Consider a motion setting a public hearing for July 16 on a resolution to annex an approximate 80 acre tract located southeast of Sycamore Street and north of the South Wastewater Treatment facility.(ANN96-0001) Miklo/ Our first item is setting a p.h. on the annexation of 80 acres... This was recommended for approval by the P/Z Commission and staff° Miklo/ .... rezoning the same property from County Residential to ID-RS ....in the city. There is actually not a development proposal for the property at this time. Kubby/ Why is there a request to annex if it is going to be zoned interim development? Miklo/ With annexation it makes it easier for us to review the subdivisions .... more timely if they sell the property... only have to go through a rezoning and subdivision process. Nov/ We also have the soccer road on the agenda later. Is this going to affect the design of he soccer road? Miklo/ The soccer road will be on this property. Whether it is annexed or not should not affect the design of the soccer road. Nov/ One time we said that if this was developable, the road would be differently designed than if it was not .... Kubby/ Nov/ I have a feeling the developer is interested ..... Miklo/ It is actually the property owner who is seeking annexation. Kubby/ Easier to sell or put on the market. Norton/ Is this the standard way for it to come in as ID-RS? ..... Miklo/ If there was a developer at hand, they could propose a rezoning of it to a residential or commercial classification. Norton/ Baker/ Could we look at (item #) H ..... h. Public hearing on an ordinance amending the Zoning Chapter by designating 37 properties as Iowa City historic landmarks. Miklo/ ...It is overlay zoning to create landmarks. Doug Russell, chair of Historic Preservation is here. Nov/ This is the actual hearing? Miklo/ Correct. Kubby/ Why doesn't the language of the ordinance actually say what the protection is? Doug Russell/ It is the same as for Historic Districts ..... They are treated the same and districts and landmarks are included in all the paragraphs that talk about regulations. Miklo/ It will be similar to any rezoning ..... Norton/ And the owners have to agree to these things? Russell/ They do not .... there is one who has stated his objection .... Job of the Preservation Commission is to collect the information about the historic merit of these buildings to make a judgement about the nomination and submit it. It does require owner consent in the statute and if the council does not want to overcome the owner's consent and designate, that is a political judgement for the council to make. Vanderhoef/ There was another letter in there that objected .... Thereafter we sent two of our commissioners to meet with Dale .... and talked about how things could have been done differently... Our meeting with Dale answered his concern .... His worry was he didn't want someone to make a subjective judgement about the way his building should appear... I think he came to agree that he would have plenty to say .... I don't really view Dale's letter as a no vote frankly. Vanderhoef/ I view it as I still would like to have my own input ... of whether this would or wouldn't happen .... Russell/ One of the points that you will address in your public meeting tomorrow is owner consent and also the review standards for rehabilitation of historic properties .... Norton/ How is it going legally if you put something on the register over a person's explicit objections? Russell/ The experience of other communities that have done just that is that the zoning has been upheld in the courts .... appropriate action of the government .... view it as not a taking .... Every property... are already regulated .... Lehman/ Most of these properties are very pleased with the designation .... Russell/ I think that is right... overwhelmingly in favor from the people we have heard from. Lehman/ What benefits accrue to the property owner by having this designation. Russell/ Honor .... Two sets of benefits... regulation itself helps the owner preserve the building .... guidance from us .... free advice .... Under the ordinance, if a building permit were to be applied for an exterior change, yes, our guidance would be required. There are some financial benefits .... fewer than we would like. State law allows the Johnson County Board of Supervisors to adopt a tax abatement program .... to abate the property tax on the increased value on a building that accrues from a renovation .... The exact form of the tax abatement has not been determined .... Thornberry/ Say the current owner would request this designation and then they sell the house. Does the subsequent owner .... Russell/ The designation would run with the land... bind the future owner. Nov/ The future owner would be certainly aware of all of the restrictions .... Russell/ Norton/ Have we considered locally any other incentives? ..... Russell/ We have not... we would entertain all possibilities ..... Miklo/ Incentive... building official may waive certain requirements of the Building Code for Historic Buildings. Russell/ Not cash incentive ..... Norton/ Do we have to do anything about