CONSIDER A MOTION SETTING A PUBLIC HEARING FOR JULY 2, '1996, ON AN ORDINANCE AMENDING TITLE III, "CITY FINANCES, TAXATION AND FEES," THE SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES AND PENALTIES OF THE CITY CODE OF IOWA CITY, IOWA. Comment: This public headng is being set to allow public input on the proposed increases in on- and off-street parking fees. The specific fees to be increased are all parking meters, the Swan and Dubuque Street parking ramps, and reserved spaces for contractors. Comment: This project involves construction of a force, main and gravity sewer to connect the new landfill lift station to the sanitary sewer system of Iowa City for treatment of the landfill leachate. The estimated cost of $350,000 will be funded by landfill revenues. CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR ~UfiE 1'1, '1996, ONPLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR CONSTRUCTION OF THE SOCCER SITE ACCESS ROAD PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will provide access from Sycamore Street to the Soccer Facility at the South Wastewater Treatment Plant as required by agreement between the City of Iowa City and Johnson County. The preliminary cost estimate for this project is $190,000 and will be funded by Road Use Tax revenues. d. Permit Motions and Resolutions as Recommended by the City.Clerk. (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING A SECOND MORTGAGE AND A PROMISSORY NOTE FOR THE PROPERTY LOCATED AT 1327 FIRST AVENUE (SYCAMORE VIEW), IOWA CITY, IOWA. Comment: The owner of the property located at 1327 First Avenue (Sycamore View) received financing from the City on May 1, 1991. The financing was in the form of a second mortgage and a promissory note for the amount of $13,000. The owner sold the property to a low-income household who can afford the home without the second mortgage, and the note was paid off May 29, 1996; thus, the lien can now be released. Comment: The owner of the property located at 718 Walnut Street received a $11,065 loan through the City's Housing Rehabilitation Program on August 26, 1991. The financing was in the form of a Rehabilitation Agreement, a Promissory Note and a Mortgage. The balance of the note was paid off on May 30, 1996; thus, the lien can now be released. (3) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING A REHABILITATION AGREEMENT AND A NO INTEREST LIFE LIEN FOR PROPERTY LOCATED AT 51'1 SOUTH DODGE STREET, IOWA CITY, IOWA. Comment: The owner of the property located at 511 South Dodge Street received a $4,570 loan through the City's Housing Rehabilitation Program on July 18, 1991. The financing was in the form of a Rehabilitation Agreement and a no interest Life Lien. The note was paid off on May 30, 1996; thus, the lien can now be released. (4) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE RELEASE OF A LIEN REGARDING A RESALE AGREEMENT AND SECOND MORTGAGE FOR THE PROPERTY LOCATED AT '1109 ' FIFTH AVENUE, IOWA - CITY, IOWA, AND AUTHORIZING THE CITY ATTORNEY STAFF TO DELIVER SAID RELEASE TO THE PROPERTY OWNERS UPON PAYMENT IN FULL OF THE PROPERTY OWNER'S DEBT TO THE CITY Comment: The owner of the property located at 1109 Fifth Avenue, received financing from the City on September 21, 1995. The financing was in the form of a second mortgage and a warranty deed for the amount of $30,000. The owner sold the property to another income eligible household who will be .receiving the same financial arrangement. Page 4 (5) (6) %- /7? ¢) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST A RESALE AGREEMENT FOR THE PROPERTY LOCATED AT 1'109 FIFTH AVENUE, IOWA CITY, IOWA, Comment: The City sold this property to Bradley and Elizabeth Johnson on September 21, 1995, pursuant to the terms of a Resale Agreement wherein the Johnsons agreed that in the event they sold the home, the home would be sold to an income-eligible household approved by the City. The Johnsons have entered into an agreement to sell the home to an income-eligible family. The City will provide the same financing to the new buyers (a second mortgage loan), and they have signed a Resale Agreement on the same terms and conditions as the Resale Agreement between the City and'the Johnsons. CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE OFF-SITE STORM SEWER PUBLIC IMPROVEMENTS FOR BOYRUM SUBDIVISION PART 4. Comment: See Engineer's Report. CONSIDER A RESOLUTION APPROVING AMENDMENT NO, 2 TO THE AGREEMENT BETWEEN MERCY HOSPITAL AND CITY OF IOWA CITY, IOWA, FOR USE OF PUBLIC RIGHT-OF-WAY FOR PLACEMENT OF AN ADDITIONAL TRAFFIC INFORMATION SIGN. Comment: This resolution is an amendment to the original Indemnity Agreement with Mercy Hospital, passed by Resolution No. 84-130, for the placement of. traffic informational signs. This amended indemnity agreement permits Mercy Hospital to place an additional traffic information sign on the south side of Bloomington Street east of Van Buren Street to facilitate traffic to Mercy Hospitars facilities. Comment: See Engineer's Repolt June 11, 1996 City of Iowa City Page 5 (9) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST