a. Consider a motion setting a public hearing for June 4 on an
ordinance amending the Zoning Chapter by conditionally rezoning a
2.32 acre tract from I-l, Industrial, to CI-1, Intensive
Commercial, for property located east of Sunset Street on the south
side of Highway 1. (REZ96-0006)
Franklin/ The first item on your agenda is to set a p.h. for June
4 on a Zoning Ordinance amendment to rezone property... from
I-1 to CI-1 ..... just east of Menards .... You will see that in
detail at your next meeting.
Nov/ We should see that Airport Commission report also. It seems to
me they were talking about absorbing everything between there
and there.
Franklin/ It may come up ..... just northeast of Menards.
bo Public hearing on an ordinance amending the Zoning Chapter by
rezoning a 1.79 acre tract from CC2, Community Commercial to
OSA/CC2, Sensitive Areas Overlay/Coramunity Commercial Zone and
approval of a preliminary Sensitive Areas Development Plan for
property located at the intersection of Sturgis Corner Drive and
Highway 6. (REZ96-0008)
Franklin/ Next item is a rezoning from CC-2 to OSA .... at Sturgis
Corner. I will refer you to the drawing in your packet.
Thornberry/ Will that need a fence between the trail and the river?
Franklin/ No, I don't think so. At one point it will but probably
not right behind this building ..... farther north before you
get to the Coldwell Banker Building, it is going to be cut
into the slope, the trail... altered protected slope.
Norton/ ...How many structures are we talking about? ....

Franklin/ A long building .... The one that is marked Anderson
Bender is already built .... This project required a parking
reduction .... minor modification.. through HIS It meets the
equlrements for an altered protected slope. The building
encroaches into the buffer, not into the slope but it does not
in any way de-stabilize the slope that is there. The trail
will cut into the slope and will require a retaining wall at
a point somewhere between this building and the Coldwell
Banker/Anderson Bender building ..... We advocated and the P/Z
Commission concurred that that was reasonable to make that
alteration in the slope for the public purpose of the trail.
Kubby/ If it were a private entity..° would that be allowable under
the overlay?
Franklin/ Trails are.allowable, yes. It would be evaluated on a
case by case basis in terms of attempting to diminish as much
as possible any disruption to the slope. The fact that this is
an altered slope made a difference in our judgement ....
Kubby/ ...issue here is erosion, not what your origin of the slope
Franklin/ .o. part of it was erosion. Part of it was habitat
preservation or preservation of a naturally occurring area ....
Norton/ Is that easement ......
Franklin/ It is not an easement.
Norton/ Just a paragraph appended to the zoning.
Franklin/ The reason for that is for years Mr. Braverman. has
been going to give this to the city as a gift and we hav~'just
been going back and forth in terms of exactly where it was
going to be... and when that was going to happen. If we

equlre it as an easement as part of a rezoning, then it is
not a gift and it is not a charitable deduction ....Calling
it... a gift. He has willingly said that he will give it to
the city.
Woito/ In all fairness to Southgate, they tried to give it to us in
1989 and at the time there were concerns on the Council°.

Woito/ Yes, I feel comfortable now that I know what the plans were
to do with the soil and what we are going to do on top of it,
etc. They have been trying to give this away for seven years,
literally.
Norton/ It had been certified as a hazardous area?

Franklin/ The resolution on preliminary and final plat for Broken
Arrow which I understand the legal papers are still being
reuiewed. We expect to have them tied up by tomorrow night.
f. Consider a resolution approving the extension of the
preliminary plat of Hunters Run Subdivision, Part 8, a 16-lot
residential subdivision located on the north side of Rohret Road.

