Landfill Tonnage Reduction/Increase in Recyclables Collected at the Curb
As part of the ECICOG Regional Solid Waste Management Plan, we are required to report
landfill reduction numbers. Our Solid Waste Management staff has prepared those figures.
It appears Iowa City landfill tonnage has been reduced by 42% since 1988. The ECICOG
region as a whole has seen a 35% reduction overall. A table is attached that illustrates the
region's progress.
Contributing to the landfill reduction is the increase in recyclable materials collected at the
curb in Iowa City. In March of 1996, Iowa City implemented unit-based rate programs for
refuse and bulky waste and provided curbside recycling containers. Since then, the Solid
Waste Division has seen the amount of recyclables collected double and appointments for
the collection of bulky items drop to just a handful per day.
Since March of 1996:
Appliance, tire, and yard waste collections remained constant. There were no changes
to these collection programs.
Newsprint collection increased from 44 tons in February to 89 tons in March. Newsprint
collection peaked at 97 tons in May. Curbside amounts have remained steady since
March. Drop site amounts have decreased by 20-25%.
Plastic collection increased from 4 tons in February to 7.5 tons in March with collection
amounts remaining steady. Drop site amounts have also decreased by 20-25%.
Metal can collection increased from 4 tons in February to 7.5 tons in March with
collection amounts remaining steady.
· Glass collection increased from 8 tons in February to 17 tons in March. Curbside
amounts have remained steady. Drop site amounts remained unchanged since most
glass is not recyclable at the drop sites due to contamination.
· Cardboard collection increased from 8 tons in February to 20 tons in March. Cardboard
collection peaked at 32 tons in May. Curbside amounts have remained steady.
· Refuse collected at the curb has decreased on average by about 100 tons per month.
Your policies and programs implemented in March seem to be doing what they are
designed to do: reduce the waste stream. Business, industry, and the rest of the county
should also be praised for their reduction efforts. We will need everyone to continue to
work to reduce the waste stream in order to reach the State's goal of 50% reduction by the
year 2000.

Re: Oakland Cemetery
The City Council discussed the July 22 memorandum conceming recommendations from the
Commission. It is their desire to have the Parks and Recreation Commission offer any recom-
mendations, opinions, and/or thoughts with respect to the cemetery operations particularly
whether you could support the expansion of the boundaries of the cemetery into Hickory Hill
Park. The City Council has not settled on a policy position as to whether they would support
or reject such recommendations and/or how they see the future for our cemetery operation.
However, they did feel it important that the Commission offer their advice and guidance.
Please proceed as soon as practical to prepare such recommendations, etc. It is likely we will
be discussing this matter at the time of our capital improvement planning and/or goal setting
session so, therefore, the sooner the better. If you have any questions please let me know.

Re: University of Iowa Biology Building Project
On July 9, 1996, Jeff Davidson, Jim Brachtel, Terry Robinson, and I met with representatives of
the University and their architect from the firm of Brooks, Borg, Skiles to review the Biological
Sciences renovation and building project. Attached is a schematic drawing of the building
footprint and the skywalk connection over Dubuque Street. The project involves renovation of the
existing Biology buildings and construction of a new building at the corner of Iowa Avenue and
Dubuque Street. The new building will substantially displace the open space at the corner of
Iowa Avenue and Dubuque Street and the sculpture on this site. As part of this project, a skywalk
over Dubuque Street at the second story level is proposed. The design of the skywalk is not
complete at this point.
The new building will consist of three to four stories with a greenhouse comprising the fourth
story. The new building is approximately 55,000 square feet. It will house teaching labs and
support spaces on the first floor and research labs on the second and third floors, with the
greenhouse on the roof. An auditorium will project off the north face of the building. The
entrance to the building will be along Iowa Avenue and at the corner of Iowa and Dubuque.
After the architect's presentation of the project, we discussed issues which would be of interest
to the City. I expressed my concern that the skywalk not obstruct the view of downtown Iowa
City, or be seen as an impediment to accessing downtown. I also suggested that the skywalk
could serve as an accent to the entrance to downtown. We discussed the height of the skywalk,
which seems to be sufficient to accommodate any traffic which would be using Dubuque Street.
We also discussed the support for the skywalk and whether it would require pillars or could be
hung from the building. Apparently, either option is feasible.
The University representatives indicated they would be willing to work with the City on the design
of the skywalk; they shared our concerns about the impact the skywalk might have on the
downtown. As noted in the attached minutes from the meeting, the arohitects will work on a
design for the skywalk and present it to us prior to any formal steps being taken to acquire the
air rights to construct the sidewalk. Similar to the Mercy Hospital skywalk, the University will need
to acquire an easement over Dubuque Street for construction of the skywalk. This will involve
action by the City Council.
Other issues which came up at the meeting included the removal of trees along Iowa Avenue and
Dubuque Street, particularly on the east side of Dubuque Street and the north side of Iowa
Avenue. The University will make every effort to save as many trees as possible; however, it is
clear that trees which currently exist in the open space along the north side of Iowa Avenue will
need to be removed and at least one or two trees on the east side of Dubuque Street will be
removed. During construction, there will be disruption of the parking along Iowa Avenue given
the proximity of the new building to the street, the need for staging of equipment, and the need

