(1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST THE EASEMENT AGREEMENT FOR TEMPORARY USE OF PUBLIC RIGHT OF WAY BETWEEN THE CITY OF IOWA CITY, AND IOWA CITY COFFEE CO. D/B/A THE JAVA HOUSE FOR A SIDEWALK CAFE (RENEWAL). Comment: See memorandum to Design Review Committee from Architect/Energy Coordinator Schoenfelder included in Council packet. (2) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR CONTRACT 2 OF THE WASTEWATER TREATMENT CONNECTION PROJECT, ALSO KNOWN AS NAPOLEON PARK PUMPING STATION AND NORTH PLANT IMPROVEMENTS PROJECT. Comment: See Engineer's Report. (3) CONSIDER A RESOLUTION AUTHORIZING AND DIRECTING THE DIRECTOR OF PUBLIC WORKS TO ACT ON THE ClTY'S BEHALF IN SECURING PERMITS FOR CONSTRUCTION OF PUBLIC IMPROVEMENTS. Comment: The City must, on occasion obtain construction permits from various governmental agencies prior to commencement of work on public improvements. This resolution authorizes the Public Works Director to execute permits on the City's behalf for the construction of public improvements. Public Works recommends approval of this resolution. (4) CONSIDER A RESOLUTION AUTHORIZING THE EXECUTION OF CONSOLIDATED ANNUAL CONTRIBUTIONS CONTRACT RENTAL CERTIFICATE PROGRAM AND RENTAL VOUCHER PROGRAM: PROJECT RENEWAL IAO22V08001. Comment: The Consolidated Annual Contributions Contract (CACC) Rental Certificate Program and Rental Voucher Program combines the 527 units of Section 8 Certificates and 350 units of Section 8 Vouchers. Renewal funding is being provided for the voucher program in the amount of $320,500. This amendment does not represent any new dwelling units for the program but is intended to maintain the number of units in the program at the current level. Correspondence. PUBLIC DISCUSSION (ITEMS NOT ON THE AGENDA). ITEM NO. 6. PLANNING AND ZONING MATTERS. Public hearing on an ordinance amending Title 14, Chapter 6, Zoning, Article T, Nonconforming Uses, Structures and Land, Section 5, Regulation of Nonconforming Lots, by changing the regulation of nonconforming lots of record. Comment: At its April 2 meeting, by a vote of 5-1 with Ehrhardt voting no, the Planning and Zoning Commission recommended approval of the proposed amendments. Staff recommended approval in its staff memorandum dated March 2.~. . _ Public hearing on an ordinance changing the zoning designation of approximately 5.4 acres from Community Commercial (CC-2, 2.4 acres) and General Industrial {I-1, 3.0 acres) to Public (P) for property owned by Kirkwood Community College at 1806, 1810, 1814, and 1816 Lower Muscatine Road. (REZ98-0003) Comment: At its April 16 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of the proposed rezoning. This is a City-initiated application. May 12, 1998 City of Iowa City Page 4 Consider an ordinance conditionally changing the zoning designation on a lO-acre tract located on the south side of Melrose Avenue and west of West High School from Low Density Single-Family (RS-5) to Planned Development Housing (OPDH-$) to permit an $0 dwelling unit retirement community. (REZ98-0002) (Second consideration) Comment: At its March 5 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the requested rezoning subject to agreements and easements for the provision of sanitary sewer service and compliance with building and site design plans. Staff recommended approval subject to conditions in a February 27 memorandum to the Commission. Consider an ordinance conditionally changing the zoning designation on approximately 41 acres located between Lower West Branch Road and Court Street extended, approximately 4/5 miles west of Taft Avenue from Low Density Single-Family Residential (RS-5) to Medium Density Single- Family Residential (RS-8) for 29.1 acres and Low Density Multi-Family Residential {RM-12) for 11.9 acres. (REZ97-0019) (Pass and