Lehman/Folks, we have officially started.
Franklin/Members of the Public Art Advisory Committee are here tonight. The chair is
Kevin Hanick and Nancy Purington, Deborah Galbraith, and Terry Trueblood,
Rick Fosse, and Lesley Wright and our representative from the Design Review
Committee are not here to night. Rick, I know, is not going to be here ....The issue
tonight is the authority of the Public Art Advisory Committee ....
(Design Review Committee seated at council work session table).
Franklin/The issue before you tonight is the authority of the Public Art Advisory
Committee and this has come up as the Rules Committee reviewed the by-laws of
the Public Art Advisory Committee. I have brought to you a recent version of the
by-laws and the pertinent page to look at is on page 4 .... Issue on page 4...
proposal .... The question has to do with who makes the final decision on the
selection or the commissioning of public art. As the by-laws came to the city
council... to be made by the Public Art Advisory Committee. There was one
piece of the by-laws that definitely needs to be changed that has to do with
fiduciary responsibility of the committee which they do not have because they are
appointed by the city council. Only the city council or the city manager as the
council's designee can make fiduciary decisions, that is to spend public money ....
City council authorizes the $100,000 each fiscal year .... One way to handle that is
to make that $100,000 allocation and then give it to the city manager the
responsibility of actually expending that money, that is authorizing the writing of
the check .... That whole issue aside... Larger issue has to do with who is going to
be making the decisions about the commissioning and acquisition of public art...
and disposal of public art .... I have inquired of a number of cities that have
programs. Most of the programs, the commission or advisory council
recommends to a board of supervisors or city council or mayor and that entity is
the one that finally approves. So they are subject to the approval of that political

entity. The original thinking in this was there was a concern about censorship and
putting the decision about art into the political realm which is the council ....
Decision for you tonight... is who that final authority should be with.
Lehman/...if you look at other boards and commissions, very very seldom does council
goes against the recommendations of boards and commissions .... I think we take
the work of boards and commissions very very seriously. I think it important the
council do have final say in the placement or selection of art .... The council will
have to answer to the public .... get the credit or the heat .... I don't think we should
be involved in selecting those sorts of things .... The buck stops with the council...
This commission needs to be of an advisory capacity ....
Thornberry/ .... had the board brought to us the design of the walkway over Dubuque
Street without .... as a for instance .... council would have said ..... He also said that
very seldom do we override other boards and commissions. But when the library
came to us with a fix it for the roof of the library .... we said no.
Lehman/That wasn't a board or commission, that was an engineering recommendation.
Thornberry/But they wanted to do that in a worst way .... I think you are right... As
elected officials, we have to have some say ....
Norton/We have taken exceptions a number of times to recommendations ....
Kevin Hanick/Just two or three points .... I realize and acknowledge... you are the ones
that are giving us a try in the first place .... I think it is long overdue... I think it is
very important that this committee take their work very seriously and retain as
much autonomy as possible .... Library Board... comparable... because of
censorship... Ant can be controversial... We will bring proposals for final approval
by the council .... If the council is not happy with the proposal, what we would like
to do .... is least amount of tinkering with the proposal .... If you want to say no,
you obviously have to be able to do that ..... We would certainly entertain your
input. But then we would expect that to go back to our committee to deal with as a
public concern .... We would prefer complete autonomy ....

Deborah Galbraith/At our last meeting .... adopted our objectives .... involve the public ....
through various activities .... there will be a lot of public involvement ....
Hanick/ .... we are in the process of developing the steps that we are going to take for each
project ....it will be well worked over ....Need some integrity in the whole
process ....need to retain the power of approval.
Lehman/ .... committee .... very proud of.... envision .... rules .... If the final approval rests
with council two things happen .... council historically sensitive to work done ....
sensitive to recommendations they make .... Council really want no part in
selection .... We need the ability to say no ....
Norton/
Kubby/ .... nervous .... made it seem like the people on the committee need to cater to
people on the council ....Controversial social issue ....I don't want people on the
committee to shy away ....
O'Donnell/Dealing with a very small percentage of the community ....
Norton/
Nancy Purington/We are going to most likely select individual groups... particular to
each project... handful of people .... I don't think our committee should have the
total say because we are your public servants ....It has got to be a reflection ....I
like to work with you.
Vanderhoef/I appreciated in the minutes... like to recognize that you folks have been
chosen... public input important... not the end say ....

