a. Consider a motion setting a public hearing for July 2 on an
ordinance amending the Zoning Chapter by amending the Conditional
Zoning Agreement for WestPort Plaza to eliminate the requirement
for a "cohesive, integrated development," and to remove the
requirement for the facades of the buildings to provide "horizontal
continuity,,' for property located in the CC-2, community Commercial
zone at 855 Highway 1 West. (REZ96-0010)
Miklo/ Setting a p.h. for July 2 on amendment to CZA for Westport
Plaza... proposed by Staples... would eliminate the
requirement for integrated shopping center and would result in
additional parking versus what was shown on the concept
plans .... P/Z Commission recommended against the proposal and
so has staff. We will include the staff report and details in
your next mailing.
Baker/ Is there anything, any new fact or argument that they are
bringing to us that they didn't do at P/Z?
Miklo/ At this point I don't believe so ....
Baker/ Having read all the staff report... P/Z ..... I agree with
them ....
Miklo/ Typically if P/Z recommends denial, the case is over unless
the applicant appeals it to you and that is what they have
done.

Norton/ .... One thing .... I noticed Tom Scott... concerns about
CZA ..... wondered if you have any further details?
Miklo/ His concerns... he felt that the original CZA was varied
somewhat when the site plan was approved ..... matter of debate
whether the current development is in general compliance ....
Norton/ We have seen nothing visual, have we?
Miklo/ Your next packet will include material.

Norton/ So we will get it on the 28th of June or something ....
b. Public hearing on an ordinance amending the Zoning Chapter by
conditionally rezoning a 2.32 acre tract from I-l, Industrial, to
CI-1, Intensive Commercial, for property located east of Sunset
Street on the south side of Highway 1. (REZ96-0006)
Miklo/ This property is to the north of Mennards. The access will
be via the access road to Mennards. The property is owned by
the Ruppert family and it is part of a larger property, a good
portion .... 10 acres included in the airport runway overlay
zone, 2 1/3 acre portion is outside of that zone. That is the
portion that is requested for rezoning from I-1 to CI-1 ....
P/Z Commission reviewed this proposal in May and recommended
unanimously approval. The staff also recommends approval
subject to a CZA which is very similar to that that applied to
Mennards property, spells out conditions regarding setbacks,
landscaping, the amount of signage and also a requirement that
vehicles be allowed to pass over the property to this area
(refers to map) ..... does not have to go back on the highway.
Nov/ Is this a signed CZA?

c. Consider an ordinance amending the Zoning Chapter by rezoning a
1.79 acre tract from CC2, Co~nunity Commercial to 05A/CC2,

Council Direction - Issues Re: to Apartment Development 96-72 S1
Miklo/ Discussion of City policy and regulations regarding
apartment development. This has been brought up bythe council
on a number of occasions, most recently last month .... several
issues identified and before we proceed... get a little
clarification as to which of these we should focus on. One of
the issues .... was compatibility of design of new construction
in older neighborhoods ..... also. o. concern in new areas as
well .... Whether you are talking about neighborhoods such as
College Street or Dubuque Street ..... Or whether you would
also like us to look at areas such as Scott Blvd where the
entire neighborhood is generally new and there is new
apartment buildings being built adjacent to s.f. homes° One of
the other issues that was mentioned was the number of
apartment buildings being built with 4-5 bedrooms .... Staff
has really not observed that this is a trend as of yet ....
Woito/ May I interrupt a second° This group that I called
together... to deal with the picking up of solid waste and 4-5
bedroom and four plex aren't the same. Doug Boothroy has a
different take on the trend of these size of apartments and so
does Chuck. They think there is a trend .... that there are a
lot more four plexes with 4-5 bedrooms being built.
Miklo/ If it is a trend, it is fairly recent ..... Do we nsed to
give this more time to find out if this is a continuing
process? ..... If it is...is this all a bad thing? .... families
..... University students ....
Kubby/ Bob, what about the two new apartment buildings near d.t. on
Iowa Avenue and Dubuque and Burlington? How many bedrooms?
Miklo/ I believe the ones on Dubuque have been three bedrooms. We
can certainly research that. The Jim Clark building has four
and mostly five bedrooms.
Norton/ What is going to be down on South Linn? ....
Miklo/ I believe those are three and four bedrooms.
Baker/ Iowa Avenue?
Miklo/ I would have to check .... The one on South Capital is also
primarily four bedroom°
Franklin/ Tonight what we would like to try to do is get at what