adopt) Comment: At its February 19 meeting, by a vote of 6-0, the Plalnning and Zoning Commission recommended approval of the requested rezoning subject to a conditional zoning agreement outlining the applicant's obligations regarding the extension of Court Street and requiring approval of a future OPDH application for each parcel prior to development of the property, to be prepared and reviewed in accordance with the neighborhood design concepts contained in the Comprehensive Plan. Staff recommended approval subject to memorandum to the Commission. Action: c-~ t " conditions in a February 13 Consider a resolution approving a preliminary plat of Walnut Ridge, Parts 6 and 7, a 66.68 acre, 2C-lot residential subdivision located at the north terminus of Kennedy Parkway. (SUB98-0001) Comment: At its March 5 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of the preliminary plat, subject to staff approval of a grading plan and a Sensitive Areas Site Plan prior to Council consideration. A grading plan and Sensitive Areas Site Plan have been approved. Staff recommended approval in a report dated March 5. Staff recommended approval in a February 13 memorandum. Staff recommended approval in a report dated April 16. ITEM NO. 7. Consider a resolution approving a final plat of Walnut Ridge, Part 7, a 11.09 acre, 8-lot residential subdivision located north of Kennedy Parkway. (SUB98-0007) Comment: At its April 16 meeting, by a vote of 5-0, the Planning and Zoning Commission recommended approval of the final plat, subject to staff approval of construction drawings and legal papers prior to Council consideration. Staff recommended approval in a report dated April 16. Action: PUBLIC HEARING ON PROPOSED AMENDMENTS TO THE FLOOD INSURANCE RATE MAPS. Comment: The public hearing is on proposed amendments to the Flood Insurance Rate Maps that are used as a tool for administration and enforcement of the Flood Plain Management Ordinance. The amendments to the maps include revisions of existing maps and expansion of area mapped. After the public hearing, the maps will be forwarded to the Federal Emergency Management Agency for review and approval. Public hearing is continued from April 28. Detailed information on amendments was made available for public inspection on May 1, 1998. a. PUBLIC HEARING Action: ITEM NO. 9. ITEM NO. 10. b. CONSIDER A RESOLUTION APPROVING Action: C'~? ~{~'~-~ ~-C~__~ IOWA CITY'S FY99 ANNUAL ACTION PLAN, THAT IS PART OF THE CONSOLIDATED PLAN (CITY STEPS), AUTHORIZING THE CITY MANAGER TO SUBMIT SAID PLAN AND ALL NECESSARY CERTIFICATIONS TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AND DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE CONSOLIDATED PLAN. Comment: The Iowa City Housing and Community Development Commission recommends approval of the FY99 Annual Action Plan. To receive FY99 funding, this document must be submitted to the U.S. Department of Housing and Urban Development (HUD) by May 15, 1998. Correspondence included in Council packet. a. PUBLIC HEARING (continued fro~,April 28~.~ b. CONSIDER A RESOLUTION ADOPTING PUBLIC HEARING ON LOCAL HOMELESS PREFERENCE FOR APPLICANTS AT THE IOWA CITY HOUSING AUTHORITY. Comment: HUD requires a Public Hearing when requesting a Local Preference for housing assistance. This preference would give homeless persons certified by HACAP, DVIP, EHP, and Successful Living priority in receiving housing assistance. Once approved, this local preference would be included in the Section 8 and Public Housing Admissions Plan. Action: May '12, 1998 City of Iowa City Page 7 ITEM NO. 11. ~ CONSIDER A RESOLUTION AUTHORIZING THE ADOPTION OF THE CHANGES TO THE SECTION 8 ADMINISTRATIVE PLAN AND PUBLIC C~__ 1*'TS . HOUSING ADMISSION AND OCCUPANCY PLAN FOR THE IOWA CITY HOUSING AUTHORITY PROGRAMS. Comment: HUD has allowed