Hanick/There will be an element in the community who will be opposed to just about
anything we do ....art... essential to a total community ....confident ....allocated
this kind of expenditure... We have in fact picked out our first project ....We need
to now evolve a process ....make it as representative as possible ....Go through a
step by step procedure ....
Norton/...get a lot of input... ground rules ....

Hanick/Even in this town... three major buildings .... amazing to me the range of
reactions... people have very strong opinions about that ....into a no-win ....We
think for that first project... get very strong support ....

Norton/...isn't this one of the few in which staff persons are literally members of the
committee .... actual members.
Atkins/It is unusual for us ....
Norton/So integral to many other aspects .... everybody is equal ....
Hanick/Insight that staff provides is important to us ....
Vanderhoef/ ....Rules Committee... made our staff people ex officio ....
Norton/...ex officio means you are a member only because of your position but you vote
just like everybody else .....

Lehman/The only real issue .... As far as rules and by-laws and whatever, the committee
should choose their own and do their own thing .... Understanding... They will
make recommendations to council ..... It appears that we have agreement.
Vanderhoef/When I toured Philadelphia .... their concern is ongoing there... they got
money to purchase art and place art and they did not get money for maintenance
of.... As I was looking through the powers and the duties, what wasn't real clear...
our budget for art would be including the maintenance of our art pieces.
Franklin/That is not something you will find in the by-laws. One of the issues that this
groups must address is to develop policies and procedures for the maintenance
and disposition of public art .... This will be something that will come back to the
city council .... Decision will have to made as to how these pieces are going to be
maintained and where the funding for that is going to come from .... It is definitely
an issue.
Vanderhoef/The budget line that we put out for public art... What does that include?

Franklin/That is something that will come back to you with a proposal from the
committee as to how that will be dealt with .....
Norton/
Franklin/Ultimately the council has to make that decision .... $100,000 for a public art
program... whatever that means .... maintenance is a critical part of any public art
program ....
Galbraith~ ....When an artists gets a proposal...tells us what is required to maintain it ....
Purington/May be a factor ....
Thomberry/If you are given a piece of art and you decide to accept it .... no monetary
expenditures... Do you still come back to council before that action is taken?
Lehman/Probably.

Franklin/If there is art... public can see it... on private property... no involvement of the
committee, then it won't.

Review Zoning Matters 98-57 S2
a. Consider a motion setting a public hearing for May 12 on an ordinance amending Title
14, Chapter 6, Zoning, Article T, Nonconforming Uses, Structures and Land, Section 5,
Regulation of Nonconforming Lots, by changing the regulation of nonconforming lots of
record.
Franklin/Consider a motion setting p.h .... regarding nonconforming lots of record .... This
will allow additional in-fill development.
b. Consider a motion setting a public hearing for May 12 on an ordinance changing the
zoning designation of approximately 5.4 acres from Community Commercial (CC-2, 2.4
acres) and General Industrial (I-1, 3.0 acres) to Public (P) for property owned by
Kirkwood Community College at 1806, 1810, 1814, and 1816 Lower Muscatine Road.

Franklin/Also setting a p.h...rezoning of property to P, public ....Kirkwood Community
College.
Kubby/I have a question about the non-confomfing lots. We are kind of planning on
reducing the lot width .... in Subdivision Code anyway. So why is this necessary?
Franklin/Well, this deals with a very particular situation where there are two non-
conforming lots that are brought together by ownership .... timing ....
c. Conditionally changing the zoning designation on a 1 O-acre tract located on the south
side of Melrose Avenue and west of West High School from Low Density Single-Family
(RS-5) to Planned Development Housing (OPDH-8) to permit an 80 dwelling unit
retirement community. (REZ98-0002)

Franklin/The Melrose Retirement Village Community... continued the p.h. for the CZA
which there will not be one. I was misinformed. Instead of doing a CZA with this
one, we are going to go through the process of a p.h. and first and second

resolved .... The applicant is aware of this ....

