4 a. Consider setting a public hearing for January 17, 1995, on an
amendment of the Comprehensive Plan to change the land use map
designation of property located on the north side of Highway
i West from 8-16 dwelling units per acre to 2-8 dwelling units
per acre and general commercial.
Franklin/ The first few items, A .... F. are to set p.h. on the
Harlocke Weeber issue. The main thing that is difference...is
the rezoning to commercial, extending the Ruppert property ko
the west and then a little bit north so it is in line with the
commercial zoning that is already there on Highway 1. So you
will probably get some public input about that.
Kubby/ There is a condition that the ravine has to stay in i~s
natural state .....
Franklin/ That is right .... Just as it is.
Horow/ ...buffer zone between the east side of Miller being
residential and the west side now being commercial. Right?
Franklin/ No. The commercial zoning that is being discussed is west
of Sobaski's Carpets. Already commercial zoning on Miller
avenue that goes north .... Iowa City Landscaping property.
Horow/ Does this go farther north?
Franklin/ No. It is to the west of that commercial that is already
there ..... abuts the Buss property...comments from Mr. Busse.
Kubby/ Can we see ... a transparency that has outlined the current
zoning and where the new commercial zone will be.
Franklin/ Yeah, sure.
Kubby/ ...around Miller Street...concerns of neighbors about moving
north....
Franklin/ It doesn't go farther north up Miller....Hudson was the
big concern.
Horow/ I couldn't conceptualize where the Buss property was.

Franklin/ Set p.h. on 17th for an ordinance...to rezone the
property that is owned by the county and was used for the
ambulance service for some period of time and now it is used
for storageo..should have been zoned P.
Kubby/ That is the storage building for the sheriff's office.

Kubby/ Someone had a concern about the aesthetics about the metal
building ....

Franklin/ It has to be zoned P ..... and it is next to the RR tracks
and Utility substation.
Kubby/ Lots of residential right across the street .....

4 h. Public hearing on a resolution to annex an 80 acre tract of
land, for a project known as the Greenview Manufactured
Housing Park, located southeast of Sycamore Street and east of
the Pleasant Valley Golf Course. (ANN94-O007)
Franklin/ P.h. on resolutlon to annex-the 80 acre tract of
land...Greenview Manufactured Housing Park. Not the annexing
but the rezoning is going to require 6 out of 7 votes because
there has been a protest. We also will probably want to
continue the p.h. on the rezoning and I think therefore on the
annexation also to get the signatures of all the Langenbergs
on the conditional zoning agreement. So we will want to
continue that to the 17th and put consideration on the 17th so
we can meet the same schedule if you want.

Franklin/ I would continue both of them, H. and I.
Kubby/ I had requested...condition #11 be that we have a signed
agreement with the Wolfs so we know exactly what were the
expectations are on both sides before we say okay to the
rezoning.
Franklin/ You wanted that to be part of the conditional zoning
agreement.
Kubby/ That is requested that we have a signed agreement with the
Wolfs before we rezone. The other way to do that is to say a
satisfactory agreement has been achieved.

Franklin/ Assuming that you wanted to have that contract in place,
written and before you, before you voted on this or before you
finish the vote on it. You will have it. The thing is if we go
back now to change the conditional zoning agreement, which we
can- We have got three signatures of the Langenbergs. There
are seven Langenbergs that have to sign this and have it
notarized with the signature. So we can do it the other way,
that is we have a contract with the Wolfs that is a different
document that the conditional zoning agreement.
Kubby/ I had brought this up....
Franklin/ ...I thought we were going to do it as two different
pieces of paper.
Nov/ I still don't understand why you need all the Langenberg
signatures on the contract with Wolf.
Kubby/ I am saying a condition of the rezoning be ..that we have
signed a contract with the Wolfs because if we rezone this but
we end up not finding an agreement that a majority of us agree
to, we have rezoned something for manufactured housing
development but we don't have an agreement with the Wolfs.
that is the only reason we would consider probably annexing
and rezoning that property.
Franklin/ Our intention was to get that contract in your hands
before you finished with this process. So you won't have
rezoned it until you have that agreement.
Kubby/ ...want to hear four people here tonight say that we won't
do the third reading until we sign that contract.
Nov/ I think that is what we all agreed to last time ....
Franklin/ That was our intent. Bob wants it, too.
Kubby/ Okay, as long as there is a majority who will do it that
way.

