WHEREAS, the following firms and persons have made application and paid the mulct tax
required by law for the sale of cigarettes, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA, that the applications be
granted and the City Clerk be and he/she is hereby directed to issue a permit to the following

RESOLUTION AUTHORIZING THE IV]AYOR TO SIGN AND THE CITY CLERK TO
ATTEST THE RELEASE OF A LIEN REGARDING A PROIV]ISSORY NOTE AND A
MORTGAGE AND FINANCING STATE[VIENTS (A UCC2 AND A UCC4) FOR
REHABILITATION OF THE PROPERTY LOCATED AT 803 CHURCH STREET,
IOWA CITY, IOWA
WHEREAS, on July 22, 1994, the property owner of 803 Church Street executed a
Promissory Note and a Mortgage in the form of a Ten-Year Low-lnterest loan for the amount
of 97,294 and a UCC2 and a UCC4 Financing Statement for appliances through the City's
Housing Rehabilitation Program; and
WHEREAS, these documents created a lien against the property; and
WHEREAS, the balance of the note and mortgage was paid off on February 28, 1996.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF 10WA CITY,
IOWA that the Mayor is authorized to sign and the City Clerk to attest the attached Release
of Lien for recordation, whereby the City does release the property located at 803 Church
Street, Iowa City, Iowa, from an obligation of the property owner to pay to the City the
97,294 which was recorded in Book 1792, Pages 296 through 302, Book 1319, Page 179,
and Book 1792, Page 308 of the Johnson County Recorder's Office.

RELEASE OF LIEN
The City of Iowa City does hereby release the property at 803 Church Street, Iowa City, Iowa, legally
described as follows:
The North ½ of Lot 4 in Block 9, in Iowa City, Iowa, according to the recorded plat thereof.
from an obligation of the property owner to the City of Iowa City in the principal amount of $7,294
represented by a Promissory Note and a Mortgage in the form of a Ten-Year Low-Interest Loan recorded on
August 4, 1994, in Book 1792, Pages 296 through 302 and Financing Statements-- UCC2 recorded
January 23, 1992, Book 1319, Page 179 and (an amendment of the original financing statement) UCC4
recorded August 4, 1994, Book 1792, Page 308 in the Johnson County Recorder's Office.
This obligation has been satisfied and the property is hereby released, in full from any liens or clouds upon

RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK
TO ATTEST A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA
CITY AND UNIVERSITY OF IOWA COMMUNITY CREDIT UNION FOR PROPER-
TY LOCATED AT 1311 FIRST AVENUE, IOWA CITY, IOWA.
WHEREAS, the City of Iowa City is the owner and holder of a certain Promissory Note and
Mortgage executed by the owner of 1311 First Avenue on August 5, 1991, and recorded in
Book 1265, Pages 165 through 1 69, in the Johnson County Recorder's Office covering the
following-described real estate:
Lot 2, Sycamore View, A Subdivision of Iowa City, Johnson County, Iowa,
according to the plat thereof recorded in Book 31, Page 138, Plat Records of
Johnson County, Iowa.
and
WHEREAS, the City's lien totals $13,O00; and
WHEREAS, University of Iowa Community Credit Union, Iowa City, Iowa proposes to
refinance the note from First National Bank of Iowa City for the sum of $62,000 on a
promissory note to be executed by the owners of 1311 First Avenue securing a mortgage
covering the real estate described above; and
WHEREAS, it is necessary that the rehabilitation loans held by the City be subordinated to the
lien of the proposed first mortgage in order to induce University of Iowa Community Credit
Union to make such a loan; and
WHEREAS, University of Iowa Community Credit Union has requested that the City execute
the attached subordination agreements thereby making the City's lien subordinate to the lien
of said mortgage to University of Iowa Community Credit Union; and
WHEREAS, there is sufficient value in the above-described real estate to secure said lien as
a second lien.