very difficult for us to tell what you were identifying as the
problem .....
Baker/ ..... In established neighborhoods there is an increased
likelihood of disruption of the neighborhood by the demolition
of existing properties and building a new apartment building
in there that is 4-5 bedroom units which might technically
fulfill the Zoning Ordinance by density but which evades
certainly the spirit of the ordinance which is to control of
density ...... concerned about what is it that the City can do
to discourage in established neighborhoods that process. I am
less concerned about outlying areas ..... What is it that we
can do to stabilize those neighborhoods and actively the
demolition of existing stock? .....
Kubby/ And when it is demolished and rebuilt, that it fits in .....
Norton/ Wouldn't this also bring in the number of bedrooms? ....
Baker/... people density... unit density. The increase of bedrooms
has allowed construction to occur that wouldn't have occurred
if they would have only been two and three bedroom
apartments .... Do you control the number of bedrooms or do you
reduce the number of allowable units? .....
Miklo/ Is that a good framing of the issue? That it is primarily
older neighborhoods?
Nov/ This is what we have been hearing ....
Miklo/ Larry, your concern isn't so much number of bedrooms but
overall density?
Baker/ I think if you lower the density, you will solve the
problem ....
Miklo/ In addition to density, there is a concern about
compatibility of new construction.
Baker/ And if it redeveloped, what happens on the site.
Miklo/
Baker/ .... an incentive to maintain existing stock .... This doesn't
create any more affordable housing, what is happening in
established neighborhoods .....

Thornberry/ It might .....
Baker/
Thornberry/ I have a question regarding the building that is
proposed in the Longfellow neighborhood .... large building
with multi bedrooms with central kitchens. Would that fall
into this category?
Miklo/ Is that the building that Jim O'Brien has been speaking of?
At this point°.. he hasn't actually shown us a plan of any
sort... provisions for elderly group housing which would- I
would say it is a different issue all together.
Lehman/ ...It is a whole new area that he is doing.
Kubby/ It has been in an established neighborhood ....
Baker/ That is a compatibility question, not a density question.
Miklo/ If he proceeds under the current ordinance without trying to
rezone the property, he would design this as basically a large
s.f. home that would rather than having a traditional family,
you would have a group of elders living together. So I would
see that as being a different issue. The size of the building
will probably be smaller, it won't look like a typical
apartment building.
Thornberry/ I don't know about that.
Franklin/ We don't know exactly what that proposal is yet .... more
like a rooming house .... It depends on what they finally come
in with .... Is it going to be individual units or is it rooms
in a facility and we don't know yet. If it is the multiple
bedrooms with common facility, it is going to have to go
through a planned development. Any change there is going to
require quite a bit of scrutiny both by the Commission and the
City council because right now it is zoned, the highest is
duplexes.
Kubby/ Are rooming houses or boarding houses considered multi~
family?
Franklin/ They are not considered multi family units, no. They are
a separate category.
Kubby/ OPDH, we have the ability to have design be part of the

Franklin/ Certainly and to look at different housing types that are
permitted in the zone. That particular project, Dean, I think
would not come under this kind of review.
Norton/
Franklin/ Primarily because it is probably going to be closer to a
rooming house than an apartment building. What we are focusing
on here is apartment buildings, not group living.
Nov/ Is group living or rooming houses allowed anywhere?
Miklo/ Anything after RS-12. I can check°
Franklin/ They are actually not permitted as liberally as one would
think ....
Kubby/
Franklin/ RM-12 it is.
Miklo/ That is correct, it is not allowed in RS-12 or RS-8 or RS-5.
Baker/ Two issues to be resolved tonight. What area are we trying
to protect and if redevelopment occurs, what sort of review
power should the City have?
Franklin/ Yes and .... what are you concerned about .... ?
Norton/ We are certainly concerned with .... compatibility
question .... Compatibility thing is surely one of our concerns
within whatever reasonable approaches we can take with
that ....
Lehman/ I think compatibility is really the big issue.
Kubby/ Isn't density part of that? .... compatibility .... have it in
all areas of town? .....
Franklin/ If you put a compatibility provision in the site plan
review and you may change the threshold for site plan
review .... that then will apply or it can apply any time there
is a structure built with a certain number of units. Right now
we don't have such a provision in the site plan process .... we
don't look at how the building fits in with the

