Council: Nov, Baker, Kubby, Lehman, Norton, Thornberry, Vanderhoef.
staff: Atkins, Helling, Woito, Karr, Yucuis, Franklin, Craig,
Boothroy, Hagerty, Trueblood, Schoon, Nasby.
Tapes: 96-52, all; 96-53, all.
Housing Administrator Introduction 96-52 Sl
Boothroy/ Tonight I would like to introduce you to Bob Hagarty...
new Housing Administrator. We hired him about three weeks ago.
He is from Charles City .... 16 years of experience ....
Bob Hagarty/ Thank you very much .... Thank you for the opportunity
to be able to come here and to be the administrator of the
Housing Program here ....
Review Zonin~ Matters 96-52 S1
a. Public hearing on an ordinance amending the Zoning Chapter to
change the use regulations of a 3.09 acre tract from RS-5, Low
Density Single-Family Residential, to OPDH-5, Planned Development
Housing Overlay, and approval of a preliminary OPDH plan for
property located on the north side of Village Road. (REZ96-0004)
Franklin/ First item is a p.h .... This is a preliminary OPDH Plan
and preliminary plat for a portion of Village Green. These are
more of the condominiums that are known as the Wellington
Condominiums and it continues the Village Green Development.
You have included in your packet the summary report from P/Z
Commission... these are multiple units in an RS-5 area and
there are reduced pavement widths on the streets which are
private streets at the interior of the project.
Nov/ Does this still have secondary access problems?
Franklin/ No, it does not have secondary access problems. At some
point soon we will have to bring out another connection to
Scott Blvd. But at this point there are no secondary access
problems.
b. Consider an ordinance amending City Code Title 14, Chapter 6,
"Zoning," Article J, "Overlay Zones," by creating a .lew overlay
zoning district entitled "Design Review Overlay Zone." (First
consideration)
Franklin/ The next item is ordinance amendment, the Design Review
Overlay Zone. You have had your p.h. on that. This is your
first consideration .....
This represents only e reasonably accurate transcription of the Iowa City council meeting of April 22, 1996.

Norton/ .....
Vanderhoef/ .... Page 6 of the ordinance ..... We have been
consistently going through the document with working days and
then all at once we have got ten business days. Why do we have
a difference in that? Then the "immediately filed" in the
first paragraph. Does that mean the next working day? .....
Franklin/ Are you still on #3, Appeal to the city council on page
6?
Vanderhoef/ Above that .... on page 6.
Woito/ It means as soon as reasonably possible. You want us to say
that?
Franklin/ Page 6, line 4.
Vanderhoef/ ...them further down in line 8...says "immediately
filed" .....
Franklin/ Maybe I have a different version.
Schoon/ Immediately filed means as soon as you can. The ideal would
be the decision would be made at the committee meeting and the
next day we would have the decision written up and available
to be filed.
Vanderhoef/ We have been real specific throughout the document ....
Norton/ I am a little bit concern as to where to start. One of the
problems I see is that if we start fiddling with any of the
wording... at what point would that have to lead to a new
p.h.?
Woito/ It is not going to. It is not substantive.
Norton/ I have got some others in there that might be ..... I kind
of think we need Design Review with some elements of
control ..... I would like to see us get into this... adding a
sunset paragraph.
Woito/ That is no problem. You can do that without starting over.
Nov/ Why do we need a sunset?
Norton/ Because I want to make sure that the processes are working

well and I want it to have to be looked at again thoroughly by
one year after the first overlay zone is established to see
how it is working in detail... pressure... costs .... Before we
approve that, I would argue that this particular ordinance
itself would also be revised rather than try to do it now .....
I would rather do it before we take up the first overlay zone.
So if we pass the enabling ordinance, then they could proceed
to develop the overlay zone, the first one. We would see what
the guidelines actually look like .... and we would have time
to think some of these details over again ..... I was going to
make it a year from-
Nov/ But you are talking only about the overlay zone having a
sunset?
Norton/ Even the enabling ....
Thornberry/ I would argue that the creation of Design Review had a
sunset clause .... all this is an extension .... It was designed
for urban renewal .... I am saying is it had a sunset clause.
Norton/ I don't know if we ever had formally a sunset in it. In any
case, I would think this one ought to be checked out because
I still have some concerns about its actual implementation.
Thornberry/ The sunset was urban renewal development. The last
parcel of urban development property is still to be decided...
At the end of that property it was to go away.
Norton/ .... stake we have in the attractiveness and viability .....
in d.t. is so crucial that I think some Design Review is
appropriate ....
Nov/ ...only the district has expanded.
Baker/ I think there is substantial public disagreement about this
particular expansion of Design Review .... process .... I
understand the concerns ..... He is talking about giving it a
year or so to prove ......
Thornberry/ Why can't we not have it and see how things progress
and then if the need is there for it, then institute it?
Baker/ You always discover the need after the problem.
Nov/ Then you amend .... to correct mistakes .... Example... the
Sensitive Areas Ordinance ..... He is talking about a sunset

clause .....
Baker/ At the end of year whatever it is, if the majority of
council doesn't think it is working-
Nov/ What if you leave it to the next council to make that
decision°..?
Franklin/ You could w-~ite such a clause that gave you a time period
in which a review of the ordinance was required and if that
review did not take place, that then the ordinance would
expire.
Nov/ When have we done that?
Franklin/ we haven't.
Nov/ And we shouldn't.
Franklin/
Baker/ When you got a split council.°. public disagreement... as a
tool to get the process through... this makes perfect sense to
me.
Norton/
Franklin/ If you want to add a clause like Dee is talking about, we
need to resolve that tonight .....
Woito/ You could put it in tomorrow night. We need to have some
idea of what language you want us to draft.
Norton/ Boiler plate around for sunset clauses.
Woito/ We did one in sidewalk cafes°
Karr/ Sidewalk cafes has one.
Woito/
Norton/ I would assume that would be in the enabling ordinance as
well .....
Baker/ We get review on the district and the guideline for the
district ..... They have got to have the enabling legislation
to continue that process ....
Thisrepresents only a reasonably accurate ~sns~lptlonofthelowa Clty coun~l meeting of April 22, 1996.
WS042296