for continued pedestrian access along Iowa Avenue and to Van Allen Hall. Also during
construction there is likely to be a need for temporary street closings on Dubuque Street and on
Iowa Avenue to facilitate connection of the new building to existing utilities.
The last item which is of interest to the City is the fact that the sculpture which is located at the
corner of Iowa Avenue and Dubuque Street is the property of the City of Iowa City. We have the
opportunity to relocate our sculpture; I am open to any suggestions. If the City does not wish to
relocate the sculpture, the University representative indicated that they would be willing to find
a place for this art work.
The biological sciences project is in the planning stages now; however, the University does have
funding approval from the Regents and intends to start construction in the fall of 1997. The next
step is for the University's architects to submit to us design(s) for the skywalk for our review. 1
believe we will also see designs for the new building at the corner of Iowa Avenue and Dubuque
Street, I did ex. pmss interest in there being activity at the street level rather than a blank wall
along this half-block face of Iowa Avenue. Upon receipt of the drawings, I will consult with you
as to how you would like to proceed in taking this project before the City Council.

Re: Reques{ for Proposal for Lock Box Services
The City of Iowa City currently uses Firstar Bank's lock box service in Cedar Rapids to process
mailed payments for utility, landfill, parking tickets and miscellaneous accounts receivable billings.
The City has utilized this service since 1985, and has been very pleased with their service.
Several months ago, there were questions raised on why the City of Iowa City uses a Cedar
Rapids bank for this service rather than an institution in Iowa City. At that time I spoke with
several local banking institutions to see if they in fact did offer a competitively priced, efficiently
run lock box service. Several hinted that they do this on a small scale basis for a few of their
clients, but were not set up to handle larger volumes. In light of this question, staff prepared a
Request for Proposal (RFP) for lock box services. The RFP for lock box services was sent to ten
institutions. The request was to provide lock box services for the next three years. The ten
institutions included five from Iowa City, one from Hills, three from Cedar Rapids and one from
Des Moines. Three institutions responded to the RFP and they were Firstar Bank, Cedar Rapids;
Norwest Bank, Cedar Rapids; and Brenton Bank, Des Moines. The proposals were evaluated
on several criteria including experience, speed of processing, cost, software conversion as well
as references.
Based on the analysis of staff we have approved a new three year agreement with Firstar.

Dear Steve:
As you are aware, the final extension of Court Street from Scott Boulevard
through to the City's eastern boundary (Taft Avenue) has always been central to the success
of the Windsor Ridge annexation. Our long range plan, as well as those of the City and the
School District, anticipated the completion of this final 113 rrdle within five to seven years of
the beginning of development of the Windsor Ridge Subdivision. Already over three years of
that horizon have passed and to accommodate the timetable, we are asking that the City
commit to complete Court Street by the end of 1997.
Finisking this last piece of Court Street would provide a number of benefits for the City:
Open up the f'mal portion cf Windsor Ridge for development which includes already
approved commemial and medium density residential zoning;
Introduction of affordable housing such as retkement condominimns and homes and
condomirdurns for f'~rst time buyers into the Windsor Ridge community;
Provide access to a dedicated school site;
Support sensible alternative transportation access with the trails and a potential bus
route; and
Clearly communicate the City's intentions regarding the future development of this
area including a showcase town square/neighborhood commercial anchor at the intersection
of Taft Road.
The property owners directly influenced by this madwork have met formally and informally
over the past two years and are supportive of finishing Court Street as the next logical step in
their plans. Based on engineers estimates, the City would need four to five acres of the land
identified as the Lindemann Estate (which has not been annexed to the City). The remainder
of the roadway would come from Windsor Ridge land.

