RECOMMENDATIONS TO COUNCIL:
Recommended approval, by a vote of 6-0, of ANN96-0002, a City-initiated application to annex
and rezone approximately 5 acres west of Dubuque Street from County RS, Suburban Residen-
tial, to P, Public.
Recommended approval, by a vote of 6-0, of SUB96-0016, an application for final plat approval
of Village Green, Part XIV, a 40.19 one lot residential subdivision located north of Village Road
east of Oxford Place, subject to the approval of legal papers and construction plans prior to
Council consideration.
Recommended approval, by a vote of 6-0, of SUB96-0017, an application for final plat approval
of Woodland Ridge, Part One, a 55.95 acre, 19 lot residential subdivision located east of Dane
Road at its intersection with Osage Street, subject to the approval of legal papers, construction
drawings, and as-built drawings prior to Council consideration.
Recommended approval, by a vote of 6-0, of an amendment to the Sensitive Areas Ordinance
revising the definition of 'construction area."
Recommended approval, by a vote of 6-0, of an amendment to the Sensitive Areas Ordinance
adding the definition of 'slopes, regulated."
Recommended approval, by a vote of 5-1, with Scott voting in the negative, of an amendment
to the Sensitive Areas Ordinance revising the Steep Slopes Section.
RecomnYended approval, by a vote of 6-0, of an amendment to the Sensitive Areas Ordinance
changing the .wording of subsection 14-6K-IN3.
CALL TO ORDER:
The meeting was called to order at 7:35 p.m.
ANNOUNCEMENT OF VACANCIES ON CITY BOARDS AND COMMISSIONS:
Starr said there was a vacancy to fill an unexpired term on the Housing and Community Develop-
ment Commission ending on September 1, 1997. He said there were also two full terms on the
Housing and Community Development Commission ending on September 1, 1999. Starr said a
decision would be made at the August 27, 1996 meeting of the City Council.

ANN96-0002/REZ96-0016. Public discussion of a City-initiated application to annex and
fezone approximately 5 acres located west of Dubuque Street, south of the Iowa River.

Miklo said staff recommended approval of the annexation and rezoning.

MOTION: Gibson moved and Supple seconded the motion to approve ANN96-
0002, a City-initiated application to annex and rezone approximately S acres west
of Dubuque Street from County RS, Suburban Residential, to P, Public.
Discussion.
Scott wanted to note that his employer owns property across the river. He said he felt
the situation did not entail a conflict of interests.
The motion was carded on a vote of 6-0.
DEVELOPMENT ITEMS:
SUB96-0016. Public discussion of an application submitted by Village Partners for final
plat approval of Village Green, Part XIV. a 40.19 one-lot residential subdivision located
north of Village Road east of Oxford Place. (45-day limitation period: August 23, 1996)
Miklo said a revised plat, which addressed all deficiencies, had bean submitted. He said
the plat now showed an approximate one-third acre outlot earmarked for public open
space. He said the Parks and Recreation Commission recommended acceptance of the
open space and that the remainder of the open space requirement be paid in fees in
lieu of land.
Bovbjerg asked if Outlot B was the one set aside for parkland. Miklo said it was. She
asked if the land was for a trail. Miklo said it was.

plat approval of Woodland Ridge, Part One, a 55.95 acre, 19 lot residential subdivision
located east of Dane Road at its intersection with Osage Street. (45-day limitation

Miklo said that staff recommended approval subject to the approval of legal papers,
construction drawings, and as-built drawings prior to City Council consideration of the
plat.

MOTION: Gibson moved and Bovbjerg seconded the motion to approve SUB96-
0017, an application for final plat approval of Woodland Ridge, Part One, a 55.95

ZONING CHAPTER TEXT AMENDMENT ITEM:
Public discussion of Council revisions to proposed Sensitive Areas Ordinance amend-
ments.
Miklo said most of the amendments were minor and self-explanatory. He noted that the
amendments sent to Council for the steep slopes section would institute administrative
review for properties with critical slopes. He said the Council favored a revision that
would require a rezoning ff the development encroached on a critical slope.
Gibson asked if protected slopes would gain more protection. Miklo said those slopes
are over 40%. and steep slopes had a grade of 25 to 40%. He said the level of protec-
tion for protected slopes was unchanged. Scott asked if the proposed change therefore
dealt only with critical slopes. Miklo said it did.
Starr asked if the original draft called for a rezoning for properties containing critical
slopes. Miklo said the version currently in place required a rezoning if development
occurred within £~ty feet of a cdtical slope. Bovbjerg said the amendment would allow
better case-by-case review. She said staff could still recommend rezoning if they felt
it was necessary. Scott suggested putting each amendment to a vote.
MOTION: Bovbjerg moved and Gibson seconded the motion to approve an ame-
ndment to the Sensitive Areas Ordinance revising the definition of "construction
area". The motion was carried by a vote of 6-0.

MOTION: Bovbjerg moved and Supple seconded the motion to approve an amend-
ment to the Sensitive Areas Ordinance adding a definition of "slopes, regulated".
The motion was carried bY a vote of 6-0.
MOTION: Supple moved and Bovbjerg seconded the motion to approve an amend-
ment to the Sensitive Areas Ordinance revising the steep slopes section.
Discussion.
Gibson asked if the Commission's recommended revision had removed any rezoning
requirement. Miklo said it had. He said the Council revision only required rezoning if
development encroached on the slope.
Supple asked if 'into' was interchangeable with "onto*. Holecek said it would be inter-
preted in that fashion.
Scott said he intended to vote in the negative, as he felt the protection in the Commis-
sion's version was sufficient. Starr asked if a Sensitive Areas site plan would still be
required. Miklo said it would. Starr asked if staff could waive that requirement. Miklo said
they could not. Bovbjerg asked if the Board of Adjustment could issue an exemption.
Miklo said the Board could exempt an applicant from rezoning, but not from submitting
a Sensitive Areas site plan.
The motion carried on a vote of 5-1, with Scott votina in the negative.
MOTION: Supple moved and Chait seconded the motion to approve an amend-
ment to the Sensitive Areas Ordinance revising the wording in subsection 14-6K-
1N3. The motion was carried by a vote of 6-0,
OTHER BUSINESS;
Starr noted that the Commission had chosen to cancel its September 5 meeting.
PLANNING AND ZONING COMMISSION INFORMATION:
Scott noted that the City Council had decided to revise the truck terminal amendment to limit
trailer storage to 45 days rather than 90 days.
ADJOURNMENT:
MOTION: Bovbjerg moved and Gibson seconded the motion to adjourn the meeting at
8:15 p.m. The motion was carried on a vote of 6-0.
