AN ORDINANCE AMENDING THE FINANCES,
TAXATION, AND FEES CHAPTER OF THE CITY
CODE BY AMENDING TITLE 3, CHAPTER 4,
SUBSECTION 6, ENTITLED "PUBLIC TRANS-
PORTATION," TO INCREASE THE FARES FOR
PUBLIC TRANSPORTATION.
WHEREAS, in the past, the City of Iowa City
has supplemented the operation of public trans-
portation with federal operating assistance; and
WHEREAS, the federal government has now
reduced the operating assistance available to
the City of Iowa City, thereby requiring a fare
increase.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. Section 3-4.6, Title 3, Chapter 4,
Subsection 6, "Public Transportation" of the
City Code should be and is hereby amended by
repealing Section 3-4-6, "Transportation",
"General Fares and Rates," more specifically
entitled "Standard fare, general public" and
"Monthly pass, general public", and enacting in
lieu therefore a new Subsection 3-4-6 to be
codified to read as follows:

At your March 21 meeting the Commission was presented with a draft of the summary report
regarding the subject rezoning and subdivision. There was some confusion expressed by
Commission regarding the summary report. For clarification Section 14-6J-2D3 of the Zoning
Chapter states that:
Upon completing review of the preliminary PDH plan, the Commission shall
recommend either approval or denial of the plan and shall make a written report
of its findings to the City Council. The report shall include findings that the
variances in setbacks, lot area requirements, building heights, building types,
sizes of buildings, and the combination of land uses will be in the public
interest, in harmony with the purposes of this Chapter and other building
regulations of the City, will not adversely affect nearby properties, and that the
parking requirements of this Chapter otherwise prevailing in the zone have not
been reduced.
The attached report addresses the pertinent issues identified above and will be forwarded to
the City Council prior to the public hearing on the rezoning and preliminary PDH plan.
Previously, the Zoning Chapter required that tile Commission approve the summary report at
the meeting following approval of a preliminary PDH plan. During the recodification process
this requirement was deleted, but the process of the Commission approving the summary
report as previously required has continued.

BACKGROUND INFORMATION:
The Village Green area began developing in the mid-1960's as Village Green, Part One. Since
that time, several subdivisions covering Village Green Parts I to XIII have been approved. The
concept plan for the remainder of Village Green shows the extension of Village Road to
connect to Scott Boulevard. 7he proposed Part XIV plan is a continuation of the townhouse
clusters surrounding the wet bottom storm water detention basin approved in Parts XII and
XlII.
The proposed Village Green, Part XIV includes 8 condominium units and is an extension of
previously approved townhouse style developments approved in other parts of Village Green.
Development of the site as proposed requires a rezoning of the property from RS-5 to OPDH-
5.
ANALYSIS:
Preliminary Plat: The preliminary plat includes only that portion of the remainder of the Village
Green development included within the proposed Lot 42. The plat does not indicate the larger
parcel from which Lot 42 is being subdivided. The remainder of the larger parcel should be
shown on the preliminary plat in some manner. The remainder could be designated as an
outlot reserved for future development.
OPDH/Subdivision Design: As mentioned previously, the proposed OPDH design is consistent
with previously approved Parts of Village Green, and continues the pattern of development
within the subdivision. The plan proposes 8 units clustered around Compton Place and
attempts to use the existing wet bottom detention basin as an amenity. Open space is
provided between and behind the proposed buildings, with abundant landscaping in these
areas as well as within the Compton Place circle.
During platting of Village Green, Part Xll, concerns were raised that the detention basin was
an attractive nuisance that might draw neighborhood children. To address these concerns a
fence has been constructed to help limit access to the pond. Additionally, the landscaping
between building clusters in Parts XII and Xlll was planted in such a way as to limit visibility
of the pond from Village Road. Similar landscape provision should be included in Part XIV.