WHEREAS, the Financial Institution proposes to loan the sum of $62,000.00 on a
promissory note to be executed by the Financial Institution and the Owner, securing a mortgage
covodng the real property described above; and
WHEREAS, to induce the Financial Institution to make such loan, it is necessary that the
rehabilitation loan held by the City be subordinated to the lien of the mortgage proposed to be
made by the Financial institution.
NOW, 7HEREFORE, in consideration of the mutual covenants and promises of the parties hereto,
the parties agree as follows:
1. Subordination. The City hereby covenants and agrees with the Financial institution that
the above noted rehabilitation loan held by the City is and shall continue to be subject and
subordinate to the lien of the mortgage about to be made by the Financial Institution.
2. Consideration. The City acknowledges receipt from the Financial Institution of One'
Hundred and Fifty Dolla.rs ($150.00) and other good and valuable consideration Ior its act
of subordination herein.
Senior Mortgage. The mortgage in favor of the Financial Institution is hereby
acknowledged as a lien superior to the rehabilitation loan of the City.

Establishing Minimum Tenant Rents in the Section 8 ~nd Public Housin~
Programs ~
On January 26, 1996, the Continuing Resolution (Public Law//104-99) enacted by Congress
and signed into law by the President requires local housing authorities to make certain
changes concerning minimum tenant rents. §402(a) of the Continuing Resolution requires
families assisted under public housing or the Section 8 certificate/voucher programs pay a
minimum "monthly rent" of not less than 925 for the fiscal year 1996. The $25 minimum
rent is mandatory and must be implemented by April 1, 1996. The Housing Authority does
have the option of setting the minimum rent anywhere from 925 to 950. Unless the minimum
rent requirement is extended in additional legislation, minimum rents may only be charged until
September 30, 1996.
Housing Authority (City Council) Action
The Housing Authority (City Council) must decide whether to increase the minimum
rent (TTP) from 925 up to but not to exceed 950.
Comment: Consideration needs to be given to the potential impact on the lowest-
income residents and the possibility that the minimum rent requirement may apply only
during the current fiscal year. The Housing Authority records indicate that a minimum
rent of $25 impacts 39 families in Section 8 program and no public housing families.
Raising the minimum rent to $50 impacts 57 families in the Section 8 program and 1
public housing family (see attached table).
The Housing Authority must pass a resolution.specifying the minimum rent. If the
Housing Authority elects to charge the statutory minimum 925, then the resolution
need not be forwarded to HUD.
The Housing Authority must (no later than April 1, 1996) charge the minimum rent for
all applicants admitted to the Assisted Housing Programs.
The Housing Authority must (no later than April 1, 1996) charge the minimum rent
prospectively for ,all other tenants.
Recommendation
Section 8 Programs - Staff recommends the minimum rent not exceed the $25
statutory requirement.
Comment: The Section 8 program provides assistance opportunities to the lowest
income residents served by the Housing Authority. The impact of 825 or more
minimum rent may result in the lowest income residents and tenants not being served
by the Housing Authority.
2. Public Housing - Staff recommends the minimum rent set at 850.
Comment: The well being of public housing relates directly to its income (i.e., public
housing pays its expenses from its income). The $50 minimum rent guarantees
minimal level of revenue. Participation in Section 8 programs is an option to applicants
uncomfortable with the $50 minimum rent for Public Housing units.

Re: Housing and Community Development Commission Recommendation on PHA Minimum
Tenant Rents
At its meeting on March 13, 1996, the Housing and Community Development Commission
(HCDC) recommended by a vote of 8-0, that minimum tenant rent payments for both Public
Housing and Section 8 Certificates and Vouchers should be $25.00/month. Commission
members commented that since there was already a requirement that tenants pay 30% of their
adjusted income for rent, they felt that no minimum payment should be required. However, since
the PHA does not have that option, Commission members felt the $25.00 minimum should be
applied to both types of rental housing assistance.
The minutes from the March 13 HCDC meeting will be available for the Council meeting on April
9, 1996.

