(1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
MAY 12 ON AMENDING THE FY98 OPERATING BUDGET.
Comment: State legislation mandates municipalities amend their
annual budgets by May 31. This resolution sets the public hearing
for amendments on May 12, 1998. Detailed information on
amendments will be available for public inspection on
May 1, 1998.

CONSIDER A MOTION SETTING A PUBLIC HEARING FOR MAY 12
ON A RESOLUTION ADOPTING LOCAL HOMELESS PREFERENCE
FOR APPLICANTS AT THE IOWA CITY HOUSING AUTHORITY.
Comment: HUD requires a Public Hearing when requesting a Local
Preference for housing assistance. This preference would give
homeless persons certified by HACAP, DVIP, EHP, and Successful
Living priority in receiving housing assistance. Once approved, this
local preference would be included in the Section 8 and Public
Housing Admissions Plan.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST A SUBORDINATION
AGREEMENT BETWEEN THE CITY OF IOWA CITY AND FIRST
NATIONAL BANK, IOWA CITY, IOWA FOR THE PROPERTY
LOCATED AT 826 RIDER STREET, IOWA CITY, IOWA.
Comment: First National Bank, Iowa City, Iowa has requested that
the City approve a Subordination Agreement for 826 Rider Street.
On March 8, 1996, the owners of the property received a $14,900
Mortgage through the City's Housing Rehabilitation Program. First
National Bank has refinanced a new first mortgage to the property
owners for the amount of $74,500. The property is assessed at
$95,000 which provides enough equity to cover the City's second
lien position, of which was the City's original position.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST A SUBORDINATION
AGREEMENT BETWEEN THE CITY OF IOWA CITY AND FIRST
NATIONAL BANK~ IOWA CITY, IOWA FOR PROPERTY LOCATED
AT 3351 WINTERGREEN AVENUE, IOWA CITY, IOWA.
Comment: First National Bank, Iowa City, Iowa has requested that
the City approve a Subordination Agreement for 3351 Wintergreen
Avenue. On August 23, 1996, Greater Iowa City Housing
Fellowship (GICHF) received a loan from the HOME Investment
Partnership Fund and a Mortgage for a total of $24,000. First
National Bank is about to finance a new mortgage to the property
owner for the amount of $68,600. The property is appraised at
$119,000 which provides enough equity to cover the City's second
lien position, of which is the City's current position.

CONSIDER A RESOLUTION AUTHORIZING THE HISTORIC
PRESERVATION COMMISSION TO FILE AN APPLICATION FOR A
HISTORIC RESOURCES DEVELOPMENT PROGRAM (HRDP) GRANT
TO OBTAIN FUNDS FOR THE PURPOSE OF CONDUCTING A
SURVEY/EVALUATION OF THE EARLY NEIGHBORHOOD
NORTHEAST OF THE ORIGINAL TOWN PLAT, PHASE III.
Comment: The Historic Preservation Commission intends to apply
for an HRDP grant of approximately $8,500 to assist in the third
phase of a survey of the Northside/Goosetown area. The grant
funding will require approximately $5,500 in local matching funds,
which the Commission intends to provide through funds allocated in
the budget for historic preservation activities, and through in-kind
services and supplies. This survey would generally include the
properties east of Governor Street, south of the cemetery, west of
Reno Street, and north of Rochester Avenue.

Comment: At its April 2 meeting, by a vote of 5-1 with Ehrhardt voting
no, the Planning and Zoning Commission recommended approval of the

Consider an ordinance conditionally changing the zoning designation on
approximately 41 acres located between Lower West Branch Road and
Court Street extended, approximately 4/5 miles west of Taft Avenue from
Low Density Single-Family Residential (RS-5) to Medium Density Single-
Family Residential (RS-8) for 29.1 acres and Low Density Multi-Family
Residential (RM-12) for 11.9 acres. (REZ97-0019) (Second consideration)
Comment: At its February 19 meeting, by a vote of 6-0, the Planning
and Zoning Commission recommended approval of the requested rezoning
subject to a conditional zoning agreement outlining the applicant's
obligations regarding the extension of Court Street and requiring approval
of a future OPDH application for each parcel prior to development of the
property, to be prepared and reviewed in accordance with the
neighborhood design concepts' contained in the Comprehensive Plan.
Staff recommended approval subject to conditions in a February 13
memorandum to the Commission.
Consider an ordinance approving the preliminary OPDH plan for Walnut
Ridge, Parts 6 and 7, a 66.68 acre, 20-lot residential subdivision located

