They have requested four on-street parking spaces on Clinton Street near the Washington Street intersection be converted from 60-minute meter term to 30-minute meter term. The goal is to create additional turnover of parking at this location, and allow more persons to conduct short-term transactions in the area. This is a policy matter for the City Council. It is appropriate for these parking spaces to be used for short-term parking; staff does not have a strong opinion on whether they should be 30-minute or 60-minute meters. Several years ago there were many 30-minute on-street parking spaces in downtown Iowa City. A decision was made by the City Council at that time to convert them all to 60-minute meter term. You may wish to discuss this matter at your August 30 work session to determine if there is a majority of the City Council who wants to proceed. Washington St. City of Iowa City Iowa City, IA 52240 Dear Ernie: Several months ago we talked about the possibility of converting the metered parking along Clinton Street adjacent to the mall to 15-30 minute meters. Since our conversation, we have signed leases with Hills Bank and Gazette Communications. Both businesses have expressed that they too would like the meters along the mall shortened, and the Gazette's lease is in fact contingent on working through parking issues. Shortening the meters would allow customers of these businesses (as well as other stores on Clinton Street) to park closely if they are conducting quick transactions. The quicker turnover ofthe meters would allow more people to get in and out quickly. At this time, we would like to make a formal request that this change be submitted to the City Council for approval. NO There is absolutely no fair way to separate bars and restaurants. Then what about entertainment venues such as comedy shows and bands. All of a sudden a young adult would no longer be able to attend our comedy club. Good-bye comedy! We rely on our restaurant, entertainment and the bar to pay the bills at The Summit. f"~-=' c::::) - c::::'> Off-premises liquor sales sky-rocketed last year with the 19 ordinance. ~t ~ -n premises keg sales nearly doubled. Cf) :2:/' .. ? ~ Do you think Iowa City has too many liquor licenses? YES I know I'm being hypocritical here, but the market is way over saturated. Bars are opening and closing like clockwork downtown. You really have to be at the top of your game to survive. It has become a cut-throat market and a twenty-one ordinance will make it worse. The city really needs to reconsider some zoning laws for downtown Iowa City. What would you do to improve enforcement? First of all, enforcement has gotten out of control. One In six University of Iowa student leave Iowa City with a criminal record. That's a travesty! The police department writes hundreds of underage drinking tickets every year and they haven't stopped underage drinking yet. No surprise. They are not going to. When young adults come to the University of Iowa they already have preconceived notions on alcohol and have already started to use it. Most view themselves as adults and as adults they feel they have a right to drink alcohol regardless whether it is illegal for 19 & 20 year old adults or not. In other words, drinking is an adult thing to do and college students perceive themselves as adults. Most rational thinking people believe a 19 year old having a glass of wine with dinner to be a responsible drinker and most people would think two drinks while watching a comedy show is responsible. However, most rational thinking people would think drinking a twelve pack and getting into a car and driving to be very irresponsible. The actual problem starts somewhere in between. Our City Counsel has expressed that they consider the over consumption and abuse of alcohol the real problem... and they are right on! Why then hasn't the department concentrated their enforcement on alcohol abuse? The police claim they only write a public intoxication ticket if the perpetrator is doing something else. Why then can't they use the same standard with writing an underage ticket? After all, what is worse: a 20 year old with a drink in his/her hand, but otherwise behaving, or an intoxicated person at any age? Currently, most students wear an underage drinking ticket as a badge of honor. Other than a little whimpering when having the ticket issued they feel no remorse and there is no negative social stigma attached to getting an underage ticket. In Iowa City, it is accepted as normal. If officers were to write tickets for underage drinking only to the irresponsible acting drinkers, people that are also doing something else wrong, then the ticket would mean something. If you get an underage ticket then you would be the social outcast, not the norm. Nobody would want to explain the embarrassing circumstances behind their ticket! All of a sudden there is a negative social stigma attached to the ticket and we are fighting irresponsible drinking. . Another way to improve enforcement would be to write tickets equally. The police say they rarely will write an underage ticket at a house or apartment party. Why ignore the underage people drinking beer bongs from a keg? Irresponsible drinking... yes. Ticket... no. What was the underlying message here? The police say that they enforce laws stricter in a bar because we are licensed. I will use the same argument. We have a liquor license. We also have a food service license from the health department. We also meet building and fire codes. We also have yearly criminal background checks for our management. We also train