Washington St., Iowa City, IA 52240 (319) 356-5030 RESOLUTION NO. 98-140 RESOLUTION APPROVING A PROPOSED 28-E AGREEMENT AND SIDE LETTER OF AGREEMENT FOR PAPATRANSIT SERVICE BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY FOR THE PERIOD OF JULY 1, 1998 THROUGH JUNE 30, 2003 IN SUBSTANCE AND AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT INCORPORATING THE TERMS OF SAID PROPOSAL. WHEREAS, there was a previous 28E Agreement, and several extentions of said Agreement, for FY97 paratransit service between the City of Iowa City and Johnson County; and WHEREAS, representatives of the City of Iowa City and Johnson County have negotiated a 28oE Agreement and a Side Letter of Agreement for paratransit service for the period of July 1, 1998 through June 30, 2003, a copy of said proposed agreement and side letter of agreement being attached hereto and incorporated herein by reference. Approved by City Attorney's Office and seconded by ¥anderhoef the Resolution be adopted, AYES: X X X X X X NAYS: ABSENT: Champion Kubby Lehman Norton O'Donnell Thornberry Vanderhoef legal~eleanodseats.c~oc 28E Agreement for Paratransit Service between the City of Iowa City and Johnson County for the period of May 1, 1998 through June 30, 2003 This Agreement is made and entered into by and between the City of Iowa City, Iowa, hereinafter referred to as "Iowa City", and Johnson County, Iowa, hereinafter referred to as "County". Scope of Services The County shall provide to Iowa City through Johnson County SEATS paratransit service consistent with the Americans With Disabilities Act and the policies of the Iowa City City Council. "SEATS" is an acronym for Special Elderly and Handicapped Transportation Services. General Terms 1. Paratransit service area for Iowa City shall be the corporate limits of the City of Iowa City. Paratransit service shall be operated within the corporate limits of Iowa City from 6:00 a.m. until 10:30 p.m., Monday through Friday; 6:00 a.m. until 7:30 p.m. on Saturday; and 8:00 a.m. until 2:00 p.m. on Sunday. The paratransit service shall operate a holiday schedule consistent with Iowa City Public Transit. Paratransit service shall be ooerated as a door-to-door service. If requested, Johnson County SEATS operators shall assist passengers from the door of the origin to the door of the destination of each trip, including assistance in carrying groceries and packages. Johnson County SEATS operators shall be sensitive to the needs of passengers with disabilities. 4. The paratransit service shall be operated with a $1.50 fare. Fares collected shall be retained by the County. The only exceptions to the $1.50 fare shall be specific individuals designated 2 by Iowa City as being entitled to a discount of the $1.50 fare. Reductions in the fare schedule will be done in consultation with the County to determine the commensurate reduction in revenue to the County. Any other fare collected on behalf of any contracting agency and administered by the paratransit provider will not affect the agreement with Iowa City. Vehicles operated by Johnson County SEATS shall be clearly marked as City of Iowa City and Johnson County (including City of Coralville) paratransit vehicles. Iowa City shall provide signage for the purpose of identifying vehicles that are in use as Iowa City-Johnson County (including City of Coralville) paratransit vehicles. Vehicles and personnel used to provide Iowa City-Johnson County paratransit service shall be neat and clean in appearance. The County shall be familiar with the Johnson County Council of Governments (hereinafter "JCCOG") complementary paratransit plan for the Iowa City urbanized area and will conduct paratransit service consistent with said document. This will include Iowa City's determination of rider eligibility based upon a certification process. Johnson County SEATS shall notify Iowa City of request for ADA certification on a weekly basis at which time the applicant shall be entitled to continue to use SEATS for a 21-day grace period. It shall be Iowa City's responsibility to notify Johnson County SEATS as to whether the applicant is ADA eligible. Otherwise the applicant shall remain eligible for paratransit service. Priority for paratransit service will be given to persons certified under the ADA. Johnson County SEATS shall maintain reporting statistics required by the Federal Transit Administration National Transit Database (formerly Federal Section 15 system). In addition Johnson County SEATS shall provide a management information system consisting of information for each trip provided. This information shall be submitted to Iowa City as a monthly report ten days from the end of the previous month. Johnson County shall use a computerized management information system which will enable Iowa City to receive information in a summary format. The reports are commonly identified as "SEATS 3 Productivity Report by Funding Source" and "Ridership Report by Jurisdiction Summary". Iowa City may request miscellaneous reports to assist it in its evaluation of SEATS services. These reports will not create an undue administrative burden on SEATS management. Johnson County SEATS shall comply with the Federal Transit Administration Drug and Alcohol testing requirements and shall be responsible for any and all costs associated with said drug and alcohol testing requirements. The County shall certify that they have not been debarred from federally funded contracting. Johnson County SEATS shall comply with any other requirements of the Federal Transit Administration. Johnson County SEATS employees shall have all commercial drivers licenses required by Iowa law. The County agrees to be responsible for the acts of Johnson County SEATS employees while on duty. 9. Johnson County SEATS shall submit proof of insurance meeting the City of Iowa City Class II requirements. 