AMENDMENT NUMBER 1 TO THE AGREEMENT BE'P~EEN THE CITY OF IOWA CITY AND THE UNIVERSITY OF IOWA FOR USE OF THE SILURIAN WATER WELLS AT BURGE HALL. Comment: The City has for the past five years been using the two Siludan Wells at Burge Hall to supplement the City's raw water supply to reduce the negative impacts associated with the use of Iowa River water. The written agreement for use of these Wells by the City expires July 31, 1996. This amendment number 1 extends the City's use for another five years. Nov/ Moved by Norton, seconded by Kubby. Discussion. Baker/ Yeah, Madam Mayor, I would like to call the public's attention to one of the things that we are approving on the Consent Calendar tonight. Lane Wyrick is gathering signatures for a petition to move the fire works, 4th of July fire works from the Iowa City Airport back to City Park and he will be in the City Plaza area on June 28th and we are probably not going to be able to do it this year but if you are interested in that particular issue of moving the fire works display back to City Park, look for him down on the Plaza June 28. Nov/ Any other discussion? Kubby/ Yes, on page 2, item #2, about the lift station at the landfill. Someone had brought up at our meeting with Coralville and the county about a new road, suggesting that maybe we should have the lift station be sized bigger than we need it for the landfill to accommodate future growth and I don't know. We have never really talked about that and I know that we are just setting p.h. but things are pretty well designed already. I guess I would like to hear from the engineers and from Planning to see if that is a decent idea for kind of looking forward. Atkins/ I can't answer that for you tonight but I can certainly talk to staff tomorrow and have a memorandum prepared on that issue. I suspect it is- Kubby/ Are there people interested in that? Atkins/ I suspect it is oversized in the sense of just capacity for the future with respect to the operation of the landfill. Nov/ The last time we discussed this, this capital improvement, we decided to not accommodate growth beyond the City limits. Norton/ That depends on where the road is a little. Atkins/ Let me have something prepared that summarizes the issues for you. We will have it prior to the 2nd. Kubby/ Okay. F061196 #3 Consent Calendar page was. In 1990 when we built Sycamore View, the houses across the street from Southeast Junior High. We did that as a City project and sold those homes to people of lower income and our hope was that if someone wanted to sell the home before a certain period of time that they would then sell it to another low income household and the first house is being sold and it is indeed being sold to another low income household. So we had this vision, we had this plan and it is actually happening and I think that is a real positive thing. Nov/ And this particular sale did not have a clause requiring that we approve the next owner. Some have had but this one did not happen that way. Will it have (can't hear) on the new owner? Woito/ Yes, it is in there now. Nov/ As part of this we are setting two p.h.s, both on July 2. One is listed for June 11 but obviously that is a typo. There is a resolution setting a p.h. on July on plans and specifications and contracts for this lift station at the landfill and there is another on the access road to the soccer site. ITEM NO. 5 PLANNING AND ZONING MA'FI'ERS. eo Consider a motion setting a public hearing for Juiy 2 on an ordinance amending the Zoning Chapter by amending the Conditional Zoning Agreement for WestPort Plaza to'elim. inate the requirement for a "cohesive, integrated development," and to remove the requirement for the facades of the buildings to provide "horizontal continuity," for property located in the CC-2, Community Commercial zone at 855 Highway 1 West. (REZ96-0010) Comment: At its May 2 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended denial of the proposed amendments to the WestPort Plaza Conditional Zoning Agreement. The Commission's recommendation is consistent with the staff recommendation. In a letter dated May 29, 1996, the applicant (Staples, Inc.) requests Council consideration of this item. Public hearing on an ordinance amending the Zoning Chapter by conditionally rezoning a 2.32 acre tract from I-1, Industrial, to C1-1, Intensive Commercial, for property located east of Sunset Street on the south side of Highway 1, (REZ96-0006) ~'//z2~ ~-~ Comment: At its May 2 meeting, by a vote of 6-0, the Planning and. Please sign in and state your name and limit your comments to no more than five minutes. RufineAnciaux/ Hello everybody. I have kind of had a lot of Senior Center activities today and so has Steve. So I will make this short. I am Rufine Anciaux and I am a Senior Center Commissioner and we report to you, try to report to you once a month. The big thing was the meeting this afternoon. We had a town meeting at the Senior Center to discuss issues and interests of all people who wanted to come and be heard. And they came and they were heard and there were a lot of them and they had a lot of good things to say and lots of comment and really was kind of enjoyable. Karen was there, too, so she can tell you. We don't have a lot of activities scheduled for the next month or so because our acting director is also the program director. So it doesn't leave her much time for that. So I think our next big thing will be our birthday party in September and you all keep that in mind and you come and participate in that. We don't have a date set yet for it and we don't have the activities we are going to have but we are planning it. We are going to have a big bash. And thank you very much. (REZ96-0008) (Second consideration) ~c~.