the Park House? Russell/ No. I think the landmark designation may encourage the owner to try and preserve it .... Building Official has the authority to order the demolition of a landmark or a non- landmark. Thornberry/ Russell/ The National Register of Historic Places is simply an honorary listing and there is no protection for those buildings .... unless there is federal money to do it. So if the Park House Hotel were to be removed by the IDOT with federal funds, then there would be some review .... Any National Register home owner can tear down their building merely by complying with the demolition permit rules. So the idea of taking these 37 properties already on the National Register is to give them some protection .... from being demolished or from being inappropriately altered without review. Thornberry/ If a tree fell.. would they have to restore it to the original? Russell/ No... if they decided they wanted to restore and they were a landmark and/or in a historic district, they would have to come to us for review ..... Baker/ One of the questions I would like to have answered tomorrow night is in the process of compliance, what happens when the commission and property owner disagree? .... Russell/ I will be glad to have that information° The review standard and process is the same one we have had since 1982 for Historic Districts ..... Kubby/ If a property owner comes in for a demolition permit and the building is in sound physical condition, can the demolition permit be denied? If you would talk about that a little bit tomorrow night .... Russell/ .... I will be glad to address that. Nov/ Doug, lsn t there some rule with the National Register... that they have to be carefully documented and photographed before they are demolished? Russell/ That is right... doesn't stop the demolition ..... In Iowa City.. there have been two National Register properties that have been destroyed... St. Mary's School .... The Close Flax Seed Warehouse .... altered beyond recognition .... it can happen .... Thornberry/ All of these people ...buildings that you have identified...not all of them wish to do this. Is that correct? Russell/ The only one who said don't do this to me is Mr. Glasgow for the Davis Hotel Building on Gilbert and Washington Street .... Baker/ Question for Linda. We are voting on these as one group eventually, not separate votes on each property? Woito/ Well, it is going to be my opinion that I think Bruce Glasgow is entitled to a 3/4 majority vote on his parcel. Baker/ So we will separate out? Woito/ I am not going to try to sandbag somebody .... someone else. Thornberry/ I want to make sure that he is the only one who has said that I don't want to do this. Nov/ I suspect whoever doesn't want it will be here tomorrow night and tell us about it. Russell/ Everyone who is on this list of 37 has gotten written notice of the p.h. of the HP Commission... P/Z Commission... your p.h. tomorrow and Mr. Glasgow is the only one who has appeared and said no or sent a letter to say no and the only one who has filed an objection requiring a super-majority or at least requesting a super-majority. Woito/ Yes, there is a protest and he has the right to do that. Kubby/ .... I am really uncomfortable with the process of silence equals affirmation .... We should make sure that everyone understands that process .... Russell/ The notice of tomorrow's meeting had a page about how to make that protest. So we are trying to give them complete information .... I do believe the packets you received included all of the letters .... that we have received, pro and con and with questions .... Woito/ ...The Haddock House would have been protected under this ordinance .... Thornberry/ I would feel a whole lot more comfortable with a letter from each of the residence saying I would like to do this as opposed to just nothing .... Woito/ You can't force them to do that. Russell/ .... we have tried to give them notice .... Thornberry/ You could also get a statement with a signature saying I really would like to do this because that is what we are doing .... Nov/ .... you could set a precedent .... Miklo/ In terms of getting owner consent or some acknowledgement, this is a rezoning. We have done several neighborhood wide rezonings and we have not required each individual property owner to respond back that they were in favor or against the rezoning ..... So I would like everybody to save the possibility of coming early on July 15 in order to have a joint meeting if they request it .... Kubby/ I think it is a big issue... The P/Z Commission recommended approval of this and so does staff. We will have the p.h. on July 16. d. Consider a motion setting a public hearing for July 16 on an ordinance amending City Cods Title 14, Chapter 6, "Zoning," Article H, "Industrial Zones," to allow trucking terminal facilities as a provisional use in the I-1 zone. Miklo/ Setting p.h. on Code Amendment to allow truck terminals in our industrial zone. This was recommended by P/Z Commission and staff. Kubby/ A P/Z member had been concerned about noise levels of trucks and the response from staff was that noise levels were covered