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO
ATTEST THE RELEASE OF A WATER MAIN EASEMENT LOCATED ON LOTS 3
AND 4, D & L SUBDIVISION, IOWA CITY, IOWA
WHEREAS, pursuant to a water main easement agreement between the Developer and City,
the City of Iowa City possesses a water main easement upon Lots 3 and 4, D & L Subdivision,
Iowa City, Iowa; and
WHEREAS, the owner and developer have submitted a site plan for the subject property which
proposes the development of one large building upon Lots 3 and 4, D & L Subdivision; and
VVHEREAS, under Iowa City City Code, a water main which serves only one building is
considered a private service line rather than a public water main, and thus the water service
line will not be accepted or maintained as a public improvement; and
WHEREAS, release of the water main easement will enable the property owners to fully utilize
the area encumbered by the easement; and
WHEREAS, Public Works has recommended the release of the water main easement; and
WHEREAS, it is in the public interest for title purposes to formally release the existing water
main easement on the subject property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
The City Council finds it is in the public interest to release the existing twenty-foot (20')
water main easement over Lots 3 and 4, D & L Subdivision, Iowa City, Iowa.
The City of Iowa City does hereby abandon, release and relinquish all right, title and
interest in the twenty-foot (20') water main easement described in Exhibit "A" attached
hereto and incorporated by reference herein, and the mayor is hereby authorized to
sign, and the City Clerk to attest, a release of said easement sufficient for recordation.
The City Clerk is hereby authorized and directed to certify a copy of this Resolution for
recordation in the Johnson County Recorder's Office together with the attached release
and the attached Exhibit "A", said recording costs to be paid by the Owner of Lots 3 &
4, D & L Subdivision.

BACKGROUND INFORMATION:
The applicant, Lucus S. Van Orden IV, is requesting approval of a preliminary plat for Newport
Ridge Subdivision, a 12-1or, 25.50 acre residential subdivision located in Fringe Area 3, north
of Newport Road, % mile east of its intersection with Prairie Du Chien Road. The property
is a resubdivision of Lot 6 of Newport Woods Subdivision. The current fringe Area Policy for
Area 3 encourages residential development.
ANALYSIS:
The proposed subdivision contains 12 lots generally configured around a proposed private
street known as Pond Lane. Two lots, Lots 7 and 8, have frontage on Newport Road. Lot
1 5, containing an existing house has access to Newport Road via an access easement across
Lot 7. This easement covers the existing driveway for the house and does not create a new
access point on Newport Road
The site contains areas with steep slopes, a potential wetland and a stream. All three of
these environmental features trigger the requirement for submission of a grading plan. The
Sensitive Areas Ordinance does not apply to this subdivision, because it is located in the
County, and the proposed design does not appear to be in conflict with the intent of the
ordinance. The proposed building sites are located away from the steep slopes and outside
of wooded areas located n the north and east of the property.
The proposed subdivision appears to comply with City rural design standards. All of the
proposed lots have access to a public or private street, and if access to Lot 8 is restricted to
Pond Lane, the number of access points to Newport Road will be minimized. Stormwater
management calculations for this property were included in the approval of the final plat of
Newport Woods Subdivision. These calculations and the easements provided for stormwater
management satisfy the stormwater management requirements for this site.
State Code requires that the purpose of all Outlots be stated on plats. Outlots C and D do not
state a purpose. Staff also has some concern with the proposed design of Pond Lane. The
lane contains a north facing 10% grade in combination with a sharp curve that may be
difficult for vehicles to negotiate during times of bad weather. However, both the steepness
of the road and the curvature are within c~ty standards.
STAFF RECOMMENDATION:
Staff recommends that the preliminary plat of Newport Ridge Subdivision be deferred but that
upon resolution of all deficiencies and discrepancies lieted at the end of this report, staff
recommends approval of the plat subject to approval of the Grading Plan prior to City Council
consideration of the plat.
DEFICIENCIES AND DISCREPANCIES:
All outlots must state a purpose.
2. A note limiting access for Lot 8 to Pond Lane should be added.
A letter from the appropriate Fire Protection District approving fire protection systems
is required under Section 2.2 of City Rural Design Standards, contained in the Approved
Fringe Area Agreement.