The proposed design of the townhouses provides for off-street parking within garages and on
driveways in front of the garages. Additional off-street parking is shown in clusters off of the
private street in the island. The island is proposed to be landscaped consistent with adjacent
developments, and the landscaping should help to screen the off-street parking.
The plan proposes that sidewalks be waived for Compton Place, the private drive serving the
proposed units. Waiving of the sidewalk is consistent with the design of Parts XII and XlII,
where sidewalks were also waived on the private drives, On the short loop streets, like that
proposed for Part XIV, sidewalks were not felt to be necessary in previously approved parts
of Village Green. On longer streets, such as Somerset Lane, north of Part XIV, a sidewalk
adjacent to the curb was required.
Sanitary Sewer: As part of the approval of the final plat for Village Green, Part Xlll, the
applicant agreed to pay $61,000 toward improvement of the Village Green Trunk Sewer and
lift station. This fee covered Part XIII and all remaining property shown on the Village Green
concept plan. The fee satisfies all off-site sanitary obligations for the Village Green
Development. The legal papers required that this fee be paid prior to January 31, 1995; the
fee has been paid.
The City is currently designing the Scott Boulevard Truck Sewer, that will replace the Village
Green Trunk Sewer and lift station. Construction of the sewer is currently scheduled for the
summer of 1997. Addition of these eight units will not overload the capacity of the existing
Village Green Trunk Sewer, but future platting and subdivisions within Village Green may
encounter sewer capacity constraints until the Scott Boulevard Trunk Sewer is constructed.
Storm Water IVlanagement: It is proposed that storm water management storage for this
development be provided in the wet bottom storm water basin which was constructed with
Village Green, Part XlI. Preliminary storm water calculations, showing tha· the existing basin
has sufficient capacity to serve the proposed development, should be submitted. Because of
the high water table in this area, the legal papers for Village Green, Parts Xll and XI]I
contained requirements for a private tile system to drain the area to allow construction of
dwellings with basements. Similar stipulations should be required for the final plat of Village
Green, Part XIV.
Neighborhood Open Space: A fee in lieu of dedication of neighborhood open space is
recommended for this property. Under the Neighborhood Open Space Ordinance, dedication
of 0.07 acre of open space is required; a fee equivalent to this dedication is recommended.
STAFF RECOMMENDATION:
Staff recommends that the requested rezoning from RS-5 to OPDH-5 and the preliminary
OPDH plan and preliminary plat be deferred to allow resolution of issues regarding the amount
of property shown on the preliminary plat.

provision of private common open space.

Recommended Variations and Rationale: The Commission finds the following variances from
the applicable provisions of the zoning and subdivision ordinances to be appropriate:
A. Land Use,
Use Modification: A multi-family dwelling, which is a structure containing three or more
dwelling units, is not a use permitted in the RS-5, Low Density Single-Family Residential
zone. However, the proposed design of the OPDH plan has the appearance of a
sufficient amount of open space to make the design compatible with the surrounding
existing and anticipated single-family development. Open space will be contained around

and within the wet bottom basin-stormwater management facility. Additional open space
is shown to the front of the proposed units around the private street, Compton Place. The
resulting density of the proFosed OPDH plan is not inconsistent with underlying RS-5
zoning. The 8 dwelling units on Lot 42 have a density of approximately 16,800 square
feet per unit.
The proposed townhouse cluster will be larger in size than the adjacent single family
homes. The proposed design, however, contains features, such as varied rooflines and
staggered facades, which will lessen the appearance of bulk. The townhouse clusters will
also be set back at least five feet farther from the street than the 20 feet required by the
underlying RS-5 ~'one.
The distance of these proposed structures from the pamel boundaries, in addition to the
installation of perimeter landscaping and landscaping within the development, will further
diminish the perception of differences between this development and surrounding
residential development.
Street Standards and Specifications.
Reduced Pavement Width Requirements: The Commission endorses the design
modifications for Compton Place within Village Green, Part XIV development. These
private streets are intended for two-way traffic. Instead of 28-foot wide paved surfaces
back-of-curb to back-of-curb (BC-BC), however, these streets are a minimum of 25 feet
in width and will have five-inch deep Portland Cement Concrete (PCC) surfaces. Three-
inch integral roll curbs will define the edges of the paved surfaces.
Given the density of development proposed within the Village Green, Part XlV complex
and the fact that these private streets will only serve eight residential units and that
sufficient off-street parking is being provided, the Commission finds the street
modifications proposed for Village Green, Part XIV will adequately provide for the safe and
efficient movement of vehicular traffic within the development and will satisfactorily
accommodate emergency vehicle access.
A total of 16 off-street parking spaces are required for the 8 proposed multi-family
residences. Garages incorporated in the buildings will accommodate 16 vehicles. Six
additional spaces, with convenient access to each building, are depicted on the site plan.
In a conventional development, no parking area may be designed in which exiting from
a parking area would require backing into a street. Due to the scale of this development,
to the unobstructed sight distances from the parking areas, and to the fact that the
proposed streets are private, this design is not expected to be detrimental to the safe and
efficient movement of vehicular and pedestrian traffic.