in the Nuisance Chapter of the City Code but our Noise Ordinance is essentially not enforceable, is it? Woito/ Last time I checked, H.I.S. does have a decibel meter reader. Kubby/ When was the last time it was calibrated? .... Would you look into that? Baker/ Woito/ The Nuisance Ordinance deals with something that is unreasonable and offensive to the community. Miklo/ There are also performance standards in the Zoning Ordinance that deal with noise levels for industrial uses .... Kubby/ Could you check into that...? The only thing would be a nuisance .... Kubby/ South Riverside Drive... you call in a noise complaint. The noise has to be happening when the police are there .... It is difficult .... Woito/ You can file a municipal infraction based on citizen complaints .... it is possible. Take your tape recorder. e. Consider a motion setting a public hearing for July 16 on an ordinance amending City Code Title 14, Chapter 6, entitled "Zoning," Article K, entitled "Environmental Regulations," Section 1, entitled "Sensitive Areas Ordinance." Miklo/ Setting p.h. on amendments to the Sensitive Areas Ordinance and we will include the entire ordinance and the proposed amendments in your next packet. f. Consider a motion setting a public hearing for July 16 on an ordinance amending City Code Title 14, Chapter 6, entitled "Zoning," Article O, entitled "Sign Regulations," to delete the specific regulation of "political signs," and to amend regulations applicable to all temporary signs, including political signs. Miklo/ Setting a p.h. on an amendment to the sign regulations regarding political signs. Again, we will have that material in your next packet. g. Consider a motion setting a public hearing for July 16 on an ordinance amending City Code Title 14, Chapter 6, entitled "Zoning," Article E, entitled "Commercial and Business Zones," Section 1, entitled "Commercial Office Zone (CO-l)," to allow small-animal clinics in the CO-1 zone by special exception. Public hearing on an ordinance amending the Zoning Chapter by rezoning the following properties owned by The University of Iowa to P, Public: 1 Eo Park Road (RNC-20), 234 N. Madison Street (RM-44), northwest corner of Dubuque and Church Streets (RM-44), 230 N. Clinton Street (PRM), 324 S. Miklo/ Some of these properties are currently being used for rental... majority are being used for University related activities at this point. Vanderhoef/ I would like to know which ones are not being used for University activities. Miklo/ I will attempt to have that. Kubby/ What does that information bring? Vanderhoef/ I question taking some properties off of the tax rolls .... Curious as to how many properties are off tax rolls and being used for housing°.. competing kinds of activities for private owners in the city. Kubby/ / I have a list of University properties that are rentals, if you want that list .... j. Public hearing on an ordinance amending the zoning Chapter by amending the Conditional Zoning Agreement for WestPort Plaza to eliminate the requirement for a "cohesive, integrated development,,, and to remove the requirement for the facades of the buildings to provide "horizontal continuity," for property located in the CC-2, Community Commercial zone at 855 Highway 1 West. (REZ96-0010) Miklo/ P.ho on amendment to the CZA for Westport Plaza... recommended against by both staff and the P/Z Commission. The applicant now, Stable, Inc., would like to amend the CZA to remove the requirement that this be a shopping center connecting the two anchor stores and additional parking be allowed ..... (refers to overhead projection) .... There is a private covenant on the property that requires more parking than the city requires and it may be more difficult to develop the shopping center concept as originally promised to the city ..... Nov/ There is some very small print there below the Wal-Mart Building .... I can't read it here .... Miklo/ That is an area for future expansion of the Wal-Mart Store, currently a garden area. Nov/ Instead of smaller stores, they have reserved that for future Wal-Mart. Wotto/ I think there is a legitimate question about whether Wal-Mart can unilaterally change that CZA ..... Miklo/ They haven't changed the CZA. They put on a restrictive covenant- Woito/ Well, they have in essence change it. There is not way- Kubby/ Woito/ The way they have done the restrictive covenant, you can't carry out the purpose and intent of our original CZA. Miklo/ Is there a legal remedy for that? Woito/ Yes. Nov/ That so called reserve area was suppose to be small stores. Woito/ They basically preempted anything from coming in there which completely breaches the CZA. Kubby/ We spent a lot of time on this in '89 ..... If it is true that the private restrictive covenants is not allowing us to live out that negotiated agreement, I guess I would like to see that on paper, see what our remedies are .... Nov/ Woito/ Nov/ If they purchased with the CZA which goes with the land, they are still obligated. Woito/ Exactly, they are. Miklo/ At this point they are asking you to change that CZA. Norton/ The covenant already changes it, doesn't it? Woito/ Yes, that is my opinion. Kubby/ Is there a majority who wants legal staff to look into this? Nov/ I see enough nodding heads, Linda. Consider an ordinance amending the Zoning Chapter by conditionally rezoning a 2.32 acre tract from I-l, Industrial, to CI-1, Intensive Commercial, for property located east of Sunset Street on the south side of Highway 1. (REZ96-0006) (First consideration) Miklo/ First consideration of rezoning property adjacent to Mennards .... no comments received. Consider an ordinance amending the Zoning Chapter by rezoning a 1.79 acre tract from CC2, Community Commercial to OSA/CC2, Sensitive Areas Overlay/Community Commercial Zone and approval of a preliminary Sensitive Areas Development Plan for property located at the intersection of Sturgis Corner Drive and Highway 6. (REZ96-0008) (Pass and adopt) Miklo/ Pass and adopt, the third reading on SensitiveAreas Overlay rezoning of the property on Sturgis Corner. m. Consider a resolution approving a final plat of Saddlebrook, Part l, a 62.59 acre, four-lot residential subdivision, located south of Highway 6 and the Bon Aire Mobile Home Lodge. (SUB95-0028) Miklo/ A resolution concerning the final plat of Saddlebrook, Part n. Consider a resolution approving a final site plan for Saddlebrook, Part 1, Lot 4, a 222-1ot, 40 acre, manufactured housing park, located south of Highway 6 and the Bon Air Mobile Home Lodge. (SUB95-0029) Miklo/ A resolution approving the manufactured housing site plan for two of the lots on that development. You have an overhead illustrating the development and I would like to point out some of the issues that came before P/Z Commission. (Refers to overhead projection) .... The original preliminary plat included a much larger area than what we are final platting at this point. The final plat includes four lots ..... This is lot 1, 2, 3, and 4. On lot 3 and lot 4 there is a proposal for the manufactured housing park. You have a detailed plan in your packet of that. At issue.°. frontage road .... this case the applicant has proposed leaving that out of the final plat and platting that at a later date when these other areas are platted... raises a concern about when and how that street is built .... to assure that when there is need for it, that there are funds to build it .... No financial incentive to complete this portion of the street (refers to map) ..... It is the same land owner at this time ..... Concern is the city may be asked to build this portion of the street. For that reason we are proposing an escrow. The applicant has proposed a legal agreement that would bind the future property owner to build that before any further construction could occur to the south. Another issue has to do with the sidewalks on Saddlebrook Parkway here (refers to map)°.. Heinz Road .... In this case, because the streets aren't being built, it doesn't make sense to build the sidewalks .... required developed to place the Thisrepresents only areasonably accurate ~anscription of thelowa City council meeting of July 1, 1996. WS070196 July 1, 1996 Council Work Session Page 14 sidewalk funds in an escrow. The applicant is proposing a legal agreement saying they would do that. Third issue was construction of the sidewalk on Heinz Road. Approval of this development will allow 222 mobile home ..... relatively short period of time .... closest bus stop is in this area (refers to map). We are proposing that the sidewalk be built at this time so the route to bus stop... on a sidewalk .... There would be some distance that would not have a sidewalk .... Our concern pedestrians.. would be using the street. So those are the three issues at hand .... Kubby/ Is staff and P/Z requesting a sidewalk along Highway 6? Miklo/ It would only be on the portion of the property adjacent to Highway 6 .... Jeff Davidson/ We have a long range plan .... to eventually extend sidewalks along Highway 6 ..... in the CIP .... Norton/ You have asked before in situation like this for the escrow payment, not just the legal paper? Miklo/ Right .... example... subdivision now occurring on Sycamore Street. Those developers are paying funds into an escrow account .... funds available for the sidewalk .... Woito/ We also did it on Melrose Avenue West for Walnut Ridge .... Norton/ Miklo/ Typically with a subdivision this would be platted at the same time. In this case the applicant is proposing°.. to final plat only a portion of what was preliminary platted. Kubby/ Is it lot 3 that is to the east of Heinz Road? Miklo/ (Refers to map). That is zoned manufactured housing. Kubby/ In the future, how is that portion of the property adjacent to Heinz Road going to be able to justify the cost of Heinz Road? ..... What about flexibility of how the escrow funds are made available? .... Miklo/ There are different methods of establishing an escrow .... none of them seem to be satisfactory to the applicant. Woito/ You have that option since it was in the preliminary plat. Nov/ Delay of the road does not seem to be justified. Kubby/ If this mobile home park was going to be less than like a Modern Manor... my sense... upscale mobile home park. Miklo/ One of the concerns