Norton/ I have some problems about the application process .... who
is making the decisions .... They don't change the philosophy
of the thing. They change the details of the process ..... edit
this thing right tonight, we can do that ..... I don't
understand..° what preliminary review means. What documents
are in front of the building official when he decides between
the No Material Effect and a Certificate of Appropriateness
process .... what documents are in front of you .... Do you have
to have the photographs ..... confusing to me ..... I want to
know exactly what happens at that point... role of the
building official is... in channeling this thing either to the
Design Review Committee or not .... what does he look at to
make that decision without having the full submission. It is
details like that ....
Nov/ I don't know if those specifics need to be in an ordinance ....
Franklin/ What is the goal that you are trying to achieve, Dee?
Norton/ I am trying to clarify the process to make sure that if we
are going to have it, that it is as little intrusive as
possible and as fast as possible and as ..... puts little
burden .... I don't want to add a lot of agony to that process.
Franklin/ As similar as we could make it to existing processes, the
better. Would you agree with that?
Norton/ Indeed. I would like to have almost nothing more than what
you have to have for a building permit ..... for that process.
Woito/ It is very close to what is required for Historic
Preservation .....
Franklin/ The decision making is a little bit different.
Norton/ Is there is a role of the building official in that?
Woito/ Yes, definitely.
Schoon/ In the HP Ordinance, it is slightly different in that the
chair of the HP Commission along with the secretary of the
commission can rule on the Certificate of No Material Effect.
Remember of Certificate of No Material Effect is on those
instances when a building permit has to be required and it is
for repair or maintenance of a project.
Norton/ May I ask, what does the building official see to make that
This represents only 8 reesonably occurate transcription of the Iowa City council meeting of April 22, 1996.
WS042296
April 22, 1996 Council Work Session Page 6
decision?
Schoon/ The applicant would have to demonstrate that they are only
performing maintenance or repair ..... Confusion is a minor
sort of project versus a major sort of project and that is not
what a Certificate of No Material Effect is. It is just saying
that if you need a building permit and you are doing
maintenance or repair, it is saying that you can go ahead with
the project without having to go through the Certificate of
Appropriateness process.
Norton/ .... Let me try something. I can't see how the owner can
apply for a Certificate of No Material Effect or a Certificate
of Appropriateness because the decision about which of these
may be issues lies .... with the building official and possibly
the Design Review Committee. The owner may know nothing about
these certificates ..... What documents go to the building
officials for preliminary review to decide whether it is a No
Material Effect? I don't see that list anywhere.
woito/ The building plans°
Norton/ But they said they could do it a head of time ..... One of
the virtuals was you could do it before the drawings .... I
want to get the principles established, but after that they
has got to be some further refinements .....
Nov/
I am getting a little confused about what should be in an
ordinance and what should be in procedure directions such as
in the Building Department.
Norton/ I guess there is a lot of detail of this level in the
ordinance. It says what drawings to bring in, what photos to
bring in, what elevations, what structural drawings.
Norton/ That As for Design Review. WheB you have somebody who is
going to the Building Department and saying I need a permit to
put on a new roof, do they necessarily need all the list of
things here they are talking about for a new construction?
Thornberry/ It depends upon whether they change the slope of the
roof or not.
Norton/
Thornberry/ I don't think they are giving the owner any credibility
at all to show justification of any material changes ....

Norton/ I am not going that far, Dean... trying to clarify
process .... We could get the enabling thing established to
that in my judgement people could proceed to draft detailed
guidelines so we could see how that looks.
Kubby/ ...can we support
clause? ..... Ask Naomi,
clause?
the ordinance without a sunset
can you live with it with a sunset
Nov/
I think a sunset clause is semething that ought to be used
with great discretion, not on ordinances ...... I don't think
an ordinance said... An ordinance is amendable if it isn't
working.
Kubby/
Norton/ My question was to defer and clean up this thing now or
whether to go ahead and proceed. I think there are some
substantial changes. Those can be made in the future, too.
Venderhoer/ If you are that uncomfortable with it, Dee, I thinkwe
had better go back and redo it because perhaps we could make
it more palatable to a lot of us .....
Baker/ But I think Dee's point is you can do that refinements and
move forward at the same time .... You are going to have a
chance when you look at the districts and the guidelines .....
Norton/ I would like to see them go ahead.
Vanderhoef/ .... think maybe some cleaning up .....
Baker/ We can start this process and accomplish those goals and not
hang up creation of the districts and the guidelines ..... if
we can get the actual ordinance amendments agreed upon ....
Vanderhoef/ I underhand what you are saying, I don't agree with it.
Kubby/ Some of the frustration for me is Design Review has been
working on this for a long time and council members who are
unhappy with the details, should have been talking to Design
Review .....
Norton/ ...some of them didn't get straightened out ...... I am
interested in getting the ordinance established so we can
proceed to the next step ...... going to have to see some
substantial changes in this for me to endorse anything
Thlsrepresentsonly e m~onably accur~etran$c~pfion ofthelowa Cl~ council meeting of April22,1996.