Comment: At its April 2 meeting, by a vote of 6-0, the Planning and

PUBLIC HEARING ON THE FY99 ANNUAL ACTION PLAN, INCLUDING THE
FY99 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) AND HOME
INVESTMENT PARTNERSHIP PROGRAM (HOME) BUDGET, FOR IOWA CITY,
IOWA.
Comment: The Housing and Community Development Commission will be
submitting the FY99 Annual Action Plan to the City Council on
April 28. The U.S, Department of Housing and Urban Development requires
a public hearing and approval of an Annual Action Plan by the City Council
for this funding.
PUBLIC HEARING ON PROPOSED AMENDMENTS TO THE FLOOD
INSURANCE RATE MAPS.
Comment: The public hearing is on proposed amendments to the Flood
Insurance Rate Maps that are used as a tool for administration and
enforcement of the Flood Plain Management Ordinance. The amendments to
the maps include revisions of existing maps and expansion of area mapped.
After the public hearing, the maps will be forwarded to the Federal
Emergency Management Agency for review and approval.

Comment: A neighborhood meeting was held on April 14 to discuss
solutions to an existing sight distance problem. The project plans reflect
making Elmira Street a "right-in only." The 1,750 foot easterly extension of
Court Street has an estimated construction cost of 9595,150 and will be
funded by General Obligation Bonds and Road Use Tax.

Comment: A portion of the Iowa River Corridor Trail has been designed
along the Iowa River on property where Linder Tire Service is located. The
owners of this parcel of property have agreed to convey the necessary
property for the trail to the City in exchange for the City conveying to them
an approximately equal amount of property the City owns south of Linder
Tire Service where Benton Street was f~rmerly located. The property being
vacated is not needed for access to other adjoining properties. Staff
requests expedited consideration of this item.

IS ADJACENT TO UNDER TIRE SERVICE TO HENRY LINDER.
Comment: A portion of the Iowa River Corridor Trail has been designed
along the Iowa River on property where Linder Tire Service is located. The
owner of this parcel of property, Henry Linder, as trustee, has agreed to
convey the necessary property for the trail to the City in exchange for the
City conveying to him an approximately equal amount of property the City
owns south of Linder Tire Service where Benton Street was formerly located.
The City Council is currently considering an ordinance to vacate this
property.

CONVEYANCE OF 2258 RUSSELL DRIVE, ALSO DESCRIBED AS LOT 204,
PART 5, HOLLYWOOD MANOR ADDITION, TO THE TENANT.
Comment: The Iowa City Housing Authority, under its Tenant-to-Ownership
program, proposed to sell 2258 Russell Drive to the present tenant. The
tenant has agreed to purchase 2258 Russell Drive for the appraised value of
$100,000. Iowa State Bank will finance the first mortgage for the amount of
$50,000. The City will carry a silent second mortgage in the amount of
$50,000. This sale provides the opportunity for a low-income family to
obtain ownership of their own home.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK .TO ATTEST AN AGREEMENT BETWEEN THE CITY OF IOWA
CITY AND STANLEY CONSULTANTS INC. OF MUSCATINE, IOWA FOR A
TRAFFIC STUDY OF THE SOUTH GILBERT STREET CORRIDOR BETWEEN
BENTON STREET AND STEVENS DRIVE.
Comment: Earlier this year, the City Council directed staff to proceed with a
traffic study and concept design plan for improvements to the South Gilbert
Street corridor between Benton Street and Stevens Drive. Stanley
Consultants Inc. of Muscatine, Iowa have been selected for the study, which
will include an extensive public information process and evaluation of
alternative courses of action. The contract fee is $87,980.
CONSIDER A RESOLUTION RENAMING A STREET JAKES WAY.
Comment: The developer of Oakes 5th Addition has requested that Car
Street be renamed to Jakes Way. The name is a family name of importance
to the developer. There are currently no houses on this street.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK TO ATTEST AN AGREEMENT BETWEEN HOWARD R. GREEN
COMPANY OF IOWA CITY, IOWA, AND THE CITY OF IOWA CITY TO
PROVIDE CONSTRUCTION SURVEY AND ENGINEERING CONSULTING
SERVICES DURING CONSTRUCTION OF THE WATER FACILITY SITE
DEVELOPMENT - PHASE I IMPROVEMENT PROJECT.
Comment: Thi~ a~reement will provi~!Q far ~nstru~tion staking and
surveying and limited engineerin§ ~on~ulting ~ervice~ during construction of
the Water Facility Site Development - Phase I Improvement. It is desirable to
have Howard R. Green Company, the design engineer for this project, assist
the City in implementing the construction contract in those areas where
outside professional engineering support is needed. The cost of this
agreement is $146,540 and will be funded with Water Revenue Bonds.
Public Works recommends approval of this resolution.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK TO ATTEST AMENDMENT NUMBER 1 TO THE AGREEMENT
DATES FEBRUARY 11, 1997, BETWEEN STANLEY CONSULTANTS, INC.,
OF MUSCATINE, IOWA, AND THE CITY OF IOWA CITY FOR CONSULTING
SERVICES DURING CONSTRUCTION OF THE WILLOW CREEK INTERCEPTOR
SEWER PROJECT.
Comment: This amendment will provide for limited engineering consulting
services during construction of the Willow Creek Interceptor Sewer Project.
It is desirable to have Stanley Consultants assist the City in implementing the
construction contract in those areas where outside professional engineering
support is needed. Specifically, professional engineering support includes
review of shop drawings, approving change orders affecting design, visiting
the construction site periodically to insure project is constructed according to
plans, conducting a final inspection, and preparing as-built plans. The cost of
this work is $71,000 and will be funded with sewer revenue bonds. Public
Works recommends approval of this resolution.
ITEM NO. 18.
CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK ATTEST AN AGREEMENT BETWEEN MMS CONSULTANTS,
INC. OF IOWA CITY, IOWA AND THE CITY OF IOWA CITY, IOWA TO
PROVIDE CONSTRUCTION SURVEY SERVICES FOR THE WILLOW CREEK
INTERCEPTOR SEWER PROJECT.
Comment: This agreement will provide for construction staking and surveying
along the route of the Willow Creek Interception Sewer as necessary to
provide alignment and grade for the construction contractor. The negotiated
fee for this work is $71,500 and will be funded with sewer revenue Bonds.
Public works recommends approval of this resolution.