expressed by the developer that placing the funds in escrow or building these sidewalks is going to add cost to the development ..... more difficult for them to produce affordable housing .... Kubby/ .... I would like to see those comparisons .... I have no information. Miklo/ That is something the applicant may be able to present to you tomorrow night is what these escrows are going to add to the- Kubby/ I would request the developer provide us with that kind of information... ballpark figures. Nov/ If this road is built five years later ..... CHANGE TAPE TO REEL 96-75 SIDE 2 Miklo/ The obligation would not necessarily be on the residences of this development. It would be on the future residences of future phases. Lehman/ If the owner sold .... Miklo/ Thornberry/ It would still be up to the developer to put in the sidewalks regardless of who pays for it ..... Is that right? Lehman/ Thornberry/ Once you have got an income coming in from the property... it will be easier to do... I am looking for lot 1, 2, 3, 4. I don't see lot 5. Miklo/ (Refers to map) .... They have chosen to plat only a portion of that that was approved as a preliminary .... Vanderhoef/ How much further south is that parkway coming in from there? .... Miklo (Refers to map). It is several hundred feet ..... Once you are a commissioner, you are always a commissioner .... I would just like to report on two new items that were both in the memo that I sent to you... We have met with school officials and they have indeed indicated that they are not in a position to contribute financially to this project. They are, however, very supportive of it .... They have been really quite good about using facilities and so fourth... Their programs are growing just like ours .... We also met with the professional fundraising consultant .... We are impressed by him... found him to be highly recommended ..... There is one portion of my memo that I would like to clarify a bit and that is the last statement, bottom of the first page where it indicates that we cannot embark on a fundraising campaign without council's commitment to support the overall financing package and future operating costs. Now that is true but I should have explained.. What we are here for now is basically what this consultant would call the pre-campaign or the feasibility study. What we really need is an indication from council that you can be supportive of the overall project. However, if we went so far as to enter into an agreement with this particular consultant, what he comes back to us with-The bottom line is whether or not there is community support out there for this project and whether or not the amount of money that we are seeking to raise privately can indeed be raised. Kubby/ Did you look at all the other private fundraising issues the community is going to be asked to look at? ..... Trueblood/ Yes, I am sure he would hear about those as he meets with people. One of the tasks is to identify X number of community leaders, potential large gift donors and that sort of thing .... Bottom line here is if we were to enter this contract, if he were to come back and say there is not support for this project out there .... then of course that would end it right there or at least put a delay on it .... If he came back and said there is tremendous support for this in the community, we can raise $300,000 .... that is really the official time that we would need council to say go for it. right now you would be giving an indication that yes you are supportive of the project if we go this far .... Other thing that concerns me... you don't have a lot of extra bucks .... With our parkland dedication .... I don't know how we can afford to maintain another... You are looking at estimated operating costs of $150,000 a year not including the payback of $1/2 million and revenue of $60,000-75,000 .... Nov/ The payback is the entire thing. So it is just a kind of thing the public might very well support a small project like this but be afraid to vote for it because of all the other things they keep hearing about ..... competition for the referendum dollar that is out there .... does frighten us a bit. Kubby/ With the $500,000 borrowed from other city sources be paid back via General Fund? We couldn't go through the Debt Service Levy, could we? Atkins/ The $700,000 clearly the Debt Service Levy would cover that... If you borrow from the Parkland Acquisition Fund ..... you could redirect that for a period for time .... If you wish to completely replenish that account, then you would be paying it back right now from the General Fund. If you choose to pay only a portion of it back, you would have to go back to your commission, I think, and get a recommendation from them .... Generally that schedule is not that far off that you have laid out there. Baker/ All those gyrations are designed to avoid a referendum .... Atkins/ The direction that I received was that they choose not to go to referendum .... their policy decision .... Baker/ Even paying the capital cost, my question always is where are you going to get the $75,000? Atkins/ $75,000 becomes a General Fund expense .....