further.
Nov/ If we pass this now, there is no reason why we cannot amend it
to fit the guidelines later. I just don't like the idea of
saying we must make those amendments within the next year or
any other specific date because I am not sure when we are ever
going to get to a district and guidelines.
Lehman/ Naomi .... to me this is a very very negative ordinance
trying to do a very very positive thing and I really really
think this thing should be delayed and if we can redo it ....
This ordinance represents a very great disincentive for
probably 90% of property owners south of Court Street .... If
they want to change it and improve the appearance, it has to
go through Design Review ...... They are going to leave that
building exactly where it is because this is a gross
inconvenience for them both in time and time is money ..... ;~n
ordinance allowing voluntary Design Review for everyone,
encouraging folks ..... maybe we can figure out an incentive
sort of thing from the city, so if I comply, we are doing
something for them ..... First, we haven't demonstrated a
need ..... The purpose I agree with 100% but it is a very
negative way to try to accomplish a positive result.
Vanderhoef/ I agree with what Ernie is saying and I agree that most
people are interested in doing the very best that they can do
for the dollar that they can afford and that is a big
statement .... I would like to also remind our council that the
dollar that we can afford in more inspections and more
staff .... we are incurring some additional costs for the city
to make this work ..... And we are seeing some of that
already... staffing to do all of these things .... could be
done on voluntary basis .....
Thornberry/ Interesting to note that the three people that have
bus~ness buildings are looking at this differently than those
who don't have business buildings. The Chamber of Commerce has
come out to say we really don't need this. We have more
confidence in the people that are in business that have
buildings whether we buy or lease than you are giving us
credit for .... Most of the pictures that were shown to us the
other night were done without Design Review and they were
saying these are nice things .... I really would rather not
have an ordinance of this magnitude established because of one
business that is perceived as not palatable.
Lehman/ ..... If you look at the area that we are talking about,
This reprosent8 only o reasonably accurate transcription of the Iowa Clpf council meeting of April 22, 1996.

the vast majority of them is not commercial property ..... We
are concerned about the cost of housing .... increase the cost
of housing.
Kubby/ ...there is a lot of commercial ..... If Design Review
Committee does a good job of educating people on the front
end, people can come in early .....
Vanderhoef/ Cost if going to make a difference ..... stretching out
their 45 days .... costly .....
Norton/ .... They didn't want to make a slide show of all the uglies
in town .... Plenty that weren't there .... They picked pretty
good examples. If I thought that everybody would comply with
everything by sweet and reasonableness, we wouldn't even have
zoning laws as far as I know .....
Thornberry/ We have building codes, too.
Norton/ We have seen some disasters in neighborhoods .....
Collective thing we are talking about here of what makes the
place work ..... Free help for plenty of people.
Thornberry/ To have it available but not mandatory I could
understand.
Norton/ The question is how far to do get without a few teeth down
the line? ...... Mutual controls .... ones that we all
collectively agree are going to be a benefit to us ..... We
can't afford many big mistakes .... And how much will it be a
benefit to us to get a really nicer looking place ....
Thornberry/ How bad is it?
Norton/
Thornberry/ Some of the things is in the eye of the beholder.
Norton/ .... part of this is leading to why we need to try it ....
Kubby/
Nov/
I would prefer the ordinance cover every new commercial
construction. But I am willing to go along with this and look
at that later.

Thornberry/ I am just getting tired of big brother.
Lehman/
Norton/ We do that to some extent all of the time.
Thornberry/ I know but the less the better.
Baker/ .... How we look at this ordinance and two phases jump out
here .... Gross inconvenience and an ordinance of this
magnitude .... This is a minor inconvenience ..... Other
business owners who support this concept as well.
Thornberry/ The Chamber of Commerce doesn't.
Baker/ Other business owners-
Thornberry/ Some do and some don't, Larry.
Norton/
Nov/ It is a fact that some business owners and some not agree with
every ordinance or disagree with every ordinance. So, can we-
Council/ (All talking).
Norton/ If push comes to shove I will go along with it as it is
rather than see it die.
Baker/ :... I don't want to see it die either ..... concerns can
still be worked out.
Council/ (All talking)°
Norton/ I much prefer a design assistance process.
Thornberry/
Norton/ I will wind up then. I will stop my diatribe here.
Baker/ You are still going to work with Design Review about the
particular concerns?
Norton/ I will talk with them ..... I have got pages that won't quit
here. I have got ponderous pages here .....
Nov/ .... You would be welcome at a Design Review Committee

meeting ....
Norton/ .... I will be there... I wish we had more votes but we got
four, I guess.
Franklin/ No changes for tomorrow night, oorrect?
Nov/ Well, a couple of minor-
c. Consider an ordinance amending the Zoning Chapter to change the
use regulations of a 1.88 acre tract from RR-1, Rural Residential,
to RS-5, Low Density Single-Family Residential for property located
at 3263 Rohret Road. (REZ96-0003) (First consideration)
Franklin/ First consideration ..... It will result in a subdivision.
d. Consider an ordinance amending the Zoning Chapter by changing the
use regulations of an approximate .14 acre parcel located at 24 N.
Van Buren Street from RM-44, High Density Multi-Family Residential,
to R/O, Residential/Office. (REZ95-0016) (Second consideration)
Franklin/ Second consideration of the rezoning .... Van Buren Street
from RM-44 to RO.
Kubby/ They have already started to grade .... Is that allowable to
do that kind of major earth moving before the zone has even
been?
Franklin/ They can but they do it at their own risk then ....
e. Consider a resolution approving a preliminary plat for Galway
Hills, Parts Three and Four, a 27.77 acre, 78-1ot subdivision
located south of Galway Drive, east of Highway 218. (SUB95-0032)
Franklin/ Consider a resolution approving a preliminary plat for
Galway Hills Parts 3 & 4. This was deferred from your last
meeting and.you received a memo from Linda about the meeting
which she had with representatives from the neighborhood and
representatives of the developer and she has given you a draft
resolution.
Kubby/ Can we go through the items in there?
Franklin/ Yes, definitely.
Woito/ And there are members of the neighborhood here and
representatives of the developer.