Franklin/ Consider a resolution approving the extension of the
preliminary plat for Hunters Run Subdivision, Part 8. This has
expired and it is a fairly routine thing .... Sensitive Areas
Ordinance was passed... would not affect this particular plat
given where the plat is. Recommendation of staff and P/Z
Commision is to approve this extension ....
Kubby/ I have another P/Z question. I saw that Staples, Inc ....
that vote to amend the CZA was in the negative. Do they have
the option of coming to us?
Franklin/ They do but they have chosen not to.
Kubby/ .... to reconfiguring agreements that we worked really hard
to get.
Thornberry/ It does have a sign up there that they are coming soon.
Is that true?
Franklin/ I think that was up when they were before P/Zo I don't
know that they have decided how they are going to proceed.
Thornberry/ I read in the paper that they were looking at another
location.
Franklin/ I don't know ....
Kubby/ Do we have any indication as to why the private covenants
are so restrictive about parking? That they have more parking
requirements than the city and why they are not negotiable?
Franklin/ Those covenants come from Walmart and they believe that
they need more parking. They owned the entire thing at the
time that it was subdivided ..... Joseph Company .... then
Walmart..o subdivided and sold a lot to Cub Foods ....
Staples... at some point after the CZA was approved, the
restrictive covenants were put into affect .... I think the
parking requirements are there because Walmart feels that they

need that much parking ..... They are more than what the city
requires ....
Kubby/ Maybe you could talk to Walmart.
Vanderhoef/ Karin, on the resolution for BrokenArrow, is there not
to be something in the resolution about the Neighborhood Open
Space or money in lieu of?
Franklin/ Uh- I am trying to remember ....
Vanderhosf/ It was money in lieu of.

Vanderhoef/ As I went through the resolution, I didn't see anything

grant? It is item 16 on the agenda because Doug can't be here

Vanderhoef/ Would you go thorough.°. identify the difference
between a historic district versus the National Historic
District...?
Franklin/ What they are doing now is the survey is the preliminary
work that is done before you can designate an area a historic
district. Basically what that is doing is evaluating the age,

the nature of the structures within the district. They use
that information to go through the State Office of Historic
Preservation to get it designated as a district. It needs to
have a certain amount.. of structures... certain
characteristics that are relevant to a point in time to make
it qualify to be a historic district .... They started it and
this is to extend the area .... Made more logical historic
sense to extend these boundaries a little bit further to get
the whole area that is pertinent.
Vanderhoef/... Thanks ....
Franklin/ $2,000 that are out of the budget that has already been
allocated for historic preservation grant matches. $1,000 from
the Longfellow Association and then in-kind contributions.
Norton/ If you go through this exercise... suppose you don't
qualify for a historic distinct. Does that help identify
landmarks? ....
Franklin/ Yes .... can use that same information as a basis for you
conservation district if it doesn't qualify as a historic
district.
Thornberry/ How old does an area have to be to be historic?
Franklin/ I think it is fifty years.

most of it you have already dealt with .... changes...
GICHF/Burns Partnership could not use all the funds that were
allocated .... F¥95 & FY96 funds, HOME and CDBG, all in one big
packet. If you have specific questions, I would be happy to
answer them.

keep us on track .... knew the regs so thoroughly .... It was

Franklin/ we will just take it in parts... run through highlights
of the Fringe Agreement first because I don't think this
Council has talked about the whole thing .... that you know
what it is that you are agreeing to in principle at this
point. The next step is going to be, assuming that there is
some agreement in principal to all of this, that we then go
back and actually re-write the document and take it back
through the Council and Board for final approval.
First of all I will Just go through the highlights. In Fringe
Area A, this area to the north,... development at a RS-3
density .... in the county, the number at the end does not mean
the same thing as the number in the city. It is just the
opposite. This means 1 dwelling unit per 3 acres, not 3
dwelling units per acre. So it is one dwelling unit per three
acres for Area A.
Nov/ Have we ever considered a different system... use RR ....
Franklin/ Only if the county were going to change their entire
Zoning Ordinance or we were. That is something we can talk
about .... At this point in time the County Zoning Ordinance
has RS, residential suburban, as their zoning classification
at 1 dwelling unit per acre. We have discussed this a little
bit. The idea of the city or the county re-doing their entire
Zoning Ordinance is a little daunting .... Area A... targeted
growth area for the two miles. That is an important concept
for all of this .... two mile area all around the city that
incorporates our growth area (refers to map). Our growth area
now is defined by 1-80 (refers to map). We have some
discussion in future about growth area to the north. On June
6 when we talk about 965 with Coralville, there will be some
discussion of the growth area on the west. The Fringe
Agreement does not rely on these growth area boundary
lines .... In the Fringe Agreement it refers to those areas
that are within the growth area and those that are without the
growth area. That is really an important distinction. (Refers
to map) ..... Area A...focuses development within the two mile
area to that north area and the reason for that is...
previously in the Fringe Agreement and county approach to
development there was an understanding that the growth area of
the county would be in the north corridor .... As time...
greater pushes throughout the two mile but largely within the
north area for more development. What this agreement says is