Kubby! We listed a whole bunch of them. Who are we targeting, that
media, income, is it going to be 65, 80 or whatever, kinds of
jobs, transit, rental units...RS-S density, community center,
longer lease period...issues out there that we need to talk
about.
Franklin/ If we have a draft contract by the 16th, will that work.
Throg/
Franklin/..because if you continue the p.h. you are still going to
have the p.h. open and then if you want to change the
conditional zoning you can still do that. Okay.
Horow/ I would ask council members to get as many questions to
staff before the 16th because the 16th is a holiday and we
will have the same situation as we had today...staff is not
here...make sure you get questions to staff ....

Franklin/ Number of things that I would like to go over...
conditions of the rezoning ..... I am going to talk about the
annexation and the rezoning together° First the conditions of
the rezonings...run through those .... 1-Approval by the City
Development Board. 2-Approval of stormwater management plan
and grading and erosion control by Public Works Department
..... Incorporation of the appropriate amount of open space
...... Design and implementation of a landscaping plan .....

As an aside here, any manufactured housing park that is
established under our city code requires approval by the
council, by resolution. There are certain prescriptive
regulations within the code that have to be met ..... you will
be seeing the park plan for this ..... Design of site plan
that insures pedestrian access to the east and to the
south...integrate it with any development that happens to the
east in terms of pedestrian access..oaccess to soccer complex
.... Review and approval by the P/Z Commission of any site
plan or land division that occurs on the Langenberg Tract
..... Adherence to a density level that does not exceed RS-5.
Approval of a maintenance agreement between the City and
Johnson County for any portion of Sycamore Street remaining in
the county following annexation and zoning ..... Commitment by
the city to provide adequate infrastructure to the Langenberg
tract in a reasonable period of time including but not limited
to water, sewer, and access. Those things are critical
issues .... city to expend some money...veryimportant issue in
terms of the annexation, the timing and then the benefits that
you feel are going to accrue to the city ......
Kubby/ And we will recover some of those expenses .... Can we
quantify that?
Franklin/ The water is the one that you will recover costs on. The
way we do water...charge..per acre charge for any development
that has frontage .... within a district defined by the
distribution system that is served by that water line and so
..°about $350 an acre and that is the obligation of any
development that proceeds along this water line and so that
would be paid back as development occurs .....
Kubby/ Can we get that quantified? How much we will recover?
Franklin/ I think so, an estimate anyway.
Nov/ Isn't there some ID-RM property there that could eventually
develop?
Franklin/ The IR-RM is in Sycamore Fa~ms....I don't know exactly
what the bounds are of the area that would be served by this
particular line. So I will have to get that from Public
Works .... do a calculation .... Now the street. We do no
anticipate getting any revenues back to pay for that .....
Sycamore Street, from what is in the city limits...proceed
south down to the soccer fields as a public project° Arterial

south to the soccer fields ..... require dedication of the
r.o.w, by the developer and then the city picks up the full
cost of the actual construction of the street ..... So far that
is how we have done that .....
Kubby/ .... CIP FYP?? That would be helpful for me to know the two
extensions, from Burns to the City and the city limits to the
Sycamore L.
Franklin/ From what you just got in the budget. The sewer..what we
are providing here is r.o.w. Mr. Wolf will put in the sewer
itself and connect it but we are providing the way for that to
go through city easements and property ....
Throg/ I would like to pose a hypothetical .... cost of improving
Sycamore south from the city limits to where the east west
arterial will go and also from there south .... The estimate
for the portion that goes from the east west arterial to the
park, would that differ if we did not choose to approve this
particular project ..... would it be smaller, less costly...if
so, how much.
Franklin/ For the short run it deflnitely could be and probably
would be because you would not be serving any development. We
have an obligation to provide access to the soccer fields
before we can use them ..... could be as primitive as a chip
seal road .... In the long run this will need to be built to
the standards that we have calculated this cost for .... If we
don't approve this development right now we can put in a
street to a lesser standard to meet our obligation for the
soccer complex. But sometime we will have an obligation to put

Throg/ The current proposal would cost about $.5 million from the east west arterial down to the park.
Franklin/ $837,000 .....
Throg/ $200,000 to do it with a chip seal kind of thing ....
Atkins/ $200,000 at the high end
Franklin/ .... There is a lane there..., have to make some
connection between that lane and farther south and there is
some...grading costs in there .... got to have some kind of
base there even with chip seal .... high $200,000.