Franklin/ The first one let's look at is the buffer.
Council/ (All talking).
Franklin/ This is a buffer between
Part i and the new subdivision.
runs between these lots ....
the lots in... Galway Hills,
Basically an open space that
Nov/ Is this going to have a trail of some sort?
Franklin/ No... an open space that would be conveyed to the owners
of Part i or the lots that are abutted on Part 1 and that that
would be private open spaceo..maintained by those owners ....
They would have to form a homeowners association to take care
of that buffer area.
Kubby/ Why not all the landowners that abut it, Dot just those in
Part 17 .....
Franklin/ Probably because it was at the initiation of the folks in
Part 1.
Norton/
Woito/ We had talked about making it a part of a broader homeowners
association ..... We did talk about if we could get unanimity
with everyone redoing the entire homeowners association and
getting everybody on board. So this is just one possibility.
Franklin/ We might want to hold that thought until we get to the
issue of the other open space that has to do with this whole
draft resolution.
Kubby/ This buffer area, will it connect so this upper area could
be used as a safer route for people to walk? ....
Woito/ No .... buffering not connection.
Franklin/ Well, there is the potential- (Refers to map) .... There
is also an easement that runs down here into this open
space... connects to the south (refers to map) across .... This
right here is an access easement as well as storm sewer and
there would be a trail constructed from here down to the end
of the subdivision to the proposed Willow Creek Trail (refers
to map). There is a potential for connections. With that in
mind, let's look at the next section of the resolution which
deals with Outlot 2 (refers to map). As in the plat that was
Thlsrepresantg only are~sonab]y accurate trans~lptlon of the Iowa City coun~lmaafing of ApHI 22,1996.
WS042256
April 22, 1996 Council Work Session Page 13
originally before you... Outlot 2 was to be private open
space. What is proposed in this draft resolution as a change
is that this be public open space and then a trail would be
constructedby the developer through this .... (Refers to map).
That is the part that goes up to Kalarney ..... Connection up
to Donugal and then the reminder of Outlot 2... trail that
would be constructed at developer's expense and comes down and
connects with Tipperary and then down to the basin and Willow
Creek Trail. P/R Commission and the P/Z Commission concurred
when this plat was being reviewed that this would be private
open space due to the terrain.°. maintenance .... and to the
fact that it will eventually be surrounded by lots ....
Neighborhood open space... accessible .... Terry may wish to
speak to this. One of the issues has to do with whether this
is public or private and the maintenance responsibilities for
it. The other has to do with whether it counts towards the six
acre obligation for neighborhood open space. The draft
resolution and... position of Planning Department... and Parks
and Recreation Department also... That this not count towards
Neighborhood Open Space. If this is to be public space which
we are not recommending .... that is not count towards those
six acres.
Thornberry/ Why would you recommend that it not be towards the Open
Space?
Franklin/ Because of the issue of it being surrounded by the lots
and its visual accessibility .... But it will appear as if it
is in people's backyards ..... It will not have the feel of a
neighbor public open space but more as a private little place.
Kubby/ It is possible to have it be private open space with a
public easement for a trail and public maintenance of just the
trail?
Franklin/ It would be possible to have that. However the developer
will not consent to having it-putting in the trail if the
space is private open space. So, it is kind of a tradeoff
between that public space or the designation of it as public
open space with a trail or it remaining in private open space
with no trail. I would point out that in this development, of
course, there will be sidewalks on all of the local streets.
That is not necessarily the most direct way to get from here
to there but there will be ways to get to the trail system
using these streets .... (Refers to map) Question of how
convenient that trail then makes it to go through the center
and how important that is.

Kubby/ Having the trail there,
people more to the north

does it make it more convenient for
and the northeast in the future?
Larry Schnittjer/ (Refers to map). There will be a street generally
in this general alignment .... This trail, no way possible,
will be considered handicapped accessible because of the
grades that are out there .....
Lehman/ (Refers to map).
Schnittjer/ The trail starts somewhere-Mormon Trek... goes over
here .... (refers to map). Proposed trail, I have no idea.
Franklin/ For Willow Creek Trail.
Schnittjer/ It deadends at that street up there.
Franklin/ Our bicycle trail system and pedestrian trail system
throughout the city is going to be an integration of separate
trails with sidewalks ..... on street bicycle trails...
Norton/ Deadend into somebody's yard for a picnic.
CHANGE TAPE TO REEL 96-52 SIDE 2
Vanderhoef/ There certainly has always been an intent to have a
trail that would connect all the way ..... Down to Willow
Creek.
Franklin/ Using the sidewalks, too, Dee, or a separate trail.
Vanderhoef/
Kubby/
Vanderhoef/ You can't talk about the rest of that area ..... because
of grades and requests for some flat land ..... trail head and
then come on down. But this does not fit my picture of what I
think are public trails.
Norton/ Where would that one go eventually .... ?
Vanderhoef/ In this undeveloped area? That is to be worked out.

