WASHINGTON STREET TO FRIENDS OF HISTORIC
PRESERVATION, AND SETTING A PUBLIC HEARING ON SAID
CONVEYANCE FOR SEPTEMBER 14, 2004.
Comment: The City condemned the property located at 925 E
Washington Street as a public nuisance. The City has entered into a
contract for the sale of the property to Friends of Historic Preservation for
rehabilitation of the currently existing structure. The contract sale price is
$100,000.00. The contract is contingent upon formal approval by City
Council. The contract and accompanying documents submitted by
Friends of Historic Preservation are in the Council packet. This resolution
declares the City Council's intent to convey the above property to Friends
of Historic Preservation for rehabilitation of the currently existing structure,
and sets a public hearing on the proposed conveyance for September 14,
2004.

Comment: This project will repair the sanitary and storm sewer system
at seven sites located throughout Iowa City. The project will utilize
underground repair technology for the sewer repairs that require no
excavation.

Comment: This project will reconstruct North Dodge Street from the one

satisfied their obligation to the City of Iowa City in the total amount of

Promissory Note, by refinancing the property and paying the debt in full.
The family continues to own and occupy the home.

Comment: Iowa State Bank and Trust Company, Iowa City, Iowa has
requested that the City approve a Subordination Agreement for 733
Highland Avenue. On November 15, 2002, the owners of the property
received a loan from the City of Iowa City's Housing Rehabilitation
Program for $3,486. The property has enough equity to cover the City's
second lien position.

Comment: At its August 24 meeting by a vote of 5-0, the Planning and Zoning
Commission recommended approval subject to staff approval of construction
drawings, grading and erosion control plans and storm water storage
calculations. Staff recommended approval in a staff report dated August 24.
The amended plan will 1) approve building footprints, which differ from those
approved as part of the original PDH plan, 2) relocate the trail shown behind
buildings 12, 13, 14, and 6 on the original PDH plan, 3) revise the landscaping
plan to illustrate what has been already planted and to provide a plan for future
landscaping to be completed with the new buildings, 4) remove the off street
parking spaces from Pentire Circle and 5) document new and modified easement

At its June 17 meeting, by a vote of 5-1 (Brooks voting no, Anciaux absent), the
Planning and Zoning Commission recommended approval. Staff recommended
approval in a report dated June 3. Approval will allow for the development of
ten zero-lot dwellings on ten lots at the northern terminus of Jensen Street. The
rezoning to OPDH-8 and preliminary Planned Development Housing Plan was
approved at the Councils August 17 meeting.

MACKINAW VILLAGE, IOWA CITY, IOWA. (SUB04-00021)
At its July 15 meeting, by a vote of 6-0 (Chait absent), the Planning and Zoning
Commission recommended approval subject to a wetland delineation review by
the Army Corps of Engineers. Staff recommended approval in a report dated
July 1, subject to corrections of deficiencies on the plat. The plat deficiencies
have been corrected, and the Army Corps of Engineers has accepted the
wetland delineation on the property. Mackinaw Village Estates is a 75.25 acre
subdivision including two 16-unit multi-family buildings, 72 townhouse-style
dwellings, and 93 single family lots located north of Foster Road and east of the
Iowa River.

ITEM 6. AUTHORIZING EXECUTION OF A CONSERVATION EASEMENT AGREEMENT
FOR PRESERVATION OF THE ENGLERT CIVIC THEATER.
Comment: The City is selling the Englert theatre on contract to Englert Civic Theatre Inc.
for a total price of $700,000. Pursuant to the contract, Englert's final installment payment
in the amount of $100,000 is due in January of 2005. As a condition for receipt of
$365,000 financial assistance through the Iowa Department of Cultural Affairs, the State
is requiring that a 50 - year conservation easement be placed on the property to ensure
that its rehabilitation and maintenance are completed in accordance with the Secretary of
Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Buildings.
The State requires that the City execute the easement agreement so that the City will be
bound by its terms in the event the sale contract is forfeited and the City becomes the
owner of the property again. This resolution approves and authorizes execution of the
easement agreement.

