Consider a motion setting a public hearing for May 21 on an ordinance amending the Zoning Chapter byrezoning a 1.79 acre tract from CC2, Community Commercial to OSA/CC2, Sensitive Areas Overlay/Community Commercial Zone and approval of a preliminary Sensitive Areas Development Plan for property located at the intersection of Sturgis Corner Drive and Highway 6. (REZ9~-0008) Franklin/ Set a p.h. for May 21 on an ordinance amending the Zoning Chapter for 1.79 acres from CC-2 to OSA/CCS. This is the sensitive areas overlay and it is for a development project at Sturgis Corner .... you will have materials in your packet on May 20th before the 21st hearing. b. Consider an ordinance amending the Zoning Chapter to change the use regulations of a 3.09 acre tract from RS-5, Low Density Single- Family Residential, to OPDH-5, Planned Development Housing Overlay, and approval of a preliminary OPDHplan for property located on the north side of Village Road. We asked for additional information as to why and haven't received any. They still would like to have it expedited. Consider a resolution approving a preliminary and final plat of Broken Arrow Estates, a 1.88 acre, 3-lot, residential subdivision located at 3263 Rohret Road. ($UB96-0004) Franklin/ Item d. would have to be deferred if you don't expedite consideration of c. e. Consider a resolution approving a final plat for Ne%~ort Ridge Subdivision, a 25.3 acre, 9-lot subdivision located on the north side of Newport Road in Johnson County. (SUB96-0009) Franklin/ A resolution approving final plat for Newport Ridge Subdivision. This you have had as a preliminary .... on Newport Road. Nine lot subdivision. It is in compliance and recommended for approval. P/Z recommended on a 6-0 vote that this be approved. f. Consider a letter of recommendation to the Johnson County Board of Supervisors regarding an application requesting zoning of 20.3 acres from County RMH, Manufactured Housing, to County M1, Light Industrial, for property located on the west side of Riverside Drive south of Colonial Bowling Lanes. Franklin/ A letter of recommendation to the Board of Supervisors regarding Bob Wolf's application to rezone 20 acres east of the mobile home park but south of the airport from RMH to M-1. The staff recommendation and recommendation from P/Z Commission is for denial ..... feel fairly strongly about this and have written a rather lengthy letter to the Board of Supervisors for the mayor's signature. It is particularly important that we consider this zoning carefully because it is in our growth area ..... We just don't feel that it is appropriate to have industrial zoning now that the residential use has been established .... Kubby/ ..... (Can't hear). I am not sure I would advocate a commercial intensive zone either at the entry to a mobile home park because you can have contractor's yards, body shops... fairly intensive use as well as small scale manufacturing. I think that the mini- warehouses, the car wash, existing contractor's yard as non- conforming, a larger sign may be appropriate .... I don't know that I would advocate more intensive kinds of commercial uses there. For some time that will be the only entrance to that mobile home park. Norton/ Franklin/ Ron and the Airport Commission were never crazy about the idea of having a mobile home park there .... What he would be most concerned about would be any kind of uses in which there would be storage of fuels .... less intensive in terms of people living there ..... There are some warehousing and manufacturing uses that would be appropriate in conjunction with the airport. Two things... one is the entrance to this residential area and then it is also the proximity to the airport .... compatibility... mini-warehouse sorts of things .... not be people intensive .... Norton/... he would rather see fewer people .... Franklin/ That is correct .... Baker/ When does the Board look at this? Franklin/ I don't know. I will find that out for you tomorrow. Norton/ Will we have something to do about imposing standards ..... when the plats come in. Franklin/ If a plat comes in, yes ..... such close proximity to Iowa City ..... Nov/ Do you know if this is going to be a construction storage zone forever after? .... Franklin/ My impression is that it is forever after. He wants to move his business there. Kubby/ Have you heard anything about a temporary concrete mixing operation there? ...... Kubby/ No one can confirm that rumor. Franklin/ It would be a conditional use permit which we should see but we don't always get them. The county should send it through us. Kubby/ You might want to mention that to them. Lehman/ Most ready mix plants are high enough that there is no way in the world that he could put one in. And there is a ready mix plant a mile up the road. Kubby/ How do people feel about Naomi going to the meeting to reinforce some- Nov/ I don't mind going but Karen and I went we said don't make this residential ...... Norton/ Yeah, but elections are coming now. Lehman/ It would be significant if Wolf were planning to use that on a temporary basis. Kubby/ Once it is zoned he has a right in the zoning .... Lehman/ I talked to Karin earlier today and as far as I am concerned a planned commercial I think it great and having a couple of non-conforming uses ..... Nov/ If he could have a temporary permit to use that area for construction .... Franklin/ If that is all it is for, I am not sure he would even need to have any kind of permit. If it just a matter of equipment that is essential for the construction, you don't have to get a permit to put that on the property on which you are building on .... Kubby/ I think he is highly motivated not to come to the city .... doesn't like to deal with us because we have not been supportive of anything he has tried to do ..... I had two other P/Z things. One is you wanted to confirm if we wanted to talk about the fringe area and respond to the Board's...for the 20th. Franklin/ On the 