Norton/
Franklin/ In terms of this revised resolution, the issue of the
buffer, is that copasetic? What that is talking about is an
open space between the lots.
Woito/ Neighbors, do you want to respond to that?
Meg
Bayless/ I live at 524 Galway and we very much liked the
opportunity we had last week to meet with the representatives
of Nr. Cabill and Linda and I think the 12 people that came to
that meeting were hoping representatives for Mr. Cabill would
be empowered .... give us more than what we got. We liked the
idea of the buffer zone .... the resolution in front of you
really doesn't reflect what we carried away from that meeting.
We thought .... that the buffer zone would include trees,
vertical landscaping as well as grass.
Kubby/
Bayless/ I think Linda is right. Ultimately we were hoping we would
get everyone part of a homeowners association to maintain
that .... have him put in the trees.
Norton/ Apply for a PIN grant.
Bayless/ We will do that, too .... For right now we had come..
hoping less dense homes behind this area as a compromise and
a buffer zone and that was truly not discussed becauee
representatives from Dav-Ed were not empowered to do that. A
minimal this might be acceptable to us if it had trees and we
did like the idea of a trail... saw the trail going no where.
Kubby/ Other people who were at that meeting ....
Nov/ Can we hear from Chuck or from Larry? I know the neighbors are
asking for something but I want to hear the answer.
Chuck Mullen/ Here as counsel to Dave-Ed Limited° I did attend the
meeting and I am thankful that Linda also attended the

the neighbors complaints... understanding my belief is that
Dav-Ed came to the council with a plan that met the criteria
established in your ordinances... entitled to be approved
...... We did volunteer to make the neighbors a part of the
homeowners association for Galway Hills Part 2 ......
membership could be expanded ..... a single homeowners
association consisting of all of the owners within the various
subdivisions in Galway Hills ..... implementation covenants ....
broad enough .... Do have a pond ..... We did volunteer to make
them members of that homeowners association, I supplied copies
of the covenants, articles and by-laws ..... But we are not
willing to be hung up waiting for all of the owners in Part 1
to get together to decide whether or not they want to be
members .....
Baker/ .... The plat that was before us two weeks ago, there was no
specified buffer area in that plat. This is a concession by
you?
Mullen/ Yes. And we would propose that it be conveyed to a
homeowners association .... broader organization.
Kubby/ I wondering if the language... locks it in to just the
abutting property owners .....
Woito/ It should be changed.
Nov/ It says in all of Part I but maybe it ought to be all, period.
Woito/ I can change it to have it go to the homeowners association
which will include all parts of Galway Hills subdivision, 1,
2, 3, & 4.
Mullen/ But not necessarily all of the owners of lots within Part
1 because we can't control that ....
Kubby/ The language should be flexible .... whatever makes it the
most flexible.
Woito/ Chuck and I need to talk.
Mullen/ The choice will be either to be a member of the overall
homeowner's association or a member ..... assessed along with
everybody else. Entitled to enjoy whatever common facilities
that are there ..... If you choose not to be a member, you will
not be assessed .... you won't have any right to use those
kinds of facilities.

Kubby/ I want to make sure that this language here that even if
they choose to become members of the homeowners association,
that the homeowners association pays for the maintenance, not
Just the abutting property owners.
Mullen/ That would be my concept .....
Woito/ What about installation of trees or grass?
Mullen/ .... The owners were volunteering to plant-
Woito/ I thought the neighbors offered to install grass or
whatever.
Nov/ If you are going to talk, you have to come to the microphone
because we are required to tape record this.
Mullen/
Nov/ We need to get the lawyers together to re-write this.
Mary
Reiman/ I did personally talk of grants and funding and that
could be over and above the initial buffer. I didn't say we
will take care of everything. I never intended that ..... If
this area was able to be set aside from Galway 1 to use ....
that we would apply for grants and we would do the work ....
Amount that is given is not even big enough for any kind of
improvement of that size. The trees could fit there .....
Norton/ Do you agree that all of people with the exclusions that
Chuck has alluded to, all the people in the homeowners
association would be involved as distinct to just the people
that abut on this particular piece of land ......
Re/man/ I have heard comments from neighbors that do not abut up to
this land that what would be their interest in getting to it.
It deadends .....
Norton/ ...people that abut on it are the ones that would be in the
position to use it and .... maintain it ....

Reiman/ To me the buffer would have been a variation of side lots
and maybe some open space. The buffer could be a combination
of things. One of the main things was to decrease the density
and increase the diversity of those lots and allow for
wildlife and the trees ..... access to that outlot if it went
public .....
Thornberry/ It might have to be private... could still use it to
get down to that other area.
Reiman/
Nov/ If it were private it would mean owned by the homeowners
association, not owned by the abutting lots.
Reiman/
Nov/
Thornberry/ One homeowners association for Galway Hills.
Reiman/ Our agreement to that doesn't hold up their construction
.... We need time to digest some of this ....
Thornberry/ .... neighbors buy the grass seed .....
Reiman/ ..... we would be maintaining someone else's end of their
backyard?
Kubby/ Some of the backyard became the buffer area.
Reiman/ .... We are just handed this land and said here, you can
mow this and that is not at all what we had in mind ..... We
were truly trying to compromise .... We haven't had a chance to
get together ....
Kubby/ Is it better to have the smaller lots and a buffer or have
the lots be as originally proposed?
Reiman/ As originally proposed.
Kubby/ Do the rest of your neighbors agree with that?
Reiman/ The ones that are here.
Woito/ No buffer?