neighborhood ....
Miklo/ ..... wasn't an existing neighborhood to be compatible
with .... You could come up with some general guidelines...
compatibility may not be the issue in new areas so much as
general design concerns.
Thornberry/ I can see this as kind of a way to get design review
into the neighborhoods and I really don't want that ..... I
don't want design review in neighborhoods ..... Another dilemma
is I have been advocating selling City owned houses ..... Where
would you like to have apartment with more bedrooms ....
Baker/ .... Design review regarding multi family dwelling in
established neighborhoods. You might have a problem with
design review .... If you ask these neighborhoods what they
thi~( about design review for their neighbors and their
neighborhood, you will get overwhelming substantial support
for that concept. Especially how multi family units impact on
their neighborhoods.
Thornberry/ .... I firmly wholeheartedly believe in neighborhood
integrity ....
Franklin/ Can you all agree what when you talk about neighborhood
integrity, that two of the issues that pertain to that are the
density of development within the neighborhood and...
appearance of development, how that building fits in?
Council/ Yes.
Franklin/ Okay.
Nov/ This is for established neighborhoods. I don't think you ought
to start writing compatibility into the site plan review of
new neighborhoods° I think it is difficult ....
Norton/ What is an established neighborhood? .....
Franklin/ The College/Summit Street example. Prior to the building
that is going in there now, it was a fraternity house with I
don't know how many occupants° That is not an issue of
density. That is an issue of the mass of the structure, what
it looks like. It is all design issues which can be handled
administratively... it doesn't have to be a long process with
a review board. Those are the issues there on the corner .....

Thornberry/ A neighborhood would be concerned also with the density
of housing within their established neighborhood.

Franklin/ Remember how that zone came about. It was to retain some
property rights in a very large area that was being downzoned
and stabilized ....
Lehman/ Staff review ..o can't come to an agreement between staff
and the developer .... Is there an appeals process? ......
Miklo/ We have three zones where we have a similar procedure for a
review process and the appeal, I believe is to the Board of
Adjustment.
Franklin/ Because it is within zoning.
Baker/ Site review process right now is

Review Ordinance. Design or compatibility is not within the
Site Plan Review Ordinance° What Bob was referring to was in

Miklo/ ..... The design of the building at the time of site plan
approval will need to show that these guidelines are being
met. If the applicant disagrees with staff on whether or not
they are met, then it is appealed to Board of Adjustment.
Baker/ So we need that sort of power in certain kind of residential
zones in established neighborhoods.
Franklin/ That is a possibility.

District. Is that a possibility? .....
Woito/ Is there an appeal process for site plan review?
Thornberry/ If a house... so old it has got to go, then what do you
do? ....

Thornberry/ House ... on Dubuque Road°.° not worth rehabbing ....

Miklo/ I haven't heard anyone propose that this site plan review
ordinance would prohibit someone from removing a building.
Norton/ Separate issue.
Miklo/ .... The Historic Preservation Ordinance would allow the
commission, if there is economic hardship shown, to allow a
historic building to be removed° That is pretty common ....

Kubby/ Our demolition process does not allow midnight demolition
anymore. That you have the seven working day waiting period
but that is where it ends. It just gives notification ....
There is not process for any kind of intervention or any
neighborhood power or City power to say can we find another
solution rather than demolition during that seven days. So we
would have to change that whole process ....
Baker/
Thornberry/ Sometimes it is a whole less expensive to demolish a
building.
Woito/ Ernie, you asked a question about where the appeal was under
the Site Plan Review. There really isn't an appeal. It seems
to me that P/Z wanted to do it one way-

Franklin/ It was the appeal in one of the zones where we review
design administratively, like PRM and CB-5, there you will go
to the Board of Adjustment.
Woito/ I thought you were talking about making an amendment to Site
Plan Review Ordinance and there is no appeal specifically
called out in there and it is a building official that makes
the decision .... It is not explicitly called out.
Kubby/ This other issue of having moratorium of demolition.°. to
say until the conservation zone is established with its
guidelines, that a building can't be demolished ....
Woito/ A moratorium ordinance requires going through the same
process as a regular ordinance. You have to go through P/Z...
p.h .... It is a Zoning Ordinance.
Franklin/ It is not until the council sets the p.h. that the
moratorium begins. Correct?
Kubby/ That is the way of protecting .... guidelines are created for
that neighborhood, the new structure has to follow those
guidelines.
Nov/ Those guidelines could take years ....

Franklin/ As we look at how we are going to deal with these two
issues that you have given us, density and compatibility, look
at the demolition regulations and see if there is something
that can be put in there .....

