Dear Joe and Members of the Board:
The City Council has received a request from Mariel Sotzen to rezone ten acres of property
from A-l, Agricultural to RS-10, Suburban Residential for property located at the intersection of
Wapsi Avenue and Lower West Branch Road. The property is within Fringe Area B, outside of
the City's growth area. The RS-10 zoning designation allows one dwelling unit per ten acres.
At its April 2, 1998 meeting the Planning and Zoning Commission found by a vote of 6-0 that the
re7oning application is consistent with the mutually agreed upon Fringe Area Agreement
between Johnson County and Iowa City. The policy for Fringe Area B states that for land
outside the City's growth area, agricultural uses are preferred. However, consideration will be
given to applications for single-family residential development at a density of RS-10 (one
dwelling unit per ten acres). This property is at the intersection of two secondary roads, and is
accessed by an existing driveway. Council, therefore, advises that the request to rezone this
property from A-1 to RS-10 be approved.

CZ9803, Mariel Sotzen Rezoning Request on Lower West Branch Road and Wapsi
Avenue From A-l, Agricultural to RS-10, Suburban Residential
Johnson County has received a request from Mariel Sotzen to rezone 10 acres of property from A-l,
Agricultural to RS-10, Suburban Residential for property located at the intersection of Wapsi Avenue and
Lower West Branch Road. The property is within Fringe Area B. outside of the City's growth area. The
RS-10 zoning designation allows one dwelling unit per ten acres. The applicant intends to deed the
ten-acre property to his son, Wesley Sotzen, who intends to construct a home on the site. The Sotzens
own an approximate 100+ acre farm.
The Sotzen's have also requested that the 10 acre property be subdivided off of the 100+ acre farm.
Because the subdivision is considered a farmstead split, the City will have no review of it. The Fringe Area
Agreement specifies that subdivisions of land into less than three lots will continue to be regulated solely
by the County.
Fringe Area Agreement
The Fringe Area Policy Agreement is intended to provide for orderly and efficient development patterns
appropriate to a non-urbanized area, protect and preserve fringe area's natural resources and
environmentally sensitive features, direct development to areas with physical characteristics which can
accommodate development, and effectively and economically provide services for future growth and
development. The policy for Fringe Area B states that for land outside the City's growth area, agricultural
uses are preferred. However, consideration will be given to application for single-family residential
development at a density of RS-10 (1 dwelling unit/10 acres).
The property proposed for rezoning to RS-10 is at the intersection of Lower West Branch Road and Wapsi
Avenue, and is accessed by an existing drive off of Wapsi Avenue. The property is currently agricultural in
character. Rezoning 10 acres to RSo10 will only allow the creation of one new lot, which is considered a
farmstead split. No new public infrastructure will be required to serve the property. Staff feels the proposed
rezoning request is not contrary to the intent of the Fringe Area Agreement.
STAFF RECOMMENDATION
Staff recommends that the City Council forward a letter to the Johnson County Board of Supervisors
recommending that CZ9803, a request to rezone 10 acres of property from A-l, Agricultural to RS-10,
Suburban Residential, for property located at the intersection of Lower West Branch Road and Wapsi
Avenue, be approved.

This application is on behalf of Mr. Wes Sotzen. It is the intent of this application to
rezone a single l0 acre lot to RS-10, as specified in the fringe area agreement, off of
the 100+ acre farm that Mr. Sotzen's mother owns so that tie may build a home. It is
my understanding that Mr. Sotzen will live in the new home but would like it separated
fi~m the remaining t~rm.

approximately one half mile north of Herbert Hoover Highway. The property is located within
Fringe Area A outside of Iowa City's growth area. The RS-3 zoning designation allows one
dwelling unit per three acres.
At its April 2, 1998 meeting the Planning and Zoning Commission found by a vote of 6-0 that the
rezoning application is consistent with the mutually agreed upon Fringe Area Agreement
between Johnson County and Iowa City. The policy for Fringe Area A states that proposals to
rezone land to RS-3 will be considered on a case-by-case basis. This particular property already
contains a number of out-buildings and a well, and is accessed by an existing driveway.

CZ9813. Louis and Ila Ernst Rezoning Request on Utah Avenue from A-l, Agricultural,
to RS-3, Suburban Residential
Johnson County has received an application from Louis and Ila Ernst to rezone 3.94 acres from
A-l, Agricultural to RSo3, Suburban Residential, for property located on the east side of Utah
Avenue, approximately ½ mile north of Herbert Hoover Highway. The RS-3 zoning designation
allows one dwelling unit per three acres. This properly is located with Fringe Area A, outside of
Iowa City's growth area. The applicants intend to deed the 3.94 acres to their daughter,
Catherine West. The Ernst family owns over 400 acres of property in the immediate vicinity.
The Ernsts have requested a subdivision of the property from the County in conjunction with the
rezoning. Because the subdivision is considered a farmstead split, the City will have no review
of the subdivision. The Fringe Area Agreement specifies that subdivisions of land into less than
three lots will continue to be regulated solely by the County.
Fringe Area Agreement
The Fringe Area Policy Agreement is intended to provide for orderly and efficient development

existing driveway. There are a number of out-buildings and a well already on the property.
Rezoning 3.94 acres will only permit one lot to be subdivided, which is considered a farmstead
split, and no new public infrastructure will be required to serve the property. Staff feels that the
proposed rezoning is not contrary to the intent of the Fringe Area Agreement.
STAFF RECOMMENDATION
Staff recommends that the City Council forward a letter to the Johnson County Board of
Supervisors recommending that CZ9813, a request to rezone 3.94 acres from A-l, Agricultural
to RS-3, Suburban Residential, for property located on the east side of Utah Avenue
approximately ½ mile north of Herbert Hoover Highway, be approved.