Franklin/Yes ....You have seen an elevation of a view from the new ..... Dublin ....from
Melrose Avenue... and from the south.
Norton/Curious on what it is like on the other side.
Franklin/Very similar to the view from Dublin .... shape of the building is the same ....

d. Consider an ordinance conditionally changing the zoning designation on a 4.46-acre
tract located at 500 Foster Road from Interim Development Single-Family Residential
(IDRS) to Sensitive Areas Overlay-8 (OSA-8) to permit 32 dwelling units and approving
a preliminary Sensitive Areas Development Plan. (REZ97-0011) (Second consideration)

e. Consider an ordinance conditionally changing the zoning designation on approximately
41 acres located between Lower West Branch Road and Court Street extended,

Franklin/Rezoning in the county. This is for ten acres in Fringe Area B which is to the
east of our corporate limits. And the recommendation from P/Z Commission and
staff is to go forward with this rezoning to RS-10 ....
Kubby/And the can't re-subdivide?
Franklin/That is correct.
Norton/
Franklin/It cannot be further subdivided .... without a subdivision or you would have to
do another rezoning .... This is a farmstead split for a child in the family. It is the
same thing for the next item ....Once it is split into three pieces, then we will
review the subdivision ....

1. (Agenda #16- Howard R. Green Company- Construction survey and engineering-
Water Facility Site Development Phase I)
Atkins/Chuck is here.
Lehman/Chuck .... this is a biggie.
Atkins/
Schmadeke/If you will recall, in 1994 we purchased the water plant site. A year prior to
that we entered into an agreement with Howard R. Green for design .... between
1993 and 1994 we solidified the water sources on the plant site .... changed the
design... pump station at the sand pit .... 1995 we purchased the peninsula site...
decided we could construct some collector wells on that site .... changed the
design .... able to build the walkway across the top of the dam and have access to
that facility from the peninsula site ....added the walkway on top of the Iowa River
Power Dam.
Leturiah/Didn't we let a contract for that for $1 million or whatever?
Schmadeke/No, not yet.

Lehman/What did we authorize for the dam then?
Schmadeke/The purchase.

Lehman/We talked about design work for that dam renovation. We knew at that time we
were going to put a walkway across. But we didn't include that in the design work

Kubby/This is just authorizing payment for that extra work that has already been done.
Norton/The pictures of the walkway are in there. It has been done .....
Lehman/Okay.
Schmadeke/In January or February of '96 we ran into the archeological site down at
Napoleon Park .... inquired about needs for the Water Plant site... proceed with
archeological investigation of those sites .... There are two sites on the peninsula.

Lehman/In item #16 there is another item for $146,000 for designing Phase I of the
Water Facility Site Development.
Schmadeke/That is services during construction.
Lehman/
Schmadeke/This is the contract you let for the site work on the Water Plant site.

Schmadeke/It is an addition in the sense that we are hiring Howard R. Green to provide
us services during construction ....
Kubby/What is our inspector?
Schmadeke/They do the inspection. Howard R. Green... office services .... engineering
services .... They will stand behind their design work. In addition they are going to
do all of the staking of the pavement, location of the water mains, transformer
pads .... they will do the surveying for that work.
Lehman/I would have thought this would have been in the original.
Schmadeke/In '93 we didn't know what the total design was going to be ....
Kubby/So it is not an unusual process.

2. (Agenda #19- Howard R. Green-Consulting Services for improvements to the Iowa
City Water Supply and Treatment Facilities).
Norton/Item #19, I couldn't understand. The work with GSR .... I though all along we
were going to upgrade all of those GSRs. What was the original plan?
Schmadeke/The original plan was just to upgrade Emerald ..... Rochester Tank... added
it... Sycamore ....
Norton/And switch to high pressure water?
Schmadeke/Those projects are more maintenance than they are tied to the new facility.
Vanderhoef/ ....this is continuing maintenance work that we need to do?
Schmadeke/This is payment for design work they did for that project.

Kubby/Everything came to us in piece mill in changes... this is payment for all of these
changes.
Norton/...handle on water projects .... tough... changes and shifts... new problems...
Trying to see where .... We must have added some wells.
Schmadeke/We shifted from Silurian aquifers to these collector wells.