Thornberry/ Of reconstruction process. If you can put something in
there.°. something that needs to be torn down, is torn down
pending rebuilding, that is when it kicks in as to what can be
built ....
Franklin/ Priorities. You have just given us a new task and we have
the CB-5 on FY97 which is this next month starting as item
#6 .... new work item, they go on the bottom of the list.

Arkins/ Joe is coming to the microphone. At your last meeting you
asked this item be placed on your agenda for discussion .... We
did make a few contacts and Joe can fill you in on this. We
did talk to IDOT .... vendors concerning ...signing... Question
we have for you, if this is something you find desirable, we
sort of need a go ahead. I suspect...round up a group of
Monday Forum folks.. informal committee... budget together ....
It might move faster if we kind of reversed it... d.t. to
highway... IDOT is going to take longer to get approval and we
can make moves internally .... We need your guidance and let us
know what you would like to do ....
Norton/ Things can be submitted to IDOT...
Arkins/ If your interest is moving with some speed... We can do
some positive things... We can do a lot more internally within
our own corporate limits a lot sooner than IDOT ....

policy procedure... now have an area representative... part of
his job is to help expedite some of the initiatives that we

made arrangements for him to talk to Jim Clayton. Lawrence was
very excited... cut red tape, go right to heart of the
matter... interested in working on this project. He gave me
names of different people around the state .... person from
Davenport is actually in charge of the signs .... I think he
might be able to help us... cut through all the letter
writing... Signs on outside of ramp is something that we have
been working on for about three years. We found one vendor who
displaces how many places are available inside the ramp ....

Fowler/ It is the only one we have been able to find that does what
everybody has been wanting for years .... What we need to do is
hook it up to space counter in the ramp°.. only person that we
have been able to find that sells it ....
Nov/ Why couldn't we get someone local to build something like
that?

Kubby/ I like the idea in the ramps, d.t, and on the highway ....
and 'the kiosks as well ..... I am worried about too much
signage .... doesn't go overboard.
Arkins/ We discussed the kiosks... weren't ready to make that
change .... Installing additional signing .... something that
allows folks to be able to identify their location... We
thought would be a pretty good idea. I think the staff is
sensitive to too much signing .... I think we can accommodate
that. We would like to get a theme... where it is consistent
throughout.
Nov/ I have one more concern... I would like us to not ignore
business districts in other areas of town ....
Atkins/ We talked a little bit about that .... we need to make sure
that our other commercial neighborhoods are at least in some
way identified. Right now the effort is d.t. and we will see
how the others go.
Kubby/ Although in our Comp Plan the d.t. is our central business
district...
Vanderhoef/ Other areas may well bring us something of their own
with a request of what they like ....
Norton/ ..... In Europe... all kinds of signs .... I don't think we
should worry about too much signage...can be pleasant.

Thornberry/ We are not a downtown association, we are a City
association .... ~]at are we doing... letting them know where
the CBD is but to the exclusion of all others? Just a
question ....

When you are coming in on Dodge Street... no problem at all
saying south side business district is straight ahead...
realize there is more than one business district ....
Baker/ This particular group have come up with very specific
suggestions and have identified problems .... Other locations
have same concerns... organize and present us with some
options ....

Norton/ ...while we are doing it .... I don't think we ought to let
the best be the enemy of the good .... Ought to get something
done.
Vanderhoef/ We certainly could write a letter to the Chamber, heads
of various areas .... malls .... some of those people and say we
are in the process of reviewing some signage for the City and
if you have some suggestions, we will be happy to look at
them.
Baker/ We have already made a large commitment to the d.t. It is
different .... I don't look at this project as penalizing or
ignoring the other one ....
Lehman/ I would like to see us pursue this... need to identify
other shopping areas .... This is really complete... proceed as
quickly as possible ....

Kubby/ Seems like people want to move ahead with this and explore
other businesses.

Atkins/ We will round the folks up, we will put together a
project ..... starting with central business district .... make
contacts with IDOT. I am hearing you say let's show some
progress on this project sooner than later.

Kubby/ A question for Monday Forum folks, the pictures comparing
Iowa City and Boulder... some of that comes from volunteerism
..... adopt a bed program.. is there a way that we could work
together to infuse some energy into that volunteer effort
again and not just say City, you do it.
Atkins/ They also have a separate taxing district, too, Boulder has
a tax policy. We just operate ours out of the general fund ....
Atkins/ One of the thoughts that we have had on that is .... I have
asked Parks folks to put together possible a contract.. hire
a local landscaping service... planning... maintain it for

Baker/ Is there any interest on the council's part for a separate
taxing district for d.t.?
Atkins/ No, I am not prepared to do it now. I would have to put
something together for you.

tonight and we have some ideas... a partnership, Project
Green..° dot. businesses... very interested in terms of a
partnership .....

shown in this memo are based on current usage ....
elasticity.°. One thing we didn't do is address use of
additional funds in any detail .... no concrete as to where you
wanted to go so that part was left out..° funds going to new
ramp south of Burlington Street, upgrades in existing ramps
that we have and money going to Transit.