NOTICE OF PUBLIC HEARING
On April 9, 1996, the City Council will hold
a public hearing on the City's FY97 Annual
Action Plan that is a pert of the CiTY STEPS
Plan. CITY STEPS is Iowa City's Consolidated
Plan for housing, jobs and services for low-
income residents in the Iowa City area. The
FY97 Annual Action Plan describes the projects
to be funded with Community Development
Block Grant and\or HOME Investment
Partnership funds for the coming fiscal year,
starting on July 1, 1996. This hearing will be
held during the Council's regular meeting at
7:30 p.m. in the Council Chambers in the Civic
Center.
Comments from the public will be received
at the public hearing on April 9, 1996, or
written comments may be submitted any time

for Amendments to the FY97 CDBG and HOME Allocations
At the April 9, 1996, Council meeting you requested that the Housing and Community
Development Commission review their recommendations for allocating the FY97 Community
Development Block Grant (CDBG) and HOME Investment Partnership (HOME) funds. It was
indicated by the Council that 950,000 - 975,000 should be allocated to the Tenant Based
Rent Assistance program.
In response to this request, the Commission met on April 16, 1996, and is making the
following amendments to the FY97 CDBG and HOME allocation recommendations.

Dear Members of the Council:
I am responding to your request regarding the effect of Greater Iowa City Housing Fellowship's
acquisition of existing property on the Iowa City market. Evaluation of the housing market and
feedback from the local Real Estate field assures me that Greater Iowa City Housing Fellowship
can acquire existing property and not negatively impact the local market.
During the preparation W the proposal for 1%'97 HOME and CDBG funding for the acquisition and
rehabilitation of 12 units of affordable rental housing, a market search was conducted. The market
search included all duplexes/multi-family housing and condominiuwa on the market. I specified a
price range of $93,500 and under for single family homes. The search was completed during
December, 1995 and January, 1996.
The search summaries revealed that there were 53 single family homes witlfin the designated price
range, and 14 condominiums and five duplexes on the market. These are unduplicated numbers
for December and January.
I have enclosed correspondence from a Realtor for your information. The correspondence states
that there are plenty of single family homes on the market. Additionally, according to the Iowa
City Area Association of Realtom, there am sigmficantly fewer properties are on the market dunng
the months of December and January than at other times of the year.
As a Fellowship, it is the intent of our organization to reach our goals in a manner which is
harmonious with our commumty. Any di,~emment that our projects lessen the market availability
of affordable housing ~s contmdictery to our mission.

PUBLIC HEARING NOTICE
On April 23, 1996, the City Council will hold
a public hearing regarding the allocation of
t~100,000 in Community Development Block
Grant and $100,000 in HOME Investment
Partnership funds to Robert Burns and Greater
Iowa City Housing Fellowship for an affordable
rental housing project.
These funds had previously been allocated to
the Robert Burns\Greater Iowa City Housing
Fellowship Joint Venture for an affordable
rental housing project on Old Dubuque Road.
A new affordable rental housing proposal has
been submitted for 16 lots in the Walden
Woods Subdivision, Part IV. A public hearing
is necessary due to the change in the location
of the proposed rental housing project.
Comments on this proposal or the allocation
of funds may be made at the public hearing,
held in the Civic Center, City Council Chambers
at 7:30 p.m. on April 23, 1996. Written com-
ments regarding the proposal will be accepted
by the City Clerks Office, 410 East Washington
Street. Information about the proposal is
available from the Department of Planning and

Public notice is hereby given that the City
Council of the City of Iowa City, Iowa, will con-
duct a public hearing on plans, specifications,
form of contract and estimated cost for the Iowa
City Landfill Fome Main Project in said City at
7:30 p.m. on the 23rd day of April, 1996, said
meeting to be held in the Council Chambers in
the Civic Center in said City.
Said plans, specifications, form of contract and
estimated cost are now on file in the office of the
City Clerk in the Civic Center in Iowa City, Iowa,
and may be inspected by any interested persons.
Any interested perSons may appear at said
meeting of the City Council for the purpose of
making objections to and comments concerning
said plans, specifications, contract or the cost of

Iowa City Sanitary Landfill Force Main Project
On April 23, 1996, a public hearing is scheduled for the above project as well as a resolution
approving plans and establishing a bid date. The public hearing should still be held, but the
plan approval and bid date should be postponed because of lack of necessary construction
approval form the IDNR.
All necessary information has been sent to the IDNR, but due to some confusion in the
submittal process, our receipt of the construction permit will be delayed. It is therefore
necessary to delay the plan approval and bid date accordingly.
At this point, it appears easier to defer the project indefinitely and re-set the public hearing
when we are more properly prepared.