Atkins/ Burns Avenue to the city limits is FY97 and Sycamore
through the manufactured housing park site is also '97. Four
of these are listed as new projects in your budget and we will
have to go over priority process sometime during budget review
because you are adding these in .....
Kubby/ Thanks for getting that.
Franklin/ In te~s of timing...if thi~ project goes, the idea is to
begin construction as soon as possible and for a period of
time then, access to these pads .... something has got to be
going in there.
Baker/ Do chip seal now and defer other projects later ....
Franklin/ Chip seal will give you a good base so it is not thrown
away. I don't think we should approach this with a notion of
deferring that construction to Just some other time. That if
you are going to approve this, it really ought to be with the
obligation of putting that road in.
Kubby/ In terms of the extension of the water main.....not all of
that is due to Greenview ....
Franklin/ It is the timing but you have to extend it ..... lengthy
discussion on this ..... You have to put this in to get the
water down there so our expenditure of it now.., is one that
is precipitated by this project ..... we wil% be getting
revenue back on that one.....what our obligations are
immediately..... Last condition we have ...Design ensures
vehicular access to the ID-RM zone tract to the east .....
Nov/ Do we want to say...via a public street when we say access° Do
we need to specify?
Kubby/ Just makes it very clear.
Franklin/ .... that is what the intention was, that it be a public
street because otherwise you have public using a private
street and that is not the idea.
Kubby/ Will the streets in this be public or private?

Franklin/ They will be private .... (Refers to concept plan) This is
the concept plan that we are working with right now and public
roads that are shown on here are the east west parkway along
the top ....... (refers to concept plan) and then the north
south road which is Sycamore Extended.... East west...prefer
to have it along the south boundary .... 0 half a mile from the
east west parkway ..... (refers to concept plan).

Franklin/ I am talking about an east west road to go from Sycamore
over to the ID-P/~ either at the southerly location or here.

Franklin/ I think that is excessive, o....more roads than you need
given the kind of development that you are going to have here
...... It would be excessive to have two means east west. The
interior roads would all be private roads unless this is a
through street here and then that would be a public street, 28
feet of paving.

Franklin/ I am not exactly sure but I think it is about mid way up
here (refers to plan). I want to have more discussions with
the school district ..... I am not sure that it is a good idea
to have this school site on the sycamore Farms property. It
may be better to have it further to the west.
Kubby/ After looking at some of the things that Jim gave us and
some other people gave us in terms of how different trailer
courts can be designed...neighborhoody~ this doesn't look like
that . .....
Franklin/ We are trying to get some costs on the Rosa Vista that you gave us .... That was to be built this fall...c~rrent costs

Kubby/ Some number of lots configured a little differently ....
Franklin/ Some of the features in the Rosa Vista development ....
must have some dollars assigned to them .... Also had roads
that had 90 foot r.o.w ...... seems very excessive....If you
look at this...we have got basically three pods ..... so that
you have a central area in each one that is open space...
community or central building in the three different
areas .... nice play'space in here ..... This is a rendition that
was done last week and I like it...., principles of connecting
people within these three different pods.

function as green space. Ail of the green is public open
space ..... some space on each of the lots .....

Franklin/ Would be built at collector standards...lower volume of
traffic here...serve arterial function between Sand and Sioux

density development.

Franklin/ The RS-5 came as a density cap in the P/Z Commission's
discussions as a response to concerns about development n the
area.

Franklin/ The comp plan is low density s.f. which is either § or 8.
Generally 2-8 dwelling units per acre.
Tom Scott/ I think that most of the discussion concerning the RS-5
on the City/Wolf proposal dealt with the attempt to bring in
the density level at probably what the immediate neighbors to
the north were concerned about. That was one of the issues.

Most of that area ...... present zone tract...and south of city
limits including the parcel ..... and west will probably
develop in the RS-§ and RS-8 density category .... the 5 was
probably high enough. I would also say that in my
conversations with Bob Wolf, he indicated that their new
section of Modern Manor...about RS-6 .....
Kubby/ The reason it is important...affordable housing..the bigger
the lot the more expensive the lot ..... And so if there ia a
question...while not have the lots be slightly smaller, yet
still within iow density ....
Horow/ One of balancing that need with the integrity of the
surrounding area ......

Nov/ The surrounding neighborhoods are already zoned RS-8 .... They
don't actually have RS-8 units...have RS-5 units .... this
probably fits the actual pattern of development there.
Scott/ The developed density of traditionally RS-5 is probably
about 3-3 1/2 and 8 is probably in the 6 to 6 1/2.
Kubby/ So the design that we just saw, what is that density ....
Franklin/ That is pretty close to 5.