our staff internally and with TIPS, the police department, and the RVAP (Rape Victim Advocacy Program). We also pay taxes. We also have adequate restroom facilities. We also clean our facility and the sidewalk in front. We also ID at the door and wristband accordingly. We also do not allow 18 yr olds or high school children in at night. We also monitor for illegal drugs. We also have insurance. We are also located in a commercial zone where noise is tolerable. We also close at 2:00 AM. You get the picture! ' ci0ì^"\ h~ì\l IOWA The owner's of Fitzpatrick's, The Union, and The Airliner ö'st t r'buslnesses while the server who committed the criminal act gets a $500 fine and is working the next day at another establishment without a care in the world. This needs to be chanqed immediatelv! The server should be at least prohibited from serving alcohol for a period of no less than six months and be fined a minimum of $5,000.00. This would make them not serve underage patrons. The threat of losing their job means nothing when a bartender knows that there are 30 other bars that they can go work at. The law is verv uniust. The other problem with enforcing civil penalties is that a criminal conviction of the bartender is not required at all to have a civil penalty imposed. In other words, a court of law could find that the bartender did not break the law or do anything wrong, but the State of Iowa will still impose a penalty. Essentially, the State relies on the word of an untrained 19 year old volunteer conducting a sting, but will not rely on the court system. Once aqain, this is very unjust. However, if the aforementioned inequities could be changed and if the police department fairly enforced the laws by checking all bars and restaurants equally, then this could be an effective tool. What would you do to balance the responsibility of individuals charged with violations? Once again, servers need much stricter penalties for serving underage patrons. Another thought here: The penalty for going 85 in a 65 m.p.h. speed zone is worse than 75 in a 65. The penalty for stealing a car is worse than stealing a sweater. The penalty for murder is worse than the penalty for manslaughter. Why is the penalty for underage drinking the same for a 20 year old adult and a 17 year old child? They are different offenses aren't they? Could a different structure benefit the bar owner, the server, the underage person and the community? First of all, there is such thing as event insurance which would have covered loses due to rain. Second of all, I don't see how the city can afford to pay these debts yet continuously threaten to shut down Friday Night Concert Series due to monetary concern. If the city uses its public event funding to pay for a past event such as Jazz Fest, would this not threaten future events which may have more public relevance? Most people I've talked to about Jazz Fest have mediocre feelings towards the event and tend to stay away. Personally, I say if it can't support itself, perhaps it should not be. (top) Pryor Street Reopens to Traffic After 5-month Construction Closure The City of Atlanta Department of Public Works reopened Pryor Street from Garnett Street to Memorial Drive last week. The streets had been closed since March 2004 for the construction of an under- street passageway between the new court facility and the City jail as a safety measure. "We are pleased to return this section of the road to public use," said Public Works Commissioner, David Scott. This summer the Organization of Black Airline Pilots (OBAP) along with Delta Air Lines sponsored ACE Camps for African Americans young adults aged 14 to 18. "Delta is investing in the community and it's evident by all of you present today," said Mayor Franklin. The ACE Camp is a one-week program that introduces curious boys and girls to the "world of aviation" by exposing them to careers and opportunities in the industry. Because of this program aspiring young aviators get a chance to experience an orientation flight, build model rockets and airplanes and meet aviation professionals. I (top) The Atlanta Police Department Is Recognized for Winning Campaigns The International Association of Chiefs of Police (IACP) and the Georgia Governor's Office of Highway Safety (GOHS) recently recognized the Atlanta Police Department (APD) during an awards luncheon at the Georgia International Convention Center. APD was recognized for its effective campaigns targeting traffic enforcement, safety and the reduction of accident related deaths and injuries. Since 2003, when APD launched it's public safety campaigns, there has been a 7.5 percent decrease in traffic fatalities and total accidents were reduced by 5.73 percent. Over 600 child safety seats, 5,000 pamphlets promoting traffic safety and 10,000 seat belt citations have been distribute through these programs. So far, do to our great president, his domestic policies and jolJy little war, my SS payment has yet to rise because of increased Medicare deductions. We moved here from Chicago, because the gentrification of our hood, raised the taxes so high, that the amenities of that city were no longer worth the price. This after a lifetime in my hometown. Also because of the increased and unbearable traffic, we got the helJ out. The funds are to come from operation funds, not from the large gift fund. This matter was not on the agenda. How could the public know in advance that the management intended to address this matter? I hope you will not approve this decision by the staff and the 4 commission members. There are more urgent needs at the