Thank you for the opportunity to be able to come here and to be the administrator of the Housing Program here .... Review Zonin~ Matters 96-52 S1 a. Public hearing on an ordinance amending the Zoning Chapter to change the use regulations of a 3.09 acre tract from RS-5, Low Density Single-Family Residential, to OPDH-5, Planned Development Housing Overlay, and approval of a preliminary OPDH plan for property located on the north side of Village Road. (REZ96-0004) Franklin/ First item is a p.h .... This is a preliminary OPDH Plan and preliminary plat for a portion of Village Green. These are more of the condominiums that are known as the Wellington Condominiums and it continues the Village Green Development. You have included in your packet the summary report from P/Z Commission... these are multiple units in an RS-5 area and there are reduced pavement widths on the streets which are private streets at the interior of the project. Nov/ Does this still have secondary access problems? Franklin/ No, it does not have secondary access problems. At some point soon we will have to bring out another connection to Scott Blvd. But at this point there are no secondary access problems. b. Consider an ordinance amending City Code Title 14, Chapter 6, "Zoning," Article J, "Overlay Zones," by creating a .lew overlay zoning district entitled "Design Review Overlay Zone." (First consideration) Franklin/ The next item is ordinance amendment, the Design Review Overlay Zone. You have had your p.h. on that. This is your first consideration ..... Page 6 of the ordinance ..... We have been consistently going through the document with working days and then all at once we have got ten business days. Why do we have a difference in that? Then the "immediately filed" in the first paragraph. Does that mean the next working day? ..... Franklin/ Are you still on #3, Appeal to the city council on page 6? Vanderhoef/ Above that .... on page 6. Woito/ It means as soon as reasonably possible. You want us to say that? Franklin/ Page 6, line 4. Vanderhoef/ ...them further down in line 8...says "immediately filed" ..... Franklin/ Maybe I have a different version. Schoon/ Immediately filed means as soon as you can. The ideal would be the decision would be made at the committee meeting and the next day we would have the decision written up and available to be filed. Vanderhoef/ We have been real specific throughout the document .... Norton/ I am a little bit concern as to where to start. One of the problems I see is that if we start fiddling with any of the wording... at what point would that have to lead to a new p.h.? Woito/ It is not going to. It is not substantive. Norton/ I have got some others in there that might be ..... I kind of think we need Design Review with some elements of control ..... I would like to see us get into this... adding a sunset paragraph. Woito/ That is no problem. You can do that without starting over. Nov/ Why do we need a sunset? WS042296 April 22, 1996 Council Work Session Page 3 well and I want it to have to be looked at again thoroughly by one year after the first overlay zone is established to see how it is working in detail... pressure... costs .... Before we approve that, I would argue that this particular ordinance itself would also be revised rather than try to do it now ..... I would rather do it before we take up the first overlay zone. So if we pass the enabling ordinance, then they could proceed to develop the overlay zone, the first one. We would see what the guidelines actually look like .... and we would have time to think some of these details over again ..... I was going to make it a year from- Nov/ But you are talking only about the overlay zone having a sunset? Norton/ Even the enabling .... Thornberry/ I would argue that the creation of Design Review had a sunset clause .... all this is an extension .... It was designed for urban renewal .... I am saying is it had a sunset clause. Norton/ I don't know if we ever had formally a sunset in it. In any case, I would think this one ought to be checked out because I still have some concerns about its actual implementation. Thornberry/ The sunset was urban renewal development. The last parcel of urban development property is still to be decided... At the end of that property it was to go away. Norton/ .... stake we have in the attractiveness and viability ..... in d.t. is so crucial that I think some Design Review is appropriate .... Nov/ ...only the district has expanded. Baker/ I think there is substantial public disagreement about this particular expansion of Design Review .... process .... I understand the concerns ..... He is talking about giving it a year or so to prove ...... Thornberry/ Why can't we not have it and see how things progress and then if the need is there for it, then institute it? Baker/ You always discover the need after the problem. Nov/ Then you amend .... to correct mistakes .... Example... the Sensitive Areas Ordinance ..... Baker/ At the end of year whatever it is, if the majority of council doesn't think it is working- Nov/ What if you leave it to the next council to make that decision°..? Franklin/ You could w-~ite such a clause that gave you a time period in which a review of the ordinance was required and if that review did not take place, that then the ordinance would expire. Nov/ When have we done that? Franklin/ we haven't. Nov/ And we shouldn't. Franklin/ Baker/ When you got a split council.