Franklin/ We still have to provide the neighborhood open space so
that is going to take up some .... increase the density...
requires more acres ..... with an 8...don't thinkyou will see
a pronounced jump ...... Also having pads that are big enough
to handle the larger homes ..... that needs to be an option .....
There is some items that I want to go over....reminder to the
council of how we got started with this. Because some of it
started..odiscussions started before all of you were seated

it was this council. But we started in December '93
talking about this...address affordable housing issue as well
as responding a lot to the flood ..... One reason why flood
moneys have come into use for this project .... lack of spaces
that were available for units for people to relocate. In
January '94 council approved $280,000 in your first allocation

for the acquire, rezone and or develop land for manufactured
housing ...... at that time we didn't know where it would
be...In February we started looking around for different
pieces...The site is good in terms of the ground...not ideal
in terms of how far it is from existing infrastructure .... we
have these other costs that are associated with it.... At that
time...started the RFP process and started working with the
Wolfs in March '94 and the purchase offer...finalized Ju~e '94
when Bob made the purchase offer and was accepted by the
Langenbergs and that purchase offer expires March 1. The
issues here with the annexation and rezoning have to do with
the location, the appropriateness of the zoning...and timing
of public improvements .... When we were looking at
locations...two things that we wanted. 1-that is be in
corporate limits or at least in the growth area and 2-that the
land be relatlvely flat. .... Looked at a number of sites and
I want to go over to the sensitive areas map and show you
where we did look and why we rejected some. (Refers to map)
One we looked at was the county property right over in
here .... flat piece .... on west side where we had no
manufactured housing but the county did not want to sell. They
wanted to swap but not sell. We had nothing to swap with them.
The airport property and near the airport....we considered.

Franklin/ ...they were concerned about the politics of getting rid
of any County Home land. That they needed to have land that
they could then say this is County Home property .....
Kubby/ What does that mean?
Franklin/ I don't totally understand the concept but it is a notion that there is a place for people to go who are the
responsibility of the county ..... County Home ..... The airport
near the airport, the airport decision not to move .... And
then the property that we were looking at right close to it
doesn't have sewer and is heavy in hydrio soils..... We looked
east of Modern Manor ..... don't have sewer to this area...on
Sycamore Street...within the corporate limits close to
existing development and had sewer but it was too small ....
deal with three properties...to get the acreage that was
necessary to make this economically feasible...more hydric
soils and some wetlands. The Gatens property is just too
low...wetlands...hydrio soils...not desirable in terms of
construction... The Lehmans on south of town indicated a
desire to work with the city on selling us some land...area

not sewerable .... was along this drainage area...Sycamore
Farms was approached by Mr. Wolf .... cost was $21,000 an acre.
That was too high.

Franklin/ The Langenberg tract is this one right here...somehydric
soils here..but compared to the Gatens property here. Sycamore
Farms was good in that it didn't have hydric soils in that
part but cost were too high and then by the airport...sewer
...big cost ....
Kubby/ Going back to the land near the airport. You said that the
need there would be for the connection of the north and south
sewer plant.
Franklin/ No, not near the airport. .... The reason I want to go
through this because there has been discussion about the
concentration of manufactured housing in this part of Iowa
City and it is not an issue that. passed us by...want to
attempt to disperse our efforts in affordable housing and low
income housing .... given the fact that with manufactured
housing...need to have relatively flat land. We Just couldn't
find anything that met those requirements.
Kubby/ Couldn't we condemn land for this public purpose ..... ?

Franklin/ Seems counter productive.

Franklin/ The question of how much RFBH do we need is one that has
been out there ..... If you view RFBH...as s.f. detached
housing .... and provides some opportunity for access to housing
that some people don't have, it is lower cost. That with this
project and with Sycamore Farms...more units available .... we
haven't built any manufactured housing since 1968. The demand
for manufactured housing is increasing in the county...has

increased some in Iowa City .... haven't had any land available
for it. We feel there is a need and that both projects can
succeed. And Bob feels that way, too ..... Are there any
questions about the location and why we picked this one.
Throg/ Talked in terms of distinct parcels...SO acres in
size...concept of scattered site housing .... Could you just
respond to general question about we are not trying to pursue
scattered site housing.
Franklin/ We are and we always have as a city policy. We have
public housing...housing assistance programs .... scattered
site. The point I would stress...this is not the solution to
all of the affordable housing issues that Iowa City faces. It
is one way to approach it ..... manufactured housing is another
way to approach this issue .... Doing this as one means to
approaching this problem...
Throg/ If you look at development of the city over time .... lower
income neighborhoods concentrated in southeast part of the
city .... What is it that we could do...to insure that
developers don~t take a cue from this ...development and have
.... that future development doesn't reinforce the image
...being low income area of the city.
Franklin/ First of all (refers to map)
Kubby/ Look at census tracts ....
Franklin/ (Refers to map) This is just showing you the census
tracts that were 51% low income and that is 80% of median or
lower by the 1990 census .... households. The west side will