~..~,..2 Comment: At its April 18 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the proposed rezoning and Sensitive Areas Development Plan. The Commission's recommendation is consistent with staff recommendation cited in the staff memorandum dated Apd118. Action: ITEIVI NO. 6 CONSIDER A RESOLUTION DIRECTING THE ACCEPTANCE ¢~= A PROPOSAL TO PURCHASE $295,000 GENERAL OBLIGATION CAPITAL LOAN NOTES, SERIES 1996, Comment: Proposals on the sale of these notes were received at 12:00 noon on June 11, 1996. Note proceeds will be used to pay a portion of the cost of a new fire truck (t~120,000) and the lighting project at the University of Iowa Softball Complex ($175,000), Property taxes will repay the debt service starting in fiscal year 1998. This resolution ratifies and confirms the actions of the CiW Clerk and the Finance Director in the determination of the most favorable proposal· A completed resolution will be presented to the City Council at the formal meeting the evening of June 11, 1996. RESOLUTION DIRECTING THE ACCEPTANCE OF A $295,000 GENERAL OBLIGATION CAPITAL LOAN Nov/ Moved by Vanderhoef, seconded by Thornberry. Discussion. Kubby/ An incredible interest rate. Very low. Nov/ Yes, very nice one. Kubby/ Is there any analysis as to why the local banks were so much different than the winner? Atkins/ Let me see if I can help you out. This type of financial instrument is, the terminology is not bank qualified. When these banks bid on this type of financial instrument, they must keep it in their own portfolio. Dain Bosworth, on the other hand, will bid it and turn around and re-market it. So they will mark it up a little bit. Banks are not permitted to do that. So therefore, automatically, their interest rates are going to be a little bit higher or a lot higher. Kubby/ Does that create any more risks or-? Atkins/ Yeah, it is a riskier type of investment. For the size of investment given everything, I was somewhat surprised the banks didn't come in with a little lower interest rate than that. As you can see, Dain really- Kubb¥/ Blew them out of the water. Atkins/ Yeah. There was 200 basis points between the two. ~o full percentage points. Kubby/ That is good for the City. Atkins/ Yes, it is. Nov/ And we should explain that some of this money will be used to help pay for a new fire truck and some of it will be used to help pay for the University of Iowa softball complex lighting project. F051196 June 11, 1§96 City of iowa City Pago 8 -ITEM NO. 7 CONSIDER A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CONTRACTS FOR VARIOUS PURCHASES IN ACCORDANCE WITH TIlE ANNUAL OPERATING BUDGET, CONTRACTS FOR PUBLIC IMPROVEMENTS WHEN THE TOTAL COST OF SUCH PUBLIC IMPROVEMENT DOES NOT EXCEED THE SUM OF $25,000, AND FOR PROFESSIONAL SERVICES WHEN THE TOTAL COST OF SUCH SERVICES DOES NOT EXCEED $50,000. Comment: This resolution clarifies the language in Resolution 85-366 regarding the authority of the City Manager to enter into contracts for services in accordance with the annual operating budget. This .resolution clarifies that the Ci~ Council intends to grant authorization to the City Manager to sign general service contracts approved during the budget process (e.g. uniform maintenance) without further City Council approval and also that the City Manager is authorized to execute professional service contracts (e.g. engineering) up to $50,000. Staff memorandum is included in Council packet. Action: ~;~ //,/~~ ITEM NO, 8 CONSIDER A RESOLUTION AUTHORIZING CONSTRUCTION AT THE IOWA CITY MUNICIPAL AIRPORT OF A t00' X 100' HANGAR BUILDING WITH A 20' X 40' ATTACHED OFFICE AREA. Comment: Atthe May 10, 1996, Airport Commission meeting, the Commission voted to request Council financial assistance to construct additional hangar space at the Airport. The aircraft hangar would be 100' by 100' with a 75' door and room for three to four corporate aircraft The Commission received three bids for the project. The bids are listed below. The Commission recommends accepting the bid from Henningsen Co'~struction of $356,900. Hangar rental would be used to repay an internal oepartmental loan. This item has been deferred from May 21 and June 4. Mid-America Construction Modern Builders Inc. Henningsen Construction Action: $437,900.00 $428,850.00 $356,900.00 #8 page ITEM NO.8 CONSIDER A RESOLUTION AUTHORIZING CONSTRUCTION AT THE IOWA CITY MUNICIPAL AIRPORT OF A 100' X 100' HANGkR BUILDING WITH A 20' X 40' ATTACHED OFFICE