okay, we can see there is more push for development in the two
mile area generally and that this is where it should be
primarily confined to if it is going to happen in the
unincorporated part of the county. In the proposed agreement
one could increase that density to RS or 1 dwelling per acre
if the development were clustered ....
Area B .... east and south side (refers to the map). Within the
growth area, rezonings would occur which were consistent with
our land use planning... part of our Comp Plan... a
generalized land use plan for this part of Iowa City ..... As
zoning requests came in, those zonings should be consistent
with that land use plan. They also, however .... looking at
annexation of those properties. If the property is not
contiguous to our existing corporate limits and a rezoning is
requested, we would then have to look at what that rezoning
was for° It should be consistent with the land use plan. If it
is to develop in the county, it has to be built at city
standards ..... In the growth area it is looking at the future
of this property being in the Iowa City corporate limits ....
urban design standards are required... annexation is advocated
if it is contiguous. (Refers to map). Then we get outside in
this area. This is where the Board has offered a compromise
position. As it stands now, in the existing Fringe Agreement,
we say agricultural use if preferred and then we have debates
whenever something comes in. The joint commission proposal
provided for up to three units per 40 acre tract .... agreement
allowed for rezoning to RS or one acre to allow a third house.
When the Board looked at that they said no, we would like this
area to be handled likeArea A. You responded no .... They then
have come back with a proposal that on a 40 acre tract, in
Area B, one could have up to 4 dwelling units on a 40 acre
tract and that would be it.
Kubby/ We already compromised from zero to three.
Franklin/ Farmstead splits you always accepted.
Area C .....
Baker/ This new proposal by the county, four units per 40 acre
tract. W~en was that discussion? ....
Franklin/ That discussion came out of a conversation .... Don Sehr,
R.J. Moore, Rick Dvorak and myself .... a month ago. When the
Council went back and said we accept Area C but we reject B
and C. I had conversation then with Don Sehr about where were

we .... Area in B and C that is not in the growth area we are
not close on .... point of contention and that is what we sat
down to talk about.
Nov/ The letter from the county is dated April 29.
Franklin/ The meeting was before then° So sometime in April.
Norton/ At that point the county said nothing about clustering in
C and B outside the growth area?
Franklin/ Yes, they did. Then going to C. In the growth area
(refers to map) where they is existing zoning... that
development would occur to city standards. Any place that is
contiguous annexation is encouraged since it would be in the
growth area at some point in time. Part of this... to gain
control of those properties that are in the growth area. This
area right around Hwy 1/218 intersection was targeted for
commercial and industrial development .... In the remainder of
the area .... that is not zoned RS already (refers to map)...
4 dwelling units per acre, RS-10. Then if the developer agreed
to clustering, you would go to RS-5 which is 8 dwelling units
per acre. On a 40 acre tract, both B & C require that there be
a minimum 40 acre tract when we are talking about rezoning.
Kubby/ RS-5 is 8 units per 40 acres.
Franklin/ That is right, it is 1 dwelling unit per 5 acres.
Thornberry/ But they all have to be in a small area?
Franklin/ No. You have to have a minimum 40 acre tract to get it
rezoned. You can get it rezoned under the policy to RS-10 or
4 dwelling units on 40 acres. If you cluster... with a set
aside, then you can get up to 8 units on that 40 acres.
Baker/ Is it 8 units per acre or 8 units per acre on a 40 acre
tract?
Franklin/ We are going to talk about clustering ....
Baker/ .... 4 units total for the 40 acre tract.
Franklin/ 4 units total on a 40 acre tract° If you cluster, 8 units
total on a 40 acre tract.
Kubby/ Is that true for B, the clustering?