10. The City of Iowa City will provide at no cost to the County, through its transit facilities, a location for the storage of SEATS vehicles and employee support services. The use of storage areas will be provided under the direction of the Director of Parking and Transit as the party responsible for these facilities. SEATS employees will be able to park personal vehicles as well as use the general facilities in the transit building. The Johnson County SEATS will be charged a fee of $2.50 per vehicle wash when performed by County SEATS employees. 11. Johnson County SEATS shall be permitted to use the Iowa City transit fueling facility at a cost of $20 per month, plus fuel expense. 12. Attached to, and made part of this agreement, is a side letter of agreement which identifies issues, concerns, and other matters relevant to the City's contract with Johnson County SEATS for the provision of paratransit services. It is understood that during the first three years of this agreement, Iowa City and Johnson County or their representatives will meet, confer, and seek resolution to the items so indicated. 4 13. The following represents a basic description of ride policy and the agency responsible for the ride. Iowa City ride - begins in Iowa City and ends in Iowa City, Coralville, or University Heights. Coralville ride - begins in Coralville and ends in Coralville, Iowa City, or University Heights. University Heights ride - University Heights resident ride that begins or ends in University Heights, Iowa City, or Coralville. Rural ride - Begins or ends in the non-urbanized area or is a county resident riding within the urbanized area. Special charters are the responsibility of the paratransit provider, regardless of origin and/or destination. Compensation and Duration 1. This agreement shall be for a period of five years and two months effective May 1, 1998 through June 30, 2003. agreement of the parties. Extent of Agreement This Agreement shall be filed with the Secretary of State of Iowa and the County Recorder of Johnson County, Iowa, pursuant to the requirements of Iowa Code 28E.8 (1997). The Agreement represents the entire agreement between Iowa City and Johnson County for paratransit service. It may be amended only by a written instrument signed by both parties. Additionally we have determined that a number of issues, concerns, and other related matters need discussion and resolution. By way of this side letter of agreement, those issues are so identified. It was further agreed that during the first three years of our agreement no later than June 30, 2001 we will have addressed these issues. The following discussion items are to be considered and either party may raise related issues during the course of these discussions. It has been agreed that the Johnson County Board of Supervisors will appoint an advisory committee as identified in Point ¢¢1 to review such matters and provide recommendations to our respective legislative bodies. It is understood that if necessary, the legislative bodies of the City and County may convene to discuss these and related issues as well as the recommendations of any advisory body. The Board of Supervisors agrees to create an advisory committee that would consist of two members appointed by the Iowa City City Council, two members appointed by the Board of Supervisors, one member appointed by the Coralville City Council and four SEATS consumers to be appointed by the Board of Supervisors. This committee would be advisory in nature and assist in addressing paratransit issues in Johnson County. The advisory committee will investigate issues of interest which include but are not limited to fair share allocation of cost, joint governance, and human service study. 2. Maintenance of Vehicles. The City has expressed interest in pursuing the possibility of the use of City maintenance facilities and employees serving as maintenance contractor to the County for paratransit vehicles. The County has indicated the importance of a timely repair and maintenance system and if it is determined to be financially and otherwise practical, the County will consider such a proposal. The City will prepare and submit a proposal that identifies the estimated cost of City maintenance of paratransit vehicles. The Johnson County SEATS staff will provide documentation and maintenance information to assist the City in preparation of its proposal. 3. Lease of Paratransit Vehicles. The City has expressed interest in the utilization of SEATS vehicles to supplement the City's fixed-route system. City employees would operate this equipment. The County has indicated they would investigate through EClCOG the use of SEATS vehicles for such Iowa City use. The County has indicated that SEATS vehicles are used first to provide paratransit services and that the assignment of these vehicles would not compete with or cause undue management and/or other operational problems for the SEATS system. The retro-fitting of existing SEATS vehicles if the leasing of these vehicles were to occur would be the responsibility of the City. Such retrofitting as fare boxes, wheelchair lifts, route markings, etc. will be the responsibility of the City. 4. Annual Rider Survey. The City and the County agree that an annual survey of SEATS riders will be conducted. 5. Operational Policies. The City has expressed interest in some type of operational policy document or compendium of documents to identify for all interested parties the operating policies, procedures and related matters associated with the operation of SEATS. This document would be provided to the advisory committee in order that they may be aware of the day-to-day operational issues associated with SEATS. The City transit staff will cooperate and assist in the assembly of this document recognizing that City operational policies for paratransit have a bearing on operational policies of the SEATS system.