AREA. Nov/ And the Airport Commission has requested a deferral to July. Thornberry/ Request to defer to July 2? Nov/ Yes. Okay. Moved by Thornberry, seconded by Lehman. Any Discussion? Kubby/ Dean, last night you had said that you wouldn't want to defer it again? Thornberry/ No, I wouldn't. We deferred this 2m3 times now and I think that if they don't get a signed lease between now and July 2, I think it is sort of a moot point. We shouldn't keep it on the books any longer and they would need to go out for re-bid in all probability anyway. So there are other things that could be done out there that I would just as soon not see this hang any longer. Kubby/ You want to see this hangar hanging. Nov/ I think the Airport Commission feels the same way. If they don't get the contract in order by July 2, they are probably ready to drop it. Norton/ Didn't their bid disappear today anyhow? Was this the last day? Nov/ They have an extension. Atkins/ That is what I had understood. They got another extension. Kubby/ I guess I would feel the same way as Dean. Unless there is some extenuating circumstances that, you know, within two days, their head guy is going to come in here and sign the papers or something. F061196 $uoe 1~, 1996 Page ITEM NO. 9 CONSIDER A RESOLUTION AUTHORIZING AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE IOWA CITY ASSOCIATION OF PROFESSIONAL FIREFIGHTERS, IAFF, AFL-CIO, LOCAL #610, TO BE EFFECTIVE JULY '1, '1996, THROUGH JUNE 30, 1997. Comment: This agreement provides for a 2.8% across-the-board wage increase with acknowledgment that this wage settlement is lower than the prevailing rate based on a non-contractual commitment by the Fire Department Administration to modify the scheduling of duties on ho!idays. Other changes affect operations but have little or no economic impact. Staff recommends adoption of this resolution. ITEM NO. RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY FOR PAPATRANSIT SERVICE DURING THE FIRST SIX MONTHS OF FY97. Comment: This agreement will continue the provision of paratransit service within the City of Iowa City by Johnson County SEATS for the first six months of FY97. The six-month contract is proposed to allow time to evaluate changes made to the certification process for persons with disabilities to use paratransit service within the City of iowa City. It is believed the certification changes may result in demand for fewer paratransit vehicles, which would be implemented during the last six months of FY97. If no change in demand is noted, the existing number of vehicles will be maintained. The proposed monthly contract rate is a 26% increase from the existing monthly rate. Johnson County has stated the monthly rate is based on the actual cost of providing paratransit service within the CiW of Iowa City. #10 page 1 ITEM NO.10 RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY FOR PARATRANSIT SERVICE DURING THE FIRST SIX MONTHS OF FY97. Woito/ The changes were made according to what you requested by they were not distributed and I was just making sure that they included your changes. Nov/ Okay, we need a motion. Tonight this council is approving the engineering contract for this street design and I understand the agreement that has been negotiated up to this point for the entire Melrose Project. However, it is interesting to me that the west end of this road is presently being widened to four lanes. The west end is presumably a less congested and less highly traveled area than the east end of Melrose near the University sports and health complexes. This section of Melrose is being designed as a three lane road. In my assessment, this plan certainly is not visionary or serving to the Iowa City community in the long range. I foresee even greater daily traffic to the hospital as more and more out patient visits are made. I don't see University athletics diminishing, University closing or the student population diminishing appreciably at least. As the new sewer trunk lines are extended to the west to serve new growth, there will necessarily be more people to move on the streets of Iowa City. Melrose is and should be a major east west arterial that connects the east and west sides of the Iowa River. Even the connecting Burlington Street bridge is four lanes plus right and left hand turn lanes. At the present time the City has two east west arterials that are state and federal highways, Hwy 1 and Hwy 6, that carry through traffic as well as local traffic and only Benton Street is the other local west side through street. It is probably equally as busy as Melrose. I have serious concerns about police and fire protection in the hospital sports area as more and more building continues on the west campus and accessibility is squeezed on the north avenue Iowa Avenue extension of Newton Road° The original goals for Melrose Avenue improvement project were listed as #1 Improve the ability of motorists, pedestrians and bicyclists to use Melrose Avenue with a higher degree of safety. This includes both through movements and movements from intersecting streets. #2 Improve the ability