ADVERTISEMENT FOR BIDS
HIGHWAY l/GILBERT STREET
INTERSECTION IMPROVEMENT PROJECT
Sealed proposals will be received by the City
Clerk of the City of Iowa City, Iowa, until 10:30
A.M. on the 26th day of Mamh, 1996, and shall
be received in the City Clerk's office no later than
said date and time. Sealed proposals will be
opened immediately thereafter by the City Engi-
neer. Bids submitted by fax machine shall not be
deemed a 'sealed bid" for purposes of this
Project. Proposals will be acted upon by the City
Council at a meeting to be held in the Council
Chambers at 7:30 P.M. on the 26th day of
March, 1996, or at such later time and place as
may then be scheduled.
The Project will involve the following:
5,400 s.y. PC concrete, 13,640 s.f. PC side-
walk, 688 I.f. of various size storm sewer,
6,700 s.y. of pavement removal, and associ-
ated work.
All work is to be done in stdct compliance with
the plans and specifications prepared by Richard
A. Fosse, P.E., City Engineer, City of Iowa City,
Iowa, which have heretofore been approved by
the City Council, and are on file for public exami-
nation in the Office of the City Clerk.
Each proposal shall be completed on a form
furnished by the City, and must be accompanied
in a sealed envelope, separate from the one
containing the proposal by a bid bond executed
by a corporation authorized to contract as a
surety in the State of Iowa, in the sum of 10% of
the bid. The bid security shall be made payable
to the TREASURER OF THE CITY OF IOWA
CITY, IOWA, and shall be forfeited to the City of
Iowa City in the event the successful bidder fails
to enter into a contract within ten (10) calendar
days and post bond satisfactory to the City
insuring the faithful performance of the contract
and maintenance of said Project, if required,
pursuant to the provisions of this notice and the
other contract documents. Bid bonds of the
lowest two or more bidders may be retained for
a period of not to exceed fifteen (15) calendar
days until a contract is awarded, or until rejection
is made. Other bid bonds will be returned after
the canvass and tabulation of bids is completed
and reported to the City Council.
The successful bidder will be required to
furnish a bond in an amount equal to one hun-
dred percent (100%) of the contract price, said
bond to be issued by a responsible surety ap-
proved by the City Council, and shall guarantee
the prompt payment of all materials and labor,
and also protect and save harmless the Ck'y from
all claims and damages of any kind caused

directly or indirectly by the operation of the
contract, and shall also guarantee the mainte-
nance of the improvement for a period of five (5)
years from and after its completion and formal
acceptance by the City.
The following limitations shall apply to this
Project:
Working Days: 72 (based on mandatory 6-day
work week)
Late Start Date: April 15, 1996
Liquidated Damages: $500 per day
Incentive Pay: $500 per day
The plans, specifications and proposed con~
tract documents may be examined at the office of
the City Clerk. Copies of said plans and specifi-
cations and form of proposal blanks may be
secured at the Office of Richard A. Fosse, P.E.,
City Engineer of Iowa City, Iowa, by bona fide
bidders.
A $25 non-refundable fee is required for each
set of plans and specifications provided to bid-
ders or other interested persons. The fee shall
be in the form of a check, made payable to the
City of Iowa City, Iowa.
Prospective bidders are advised that the City of
Iowa City desires to employ minority contractore
and subcontractors on City projects.
Bidders shall list on the Form of Proposal the
names of persons, firms, companies or other
parties with whom the bidder intends to subcon-
tract. This list shall include the type of work and
approximate subcontract amount(s).
The Contractor awarded the contract shall
submit a list on the Form of Contract of the
proposed subcontractors, together with quantities,
unit pnces and extended dollar amounts. If no
minority business enterprises (MBE) are utilized,
the Contractor shall furnish documentation of all
reasonable, good faith efforts to recruit MBE's.
A listing of minority contractors is available and
can be obtained from the Iowa Department of
Economic Development by calling 515/242-4721.
By virtue of statutory authority, preference will
be given to products and provisions grown and
coal produced within the State of Iowa, and to
Iowa domestic labor, to the extent lawfully re-
quired under Iowa Statutes. The Iowa Reciprocal
Preference Act, Section 23.21, Code of Iowa
(1991), applies to the contract with respect to
bidders who are not Iowa residents.
The City reserves the right to reject any or all
proposals, and also reserves the right to waive
technicalities and irregularities.