Norton/Item #18 .... has to do with the Willow Creek .... looks to me like the city is
watching Stanley who is watching MMS .... four layers... who is watching Kinko.
Schmadeke/The city is watching everything.
Norton/There is an awful lot of supervision layers.
Schmadeke/#17 & 18 are similar to the contract ....
Lehman/#17 & 18, when we let the contract for that project .... that contract does not
include these services .... Willow Creek Sewer ....
Schmadeke/We feel we have more control over the project ....
Norton/Did you use this same process on the connection between the two plants?
Schmadeke/Yes.

Thornberry/We got inspectors out there watching three different companies do their
thing. One is doing the engineering, one is doing the actual physical work. What
is the other company doing?

Norton/There are so many things going on that you just don't have the horses ....
Schmadeke/We wouldn't have the personnel ....

4. (Agenda #28 a(1)-Historic Preservation Commission: One vacancy representing
the Brown Street District to fill an unexpired term ending March 29, 1999. (John Shaw
resigned.) (3 males and 6 females currently serve on this Commission.) (John Shaw
resignation letter distributed 04-10-98 as IP#8.)
Champion/I am really disturbed about the resignation of John Shaw .... I don't understand
the legal stuff here ....Was it just the terminology of what we call the people on
the commission?
Dilkes/I had a conversation with John Shaw when he was looking at submitting a
proposal for the parking ramp. It is clear under the state law .... I would be happy
to have you read the statute... I talked to John Shaw.. clear that he did not fall
within any of the exceptions of that prohibition on an officer of the city... that
includes board and commission members carmot have an interest in the contract
with the city. He is an owner of that architectural firm ....
Champion/So it isn't just the terminology then?
Dilkes/Not at all .... It is a state law... Staff met to talk about it .... I didn't get a whole lot
of argument from them ....
Kubby/Does it include those contracts that are competitive bidding situations?
Dilkes/Competitive bidding is one of the exceptions ....
Kubby/
Dilkes/ .... There are a number of major exceptions to this prohibition and one is exactly
that, competitive bidding .... Another one is employee ....

Norton/ .... headline... just a fact of life .... membership of all of the committees ....
exceptions... It does not raise havoc with our membership .... I don't think it is as
pervasive a problem as we might have thought.
Champion/
Dilkes/I had a conversation with an assistant city attorney who handled this matter when
it came up in Des Moines... He told me that when this came to a head in Des
Moines that they had a number of architect and attorneys... who had to resign
from their boards and commissions .... I feel certain that we are not off base here.

Champion/It is too bad.

Lehman/It is good public policy ....
Norton/...in the packet... now in the information that goes to applicants ....issue that they
need to be made aware of.
5. (Agenda #5g(8)(a)- SIGNALIZATION OF INTERSECTION OF MELROSE
AVENUE AND MELROSE COURT
Kubby/The stoplight, the conventional traffic signal at Melrose Court and Melrose
Avenue. I just want to make sure that the neighborhood ....
Lehman/They have met.
Kubby/That that was acceptable.
Davidson/It was unanimously endorsed by the neighborhood association.
Lehman/They were very glad to be consulted.
Davidson/It was a real good meeting.

6. (Agenda #8- PUBLIC HEARING ON THE FY99 ANNUAL ACTION PLAN,
INCLUDING THE FY99 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG)
AND HOME INVESTMENT PARTNERSHIP PROGRAM (HOME) BUDGET, FOR
IOWA CITY, IOWA.)
Kubby/A question about when it is appropriate to bring up issues about the CDBG and
HOME Funds .... I know the plan is on our agenda .... discussion .... letter in our
packet from Charlie Eastham .... When will we talk about it?
Franklin/You need to be able to feel comfortable voting on it on the 12th. We need to get
it into the state by the 16th, I think ....That is your next meeting. Tomorrow night
is the p.h.
Vanderhoef/Can we talk about it tonight?
Kubby/...important to say something ....
Norton/I talked to Maurice today ....
Thornberry/I have stuff to talk about it, too ....