of Melrose Avenue to function as a major transportation link while being sensitive to the residential neighborhoods along the south side of Melrose Avenue. Many of these houses are owned by the University. #3 To provide improved access to major traffic generators. #4 To upgrade the existing deteriorating Melrose Avenue Bridge and #5 To provide facilities which are in Thlsrepresents only a reasonably accuratetranscription ofthelowa Ci~ councllmeetlng ofJune11,1996. F061196 #12 page 2 compliance with the American Disabilities Act regulations. Justification for the three lane plans talks about improvement. Anything would be an improvement for the present street. I assess the three lane configuration as minimal and would have supported the five land alternative which would serve not only the present but the 25 year life span of the street itself. By the engineer's estimate in the January 1996 Project Plans for an additional $135,000 the five land design could have been done. Added onto a $2.3 million project, I find that an acceptable expenditure of my tax dollars for a project that will serve the community for 25 years. For me doing anything less than five lanes is not being fiscally responsible to the people who elected me. I took a similar stand on the First Avenue Widening Project in my neighborhood and I choose not to do anything less in another neighborhood. I am not into reinventing the Melrose Plan at this time or into spending another $500,000 and three years to get his project planned and moving forward. It is something the University had requested and in looking at the pros and cons between three and four, it was felt that over a long period of time that none of the options-Like we had, I think, seven options, and none of them singly would take care of capacity problems in the future. And so we began looking at the difference between three and four and looking at safety factors versus capacity and came to the conclusion that three lanes was the best option for the community in this part of the project. It may be that we need to do something else with the different road somewhere else to help alleviate capacity problems in the future and we would need to do that whether we did a three or four lane in my mind. Vanderhoef/ I would just like to say tha~ the difference between the three and four lane is exactly the same dimensions, it is just the way that it is striped and is foreseen as usage with a pull off for buses and bicycling. So where I moved from the four lane to the five land was to the difference in the dollar amount that said we can go ahead and provide complete turn lanes and four lanes moving forward at that cost. So three and four lanes or alternative three and four was the same price. Norton/ It seems to me we went through this argument some time ago and looked at the question of how much front yard it would take and what would happen with the short accesses, the number of access in the neighborhood and where it was going on the east end. It was kind of pinching there in any event and of course, University Hts. is very interested in only three. So a whole lot of factors led us to that decision, not just- I don't think it was cavalierly done. That is my point. Arkins/ While Dan is coming to the microphone, as I recall, the basic problem was the project had two elements: sanitary sewer and storm sewer. And the storm sewer component was beyond our engineering estimates and I assume, Dan, we made an attempt to split the contract. In other words, negotiate with the lower bidder who chose not to do that. Therefore it just seemed a lot cleaner to reject the bids, go back out for the sanitary sewer, allow Dan and the folks to go back on the storm sewer. We also then can incorporate, you remember a couple of meetings ago the folks that come in from Abbey Lane, we can incorporate some of that thinking into a new design. Does that pretty well summarize it? Dan Scott/ Yeah, that is correct. Kubby/ So is there something about how we design the storm sewer part of it that was too complicated or what was about it that made it more expensive than we thought? Scott/ Okay, well, I think there are several issues here. One is we have had some wet weather here lately that has caused a backlog of work for the contractors in the area and therefore they are pretty busy right now and they can't really take on anymore work and also this area is, itself, located in a rather wet area. So it is going to be even more difficult to access the site. So those two things have combined to really increase the prices. Kubby/ The other reason for combining them is that you tear up the land, you disrupt that area once and then you can rehab it and get a park going. Now we are saying we are not going to do that because of money. Nov/ We moved the sanitary sewer into the street in front of the houses instead of backyards. Kubby/ So that it is more feasibly two separate projects. Okay. Norton/ If you incorporate still another aspect because the folks were in here showing us the water recently in the backyard. You try to deal with that then the project is