Because it was required to develop Windsor Ridge, the sewer trunk line is already in place,
reducing costs in that 'regard. It might be possible for the Lindemann Estate owners to
provide the necessary land in lieu of an assessment rather than to go through a condenmation
process or an outright purchase of the land. Similarly, Windsor Ridge would be open to
discussing cost sharing alternatives for the project such as per lot assessments or other
instruments intended to reimburse the City as development occurs.
The completion'of Court Street has been on the Capital Improvements "wish list" for some
time. We feel it is time to place it on the "to do" list. Conditions are favorable, the parties
involved are amenable and there is the potential for the council to use this project to make a
strong statement about planned development in our city.

Re: City Council Design Approval by Agreement: Old Library Parking Lot
As you can see from the attached agreement signed in January 1983, and recorded in June
1984, the last unnumbered subparagraph of paragraph 8 states as follows:
"Seller [City of Iowa City] and Buyer [GWG Investments] further agree that in the
event the option to purchase the parking lot is exercised by the buyer, buyer
agrees to construct a new building no later than twelve months after conveyance
of parking lot and the design of same shall be subject to approval by the City
Council." [emphasis added]
The sale to GWG Investments by the City was finally consummated in April 1992, after
considerable delay.
As discussed at your meeting Monday, August 6, 1996, the City Council does have the right to
approve the design of the building being constructed on the Old Library parking lot, see attached.
Your approval authority does not speak to the question of zoning density. Thus, it would be my
opinion that density and zoning questions are beyond the purview of the City's design approval
under the agreement. Also, Iowa City traditionally has limited "design review" to the exterior view
of the building. In any event, the way the exterior of the proposed building relates to neighboring
buildings clearly falls within the definition of "design approval."

OFFER TO PURCHASE - OLD PUBLIC LIBRARY AND PARKING LOT
The undersigned, hereinafter referred to as "Buyer," offers to purchase from the
City of Iowa City, hereinafter referred to as "Seller," the interest in real
property, situated in the City of Iowa City, County of Johnson, State of Iowa,
and described below, at the price and upon the terms and conditions as follows:
Buyer agrees to pay Seller a total purchase price of One Hundred Sixty-Five
Thousand Dollars ($165,000.0D) of which Fifteen Thousand Five Hundred
Dollars ($15,500.00) hereinafter called "earnest money," is paid herewith
to Seller to be refunded only if this offer is not accepted by Seller
within ninety (90) days from the date this offer is received. The balance
on the purchase shall be paid to Seller in the form of a Cashier's Check,
Certified Check or Money Order within thirty (30) days from the date this
offer is accepted, provided the Seller's deed i5 then ready for delivery.
If the Buyer fails to perform this agreement within the time limit herein
specified, Seller may retain the earnest money as liquidated damages, not