Nov/ Shall we go back to the original plan?
Reiman/
Thornberry/ I think it is a question between the neighbors and the
developers.
Vanderhoef/ Can you have an answer for us by tomorrow night?
Whether you do or don't want the buffer?
Reiman/ I believe we will. Everyone that is abutting it will be at
the meeting tonight.
Woito/ Call me tomorrow morning.
Council/ (All talking).
Nov/ If we are going to amend this, we are going to go back to the
original resolution. Do we then have to post that again?
Woito/ No.
Reiman/ If the developer would say there is something I can do here
to compromise and make the situation better, would you still
on a final plat be able to do something? This is a
preliminary-
Franklin/ If there is not a significant change from the preliminary
to the final some accommodation could be made. If it is a
complete redo, then we would have to do preliminary and final
together at that time ..... In terms of process... yes, there
could be some changes... as long as they were not huge. If
they were huge, then we would have to kind of start over
again.
Kubby/ It is my understanding that the developer doesn't want to
change the size and number of lots.
Reiman/ He has not talked to us and Chuck Mullen has stated that
are within all their legal rights.

Woito/ Call me tomorrow.
Franklin/ We still have the issue of Outlot 2 and the public
private open space and I think Terry would like to address
you°
Terry Trueblood/ Maybe I can help clarify a couple of things ....
P/R Commission and also Neighborhood Open Space Task Force
reviewed this twice and voted not to accept it at least as
part of the neighborhood open space allocation as required by
the ordinance .... Maintenance problem because of the
topography .... main reason is that it is not viable as a
neighborhood park because of the topography and it is a storm
water detention area ..... If council directed us to accept
this land, we would cheerfully do so. But I think one of the
things .... I don't believe this addresses concerns of the
current neighborhood residents .... On the Neighborhood Open
Space Ordinance for trail purposes, the ordinance says we have
to have a minimum of a 20 foot wide access. That is just for
the trails ..... If it is going to be a park or open space
area, we have to have a minimum of 50 feet of access ...... the
visual that Karin referred to and slope, a maximum of 15%
slope for a neighborhood park. ADA regulations ..... just to
clarify°.. we may or may not be required to make this
accessible to persons with disabilities. The law is really
rather vague in many areas .... Where feasible you have to make
things accessible ..... that is determined by either the
department of justice of courts ..... Our philosophy and policy
is to try to make things accessible if at all feasible .....
Trail system that we built in Ryerson Woods ..... small segment
in there that is accessible ..... The more slope the more
difficult it is to maintain ..... Rule of thumb is we think
anything over 25% slope is .... we can go as high as 33% but
that is really pushing it for mower operation. 25% is usually
the most that we like to see .... Trails should be constructed
by the developer .... receive it in mowable condition or ready
to accept condition .... It would have to be with the
understanding that it is going to be a low maintenance area as
far as park aspect .... It is not going to be a neighborhood
park .... ground cover that is mowed 2-3 times a year ....
Public Works... intake or outlet... they would be responsible
for .... Hunters Run .... a little different situation .....
Thornberry/ Would you like to have that?
Trueblood/ Right now, I would have to say noo Any questions?

Nasby gets here ..... This is the FY96 CBDG and HOME funding
allocations... requested that the HCD Commission advise you on
how to reallocate some funds to get up to $75,000 for Tenant
Based Rent Assistance. The recommendation of the Commission is
to take $50,000 from Housing Rehab Program and $25,000 from
GICHF and put that into $75,000 for Tenant Based Rent
Assistance. You have two resolutions in your packet .... adopt
the revised allocation without Free Med and then a resolution
which adopted the Free Med allocation ..... Call your attention
to Steve's memo of April 18 indicating that the commission
requested that the council consider using $75,000 in General
Fund moneys for the Tenant Based Rent Assistance Program as an
alternative to the reallocation .....
Nov/ Alternative or an addition?
Franklin/ As an alternative... from the General Fund .....
Kubby/ ...I have problems especially with taking it from Housing
Rehab ..... How many households will not get served...?
Steve Nasby/ It depends on what program Pam decides to take the
$50,000 out of... they are talking about Mobile Home Repair

possibly. The other place they are looking at is the
Residential Accessibility ...... and Exterior Repair ..... The

then was to come up with configuration and space needs .... got
figures for expansion ..... Essentially the estimated costs
were roughly .... $12 million to renovate and expand the

Additional problem was we hoped that there would be a way to

costs that we have to come up with... this does not include

Traw/ Yeah, they would be a part of the bond issue. The other thing
you should be aware of the Library Foundation is excited about
this...July '95 they hired a professional fund raiser and are
anxious to get out a raise money for this project ....
Baker/ I have lots of questions .... two general questions. Was

is an unreasonable cost for this service, what is your
alternative?
Traw/ If they say that, then we have to reconsider .... We don't
have a plan ..... B and a plan C and plan D .... If this fails
we will do,,,,work as hard as we can to come up with what is
necessary that the public will accept to meet there needs ....
Baker/ Do you consider this a project that will satisfy the present

Nov/ We are only running a little bit behind.
Sensitive Areas Ordinance Staffing.
We are on the
Arkins/ I will do that and try to summarize it fairly quickly... I
put in the packet two memos and we have a job description.
Bottom line is the need to have a staff person to enforce the
ordinance ..... I would like to assign the position to Doug's
office ..... a resolution would have to be brought back to you
to approve it. We have the money budgeted. Ready to go. It is
Just a matter of we wanted you to understand how we were
intending to do this and we are going to operate out of ~IS.
Kubby/
Atkins/ I have told Rick that I certainly felt .... this is going to
be something even broader, private and public projects. The
things that I did indicate to Rick that if he needed some
money to secure some outside assistance, that would be fine
with me ..... It seemed this position was best suited for ~IS
because they review most of these plans ....
Kubby/ ...I want a hybrid. I want an engineer to who will do
inspections on site and I think that would be a dynamite
position and I would support one position that is a melding.
Atkins/ The engineering, Doug can speak better than I to this .....
When we were researching the positions, there is a body of
knowledge which is technical but not engineering...
environmental backgrounds .... If you want a civil engineer
with environmental experience, you are probably going to have
to pay a lot more than this thing.