°. public disagreement... as a tool to get the process through... this makes perfect sense to me. Norton/ Franklin/ If you want to add a clause like Dee is talking about, we need to resolve that tonight ..... Woito/ You could put it in tomorrow night. We need to have some idea of what language you want us to draft. Norton/ Boiler plate around for sunset clauses. Woito/ We did one in sidewalk cafes° Karr/ Sidewalk cafes has one. Woito/ Norton/ I would assume that would be in the enabling ordinance as well ..... Baker/ We get review on the district and the guideline for the district ..... They change the details of the process ..... edit this thing right tonight, we can do that ..... I don't understand..° what preliminary review means. What documents are in front of the building official when he decides between the No Material Effect and a Certificate of Appropriateness process .... what documents are in front of you .... Do you have to have the photographs ..... confusing to me ..... I want to know exactly what happens at that point... role of the building official is... in channeling this thing either to the Design Review Committee or not .... what does he look at to make that decision without having the full submission. It is details like that .... Nov/ I don't know if those specifics need to be in an ordinance .... Franklin/ What is the goal that you are trying to achieve, Dee? Norton/ I am trying to clarify the process to make sure that if we are going to have it, that it is as little intrusive as possible and as fast as possible and as ..... puts little burden .... I don't want to add a lot of agony to that process. Franklin/ As similar as we could make it to existing processes, the better. Would you agree with that? Norton/ Indeed. I would like to have almost nothing more than what you have to have for a building permit ..... for that process. Woito/ It is very close to what is required for Historic Preservation ..... Franklin/ The decision making is a little bit different. Norton/ Is there is a role of the building official in that? Woito/ Yes, definitely. Schoon/ In the HP Ordinance, it is slightly different in that the chair of the HP Commission along with the secretary of the commission can rule on the Certificate of No Material Effect. Remember of Certificate of No Material Effect is on those instances when a building permit has to be required and it is for repair or maintenance of a project. Confusion is a minor sort of project versus a major sort of project and that is not what a Certificate of No Material Effect is. It is just saying that if you need a building permit and you are doing maintenance or repair, it is saying that you can go ahead with the project without having to go through the Certificate of Appropriateness process. Norton/ .... Let me try something. I can't see how the owner can apply for a Certificate of No Material Effect or a Certificate of Appropriateness because the decision about which of these may be issues lies .... with the building official and possibly the Design Review Committee. The owner may know nothing about these certificates ..... What documents go to the building officials for preliminary review to decide whether it is a No Material Effect? I don't see that list anywhere. woito/ The building plans° Norton/ But they said they could do it a head of time ..... One of the virtuals was you could do it before the drawings .... I want to get the principles established, but after that they has got to be some further refinements ..... Nov/ I am getting a little confused about what should be in an ordinance and what should be in procedure directions such as in the Building Department. Norton/ I guess there is a lot of detail of this level in the ordinance. It says what drawings to bring in, what photos to bring in, what elevations, what structural drawings. Norton/ That As for Design Review. WheB you have somebody who is going to the Building Department and saying I need a permit to put on a new roof, do they necessarily need all the list of things here they are talking about for a new construction? Thornberry/ It depends upon whether they change the slope of the roof or not. Norton/ Thornberry/ I don't think they are giving the owner any credibility at all to show justification of any material changes .... We could get the enabling thing established to that in my judgement people could proceed to draft detailed guidelines so we could see how that looks. Kubby/ ...can we support clause? ..... Ask Naomi, clause? the ordinance without a sunset can you live with it with a sunset Nov/ I think a sunset clause is semething that ought to be used with great discretion, not on ordinances ...... I don't think an ordinance said... An ordinance is amendable if it isn't working. Kubby/ Norton/ My question was to defer and clean up this thing now or whether to go ahead and proceed. I think there are some substantial