Ladies and Gentlemen:
My purpose in writing is to request the permission of the City Council for the Historic
Preservation Commission to appear before the Johnson County Board of Supervisors for the
purpose of lobbying in favor of the adoption of a resolution concerning the State of Iowa's
Historic Rehabilitation Tax Exemption Program based on Section 427.16 of the Iowa Code.
The Commission has been requested to join the Johnson County Historic Preservation
Commission in drafting the language of the proposed resolution and in appearing betbre the
Johnson County Board of Supervisors to urge its adoption. The Iowa City Historic Preservation
Commission is very eager to do so but understands it may not proceed without the consent of the
City Council.
The Historic Rehabilitation Tax Exemption Program provides for a temporary real estate tax
exemption for properties which are on the National Register of ttistoric Places or certified as
eligible for the National Register and then only in the event the building owners complete a
rehabilitation project certified by the State Historic Preservation office.
The tax exemption allowed by the proposed resolution would be on the increased value on an
historic property caused by a rehabilitation project. The exemption would be for a period of
years to be specified. While the exemption is in effect, the property would remain on the tax
rolls at it CUlXent valuation. After the period of exemption ended, it would remain on the tax
rolls bul at the new, higher valuation including the additional value due to the rehabilitation or
renovation. It is believed that the tax exemption would be a strong incentive for the rehabilitation
and restoration of historic buildings in Iowa City and in Johnson County.

The tax exemption would affect the 168 buildings contained in Iowa City's fore' historic districts,
South Summit Street, Woodlawn, Brown Street, and the Muscatine Avenue Moffit Cottage
District In addition, there are 47 individual properties in Iowa City which are on the National
Register but which are located outside the boundaries of the historic districts. Of these, 36 are
pending as the first series of Iowa City Historic Landmarks. There are approximately 14
properties on the National Register of Historic Places located in Johnson County but outside the
boundaries of Imva City.
It is important to note that the tax abatement trader the proposed resolution would only be
available to properties that are listed on or certified as eligible for listing on the National Register
and which complete a certified rehabilitation project. The number of rehabilitation projects for
such properties reviewed by the preservation commission from 1987 through 1996 was
approximately three per year.
The Conunission would welcome the permission of the City Cotmcil to proceed with the tax
abatement resolution in cooperation with the Johnson County Historic Preservation Commission.
Representatives of the Commission would be glad to meet with the City Council at a convenient
time to answer questions about the matter.

At its August 27 meeting, the Iowa City City Council considered your request to authorize the
Historic Preservation Commission to assist in drafting a resolution for the adoption of a
historic properties tax exemption program, and to lobby for its passage. The Council approved
the request and thereby authorizes the Historic Preservation Commission to pursue the
passage of this resolution as an incentive for the preservation of designated historic properties
within Iowa City and Johnson County.

Re: Napoleon Park archaeological survey
Dear Mayor Novlck and City Councilors:
At the last City Council meeting (O Aug., 1996) there was a discussion about
paying the bill from Louis Berger and Associates, Inc. This bill was in part for
the archaeological survey of the area in Napoleon Park which was being disturbed by
construction of the new trunk sewer connecting Iowa City's north and south sewer
plants. Several city councilors either explicitly stated or implied by their
comments during this discussion that 'nothing of significance' was found by this
survey. Because you had not been provided with complete information, these
statements are in error and I believe that it is important to correct the public
record about this matter,
Dr. William Green, State Archaeologist of Iowa, in a letter published in the Iowa
City Press-Citizen on 7 May, 1996 (copy attached), noted that remains of "2000-year-
old dwelling and associated features" were found in the trunk sewer trench in
Napoleon Park during this archaeological survey. He further states that this is
"the first prehistoric structure ever found in the entire Iowa River valley and a
highly significant archaeological find," On 9 Aug,, 1996, I phoned Dr. Green to
verify this information and he characterized this find as a 'spectacular' one where
'large amounts' of prehistoric cultural materials had been found. As is customary
when cultural resources are discovered duJzJzk.q construction activity, these
archaeological materials were carefully excavated to preserve the information for
posterity and the project was allowed to proceed,
Furthermore, I do not believe that the cost of any archaeological survey is
"wasted" even if nothing is found. In those cases, we confidently can proceed,
knowing that our community construction projects will not be destroying
irreplaceable artifacts and information about our prehistoric heritage. Indeed, the
best case for the City of Iowa City always will be when a survey discovers no
significant archaeological sites! The city then is ~ obligated to either redesign
the construction project or to expend additional funds to preserve the cultural
resources by salvage excavation, as it was in the Napoleon Park event.

