ITEIVi NO. 2- ITEIVi NO. 3 - CONSIDER A MOTION APPROVING A CLASS C LIQUOR LICENSE FOR HIGH ENERGY FOOD CONCEPTS, INC. DBA BUSHNELL'S TURTLE, 127 E. COLLEGE ST. (NEW) Comment: The owners of Bushnell's Turtle currently have a Beer/Wine License for their establishment. As a result of the license change staff is unable to timely file the application with the State and a special meeting was called to approve the new license. Council will be considering the outdoor service area application at the August 6 Council meeting. Staff recommends approval of this license request. Action: CONSIDER '~TION TO ADJOURN SPECIAL MEETING. Woito/ No, but I don't even need to be here. Karr/ No. Thornberry/ But you were in the neighborhood. Council/ (All talking). Nov/ All right, we had a motion. Moved by Baker, seconded by Lehman. Is there any discussion? Thornberry/ Yes. I would like, if it is appropriate, I would like to know who made the complaint? Norton/ Is that public information? Woito/ It is- I don't know. Norton/ You mean about the fence. Woito/ I don't know. Karr/ Doug would know. Woito/ Doug Boothroy would know. Lehman/ It was another business that did. Karr/ It was and I don't know- Woito/ Holiday Inn? Lehman/ No, I think I know but I am not going to say it on tape because I don't know for sure. Karr/ I know who it was. Norton/ Is this the indoor one or the outdoor one, now? Nov/ We are approving a- excuse me, we are approving a new license for indoors at Bushnell's Turtle. They will have no liquor served outdoors until they change something and we will not approve the outdoor service until August 6. Thornberry/ Because their fence is six inches too short. Norton/ I understand that. It may not be quite solid enough. But I thought we were giving them a dispensation of a year to get that together. Lehman/ Well, that comes up the 6th. All we are talking about now is a liquor license. Nov/ We offered them a- Woito/ Inside. Norton/ Okay, we still have the other one pending. Nov/ Not to be decided today. Norton/ Fine. Nov/ Okay, any other discussion? Okay, all in favor, please say aye- (ayes). Motion carries. Lehman/ I have one item. I drove down to Winebrenner this morning and looked at their parking lot and as you remember, when we had that condemnation and damages thing, we talked about mountains of dirt and dirt blowing all over and no access- Woito/ They are hauling it out. Lehman/ That place down there is clean as a whistle. They cut that parking lot. They cut it was a cement saw just as straight as the edge of that envelope there. There is no dirt. They have access to the showroom. The interference with their business is so minimum it is unreal and I understand- Woito/ We are videotaping and we are photographing everything. Woito/ I keep sending self serving letters to Bill Meardon saying gee, we haven't done anything yet. Lehman/ That is incredible what we are doing. Norton/ You are getting this record to appeal the condemnation award or what? Woito/ We did appeal. Norton/ Okay, so this is to back up that appeal. Woito/ It is to reduce the damages substantially. Norton/ They were pretty humongous as I remember. Thornberry/ When this thing first came up I suggested that we pay them after the fact to see what the damages actually were and I guess that couldn't be done. Woito/ Not with condemnation. Lehman/ Anyway, we are doing a beck of a job. Woito/ We are. Tim Randall works real well with that contractor. Thornberry/ One other thing. All of those field girders on the corner of Hwy 6 and Gilbert- Woito/ We are tunneling under the highway, 45 feet down. Thornberry/ And that is- Lehman/ That is to keep it from caving in. Norton/ That is the entrance- Woito/ That is where they go down and- Yucuis/ That is a federal requirement, OSHA. Norton/ What is that? Lining the entrance kind of. Lehman/ So the dirt doesn't cave in. Norton/ They line the entrance and then they tunnel under, yeah. Woito/ Right. Yucuis/ Do you want to go down there, Dean? Thornberry/ Well, Larry Baker just mentioned that he thought it was very attractive. I- Are you going to be part timer Design Review guy? Baker/ I think it is just as attractive as the Coralville work in the pond out at Coralville. Thornberry/ I like Coralville's little slogan. Dig now-what is it? Norton/ Call later. Thornberry/ Call later. You know, it is kind of neat. Kind of catchy. Baker/ Dig now. Vanderhoef/ Dig it now, love it later. Thornberry/ Dig it now, love it later.