changes. Those can be made in the future, too. Venderhoer/ If you are that uncomfortable with it, Dee, I thinkwe had better go back and redo it because perhaps we could make it more palatable to a lot of us ..... Baker/ But I think Dee's point is you can do that refinements and move forward at the same time .... You are going to have a chance when you look at the districts and the guidelines ..... Norton/ I would like to see them go ahead. Vanderhoef/ .... think maybe some cleaning up ..... Baker/ We can start this process and accomplish those goals and not hang up creation of the districts and the guidelines ..... if we can get the actual ordinance amendments agreed upon .... Vanderhoef/ I underhand what you are saying, I don't agree with it. Kubby/ Some of the frustration for me is Design Review has been working on this for a long time and council members who are unhappy with the details, should have been talking to Design Review ..... Norton/ ...some of them didn't get straightened out ...... WS042296 April 22, 1996 Council Work Session Page 8 further. Nov/ If we pass this now, there is no reason why we cannot amend it to fit the guidelines later. I just don't like the idea of saying we must make those amendments within the next year or any other specific date because I am not sure when we are ever going to get to a district and guidelines. Lehman/ Naomi .... to me this is a very very negative ordinance trying to do a very very positive thing and I really really think this thing should be delayed and if we can redo it .... This ordinance represents a very great disincentive for probably 90% of property owners south of Court Street .... If they want to change it and improve the appearance, it has to go through Design Review ...... They are going to leave that building exactly where it is because this is a gross inconvenience for them both in time and time is money ..... ;~n ordinance allowing voluntary Design Review for everyone, encouraging folks ..... maybe we can figure out an incentive sort of thing from the city, so if I comply, we are doing something for them ..... First, we haven't demonstrated a need ..... The purpose I agree with 100% but it is a very negative way to try to accomplish a positive result. Vanderhoef/ I agree with what Ernie is saying and I agree that most people are interested in doing the very best that they can do for the dollar that they can afford and that is a big statement .... I would like to also remind our council that the dollar that we can afford in more inspections and more staff .... we are incurring some additional costs for the city to make this work ..... And we are seeing some of that already... staffing to do all of these things .... could be done on voluntary basis ..... Thornberry/ Interesting to note that the three people that have bus~ness buildings are looking at this differently than those who don't have business buildings. The Chamber of Commerce has come out to say we really don't need this. We have more confidence in the people that are in business that have buildings whether we buy or lease than you are giving us credit for .... Most of the pictures that were shown to us the other night were done without Design Review and they were saying these are nice things .... I really would rather not have an ordinance of this magnitude established because of one business that is perceived as not palatable. Lehman/ ..... WS042296 April 22, 1996 Council Work Session Page 9 the vast majority of them is not commercial property ..... We are concerned about the cost of housing .... increase the cost of housing. Kubby/ ...there is a lot of commercial ..... If Design Review Committee does a good job of educating people on the front end, people can come in early ..... Vanderhoef/ Cost if going to make a difference ..... stretching out their 45 days .... costly ..... Norton/ .... They didn't want to make a slide show of all the uglies in town .... Plenty that weren't there .... They picked pretty good examples. If I thought that everybody would comply with everything by sweet and reasonableness, we wouldn't even have zoning laws as far as I know ..... Thornberry/ We have building codes, too. Norton/ We have seen some disasters in neighborhoods ..... Collective thing we are talking about here of what makes the place work ..... Free help for plenty of people. Thornberry/ To have it available but not mandatory I could understand. Norton/ The question is how far to do get without a few teeth down the line? ...... Mutual controls .... ones that we all collectively agree are going to be a benefit to us ..... We can't afford many big mistakes .... And how much will it be a benefit to us to get a really nicer looking place .... Thornberry/ How bad is it? Norton/ Thornberry/ Some of the things is in the eye of the beholder. Norton/ .... part of this is leading to why we need to try it .... Kubby/ Nov/ I would prefer the ordinance cover every new commercial construction. Thornberry/ I know but the less the better. Baker/ .... How we look at this ordinance and two phases jump out here .... Gross inconvenience and an ordinance of this magnitude .... This is a minor inconvenience ..... Other business