Kubby/It should be sooner than later .....
Thornberry/The Institute for Social and Economic Development is not funded at all and I
would like them funded.

institution ....pledged $5,000 towards the project ....
Norton/I was convinced by rational in the packet .... good reason ....
Thornberry/...If you read their literature... putting people to work and they are giving

Kubby/Is this the right pot of money?... administrative costs were higher, their points
were lower than other folks doing the same kind of work .... I need to make sure I
can justify based on the committee's recommendation ....
Thornberry/Their location is where it needs to be... walk in traffic .... two of them... They
are doing all they can .... wing and a prayer .... a lot more effective with some
funding .... They are continuing to look for some ....
Norton/The committee is surely fully aware of the kind of issues you are raising about
what they have done in the past .... They had to make some tough choices ....
Thornberry/...takes two years to get off the ground.
Vanderhoef/...they had an expectation there would be follow-up .... They were turning
down requests this year... in a quandary of trying to figure out where they were
with feedback ....
Kubby/Follow-up... important ....
Vanderhoef/And where our dollars are going ....
Norton/Can we do this discussion tonight without Maurice?... one side of the story...
Lehman/We got Maurice's memo which I thought detailed why they didn't fund it .... I
think the same argument can be made for everybody that we didn't fund.
Franklin/I was just going to make the suggestion that if you enumerate those projects that
you have different views on, then I will let Maurice know... Gretchen will be there
tomorrow night... Or if you have suggestions ....
Vanderhoef/I was concerned totally in the number of dollars that were put into economic
development... small amount, few requests...
Kubby/What level would you be interested in funding ISED at? ....

Gilbert Street Corridor Study 98-58 S1
Lehman/Talk about Gilbert Street.
Davidson/In January we discussed with you the situation occurring on South Gilbert
Street .... Our greatest concern being the existing situation with traffic safety in
that corridor and then also our prognosis for the future based on such things as the
co~mection of the sewage treatment plant... additional development .... just the
overall growth in Iowa City .... traffic increases in that corridor .... both existing
and future concerns .... Did need to take an in-depth look at this corridor. We did
some preliminary survey work .... received a pretty loud and clear consensus from
the folks down there... something does need to be done... willingness on their part
of participate with the city in the development of some alternatives .... large scale
improvements .... process that we are beginning right now is doing some concept
planning on what the alternatives... are. We are very excited to have a very strong
team from Stanley Consultants to assist us with this process .... They have
assembled a very good planning team to work with us. We have two individuals
tonight from that team: Tom Stout... principle transportation engineer... Also John
Sayles... principal planner from Stanley .... express any concerns at this point ....
We do have our first public meeting scheduled for the 7th of May at the Senior
Center .... have some input and discussion with them ....

things that have to be considered. Another possibility... widening ....widen and put
a median in to almost eliminate left tums except at intersections ....put in a fifth
lane... two way left turn lane .... We would like to get a feel if there is something
else we should look at... Key issues .... they want access... they want people going
by their property. They aren't going to want to give up any parking .... We are
going to look at the no-build, what would happen if we don't do anything ....

time .... what the stabilization project was .... What it did was clean up the site, the
house is solid now, the roof is solid. If we decide that we wish to do something
with this structure .... then we have got a building here that can be used ....

Committee... as possibly a trail head ....The estimated cost for this was $73,310. It
came at $50,904 ....

Dunbar/We have gone through a process... looked at the land .... slopes... vegetation..
demand levels .... came up with several options... Three options... selected this
basic option... Take it up to a larger scale... This is still a preliminary plan... based
on air photo topography. We haven't located any of the trees .... The green... here
is .... This is the Rose Hill area (refers to map)... path that now comes off the
existing cemetery .... Graceland area... grassy slope that goes down hill from that
area .... We had criteria in terms of slope of the land .... Come out with a circle ....
long cul de sac through here... green lots... monument lots... white lines are four
foot walk spaces every two lots .... Non-monument lots... mint green... they have a
three foot alley... yellow lots are infant lots ....Other options... cremations lots ....
mausoleums .... they are here ....mausoleums ....cremains...take advantage of the
slope .... handsome... dignified...ridge lines so there are views out every
direction .... secluded area... non-monument lots .... steps down this way... ramps
down this way... everybody could have access... no steps at all on this side .... We
have family lots up here .... that use to be a very common style... family to buy 5-
10 lots... families don't buy a lot of lots together .... one single lot is probably the
most popular purchase right now .... still to make allowances for that to happen ....
Taking this area... grassy slope and rolling it into this whole plan... preliminary
grading plan .... to get some sense to make sure we can do all of this. The thing we
haven't done is locate trees... want to save as many trees as possible so you don't
ruin the environment that you are trying to create .... clearly some of them will
have to go .... overall numbers might drop a little bit... We have 6690 monument
lots, 1710 non-monument lots, ten families that give you 50 lots, 138 infant lots,