Could be environmental studies ..... any of those ....
Boothroy/ The educational background does include the possibility
of a civil engineer with environmental studies which is
offered at the University of Iowa or could be a higher degree
in environmental engineering which is offered in other parts
of the area... or it could be in geography .... number of
different places that do these kinds of things. I talked to

Department... Planning Department... got feedback from all
those various areas and they all felt that the people that
were cross trained... would be able to handle this particular
job.
Kubby/ Engineering isn't listed in the job summary or in knowledge,

Atkins/ Environmental engineering, Karen.
Boothroy/ I didn't put down civil engineering with environmental
studies .... listing environmental engineering would get to
that .....
Norton/
Woito/ I think Karen is right, if you do hire someone without the
engineering background, you are going to put stress on the
Engineering Division because only the engineers can read those
grading plans .....
Boothroy/ I am not sure that is true. The purpose of this
position... is to review grading plans.
Woito/ The engineering portion of the grading plans stuff that HIS
does gets done by the engineers.
Arkins/ I don't have a basic disagreement with it. I think we have
to understand the nature of that ordinance .... involves such
a variety of enforcement provisions. Wetlands, soils,
woodlands .... We are trying to fashion a position ....
engineering is certainly an important component of it .....
involves a whole variety of issues.
Woito/ Council needs to be aware of extent of engineering skills
that are needed for this job.

Local ODtion Sales Tax 96-53 S1
Nov/ We are on to a discussion of local option sales tax. Marian
has given us tonight a list of what other cities have put on
the ballot ..... We need to decide among ourselves if this is
something we truly need .... Should we put it on the
ballot? .... If it is on the ballot, how do we word it? We have
to have all the ballot words to the Auditor on August 28 and
that means all .... If we are going to put it on the ballot had
better make that decision soon enough so that other cities can
get their wording in order.
Baker/ .... I am wondering if tonight we can sort of tentatively
get a schedule on such and such date we will accomplish such
and such. We will have a p.h. by such and such a date .....
Nov/ If we do not have four people who definitely want a sales
tax... there is no point in getting a schedule in order.
Kubby/ We asked that before, there were six people who
instantaneously said yes. So I feel we have gone beyond that.
Nov/ We have people who said well, I would go along with it if it
were allocated to whatever project I liked ..... ifs, pretty
big ones.
Baker/ We shouldn't have a hard and fast irrevocable position right
now on the particulars of the ballot° If we want a sales tax
option, we have a certain time to reach that hard and fast
discussion on the options .... We ought to have some public
input ....
Nov/ You are saying now you want public input on whether or not we
should have a sales tax?
Baker/ No. I am saying we should have public input, if we are going
to have a sales tax .... legitimate allocations for that sales
tax.
Thornberry/ ..... My suggestion to Naomi this afternoon was having
a telephone hot line type thing set up... machine answering...
got two minutes. Given there is a one cent sales tax, what
would you like that money to go for type of thing. You have
two minutes to respond ....

Thornberry/ Just getting some input ....
Lehman/ .... I can't say i am totally locked into this .... If the
allocation to anything but CIP then I can't support it.
Baker/ ...allow ourselves some flexibility on what we define as a
CIP .... Have 2-3 general categories that we allocate a certain
percentage to .... That is what we can decide. I don't thinkwe
have to pin it down to capital project.
Lehman/ If we are going to ask the public to pay a 1% sales tax,
they have a right to know what we are going to spend it
for...specifically.
Thornberry/ My proposal is not go broad.
CHANGE TAPE TO REEL 96-53 SIDE 2
Baker/ Did we all agree on a ten year sunset clause? ....
Thornberry/ It has got to have a sunset clause.
Council/ (All talking).
Nov/ A minimum sunset clause of ten rather than a maximum? .... Most
of us could go along with a sunset.
Baker/ Okay...discuss the length of that. Ten seems a minimum ....
Trying to be proactive for at least ten years... be clear and
finite and up front... only these projects for the next ten
years°
Lehman/ .... If it is perceived by the public as just being another
tax, it will not pass .....
Baker/ But it is how we define those projects ....
Kubby/ Whatever we use it for, it is a tax, it is a sales tax ....
no matter what we say it is for ....
Lehman/ I think it can be shown that a sales tax .... far less
regressive than the increase in water rates are going to be.