Comment: This amendment compen ard R. Green Company for
extra work performed during design of the water facility improvements. The
extra work includes the collector wells on the peninsula property, renovation
of the Rochester Avenue and Sycamore Street ground storage reservoirs,
pedestrian bridge atop the Iowa River power dam and additional work
necessary to obtain Corps of Engineers construction permit. See included
letter from Howard R. Green. The cost of this additional design work is
$245,135 and will be funded with water revenue bonds. Public Works

CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE
ENGINEERING DIVISION OF THE PUBLIC WORKS DEPARTMENT AND THE
AFSCME PAY PLAN.
Comment: Water and Wastewater Facility projects totaling approximately
$12,000,000 will be under construction this summer. With the continuation
of this level of work effort for the next several years and with the anticipated
project management and inspection effort necessary to insure quality
construction, Public Works recommends the addition of the position of a
Special Projects Inspector II and the deletion of a Special Projects Inspector.
This change will improve the overall management of Water and Wastewater
construction projects. The additional cost of this recommendation is
approximately $900 per year. Staff memorandum included in Council packet.

completed the design of the Civic Center Third Floor and Police Department
Second Floor Expansion development phase. The design for the contract
documents phase, to prepare this project for bidding, will cost ~37,000, and
will be funded by general fund.

CONSIDER A RESOLUTION CERTIFYING UNPAID WATER, WASTEWATER,
SOLID WASTE AND RECYCLING CHARGES, INCLUDING FEES AND
PENALTIES, TO JOHNSON COUNTY FOR COLLECTION IN THE SAME
MANNER AS A PROPERTY TAX.
Comment: This resolution authorizes the filing of a lien against properties for
delinquent water, wastewater, solid waste, and/or recycling services,.
including fees and penalties. A memorandum dated April 15, 1998, was
sent to Council explaining the utility collection system procedures. On
March 30, 1998, letters were mailed to each property owner and tenant, if
applicable, listed in Exhibit B, notifying them of the date for the Council's
consideration of the resolution. On April 10, 1998, a letter was mailed to
the same individuals advising the City Council meeting was rescheduled to
April 28, 1998. After the resolution is moved for adoption, property owners
should be permitted to be heard concerning the unpaid charges.

CONSIDER A RESOLUTION RESCINDING RESOLUTION 92-316 AND
ESTABLISHING A NEW POLICY FOR USE OF FUNDS DERIVED FROM
HOTEL-MOTEL TAX.
Comment: The City Council approved the reallocation of 10%
(approximately $46,000) of the hotel-motel tax revenue. It was allocated to
the parkland acquisition and development fund and will be moved to a fund
for constructing, improving, enlarging, equipping or operating park and
recreational facilities. The existing parkland acquisition and development
fund, totaling approximately $493,000, will be used for parkland purposes.
This funding change will begin July 1, 1998.
CONSIDER A RESOLUTION ASSESSING LIQUIDATED DAMAGES AGAINST
CABLEVISION VII, INC.
Comment: This resolution authorizes enforcement of the provisions of the
existing franchise agreement by assessing liquidated damages in the amount
of $250 per day beginning February 27, 1998, and continuing until the
upgrade of the local Cable TV system is completed in accordance with the
terms and conditions of the franchise agreement.