owners who support this concept as well. Thornberry/ The Chamber of Commerce doesn't. Baker/ Other business owners- Thornberry/ Some do and some don't, Larry. Norton/ Nov/ It is a fact that some business owners and some not agree with every ordinance or disagree with every ordinance. So, can we- Council/ (All talking). Norton/ If push comes to shove I will go along with it as it is rather than see it die. Baker/ :... I don't want to see it die either ..... concerns can still be worked out. Council/ (All talking)° Norton/ I much prefer a design assistance process. Thornberry/ Norton/ I will wind up then. Nov/ Well, a couple of minor- c. Consider an ordinance amending the Zoning Chapter to change the use regulations of a 1.88 acre tract from RR-1, Rural Residential, to RS-5, Low Density Single-Family Residential for property located at 3263 Rohret Road. (REZ96-0003) (First consideration) Franklin/ First consideration ..... It will result in a subdivision. d. Consider an ordinance amending the Zoning Chapter by changing the use regulations of an approximate .14 acre parcel located at 24 N. Van Buren Street from RM-44, High Density Multi-Family Residential, to R/O, Residential/Office. (REZ95-0016) (Second consideration) Franklin/ Second consideration of the rezoning .... Van Buren Street from RM-44 to RO. Kubby/ They have already started to grade .... Is that allowable to do that kind of major earth moving before the zone has even been? Franklin/ They can but they do it at their own risk then .... e. Consider a resolution approving a preliminary plat for Galway Hills, Parts Three and Four, a 27.77 acre, 78-1ot subdivision located south of Galway Drive, east of Highway 218. (SUB95-0032) Franklin/ Consider a resolution approving a preliminary plat for Galway Hills Parts 3 & 4. This was deferred from your last meeting and.you received a memo from Linda about the meeting which she had with representatives from the neighborhood and representatives of the developer and she has given you a draft resolution. Kubby/ Can we go through the items in there? Franklin/ Yes, definitely. Woito/ And there are members of the neighborhood here and representatives of the developer. Franklin/ This is a buffer between Part i and the new subdivision. runs between these lots .... the lots in... Galway Hills, Basically an open space that Nov/ Is this going to have a trail of some sort? Franklin/ No... an open space that would be conveyed to the owners of Part i or the lots that are abutted on Part 1 and that that would be private open spaceo..maintained by those owners .... They would have to form a homeowners association to take care of that buffer area. Kubby/ Why not all the landowners that abut it, Dot just those in Part 17 ..... Franklin/ Probably because it was at the initiation of the folks in Part 1. Norton/ Woito/ We had talked about making it a part of a broader homeowners association ..... We did talk about if we could get unanimity with everyone redoing the entire homeowners association and getting everybody on board. So this is just one possibility. Franklin/ We might want to hold that thought until we get to the issue of the other open space that has to do with this whole draft resolution. Kubby/ This buffer area, will it connect so this upper area could be used as a safer route for people to walk? .... Woito/ No .... buffering not connection. Franklin/ Well, there is the potential- (Refers to map) .... There is also an easement that runs down here into this open space... connects to the south (refers to map) across .... This right here is an access easement as well as storm sewer and there would be a trail constructed from here down to the end of the subdivision to the proposed Willow Creek Trail (refers to map). There is a potential for connections. With that in mind, let's look at the next section of the resolution which deals with Outlot 2 (refers to map). WS042256 April 22, 1996 Council Work Session Page 13 originally before you... Outlot 2 was to be private open space. What is proposed in this draft resolution as a change is that this be public open space and then a trail would be constructedby the developer through this .... (Refers to map). That is the part that goes up to Kalarney ..... Connection up to Donugal and then the reminder of Outlot 2... trail that would be constructed at developer's expense and comes down and connects with Tipperary and then down to the basin and Willow Creek Trail. P/R Commission and the P/Z Commission concurred when this plat was being reviewed that this would be private open space due to the terrain.