1996 CURB RAMPS PROJECT
Sealed proposals will be received by the City
Clerk of the City of Iowa Ciry. Iowa, until 10:30
A.M. on the 19th day of Mamh, 1996. and shall
be received in the City Clerk's office no later
than said date and time. Sealed proposals will
be Opened immediately thereafter by the City
Engineer. Bids submitted by fax machine shall
not be deemed a "sealed bid" for purposes of
this Project. Proposals will be acted upon by
the City Council at a meeting to be held in the
Council Chambers at 7:30 P.M. on March 26,
1996. or at such later time and place as may
then be scheduled.
The Project will involve the following:
Construction of 9,200 SF of 4" and 6" Port-
land Cement Concrete sidewalks and curb
ramps, 610 LF of remove and replace curb,
840 SF of roadway pavement, and other
associated work.
All work is to be done in strict compliance with
the plans and specifications prepared by the
City of Iowa City Engineering Division of Iowa
City, iowa. which have heretofore been ap-
proved by the City Council, and are on file for
public examination in the Office of the City
Clerk.
Each proposal shall be completed on a form
furnished by the City, and must be accompanied
in a sealed envelope, separate from the one
containing the proposal by a bid bond executed
by a corporation authorized to contract as a
surety in the State of Iowa, in the sum of 10% of
the bid. The bid security shall be made payable
to the TREASURER OF THE CITY OF IOWA
CITY, IOWA, and shall be forfeited to the City of
Iowa City in the event the successful bidder fails
to enter into a contract within ten (10) calendar
days and post bond satisfactory to the City
insudng the faithful performance of the contract
and maintenance of said Project, if required,
pursuant to the provisions of this notice and the
other contract documents. Bid bonds of the
lowest two or more bidders may be retained for
a period of not to exceed fifteen (15) calendar
days until a contract is awarded, or until rejec-
tion is made. Other bid bonds will be returned
after the canvass and tabulation of bids is
completed and reported to the City Council.
The successful bidder will be required to
furnish a bond in an amount equal to one hun-
dred percent (100%) of the contract price, said
bond to be issued by a responsible surety ap-
proved by the City Council, and shall guarantee

the prompt payment of all materials and labor,
and also protect and save harmless the City
from all claims and damages of any kind caused
directly or indirectly by the operation of the
contract, and shall also guarantee the mainte-
nance of the improvement for a period of five (5)
years from snd after its completion and formal
acceptance by the City.
The following limitations shall apply to this
Project:
Early Start Date: April 1, 1996
Late Completion Date: November 15, 1996
Liquidated Damages: ' $100 per day
The plans. specifications and proposed con-
tract documents may be examined at the office
of the City Clerk. Copies of said plans and
specifications and form of proposal blanks may
be secured at the Office of Richard A. Fosse,
P.E., City Engineer of Iowa City, Iowa, by bona
fide bidders.
A $10 non-refundable fee is required for each
set of plans and specifications provided to
bidders or other interested persons. The fee
shall be in the form of a check, made payable to
the City of Iowa City, Iowa.
Prospective bidders are advised that the City
of Iowa City desires to employ minority contrac-
tors and subcontractors on City projects.
Bidders shall list on the Form of Proposal the
names of persons, firms, companies or other
parties with whom the bidder intends to subcon-
tract. This list shall include the type of work and
approximate subcontract amount(s).
The Contractor awarded the contract shall
submit a list on the Form of Contract of the
proposed subcontractors, together with quanti-
ties, unit prices and extended dollar amounts.
If no minodty business enterprises (MBE) are
utilized, the Contractor shall furnish documenta-
tion of all reasonable, good faith efforts to recruit
MBE's.
A listing of minodty contractors is available
and can be obtained from the Iowa Department
of Economic Development at 515/242-4721.
By virtue of statutory authority, preference will
be given to products and provisions grown and
coal produced within the State of Iowa, and to
Iowa domestic labor, to the extent lawfully re-
quired under Iowa Statutes. The Iowa Recipro-
cal Preference Act, Section 23.21, Code of Iowa
(1991), applies to the contract with respect to
bidders who are not Iowa residents.
The City reserves the right to reject any or all
proposals, and also reserves the right to waive
technicalities and irregularities.