Nov/ I would not say d.t. improvements .... I would say public

Norton/ There might be virtues of being somewhat more specific ....
needs to be fairly broad .... I was more focusing on dot. and
Near South Side where we have already made some commitments to
try to move this along ....
Nov/
.... There are various projects that may take priority in a
given year and I don~t want future councils to be absolutely
committed to spend that money only within a finite area.
Norton/
Nov/ If you were to say, for example, that it is all going to be in
capital improvements ..... not going to use any sales tax money
for operations .... There would be some General Fund money for
operations because you have pulled some capital projects out
of the General Fund ....
Baker/ You have to be careful about that term operating
expenses ....
Council/ (All talking).
Baker/ .o. We need to do two things at once. We need to get a ....

we can sale to the public and that is why just picking one

for the next ten years, we are going to have to send money
d.t. We can Justify it in all sorts of ways.
Nov/ How specific...?
Baker/ You determine the percentage and that will flux~ate by the
year.
Lehman/ ...We find ourselves in a very unique situation... where
the minimum water rates...in year 2000 is $79 and some cents
per month ..... The sales tax revenue .... rates in neighborhood
of $50 per month minimum?
Don Yucuis/ The entire amount, the rates would most likely stay
about the same they are right now. They might even go down.
Lehman/
¥ucuis/
Lehman/ I think that represents a very unique situation we are
in .... Because we have a large number of people who are in the
lower of the income scale .... I think it is going to be a real
benefit to some people who can at least afford this increased
rates. I would not support a sales tax to do s.t. improvement
...... We can help some folks out.
Kubby/ The people you are helping you are disproportionately
taxing. The lower strata is going to be paying a bigger
portion of their income for sales tax which is going to
relieve rates for water for everybody .....
Lehman/ $40,000 a year .... disposable income... in neighborhood of
$4,000-5,000 a year. That is $40-50 bucks it is going to cost
you. Your water rate will go up $360 a year.
Norton/ ...we need to stretch that out... over a longer set of
people .... one way of reducing water rates ....
Nov/ I am going to agree with Dee on this one... We don't say we
need a sales tax in order to reduce the water rate ....
Baker/ I see the substantial portion of the sales tax revenue being
allocated towards water rate relief .... Also it is the easiest
understood issue for the public to say I will support sales
tax ....

just for the water rates .... We need the whole county to
cooperate if this tax is going to do something for us .....
Norton/ I think it is going to be interesting to leaf through this
handout we got tonight .....
Nov/ There was a time when you must put property tax relief on the
ballot ..... Some part of it must go to property tax relief and
then the rest of it is flexible.
Kerr/ You have to put the line down and account for it even at a
zero. Okay, you don't have to put a percentage in there.
Nov/
Baker/ I am not thrilled about using the sales tax for property tax
relief ..... potential for property tax relief... that is not
my goal. That is not the way I would sell it to the public. I

community betterment ....
Thornberry/ Larry, what you are saying, you want to get as many

they don't like and say I am not going to vote for it.

because of the water .... and the sewer plant combination
coming together at the same time. That is why we are having
this discussion about sales tax increase ....
Baker/ ...that is not the only budget problem we have.
Thornberry/ I would rather see less government than more.
Nov/ Let's say, if we chose to we could reduce the water and sewer
rates by changing our formula of set asides and we do not need
a sales tax. Would you go along with it?
Thornberry/ No. I don't- I said I would support the concept of an
increase in sales tax... if it were for that reason ....
Nov/ We can do that without the sales tax ....
Thornberry/ Then we wouldn't need a sales tax increase ....
Nov/ We can take care of that issue without a sales tax ....
Norton/ ...adjusting the rate structure .... It would be an
attractive element of this .....
Thornberry/
Nov/
I still believe if we are going to put it on the ballot .....
We are putting it on the ballot because we need it .... There
is an ability to help the water rates without the sales
tax .... We can readjust our user fees and spread the schedule
in a different fashion and reduce our future increases.
Thornberry/
Nov/
... we need it for something that we cannot take care of in
another fashion ..... It is very difficult for me to go out in
the public and say please vote for this tax, we really need it
because I know... it is not true. But for some other purpose
we may say we need it.

Norton/ ..... It would certainly restrain the increases
considerably.
Vanderhoef/ Ten years of assistance... of a sales tax .... could get
us well into being able to bring those bonds in at reasonable
rates....
Kubby/ Start planning for increase in capacity ....
Vanderhoef/
Thornberry/ They can double the output of water without any more
land acquisition.
Kubby/ The land is but a very small percentage of the total cost of
building a water treatment facility.
Thornberry/ They are building it now like they should have built
the library .... with excess capacity ....
Baker/ One of the assumptions that I am operating on .... My
perception .... our budget in next ten years is we are going to
face a lot of unknowns .... that is why, as a source of revenue
for the city .... this seems like a reasonable alternative for
long term budget problems ...... revenue stabilization .... I am
trying to protect programs .... That money spent in this
community can be turned over in a lot of ways .... benefit a
great range of people. If you tie it to one thing, you have
tied your hands .....
Thornberry/ .... We don't know what we will be getting from the
federal government. I think we can't ask the people for a one
cent city sales tax on the maybe.
Baker/ We certainly have transit problems... housing problems ....
Our housing program ain't our money ....

saying don't do this to us, people will go and shop in Cedar

Kubby/ How do we annotate this conversation with the library

Nov/ That is an issue to be considered.
Kubby/ They have been working really hard for a long time ....
Thornberry/ I don't think it should make any difference ....
Kubby/ ...they have established a plan .... The question is still

support the concept of expanding the library d.t ...... I think
a library ballot should be on this November ....
Baker/
Norton/ I have heard people argue that it could be a virtue,
Nov/ I have hear arguments from both sides.
Baker/ We have two major selling jobs going on at once. One selling
job affects the other one .... Sales tax resolution is a more
important issue for this community .... for us to resolve than
the library issue ..... I am trying to find a way to reach some
sort of accommodation with each other that is for the good of
the city .... The sales tax issue affects more other issues
than just the water and sewer... in a positive way ....

very adamant against using it just for water rates and if the
majority said that, I might say no ....
Thornberry/ Wh~t do you think it should be used for?
Kubby/ I am not in favor of sales tax at this point .... I may be
persuaded because of its use .... We haven't gotten to that

Lehman/ We are sitting here acting like we are going to pass the