You can see Phase 1 the mausoleum is $312,000 because they are a structure ....

That is the issue of the heirs of Christian Gaulocher would like to see the 40 acres
plus or minus held in reserve for cemetery use but they certainly have no problem
with it being used as parkland until such time that it is needed. Basically it is a
question if you dedicate it as parkland or you just designate it for park use.
Vanderhoef/I would like to ask Tom... looking at whole area... What do you see as the
possibility of ever using much more of this land for cemetery?
Dunbar/Physically... look at 40 acres... has pretty severe limiting edges all the way
around. Unless you went to a lot more mausoleums .... using the slope .... you
would just have to absolutely move everything .... trees ....

Fowler/We have developed two plans so far for a facility at the transit interchange ....
started off in the middle of the interchange .... design... Then we were directed to
check with Old Capital about locating on the sidewalk on southside of
interchange... Those plans didn't work out .... facility we need .... important to Iowa
City Transit to get something... be able to move ahead. We have looked at
different options. Trying to locate on the sidewalk is not going to work ....We
have the plans ready to go for back in the middle of the street .... Another option
that we thought of was to move the interchange .... take it around the comer and go
onto Capital Street.
Lehman/At one time... completed one-way on Washington, the city council at that point
was inclined to close Washington Street from Clinton to Capital to any vehicular
traffic .... If the traffic in that area were limited to buses only .... Could we pick up
enough room to build... in an attractive sort of fashion? We could eliminate one
lane...
Kubby/What do you do to the traffic circulation for downtown? ....
Lehman/I would like to see the number of cars that actually use that.

The Union has a catering permit. The University requires their activities to be
catered by the Union ....
Champion/That is not true... you can have somebody else cater .... You have to purchase
the alcohol... from the University .... They have to provide the bartenders ....
Thornberry/I liked Dee Norton's birthday party so well .... when he turned 75 .... at the
University... They had alcohol there .... I could get the gazebo... alcohol had to be
from somebody else .... It was available ....

Atkins/I just want to report real quickly to you that I have not finished my work on that.
Eleanor and I and Don... additional research .... I want to get a report to you in the

Lehman/One other things associated with sales tax .... I have had a conversation with a
couple of folks from Coralville. Should the sales tax pass, should we put it on the
ballot and it passes .... number of question .... There may very well be some
projects that Coralville and Iowa City might consider together... Mormon Trek ....
another project... County might be involved in .... Is there interest on the part of
council in visiting with Coralville and the County to see if there is any project that
might be of mutual interest to all of us?

Lehman/They are going to list... options... what we would do should the sales tax pass ....
Norton/I would be hesitant to be too specific ....You say we have to have some options
for capital activities ....

a sidewalk they ought to get a ticket. People shouldn't have to walk in the

23. Vanderhoef/I was concerned about the new story that was talking about the number
of complaints to our PCRB... seem to have it out of context... the public report ....
sounded like that we had hundreds of complaints... I went back through the
reports... seven... all from the same person and three of the seven from the
previous year are from the same person .... I would like a news report out there that
says hey folks... we aren't getting that many complaints ....

Vanderhoef/ .... they misled you .... I don't know how we get around that .... If we can put
out a statement of how many complaints we have had total.
Lehman/That commission was set up to be as autonomous as it could possibly get... their
responsibility .... hands off, leave them alone .... I think I would let that one go ....

Kubby/Not a bad idea for a commission like that to meet with the editorial board ....
present how they are progressing ....have direct contact ....You can say I want to
meet with your editorial board.