20th. Kubby/ .... P/Z Commission minutes of April 18 it mentioned a memo dated Ma~ch 25 which was a while ago about a joint statement from HCDC and P/Z on affordable housing policy. We haven't seen that yet. Franklin/ I thought it went into this week's packet. It was just approved by P/Z last week. No, okay. Then you will have it shortly in one of you special packets. The P/Z Commission just voted on it I think last Thursday to approve the statement ..... requesting council direction on housing policy for affordable housing. Kubby/ Do we have a time schedule to talk about housing? Franklin/ You do not but it is on the pending list. Whenever you want just let us know. Vanderhoef/ The letter that you had proposed to the supervisors... last sentence... You are saying that it would be prefarable to the proposed M1 zoning. I wonder if we could have the council say that it would be acceptable zoning at this point ..... Franklin/ I think we don't know exactly what would you say would be acceptable. Vanderhoef/ Would be acceptable zoning, period and leave out the preferable to the proposed M1 zoning. Franklin/ I think we want to know... what was going to be in that planned commercial before I said that. Planned commercial it not defined. Franklin/ Yeah, it would and I think I would feel more comfortable making that strong of a statement at that point when we knew what that was about ...... This is to- It is kind of a next step. I needed to get some kind of feedback from the council .... some confirmation from the council .... list of potential uses for 64-1A and what David and I tried to do was to put that into a form that we can begin to draft a RFP. The step would be for us to get the marketing consultant on board and then use that person to evaluate the total RFP ..... development conditions being the most important part because that is where it sets out what it is you want for this project. Have them look at it to see if this is so bizarre that there is really no chance of selling it .... we will get that feedback later. What I wanted to get from you tonight was a notion of whether this was going in the right direction given our last discussion. Just let me point out a few things .... Startling .... that is the statement that the ratio of private to public use should be 3:1 ..... To get 75,000 square feet which would be cultural centers .... children museum .... library extension .... If we were to require that 75,000 feet be in public space in that project, we would need a project that was 225,000 square feet total for this 3:1 ratio. That would be a six story building on most of this site .... If we are looking at a smaller project... size of CenterSpace then that means some choices will have to be made about the use of the public space if we stay with 3:1 .... Baker/ Why couldn't you phrase that the ratio of private to public space should be a minimum of 3:1...? Franklin/ ..... make it a little bit more .... flexible ...... Lehman/ .... We have to throw something out just to get a reaction. Baker/ I would just like to see that reworded some how so it is not as restrictive. Fra~(lin/ .... How specific you want to be..o how firm you want to be .... versus how flexible you want to be. Norton/ I think we have to think about this very carefully .... For example... what about a whole library? Franklin/ That is going to be a different kind of project. Norton/ Let me run do~n a couple of figures. Let's suppose we talk about a six story building .... library space .... communication center, children's museum... You can still get the hotel. You can get some retail in both places .... Franklin/ I think what we can do is start along a couple of concurrent paths. The Library Board has already put considerable work and effort into their expansion plans. They will be coming back to the council .... I think we can start along this path .... get the marketing consultant to come in and look at that and bring up that possibility .... Before we go out with it we are going to need to knowwhat the intention is of city council as far as that is concerned. Norton/ .... I didn't know at what point ..... Library ..... land costs .... trying to figure a way to accomplish both purposes .... I think we need to think pretty largely about that-the combination of spaces there. Kubby/ I asked about a couple of library board members about doing something in conjunction with 64-1A and one of the things that three different people that I talked to said when we looked at the possibility earlier we were always told it is not going to work°.. they decided to just move on ..... It does create some frustration .... Norton/ Trying to get a better library out of this .... What they are talking about is totally rebuilding that library .... It is a matter of timing ..... Lehman/ Dee, I suspect if we put this proposal out we are going to get variations of what we would like .... ! think you have to throw something out so you can qet a reaction to it. Norton/ .... Ask the large enough question to start with. Therefore I am asking is it an option to say hey, incidently, you might think about the whole library over there and have the library space for some of the CenterSpace functions. Does that expand this beyond reason? Franklin/ I think so .... You are talking about significant square footage that leaves very little .... Norton/ Combined spaces with judicious decisions about which components of CenterSpace might most appropriately remain in the library sp~ce .... I don't know when to do it. Baker/ It is appropriate for us to be firmer in our desire for the square footage of the public space without the specific uses? Franklin/ I think at this point, yes ..... realm of practicality .... I think if you go much beyond a third .... it may be just too much to expect a private developer to take on depending upon how much you are willing to put into it. Baker/ Franklin/ One point about CenterSpace and the existing library, Dee, one of the primary