Seller shall convey or cause Lots 3 and 4, Block 63 (Original Town} of Iowa
City, Iowa to be conveyed to Buyer by WARRANTY DEED subject to the
conditions, exceptions and reservations as shown herein. Premises include
all estates, rights, title and interest in the above real property, subject
to easements of record. Seller agrees to comply with all applicable state
law regarding disposal of public property.
Seller shall retain the following easements:
Seller shall retain a driveway easement over the existing driveway over the
easterly portion of Lot 3. The easement shall be for access only to the
parking lot on Lots 1 and 2, Block 63 (Original Town) of Iowa City, Iowa.
Seller shall have no obligation to maintain driveway. The easement will
run with the land. ~owever, the easement shall be terminated when Lots 1
and 2 herein described are no longer used as parking lots by Seller, its
successors or assigns.
This Offer shall apply to and bind the legal successors in interest of the
parties herein, and shall not be assignable. Upon acceptance in writingby
City, this Offer shall constitute a Contract of Sale and shall be recorded
in the Johnson County Recorder's Office and that upon said recording, the
real property herein shall be deemed taxable real estate under Iowa
property tax law. Further, parties agree that Buyer shall be responsible
for all such property taxes from the date of recording of said Contract of
Sale; and in the event legal title is not delivered to the Buyer, parties
agree that said taxes will be pro-rated between Buyer and Seller between
the applicable date of possession and date of termination or expiration of
this Contract.
Seller agrees to convey said property free and clear of liens, and to
warrant good and merchantable title under ]owa title standards. Seller
shall provide an Abstract of Title continued to date showing merchantable
title in Seller, and agrees to pay the cost of corrections, continuations,
and costs necessary to transfer title, including documentary stamps,
recording fees and other fees, but not including attorney's fees. Claim
for said fees and costs shall be furnished in writing to Seller upon
demand.
Seller warrants that there are no tenants on the premises, holding with or
without a lease.
Seller warrants that names and addresses of all lienholders are as follows:
none.
Buyer agrees to pay and Seller agrees to grant the right of possession, to
convey title and to transfer possession as shown below:
Building (Lots 3 and 4, Block 63, Original Town}:
$165,000.00
Parking Lot Lease Terms: The Buyer retains the right to purchase the
parking lot in entirety within twelve (lg) months from the date that
title to the library is conveyed. Purchase price will be $205,000.
The right to purchase shall be at Buyer's option and Buyer will
exercise this option by giving written notice to Seller. Seller
agrees to convey said property within sixty (60) days after receipt of
said notice.
Further, this Offer includes the right to lease all or part of the
parking lot property at the following terms: at existing City lease
rates with a written request from Buyer to Seller one month in advance
of lease period specifying the number of spaces desired for lease. for a perio
of time not to exceed ]2 months from the date of execution of this contract.
This option shall extend for 12 months following the date of
conveyance of the library property.
The Buyer, when exercising the option to purchase the parking lot
property by written notice, will tender $20,500 in the form. of a
cashier's check, money order or certified check as earnest money. The
balance on the purchase will be paid within sixty {60} days from the
date this offer is exercised. If the Buyer fails to perform this
agreement within the time limit herein specified, Seller may retain
the earnest money as liquidated damages, not as a penalty or
forfeiture, and declare this agreement terminated. The Seller may, as
an option, proceed to have this agreement specifically enforced or
pursue any other remedy that is available, in law or equity, for
breach of this agreement.
Seller and Buyer further agree that in the event the option to
purchase the parking lot is exercised by the Buyer, Buyer agrees to
construct a new building no later than 12 months after conveyance of
parking lot and the design of same shall be subject to approval by the
City Council.
Parties agree that the Buyer shall acquire Lots 3 and 4 for development
purposes as set forth in the Library Marketing Brochure (see Attachment A).
The failure of the Buyer to make reasonable progress on said development or
redevelopment may require reconveyance of said property to the City of Iowa
City. Reasonable progress shall mean that the Buyer shall make a
commitment of no less than 300 percent of the Buyer's minimum bid for said
property, to be demonstrated to the Seller's satisfaction within 18 months
from final closing. The minimum 300~ financial commitment shall be for
~hard' construction costs such as demolition, materials and other item
purchases, and excludes fees for architectural and engineering services,
consultants and other 'soft' costs paid to third parties. These hard
construction costs shall be documented and made available on request to the
Seller.

representations with respect to soil conditions, structural conditions,
subsurface conditions, and the like. Further, Buyer does not rely upon any
studies of such conditions possessed by the Seller for purposes of purchase

offer is being made and has satisfied him/herself as to surface and
subsurface conditions of the site.

Dear Mayor Novick:
The North Liberty Cable Commission would like to bring to your attention one of your
employees that has been a tremendous help to our Commission. Our city is experiencing
growing pains and our budget is still limited, but thanks to volunteers like Bob Hardy we
have the expertise needed to up-grade our telecommunications equipment, keeping our
expense down, and still able to keep the citizens of North Liberty informed.
We currently have one Government Access Channel that allows us to produce LIVE
broadcasts of our Council and Commission meetings, and playback tapes of the Johnson
County Board of Supervisors and the Iowa City School Board meefmgs. The city is
currently building a Community Center/Library that will be equipped for video and audio
production. Dedicated volunteers, like Bob, allow us to offer the best possible service to
our community.
The generosity and dedication of volunteers make this a community that we are very
proud to be a part of.