ITEM 7. AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 2608
INDIGO COURT TO A SECTION 8 PROGRAM PARTICIPANT.
Comment: The Iowa City Housing Authority, under its Tenant-to-Ownership Program,
proposes to sell 2608 Indigo Court to a Section 8 program tenant. The amount of the
sale will be the appraised value of the home, which is $103,000. The family has
participated in the Section 8 program since 2000 and will purchase the property using
their Housing Choice Voucher to assist with mortgage payments to the lender. Due to a
Social Security lump sum payment received, the family will be making a down payment
of $24,000 and has received a written commitment for a mortgage from a local bank in
the amount of $79,000. No second mortgage will be necessary. This sale will provide
the opportunity for a low-income family to obtain ownership of their own home.

OF COST FOR THE CONSTRUCTION OF THE OAKLAND CEMETERY SEWER

Comment: This project will separate a combined sanitary and storm sewer system in
Oakland Cemetery. The project will consist of installing new sanitary sewer, and
making repairs to the existing storm sewer. The estimated construction cost is $64,000
and will be funded Wastewater Revenue funds.

ITEM 9. AUTHORIZING APPLICATION TO THE IOWA DEPARTMENT OF CULTURAL
AFFAIRS FOR CERTIFICATION OF THE IOWA CITY CULTURAL DISTRICT FOR
AT LEAST 10 YEARS.
Comment: Designation of a cultural district and its certification by the State recognizes
approximately one square mile of central Iowa City as a concentration of cultural
assets and enables a public-private partnership between the City and the Convention
Visitors Bureau to continue to foster cultural activities and establishments in the district
and market the district as such. Correspondence included in Council packet.

ITEM 10. CONSIDER AN ORDINANCE AMENDING THE CITY CODE TITLE 10, "PUBLIC
WAYS", CHAPTER 3, "COMMERCIAL USE OF SIDEWALKS", SECTION 3B-1, TO
PERMIT THE UNOBSTRUCTED 8 FOOT PEDESTRIAN WAY REQUIRED FOR
SIDEWALK CAFES TO BE IN ZONE 3 OF CITY PLAZA. (FIRST CONSIDERATION)
Comment: The present ordinance permits sidewalk cafes located in City Plaza in
Zones 1 and 2, reserving Zone 3 as an unobstructed open area for emergency access,
which is also used daily as the primary pedestrian way in City Plaza. The present
ordinance requires an 8 foot unobstructed pedestrian way within Zones 1 and 2
wherever a sidewalk cafe is permitted. The proposed amendment would permit the use
of Zone 3 for the purpose of establishing an 8 foot unobstructed pedestrian way for
permitted sidewalk cafes.

ITEM 11. CONSIDER A RESOLUTION RESCINDING RESOLUTION NO. 04-192 AND
04 ~ ~-4( AUTHORIZING THE APPLICATION FOR TRAFFIC SAFETY IMPROVEMENT
GRANT FUNDS FROM THE IOWA DEPARTMENT OF TRANSPORTATION FOR AN
INTERSECTION IMPROVEMENT PROJECT AT THE INTERSECTION OF GILBERT
STREET AND PRENTISS STREET AND BOWERY STREET.
Comment: The intersection of Gilbert Street and Prentiss St./Bowery St. has been
identified as a high collision intersection in Iowa City. This project will add left-turn
lanes on the north and south approaches on Gilbert Street. The Engineering Division
has revised the original estimated cost of the project to be $690,000. The Iowa DOT
has safety funds for which this project qualifies. The requested grant funds will be
increased from $420,000 to $500,000. That is the maximum available under this
program. The original resolution authorizing this application, 04-192, will be rescinded
and replaced with this one. If the grant is not awarded, the project will not be completed
at this time.