facilities of the cultural components of CenterSpace was performance space. The renovation that would be necessary to that existing building would be significant. It is not an easy transition to go from that existing library to those cultural facilities that are envisioned in CenterSpaceo Norton/ Some parts of it will .... Franklin/ Perforl~ance space would not .... Norton/ Franklin/ I think you are going to have to make the decision about the library before .... This doesn't have to go out~ You are going to be under a certain deadline to make a decision about the library ..... In terms of timing, we can adjust all of the timing on 64-1a proposal to work around the library and the library ...they are going. They are going to be back to you before August .... I think that will then settle out what happens to this. Kubby/ ..... We are pretty clear... what we want. Franklin/ That is a question that I have for you .... as to how firm you want to be with that. We want to give them as much direction as possible and also giwe them as much room for creativity as possible .... If there are ones that you know are a must, then let's say that. Nov/ I think desirable is a good word .... trade off these kinds of things. Franklin/ Is preferred a stronger word than desirable? Baker/ Yes but I prefer desirable but not required. Council/ (All talking). Baker/ Maybe we can come to some conclusion as a council as to what is preferred. I don't think we have done that yet. Lehman/ We know what we think we would like to have .... I think until we put this out and get something back ..... the public has to buy this .... Nov/ These things here may not be feasible even though they are listed here as desirable. Franklin/ Is there anything on the list of either the private of the public spaces that you want to delete? Kubby/ I am concerned about, on retail, saying such as a nationally recognized store. I am not so sure. I may want something more unique .... Franklin/ How about just emphasizing the destination point and leaving that part out? Baker/ I don't have any problems with nationally recognized. Lehman/ ...I don't care, one way or the other. Franklin/ It's gone, okay° Nov/ ... I don't see any point in being very specific. Franklin/ But as much direction as you can give us so we can give it to the consultant, the better .... Nov/ Venderheel/ This is where I have been thinking in terms of connecting library and this building ...... There are lots of things you don't need windows for .... cheaper way to get square footage... library .... conference space or both. Nov/ Building under the plaza .... reinforce library .... Nov/ ...connection to Holiday Inn down below .... Franklin/ At the last work session when we talked about this there was some discussion of underground parking or parking on site. Nov/ I would be happy to eliminate the parking and get a good conference center underground. Kubby/ Question of feasibility. Franklin/ Maybe just a statement that subterranean development is an option. Kubby/ Then it could be either parking and or public space or private space. Norton/ Franklin/ Under zoning you can have residential... one of the uses permitted under zoning. So that is still an option. Franklin/ Anything else on potential uses. This will be coming back to you. Kubby/ It is really important to talk about those financing incentives. Franklin/ I wanted to get to that .... Baker/ Under additional considerations... Are we going to get a new appraisal? Kubby/ Yes, we are having one done right now. Schoon/ Third week in May. Franklin/ That $10,000 may change. Ready for the financing. One of the issues here is in terms of providing financial incentives, whether those financial incentives are in return for construction of the space and favorable lease rates or just for construction of the space .... The more public space that you have in here, the more you are going to have to give in terms of the public part of this to finance it. My thought was with the 3:1 that it would be for construction as well as for favorable lease rates ..... 30,000 square feet and $15 square foot... if the city were to pay that rent for a year, we would be subsidizing the cultural components at $455,000 a year. Baker/ Why couldn't we... finance by the space as part of construction .... figure out someway for a substantial up front contribution to the cost if we get our public space in addition to the land cost. Lehman/ You really need a proposal to start talking ~bo~t Baker/ .... $18 million CenterSpace, $15-20 million library ..... Franklin/ Okay... last paragraph there... any proposed financial package we will look at and evaluate it .... Those who do this kind of thing may have a better way to do it than what we envision. Atkins/ Kubby/ ...Whatever comes out of Economic Development Committee's task force in term of parameters under which public assistance will be given for businesses. Baker/ ... us buying space for public use .... Arkins/ What is offered here is pretty standard fare .... land value write down .... Under these three we haven't really no cash involved right now .... Now if you are saying cash .... Baker/ It might be unreasonable to expect the private development that we want to also provide the public development that we want with just these financing incentives. Franklin/ It may be and that is something the marketing consultant will tell us .... To borrow money means to incur debt ..... general purpose debt requires approval. Klingaman/ Tomorrow night you are going to be asked to authorize a resolution that approves the expenditure of $25,000 in Program for Improving Neighborhoods (PIN) .... go through all of the applications .... All the representatives from the neighborhoods who have worked so hard on these applications are here this evening .... Brief background. The PIN Grants are now in their second year .... established to enable neighborhood associations to work towards some of those projects ...... to provide a focus for a lot of them in terms of the improvements they would like to see in our neighborhoods ...