what everybody else is thinking. Lehman/ I don't know enough about it 100%. I would like to know more nay. but I agree with you, Karen, about it before I say yea or Norton/ I heard some people say how in the hell are they going to bring a road around there, around the top of that quarry and through Muddy Creek. I am not telling you it is wrong but I am just (can't hear). Kubby/ It would be great (can't hear) to outline some things tomorrow since you have done a lot of thinking. Vanderhoef/ (Can't hear). Norton/ You mean during the JCCOG meeting, yes. (Tape cuts out) Vanderhoef/ Just a side line question. If you are looking at these kinds of things and they are asking for federal money, which I know we have got the bridge over 1-80 sitting out there onto Scott Blvd. project. Who, if push comes to shove, who is going (can't hear)? If they both were on the arterial plan. Atkins/ Seems to me, and we had a meeting the other day, folks about 965, one of Coralville's and kind of to their credit, their strategy is to load the plan up with a lot of these very big projects and that is going to improve their position dramatically when the federal moneys become available. You get these things mapped and outlined. It is a good strategy. A good bit of what we use federal money for is to fix bridges in town, lots of smaller jobs. Some day that could peal off a big hunk of that money. But, of course, I think that is where the importance of the five members of council are on JCCOG. Keeping them honest about that. Vanderhoef/ Well, I am more concerned about Scott Blvd. kind of federal money (can't hear). Atkins/ We have ours on. I am not saying we don't have ours. We are also six times their size. The 965 and Oakdale are big big projects. Vanderhoef/ Norton/ If you got more, go ahead and get them in there. 6.