WHEREAS, the City of Iowa City, Iowa has undertaken to provide its residents with a public
transportation system; and
WHEREAS, the Iowa Department of Transportation offers financial assistance to local
governmental units for their public transportation systems.

Attached you will find the reported bids and recommendation from the City's financial advisor,
Evensen Dodge, Inc., for the 918,300,000 Sewer Revenue Bonds and the $6,100,000
General Obligation {GO) Bonds that were bid today at noon.
Three bids were received for the 918,300,000 Sewer Revenue Bonds. The low bid was
received from Hutchinson Shockey out of Chicago at a Net Interest Rate of 5.7075%. The
rating from Moody's Investor Service, Inc. on this bond issue was 'A'. The low bid from
Hutchinson Shockey included insurance paid for by them and the bonds sold similar to a
General Obligation Bond Issue rated 'Aa'. This equates to about a .25% savings between an
'A' and a bond issue rated 'Aa'. The 5.7075% interest rate is approximately .08% lower than
what Evensen Dodge estimated the market to be back in February, 1996. I am very pleased
with the bids received and concur with Evensen Dodge's recommendation of awarding the bid
to Hutchinson Shockey.
Four bids were received for the $6,100,000 General Obligation Bonds. The low bid was
received from Piper Jaffray, Inc. of Minneapolis at a Net Interest Rate of 5,3411%. Moody's
Investors Services, Inc. confirmed the City of Iowa City's 'Aaa' rating on its General
Obligation Debt earlier in the week. This is the highest rating for GO debt. The interest rate
is approximately . 10% higher than what was estimated back in February, 1996. The dollar
difference or savings between a rating of 'Aaa' and 'Aa' for the $6,100,000 bond issue is
approximately $176,000. I am very pleased with the bids and concur with Evensen Dodge's
recommendation for awarding the bid to Piper Jaffray, Inc.

Dear Don:
The procedure for the sale date covering minutes of the reception of bids and form
of resohtion awarding the bonds to the best bidder is enclosed. Please return a certified
photocopy of the completed proceedings to ore' office, using the certificate form enclosed.
Please return copies of the bids and pm'ticularly the accepted bid.
Sealed bids for each series of bonds should be received by the Finance Director
m~d listed in the minutes. After a final call for sealed bids, the bids should then be
opened and the best bid recorded. Only sealed bids are pernlitted by the terms of sale.
No other bids should be considered. All bids should then be referred to tile Council for
award of the bonds.
Form ofBids.
The Terms of Offering set out the rest, ictions on the type of interest rates which
may be bid. Bids must comply with the Terms of Offering. Any number of different
interest rates may be bid for each issue. Each interest rate must be in a multiple of one-
eighth or one-twentieth of one percent.
Each bidder is required to fumish a bid security in the arnotrot of $61,000 for the
General Obligation Bonds, and $183,000 for the Sewer Revenue Bonds. The check of
the successful biddel' should be held uncashed by the City as security that the bidder will

take the bonds as agreed after the printed bonds are ready for delivery. If the bid security
is submitted in the form of a sure bid, please hold the funds unused until the time of
closing.
Acceptance of the best bid can be made by execution of the bid form.