Franklin/ NOo The distinction here... was B is the area that they
have always identified as having a high CSR, high water table
not good for septic fields ....
Kubby/ That is why we wanted the growth in A to try to protect
agricultural uses in B.
Franklin/ (Refers to map).
Kubby/ It is balancing between being a very urban and a very rural
county ....
Franklin/ The distinction between B and C.
Norton/ Used the word growth area in the north corridor .... that is
develop area ....
Franklin/ Growth area is as we use that term is where we anticipate
Iowa City's future corporate boundaries will be. That is the
growth area for the municipality .....
Concept of clustering. In Fringe Area A, example of 30 acre
tract. With the zoning that the policy endorses as being okay,
RS-3, you had 10 dwelling units on that 30 acres or 1 dwelling
unit per 3 acres. If you just straight rezoned it to RS, your
density would be 30 dwelling units at i dwelling unit per
acre. With the cluster, set aside 50% of the land for open
space, you are putting 30 dwelling units on 15 acres. Which
means each dwelling unit is on a half acre site°.. if you
chose to. That is the only way you get the higher density is
if you do the clustering. The proposal before you ....
clustering... is to have this 50% set aside. That would
prevail at any time that someone wanted to get that higher
density, they would have to consent to that set aside.
Kubby/ The proposal that came from the Commission was mandatory
c~ustering.
Franklin/ Let me go back and check that.
Kubby/ Compromise .... incentive via higher density to get the
clustering.
Franklin/ Yes, it was very different. There wasn't the set
aside .... The illustrations that I put in your packets ....
(refers to map) ..... lots are smaller but the sense of
openness can be just as great ....

Norton/ Karin... county... they had a 1 acre minimum .... assuming
they would be willing to go to smaller lot sizes ....
Franklin/ Right, that does assume there would be that willingness
to go down to get that higher density and the stumbling block
eometime with that .... is how you deal with sewage disposal
..... are ways in which you can provide the septic fields on
the open space. Use that ground but it ie not built on ....
Also other mechanisms that you can provide for sewage
treatment .....
Kubby/ .... Did you hear any feedback?
Franklin/ They had some discussions about it because they talked
about even before they sent the letter back to the city and
there were some reservations. I don't think they have
discounted it entirely. I brought this before the county staff
and they think it hae some merit but it is something that we
will have to work with in terms of how this works with the
Board of Supervisors, with the Board of Health.
Norton/
Franklin/ The 50% number in A and the 80% number in C.
Norton/ Where do those numbers come from, Karin?
Franklin/ My head .... for every acre that is built on, you have an
acre that is left in open space .... That is 50%.
Kubby/ Especially C... makes so much sense... get even greater
density... have fewer roads ....
Franklin/ You don't have to maximize the density either ....
Kubby/ If we are going to try to facilitate Deople doing the growth
in the unincorporated areas in Fringe Area A, for me the
tradeoff is balancing the important economic factor of
agricultural uses in our county .... this allows that to
happen ....

This is a constant argument among county residents. I did not
move to the county to live on a .5 acre lot .... We may provide
the option for something to develop this way and it may never
happen.

all. We talked about it.

It is probably not going to be mandatory... this is a
reasonable incentive. I would like it to be a little bit more
restrictive in that you don't have to get up to 30 units on 15
acres ..... Anybody who wants more than 1 unit per acre must
cluster ..... I would like the cluster to kick in somewhere
earlier .....
Franklin/ If there are 5 houses on a 5 acre tract with what is in
the agreement now, you do have to cluster...
Nov/ I was talking about the RS zone.
Franklin/ You don't get a RS unless you cluster ....

Franklin/ The requirement is RS with the cluster ....
Kubby/ It is not only clustered but it is the 50% set aside.
Franklin/ That is totally new .... issue of how to define what we
mean by cluster. The proposal is that you have the 50% set
aside and that is set aside in an outlot which is designated
for open space. The only way that you can change that is to go
through the platting process again... you to have zone all of
it including the outlot .... the entire property would be
zoned, including that outlot ..... We are only in Area A
now ....