housing authorities to eliminate federal preferences and to establish their own local preferences. The Housing Authority proposes to have a homeless preference that would be documented by the Emergency Housing Project, the Domestic Violence Intervention Program, the Hawkeye Area Community Action Program, and Successful Living. It also allows housing authorities to establish a minimum rent. This resolution proposes to raise the current minimum of $25 a month to $50 a month. Finally, this resolution offers a change in the definition of family. This definition utilizes both the human rights and the zoning ordinance definition of family. CONSIDER A RESOLUTION AMENDING BUDGETED POSITIONS IN THE ASSISTED HOUSING DIVISION OF THE HOUSING AND INSPECTION SERVICES DEPARTMENT AND AMENDING THE AFSCME PAY PLAN. Comment: The proposed reorganization of the Iowa City Housing Authority is a result of an analysis of all Housing Authority operations. This analysis included a review of every process and staff position and consultation with the Department of Housing and Urban Development. It is designed to improve customer service, reduce operational costs, and improve the efficiency and productivity of the Housing Authority. Staff memorandum included in Council packet. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING MAYOR TO SIGN AND CITY CLERK TO ATTEST CONTRACT FOR CONSTRUCTION OF THE SOUTHGATE AVENUE AND WATERFRONT DRIVE PAVING IMPROVEMENTS AND WEST PEPPERWOOD RELIEF SEWER PROJECT. Comment: The bid opening for this project was on May 5, 1998, at 10:30 a.m. and the following bids were received: Metro Pavers Streb Construction Hurst & Sons Engineer's Estimate Iowa City, IA Iowa City, IA Waterloo, IA $627,286.80 $697,299.45 $767,067.00 $820,000.00 Public Works and Engineering recommends award of the project to Metro Pavers of Iowa City, Iowa. Local Road Use taxes and Hy-Vee Food Stores will fund this project. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING MAYOR TO SIGN AND CITY CLERK TO ATTEST CONTRACT FOR CONSTRUCTION OF THE IOWA RIVER CORRIDOR TRAIL PROJECT BURLINGTON STREET TO NAPOLEON PARK. Comment: The Iowa DOT bid opening for this project was on April 28, 1998 at 9:00 a.m. and the following bids were received: Peterson Contractors Inc. Iowa Bridge & Culvert, Inc. United Contractors, Inc. Reinbeck, IA Washington, IA Des Moines, IA Engineer's Estimate $1,312,306.32 $1,643,356.77 $1,658,976.20 $1,364,881.00 Public Works and Engineering recommends award of the project to Peterson Contractors,. CONSIDER A RESOLUTION RESCINDING RESOLUTION NO. 98-162 WHICH AUTHORIZED THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT WITH ROHRBACH, CARLSON P.C. FOR THE DOCUMENT PHASE OF THE CIVIC CENTER THIRD FLOOR AND POLICE DEPARTMENT SECOND FLOOR EXPANSION PROJECT. Comment: By letter of May 6, 1998, Rohrbach, Carlson P.C. informed the City that it chooses not to proceed with the contract documents phase of the Civic Center third floor and Police Department second floor expansion project, which contract was authorized by the resolution being rescinded. (1) Historic Preservation Commission: One vacancy representing the Brown Street District to fill an unexpired term ending March 29, 1999. (John Shaw resigned.) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A 28E AGREEMENT BETWEEN THE COUNTIES OF BENTON, CEDAR, IOWA, JOHNSON, JONES, LINN, AND WASHINGTON, AND THE CITIES OF CEDAR RAPIDS, IOWA CITY, AND CORALVILLE. Comment: Pursuant to Iowa Code Chapter 28E, the counties of Benton, Cedar, Iowa, Johnson, Jones, Linn, and Washington, and the cities of Cedar Rapids, Iowa City, and Coralville, desire to establish a legal entity known as the East Central Iowa Em- ployment and Training Consortium, for the purpose of enhancing employment and training opportunities in east central Iowa.