going to get larger somewhat I take it. Atkins/ Well, my understanding that there is a potential the project could get larger but then, on the other hand, it allows them time to evaluate and they may be something we can do upstream with respect to detention basin somewhere else that may help slow down that water coming down. I just don't think Dan and the guys have really had time to decide how best to do that. It is disappointing because of the bid. The sanitary sewer we certainly have to get done. But the folks in the neighborhood have waited a long time at Kiwanis Park and we have kind of been anxious to get this project moving. We are disappointed in it but given the set of circumstances I think we are probably better off waiting and we will spend some time to make sure they know what and why we do what we did. Nov/ And the park design hasn't been finalized. I suppose some of the park rehabilitation and the- could be tied in the same contract. Comment: In 1994 and 1995, James Glasgow filed three lawsuits against the City of Iowa City, challenging the Iowa City Water Supply and Treatment Facility Project. Also during this time, the City condemned Jim Glasgow's property, located near Butler Bridge, and both the City and GlaSgow appealed the condemnation award. Lastly, in 1995 the City filed a quiet title action concerning the 5 acres surrounding Glasgow's condemned land (.45 acres). In an effort to save expenses of prolonged litigation, the parties have negotiated a settlement agreement, presented to the City Council in Executive Session. But I want to express my concern, I am sure my colleagues on the council share this° The concern about the incident of racist graffiti in the community that apparently has been reported and I applaud the efforts of the Human Rights Commission to help the community to respond appropriately to try to preclude the future incidence of that kind. I am not saying it happens everywhere, we are not immune for that kind of thing. But we need to do everything we can to try to head it off° To deal with it if it happens. Nov/ Our Human Rights Commission is working. Kubby/ I had two events I wanted to remind people of and then a question. The first event is happening June 15th, this Saturday and it is the Lesbigay Pride Parade and there is actually a whole list of gay pride activities this week and I don't have a schedule of all of them. I forgot to bring them. If you haven't gone to the talent show, you shouldn't miss it. It is a wonderful showing of a lot of great talent in this community and it is a lot of fun. The parade starts about noon and if you don't want to be in the parade, you can show lots of support by standing on the sides and clapping as people come by. Nov/ And what day is this? Kubby/ June 15th, it is a Saturday. There will be lots of Arts Fest activities d.t. as well that day. And the second event is happening on June 25th and it is a group called Progressive Johnson County is going to be having a public discussion that is about transit and national transit policies and local policy decisions and future challenges for public transit and that will be in the Iowa City Public Library at 7:00 PMo There will be lots of perspectives from policy makers to funders to possibly drivers and lots of different kinds of riders talking about transit issues. That will be June 25th, 7:00 PM, at ICPLo If you want more detailed information, you can call me. I am in the book. We talked about having a family bus pass, similar to a family swim pass. To try to figure ut a way to configure pricing so that families who choose regularly to ride the bus could do it in a more economical way. That they have kids over five years old, you have to pay for each one of the children which makes it basically impossible for a family of 3, 4, and 5 to go d.t. to dinner on the bus. It just adds to much cost. That it is more economical to drive your car and pay for parking. so, we just didn't bring that up again. Are people interested in trying to find if there is a way to create a family pass for the bus? You second that, Larry, thank you. Baker/ I second that. Norton/ I would think so, too. Nov/ I think we can ask the staff if they have anyway they can figure out how to do that. Atkins/ We will bring something back to you. Thornberry/ I wanted to bring up the fact that I believe the trucks or the Forestry Department will be leaving the cemetery on weekends. Is that correct? Arkins/ You got it. Thornberry/ So I got a call earlier this evening saying that the gentleman had another idea on how to do this and it is already done. So, the Forestry trucks will be out of the cemetery on weekends until they find a new home which will be I think next calendar year? Nov/ I have lost track of which year. Atkins/ (Can't hear). Thornberry/ I don't do fiscal years real well. A calendar year. Sometime next calendar year they will have new homes. So that will be a non-issue° Nov/ But the cemetery itself does have a couple trucks which are planning to stay there. Thornberry/ Yes, but they are cemetery trucks. I wanted to mention two other