CAFE AT 219 IOWA AVE.
Comment: University View Partners, as landowner, and Takanami LLC,
d/b/a as Takanami, as tenant, seek a license agreement for temporary
use of public right-of-way at 219 Iowa Ave., Iowa City, Iowa for a sidewalk
café. City staff has reviewed the plans and specifications and required
submittals and recommends approval of said agreement.

ADOPTING IN LIEU THEREOF A NEW RESOLUTION
ESTABLISHING FEES AND POLICY FOR EXAMINATION OF
PUBLIC RECORDS FOR SERVICES PERFORMED BY THE OFFICE
OF THE CITY CLERK
Comment: Fees have not been changed since 1994 and the resolution
raises the copier costs from 10 cents to 15 cents, and establishes a fee
04 - 101 for faxing copies to $2.50. Staff recommends the adoption.
(3) CONSIDER A RESOLUTION APPROVING AN AGREEMENT
BETWEEN THE CITY OF IOWA CITY AND THE IOWA STATE
DEPARTMENT OF ECONOMIC DEVELOPMENT FOR EMERGENCY
SHELTER GRANTS PROGRAM FUNDING, AND AUTHORIZING THE
MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST THE
SAME.
Comment: The Iowa Department of Economic Development has agreed
to provide the City of Iowa City $81,252 in funding for supportive
services for persons who are homeless. These funds will be used in
FY05 by the following local agencies: Domestic Violence Intervention
Program ($22,500), Shelter House ($32,189), and Table to Table
($22,500). The award also includes $4,063 to reimburse the City for its
expenses in administering this grant. This Emergency Shelter Grants
Program funding represents a decrease of $12,148 in funds from the
FY04 allocation.

REPRESENTED BY A SECOND MORTGAGE AGREEMENT.
Comment: The owners of 2258 Russell Drive, Iowa City, Iowa have
satisfied their obligation to the City of Iowa City in the total amount of
$50,000, represented by a Second Mortgage Agreement and Promissory
Note, by refinancing the property and paying the debt in full. The family
continues to own and occupy the home.

LOCATED AT 1512 DICKENSON LANE FROM ANY LIEN
REPRESENTED BY A SECOND MORTGAGE AGREEMENT.
Comment: The owners of 1615 Dickenson Lane, Iowa City, Iowa have
satisfied their obligation to the City of Iowa City in the total amount of
$57,000, represented by a Second Mortgage Agreement by refinancing
the property and paying the debt in full. The family continues to own and
occupy the home.

Comment: At its April 15 meeting, by a vote of 6-0 (Shannon absent), the
Planning and Zoning Commission recommended approval, subject to a
minimum 1-acre lot size and preservation of an existing landscaped parkway
easement along Northgate Drive. The rezoning would alter the permitted uses
in this portion of Northgate Corporate Park, and would eliminate a 1989
Conditional Zoning Agreement on the property that affected how lots are
developed. Staff recommended approval in a report dated April 15.

Comment: At their May 20 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval subject to approval of legal papers and
construction plans prior to Council consideration. Staff anticipates that legal
papers and construction plans will be been approved prior to June 1. Staff
recommended approval in a report dated May 20. This subdivision is a 21-lot
single-family subdivision at the west end of Langenberg Drive.

ITEM 6. CONSIDER A RESOLUTION APPROVING THE ACQUISITION OF PERMANENT

TRAIL PROJECT, AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST DOCUMENTATION OF THE SAME.
Comment: City Staff intends to extend the Clear Creek Bike Trail along the west side of
Hawkeye Park Road from the current trail end at Prairie Meadow Drive intersection to
Melrose Avenue. To do so, the City will need to acquire a 20-foot wide, .78 acre
permanent trail easement, and a 50-foot wide temporary construction easement, from
the University of Iowa. University Staff has indicated they will grant the easements,
without compensation, and maintain the trail after it is constructed. This resolution
authorizes City staff to proceed with acquisition of the easements.

Comment: This project includes extending the existing Clear Creek Recreation Trail
along Hawkeye Park Drive from the existing University parking lots to Melrose Avenue.
The estimated construction cost is $53,800 and will be funded by General Obligation
bond proceeds.

ITEM 8. APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT AND ESTIMATE
OF COST FOR THE CONSTRUCTION OF THE BENTON HILL PARK
DEVELOPMENT PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO
ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH

Comment: This project will result in the construction of a new 3.5-acre neighborhood
park south of Benton Street and west of Miller Avenue. Several public meetings were
held to gain input from neighborhood residents in the planning process. The estimated
construction cost for this contract is $175,335. Other costs will be incurred as a result
of direct purchases for playground equipment and site furnishings. This project is
financed through GO Bonds.

Comment: At their May 20, 2004 meeting, the Public Art Advisory Committee
recommended, by a vote of 5-0, approval of a Call to Artists for an Iowa artist to
design, fabricate and install an entryway to Benton Hill Park, consistent with the Benton
Hill Park plan. The cost of the project will be $30,000 with $10,000 from the park
improvements budget and $20,000 from allocated public art funds.

Comment: This proposed ordinance will decrease water service charges by 5%. The
decrease is due to the bid for construction of the new water supply and treatment facility
and distribution system being lower than projected. The effective date for billing
reductions will be on or after July 1, 2004.

MAINTENANCE OF A HIGHWAY, BRIDGE OR CULVERT WHEN THE ESTIMATED
TOTAL COST TO THE CITY DOES NOT EXCEED $50,000, CONTRACTS FOR
OTHER PUBLIC IMPROVEMENTS WHEN THE ESTIMATED TOTAL COST TO THE
CITY DOES NOT EXCEED $25,000, AND CONTRACTS FOR PROFESSIONAL

Comment: Based on state law, previous City Council Resolution No. 96-180 authorized
the City Manager to initiate and execute three general types of contracts without City
Council approval: (1) contracts for and purchases of commodities, operating services and
capital outlay in accordance with the Annual Operating Budget, (2) public improvement
contracts in accordance with the Annual Operating Budget where the total estimated
amount does not exceed twenty-five thousand dollars ($25,000), and (3) contracts for
professional services (e.g. engineering, architect) where the total estimated amount does
not exceed fifty thousand dollars ($50,000). State law has since been amended, and
now requires cities to publicly advertise and let for bid public improvement contracts
involving the construction, reconstruction, improvement, or repair or maintenance of a
highway, bridge, or culvert only if the estimated total cost of the contract is in excess of
fifty thousand dollars ($50,000). In accordance with current state law and in addition to
the above-mentioned types of contracts, this resolution authorizes the City Manager to
initiate and execute, without City Council approval and in accordance with the Annual
Operating Budget, public improvement contracts involving the construction,
reconstruction, improvement or repair or maintenance of a highway, bridge or culvert
when the estimated total cost to the city does not exceed $50,000.