~ Neighborhood Council... developed the application, ranking criteria, method... are the review body .... Last year there were eight grants .... Most of the projects last year were for physical improvements .... You are going to be hearing from the neighborhoods .... In terms of 1997, this program year- CHANGE TAPE TO REEL 96-56 SIDE 2 Klingaman/ -$5,000 ..... The criteria that they used last year is very similar to what they used this year .... Required criteria... had to solJolt input from the entire neighborhood as to what the funding would be used for... surveys... neighborhood meetings .... The neighborhood need for the project was well documented ..... Neighborhood participation in the project is evident ..... The plan for the project is feasible. Can it happen? .... resources... And the project can be completed within the funding ..... Clean cut and doable. I thought what I would do very quickly is just run through all of the applications... questions that you have... process... ask me .... The Pepperwood Neighborhood Association submitted two applications, the first one was for a welcoming sign .... construct and install a welcoming sign at the entrance of Pepperwood Neighborhood .... Keokuk and Sandusky area ..... they have received approval from Southgate to install a sign there .... also includes landscaping and concrete block retaining wall. Baker/ You say this cost included more than just the sign .... was there an effort made... Why was that particular contractor chosen for the sign as opposed to ..... David Dawes/ Coordinator of the Pepperwood Neighborhood Association. Basically we looked at a number of sign makers... Those are all projects that have cooperative effort with PTO and school... working together on this .... They received a pretty substantial contribution from the PTO to assist on all of these projects .... Nasby/ You can .... can give theme the $200.000 instead of loaning it to them .... if you want the lowest possible rent, then you structure your deal differently .... The state may, in fact, if they continue to have these issues in terms of the unit cost of the developer fees either not grant as much money to the project or not grant any money to it... Beyond that it becomes a matter of choice, that you decide because there really isn't any strict regulations that say whether this is a good or bad idea. I can tell you from history... traffic right in front of school where we get this type of requests. The one at Regina, the Manual of Traffic Control Devices doesn't apply .... Jim points out on the Regina request that if you were to choose to do the all phase pedestrian and no right turn on red, it should be installed at the same time or it kind of defeats the purpose. I would suspect that you would find support in the all phase but the no right turn... is probably going to be found objectionable and just going to encourage people to run it. Norton/ Atkins/ If you are going to have an all phase pedestrian, you are going to have to have no right turn- Kubby/ .... like Linn and Washington .... We changed it to no turn on red. Do the same thing on that corner... Nov/ ..the real problem is the green because the pedestrian has a green and the car has a green turning right at the same point. The signalization and no right turns and so fourth, it appears there is only about four car lengths that you can stack between the light as you are headed on Rochester before you get to the Rochester turn in which is off set from the turn in that goes into the Quik trip and gas station and all of this kind of thing and there are people who are constantly whipping through off of First Avenue and cut through there and come out. The Langenberg property is in a state of transition. There are people looking at it to buy it and it is possible that we can .... get a road put in that is at city standards as opposed to building a park road, having that then ripped out subsequently within a year or two and having a city road constructed. This all hinges also upon the Langenberg Tract is ...... in the process for annexation. It is before the P/Z Commission at their next meeting. The Langenberg family is requesting that it be annexed and rezoned to ID-RS. No development plans for it right now. However, if it changes hands, then we will be looking at another zoning consideration on the property .... We have to .... with this fall or next spring provide for access to those soccer fields and we think we can save some money if we work through the development process to get a city road in there rather than putting in a park road or rock road .... With putting it in at city standards with the developer, it is dedicated through the development process. So, there are some things that we should work out .... Before we can work out any of those things we have to get an okay from the county to defer our obligation in terms of access for the soccer fields. So that is kind of a first step involved. Kubby/ How we can talk about a developer doing a city standard street when it is going to be zoned ID-RS? Franklin/ It was be zoned ID-RS now with its imminent annexation. Within the next 12 months if this land transaction in fact does take place, then a rezoning, a plat could come through. Nov/ So if someone came and asked for RS-5 or some other residential specific zone, we could then ask for the road? Franklin/ Well, we could at the time it was platted .... But the developers have approached us with this proposal. That they would agree to put in the infrastructure. We did have plat .... I figured out it would take 38 1/2 rides to break even at $.54 if they are going to spend $25 month ..... If you are going to ride for 20 days you save a dollar .... We may sell fewer passes .... Dale, if you get around to evaluating that kind of thing, try and keep some records and seewhat happens ..... $6.50 for ten tickets.