To go through and upgrade our elevators, elevators lobbies, to

stairways ..... To go the whole upgrade .... talking close to
$400,000... preliminary figures .... This could vary by the
time we see the final project...

2. Thornberry/ How is pick up coming on storm damage stuff?
Arkins/ .... generally we are in pretty good shape .... spoke with
Terry .... We are done...Have to draw a line somewhere.
3. Thornberry/ Second question is on (cemetery) weekends.
Arkins/ I had Terry park the trucks as he would liks to see
them .... I drove out Saturday to look at them, they should be
moved ..... I spoke with Terry about it. We have extra
employees .... summer... Suggest that we move four vehicles.
There are six there. Two of them are Cemetery, four of them
are Forestry .... I would like to leave the Cemetery vehicles
there because those folks get called... in .... On the weekends
only and for the summer .... makes shuffling of vehicles
easier... June, July, August we would have four of them
moved .... just on the weekends .... Friday night... crews taken
to P/R City Park location and dropped off there .... Is that
okay with you? Okay.

4. Norton/ I had a couple of calls from Nancy Carlson in connection
with some zoning issues on near north side .... I wanted to
make sure that we understand. She is in the duplex, she is
living in one side and they inspect her side as though it were
rented out which seems rather inconsistent with places where
somebody lives in a condo and their condo isn't inspected but
the others they rent are .... Wondered if there is any
consistency there?
Arkins/ I think Doug takes a literal interpretation of the code ....
duplex gets inspected whether it is owner occupied or not...
I understand it is a pretty hard and fast rule and we have
done it that way forever.
Thornberry/ My mother has a house and has an apartment downstairs
with a walkout entrance. The house is labeled...duplex... my
mother's house is inspected ....

Kubby/ I have a question for Dale about the firefighter
contract ..... Has to do with pregnancy leave... about light
duty is someone is pregnant .... Can this employee get light
duty until she actually delivers or does she have to be saving
up vacation time and sick leave in order to work or get some
pay coming in?
Helling/ My recollection of the contract... we don't guarantee
light duty in any case. The philosophy... State Code changed..
requires us .... injured on the job, they are paid out of the
General Fund rather than out of what used to be the Pension
Fund .... If it is an off duty disabling .... we will allow
light duty when light duty is available but we don't guarantee
it.
Kubby/ Is that outlined at all... that light duty is available in
that circumstance ....
Helling/ No. I can go back and check. I think there is a
reference .... avoided making any contractual commitments ....
Kubby/ Trying to make sure that being a firefighter is an option

12. Kubby/ Next question is about the St. Patty's parking garage
and the design of it. Seems like... access to parish hall, to
make sure they have designed such that people can park and not
have to walk around the building to get to the hall.
Arkins/ We can do that. I will show you the sketches .... it is a
very preliminary... color... I will bring them along for
tomorrow night .... Bring them early... prepare them for you.
Waiting to hear what they have to say.
Kubby/ Are we getting away from an idea of a multi-use facility?
Atkins/ No .... We can always reject that later on ....

Kubby/ Issue for Linda.. concern about copper mercury at
wastewater treatment plant and I am glad that we have some
kind of agreement .... updated information.. negotiated with
University about their labs .... What is the source of the
copper mercury that is causing our problems in our water?
Woito/ It is in the Iowa River when it comes into the plant. It is
at threshold level .... that makes our job extremely difficult.
And what the settlement agreement does is gives us time to do
a whole lot of study in terms of sampling, protocol ....
because the sampling protocols get very differing results from
the samples .... which means maybe the water has less mercury
than we think... testing is totally erratic .....

Woito/ Not consistently, no .... They cooperated but it wasn't any
dramatic change and it fluctuates .... There is not good
explanation for it. If you want Dave Elias to report on it, he

back into the river... if we can trace it up stream to some
point source...
Woito/ I think the problems are largely biological, chemical,
laboratory type problems .... technical tools of trying to test
it.

to get 2% of the gubernatorial vote in order to be deemed a
party in Iowa and the Greens are non-political party because

overlap ....