1990 was not classified as having more than half of low income
people. What has happened in southeast Iowa City since then,
Villa Garden, Mt. Prospect, South Point. Those are over
$100,000 houses ..... Whispering Meadows, I don't know what
that will do to it. It may be that we have a misconception of
this issue of concentration. There is south of Highway 6 some
older neighborhoods...that are entry level housing but I think
it is a misnomer to classify south of Highway 6 as a low
income neighborhood especially given the construction that is
happening there right now. Will putting a manufactured housing
park or two in this are make it then a low income
neighborhood? ...... There will be a mix of income levels ......

positively by the staff but was overturned by the P/Z
Commission on a vote of 5-1 with George Start voting in the

were imposed upon this by the staff were that the development
be a subdivision and that it include the extension of
Whispering Prairie Drive south to the east west parkway. The
main reason that we wanted this particular provision was
because we were concerned about the proximity of what
potentially could be 3 mobile home parks right next to each
other and then the ability to develop a street network for
circulation within that larger area ..... Sycamore Farms...they
would like to rezone the RS-8 .... have a manufactured housing

get that paved...., or they would come to the city and request
the city to intervene or take that on as a capital project and
assess it back to the Barkers ..... matter of timing ....

in the present 84 acres .... With the mix of housing on that 84
acres, it seems that it is a natural progression to the RS-8

opposed to a modified RFBH ....

Appeals to deal with #10 (#10 -CONSIDER ANORDINANCEAMENDING
THE IOWA CITY BUILDING AND PLUMBING CODES TO INCREASE THE
OCCUPANT LOAD AT WHICH SEPARATE RESTROOM FACILITIES ARE

Horow/ I would like them to be called family toilets instead of unisex.
Kubby/ My question is outside the actual changes that are
recommended for somewhere between 15 and some magical
number...why couldn't they both be unisex and one b~
accessible to people with disabilities ....
Robert Carlson/ At some point, oopeople have a problem sharing
between male and female .... 15 is the point in the new code
that we will be looking at adopting later this year that
requires youto have two fixtures ....... matter of how you
declare what you want us to do ..... At some point in time you
have a need. You cannot have...byADA...have to have the equal
facilities ...cannot have male, female and handicapped because
, you differentiate. Although there is now this concept of
(.~ family ..... It is more use than that .... way to do it ....
option for somebody...
Nov/ Family idea came from the thought that a father and daughter
might want to go into the same restroom and they wouldn't want
to be embarrassed ....
Carlson/ If you want the count higher, we would set the count

accessible ..... And the answer we got from Ron is that ADA
says when you have two restrooms, they need to both be

me..interpretation of the ADA would be ...must both be
accessible .... But I don't know what context ..... I think that
is something we have to look at..

Tree Preservation Ordinance Reconsideration 95-2 Side 1
Franklin/ Larry, your feet are very distracting. Sorry ....
Karen, you brought up...about our investigating further
significant individual trees and then review the existing tree
ordinance. I talked to Bob and Melody about this and their
understanding was that the Woodlands Preservation Committee,
that when they did their work...they had said we are not going
to deal with the individual trees right now but we will come
back to that later and then they continued to pursue the
Woodlands Preservation .... got to joint meeting of Commission
and council and the Woodlands Preservation was put aside for
sensitive areas overlay. At that point we have on our work
program only the sensitive areas overlay. We do not have
anything about significant individual trees nor review of the
existing tree regulations. So if that is something you want,
it is something that yo will need to-We will need more
clarification of exactly what it is that you are after and
then we need to put it back on the work program...after July
I because of the sensitive areas overlay. The Heritage Tree
Program ,as I understand, is an identification process. It can
be carried further .... they will continue to work with the
city forester...nothing that is regulatory ....
Horow/ Just as in Historic Preservation, one can document a special
tree but that does not mean you have to preserve it .....
Throg/ I was struck by the Heritage Tree Program...might be
worthwhile...encourage support of that .... all sorts of
leads...future work...opportunity for the Heritage Tree
Program to expand ..... to extend it to other neighborhoods ....
Kubby/When we did the OPDH decision .... I wasn't conscience...also
saying no to the other things.., when I go by Walmart...see
very few trees .... I guess I want that to ba updated...better
landscapes...