°. maintenance .... and to the fact that it will eventually be surrounded by lots .... Neighborhood open space... accessible .... Terry may wish to speak to this. One of the issues has to do with whether this is public or private and the maintenance responsibilities for it. The other has to do with whether it counts towards the six acre obligation for neighborhood open space. The draft resolution and... position of Planning Department... and Parks and Recreation Department also... That this not count towards Neighborhood Open Space. If this is to be public space which we are not recommending .... that is not count towards those six acres. Thornberry/ Why would you recommend that it not be towards the Open Space? Franklin/ Because of the issue of it being surrounded by the lots and its visual accessibility .... But it will appear as if it is in people's backyards ..... It will not have the feel of a neighbor public open space but more as a private little place. Kubby/ It is possible to have it be private open space with a public easement for a trail and public maintenance of just the trail? Franklin/ It would be possible to have that. However the developer will not consent to having it-putting in the trail if the space is private open space. So, it is kind of a tradeoff between that public space or the designation of it as public open space with a trail or it remaining in private open space with no trail. I would point out that in this development, of course, there will be sidewalks on all of the local streets. That is not necessarily the most direct way to get from here to there but there will be ways to get to the trail system using these streets .... (Refers to map) Question of how convenient that trail then makes it to go through the center and how important that is. This trail, no way possible, will be considered handicapped accessible because of the grades that are out there ..... Lehman/ (Refers to map). Schnittjer/ The trail starts somewhere-Mormon Trek... goes over here .... (refers to map). Proposed trail, I have no idea. Franklin/ For Willow Creek Trail. Schnittjer/ It deadends at that street up there. Franklin/ Our bicycle trail system and pedestrian trail system throughout the city is going to be an integration of separate trails with sidewalks ..... on street bicycle trails... Norton/ Deadend into somebody's yard for a picnic. CHANGE TAPE TO REEL 96-52 SIDE 2 Vanderhoef/ There certainly has always been an intent to have a trail that would connect all the way ..... Down to Willow Creek. Franklin/ Using the sidewalks, too, Dee, or a separate trail. Vanderhoef/ Kubby/ Vanderhoef/ You can't talk about the rest of that area ..... because of grades and requests for some flat land ..... trail head and then come on down. But this does not fit my picture of what I think are public trails. Norton/ Where would that one go eventually .... ? Vanderhoef/ In this undeveloped area? That is to be worked out. Vanderhoef/ Open space that would meet the criteria. Norton/ Franklin/ In terms of this revised resolution, the issue of the buffer, is that copasetic? What that is talking about is an open space between the lots. Woito/ Neighbors, do you want to respond to that? Meg Bayless/ I live at 524 Galway and we very much liked the opportunity we had last week to meet with the representatives of Nr. Cabill and Linda and I think the 12 people that came to that meeting were hoping representatives for Mr. Cabill would be empowered .... give us more than what we got. We liked the idea of the buffer zone .... the resolution in front of you really doesn't reflect what we carried away from that meeting. We thought .... that the buffer zone would include trees, vertical landscaping as well as grass. Kubby/ Bayless/ I think Linda is right. Ultimately we were hoping we would get everyone part of a homeowners association to maintain that .... have him put in the trees. Norton/ Apply for a PIN grant. Bayless/ We will do that, too .... For right now we had come.. hoping less dense homes behind this area as a compromise and a buffer zone and that was truly not discussed becauee representatives from Dav-Ed were not empowered to do that. A minimal this might be acceptable to us if it had trees and we did like the idea of a trail... saw the trail going no where. Kubby/ Other people who were at that meeting .... Nov/ Can we hear from Chuck or from Larry? I know the neighbors are asking for something but I want to hear the answer. Chuck Mullen/ Here as counsel to Dave-Ed Limited° I did attend the meeting and I am thankful that Linda also attended the meeting .... WS042296 April 22, 1996 Council Work Session Page 16 the neighbors complaints... understanding my belief is that Dav-Ed came to the council with a plan that met the criteria established in your ordinances... entitled to be approved ...... We did volunteer to make the neighbors a part of the homeowners association for Galway Hills Part 2 ...... membership could be expanded ..... a single homeowners association consisting of all of the owners within the various subdivisions in Galway Hills ..... implementation covenants .... broad enough .... Do have a pond ..... We did volunteer to make them members of that homeowners association, I supplied copies of the covenants, articles and by-laws ..... But we are not willing to be hung up waiting for all of the owners in Part 1 to get together to decide whether or not they want to be members ..... Baker/ .... The plat that was before us two weeks ago, there was no specified buffer area in that plat. This is a concession by you? Mullen/ Yes. And we would propose that it be conveyed to a homeowners association .... broader organization. Kubby/ I wondering if the language... locks it in to just the abutting property owners .....