things that I wish I didn't have to but I will. We are close but we are not quite there yet. We are still scheduling over time. And I don't want- Well, it is within 3-5 minutes of overtime. That is real real close but it is not zero overtime and the old saying close enough for government work hasn't not a real good connotation and I would like to see zero overtime scheduled. In a memorandum from the City Manager about the Army Reserve Unit trying to put together a project that would serve as a training exercise to move dirt for the City in a couple of grading projects. We are required to receive certain clearances, one of which is from the area labor organizations before we proceed° The City contacted the union, the union dirt movers, operating engineers, close. And we asked those engineers to sign off so that the Army Reserve Unit could get practice in moving dirt as a training exercise and it would also save the City a lot of money. After discussing the matter the operator engineers union has chosen not to give us that sign off and therefore we will be notifying the Army reserve that we cannot project to serve as a training exercise. Is it a law that the unions will tell us who we can use and who we can't use to move earth on City projects? Atkins/ Federal regulation. Thornberry/ Federal regulations. I love my job here. Kubby/ Are there some other issues in terms of when we decide who we want to move our earth? I mean if we end up having archeological sites we need to move or protect or done in an engineered way. I mean, I certainly want to make sure that the people doing it are doing it according to our engineer's plans and I guess growing up in the Army, some of my thoughts about how the Army does things is not- Even though my dad was a civil engineer in the Army, it wasn't always as efficient or as well done as things could be, especially when they are training. Atkins/ We would have a grading plan and they would have had to follow it. I wasn't concerned about our ability to supervise it. I think what happens is that they have, I think an engineering unit, they have this heavy equipment and it is Just difficult for them to find projects on the scale. They are usually a public project of some kind. It is really rather difficult for them to find that kind of work. F061196 #17 page 5 Kubby/ Can they go to the landfill and practice? Atkins/ That isn't so much dirt moving because we contract out for the excavation of a cell. Most of the landfill work is smashing, not moving. Thornberry/ Maybe if somebody needs a swimming pool dug or something. Arkins/ Their equipment is a lot bigger than that. Yeah, I think they- Thornberry/ It is too bad but that is what makes this job just a little bit frustrating sometimes. That is all I have. Vanderhoef/ Just one thing. I had a call a couple of days ago about a parent that was real concerned about young people playing in the underpass on Pine Street and it just brought to mind that we need to remember that school is out and all the children are there and sidewalks and streets are busy and these kids are kids. Atkins/ Just so you know, I did alert the police and that particular watch will be notified to do the appropriate patrol. A letter went out today to the railroad to advise them and we will also do something through our Neighborhood Services Office to let folks know. The bottom line is that the parents are going to have to stay after the kids because it is a big time dangerous thing that they are doing. Vanderhoef/ It certainly is and the neighborhood associations are available to help with concerns that parents have. So feel free to call the City if you don't know what neighborhood association and who to call in your association. Marsha Klingamon is great to work with. (Can't hear). That is it. Baker/ Three quick things. This is an old issue but I still get phone calls on it. So I thought I would reiterate something that has been said and probably will have to say it over and over again. I am still getting phone calls about complaints about the late increases on cable. I keep pointing out to people that this is something that we have negligible to no control over and that we can sympathize with them and agree with them. But what they are really going to have to do is make some decisions. One, complain to the cable company and beyond. F061196 ~17 page 6 program. What I am telling people is to get the basic basic service. That way you still get this channel and also Channel 9 in Cedar Rapids which is a pretty nice station° A plug for somebody in the audience right now. They are all nice stations but Channel 9 is here. Here is better than most tonight. So you can still get Channel 9 but putting an aerial back on your roof but you cant get us. So keep your basic basic cable. Certainly feel free to complain loudly and vociferously and often. The second thing is I am wondering the next informal meeting, 1st of July, would it be possible on that informal agenda to set aside some time to talk the library before they come back in the middle of July to talk to us if there is a feeling on council that