Franklin/ This will be a new thing for the county to do this.
Norton/ In B and C it will take 40 acre chunks to re~one.
Franklin/ That is correct.
Norton/ That sure hasn't been the history.
Thornberry/ What if you only own 30 acres?
Franklin/ You got to get 10 more in order to do your 4 houses.

Franklin/..° So in B, we have no cluster provision... It is 40 acre
minimum tract, RS-10, 4 dwelling units. 1 dwelling unit on 10
acres, no lot is less than 1 acre.
Okay, let's go to C. Same basic concept. However, you do have
the cluster provision which allows you 8 dwelling units with
80% set aside .... just a proposal. That gives you 1 dwelling
unit on ! acre.

Franklin/ So you would have 32 acres in open space or continue to
be in farm land or open space... 8 acres of it could be
developed and that is if you want the higher density, then you
must cluster. Other wise it is 4 dwelling units on 40 acres.
You can do them on 1 acre lots or
Norton/ Do you think that 40 acre thing is realistic? ....
Nov/ 40 acres is a minimum farm property ....
Franklin/ One of the other provisions is the frequency which we
review the Fringe Agreement. A year has been suggested. That
makes me nervous. I would like to see at least two if not
three.
Kubby/
Nov/ Three.
Norton/ Three, I agree with you.

Kubby/ Also allowing something to see if it works or not.

Franklin/ It takes some time, certainly.
Okay, annexation .... still within the purview of the city. We
always require the county. We are required to notify the
county by state law. This issue with annexation is when and if
we extend the two mile extraterritorial jurisdiction. Right
now the state enables cities to review plats within the two

mile boundary or up to two miles of your corporate limits. You
have to adopt an ordinance that says you are going to do that
or something less. We have, in our subdivision regulations,
part of that is that we will review all subdivisions within
the two miles and it is automatic .... ?~at the agreement now
has in it is language to the affect that we will consider
those two mile extensions on a case by case basis in
consultation with the county .... When the annexation comes
through, when we notify the county, the staff will make a
recommendation as to whether we extend that two mile area or
not and that recommendation would be based upon whether we
anticipate further annexation in that area, what the pressures

Council member, one Board member, one County Zoning Commission
member, one City Zoning Commision member and a fifth at
large .... The stickier thing is what decision is made by this
Board and what power they have .... I have had conversations
with Pat White and Linda .... The zoning authority rests with
the Board of Supervisors. We cannot just give that to another
entity because that is set by state law. If you like the idea
of an Appeals Board, the next step... is for the attorneys to
get together and figure out how this is done .... whether this
Board is recommending to the Board of Supervisors or what it
is. Pat White has suggested a joint City/County P/Z Commission
for the two mile area which would be a new beast for Johnson

modifying the standards which you impose on those subdivisions

look forward to any comments that you may have. We have
prepared an exhibit .... depicts existing conditions as well as
future improvements ....
I would like to begin first with Runway 6/24, this will be our
primary runway .... (refers to map)°.. 154 foot in width and we
are proposing an extension of 800 feet on Runway 06 end as
well as displacement of Runway 2/4 end .... This gives us
effective overall accelerate stop distance and take off
distance available of 5,015 feet .... We need to do two
things.°. acquire additional land... approximately 14.7 acres
(refers to map) and additional 1.1 acre as well as mobile home
park, consisting of approximately 5.1 acres. We would also
propose relocation of Dane Road .... drainage way .... We did
prepare colored exhibit .... extensions as well as runway
protection zones... relocated drainage way .... 80 foot r.o.w.
with 31 foot street. We would propose that this road be
constructed from the existing Dane Road .... intersect with
Mormon Trek and extend to the property lineo.. arterial street
intersecting with Dane farther to the south .... relocation of
a service road to the out building .... raising all the
imaginary surfaces .... have approximately 140 obstructions
identified in 1990 .... we eliminate all but 55 of those.