Senior Center than to have a Grand Piano. For example, seniors cannot use the old Mac computers in the computer room for e-mail. This matter deserves attention. A Grand piano would be a nice luxury but it could be sought by some alternative fund raising conducted by those who see it as a priority. Four unelected people should not be given the authority to spend that much of tax money without very serious oversight. Now, I'll be the first to admit that my ideas are totally random, not due to any research I've done, and certainly not backed up by evidence or statistics. Until now, you have wisely expressed a desire to remain impartial until after the citizens have had an opportunity to vote in November, 2005, on the question of authorizing you to proceed with establishing a municipal electric utility. Should you decide to enter into negotiations with MidAmerican Energy before this election, your appearance of impartiality would be in question. Should such negotiations result in a document approved by you, it would appear that you are supporting MidAmerican's position. As you know, a feasibility study has shown that a municipal electric utility would save the City between $2.5 and $3.4 million per year over a 25 year period. And, as you also know, residential ratepayers in Iowa City pay at least 30% more per month than the average of municipal utilities in Iowa. For small businesses the commercial rate for MidAmerican Energy is at least 40% more per month. City Council members do not have legal standing to negotiate rates. Therefore, a franchise agreement with MidAmerican, as your consultant testified before you, would be of little value to ratepayers in Iowa City. The City Council has a responsibility to represent the best interests of the ratepayers and the taxpayers ofIowa City. We strongly believe that this can only be done by a further, detailed, objective and impartial consideration ofthe potential benefits and costs of a municipal electric system. Such a study can only be made after a successful authorizing referendum. The City Council and staff will then have an opportunity to develop a municipal electric utility business plan that should be compared with any franchise proposal from MidAmerican Energy. Until such a time, we urge you to maintain your impartiality on the ballot issues by refraining from entering into franchise negotiations with MidAmerican Energy. We support the creation of this district - we feel district designation is beneficial to our neighborhood and creates new opportunities for aesthetic, social, and cultural development. However, and this is a bit! however, we feel it is unnecessary and unsound to include commercially zoned property into the proposed district. The City ofIowa City, as a whole, has already acknowledged through its zoning process that these properties an. maintained and used under different conditions than residential properties. We feel that the long term success of district designation will come from the residential community of Gilbert-Linn. Homeowners and property owners alike in the new district may come to enjoy new respect and pride for their neighborhood as it evolves after designation. Commercially zoned properties, however, must continue to operate as businesses without as much regard for sentiment or attitude. We believe that district designation was originally intended to strengthen our neighborhood. The dogs that are "on-leash" tend to walk along side their owners and seldom is there a dog on-leash that lunges out at passers-by. . " . The worst I've seen was a few weeks ago when I came upon a dog hassling a family with three small children, two on foot and one in a baby carriage. The mother had the most anxious look asking if it was my dog. . .it was not. This while the father tried vainly to drive the dog away. Together we were driving the dog off when the owner finally approached from the other direction with a "is anything wrong" comment. Last night pretty much brought me to wits end. Of the four groups of dogs I encountered, three were off-leash. Two were singles while one group was a small pack of four dogs along with their four owners. All of these encounters brought dogs out charging at me, circling around, while one of the singles (a very small dog I admit) actually nipped at my ankles. On many occasions I have asked owners if they would please keep their dogs on the leash (that they almost always are have with them.) This usually results in some flip remark about this being the "unofficial dog park," or the dog "isn't bothering anyone." The dog has just acted in the fashion mentioned above; THE DOG HAS BOTHERED SOMEONE. But it seems that this isn't of concern to anyone, especially not the pet owners. During my months in the park I have yet to see any enforcement of the posted regulations, especially in the evenings or the weekends. I fear that with the rate of interaction between loose dogs and casual passers-by, especially with the increased access to the park, someone will get hurt. The plan to address the problem is to do a news release for the media (Done) advising the public that tickets will be issued for violations in Hickory Hill Park. Animal Control personnel have been provided with overtime funds to address the issue at times that they are not normally on duty. Officers will be assigned to Bike Patrol in the park and will partner with Animal Control folks in the enforcement efforts. This is being done. After the initial efforts both animal control and bike officers will return to the park at unannounced times to continue the enforcement efforts.