we need to talk more. Maybe put it on the agenda for an informal session. Norton/ I certainly think I don't see how we can avoid it given the time line that is coming up. Baker/ And one of the things I think we obviously all need to be thinking about individually is: is there any question out there unanswered yet that we want them to- the information to bring to us when they come back to us. Operating costs, lease problems, anything like that. What information do we still think we need. I have a list. Woito/ I need that list, Larry. Baker/ Sure. Woito/ Because Eleanor is negotiating with the library. Norton/ How is that list to go to the Board, collectively or individually and what power does it have for us individually? Baker/ Either or. You reminded me, Dee, that I need to point out the Press Citizen. Dee is going to a ~ational .League of Cities Conference in Lithuania and it w~11 be pa~d for by the City and so he will be glad to give you all his receipts when he gets back. Now, final issue. I read a recent editorial in one of the local newspapers about our public housing and I got a couple of phone calls and there was some misconceptions and I don't know if they came out of that editorial or perhaps other discussions or just lack of information in general. That we can disagree philosophical about the City's role in owning public housing. But I want to make sure the public understands that this public housing costs us nothing. It is my understanding, Steve, that there is no local money that bought the housing. There is no local money that goes into the maintaining the housing and the way it is geared now, those will be self sufficient units. Is that correct? Atkins/ There are two basic housing programs we have. One is Certificates and Vouchers, you are familiar with that. There are about 900 families. We own about 100 units, 100 plus. Those 100 units were purchased with federal money as part of federal policy. I mean that money is granted to us. We then rent those units to low income families at the fair market rent also determined by HUDo Those moneys come into the public housing coffer. That helps support the program, moneys are set aside and accumulated for the maintenance of the housing units and it helps pay for the staff. So, you are correct, we don't use our general taxing- Baker/ Local property tax, nothing goes into it. Arkins/ No we do not. No. Thornberry/ There is not tax money generated from that. Thornberry/ The payment is lieu of taxes is not the same as taxes. It is not split the same way. Arkins/ That is correct. It is a lot smaller. Thornberry/ It is a smaller amount. Baker/ Also something to keep in mind, that grant that we just approved, that is money that we spend locally. It will go back into the local economy. Arkins/ Well, if the grant is approved, I am assuming that somebody out there is going to get an order for 25 refrigerators, assuming that will done somewhere in the local economy if we bid those things out. Baker/ Okay, thank you° Thornberry/ Of course, if the people that lived in them was in a regular house, they needed a refrigerator, and there were 25 of them, they would buy them. Kubby/ If I lived in that house and had a landlord that wasn't the City and I needed a new refrigerator, I would go to my landlord to replace the refrigerator. It would not be the tenant's responsibility to replace the refrigerator. Council/ (All talking). Norton/ We have been playing our role in a federal program and there will be a time when that has to be considered depending on the shape and size of that program and what we want to do out of local resources° But we are a part of a federal program and now whether we like that or not, it seems silly not to take advantage of ito But it may not be the right logic to do it forever. On Saturday there was a cornerstone ceremony for the Firefighter's Memorial. This is a state wide firefighter's memorial and it was an interesting cornerstone ceremony done by the Mason's and I had never seen one before. So, I am saying it was a nice ceremony. If anybody has a cornerstone laying ceremony and you are invited, go and watch. The Iowa City Arts Festival is constructing an Arts City this Sunday afternoon at noon. The Art City will have a ribbon cutting. The Mayor is going to be there to cut the ribbon and along with that they are going to release lady bugs. They say the lady bugs are going to dance and everybody here is invited. There will also be music and magic and dancing and puppets all afternoon, starting at 12:00 and finishing at 5:00. So come anytime in the afternoon or come at noon for the ribbon cutting. Also the City of Iowa City still has Census Worker positions available. The testing is scheduled in May and June, I should delete May, shouldn't I. It is an old report. Anyway, there will be testing. The actual work begins on August 29. It will last approximately six weeks. Workers are paid $7.50 an hour plus mileage. The applications for Census Workers are available through the Personnel Department at the City or the Job Service of Iowa and there are three on campus sites.