runway would that elevation be raised?
Searle/ We would have a maximum of 2% centerline slope on this
runway .... this end becomes the highest point on runway

talk to you about additional gym space in Iowa City... Project
that called Mercer Park Expansion. Mr. Atkins met with us
several months ago... need a plan .... We got a plan and we are
here to tell you what it is and get your reaction and thoughts
on it .... I want to tell you a little bit about the
process .... How we arrived at this plan. The P/R
Commission .... August 1993 set additional gym space as a
nunuber one priority for capital improvements... Commission or
referendum, projects had Mercer Park Expansion as number two
and additional space or expansion of the d.t. Rec Center as
number 1 .... Mike Gatens... came to a Commission meeting one
night and said .... we need more space .... So we began batting
around the need in Iowa City for additional gym space ....
Foundation began discussing how to accommodate that demand. We
formed a group and we hired Kevin Munson to essentially
brainstorm and put together three or four concepts .... take
those concepts and narrow them down to one plan and our plan
took into consideration several factors .... Accommodate as
many different types of uses are we could think of ....
basketball courts .... spaces that could accommodate
volleyball... groups who like to walk .... meeting space...
aerobics groups .... We then had to factor in the cost of the
project .... trimming it back down to something that we thought
could actually happen... Talking about how we are going to pay
for it .... Let's try to do a project without having to go to
a referendum .... impressed with soccer fields where a group
did private fund raising .... Talked about financing of the
project... We developed the plan... We put together a citizens
group from all over Iowa City .... Harry Ostrander, Tom Cilek,
Darrel Courthey, Mary Ann Brown ..... to have them come in and
shoot down our plan... positive suggestions .... brainstorm ....
made more modifications to the plan ...... Modifications to the
plan..o We finally developed a model that Terry can talk to
you about .... School district involved... We have written the
school district .... This week we are going to meet with Jerry
Palmer... get their input and see if they have interest in
pursuing it .... Terry showed you the actual plan.

package. Can I talk about that? I have a problem with either
direction. I have a problem with a private package sewer plant
on private land and I have a problem with a public entity
providing the responsibility for sewer for private entities
who are not within the city limits.

Kubby/ I thought you were interested in having us have a private
package sewer plant.
Arkins/ I am ..... short term basis in anticipation of the southwest
sewer. I put that on the table simply to say there is another
way to go after this thing. I think this thing is fraught with
issues that need a lot of attention .... A private sewer
system .... wish to expand it..° there are new rules .... I
think this is a big issue... so much potential of blowing up
in our face°°. I think it is a bad zoning decision to put
there and we know that but we have got it. Bob is a good and
decent developer... concerned about putting a packaged plant
on public property .... potential for 400 families hooked up to
a private system. He wants to build it on his own site° There

the sanitary sewer business other than regulating us .... The

front of it.°. It is no longer a neighborhood... adjacent to

You can buy these steel basins and put them in the ground ....
They are very easy to move .... Easy to shut them down and move
them .... Bob bottom line response is I can build a sewer
treatment package plant and operate it cheaper than hooking
into your comprehensive... He is right .... It is publicly
owned... full time personnel and crews... cash resources to
respond to any kind of environmental disaster° We don't go
bankrupt, we don't walk away .... I will talk with him... if
you are willing to press this matter a little further.

What I had Jim do was we signed it right off of Park Road so

the height of either one of them .... Park Road and Rocky Shore
and Hwy 6 .....

before you get to ....

was voted down .... wider street planned .... Council voted it

read this, all of this is coming from the Elks Golf Course.

8. Vanderhoef/ ... When we have these torrential rains and we have
backup in basements because of storm water overload and there
are pumps out there on the street to help us... how does it
get triggered?
Atkins/ We have people that go out .... Problem last time is they
stole two of the pumps .... We have to go buy a couple of more
pumps .... We have pumps set up. We have people on call.

think it is really great ....

rates for two water meters, the outdoor water meter... when we
split from a two month to a one month billing and the water
meter rates were not changed for those.
Atkins/ For the ... lawn meter ....
Woito/ It has always been cheaper because you don't have to treat
the waste water.

Vanderhoef/ I know we are charging for the meters now. Had we
always charged for the second meter?
Woito/ They have to buy both meters from us ....
Norton/ What is the rational for the minimum charge for the second
meter?

Arkins/ There is a couple of months during the year we don't

Wednesday night to meet with all the neighbors .... They are

Ed Moreno .... They came out and put one of those meters on for
24 hours and I have to call him to see if he has got results
yet.