would have been prudent for the city
to have planned, budgeted for and
conducted archaeological work at Na-
poleon Park prior to construction.
The office of the state archaeologist
has not been involved in archae-
ological work at Napoleon Park since
March. But I recently learned from the
State Historical ,Society of Iowa that a
2000-year-old dwelling and associated
features were excavated over the past
few weeks at the park -- the first
prehistoric structure ever found in the
entire Iowa River valley and a highly
significant archaeological find.
It is incorrect to assume the areas
now being studied on the north side of
the city do not contain historical re-
sources. In fact, several archaeological
sites have been identified in the tract
on terraces along the Iowa River and
on blufftops overlooking the valley.
I believe it is also incorrect to state
the city is funding the north side study
in response to "the Napoleon Park
archaeological fiasco." To be fair to
the city, a city attorney told me on
Nov. 7, 1995, that the city would
conduct an archaeological survey of
the north side area. This was 12 weeks
before the Office of the Sate Archae-
ologist was notified of the Napoleon
Park sewer plans.
Although the Napoleon Park issue
was difficult to resolve, your editorial
highlights the great interest in Iowa
City area history and archaeology.

dents can consult to learn more about
this region's rich heritage.

There is one fraterni .ty in town that has loud parties with amplified music and nothing
has ever been done about it despite numerous complaints. Their parties are much louder
than other fraternity parties and emit sound levels way above that specified in the Iowa
City noise ordinance. This fraternity is in the middle of a residential zone and, whereas
neighbors tend to put up with a few parties a year, this fraternity has over a hundred
pro'ties per year.
In light of the number of times the police are called to other fraternity parties, in the
interest of fairness to the lesser offenders, I would hope something could be done about it
this year, now that the big Fall party season has started.

Re: Stop Sign Installation on Walnut Street at Lucas Street
As directed by Title 9, Chapter 1, Section 3 of the City Code, this is to advise you of the following
action:
ACTION:
Pursuant to Section 9-1-3(A).5 of the City Code, the City Traffic Engineer will direct the installation
of stop signs on Walnut Street so as to cause traffic on Walnut Street to stop prior to entering the
right-of-way of Lucas Street. This action will take place on or shortly after August 28, 1996.
COMMENT:
This action is being taken so as to discourage the use of Walnut Street for pass-through traffic.
This action is consistent with the City Council's use of stop signs for traffic calming in residential
neighborhoods at the intersection of residential streets.

Re: Stop Sign Installation on Court Street at its Intersection with Seventh Avenue
As directed by Title 9, Chapter 1, Section 3 of the City Code, this is to advise you of the following
action:
ACTION: Pursuant to Section 9-1-3A5 of the City Code City Traffic Engineer will direct the
installation of stop signs on Court Street so as to cause traffic on Court Street to stop prior to
entering the right-of-way of Seventh Avenue. Currently Seventh Avenue stops prior to entering
Court Street. The addition of stop signs on Court Street will create an all-way stop condition at
this intersection. This action will occur on or shortly after 28 August, 1996.
COMMENT: This action is being taken upon the completion of a review of the traffic conditions
and reported accident history at this intersection. Conditions at the intersection are consistent
with warrants of the Manual Uniform Traffic Control Devices for all-way stops and the change to
an all-way stop is appropriate.

Re: 965 Alternatives
Dear Council.
The Kennedy family owns the farmland and timber west of the County fan'n on both sides
of Melrose. This land has been in the family for over 130 years. Plan C for #965 would
diagonally cut it in two. It does not seem to us that Plan C is wise or necessary. Why not
utilize Hurt Road to Melrose and then east to Slotbower Road9
Any of the proposed plans affect us greatly, but Plan C is devastating. The decision the
various governments make about this will have an effect for years to come. As an
example, the DOT wanted to do and pay for a four lane highway to #218 when it was
being built. The Iowa City Council turned it down. That decision certainly had a financial
impact.
We urge the Council to consider any of the other plans. Thank you.

Re: 965 Alternatives
Dear Council:
I have followed with great interest tire debate that continues about where Highway 965
should go. Now wi:~ 'he addition of three more alternative routes to consider, I wonder
whether your searching for a compromise solution may have in thct created alternatives
that are worse than the originally proposed Eastern or Western routes. 1tow one could
consider any alternative that totally ignores the integrity of existing farm units or does not
utilize existing right of ways makes no sense.
Since you have found it advisable to continue looking tbr ahernatives for the original East
or West alignments, let me make another suggestion that 1 think should be seriously
considered. Rather than have 965 fly over 218, build an interchange from 965 to Highway
218. I know that 1DOT will not allow access so close to the present Melrose interchange,
and my suggestion would be to close the Melrose interchange and utilize a point further
West on Melrose or Deer Creek Road as access points to 218 By establishing a different
interchange with 965 you alleviate traffic congestion that will continue to mount at the
present location of the interchange with Deer Creek Road. and you u, ill also eliminate the
need for extending 965 further South to Highway I, since 218 will be tiTat access to
Highway 1,.____. -)
