Washington St., Iowa City, IA 52240; 319-356-5246 RESOLUTION NO. 96-65 RESOLUTION AUTHORIZING THE IV]AYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING A PROIV]ISSORY NOTE AND A MORTGAGE AND FINANCING STATE[VIENTS (A UCC2 AND A UCC4) FOR REHABILITATION OF THE PROPERTY LOCATED AT 803 CHURCH STREET, IOWA CITY, IOWA WHEREAS, on July 22, 1994, the property owner of 803 Church Street executed a Promissory Note and a Mortgage in the form of a Ten-Year Low-lnterest loan for the amount of 97,294 and a UCC2 and a UCC4 Financing Statement for appliances through the City's Housing Rehabilitation Program; and WHEREAS, these documents created a lien against the property; and WHEREAS, the balance of the note and mortgage was paid off on February 28, 1996. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF 10WA CITY, IOWA that the Mayor is authorized to sign and the City Clerk to attest the attached Release of Lien for recordation, whereby the City does release the property located at 803 Church Street, Iowa City, Iowa, from an obligation of the property owner to pay to the City the 97,294 which was recorded in Book 1792, Pages 296 through 302, Book 1319, Page 179, and Book 1792, Page 308 of the Johnson County Recorder's Office. WHEREAS, the City of Iowa City is the owner and holder of a certain Promissory Note and Mortgage executed by the owner of 1311 First Avenue on August 5, 1991, and recorded in Book 1265, Pages 165 through 1 69, in the Johnson County Recorder's Office covering the following-described real estate: Lot 2, Sycamore View, A Subdivision of Iowa City, Johnson County, Iowa, according to the plat thereof recorded in Book 31, Page 138, Plat Records of Johnson County, Iowa. and WHEREAS, the City's lien totals $13,O00; and WHEREAS, University of Iowa Community Credit Union, Iowa City, Iowa proposes to refinance the note from First National Bank of Iowa City for the sum of $62,000 on a promissory note to be executed by the owners of 1311 First Avenue securing a mortgage covering the real estate described above; and WHEREAS, it is necessary that the rehabilitation loans held by the City be subordinated to the lien of the proposed first mortgage in order to induce University of Iowa Community Credit Union to make such a loan; and WHEREAS, University of Iowa Community Credit Union has requested that the City execute the attached subordination agreements thereby making the City's lien subordinate to the lien of said mortgage to University of Iowa Community Credit Union; and WHEREAS, there is sufficient value in the above-described real estate to secure said lien as a second lien. The $25 minimum rent is mandatory and must be implemented by April 1, 1996. The Housing Authority does have the option of setting the minimum rent anywhere from 925 to 950. Unless the minimum rent requirement is extended in additional legislation, minimum rents may only be charged until September 30, 1996. Housing Authority (City Council) Action The Housing Authority (City Council) must decide whether to increase the minimum rent (TTP) from 925 up to but not to exceed 950. Comment: Consideration needs to be given to the potential impact on the lowest- income residents and the possibility that the minimum rent requirement may apply only during the current fiscal year. The Housing Authority records indicate that a minimum rent of $25 impacts 39 families in Section 8 program and no public housing families. Raising the minimum rent to $50 impacts 57 families in the Section 8 program and 1 public housing family (see attached table). The Housing Authority must pass a resolution.specifying the minimum rent. If the Housing Authority elects to charge the statutory minimum 925, then the resolution need not be forwarded to HUD. The Housing Authority must (no later than April 1, 1996) charge the minimum rent for all applicants admitted to the Assisted Housing Programs. The Housing Authority must (no later than April 1, 1996) charge the minimum rent prospectively for ,all other tenants. Recommendation Section 8 Programs - Staff recommends the minimum rent not exceed the $25 statutory requirement. Comment: The Section 8 program provides assistance opportunities to the lowest income residents served by the Housing Authority. The impact of 825 or more minimum rent may result in the lowest income residents and tenants not being served by the Housing Authority. 2. Public Housing - Staff recommends the minimum rent set at 850. Comment: The well being of public housing relates directly to its income (i.e., public housing pays its expenses from its income). The $50 minimum rent guarantees minimal level of revenue. Participation in Section 8 programs is an option to applicants uncomfortable with the $50 minimum rent for Public Housing units. Commission members commented that since there was already a requirement that tenants pay 30% of their adjusted income for rent, they felt that no minimum payment should be required. However, since the PHA does not have that option, Commission members felt the $25.00 minimum should be applied to both types of rental housing assistance. BACKGROUND INFORMATION: The applicant, Lucus S. Van Orden IV, is requesting approval of a preliminary plat for Newport Ridge Subdivision, a 12-1or, 25.50 acre residential subdivision located in Fringe Area 3, north of Newport Road, % mile east of its intersection with Prairie Du Chien Road. The property is a resubdivision of Lot 6 of Newport Woods Subdivision. The current fringe Area Policy for Area 3 encourages residential development. ANALYSIS: The proposed subdivision contains 12 lots generally configured around a proposed private street known as Pond Lane. Two lots, Lots 7 and 8, have frontage on Newport Road. Lot 1 5, containing an existing house has access to Newport Road via an access easement across Lot 7. This easement covers the existing driveway for the house and does not create a new access point on Newport Road The site contains areas with steep slopes, a potential wetland and a stream. All three of these environmental features trigger the requirement for submission of a grading plan. The Sensitive Areas Ordinance does not apply to this subdivision, because it is located in the County, and the proposed design does not appear to be in conflict with the intent of the ordinance. The proposed building sites are located away from the steep slopes and outside of wooded areas located n the north and east of the property. The proposed subdivision appears to comply with City rural design standards. All of the proposed lots have access to a public or private street, and if access to Lot 8 is restricted to Pond Lane, the number of access points to Newport Road will be minimized. Stormwater management calculations for this property were included in the approval of the final plat of Newport Woods Subdivision. These calculations and the easements provided for stormwater management satisfy the stormwater management requirements for this site. State Code requires that the purpose of all Outlots be stated on plats. Outlots C and D do not state a purpose. Staff also has some concern with the proposed design of Pond Lane. The lane contains a north facing 10% grade in combination with a sharp curve that may be difficult for vehicles to negotiate during times of bad weather. However, both the steepness of the road and the curvature are within c~ty standards. STAFF RECOMMENDATION: Staff recommends that the preliminary plat of Newport Ridge Subdivision be deferred but that upon resolution of all deficiencies and discrepancies lieted at the end of this report, staff recommends approval of the plat subject to approval of the Grading Plan prior to City Council consideration of the plat. DEFICIENCIES AND DISCREPANCIES: All outlots must state a purpose. 2. A note limiting access for Lot 8 to Pond Lane should be added. A letter from the appropriate Fire Protection District approving fire protection systems is required under Section 2.2 of City Rural Design Standards, contained in the Approved Fringe Area Agreement. The low bid was received from Piper Jaffray, Inc. of Minneapolis at a Net Interest Rate of 5,3411%. Moody's Investors Services, Inc. confirmed the City of Iowa City's 'Aaa' rating on its General Obligation Debt earlier in the week. This is the highest rating for GO debt. The interest rate is approximately . 10% higher than what was estimated back in February, 1996.
